RBS CITIZENS, N.A., d/b/a CITIZENS BANK, Defendant. ~ORDER GRANTING PLAINTIFFS' AMENDED MOTION ~- ~ FORAPPROVAL OF ATTORNEYS' FEES AND EXPENSES, CLAIMS ADMINISTRATI ON COSTS, AND SERVICE AWARDS This matter came before the Court at a Final Approval Hearing on October 9, 2014, on Plaintiffs' Amended Motion for Approval of Attorneys' Fees and Expenses, Claims Administration Costs and Service Awards. The Court has considered the initial Motion and Amended Motion, the Settlement Agreement that the Court preliminarily approved on June 5, 2014, the other papers submitted in connection with the Motion and Amended Motion, the arguments of counsel, the response of the Settlement Classes to the Class Notice, and all files, records, and proceedings in the above-captioned actions (the "Actions"). Finding good cause to Case 1:11-cv-00268-M-PAS Document 79 Filed 10/09/14 Page 2 of 2 PageID #: 1547 Case 1:11-cv-00268-M-PAS Document 75-1 Filed 09/25/14 Page 2 of 2 PageiD #: 1536 approve the Amended Motion, and otherwise being fully informed as to the facts and the law, the Court now finds and ORDERS as follows: 1. All defined terms contained herein shall have the same meaning as set forth in the Settlement Agreement executed by the Parties and filed with the Court. 2. Having reviewed Class Counsel's fee application and all applicable legal authorities, the Court approves the requested award of attorneys' fees in the amount of $500,000 (one-third of the $1.5 million Settlement Fund), and finds that the requested fees are reasonable and appropriate. 3. The Court has also considered Class Counsel's request for costs in the amount of $53,651.71, and finds that reimbursement of these costs is reasonable and appropriate. Accordingly, the Court hereby approves the requested costs. 4. The Court has also considered Plaintiffs' request for approval of the expenses of the Court-appointed Claims Administrator. The Court finds this award to be reasonable and justified, and approves this requested expense in the amount of$52,928.13. 5. The Court has considered Plaintiffs' request for service awards in the amount of $2,500 per Plaintiff. The Court finds the requested service awards to be reasonable and justified, and approves the award of $2,500 each to Dennis Cook, Robert Haberman, William Nuesslein, and James Edward Richards.
