Re: Comments on Proposed Rulemaking Order concerning implementation of the
Alternative Energy Portfolio Standards Act of 2004 published in the Pennsylvania Bulletin
on July 5, 2014
Docket Number: L-2014-2404361
Dear Pennsylvania Public Utility Commissioners:
Please keep Pennsylvania fair for clean energy. At a time when the rest of the world urgently
seeks clean energy, it is stunning that Pennsylvania would suggest new rules designed to
discourage and limit private investment in clean energy. These rules, addressed below, are
without technical basis and fail to consider the benefits of clean energy to all citizens of
Pennsylvania.
We urge that you withdraw changes to §75.13(k) giving the Commission authority to approve
utility company requests to charge net metered customers special fees. When homeowners and
small businesses spend their own money to build clean energy sources, we all benefit. Please do
not open the door for utilities to discourage and penalize clean energy system owners.
We urge that you withdraw changes to §75.13(a)(3) adding a new 110% generation limit on
system size. Consumers spend their own money to install a clean energy system. Deciding how
much to spend and how big the system needs to be is a private matter. This rule would require
every homeowner and small business owner to convince his or her utility company (somehow)
that the system they want to purchase will generate less than 110% of the electricity they use.
This is impractical, intrusive and expensive to administer. It is also unneeded. Pennsylvania
already has a rule for maximum size—50 kW for a residence and 3 (or 5) MW for a business,
period. It’s simple, works fine and is the same for everyone.
Thank you for providing a regulatory environment that supports the responsible use of clean
energy in Pennsylvania.
Sincerely,
The Undersigned
MRRER

There is no legitimate, practical reason to
charge individuals with PV systems a fee to
generate electricity for their own use any
more than they should get a surcharge from
the water company for having a well. This is
just a transparent political tactic that is
promoted by the fossil fuel industry to
prevent development of distributed clean
energy production in the name of corporate
profit. In addition, the limitations and rules
are extremely vague, and consumers do not
have ANY options to switch their energy
supplier. Thus, the suppliers effectively
make the rules, and there is no incentive at
all for suppliers to provide a competitive
product (e.g. $0 PV or net metering fees).
That is what is known as a monopoly, and it
is clearly disadvantageous to the welfare of
the general public. Expect a legal battle...
Thansk you for alerting us about these
potential issues.

Until there is definitive proof that net
metering is a financial burden to non solar
ratepayers, there is no need to change the
existing rules.

It would be very unwise (dumb) not to
encourage the growth of renewable energy
solutions in PA.
Renewable energy is such a small portion of
the electricity generated and used in PA. Not
only should clean energy receive fair
treatment in PA but the boarders should be
closed for SRECs and increase the % of
electricity generated by renewables.

I support this cause! You should too! Our
entire country is in transition to a sustainable
clean energy future as should be the entire
planet. Don’t create artificial man made
barriers that will discourage the adoption
clean energy systems. You should be
making it easier and more affordable for
customers to make the transition. The
utilities business model is outdated and
needs to evolve in a fair and responsible
manner. Don’t attack customers to protect
profits.

Go MAREA. Rules proposals §75.13(k) and
§75.13(a)(3) smacks of regulatory capture
by the utilities. It’s an imperative that the
citizens and it government adopt policies
and take actions that benefit all of us and
coming generations by supporting
renewables, not inhibiting them. The
proposals are just so wrong-headed. Where
is PUC’s leadership in the renewable area?
When enough energy from sunlight falls on
the earth in approximately one day to power
all of humanity for a year! Compare and
contrast such initiatives as expressed in
proposals §75.13(k) and §75.1 3(a)(3) to NY

As a responsible person, aware that
we,humans, are too successful as a species
and have begun to overpopulate and over
use the natural resources this planet offers, I
have chosen to do as much as possible to
minimize my impact. If we want to offer a
world, comparable to what we have to our
children, and their future generations, we
must take steps now to prevent further
erosion of our air and, our natural resources.
Our government should be looking at the
long range and legislating and regulating to
encourage doing what is necessary to
preserve our quality of life, not pandering to

Tax the use of sunlight? What an asinine
concept.. what’s next? Tax us for using air,
tax us on the rain that falls on our land?
What idiot thinks this is a good or even legal
concept?

We will be judged by our grandchildren’s
children by what we do today to insure that
they will have the ability to survive in a post
carbon energy world. For once in our selfish
lives we should think about those who will
inherit the results of our expedient choices.
Imagine a world where humans are only
dependent on the wind, water and sun for
their energy.

We should be doing all we can to help
businesses and individual citizens move to
alternative and independent energy sources.
Taxing and over-regulation would be
unwise.
The utilities have checks in place to ensure
the quality of electricity moving back onto
the grid is at the required level. This is an
additional cost to the consumer during
installation. In addition, the payment to the
generator is much less than the cost of
generation by any other supplier, allowing
the utility to capitalize on the resale.

Hey PUC STOP doing big energy’s dirty
work. You MUST do everything in your
power to make solar and wind energy
EASIER to deploy. Do not approve any
new rules that put further barriers or other
impediments in the way of solar and wind
energy. These proposed changes are
OUTRAGEOUS! The commission MUST
stand up to industry and make it clear that
this type of unnecessary regulation will not
be tolerated.

Most homeowners who invest in clean
energy, as my wife and I have done, do so
out of a conviction that this is the way that
energy will be provided in the future and
they want to lead by example. Few if any
believe that it is a money-making
proposition. We expect to make our money
back in energy savings over the course of 10
or 20 years but that presupposes that we live
that long, that we can afford to stay in our
homes etc. Putting road blocks in the way
of people trying to do the right thing for
themselves, their community and their
country seems short-sighted at best, and
smacks of undue influence from the
purveyors of dirty energy who refuse to lead
the inevitable changeover to renewable
energy sources.

While I do support some limits to Solar PV
system abuses, I do believe that imposing
fees for Solar PV owners (existing or new)
is a deterrent to any future system
installations or enhancements.
One way to fluctuate the Solar PV system
deployment is to limit the rebates available.
If someone wants to install a larger system,
they would be paying for it up-front without
tapping into rebates that the state has to
manage and pay for (ie. taxpayer funds).
Instead of paying customers the rebate fees,
the State of PA can use such funds for more
PUC study into why systems such as the
very expensive Smart Meter program at
PECO is not really doing anything for the
hundreds of millions of dollars that the
federal government has given to PECO to
implement. No new custom rate plans exist,
no electric rate plans to help smooth out the
demand curve by load-shifting to off hours,
no new support for electric vehicles to
charge at night during the low demand
cycle. I suppose a jobs program like this is
acceptable but independent power
generators are a problem for the state.
The small sector of Solar PV customers
being imposed a fee for generating
electricity flies in the face of conservation
and intelligent energy usage. It just makes
them “pay more” in order to participate and
many will choose not to participate.

It is NOT fair to penalize those of us who
made the investment and commitment for

sacrifices to save the money for such a huge
purchase to do my part to “go green”. I
saved for ten years to make that

Their is clearly no reason to give a utility
power and control over the people’s ability
to make personal investment and
improvements to their private property.
This would also grant a public utility over
reach when it comes to local governing
bodies, where the people living in the
community should not have their rights to
determine what works best for them.
We are supposedly a Capitalistic country
where consumers drive the economy and
success or failure of businesses. If
legislators make these changes they will be
doing so to thwart the very ideals that they
claim to support.

Additionally, It is time for the legislature to
change the rules governing SRECs in PA.
PA is currently only state in the nation that
allows the utilities to purchase all of their
SRECs out-of-state and to the lower bidder,
bypassing the economic benefits to its own
citizens of supporting local SRECs.

I understand the need to charge for the
distribution of electricity over the existing
power grid, as is already the case. But since
when is it a corporation’s business to tell me,
a private citizen, that I must pay them to
generate my own electricity? This smacks of
avarice by corporate executives and law
firms who are already overpaid. My yard,

Philadelphia is full of flat roofs that would
be perfect for solar. Solar should be
encouraged. These new rules only protect
the public utility that surely sees that in the
future solar will make big electric generators
obsolete. The future should be distributed
solar with the utilities acting as the
distributor and temporary storer of electric
power. Let’s move into a cleaner future
rather than make rules to keep the dirty
dinosaurs alive.

I am discouraged and disheartened that
Pennsylvania’s utilities and the PUC would
consider taking a step which would
discourage residents from doing their part to
help curb carbon emissions and supply clean
energy to their local utility with a solar
installation. We paid for our solar system
out of our own money. The Sunshine Rebate
Program was out of funds but we decided to
move ahead with our installation anyway.
Not only are we helping to reduce carbon
emissions but we provide power beyond our
needs, on sunny days, to help our utility. We
invested in the system, we are doing our part
to help deal with climate change and now
we are to be penalized for this. How does
this move encourage others to want to live,
invest, or do their part in helping with
overall climate issues in PA? Pennsylvania
is continuing to disappoint and be behind
other more progressive states. And that’s a
real shame.

We took on the expense of solar to protect
ourselves from endlessly escalating power
costs in the future, when our income will be
reduced. It is not equitable that, after the
fact, our utility could increase ur ongoing
costs by adding (and presumably increasing
over time) a fee that did not exist before we

This is a plan that A.L.E.C contrived on
behalf of one of its founders the Koch
Brothers. ALEC is the legislative arm of the
Tea Party Right Wing and the policies
created are geared to financially benefit
those powerful members of the 1% right
wing ;a wealthy and powerful small portion
of society .In this case the coal burning
electricity plants that tires Koch Coal will
benefit. This anti solar legislation makes it
more difficult to get off the grid by
punishing those that reduce or eliminate
their energy footprint when they should be
rewarded. The Kochs have been concerned
legislation that bolsters clean power would
erode their power base. This legislation was
trotted out and made law in Oklahoma
earlier this year and is being foisted on states
through their Republican Legislation.
I fail to understand why there is any
opposition to maintaining solar energy
installations in a State that uses as much
energy as Pennsylvania does. We should be
encouraging the installation of additional
solar energy panels where ever we can and
as quickly as possible to defray the damages
done by coal fired plants and Fracking for
oil reserves, a process that destroys the
aquifer and is dangerous to the people who
live close to the areas being abused.
Clean Energy through solar scares the utility
companies ,too, because if it becomes the
predominant method to power our homes
,businesses etc. it cuts out the middle man
Yet that would be a small sacrifice to allow
the
dawning of a cleaner America and world.
This legislation sucks and is a contrivance
by a group of oligarchs to maintain their pot
of gold and screw the rest of the nation and
world. Please do the right thing and vote it
down.
Let’s cover our parking lots with solar panels
which will provide energy for the Mall or
Business center and create shade for the
vehicles that park beneath. This is a win
win situation that should be promoted
throughout the USA!

Is climate change real or not? It seems
logical that if it’s only a possibility we
should be taking steps to avert or minimize
the adverse effects. To discourage the
development of clean energy i.e. solar is not
in the interest of mankind..
I have encountered elected representatives
who wrongly believe that as regards
renewable energy, Pennsylvania is
progressive and a leader. This proposal is
clear evidence that this is not the case, and
people need to be re-educated.

Perhaps we should look at who’s interest this
initiative benefits? Certainly not the general
public. Quash this foolish attempt to add
roadblocks and extra costs to the
implementation of more solar installations.

When I purchased my solar photovoltaic
system, I was helping PPL make their
mandated quota to have 20% renewable
generation by 2020 (not sure of the year).
Now you want to let the utilities punish me
for helping them out.
I know of 5 homeowner systems and all are
sized less than 80% of their yearly usage.
The 110% cap is not needed.

Now is the time to protect the manufacture,
installation, and use of solar panels and
equipment in Pennsylvania. Solar power is
clean power, and a growth industry badly
needed in the state. Please withdraw changes
to §75.13(k) and §75.13(a)(3) and take
Pennsylvania out of the hands of the
unaccountable fossil fuel corporations
whose products are driving accelerating
climate change. Remember that carbon
pollution from Pennsylvania will negatively
affect the atmosphere that everyone in the
world shares as they breathe. Please don’t
allow Pennsylvania to miss its chance at
being in the vanguard of creating clean
energy and thousands ofjobs you will not
get a second chance.

Is it unfair to change the economic benefits
of an existing installation after the purchaser
has decided to pay for it. We should be
encouraging solar by raising fossil fuel
derived electric rates, not by adding fees for
solar or general connection charges.

i can see that the utilities do need some
money so i can use them as back up power
when the sun does not shine or whenever my
system is not big enough to provide all my
needs. they need to maintain the lines and
power sources. that needed feature is not
free and homes with solar PV should pay for
those services.
we must recongnize that as solar users we
do use the power lines from the utility and
rely on them for power when the sun does
not shine or when our systems are too
small. so i expect to pay a service charge to
PECO along with any electrons i use. we
can not expect a free ride. bill
