MidPenn Legal Services Legal Aid: Critical Help for Critical Moments MidPenn Legal S MidPenn Legal Services 2006 MidPenn Legal S Mission Statement MidPenn Legal Services is a non-profit, public interest law firm dedicated to providing equal access to justice and high quality civil legal services to low-income residents and survivors of domestic violence in eighteen counties in central Pennsylvania. MIDPENN LEGAL SERVICES Executive Director’s Message One Team, One Program Rome wasn’t built in a day. MidPenn Legal Services has made significant progress in recent years in coming together as one team and functioning as a regional law firm. We are determined to be the best of both worlds. On the one hand we are a large regional law firm, covering eighteen counties and more square miles than any other legal aid program in Pennsylvania. On the other hand we are fourteen compact local offices with established roots and local connections. Many epic battles involve overcoming the challenges of geography and ours is no different. Central Pennsylvania has great differences in population and culture but people are people. Our aim is to treat everyone the same - whether they are applying for service in DuBois or Reading, Pottsville or Bedford. And the needs of clients from a rural area are as important as those from any city. Utilizing technology and thinking strategically, we can integrate the roles of the regional firm and the local offices. Our clients deserve nothing less and our funders expect efficient success. These are but some of the strategies we are implementing to maximize our effectiveness and to function as a team: • We have implemented program wide uniform case acceptance guidelines and priorities. • Substantive law groups have been formed and meet every two months to provide training and stay atop developments in areas of critical interests to our clients: housing, family, consumer, public benefits, disability, employment, elderly, and utilities. • Numerous listservs covering these subjects connect staffers throughout the program for a free flow of information. –1– MIDPENN LEGAL SERVICES • • • Special projects are underway to increase our effectiveness in critical areas: predatory lending, employment, public benefits and providing medical assistance information to seniors. An Ombudsman project is in place in two counties. The entire staff and board have retreats twice each year to come together and share information on legal developments and review issues and solutions. A donor newsletter, MidPenn Matters, and an in-house newsletter Inside MidPenn, keep all staffers informed of the work and personal development of members of the MidPenn team. We are closely monitoring our fiduciary duties. The watchful eye of MidPenn’s accounting team has resulted in repeated clean audits. Our Finance Committee meets on a regular basis to stay current with all pertinent issues. Our Development Committee meets before every Board meeting and is aggressively pursuing new fundraising strategies. MidPenn is not an island. We are an integral part of the justice system in Central Pennsylvania. We need to continue to connect with our bar associations and to seek new partners. We are embarking on new projects as this report goes to print. We are conducting a needs survey amongst our client community and members of the bench and bar. We are in the middle of a strategic planning process to ensure that MidPenn continues to move ahead. Providing legal aid to needy residents of central Pennsylvania is a battle worth winning. Our communities are stronger when everyone has access to an attorney. Please join us in supporting the work that MidPenn advocates do each day to make our communities stronger. Rhodia D. We’re doing great now,” says Tammy. –4– MIDPENN LEGAL SERVICES When A Parent Snatches A Child Tammy Dowis was recently divorced from her husband of twelve years but she bore him no ill will. He was jobless and homeless but she made their eleven year old daughter, Alicia, available to him for frequent visits. But he began to exhibit signs of erratic behavior. When he made suicidal threats and put his fist through a wall, Tammy contacted Crisis Intervention. Alicia’s Dad thought Tammy was going to limit his visits. He went to her school in Red Lion and signed her out, telling her he was moving to Florida and taking her along. “I was beside myself,” says Tammy. “I called the police but when they found out I didn’t have a court order there was nothing they could do to stop him.” A social worker at Children & Youth directed her to MidPenn Legal Services in York. Attorney Gerry Studzinski had seen it all before. He promptly filed a Custody Complaint and got a hearing date within two weeks. “He assured me that what her Dad had done was wrong and that the court would back me up,” says Tammy. The court directed the case be held in Pennsylvania as it was the home state. Alicia was returned to Tammy who drove to the airport in Washington D.C. to pick her up. Shortly afterwards the father participated in the Custody Conciliation Conference by phone. He later signed a paper agreeing to follow the terms of the court order. Alicia will take more trips to Florida but it will be with the protection of a court order. “She just finished fifth grade and she’s getting ready to go with her Dad for the summer. I’ll miss her but I know she has to see her Dad, too. “I know he will return her because we have the court order. I’m not worried. MidPenn was there for me when I needed them. We’re doing great now.” –5– MIDPENN LEGAL SERVICES MidPenn Attorney Brenda Zimmerman helped “George” get the help he needed and retain his job despite a struggle with mental illness. Instead of being unemployed and without health insurance, George kept his job and is doing well. –6– MIDPENN LEGAL SERVICES Protecting Employment Rights Even today people don’t talk about mental illness so much as whisper the words. A client we will call George has good days and bad days. He tries mightily to string the good days together but sometimes his condition gets the better of him. Then he needs to have inpatient treatment at a proper facility along with appropriate counseling. George didn’t choose to be schizophrenic. He had a good work record at the factory and had been there a number of years without an incident. But after a severe episode he had to take a leave of absence to be treated. George gave his employer notice of his situation and turned in notes from his licensed psychologist. Afraid that George had not informed his employer, his mother also talked with his employer about his need for treatment. George requested leave time under the Family and Medical Leave Act (FMLA) and the employer promised to send him the appropriate form. This law gives employees the right to request up to twelve weeks of unpaid medical leave to attend to a serious health condition. But instead of acting on his request and inquiring into his heath condition, the employer fired George and canceled his insurance. He was told he could reapply for a job in the future. He was without an income and had no medical coverage. He contacted Attorney Brenda Zimmerman of the Lewistown MidPenn office. Attorney Zimmerman quickly contacted the employer to discuss the case. She pointed out the law and explained George’s rights under the FMLA law. The employer agreed to grant the leave and reinstated George’s job and health insurance. George has since recovered from his episode and returned to work at the factory. He didn’t lose his job or his seniority and he is a steady employee. Without MidPenn, George would have fallen through the cracks. Instead of being unemployed and without health insurance, George is doing well. He is another example of MidPenn providing critical help at critical moments. –7– MIDPENN LEGAL SERVICES Kathleen Kline had to fight to get the surgery she needed but her MidPenn lawyer stood by her side. “I thought I was right. I’m feeling less pain.” –8– MIDPENN LEGAL SERVICES Fighting To Get Medical Care Kathleen Kline had tried everything to deal with the excruciating pain in her jaw. But years of medication, mouth guards, physical therapy, bio-feedback, and counseling to deal with her pain did not work. The pain was relentless and getting worse. It woke her up at night. It severely limited what she could eat. Her weight dropped from 115 to 95 lbs. She had to do something. By sheer persistence she succeeded in securing the services of a University of Pittsburgh Medical Center board certified oral and maxillofacial surgeon who was an acknowledged expert in TMJ surgery. Dr. William L. Chung, DDS, MD authored chapters in the primary textbook on the operation. There was only one hitch - the Department of Public Welfare denied her request for payment, saying the operation was not necessary. State College office MidPenn attorney Susan Michalik filed an appeal. TMJ surgery is sometimes controversial and medical opinions vary as to its value in some cases. But Dr. Chung was confident that Kathleen would benefit from the procedure. Attorney Michalik knew she needed to overcome the opinion of the Department’s reviewing physician. Dr. Chung agreed to testify as to the need for the surgery. Not only was he an expert in this area but he had actually met the patient and reviewed her medical records. He knew what she had gone through. He stated that her condition had deteriorated to the point where only the surgery could help. When the Secretary of Public Welfare remanded the case for further review, the Department determined that the surgery was indeed appropriate. “There are hundreds of stories like this one,” says Attorney Michalik. “Sometimes you need an advocate to get what you need from the system. You have to prove your case.” Attorney Michalik spoke with Kathleen a few weeks after the procedure. “Her jaw was wired shut but she wanted to tell her story. She is already getting some relief. She’s proud of what she achieved and she wants others to get the care they need.” –9– MIDPENN LEGAL SERVICES Adam Griswold sends Attorney Peg Simok photos every year to say thanks and to let her know how he and A.J. are getting along. She says, “This is why you stay at Legal Aid.” – 10 – MIDPENN LEGAL SERVICES Big Man for a Little Boy Adam Griswold was only 18 years old when his son, A. J., was born and things were not going well in his life. He had dropped out of school when he was 16 and a scrap with the law had netted him six months probation. That got his attention. A.J.’s mother was also quite young and a serious bout of post partum depression left her not ready to be a parent. A short time after the birth she moved back with her folks and let Adam care for the child. Adam had to grow up fast. It didn’t go smoothly at first. The mother came to the Adam’s home at all hours without notice. She would show up at the residence early in the morning and demand to see the child. If Adam didn’t answer the door, rocks would be thrown at his windows. Adam had to call the police. A family member suggested he contact MidPenn. Adam had never talked with an attorney before he went to the Harrisburg MidPenn office and he was apprehensive. “But I figured it was to help us out.” He met with Attorney Peg Simok. After a number of courthouse conferences Adam emerged with primary custody of A.J. Adam was pleased with his lawyer. “ She called every few days and told me what to do to stay out of trouble.” If an issue arose, Adam was to call the police and not take matters into his own hands. He wanted to do it the right way for A.J.. “A.J.’s mother and I are cool now. I think it’s good that A.J. has contact with his mom. Having my son was the best thing that ever happened to me,” he says. Adam has obtained his high school diploma and recently was promoted to full time work. He is also taking courses online in criminal justice. He wants to be a parole officer or a policeman. When he first saw Attorney Simok he noticed she had some client photos on the wall. “A.J. is now three years old. Every year I send her a picture to thank her and let her know how we are doing.” Attorney Simok holds the latest photo proudly and says simply, “This is why you stay at Legal Aid.” – 11 – MIDPENN LEGAL SERVICES A car repossession threat was the just tip of the iceberg for Bonita Weland. A team effort by MidPenn advocates saved her home and got her the help she needed. – 12 – MIDPENN LEGAL SERVICES Getting to the Bottom of It Sometimes there are so many things wrong it is hard to tell where to start. When Bonita Weland went to the MidPenn office in Lebanon she thought her main problem was that her car was going to be repossessed. She met with Attorney James Orgass who asked why she was behind. As Bonita talked it became clear the car was the least of her worries. She was behind on all the bills. Her home was in foreclosure. She had quit her job as a Certified Nursing Assistant three years ago to care for her husband. He was a truck driver who had become seriously ill and had recently passed away. Bonita had focused all of her attention on him. Now he was gone. With their two incomes things had been fine. Everything changed when he got sick. Bonita stayed by his side when he became bedridden. A Social Security check kept them marginally afloat. When he died, she lapsed into a deep depression and was unaware of her own health issues. Her lawyer noted that Bonita had arm and neck tremors and presented with a very low affect. Bonita desperately needed an income but her health ruled out her old job. Attorney Orgass called Valerie Case of the Lancaster office, a paralegal with over 35 years of experience. Valerie specializes in Social Security matters. Step one was to get Bonita a medical assistance card so she could see doctors and document her condition. Not only was she clinically depressed, she was in the early stages of Parkinson’s disease. But she had to be able to prove it. While Valerie worked to get her Social Security disability on the fast track, Attorney Orgass tried to stop the foreclosure. He filed an application under an emergency home owner’s mortgage assistance program. This was not successful but it did provide time for Valerie to get the Social Security case to an Administrative Law Judge who granted a favorable decision. With a steady income stream and retroactive Social Security benefits, MidPenn was able to negotiate with the bank and save the home. Bonita will continue to face health challenges but she will have a roof over her head, an income and medical care. Her world is much improved. Without a legal team trained to get to the bottom of things, the community would have someone in crisis, not a neighbor at peace. – 13 – MIDPENN LEGAL SERVICES Patrick Cicero specializes in predatory lending cases. “People need a lawyer to sort through this type of case. If we had not stepped in, Tara would have lost her home unnecessarily and illegally.” – 14 – MIDPENN LEGAL SERVICES Saving Tara’s Home, Saving Tara’s Family Tara Williams is not her real name. This young mother of four was working hard and making ends meet when domestic violence caused her world to blow up. “I had a black eye more than once,” she says. “My kids were asking me what was wrong.’” Her husband went to jail for assaulting her. With him gone she couldn’t carry the full load. “I had no child support, no alimony, no nothing.” To save the home she filed a Chapter 13 bankruptcy. She got a better job and with the new position she was eventually able to get caught up with her payments. But just after getting out of bankruptcy her mortgage company tried again to foreclose, alleging unpaid fees. “Just when I was looking to move forward I was back in the darkness again,” she says. Tara was not just another uninformed consumer. She had a degree in finance from her local community college. She made every attempt to reinstate her mortgage. They told her she had to come up with $3000 in fees and she went to every relative and friend she knew and got the money. But the mortgage company then insisted she owed yet an additional $2000. “I would have agreed to pay whatever they asked for. I just knew I had to save my home. But they were downright rude. They said to me: “Why don’t you just move?’” That did it. The YWCA referred her to the Harrisburg MidPenn office and she met with Attorney Patrick Cicero who specializes in predatory lending cases. “Patrick saved the day in so many ways I can’t even describe it,” she says. He couldn’t understand where the mortgage company was getting their numbers. When they stonewalled every attempt to negotiate the case Attorney Cicero filed papers to stop the sale, alleging that the fees were both arbitrary and excessive. The mortgage company settled the case and rewrote the mortgage. Tara’s interest rate was reduced from an adjustable 10.2% to a fixed rate of 7.5%. All monies paid toward fees were applied to her principle balance. The mortgage company lawyers even waived their attorney’s fees. “People need a lawyer to sort through this kind of case,” says Attorney Cicero. “Tara was getting nowhere by herself. If we had not stepped in, she would have lost her home unnecessarily and illegally.” Ironically, Tara is now a financial counselor for a local investment bank. “If this can happen to me, it can happen to anyone,” she says. “I didn’t want to sue anybody. I just didn’t want to pay more than I was supposed to pay.” – 15 – MIDPENN LEGAL SERVICES A vindictive landlord refused to return rent and a security deposit even though she could not move in. “He knew he was wrong. I just wanted my money back,” says Lovett. – 16 – MIDPENN LEGAL SERVICES Lovett Falwell A Single Mom’s House of Cards Lovett Falwell had two young children and she desperately needed both a job and a place to live. When she answered a want ad for a cleaning job she thought she might have both. The employer had numerous rental units and in addition to hiring her for the cleaning job, he rented her one of his apartments. She reached deep to come up with some of the money for the first month’s rent and the security deposit. The landlord withheld the rest from her paycheck. She paid him a total of $1349. Problems arose before Lovett could even move in. The only financial assistance she received was a Section 8 certificate which supplemented her rent. But the apartment flunked a required inspection. The inspection report listed what had to be fixed: install glass in windows, replace rotting wood throughout, insure windows opened properly, and remove a sofa from the front porch. Lovett did her work, continued to live with friends and hoped the landlord would soon fix up the premises. But the landlord did none of the required work and did not even appear for the reinspection visit. When she asked for her money back, he refused even though she had never spent a day in the apartment. Worse yet, the landlord cancelled his agreement with the Section 8 program. Not only did she not have a home or her money, her Section 8 certificate was now imperiled. She had kept her part of the deal and worked hard but everything was falling apart. Lovett had no choice but to quit the job. “I was so angry. I didn’t know what to do. My brothers offered to help me deal with the situation but I wanted to do it the right way. She contacted the Lancaster office of MidPenn Legal Services and saw Attorney James Orgass. When he couldn’t get the landlord to agree to return the money he took action. He filed to get an extension of her Section 8 certificate which was about to lapse. Secondly, he filed a Complaint alleging Unfair Trade Practices and violations of the Wage Payment and Collection Law. Lovett wasn’t looking to cash in. She just wanted her money back so she could get on with her life. She soon received payment in full. She also kept her Section 8 certificate and found a decent apartment. “He knew he was wrong, I just wanted my money back. Hopefully, he’ll think about this in the future and not do it to someone else,” she says. Lovett is currently holding down a third shift machine operator job but she is looking for other work. – 17 – MIDPENN LEGAL SERVICES SPECIAL PROJECTS MidPenn Legal Services The Consumer Law Team – Fighting Predatory Lending Predatory lending is a hot topic in our area for good reason. Statistics show that Pennsylvania has the ninth highest foreclosure rate in the country. MidPenn advocates are actively engaged in the battle and last year handled 1645 consumer related matters. The term predatory lending also includes unfair sales practices and payday lending as well as refund anticipation loans. MidPenn Legal Services Predatory lending destabilizes families and neighborhoods and targets the elderly, poor, and minorities. MidPenn advocates have also seen an increase in the number of debt collectors taking cases to court without any real proof of the debt they claim is owed. Often, the debt collectors win these cases when the client is unrepresented or does not appear. MidPenn’s Consumer Law team is fighting back against these abuses by successfully representing clients who face this type of abuse. They have been successful in many instances in proving that the claimed debt is vastly overstated or by reducing by thousands of dollars the amount owed. In other cases, they have negotiated settlements where the creditor withdraws its legal action entirely. By sharing information and expertise with other MidPenn advocates, the entire organization is better equipped to represent embattled consumers. – 18 – MIDPENN LEGAL SERVICES Medical Assistance Outreach to Seniors Project – Knowledge Is Power The world is a confusing place. Just ask a senior citizen about their rights to medical assistance. There are a number of programs to help seniors with their needs but these consumers need to be educated both as to what is available and what fits their needs. Together with an IOLTA grant and a partnership with the Pennsylvania Health Law Project this MidPenn project is designed to educate both seniors and their caregivers in nine rural counties with a significant percentage of senior citizens: Bedford, Franklin, Fulton, Huntingdon, Juniata, Lebanon, Perry, Mifflin and Schuylkill. The partnership has produced a comprehensive manual to answer commonly asked questions about the Medicare and Medicaid programs. In addition, MidPenn advocates meet with seniors at personal care homes and other group settings to speak about the programs they may be eligible for, from prescription medication coverage to transportation issues. Over twenty-five presentations were made and over 100 consumers were provided with information. The Public Benefits Project – Aiming for Self-Sufficiency Public benefits programs are an essential means of survival for many MidPenn clients. The laws that regulate these programs are extremely complex. MidPenn advocates participating in this project have become experts in dealing with these regulations. Public benefit programs include food stamps, Low-Income Housing Energy Assistance Program (LIHEAP), Temporary Assistance for Needy Families (TANF), General Assistance and Medical Assistance The goal is to get clients the benefits to which they are entitled and to help them climb out of poverty. The project includes special training for advocates in these regulations. Dedicated listservs provide a way for project participants to share both questions and solutions in this difficult area of law. One project goal is to reach out to local County Assistance Offices and meet face to face to establish common ground. Good communication with these local offices can result in the early intervention and resolution of issues favorable to our clients without the need for hearings and further litigation. – 19 – MIDPENN LEGAL SERVICES The Employment Project – Removing Barriers to Employment The poor face many hurdles in getting jobs. Some have driver’s license problems that severely limit their employability. For others a criminal record from the distant past can be an impediment. Some employers illegally refuse to accept job applications. MidPenn’s Employment Law Project helps clients obtain employment, secure employment-related benefits, and overcome illegal employment practices. The MidPenn Employment Law team members have been trained to spot work related issues. In addition, they conduct outreach sessions to get the word out to the community that MidPenn advocates can assist low-income clients with employment related matters. The Ombudsman Project - Protecting Our Elders Many older people are faced with obtaining long-term care outside their own home. But not many know their choices or understand their rights. MidPenn’s Ombudsman Program operates in Schuylkill County and Lebanon County with the support from each county’s Office of Aging. The program ensures that seniors who need long-term care in a nursing home or an assisted living facility are treated with respect and dignity and that their rights are protected. The Ombudsmen provide both education and advocacy on behalf of those in long term care. Our Ombudsman visit each facility in their county at least twice a year. As a result, the facilities caring for these seniors know they must comply with all regulations concerning the health and well-being of their patients. MidPenn’s three full-time Ombudsmen learn about problems by visiting residents at the facilities. The program is assisted by many volunteers. – 20 – MIDPENN LEGAL SERVICES President’s Message Spring and summer in central Pennsylvania are so lush and beautiful it is hard to believe we have genuine problems here. Our gardens are in bloom, the trees are so green and the cities and the countryside seem full of hope. But amidst this hope there is despair. Poverty in central Pennsylvania is a very real issue. The 2006 census estimates that nearly 250,000 people in the MidPenn service area are living in poverty. Imagine a world where everyone who needed a legal advocate had access to one. In this perfect world every poor person and survivor of domestic violence would be able to meet with their own advocate. They would not have to fend for themselves or sweep dark secrets under the rug because they didn’t have someone to talk to about their critical legal questions. Imagine the impact this would have upon these individuals and their families. And finally, imagine the impact upon our communities if we could get their lives back on track with a minimum of community resources. Everyone should have an advocate for their critical legal needs. A large number of our neighbors are struggling just to get by. When they need a legal advocate it is for a genuine necessity: custody, access to medial care, housing, domestic violence, consumer protection, elder law and public benefits. These are not optional issues. These families desperately need to resolve their problems. For the great majority of them, we are the only answer. Our mission is to help them with their legal needs. The scope of this undertaking can be overwhelming. We have 43 lawyers, 22 paralegals and three ombudsmen to cover an area larger than the State of Maryland. But we do a lot with our limited resources. In 2006 we handled nearly 12,000 cases. On the one hand, we are doing it the old fashioned way, one client at a time. But we are also looking for new efficient and innovative approaches to get the maximum amount of needed information to those who need it. They say that information is power and we are mindful of trying things such as telephone “hot lines” to reach as many of our customers as possible. We could not undertake this task if we did not have a strong pool of legal talent. Many of our advocates have been practicing law with MidPenn for more than 30 years. Their dedication to this work is to be commended as they are not only wonderful advocates, but they serve as mentors, trainers and supervisors to the next generation of legal aid attorneys. While all of these individuals do this work because they are committed to it, their efforts have not gone unrecognized. Many of them have been recognized for their dedication, and commitment, by their local bar associations, the Pennsylvania Bar – 21 – MIDPENN LEGAL SERVICES Association, and the Pennsylvania Legal Aid Network. MidPenn is truly privileged, to have such dedicated staff working to serve those who are less fortunate. Our Development Committee is producing results and establishing collaborations with both traditional and new partners. For example, our Development Committee Chair, Executive Director, Director of Development, local staff, and Board members traveled around our region this past fall to meet with many of you. We undertook this trip to reconnect with you to discuss what we do, and how we plan to revitalize our development efforts so that we could continue to provide high quality legal services to the client eligible population in your community. We recognize that we have had great success in some areas and we want to replicate that success in others areas of our 18 county region. We truly enjoyed meeting you as we learned much about our region through our travels. As with any non-profit, funding is a key component and we are fortunate to have many partners in this endeavor. We truly appreciate the support we received from our primary funders, the Pennsylvania Legal Aid Network, the Legal Services Corporation and Pennsylvania IOLTA. We are also grateful for the support that we receive from many of the United Ways in our eighteen county region as well as from county and city governments. Many of our bar associations have taken a leadership role in funding their local MidPenn offices, resulting in stronger offices. Providing equal justice to those in dire need is a community effort. We are very thankful for all your support. We take our stewardship very seriously. In this report you can read some examples of individuals who have sought our help. As you read these stories, ask yourself what would have happened to these individuals and their families if MidPenn advocates were not there to help. You can also read about some of the special projects we have developed to address emerging issues in our region. A major source of inspiration is the number of attorneys who volunteer their time through their bar associations to assist us by handling cases we simply cannot cover due to limited resources. Making MidPenn work for our customers, our clients, is what we are all about. But our success also has a direct impact on our communities. By helping individuals, we help stabilize their families. Strong families make for strong communities. We are working toward that day when everyone, regardless of age, disability or income, can meet with an advocate to help them with their critical moments.
