Welcome to the first edition of Ziwaphi on the Road for 2015!
Ziwaphi on the Road is a newspaper designed for employee members of
the NBCRFLI. Through this newspaper, we at the NBCRFLI continue to
provide you with valuable information about our services, entertainment
news, competitions and more.
In this edition of Ziwaphi, we provide you with detailed information about
our new Health Plan service provider, Affinity Health, who took over from
Universal in January 2015. We also give you information about all the latest
Council News including the appointment of our New National Secretary,
Musa Ndlovu, who joined in September 2014. Batho also deals with your
queries in “Ask Batho”.
In the “Know your team” section, we look at the 2013/2014 PSL champions
Mamelodi Sundowns. And who can forget the 26th of October 2014, when
we all learned of Senzo Meyiwa’s tragic passing? The Orlando Pirates and
South Africa captain made a huge contribution to football in Africa. We pay
tribute to him in the Celebrity Spotlight section.

COMPETITION RULES & WINNER SELECTION

24 SEPTEMBER 1987 - 26 OCTOBER 2014
Senzo Robert Meyiwa (24 September 1987 – 26 October 2014) was a South African soccer player who
played as a goalkeeper for Orlando Pirates FC and for the South African national team. Senzo made his
PSL debut on 8 November 2006 in a 2-1 victory against Amazulu. He then went on to make his debut for
South Africa on 2 June 2013 in a 2–0 away victory against Lesotho.

Senzo was no ordinary player. He was the captain of the national team, captain of Orlando Pirates. Senzo joined Pirates when he was just 13-years-old, and
we are proud to say that Senzo put us on the map when we qualified for the Champions League final. He was part of the team that won the treble back to
back, he was in the last five finals, and we can say that he always tried his best.

Senzo was beyond a player. He was a leader, a peacemaker in the camp. The good thing about Senzo when sitting face-to-face with him was his sparkling
eyes and smile. He never stopped smiling. One day, I asked him, ‘I don’t know whether you are trying to fool me or what, you always smile.’ His answer:
‘Nginjalo Mqeqeshi, anginasikhathi sokukwata ngoba akungenzeli lutho (I don’t have time to be angry because it doesn’t help me).’

It is a national tragedy because you know Senzo has contributed so much, not only to Orlando Pirates. You will remember when he went to the Champions
League, he was outstanding in his performances. We are just saddened by his departure because his career was just blossoming and he was in the prime of it.

The nation had their hopes on him following brilliant displays in the Bafana Bafana jersey, especially in the recent
AFCON matches where he kept a clean sheet in all four games. We will surely miss him.

TRUCKING WELLNESS
The NBCRFLI Wellness Fund Health Plan protects the well-being of employees
within the Road Freight and Logistics Industry, and is available to all active
NBCRFLI members who are contributing to the Wellness Fund and meet the
stipulated eligibility criteria.
Trucking Wellness is a value-add health service offered by Council to
members of the Industry as well as those in surrounding communities
including sex workers. Over the years it has changed into providing a
holistic approach to health and wellness which encompasses a wide range
of free primary health care services, including:
Following the appointment of a new service provider, Affinity Health, on 1
January 2015, eligible Health Plan members are entitled to the following
improved benefits and health services:
GP CONSULTATIONS, per eligible members and spouses, are unlimited with
pre-authorisation required after the sixth consultation. For assistance to find
your network GP before your 1st consultation, call Affinity Health on 0861 00 11
31. You can also send a “please call me” to 079 409 1834 and Affinity Health
will call you back.
RADIOLOGY AND PATHOLOGY are linked to GP consultations as you must
be referred by a doctor for this benefit. Only approved x-rays and blood tests,
as per the formulary, will be covered for eligible members and spouses.
ACUTE MEDICATION is limited, per eligible member and spouses, to a
maximum of R1 000 for every 12 months. Only medication approved by Affinity
Health, and according to formulary reference pricing, will be covered. Please
call Affinity Health Customer Care at 0861 00 11 31 so we may direct you to the
nearest pharmacy.
CHRONIC MEDICATION is subject to formulary reference pricing per eligible
member and spouse, as approved by Affinity Health. You must be registered
as a Chronic member in order to obtain this benefit. To confirm if your chronic
condition is covered, you can contact the Affinity Health Customer Care line.
• Condom distribution.
• STI diagnosing, treatment and education.
• HIV awareness, information, education, counselling and testing.
•Referrals to appropriate service providers for ART as well as HIV and AIDS
treatment and care.
•TB awareness, information, education, screening and referrals for treatment
and care.

Malaria awareness, information, education, screening and referrals for
treatment and care.
•Screening tests for blood pressure, blood sugar, cholesterol and body mass
index.
•Diagnosis, treatment, care and support of any primary care health problem
or concern.
These services are offered through a blend of 5 mobile Wellness Clinics and
22 fixed Wellness Centres staffed by registered nurses and counsellors and
situated on all major trucking routes. The clinics are funded by the NBCRFLI
and supported by donor organisations, industry partners, local government,
relevant health departments and a portion of the monthly wellness contribution
made by members.
CHRONIC DISEASE MANAGEMENT is available for members that are
registered for Chronic medication. Through support, we hope to assist you in
bringing your condition under control so that you can live a normal life.
DENTISTRY is covered up to a maximum of R500 per insured incident and
a maximum of R1 500 for every 24 months, per eligible member and eligible
spouse. In the event of injury requiring dental treatment, there is a limit of R1
500 per insured incident and R3 000 for every 24 months.
OPTOMETRY is only available through a Specsavers outlet. A basic pair of
frames and clear plastic single vision or bifocal lenses are available every 24
months, per eligible member and eligible spouse.
EMERGENCY SERVICES are available by phoning the number provided on
the membership card. If another service provider is used, costs may not be
covered if deemed non-emergent. This benefit includes repatriation of mortal
remains if death occurs away from normal place of residence, per eligible
member, eligible spouse and eligible children.
HOSPITAL ILLNESS BENEFIT will ensure that you receive some income while
you are in hospital. After the first 24 hours you will receive R500, for the second
day you will receive R400 and thereafter, up to a maximum of 21 days, you will
receive R250. If you are in ICU or High Care, a benefit equal to R1 000 per day
will apply. You do need to notify the pre-authorisation department when you are
admitted; per eligible member only.
ACCIDENTAL INJURY BENEFIT (casualty rooms) is for injuries sustained as
a result of an accident and is applicable only to eligible members. It is limited
to treatment received in a hospital emergency unit and limited to R12 000
per incident. Please phone the pre-authorisation number for a Guarantee of
Payment.
HOSPITAL INDEMNITY BENEFIT is for actual costs of hospitalisation, if
admitted due to an accident, up to the maximum amount of R75 000 per incident.
Please phone the pre-authorisation number for a Guarantee of Payment, per
eligible member, eligible spouse and eligible children.
FUNERAL ASSISTANCE BENEFIT of R10 000 is payable in the event of the
death of the eligible member. This benefit shall be limited to the eligible member
only, and excludes the eligible spouse.

HEALTH PLAN SERVICE PROVIDER
IMPORTANCE OF GIVING YOUR
COMPANY YOUR UPDATED BANKING DETAILS
We are pleased to announce the appointment of a new service provider, Affinity
Health, for our Wellness Fund Health Plan. This appointment, which came into
effect on 1 January 2015, means that all eligible NBCRFLI employee members
will receive even better benefits and health services.
In order for you to get your year-end payouts paid on time, it is important that
you give your employer your correct banking details. If you change your bank
account to another bank, you also need to give them your new account number.
All eligible Health Plan members have been issued with new Health Plan
cards, which have been sent to employers for distribution to their employees in
December 2014 and January 2015. Contact your HR department if you have
not yet received your Health Plan card or call Affinity Health on 0861 00 11 31.
They can also send a “please call me” to: 079 409 1834.
If you are a foreign employee you need to make sure your employer has a copy
of your valid passport and a letter (no older than 6 months) from your bank
confirming account holder details (member surname, initials, passport number,
account number, branch code) and bank stamp. The NBCRFLI does not make
payments to foreign bank accounts, so make sure you have a South African
bank account.
Please remember to keep your Health Plan card in your wallet or purse so that
it is readily available, should you need it.

The Council works to ensure that the provisions of the Council’s Agreements
are upheld by all stakeholders in the Road Freight and Logistics Industry. The
designated agents play a vital role in the achievement of this goal.
APPOINTMENT OF THE NEW
NBCRFLI NATIONAL SECRETARY
The NBCRFLI Board appointed a new National Secretary, Mr Musa Ndlovu,
to head the National Bargaining Council for the Road Freight and Logistics
Industry (NBCRFLI) in September 2014. We welcome Mr Ndlovu on board
and have every confidence that he will continue to lead the Council to new
heights.
INCREASES IN MINIMUM WAGES, ACROSS THE BOARD
INCREASES AND ALLOWANCES DUE ON 1 MARCH 2015
If you are an employee for whom minimum wages are prescribed and were
employed by a company before 1 September 2014, you should have been
awarded an increase of 0.25% on actual basic wage as from 1 September
2014.
The 2015 ATB increases are effective as from 1 March 2015. All employees for
whom minimum wages are prescribed and who were employed in the Industry
prior to 1 March 2015 must be awarded a 9% increase based on actual basic
salary as from 1 March 2015.
All EBU employees must be awarded ATB increases based on actual basic
salary as from 1 March 2015, as set out in the schedule hereunder:

The Gauteng Region Call Centre number, which was launched in May 2014, is
yet another way in which you can communicate with us directly at the NBCRFLI
and receive help quickly. Our dedicated Call Centre staff will make sure that
your queries and concerns in the Gauteng region are attended to as quickly as

What are designated agents?
Designated agents are appointed by the Minister of Labour at the request of
a bargaining council to promote, monitor and enforce compliance with any
Collective Agreement concluded in that bargaining council. On a more detailed
level, the role of the agent includes:
•
Promoting, monitoring and enforcing compliance with the Collective
Agreements.
•Educational inspections of employers in the industry with the objective of
assisting stakeholders to move towards voluntary compliance.
• Interpretation and explanation of the provisions of Collective Agreements.
• Registration of unregistered employers.
• Investigation of complaints and enquiries.
•Effectively and successfully conclude enforcement, conciliation and arbitration
matters.
• General administration of Council matters.
Thus the designated agents play an important part in protecting the rights of the
members of the Industry.

In a move to keep up with communication trends, the NBCRFLI launched its first
ever user-friendly mobi app a year ago. The mobi app is aimed at strengthening

level of service that the NBCRFLI strives to offer. The highly user-friendly app
has similar information to the NBCRFLI website, which means users have
access to Council-related information at any time.

Crime negatively impacts on the profits, salaries and infrastructure of the
road freight and logistics industry. As members of this industry, we need to
work together to prevent this crime, which includes unlawful, dishonest and
unethical behaviour such as fraud and non-compliance.

BE HEARD HELPS TACKLE MAJOR FRAUD ALLEGATION
AGAINST COMPANY IN KZN
To ensure the protection of whistle-blowers, the NBCRFLI has implemented an
outsourced disclosure service. The objective of the hotline is to create an avenue
for all our stakeholders to report their suspicions of fraud, theft, corruption and
anything that they feel uncomfortable about to the Council anonymously. The
information received from the “Be Heard” disclosure service is used as a basis
for investigation into illegal activity.
In July 2014, the Council received information through its “Be Heard” line about
an employer who was initially registered in 2005 as a normal employer with
four employees. However, around 2007 the company status was changed to
“owner driver” and this resulted in the discontinuation of Council levies and
contributions. The following additional information on the same employer was
also provided via the disclosure service:
• The company employs between 25 to 30 drivers – all foreign nationals.
• It operates approximately 18 trucks.
• The company used one registration number on two of its trucks.
•It planned to move from its current address in an attempt to hide from the
Council.
After conducting numerous site visits and meeting with representatives from
the organisation, designated agents from the Council’s KZN region issued and
faxed a subpoena to the company to appear on 21 August 2014. The matter
relating to the fraudulent car registration was reported by Council through our
independent forensic investigators to the Road Traffic Management Corporation
who conducted a raid at the premises. A criminal case has now been opened
against the owner, who was arrested on 18 September 2014.
AMENDMENT TO THE MAIN COLLECTIVE AGREEMENT:
MEMBERSHIP TO PROVIDENT FUND
EXPLAINING SICK AND ABSENT FUND:
MEDICAL CERTIFICATES
The Minister of Labour approved an amendment to the Main Collective
Agreement, in terms of members to the Provident Fund, which was published
in the Government Gazette on 5 September 2014, and came into effect on 15
September 2014. This amendment makes it compulsory for all employees, for
whom minimum wages are prescribed in the Industry, to belong to a registered
provident or pension fund.
According to clause 19 (9) of Council’s Main Collective Agreement, when
you take occasional sick leave, you need to provide your employer with a
medical certificate. This certificate needs to be issued and signed by a medical
practitioner or any person who is certified to diagnose and treat patients, and
who is registered with a professional council established by an Act of Parliament.
Please also note that the non-payment of provident/pension fund contributions
deducted by employers is considered a criminal offence in terms of the Financial
Services Laws Amendment Act, 45 of 2013.
The Interim Traditional Health Practitioners Council of SA came into effect
on 1 May 2014. This means that as an employee you may consult registered
traditional healers if you are sick and may provide the company you work for
with medical certificates issued by such traditional healers. Your employers
may contact the Interim Traditional Health Practitioners Council of SA to verify
the authenticity of medical certificates issued by traditional healers.
In these tough economic times, many companies are suffering financially, which sometimes
results in retrenchments. But, as a truck driver, you can help your company just by avoiding
excessive idling.
Did you know that there are two main factors which lead to excessive idling in heavy vehicles?
These include:
1. Warming an engine in the morning for more than the maximum recommended idling time
specified by the manufacturer.
2.Excessive idling in general, such as powering the air-conditioner or heater for extended periods.
Excessive idling results in massive monetary losses for your company. Apart from the wear on
parts, the cost of idling an average diesel truck is approximately 5 litres per hour, or R1.02 per
idling minute (AA Diesel price September 2014)!

Ebola
WHAT IS EBOLA?
WHERE IN THE WORLD CAN YOU GET EBOLA?
Ebola is a serious illness that is caused by a virus.
•More than half of the people who become sick with Ebola will die from the
disease.
•There is no vaccine (injection that prevents the illness) or cure available for
Ebola.
•Ebola is still very rare and until recently only occurred in some central and
western African countries.
•The Ebola outbreak in 2014 has killed many people in Guinea, Sierra
Leone, Liberia and Nigeria.
•During 2014, another outbreak of Ebola was reported from the Democratic
Republic of Congo (DRC).
•Ebola first occurred in the DRC and Sudan in 1976.
•It has occurred in countries like Uganda, Gabon and the Democratic
Republic of Congo.
•The Ebola case in Johannesburg, South Africa occurred in 1996. The
person affected was a nurse that cared for a patient that had Ebola.
WHAT ARE THE SYMPTOMS OF EBOLA?
•Fever
• Severe headache
• Muscle pain
•Weakness
•Diarrhea
• Vomiting
• Stomach pain
• Unexplained bleeding or bruising
•Cough
• Lack of appetite
HOW DO I GET EBOLA?
People become sick with Ebola through the following ways:
•Touching vomit, urine, saliva (spit), stool (faeces) or blood of a person that
has Ebola.
•Touching the body of a person who has died of Ebola.
•Contact with animals such as bats and monkeys, especially their blood or
organs.
You can’t get Ebola:
•From healthy people who have travelled to West Africa.
• Through the air, food or water.
WHAT ARE THE SYMPTOMS OF EBOLA?
•People become sick 2-21 days after coming into contact with the virus.
People with Ebola suffer with fever, vomiting, bloody diarrhoea, body pains
and bleeding from different places on the body.
•People that come into contact with Ebola will become very sick and will
have to go to a hospital.
•Many other diseases may also cause the same symptoms.
•You cannot get Ebola if you didn’t have contact with someone that already
has the disease.
HOW TO PREVENT EBOLA
People that travel to areas that report an Ebola outbreak should prevent
themselves from becoming sick in the following ways:
•Do not touch vomit, saliva (spit), urine and blood of a sick person that may
have Ebola.
•Do not touch the body of a person who has died.
•Always practice good hygiene and wash hands with soap and water
thoroughly.
•Avoid contact with wild animals such bats, monkeys and antelope,
especially their blood and organs.
•Go to your nearest clinic if you have signs and symptoms of Ebola.

HEALTH AWARENESS ROADSHOW
On 27 October 2014, Dinotshi Transport Holdings in Johannesburg hosted a Wellness Day, and invited
the NBCRFLI to present their services. It was a huge success with everyone from the company in
attendance, including their management team.
Members were able to access a variety of healthcare services, including eye tests. They also had access
to Council-related services from the NBCRFLI mobile office, which was present on the day.
“We are extremely pleased with the outcome of the event,” says Musa Ndlovu, National Secretary of the
NBCRFLI. “It is of paramount importance to us that the health and wellbeing of truck drivers and other
logistics staff across the country is taken care of.”
The health awareness roadshow is set to move around various regions across South Africa in an effort

It is important to remember that as an employee you qualify for a sick leave bonus payment after you complete your 3 year sick
leave cycle, provided you have sick fund credits available.
Your sick leave bonus will only be paid out as follows:
•On completion of the 3 year sick leave cycle after starting work or from the date that the previous sick leave cycle expires, this
means that the date you started working will determine the year during which you can expect a bonus payment.
•The NBCRFLI will pay a sick leave bonus, based on contributions received less sick leave benefits paid to an employee during
the preceding 3 year cycle.
If you have used all your sick leave benefits, you will not qualify for any sick leave bonus payments at the end of your sick leave
cycle.

The Provident Fund is a separate legal entity and is not owned by any stakeholder or party connected to the Fund, such as the
Council, an employer organisation or trade union. All Provident Fund contributions are made directly to the Fund and not via the
Council. The Council remains the body where collective agreements are negotiated and thereafter we enforce the provisions of the
said collective agreement in terms of the Labour Relations Act. Although there are Provident Fund service centres in the Council’s
Johannesburg, Cape Town and Durban branches, this is purely for the convenience of the Council’s members. No Provident Fund
queries or payments are received or handled by the Council itself, as stipulated above.

MAIN COLLECTIVE AGREEMENT
Clause 66 of the NBCRFLI Main Collective Agreement states that:
“An employee of a TES who is provided to one or more clients within the industry for a period in excess of 2 months is deemed to
be an ordinary employee, and all relevant provisions of this agreement are applicable to that employee.”
So, for example, if a TES employee has been on our site for 3 months but works less than 45 hours a week, does that employee
get paid the equivalent of a full 45 hour week or pro-rata commensurate with actual hours worked?

Clauses 66 and 67 in the Main Collective Agreement deal with matters relating to TES employers and their employees. Clause 66
provides that an employee of a TES who is provided to one or more clients within the Industry for a period in excess of two months
is deemed to be an ordinary employee and all relevant provisions of the Agreement are applicable to that employee. The employee
referred to in your enquiry is thus regarded as an ordinary employee and all the provisions of the Agreement will be applicable. The
employee should be paid his/her full wages irrespective of the number of hours work. The TES must further contribute to all the
benefit funds (in full) in respect of that employee and the employee must be a member of a registered pension/provident fund. The
employee may not be treated less favourably than any other ordinary (permanent) employee.

The NBCRFLI is accredited by the Commission for Conciliation Mediation and Arbitration to provide dispute resolution functions
to the industry. Arbitration is an escalation of the dispute resolution process in that it takes more time and involves the use of legal
representatives. It is very important that you attend the arbitration. If both parties fail to attend the case will be dismissed. When a
conciliation matter remains unresolved the party can refer the matter to arbitration. An application for arbitration must be submitted
within 90 days after the conciliation certificate had been issued.

We are employed by a security company in the logistics industry and are not registered with the Council. The security
company acts as a labour broker. We are doing normal warehousing jobs such as operating fork lifts. What can we do
about our problem?

Should you be involved in a dispute with your employer, the best thing to do is to declare a dispute, whether section 51 or
enforcement. The Council may not provide employers/employees with advice; we may only interpret the provisions of the Main
Collective Agreement and ensure that disputes are being heard by independent arbitrators. However, general questions about - for
example - leave, wages, etc. can be entertained by us as those provisions are catered for in the Agreement.
DISPUTES RESOLUTION
Should a long distance driver undergo a disciplinary hearing for parking the truck at 20:24 hours for sleeping, starting
