Winnick FEBRUARY, 2014 PRESIDENT’S MESSAGE I am both humbled and honored to serve as the next President of the DCBA. I follow a long line of distinguished attorneys to have served. With this being my initial letter I thought I would tell you a little about me and why I’m involved and perhaps in the process, convince you that it is in your best interests to be involved in the DCBA. On a personal side I am the oldest male of the thirteen children born to my parents (if you haven’t already guessed, yes I am Catholic). I grew up in Philadelphia but have lived in Central Pennsylvania all of my adult life. I graduated from Penn State and Drexel Universities and obtained my law degree from Widener School of Law in Harrisburg. The practice of law is actually my second career. I began my first career with one of the Big Eight (now we refer to them as “the final four”) accounting firms. One of my initial supervisors told me that if you want to be successful in this business, you need to be involved in your professional organizations and your community. To this day, I think that is some of the best advice I have ever received. As a CPA, I did become involved both in my profession as well as my community, so much so that I felt confident to leave the large accounting firm and start the accounting firm of Sheridan & Fritz. As this firm grew over the years I began to develop relationships with many of the attorneys in this community. It was during this time that I decided to broaden my horizons by obtaining a law degree. Even though Widener made it obtainable by having evening classes, I don’t miss going to class at nine in the evening. In order to practice law I had to phase out of the accounting profession. Paramount as to how I would accomplish that was the welfare of my employees and clients. The firm merged with another accounting firm and is now known as Brown Schultz Sheridan & Fritz. That merger allowed me to join Serratelli Schiffman & Brown to practice law. Well here I was, in midlife, starting a new career. More than once I asked myself, how can I build a law practice as successful as my accounting practice? Then the advice of my initial supervisor played over in my head: “get involved in your professional organizations and your community.” The DCBA was the perfect organization to do that. I approached Don Morgan who helped me get on the Board and also encouraged me to become the Treasurer of the organization, probably because few of my brethren could read a financial statement. So, as my first order of business I want to say thank you to the DCBA for providing me with the opportunity to be involved and to network with some of the finest attorneys ever. My second order of business is to do everything I can to make sure you get the most out of your membership. A lot of great things are happening behind the scenes to make this happen. Liz, along with some of our members, has been working diligently on a new and exciting web site. We envision this site will become a tremendous tool for the association and its members. We had hoped to roll this out by the annual meeting but as we learned from the Obama Care web site, roll it out when it’s ready! More to come in future issues. I have ordered somewhat permanent name badges for all of our current board members and have encouraged them to wear them at as many functions as possible. The idea is that you get to know who these members are and I encourage you to approach them with your thoughts, suggestions and criticisms, where appropriate. For those members that have had little or no involvement with the DCBA, I encourage you to “GET INVOLVED, GET THE MOST FOR YOUR MONEY!” FEBRUARY 2014 JUDGE CLARK RETIREMENT RECEPTION PAGE 2 FEBRUARY 2014 JUDGE CLARK RETIREMENT RECEPTION CONTINUED PAGE 3 FEBRUARY 2014 PAGE 4 DCBA ANNUAL AWARDS Several weeks ago at the 2014 DCBA Annual Membership Meeting, awards were presented to some very deserving members. Each year the Bar presents the Honorable Clarence Morrison Award and the Pro Bono Award to members of our bar who have done exemplary work in certain areas. The recipients for 2013 were Nathaniel Holmes and The Association of Corporate Counsel Central. Nate participates in pro bono through our Custody Mentorship Program which allows attorneys who are not family law practitioners to take their first custody conference case with an experienced custody attorney. As many of you know, MidPenn Legal Services is often looking for pro bono attorneys to assist low-income clients with custody issues. Unfortunately, many attorneys are reluctant to take these custody cases. In particular, attorneys who do not normally practice family law are understandably uncomfortable and ethically restricted from taking a case in an unfamiliar area of law. Thus, we created the Mentorship Program to better address this need. After watching a brief video, a lawyer who does not normally practice family law (the “Mentee”) takes their first custody conference case with an experienced custody attorney (the “Mentor”). The Mentor participates in the initial interview and the custody conference with the Mentee. The Mentor is also available for advice and guidance in future custody cases. Nathaniel Holmes, Winner DCBA Pro Bono Attorney of the Year Nate took his first custody case in December 2009 with Mark Silliker. Since then, Nate has independently assisted 14 more low-income parents with custody matters. Without, Nate and the other Custody Mentors, these 14 parents would have nowhere to turn for legal help. Lisa Katterman accepted the Pro Bono Award on behalf of the Association of Corporate Counsel, Central PA Chapter. The DCBA Equal Professional Opportunity Committee announces its 2014 Award, recognizing significant contribution to the advancement of equal professional opportunity in the local bar and community. This Award recognizes sustained and exceptional effort in advancing diversity in the law and in our legal community and ACC has been committed to this effort for a number of years. In 2003, the chapter partnered with Street Law Inc., began supporting the PBA Mock Trial Program in 2004, in 2005 established a partnership with the Keystone Bar Association and in 2006 held their first Pathways to Success fundraiser. The goal in their efforts has been to build and strengthen the inclusion pipeline for law-related careers for minority students in our community. It is vital that these pipelines be created in most professions, not just the law, in order to encourage young people to pursue careers that will benefit the community at large. Lisa Katterman accepted the 2013 Calrence Morrison Award on behalf of the ACC. ACC has been a strong partner with the DCBA and EPOC Committee in the CAMP 1L Summer Intern Program for over eight years. As part of that effort, each summer ACC has hosted the students at one of their member offices for a presentation in the professional development component on the work of corporate counsel. Last year this was combined with a scholarship presentation to high school students as part of its Pathways to Success Scholarship project. The Pathways scholarship is presented annually to minority students who aspire to the legal profession in the Central PA area. Our committee salutes ACC of Central PA for its strong and demonstrated commitment to diversity. We recognize and congratulate that commitment in awarding the chapter the Honorable Clarence C. FEBRUARY 2014 PAGE 13 NEW CODE OF JUDICIAL CONDUCT STRENGTHENS AND CLARIFIES RULES FOR JUDICIAL BEHAVIOR NEPOTISM AND SERVICE ON COMMERCIAL BOARDS ADDRESSED HARRISBURG — The Supreme Court of Pennsylvania has approved a new Code of Judicial Conduct. Among notable changes from the prior code is the adoption of provisions dealing with nepotism and service on commercial boards, including the issues of recusal and disqualification. It goes into effect on July 1, 2014. “For courts in western democracies to effectively render independent and impartial decisions, the public’s confidence in the integrity of the judicial system and its judges is essential,” Chief Justice Ronald D. Castille said. “The Code of Judicial Conduct is designed to foster that confidence by assisting judges in their adherence to the highest judicial and personal conduct standards. It also establishes a basis for disciplinary agencies to regulate judges’ conduct.” The new code in both style and content is based upon the model code promulgated by the American Bar Association in 2007, but it also reflects the experience of Pennsylvania and the provisions that best apply to the state judiciary. It updates the version that was initially adopted by the court in 1973. As the code’s preamble notes, the code is not intended to specifically address every aspect of conduct, but its precepts are to be applied in concert with constitutional requirements, statutes, other court rules, and decisional law, and with due regard for relevant circumstances. The updated code includes an anti-nepotism provision (Rule 2.13), which states that in making administrative appointments and hiring decisions a judge shall be impartial, base hiring on merit and avoid nepotism, favoritism and unnecessary appointments. Another major change in the code says that service on commercial boards is now prohibited and all judges who hold such positions have until July 1, 2015, to resign from those seats (Rule 3.11). Prior limitations on personal financial activities remain in force to avoid conflicts of interest and disqualifications from judicial matters, but the new code allows judges to place personal investments into a blind trust rather than relinquishing those investments. The new code also contains provisions dealing with bias, prejudice and harassment (Rule 2.3) and a ban on judges holding membership in any organization that practices invidious discrimination. (Rule 3.6) In 2011, the Supreme Court of Pennsylvania established a work group, chaired by Superior Court Judge Anne E. Lazarus, to recommend proposed revisions to the Pennsylvania Code of Judicial Conduct. The work group, which included judges, lawyers and academicians, reviewed the 2007 American Bar Association Model Code of Judicial Conduct and codes from other states in making its recommendations. The new code adopted today reflects the work of that committee. Others collaborating with the work group on the proposed revisions were the Pennsylvania Bar Association under the leadership of Bar President Forest N. Myers and the Philadelphia Bar Association under the leadership of Chancellor Kathleen Wilkinson. In addition to the code update, the Supreme Court also shifted two issues contained in the Code of Conduct and incorporated them in the Rules of Judicial Administration, deciding that they were more appropriately included in administrative rules, rather than ethical conduct rules. The first is Rule of Judicial Administration No. 1910, which governs broadcasting from courtrooms. There is no substantive change in that rule.
