Allgemeine Geschäftsbedingungen – Mountainbike-Park Hürtgenwald
Vorbemerkungen:
I-
Betreiber des Mountainbike-Parks Hürtgenwald (nachfolgend: „Bikepark“) ist der
Nordeifel Gravity e.V. (nachfolgend „Betreiber“ genannt).
II -
Die Benutzung des Geländes des Bikeparks steht dem Betreten und insbesondere der
Benutzung sowie dem Befahren der Strecken auf dem Gelände des Bikeparks gleich.
III -
Die Strecken werden durch den Betreiber stets präpariert und nach bestem Wissen
und Gewissen abgesichert.
Die Benutzung des Geländes des Bikeparks erfolgt jedoch stets auf eigene Gefahr.
IV –
Eltern haften für ihre Kinder.
V-
Mit Erwerb eines Tickets oder mit der Benutzung des Geländes des Bikeparks stimmt
der Erwerber (nachfolgend: „Nutzer“) diesen allgemeinen Geschäftsbedingungen zu.
1. Ticketerwerb durch nicht volljährige Personen
a. Kinder unter 10 Jahren
Kinder unter zehn Jahren dürfen das Gelände des Bikeparks nur in Anwesenheit des
gesetzlichen Vertreters (i.d.R. eine volljährige, erziehungsberechtigte Person) betreten,
benutzen und befahren. Die Anwesenheit des gesetzlichen Vertreters gilt zugleich als
Einverständniserklärung in diese allgemeinen Geschäftsbedingungen.
b. Kinder zwischen 10 und 18 Jahren
Kinder im Alter zwischen zehn und achtzehn Jahren dürfen das Gelände des Bikeparks sowie
die Mountainbike-Strecken des Bikeparks nur mit einer durch den gesetzlichen Vertreter
unterschriebenen Einverständniserklärung bezüglich der allgemeinen Geschäftsbedingungen
des Mountainbike-Parks Hürtgenwald, betreten, benutzen und befahren.

2. Haftungsausschluss
a. Der Nutzer betritt, befährt und benutzt das Gelände und die Strecken des Bikeparks auf
eigene Gefahr. Er trägt die alleinige zivil- und strafrechtliche Verantwortung für alle von
ihm und dem von ihm benutzten Sportgerät ausgehenden Schäden. Dies gilt ferner für
durch das Verhalten anderer Nutzer verursachte Schäden.
b. Buchst. a) gilt für die Benutzung des Shuttle-Services, insbesondere des Shuttlebusses
sowie dessen technischer Vorrichtungen (Anhänger) entsprechend.
c.
Der Nutzer verzichtet auf die Geltendmachung aller im Zusammenhang mit dem Betreten,
der Benutzung und dem Befahren des o.g. Geländes sowie der Mountainbike-Strecken
des Bikeparks erlittenen Unfälle oder Schäden gegen:

den Betreiber, dessen Vorstand, Mitglieder, hauptamtliche Mitarbeiter, Sportwarte und
sonstige Mitarbeiter sowie
den Veranstalter von besonderen Veranstaltungen wie Übungen, Test- oder
Probebetrieben, dessen Beauftragte, Sportwarte und Helfer - den/die
Eigentümer/Pächter des für die Veranstaltung genutzten Grundstücks sowie der
baulichen Anlagen und Einrichtungen, gegen den/die Betreiber der für die
Veranstaltung genutzten Strecke, dessen/deren Beauftragte und Helfer - die
Teilnehmer und deren Helfer sowie gegen eigene Helfer - Behörden, Renndienste,
und irgendwelche andere Organisationen bzw. juristische oder natürliche Personen,
die mit der Organisation auf dem Bikeparkgelände in Verbindung stehen, soweit der
Unfall oder Schaden nicht auf Vorsatz oder grober Fahrlässigkeit beruht.
d. Die Nutzung des o.g. Geländes stellt hohe Anforderungen an die Aufmerksamkeit,
körperliche und geistige Fitness sowie Disziplin der Nutzer. Der Nutzer versichert daher,
dass er an keinerlei körperlichen Gebrechen leidet und bei der Nutzung des o.g. Geländes
nicht unter Alkohol-, Drogen-, oder Medikamenteneinfluss steht, die seine
Nutzungsfähigkeit beeinflussen können.
e. Anweisungen von Mitarbeitern, Bikepark-Personal und Beauftragten des Betreibers leistet
der Nutzer uneingeschränkt Folge.
3. Nutzungsordnung/Parkregeln
a. Es gilt Vollvisierhelm- und Protektorenpflicht im ganzen Bikepark.
b. An unübersichtlichen Stellen ist langsam und vorsichtig zu fahren.
c.
Es ist stets ein ausreichender Sicherheitsabstand einzuhalten. Dem vorderen,
langsameren sowie schwächeren Biker ist stets Vorfahrt zu gewähren. Drängeln ist streng
verboten.
d. Das Halten auf den Strecken ist streng verboten. Gehalten werden darf nur außerhalb der
Stecken.
e. Das Belaufen oder Befahren der Strecken gegen die Fahrtrichtung ist streng verboten.
f.
Grundsätzlich sollten die Strecken vor dem Befahren besichtigt werden.
g. Für weniger geübte Fahrer sind an Streckenhindernissen Umfahrungen angebracht.
h. Die aufgestellten Schilder und Markierungen an und auf den Strecken müssen, um
Unfälle zu vermeiden, unbedingt beachtet und befolgt werden. Es ist auf Wanderer,
Fußgänger und forstwirtschaftliche Fahrzeuge zu achten, die sich im Bikepark befinden
können.
i.
Den Aufforderungen und Anweisungen des Bikepark-Personals ist stets unverzüglich
Folge zu leisten. Zuwiderhandlungen können mit Fahrverboten und dem Verweis vom
Gelände geahndet werden.
j.
Auf öffentlichen Straßen und Wegen gilt die Straßenverkehrsordnung (StVO). An
Gefahrenstellen wie auf den Wegen zwischen Shuttle und Start- und Ausgang und
Shuttleparkplatz sind insbesondere deren Vorfahrtsregelungen zu beachten. Der Verkehr
ist zu beachten und das eigene Verhalten ist entsprechend anzupassen.
k.
Jeder Nutzer ist angehalten Umwelt und Natur zu schonen. Müll kann in die Mülleimer am
Kassenwagen (Talstation) sowie in die Mülleimer, die sich an dem Toilettenhäuschen
gegenüber dem Shuttleparkplatz befinden (Bergstation), entsorgt werden.
l.
Das Betreten der Strecken ist für Fußgänger streng verboten. Es besteht Lebensgefahr!
m. Die Tagestickets sind nicht übertragbar. Es erfolgt kein Ersatz für verloren gegangene
Tickets. Die Zugangskontrolle erfolgt durch das Bikepark-Personal.
4. Parken
a.
Die Besucher des Bikeparks parken ausschließlich auf den durch Beschilderung oder
durch das Bikepark-Personal ausgewiesenen Parkplätzen- und –Flächen. Dies betrifft
insbesondere die unterhalb des Franziskus-Gymnasiums gelegenen Parkplätze links und
rechts der Kreisstraße K 36, sowie den Asche-Sportplatz unterhalb des Franziskus
Gymnasiums in unmittelbarer Nähe des Startpodestes des Bikeparks.
b.
Bei Regen und Nässe ist das Parken auf dem unter a. genannten Asche-Sportplatz
verboten.
c.
Auf dem Parkplatz vor dem Franziskus Gymnasium ist das Parken nicht gestattet. Es
handelt sich um Privatgelände. Den Anweisungen des Eigentümers ist Folge zu leisten.
Bei Zuwiderhandlungen wird sich dieser unmittelbar an das Bikepark-Personal wenden.
Dieses kann in Folge Fahrverbote und Verweise vom Bikepark-Betrieb aussprechen.
d.
Das Parken ist kostenfrei. Das Parken und Halten vor und hinter den Rettungswegen ist
verboten. Nur so kann sichergestellt werden, dass die Rettungswege jederzeit frei
zugänglich sind.
5. Reduzierung des Streckenangebotes
a. Es muss damit gerechnet werden, dass Streckenabschnitte oder ganze Strecken
aufgrund von Wartungsarbeiten, Unfällen, oder sonstigen Ereignissen, welche die
Sicherheit des Betriebs gefährden, geschlossen werden. Der Betreiber weist auf
geschlossene Strecken oder Streckenabschnitte, soweit möglich, vorab am Startpodest
und am Kassenhäuschen hin.
b. Ein reduziertes Streckenangebot berechtigt nicht zu einer Vergünstigung oder
Rückvergütung des erworbenen Tickets.
c.
Unvorhergesehene Wettersituationen (starker Wind, Unwetter usw.) oder technische
Probleme an den Shuttlebussen, die eine Einstellung des Betriebes aus
Sicherheitsgründen erfordern, berechtigen ebenfalls nicht zur Rückvergütung des
erworbenen Tickets.
6. Öffnungszeiten
a. Der Bikepark hat an Samstagen und Sonntagen im Zeitraum von 01. April bis 31. Oktober
geöffnet.
b. Der Bikepark kann, innerhalb des unter a. genannten Zeitraumes, in den Ferien und an
Feiertagen geöffnet haben, sofern dies der Betreiber explizit bekannt gibt.
c.
Im Falle schlechten Wetters oder anderen unvorhersehbaren und vorhersehbaren
Naturereignissen behält sich der Betreiber die Schließung des Bikeparks, auch während
des Betriebes, nach eigenem Ermessen vor.
7. Nutzung außerhalb der Öffnungszeiten
Das Befahren aller Bikepark-Strecken außerhalb der Öffnungszeiten ist streng verboten. Bei
Zuwiderhandlung behält sich der Betreiber entsprechende zivil- und strafrechtliche Schritte
explizit vor.
General Terms and Conditions of Business – Mountainbike-Park Hürtgenwald
Preliminary remarks:
I
The operator of Mountainbike-Park Hürtgenwald (hereinafter: the “Bikepark”) is Nordeifel Gravity
e.V. (hereinafter referred to as the “operator”).
II
Use of the Bikepark premises equals entering and in particular using and cycling on the tracks on
the Bikepark premises.
III
The tracks are always prepared by the operator and secured according to the operator’s best
knowledge and belief.
However, you always use the Bikepark premises at your own risk.
IV
Parents are liable for their children.
V
By purchasing a ticket or using the Bikepark premises, the purchaser (hereinafter: the “user”)
accepts these General Terms and Conditions of Business.

Ticket purchase by minor persons
a
Children under the age of 10
Children under the age of ten may enter, use and cycle on the Bikepark premises only in the presence
of the legal representative (usually a parent or legal guardian of full age). The presence of the legal
representative shall be considered at the same time as declaration of consent to these General Terms
and Conditions of Business.
b
Children between 10 and 18 years of age
Children aged between ten and eighteen years may enter, use and cycle on the Bikepark premises
and the mountain bike tracks of the Bikepark only with a written declaration of consent to the General
Terms and Conditions of Business of the Mountainbike-Park Hürtgenwald, which must be signed by
the legal representative.

Exclusion of liability
a
The users enter, cycle on and use the premises and the tracks of the Bikepark at their own risk.
They shall bear the exclusive civil and criminal liability for all damages caused by themselves and
the sports equipment used by them. This shall also apply for damages caused by the behaviour
of any other users.
b
Letter a) shall apply to the use of the shuttle service, in particular the shuttle bus and its technical
devices (hooks) accordingly.
c
The user shall waive the assertion of any claims for accidents or damages suffered in connection
with the entering, use or cycling on the premises mentioned above and the mountain bike tracks
of the Bikepark against:
- the operator, its executive board, members, staff, sports managers and other employees,
and
- the host of special events, such as practices, test or trial operation, its agents, sports
managers and helps, the owner(s)/tenant(s) of the premises used for the event and
the
structural installations and facilities, against the operator(s) of the track used for
the event,
its/their agents and helps, the participants and their helps, and against own
helps,
authorities, racing services and any other organisations or legal and natural
persons
associated with the organisation on the Bikepark premises, unless the
accident or damage
was caused with intent or gross negligence.
d
The use of the above-mentioned premises places high demands on the attention, physical and
mental fitness and discipline of the users. The user therefore assures not to suffer from any bodily
ailments and not being under the influence of alcohol, drugs or medication when using the abovementioned premises, which could affect their ability to use the premises.
e
Any directions given by employees, Bikepark staff and agents of the operator shall be observed
by the user without any restrictions.

Usage regulations / Park rules
a
There is an obligation to wear a full visor helmet and protectors within the entire Bikepark.
b
Go slowly and carefully at narrow places.
c
Sufficient safety distance must be kept at all times. The biker in front, slower and weaker bikers
must always be given priority. Pushing is strictly forbidden.
d
Stopping on the tracks is strictly forbidden. You may only stop outside the tracks.
e
Walking or cycling on the tracks in reverse direction is strictly forbidden.
f
As a general rule, the tracks should be inspected before cycling.
g
For less experienced cyclists, bypasses are available at obstacles on the track.
h
In order to avoid accidents, the signposts and markings at and on the track must be observed and
followed without fail. Attention has to be paid to hikers, pedestrians and forestry vehicles which
could be in the Bikepark.
i
The requests and directions of the Bikepark staff must always be followed without delay.
Infringements can be sanctioned with cycling bans and being sent off the premises.
j
The German road traffic regulations (StVO) apply on public roads and lanes. Their priority rules
must be observed in particular in dangerous areas like the paths between the shuttle and the start
and exit and the shuttle parking area. Traffic has to be observed, and you have to adapt your own
behaviour accordingly.
k
Any user is encouraged to protect the environment and nature. Waste can be disposed of in the
rubbish bins next to the point of sale (valley station) and in the rubbish bins at the toilet building
opposite to the shuttle parking area (top station).
l
It is strictly forbidden for pedestrians to enter the tracks. There is danger of death!
m
The day tickets are not transferrable. Any lost tickets will not be replaced. Access control is
provided by the Bikepark staff.

Parking
a
The visitors of the Bikepark shall park exclusively on the parking spaces and areas marked by
signposts or indicated by the Bikepark staff. This relates in particular to the parking spaces
located below the Franziskus-Gymnasium to the left and right of the K 36 country road, as well as
the Asche-Sportplatz below the Franziskus-Gymnasium in close proximity to the starting platform
of the Bikepark.
b
Parking on the Asche-Sportplatz mentioned in a) is forbidden in case of rain and wet weather.
c
Parking is not allowed at the parking space in front of the Franziskus-Gymnasium. This is private
property. The directions of the owner must be complied with. In case of infringements, the owner
will directly approach the Bikepark staff who may consequently ban you from the Bikepark.
d
Parking is free of charge. Parking and stopping in front of and behind the escape routes is
forbidden. This is to ensure that the escape routes are freely accessible at all times.

Reduction of tracks
a
It is possible that track sections or entire tracks are closed due to maintenance works, accidents
or other events jeopardising the safety of operations. As far as possible, the operator will point out
any closed tracks or track sections in advance at the starting platform and the point of sale.
b
Any reduction of the tracks available does not entitle to claim any reduction or refund of the
purchased ticket.
c
Unforeseen weather conditions (strong wind, thunderstorm, etc.) or technical problems with the
shuttle buses which require that the operations are stopped for reasons of safety also do not
entitle to claim refund of the purchased ticket.

Opening times
a
The Bikepark is open on Saturdays and Sundays from 1 April until 31 October.
b
Within the period stated under a), the Bikepark may be open during school holidays and on public
holidays, provided that this is expressly announced by the operator.
c
In case of bad weather or other unforeseeable and foreseeable natural disasters, the operator
reserves the right to close the Bikepark even during normal operation at its own discretion.

Use outside the opening times
Cycling on any Bikepark tracks outside the opening times is strictly forbidden. In case of infringements,
the operator reserves the right to take action under civil and criminal law.
Conditions générales de vente – Mountainbike-Park Hürtgenwald
Observations préliminaires :
I.
L’exploitant du Mountainbike-Park Hürtgenwald (ci-après dénommé : « Bike Park ») est la
Nordeifel Gravity e.V. (ci-après dénommé « l’exploitant »).
L’utilisation du terrain, son accès et tout particulièrement l’utilisation ainsi que la conduite
sur les pistes du terrain du Bike Park se trouvent sur un même pied d’égalité.
Les pistes sont toujours préparées et sécurisées en toute conscience par l’exploitant.
L’utilisation du terrain du Bike Park se fait toutefois toujours aux risques de l’utilisateur.
Les parents sont responsables de leurs enfants
En faisant l’acquisition d’un billet ou en utilisant le terrain du Bike Park, l’acquéreur (ciaprès dénommé : « l’utilisateur ») accepte les présentes conditions générales de vente.

1. Acquisition d’un billet par les personnes mineures
a. Enfants de moins de 10 ans
Les enfants de moins de dix ans ne sont autorisés à accéder au terrain du Bike Park, l’utiliser
et y circuler en vélo qu’en la présence d’un représentant légal (en principe une personne
majeure et investie de l’autorité parentale). La présence du représentant légal vaut dans un
même temps pour déclaration de consentement à ces conditions générales de vente.
b. Enfants ayant entre 10 et 18 ans
Les enfants ayant entre 10 et 18 ans ne sont autorisés à accéder au terrain du Bike Park,
l’utiliser et circuler en vélo sur les pistes VTT qu’avec une déclaration de consentement écrite
et signée de leur représentant légal, aux fins des conditions générales de vente du
Mountainbike-Park Hürtgenwald.

2. Exonération de responsabilité
a. L’utilisateur accède au terrain du Bike Park, conduit sur les pistes et les utilise à ses
propres risques. Il porte l’entière responsabilité civile et pénale pour tous les dommages
causés par lui ou par l’équipement de sport qu’il aura utilisé. Ceci s’applique en outre aux
dommages causés par le comportement d’autres utilisateurs.
b. Le petit a) s’applique à l’utilisation du service de navette, en particulier à l’autobus de
navette ainsi qu’à ses dispositifs techniques correspondants (remorques).
c.
L’utilisateur renonce à engager toute poursuite en rapport avec des accidents ou
dommages subis relatifs à l’accès au terrain susmentionné du parc, son utilisation ou la
conduite sur ses pistes contre :

L’exploitant, son comité de direction, ses membres, ses collaborateurs, ses membres
organisateurs et autres membres du personnel ainsi que
Les organisateurs d’évènements spéciaux comme des exercices, des tests ou des
essais de fonctionnement, leurs mandataires, membres organisateurs et aides – le/les
propriétaires/bailleurs du terrain utilisé pour l’organisation de l’évènement ainsi que
les constructions et installations, contre le/les exploitants des pistes utilisées pour
l’évènement,
leurs mandataires et aides – les participants et leurs propres aides ainsi que contre ses
propres aides – autorités, membres du service course et toute autre organisation ou
personne physique ou morale en lien avec l’organisation sur le terrain du Bike Park, dans
la mesure où l’accident ou le dommage causé ne découle pas d’une faute intentionnelle
ou grave.
d. L’utilisation du terrain susmentionné pose des exigences élevées quant aux capacités
d’attention, à la forme physique et mentale ainsi qu’à la discipline de l’utilisateur.
L’utilisateur certifie par conséquent qu’il ne souffre d’aucun handicap et qu’il n’est pas
sous l’influence de l’alcool, de drogues ou de médicaments pouvant influencer sa capacité
d’utilisation lors de son utilisation du terrain susmentionné.
e. L’utilisateur doit pleinement respecter les instructions des collaborateurs et du personnel
du Bike Park ainsi que des mandataires de l’exploitant.
3. Modalités d’utilisation / Règlement du parc.
a. Le port du casque intégral et de protections est obligatoire dans toute l’enceinte du Bike
Park.
b. Il convient de rouler lentement et avec prudence aux endroits où la visibilité est mauvaise.
c.
Il convient de toujours conserver une distance de sécurité suffisante. Obligation de
toujours laisser la priorité au cycliste de tête, aux cyclistes plus lents ainsi qu’aux cyclistes
plus faibles. La bousculade est formellement interdite.
d. Il est formellement interdit de s’arrêter sur les pistes. Il n’est permis de s’arrêter qu’endehors des pistes.
e. Il est formellement interdit de marcher ou de rouler sur les pistes dans le sens contraire
du parcours.
f.
Les pistes devraient être contrôlés systématiquement avant d’être empruntées par les
cyclistes.
g. Des contournements ont été mis en place au niveau des obstacles du parcours pour les
cyclistes moins expérimentés.
h. Les panneaux présents le long des pistes et les marquages au sol doivent absolument
être observés et respectés pour éviter les accidents. Il convient de faire attention aux
promeneurs, piétons et véhicules forestiers pouvant se trouver dans le Bike Park.
i.
L’utilisateur doit pleinement respecter les instructions du personnel du Bike Park. Les
contrevenants peuvent être sanctionnés par l’interdiction de rouler et l’expulsion du
domaine.
j.
La Straßenverkehrsordnung (StVO) [Code de la Route allemand] doit être respectée sur
les voies et chemins publics. Ses règles de priorité doivent particulièrement être
observées sur les zones dangereuses telles que les chemins entre la navette et le départ
et la sortie ainsi que celui menant au parking de la navette. La circulation doit être prise
en compte et le comportement adapté en conséquence.
k.
Chaque utilisateur est tenu de préserver l’environnement et la nature. Les déchets
peuvent être jetés dans les poubelles se trouvant près de la caisse (à la Talstation) ainsi
que dans les poubelles se trouvant près des toilettes en face du parking de la navette (à
la Bergstation).
l.
L’accès aux pistes est formellement interdit aux piétons. Il y a danger de mort !
m. Les billets pour une journée simple ne sont pas transférables. Les billets perdus ne sont
pas remplacés. Le personnel du Bike Park effectue les contrôles d’accès.
4. Parking
a. Les visiteurs du Bike Park se garent uniquement sur les places de parking et
emplacements signalés par des panneaux ou par le personnel du Bike Park. Cela
concerne en particulier les places de parking se trouvant en contrebas du Franziskus
Gymnasium [lycée Franziskus], à droite et à gauche de la Kreisstraße K 36, ainsi que
celles se trouvant à proximité du Asche-Sportplatz, [terrain de sport] en contrebas du
Franziskus Gymnasium, à proximité directe du podium de départ du Bike Park.
b. Il est entre autres interdit de se garer sur le Asche-Sportplatz par temps de pluie ou temps
humide.
c.
Il n’est pas autorisé de se garer sur le parking devant le Franziskus Gymnasium. Il s’agit
d’une propriété privée. Il convient de respecter les indications du propriétaire. En cas
d’infractions, le propriétaire s’adressera directement au personnel du Bike Park. Cela peut
donner lieu à une interdiction de rouler et une expulsion de l’exploitation du Bike Park.
d. Le parking est gratuit. Il est interdit de s’arrêter et de se garer devant et derrière les voies
d’urgence. C’est la seule façon de s’assurer que les voies d’urgence soient toujours libres
d’accès.
5. Réduction de la longueur des pistes
a. Il faut s’attendre à ce que des portions de pistes ou des pistes complètes soient fermées
pour travaux de maintenance, accidents ou toute autre raison pouvant compromettre la
sécurité de l’exploitation. L’exploitant signale à l’avance les pistes ou les portions de
pistes fermées au niveau du podium de départ et à la caisse, dans la mesure du possible.
b. Un nombre réduit de pistes disponibles ne donne pas le droit à une réduction ou un
remboursement du billet acheté.
c.
Des situations météorologiques imprévues (vent fort, orage, etc…) ou des problèmes
techniques sur les autobus de navette qui nécessitent la cessation des activités pour des
raisons de sécurité ne donnent également pas le droit à un remboursement du billet
acheté.
6. Horaires d’ouverture
a. Le Bike Park ouvre les samedis et les dimanches, durant la période entre le 01 avril et le
31 octobre.
b. Il se peut que le Bike Park ouvre pendant les vacances et les jours fériés de la période
susmentionnée, dans la mesure où l’exploitant l’a explicitement déclaré.
c.
En cas de mauvais temps, ou autres phénomènes naturels imprévisibles ou prévisibles,
l’exploitant se réserve le droit de fermer le Bike Park selon son choix, même pendant les
heures d’ouverture.
7. Utilisation en-dehors des horaires d’ouverture
Il est formellement interdit de rouler sur les pistes du Bike Park en-dehors des horaires
d’ouverture. En cas d’infractions, l’exploitant se réserve en conséquence explicitement le droit
