MidPenn Legal Services Legal Aid: Critical Help for Critical Moments MidPenn Legal Services 2007–2008 Mission Statement MidPenn Legal Services is a non-profit, public interest law firm dedicated to providing equal access to justice and high quality civil legal services to low-income residents and survivors of domestic violence in 18 counties in central Pennsylvania. MIDPENN LEGAL SERVICES Executive Director’s Message Tackling Tough Times Welcome to the 2007-2008 MidPenn Annual Report. On the pages of this report you will read about people who were faced with the stark reality of struggling to keep their homes, to protect their safety, to feed their families or get on the road to health. The individuals on these pages are just a few of the people who MidPenn staff assisted in the past year. However, through the efforts of our advocates, illegal evictions were prevented, mortgage foreclosures were avoided, medical insurance was obtained, family violence was stopped and barriers to employment were removed. This is the work that MidPenn advocates do each day. Despite all that we do, it is estimated that only about one in five low income Pennsylvanians with civil legal aid issues receives the legal help they need. The ever-growing need for our services requires that we become innovative and find new ways to serve those most in need. For our part, we continue to evaluate our method of service delivery to ensure that we are meeting the most critical needs of the low-income communities we serve. Recently, we have developed substantive law units to address the problems our clients face in the consumer and employment areas. We have instituted the Telephone Advice Project which is spotlighted in the Special Projects section of this report. There you can also read about a non-legal project to assist low-income individuals, the I-CAN ™ E-File, which is a web-based software that allows lowincome workers to electronically file their income taxes and apply for earned income tax credits online at no charge. In the coming year, we will continue to face the challenge of trying to serve everyone who needs our help, while tackling the problems of funding shortfalls and rising costs. But as in the past, when faced with similar challenges, we will use these tough economic times as an opportunity to continue to evaluate the ways we provide service throughout our region while continuing to provide high quality legal services. –1– MIDPENN LEGAL SERVICES We recognize that we are not alone in our effort to make access to justice a reality. Innovative partnerships are producing tremendous results. Grassroots fundraising campaigns have allowed us to hire an additional attorney in three of our offices. Spotlighted elsewhere in this report is a unique program where a collaboration of funders has placed a MidPenn staff attorney in a medical clinic, the first such program in Pennsylvania. And there are many volunteer attorneys, law students, paralegals and others who work to assist us to serve the ever-growing needs of the poor. Without the efforts of these individuals many of whom are listed in this report, the gap between those who we can and can’t serve would be even greater. We are truly appreciative of your efforts and we thank you for lending your generosity, skill and time in assisting our client population. Rhodia D. Vicki Miller’s Fight to Save Her Home Resonates Across the Country Vicki Miller’s story was the lead in a Los Angeles Times article on July 5, 2008. The headline read “Bitter Lessons Learned From Refinancing”. How did a 52 year old single mom from Altoona make such a splash? Like too many people, she was taken in on a home improvement refinancing offer that seemed to make good sense. She had moved into her mother’s modest home in 2001 after her mother’s death, buying the home from the estate for $32,000. It needed work and within three years Vicky was over $15,000 in debt. Seven years later her debt had doubled, her equity had vanished and she was behind in payments and facing foreclosure. She is the face of the subprime mortgage meltdown. Vicky realizes now that she should have just stayed with her original loan. As an office worker she has a modest income. She readily admits that she didn’t understand what she was getting into; she just wanted to keep her home from falling into disrepair. Vicky didn’t understand about second mortgages and subprime loans. She wanted her son and her grandchildren to grow up in the same home that she did. For help, Vicki called the Center for Responsible Lending and she found her way to MidPenn Legal Services. MidPenn attorney Patrick Cicero is handling Vicki’s case. Patrick is in the Harrisburg office but consumer cases are his specialty and he stepped in to help. He says that it is a myth that the mortgage crisis was brought on by overreaching buyers. Most, like Vicki, were refinancing loans to enable people to fix up their homes or consolidate their debts. “There is a good chance of obtaining a favorable loan modification in this case,” says Patrick. “She has a number of very strong claims and she can demonstrate that she is able to pay a reasonable monthly payment.” Vicki has been placing $600 per month in an escrow account to show good faith. She is grateful for Patrick’s assistance. “I thank God every day for bringing Patrick and MidPenn into my life. I do not know what I would have done without his help.” –5– MIDPENN LEGAL SERVICES New MidPenn Attorney Jaime Haley knew there had to be a way to lift this cloud. –6– MIDPENN LEGAL SERVICES New Lawyer Helps New Nurse Keep Her License Battles Barriers to Employment to Help Single Mom Keep Her Job It started innocently. Sherry had put herself though nursing school so she would be better able to provide for her young daughter. But her car had over 240,000 miles on it and she required reliable transportation to get to work. She needed a car right away but she was short of the asking price. A local used car dealer said she could have a car that day if she wrote him a post dated check. She would have the money when she received her next pay check within two weeks. She wrote him a check for $1062.50 and dated it for her next payday. Within a week, however, the car broke down repeatedly and an independent garage confirmed that the car has serious problems. When she attempted to return the car she discovered the dealer had already tried to cash her check and it had bounced. When the car again broke down she had it towed back to the used car lot. She incurred more bank fees when the car dealer again presented the check to her bank. After an impasse of a few weeks she bought a car from another dealer and considered the matter closed. But then she received a certified letter: the first dealer had filed criminal charges against her. The charges put a cloud over her ability to work. She feared the Board of Nursing would suspend or even revoke her license. She had no prior charges, nothing like this had ever happened to her. Gettysburg MidPenn attorney Jaime Haley understood the importance of protecting a license; she had been an attorney for less than a year. She worked in conjunction with the Adams County District Attorney’s office. The charges were withdrawn and the D.A. joined with Attorney Haley’s expungement petition and the client’s record was cleared. She continues to work as a nurse. Sherry returned a client satisfaction survey that noted “I don’t know what I would have done without all your help. Thanks a million times over.” –7– MIDPENN LEGAL SERVICES MidPenn Paralegal Patricia Shilling fought for Mark and Maureen Tray and their staircase of stars. –8– MIDPENN LEGAL SERVICES Things We Take For Granted: Heat & Hot Water Persistent Paralegal Negotiates with Utility, Keeps Large Family Together Mark and Maureen Tray and their 10 children had moved to a better home in Pottsville but the gas bill from their last home had followed them. The former home was in terrible shape and had very little insulation. Their heating bill costs proved impossible to control. It didn’t help that for a time Mark was laid off from his job as a maintenance worker at a near by shopping mall. The gas company demanded full payment and when the Trays could not pay up, their service was terminated. When they spoke with MidPenn paralegal Patricia Schilling, they were desperate. Mrs. Tray was so worried that Children & Youth would split up their family that she could neither eat nor sleep. Ms. Schilling determined that one of the children had asthma and contacted the family physician to get a statement that the child’s medical condition would be aggravated if gas service was not restored. She faxed the statement to the gas company but they refused to turn the service back on. Finally, she contacted the Public Utility Commission. PUC regulations provide for restoration where an appropriate medical statement has been obtained. The next day the gas company called and offered to restore service if the client could come up with $558. They borrowed from friends and preserved their household. Ms. Schilling connected the family with the Community Action Program to enroll them in a budget program and get them assistance with some of their arrearage. Patricia recently visited the family just after all but one of the children had returned home from school. She said, “The house was neat as a pin and the kids were very well behaved. Both Mr. and Mrs. Tray kept thanking me for what we were able to do for them.” –9– MIDPENN LEGAL SERVICES Attorney Linda Timberlake went the extra mile and then some for Luis Torres – 10 – MIDPENN LEGAL SERVICES Treating Luis: More Than a File Holistic Approach Prevents Eviction, Wins Luis a New Lease on Life “When I first met Luis he was being evicted from a local rooming house because he had no money. He was an emaciated, disheveled alcoholic,” says Attorney Timberlake. As a child he had bounced around numerous foster care homes and been treated horribly. His arm had been broken; he had been chained in a basement. He was a Marine in Vietnam and returned with post traumatic stress syndrome. He believes his emphysema stems from exposure to the chemicals there. Linda talked the landlord into holding off on the eviction by letting him hold the title to Luis’s old truck while she filed for Social Security disability. Getting his medical records was a challenge because Luis remembered little of his personal history. Searching the internet, Linda discovered a school that used to be an orphanage where Luis had resided. They still had some records including a birth certificate, which revealed that he was not Louis but Luis, and that he had been born in Puerto Rico, all of which was new information. With the birth certificate he could apply for Social Security Retirement benefits as he was 62 years old. Linda also filed for disability benefits and requested a psychological consultative examination. In the meantime she urged him to enter an alcohol detox program at the VA Hospital in Lebanon. Linda and her husband visited Luis during his hospital stay. Upon his discharge Linda made frequent phone calls to Luis to make sure he kept his appointments. The consultative exam confirmed that Luis had marked impairments in his ability to function. Attorney Timberlake was able to win him benefits and get his landlord paid up to date. Luis is clean and sober and resides in New Providence with friends who see that he has three square meals and a roof over his head. “He is a different person from the one I met only a few months ago. He calls me “Mom” because he says I’m the first person to care for him like a mother should.” – 11 – MIDPENN LEGAL SERVICES Luis Cepada was overjoyed when Custody Attorney Michelle Goldstein secured the return of his children. – 12 – MIDPENN LEGAL SERVICES Recovering Missing Children Lancaster Bar Association Campaign Funds Custody Attorney Position Luis Cepeda and the mother of his three young children lived together in Lancaster for eight years. One day she said she was taking them to the park but she didn’t return. She moved in with another man in a nearby town and only got in touch with Luis a week later. She told him that he’d never see his children again. Police were unable to help because, as with most parents, there was no custody order in place. Attorney Goldstein filed in court for the immediate return of the children. The children were returned to their father and at a later Custody Conference the mother received reasonable visitation rights. Attorney Goldstein has represented family members in nearly 300 custody proceedings in the last three years. The Lancaster Bar Association Foundation recently raised $180,000 to fund this position for a second three year period. The Foundation’s theme for the initiative is We Care About Families. Stable families make for a stable community. Luis said, “Attorney Goldstein has been a hero to me. I am very thankful for her help.” – 13 – MIDPENN LEGAL SERVICES Ombudsman Jessica Tavara has no problems relating to clients. Before she came to work for MidPenn, she was a client herself. – 14 – MIDPENN LEGAL SERVICES Keeping Seniors Safe Lebanon Ombudsman was a MidPenn Client. Now She Helps Others. Jessica Tavara is a former client of MidPenn. MidPenn helped her obtain a Protection From Abuse Order. Now, years later, she has grown to become a community treasure who can bring a tear to the eyes of business leaders when she tells her story. She is a shining example of overcoming adversity and giving back to others in need. Thanks to a contract with the Lebanon County Area Agency on Aging, Jessica is a Long Term Care Ombudsman. She visits every nursing home and personal care home in Lebanon County to protect the rights of residents and investigate complaints concerning the care and services. Jessica first worked for MidPenn as part of our support staff. Now, in addition to attending resident council meetings and presenting resident’s rights sessions, she supervises six volunteers. She has served as a facilitator for the State Ombudsman Conference and played a vital role helping relocate residents during Personal Care Home closures. Jessica also helps residents to find their voice through a program known as PEER (Pennsylvania’s Empowered Expert Residents). The PEER Project is overseen by the Pennsylvania Department of Aging and educates residents of long-term care facilities to advocate for their fellow consumers, from within the facility. To date, Jessica has helped train 13 individuals in Lebanon County, who have completed the 5-week training course that includes topics such as “Navigating Your New Home,” “Conflict Resolution,” and “Recognizing and Reporting Abuse.” Jessica also performs valuable volunteer service for the community. She is a family partner for Habitat for Humanity; a board member and Medical Advocate for the Sexual Assault Resource Counseling Center; and the Treasurer for the Lebanon Hispanic Center. She is on several committees such as the United Way Day of Caring and the Lebanon Family Health Services Latino Health Fair. Her children, Valerie, Julian and Jenny Jordan, also do volunteer work and participate in Community Outreach events. – 15 – MIDPENN LEGAL SERVICES York Family Law Attorney Ann Marie McElwee fought for Deborah Yocum to bring her children back home. – 16 – MIDPENN LEGAL SERVICES Community Partnership Helps A Parent Fight for Her Children York Bar Association Foundation and Business Leaders Join Hands to Help Families Debra Yocum of Dillsburg followed the custody order to the letter but still the children’s father denied her any contact. In a custody case gone horribly wrong she had somehow lost custody of her children. She and the father had separated years ago and Deborah had always been the primary caretaker. Dad visited about once a month. But when he discovered that Deborah had a boyfriend, he fought her for custody. Debra couldn’t afford to lose her job. This was exactly what a group of York lawyers and business leaders wanted to avoid. A MidPenn Advisory Board created the Family Attorney Campaign to raise funds to hire a Family Law Attorney. They had two strong allies: The York County Bar Foundation and area business leaders. With the help of the York United Way, they raised over $300,000 to fund the position for five years. Family Law Attorney Ann Marie McElwee did her homework. “I had the father’s complete criminal record. I could show that he was not following the court order and that he was alienating the children.” She won a contempt hearing and got her client an immediate three week visit with the children. After more transgressions came to light the father consented to Deborah regaining primary custody. Deborah said, “I could not have done this without Ann Marie’s support. She was with me all the way.” For their innovative advocacy, and generosity, the York County Bar Foundation and the York MidPenn Advisory Board were awarded the Louis J. Goffman Award by the Pennsylvania Bar Association at the PBA Annual Meeting in Hershey. – 17 – MIDPENN LEGAL SERVICES SPECIAL PROJECTS MidPenn Legal Services I-Can E-File Wrap-Up Providing Tax Help for Clients In January 2008 MidPenn Legal Services partnered with Southwestern Legal Services to bring the I-Can E-File project, made possible through a tech grant from the Legal Services Corporation, to our service area. I-CAN ™ E-File is webbased software that allows low-income workers to electronically file their income taxes and apply for their earned income tax credits online at no charge. MidPenn Legal Services MidPenn offices throughout the service area distributed materials, held outreach events, provided kiosks in each office for individuals and families to file their taxes online and a Tax Day event was held on February 16, 2008 at Harrisburg Area Community College. Paula Burkett, the assistant to the Executive Director had primary responsibility for the implementation of the program in our area. All told, MidPenn assisted 92 individuals for a total of $167,022 in tax refunds and $87,624 in earned income tax credit payments. MidPenn looks forward to assisting individuals and families again next year. – 18 – MIDPENN LEGAL SERVICES The Medical Legal Partnership Innovative Program Places MidPenn Attorney in a Medical Clinic Setting MidPenn Legal Services and SouthEast Lancaster Health Services in January of 2008 announced the Medical Legal Partnership for Families. It is based on a national model that puts a lawyer in a medical setting to address root social causes of illness, such as substandard housing, hunger and domestic violence. This innovative collaboration allows doctors to more effectively treat chronic illnesses often suffered by low-income members of our community - such as diabetes, asthma, and depression. It is the first such program in Pennsylvania. Bill Fife, Medical Director noted that he often found his efforts stymied by environmental factors such as substandard housing, his patients’ limited understanding of their legal rights, and family violence. He felt many of these factors can be improved through the legal system. Dr. Fife said,” I think together, we can truly offer comprehensive care to our patients – by treating all of the factors that create and maintain disease.” This project is a preventive approach to law. By preventing homelessness for a family, a child’s diabetes is much more likely to be kept under good control. By meeting with a victim of domestic violence in the exam room, a lawyer can help obtain a Protection From Abuse order immediately and prevent more severe physical abuse. Attorney Catherine Schultz is the MidPenn staff attorney at the medical clinic. This new project is completely underwritten by local funders: Lancaster Osteopathic Health Foundation, Lancaster County Community Foundation, United Way of Lancaster, St. Joseph’s Health Ministries, Feree Foundation, RodaNast Foundation, Lancaster General Hospital and the City of Lancaster. – 19 – MIDPENN LEGAL SERVICES The Telephone Advice Project Rural County Residents Reach Out and Get Advice, Without Leaving Home Many low-income people who previously were unable to easily reach a local office can now receive the assistance of an attorney by telephone. Often clients lack transportation, are disabled or cannot get to an office for any number of reasons. This project, which began in September 2007, offers a systematic approach to providing legal advice over the phone on the issues of housing, consumer and family law. Brenda Zimmerman is an attorney working out of the Lewistown office. By phone she serves a nine county area: Bedford, Blair, Centre, Clearfield, Franklin, Fulton, Huntingdon, Juniata and Mifflin. These primarily rural counties represent 52% of the MidPenn service area. Between September of 2007 when the project began and the end of June 2008, Attorney Zimmerman provided important information to 828 clients, or about 92 callers per month. Skilled intake workers screen calls and identify clients who may need brief legal advice. After the call, clients are sent letters summarizing the advice given, along with helpful brochures. Referrals to other agencies may be offered. This project has enabled many people to receive needed legal advice who otherwise would remain uninformed. A client summed up the project’s effect in a comment in a client satisfaction survey: “Extremely helpful - took me from hopelessness to an informed and efficient client!” MidPenn is considering expanding the project. Primary funding for the project comes from the PA Interest on Lawyers Trust Account Board (IOLTA) with additional funding coming from the United Way of Blair County and the Centre County Council for Human Services. – 20 – MIDPENN LEGAL SERVICES President’s Message It is with considerable pride that I write a short note to introduce our annual report for the 2007-2008 fiscal year. May I suggest that it is time for “slaps on the back” all the way around! To our staff attorneys, paralegals, support personnel and administrators--thanks for meeting the challenges of helping the poor each and every day. Because of MidPenn and its dedicated staff, over 10,000 persons achieved access to justice last year that, without MidPenn, would not have been able to seek it. To our board, I give a slap on the back for their devotion to the cause. The leadership shown by our directors has demonstrated an unrivaled investment in MidPenn’s role in our society. For me, it was very rewarding to have chaired the strategic planning committee, bringing together for the first time staff, administrators and board members to form a cohesive working group. The resulting vision for the next five years has been adopted by the entire board. Personally, I will not rest until the strategic plan is seen to its successful conclusion, the result being an even greater ability to address the needs of our clients. Another slap on the back goes to the pro bono programs throughout our 18 county service area. Whether private attorneys are donating their time in providing representation or making financial contributions, they are helping to meet the legal needs of those persons MidPenn would not otherwise be able to help because of limited resources. Finally, to our benefactors, a major slap on the back. I cannot imagine MidPenn coming even close to achieving its mission without the financial contributions of bar associations, United Way agencies, foundations, county commissioners, social agencies, corporations, and the many other individual contributors listed on the pages that follow. Thank you from the bottom of my heart. The support of the community is what motivates all of us to work in meeting the legal needs of our most vulnerable citizens.
