Appellate Practice
Hurrell Cantrall LLP’s appellate practice remains a longstanding and integral facet
of the firm. Our approach at the appellate level is to aggressively represent our
clients by staying abreast of new developments in the law and writing persuasive
and effective briefs. We regularly handle appeals and writs in state and federal
courts.
Our attorneys have been involved in all aspects of the appeals process in a wide
range of practice areas, including government liability, police misconduct litigation
and actions filed under 42 U.S.C. § 1983, products liability, professional liability,
elder abuse, premises liability, and general liability.
We have represented a wide variety of clients from individuals to corporate
entities in appellate matters involving a gamut of legal issues.
Employment Law
Our employment law practice includes the defense of claims arising from
allegations of wrongful termination, whether based on public policy,
discrimination, or contract.
Hurrell Cantrall LLP has represented employers against single-plaintiff and large
class-action allegations of retaliation and discrimination on the basis of age,
disability, gender, marital status, national origin, pregnancy, race, religion, and
other prohibited forms of discrimination. We have represented clients across the
entire spectrum of employment discrimination and related litigation, including
claims under federal and state statutes, as well as claims under the common law.
We also emphasize the development of effective personnel-management
strategies that help our clients avoid costly litigation and lengthy government
investigations. We can assist in the development of employment policies and
procedures, handbooks, applications, job evaluation forms, offer letters,
employment contracts and other documents that affect the employment
relationship. We also assist our clients by keeping them compliant with the law

Environmental Law
Hurrell Cantrall LLP’s environmental litigation practice has been an intrinsic part
of the firm since the firm’s inception. Our attorneys have developed specialized
knowledge in the area of environmental law. In particular, throughout our 30
year history, the firm has become well-versed in the intricacies of federal and
state statutes, as well as regulations and case law, pertinent to environmental
issues. In addition, we understand the technical and scientific issues underlying
such cases and have developed a network of some of the most knowledgeable
geologists, industrial hygienists, hydrologists, toxicologists, and physicians.
We have handled complex environmental law cases in both state and federal
courts involving numerous plaintiffs, and a wide range of environmental issues,
from air pollution and groundwater contamination to exposure to mold and
chemicals. We have defended and advised public and private entities in claims
of personal injury, property damage, diminution of property values, and wrongful
death.
General Liability
Hurrell Cantrall LLP also has substantial experience handling general liability
cases of all types. We have defended various clients, from retail organizations
and individual property owners involved in personal injury claims, to individuals
and corporate entities in cases involving motor vehicle negligence. Our
aggressive approach to defending all cases has consistently led to defense
verdicts, dismissals, and nominal settlements.
The firm’s defense of general liability cases is renown throughout California,
largely due to a consistent success rate for a well-known commercial and
industrial client base. We represent clients on behalf of some of the most
successful insurers in the nation, and have done so for over 30 years. We have
also represented national supermarket and department store enterprises in their
general liability and premises liability cases.

Professional Liability
Professional liability has long been a cornerstone of the firm’s practice. We
have successfully defended hospitals, medical schools, dental schools,
pharmacy schools, nursing homes, extended care facilities, as well as
individual physicians, pharmacists, chiropractors, podiatrists, and dentists.
Our attorneys regularly defend clients in matters involving patient care and
treatment, including alleged negligence during surgery, and the alleged failure
to properly diagnose, medicate, and monitor patients.
We have also been involved in matters relating to claims of medical
instrumentation and mechanical support malfunctions, as well as issues
involving organizational management and oversight.
Illustrative Cases
• Plaintiff alleged injuries after cleaning products splashed in his face. A
motion for summary judgment was granted on behalf of the public entity
defendant and demurrers were sustained on behalf of the individual
defendants.
• Plaintiffs sued a paint manufacturer alleging that toxic exposure to benzene
from paints caused his leukemia. The trial judge granted summary judgment
for our client, finding that the paint was not a substantial factor in decedent’s
death.
• Plaintiffs sued a public entity in federal and state court for wrongful
termination and retaliatory discharge in violation of federal and state law, as
well as the U.S. Constitution. Summary judgment was granted for the
defense in both state and federal courts.
• Defense verdict after two-week trial in a case against a grocery chain after
plaintiff slipped and fell on spilled yogurt. Plaintiffs demanded $1.8 million.
The jury found in favor of our client, agreeing that reasonable care was used
in inspecting and maintaining the premises prior to the incident.

Leaders in Litigation
Born in 1960, Mr. Hurrell attended college at the
University of California at San Diego, and
earned his law degree from Case Western
Reserve University in Cleveland, Ohio in 1985.
Mr. Hurrell began his legal career with the
predecessor firm of Hillsinger and Costanzo,
where he quickly jumped into the trial arena his
first year of practice. He averaged trying six to
eight cases a year as he progressed into his
legal career. At the age of 32, he became one
of the youngest members in the country of The
American Board of Trial Advocates (“ABOTA”).
He now holds the rank of Advocate in that
prestigious organization.
Mr. Hurrell specializes in the defense of
Products
Liability,
Government
Liability,
Professional Liability, and General Liability
litigation.
He has achieved a remarkable
success rate in the last decade, often achieving
major victories. Most recently these included
defense verdicts in multiple civil rights cases
against law enforcement agencies, and several
wrongful death cases involving allegations of
medical negligence that were evaluated
prospectively by mediators and the bench as
being virtually incapable of being won by the
defense.
In 2004, Mr. Hurrell tried a major action in Los
Angeles, California involving allegations of mold
contamination and related illnesses by 25
individual plaintiffs in which the settlement
demand was $12 million dollars. After two
months of trial, the jury came back with a token
judgment awarding plaintiffs minimal damages
for inconvenience, but denying them any
damages for personal injury.
