11437 - 9 23 September 2011 Project No. 11616366 ENVIRONMENTAL IMPACT ASSESSMENT FOR THE PROPOSED OPEN CAST MINING OF THE MAFUBE COAL MINING (PTY) LTD NOOITGEDACHT AND WILDFONTEIN RESERVES, MIDDELBURG DISTRICT, MPUMALANGA PROVINCE Dear Sir Madam Background Mafube Coal Mining (Pty) Ltd is at present assessing the extraction of coal from its Nooitgedacht and Wildfontein reserves in the Middelburg District, Mpumalanga Province. The coal reserve will be used to supply coal for both power generation (Arnot Power Station) and for export purposes. The proposed open cast mine is situated on portions of the Patattafontein, Nooitgedacht and Springboklaagte farms, between Middelburg and Belfast. A parallel environmental authorisation process is being undertaken in terms of the Mineral and Petroleum Resources Development Act (MPRDA), Act 28 of 2002 and the National Environmental Management Act (NEMA), Act 107 of 1998. The process will also include an Environmental Management Programme Report (EMPR), based on the findings of the EIA, a waste management licence in terms of the National Environmental Management: Waste Act (NEMWA), Act 59 of 2008 and an Integrated Water Use License Application in terms of the National Water Act (NWA), Act No. 36 of 1998. Purpose of this letter In accordance with the EIA Regulations (GNR 543, Regulation 15), the applicant Mafube Coal Mining (Pty) Ltd (Mafube) must give written notice of the proposed activity to the owner or the person in control of the land on which the activity is to be undertaken and inform such a person that he/she may participate in the public participation process. It is the purpose of this letter to fulfil the notification requirements as stipulated in the mentioned regulations. The properties that are potentially affected by the proposed applications are indicated on the attached map. Furthermore, Golder respectfully requests your assistance to allow specialists to conduct their studies. For some of the specialist studies, such as detailed wetland assessments, it may be necessary to gain access to certain properties whose surface rights do not belong to Mafube. Please be assured that no specialist will access a property, without prior arrangement with the landowner, including a discussion regarding the correct specialist procedures to be followed whilst on their land. It is envisaged that these specialist studies will take place from September 2011 to April 2012. Please be assured that every effort will be made to cause minimum disturbance. The coal reserve will be used to supply coal for both power generation (Arnot Power Station) and for export purposes. The proposed open cast mine is situated on portions of the Patattafontein, Nooitgedacht and Springboklaagte farms, between Middelburg and Belfast. A parallel environmental authorisation process is being undertaken in terms of the Mineral and Petroleum Resources Development Act (MPRDA), Act 28 of 2002 and the National Environmental Management Act (NEMA), Act 107 of 1998. The process will also include an Environmental Management Programme Report (EMPR), based on the findings of the EIA, a waste management licence in terms of the National Environmental Management: Waste Act (NEMWA), Act 59 of 2008 and an Integrated Water Use License Application in terms of the National Water Act (NWA), Act No. 36 of 1998. The purpose of the EIA is to evaluate potential environmental and social impacts of the project. Farm workers are consulted when environmental assessments or resettlement negotiations take place. Does the mine have a contact person which the community can speak to regarding problems experienced with farmers in the area. When the mine addresses an issue with a farmer will the community member concerned be present at the meeting? Mr Ezra Nhlapo Department of Health What will happen to people from Nooitgedacht if the mine expands to the area? Mr Johannes Malaza Nooitgedacht Public Meeting, 02 November 2011 Mafube has not yet taken a final decision to continue with the proposed mine. Should the proposed mining go-ahead all affected parties will be consulted. It should also be noted that not the whole of the Nooitgedacht farm will be taken up by mining. The resettlement action plan will identify whether any people stand to be directly affected, and whether any homesteads will need to move. This study will only be done once the EIA is complete and Mafube have decided to go ahead with the LifeX project. Will there be any benefit to the farming communities when they have to be relocated? Is there a possibility that they could receive preferential treatment for job opportunities? The SLP is written according to DMR specifications where employment strategies need to be addressed. The farms affected by the proposed mine expansion are currently practicing agriculture. The expansion will result in a loss of jobs by farm workers. In the current situation we have made provision for the livestock and fencing. If the livestock gets overpopulated, we will explore other ways of making sure that the livestock is retained on reasonable size of land. The mine will go through the process in consultation with the community as the community needs to take ownership of the process to ensure the sustainability of this plan. Should people have to be relocated they should have a choice of housing plans and their houses should be at least the same size but preferably bigger. The basic principle of closure planning is that is should already be taken into account in the feasibility phase of the project. On p.65 of the report it is stated that the closure plan and the quantification of closure cost will not be done in this application. A detailed programme of the quantification of current cost, for the period in which the impact will occur, must be done. The plan may change during the life of mine, but there has to be a sustainable plan before any right can be awarded. Any models used in the determination of financial liability must be made available to I&APs. 7.0 The assessment of cumulative impacts is also discussed under section 9.1 Please also see closure report in section 9.3.12. Dedicated closure planning and costing will be undertaken as part of the EIA phase. Specifically, a base case land use plan will be compiled to inform the closure planning through identification of suitable/appropriate post-closure land use/s; the closure plan will then be compiled, comprising identified closure objectives and associated measures towards attaining the identified land use/s. The identified closure measures will be costed, aligned to the DMR guideline and international good practice, and presented in dedicated spreadsheets with supporting motivation for the costs. All of these deliverables will inform the EIA/EMP. Information that is not commercially sensitive or confidential can be shared including the principles of how financial models are compiled. WATER AUTHORISATION ISSUES How far are the mining activities from the pans in Rooipan? Mafube shall comply with all the provisions of the IFC and WB standards and explain the process that needs to be followed when graves need to be relocated and we shall respect all cultural beliefs and comply with the legislation of the country in terms of how to manage the relocation of graves. Mafube shall also respect community rituals and rites and beliefs of the community that need to have graves relocated. It is the responsibility of the local authority to identify the location of a new graveyard. The impact of loss of high potential land on food security must be investigated, taking into account the total hectare of high potential land available on the Highveld for food production and the areas that have already been mined or are applying for mining rights. The rehabilitation plan must be detailed and any production potential connected to this plan must be proven. The written motivations on pages 24 and 25 of the DSR are not sufficient. On page 53 of the report, the alternative sources of coal are mentioned, but no comparison of their impact on socio economic and environmental basis has been done. The basic principle that a coal field might not be mined as a result of the cost of such a mine on socio economic and environmental aspects must be mentioned. Equally so, no mention is made for alternatives to open cast mining e.g. underground coal gasification.
