hereby appoint and authorize Dawn Coates, a member in good standing with the Canadian
Society of Immigration Consultants (CSIC) membership ID# M052586, hereinafter
referred to as the “consultant”, of Guardian Nanny & Immigration Services Inc., located at
106 Farrell Crescent, Fort McMurray, Alberta, Canada, hereinafter referred to as the
“company”, to provide limited Labour Market Opinion application services to me/us.
I/We, _______________________________________, hereby authorize the consultant as
well as any of it’s staff members who are eligible, to prepare on my/our behalf any matters
either in whole or in part that are related, required or deemed appropriate as it pertains to
the above said application services.
DECLARATION
I/We, _______________________________________, hereby affirm that I/we have not and
will not present any fraudulent, false or misleading information or documentation to either
the consultant or the company.
I/We understand and agree that it is my/our responsibility to ensure that all required
information and documentation required by either the company or the consultant is
provided in a timely manner.

SERVICES
The consultant and the company will provide the following services and may provide
additional services at additional costs if required or if requested and authorized to do so by
the client.




Preparing entire application for a Labour Market Opinion
Detailed instructions to client with regards to the steps required before and after
submission of the Labour Market Opinion application
Detailed instructions to client on how to finalize and submit said application to the
appropriate Service Canada office
Complete employment contract
FEES
Professional fees of $375.00 plus G.S.T.
TERMS OF PAYMENT
The client agrees that the fees listed for the above services are block fees covering only the
services outlined in this retainer agreement.
The client understands that this block fee will be placed in a trust account and will be
payable to the company upon the completion of the said services.
An invoice of billing and transfer of funds will be sent prior to any funds being paid from
this trust account. These billings include all anticipated disbursements.
ADDITIONAL SERVICES AND DUE DATES
If and when additional services or disbursements are required or requested and authorized
by the client, the client agrees that the client shall be billed at a rate of $150.00 plus G.S.T.
per hour required, in 15 minute intervals with a minimum of 1 hour as well as any and all
disbursement charges accrued on the client’s behalf.
The client agrees that should additional services or disbursements be required or
authorized, the client is to pay the estimated cost of these amounts prior to any furtherance
of work on the clients case. This money shall be deposited into a trust account and will only
be payable to the company once it has been earned. The client will be sent an invoice of
billing prior to any funds being paid from this trust account.
The client understands and agrees that if payments are not made as stated in this retainer
agreement, the client shall be responsible for all recovery costs incurred by the consultant,
the company, or both, in order to recover said costs, and the company shall not be held
liable. By signing this agreement, the client gives permission for the consultant, the
company, or both, to take any appropriate action in recovering such fees and the
consultant, the company, or both, may suspend or cease work on the client’s case.

REFUNDS
The client agrees that the above professional fees are non-refundable once work has
commenced on behalf of the client. Should the termination of services either on the
consultants or the company’s part take place, all monies earned by the consultant or the
company as well as any disbursements paid or owed on the client’s behalf by the company
will be deducted from the professional fees.
The client agrees that should the fees paid to date not cover any expense owed, said fees will
be due and payable upon termination of services.
CONDITIONS AND OBLIGATIONS
The client understands that, until such time as this agreement is signed, the consultant or
the company will not be liable or responsible for any payments made nor will any receipts
be issued for said payments.
Should the client withdraw their application, the client understands that there are no
refunds for the services rendered.
The client understands that it is their responsibility to ensure that they qualify to hire a
foreign caregiver in Canada and that in no way is the company or consultant liable should
the client fail to be approved by Service Canada. The client understands that a refusal
based on reasons not the fault of the companies information provided will not be the
responsibility of the consultant or the company.
The client understands and agrees that the maximum recoverable to the client shall not
exceed the amount paid to the consultant or the company.
AGREEMENT
This agreement shall be construed as governed by Canada and that of the state and
country of the clients’ nationality and place of habitual residence. Each of the parties
hereto irrevocably atourns to the jurisdiction of the relevant court authorities. The interest
rate on payments in default including any recovery costs shall be 15% per annum from the
due date. Recovery costs shall be considered to be due and payable at the time of
incurrence.

The client hereby confirms understanding and agrees to the above terms and conditions of
this agreement including parameters of fees, services, procedures, and the mutual
responsibilities.
