 Wedding and Event Terms and Conditions Policy Statement “To continually ensure our high levels of service, creation and supply of high quality products, we need to be clear and transparent in all aspects of our business practices in order to maintain a professional relationship between the Company and the Client.” Sarah Bateup, Broadview Florist Manager (2015) 1. Parties 1.1 Broadview Florist (“the Company”) 1.2 Any person(s), firm or business trading with the Company (“the Client”) 2. Enquires and Estimations 2.1 For enquires regarding the cost of wedding flowers, a price guide will be sent to the Client by the Company. A price guide is purely for guidance and a further consultation is required to produce a bespoke quotation. 2.2 Upon receiving an enquiry with floral design requirements estimation of prices will be provided by the Company. This is not a contract between the Client and the Company and upon further consultation a bespoke quotation will be provided outlining exact costs. 3. Consultations and Quotations 3.1 Consultations are free when carried out at the Company premises and at our recommended supplier venues during shop hours. 3.2 Consultations are by appointment only to ensure a bridal florist is available to help. 3.3 A maximum of 2 free consultations will be provided prior to making a booking for your wedding flowers. Additional consultations will be charged at £20 per hour until your booking and deposit are received. 3.4 Consultations out of the company hours will be charged at £20 per hour with travel expenses charged at 50p per mile. Charges will be agreed at the time of consultation booking and payment will be required prior to the consultation in store by cash or credit/debit card or over the phone by credit/debit card. 3.5 The prices quoted for each of your chosen designs are exact prices for the exact design quoted upon. Changes to the designs chosen will require a new price to be quoted upon which may be higher or lower than the original quote depending upon the design. 3.6 Prices will reflect the time of year the wedding/event is booked and the flower/foliage choices made. 3.7 Prices quoted upon are valid for 28 days from date of quotation. If you choose to book after this time there may be a need to re-­‐quote. 3.8 Changes can be made after booking and deposit have been received up until 28 days before the wedding/event date (see 3.5). 4 Bookings and Payments 4.1 When a wedding date is booked a £100 deposit is required. The £100 deposit is subtracted from the final wedding balance. This deposit will secure the date to ensure a wedding florist is available for you. The deposit is non refundable or transferable 4.2 At the time of booking both parties will be bound by these terms and conditions forming a contract between the Company and the Client. 4.3 Full payment of the balance due will be required 28 days before your wedding date. All products remain the property of the Company until paid for in full. 4.4 If full payment is not received by 28 days prior to the event the Company reserves the right to deem the agreement no longer valid and all flowers and accessories relating to this contract, including any hire arrangements, will be cancelled with no financial liability borne by the Company. We are not obliged to offer any compensation for inconvenience caused. 4.5 The cost of your wedding flowers can be spread over the months leading up to your wedding date, please ask for details. 4.6 If, for any reason you decide to cancel your wedding this deposit is non -­‐ refundable. If you decide to postpone your wedding we will hold your deposit until your wedding goes ahead. 4.6 Payment can be made by cash, credit/debit card or BACS transfer, please ask for details. 4.7 All costs are subject to VAT at the prevailing rate. 5 Details and amendments 5.1 Your initial quote will be provided in writing, by email or post. 5.2 If you wish to make any alterations to your wedding flowers discussed, these can only be accepted in writing, via email or in person at the shop. 5.3 Only the Client may make any amendments to the flower order. 5.4 The final details of the wedding flowers should be made on or before the balance due date, 28 days prior to the wedding date. This is so the Company can order and receive items required for your wedding. 5.5 Only minor changes such as buttonhole numbers can be made within 7 days to the wedding date and payment is required at the time of making the change (see 5.2/5.3, 4.6/4.7) 5.6 Mock floral designs can be made if required but will be made to the same standard as the on the day design and using best available materials. As such they will be charged at the same price quoted upon and must be paid for in advance (see 4.6/4.7). 5.7 As the Company will be providing a natural product please be aware that the quality and colours may differ slightly to those discussed and agreed, depending on season and availability. 5.8 The Company reserves the right to substitute what the Company deems as suitable alternative sundries, foliage and flowers from those agreed, depending on season and availability. However the Company will endeavour to keep the designs and finished work as close to the agreed requirements as possible. 5.9 The Company are under no obligation to inform the Client of any substitutions that are made prior to delivery of the goods, however the Company will endeavour to keep the designs and finished work as close to the agreed requirements as possible. 6 Hire Items and Agreements 6.1 The Client shall be solely responsible for the hired items, not the reception/event venue/hotel/florist or any other third party to whom shall take possession of the hired items. The Client shall be responsible for ensuring the hired items are kept in good order from the time of receipt of delivery until back into the possession of the Company. 6.2 The Company will charge the Client a hire fee per item required and in addition a damages deposit of £50 for any hired items (see 4.7). 6.3 All hire items will be collected by the Company, as pre arranged at a pre arranged price, and all hired items are expected to be available to be collected in their entirety and undamaged. 6.4 The refund of the damages deposit on hired items will be made within 28 days of their return providing that the card or bank details are supplied. Such details will be held on file until completion of all transactions and then destroyed in accordance with the Data Protection Act. 6.5 The Company reserves the right to retain the deposit and make additional charges in respect of any loss of and/or damage to the hired items. A full list of retail costs for hire items can be provided upon request. 6.6 Hired items are based upon 1 day (24 hours) hire duration. The Client may request hire items for a longer period of time but may be charged additionally or refused. 6.7 All hired items are for use as specified in the quotation and are not for any other use. 6.9 The hire items remain the property of the Company. The Client will undertake not to sell, offer to sell, assign, charge, pledge, underlet or otherwise deal with the any hired items provided by the Company in any circumstances. 7 Delivery and Set Up 7.1 Deliveries to home addresses will need to be signed for. Please check the flowers carefully and ensure any discrepancies or quality issues are communicated to us at time of delivery of delivery. We regret that after this time has passed a replacement or refund will not be available. 7.2 We will not be held responsible for any injuries or damages sustained as a result of broken glass, materials or dyes that may be used to colour the water for you. Liability is limited to the supply of goods only. 7.3 Where candles are incorporated within the design e.g candelabras, it is the Client’s responsibility to agree with the venue provider whether the venue and the proposed location of the item deem it safe within their health and safety policy for the candles to be lit. The Company will supply good quality, drip proof candles in secure holders but cannot be held responsible should the provider of the venue deem it unsafe, at the time, for them to be lit. The Company can supply battery operated candles which are subject to hire charges (see 3.8, 4.7) 7.4 Delivery charges will be shown in your quotation where applicable. 7.5 Where set up at the venue is required the price will be shown in your quotation. 7.6 Collection of hired items will be made by the Company at a pre-­‐arranged price. 7.8 Removal of all floral designs from the venue is your responsibility unless previously arranged and included in your quotation. 8 Cancellations and refunds 8.1 If you cancel your wedding flowers no less than 28 days before the delivery date then we will keep your non-­‐
refundable deposit to cover consultation and administrative costs. 8.2 Cancellations within 28 days of the delivery date, when payment has been made in full, will be subject to only 50% being refunded minus the £100 non-­‐refundable deposit. 8.3 All cancellation notifications must be received by the Company in writing and signed by the Client. 8.4 If through illness or for reasons beyond our control none of our florists are able to finish your wedding flowers we will employ a freelance florist or pass your order to an available florist who will work to our quoted prices. 9 Force Majeure 9.1 The Company will make all reasonable efforts to carry out its obligations but this is subject to such variation as may be necessary as a result of circumstances beyond the Company’s control including (but without prejudice to the generality of the concept of force majeure) difficulty in securing labour, materials or other supplies or as a result of any act of God, war, strike, lock-­‐out or other labour dispute, fire, flood or other cause beyond the Company’s control. 10 Additional terms and information 10.1 Any mock floral designs made for the Client, along with any designs, sketches and photographs of the Company’s we’ve allowed the Client to view and/or take away are subject to copyright laws (The Copyright, Designs and Patents Act 1988) and therefore the Client is not permitted to show them to, or allow them to be copied or used by any other florist or floral designer without the express consent of the Company. If the Client chooses not to use the Company to provide the wedding/event flowers, any designs, sketches and photos must be returned without being copied. Any use of the images, including the reproduction, modification, distribution or replication of the images, without the written permission of the Company is strictly prohibited. 10.2 When you place an order with the Company or make an online enquiry, we gather certain information that the Client submits. This includes contact details that we require to action your request. We will not sell, rent, lend or disclose your information in any form whatsoever to any third party other than for the dispatch of your order. 10.3 The Company and the Client each agree with the other that any information given to the other which is proprietary and confidential will be kept confidential and not revealed to any third party both during and after the currency of any contract between the parties and after its termination. 10.4 All prices are in UK Pounds Sterling and are correct at time of viewing 10.5 The Company reserve the right to supplement and/or amend these terms and conditions from time to time. 10.6 The Company manager has the right the waiver fees in regards to consultations, hire, delivery, set up and collection at their discretion For any queries with the terms and conditions please contact us [email protected]
