Trick or Treat, Rocking the
Street on Oct. 31 is coming together even bigger than last year! Over
44 businesses and organizations
are committed to the big Halloween bash on Johnson Avenue.
Rumor has it, everything from
caramel apples to a shooting gallery are coming this year; and of
course, the candy and goodies.
This community event provides
kids a safe and fun place to celebrate Halloween. Merchants and
organizations will not be selling
anything, as everything is free and
available to all the kids. The only
requirement is that participating
kids be in costume and accompanied by an adult.

leaf pick-up
begins Oct. 28
The City of Orofino will pick
up leaves from curbside starting
Tuesday, Oct. 28. Pick-up days
will be Tuesday and Friday at 8
a.m. Please have your leaves in
bags and placed beside the curb.
Bagged leaves limited to 30 gallon
bags only.
Orofino City Code 8-1-19 states
that it is unlawful for any person
to sweep, place or leave any debris
in or upon any street, sidewalk, or
other public place within the corporate limits of the city.

Bonaparte charged with
arson in two structure fires
Douglas D. Bonaparte, 53, of
Orofino, was arrested and taken
into custody Oct. 16 on charges
of first degree arson, according
to Clearwater County Sheriff’s Office.
Two structure fires were reported to Clearwater County Sheriff’s
Office the afternoon of Oct. 16,
shortly before 4 p.m. The fires
were located at 2273 Lower Fords
Creek, Orofino. Both residences,
one a house and one a manufactured home, belong to Katherine
Bonaparte.

there and vote in the General election on Tuesday, Nov. 4. Polls are
open from 8 a.m. to 8 p.m. and
each location is accessible to individuals with disabilities.

The suspect, Bonaparte, was located in a vehicle near the scene
and taken into custody, according
to the sheriff’s office.
At arraignment Oct. 17 at 2nd
District Court in Clearwater County, with Judge Randall Robinson
presiding, Bonaparte was charged
with two felony counts of first de-
gree arson, plus an enhancement
due to the fact Bonaparte has been
convicted of two felonies on prior
occasions.
Each count of first degree arson carries a maximum sentence
of 25 years in jail and a $100,000
fine, plus possible restitution. The
enhancement carries a minimum
five years in prison, and a maximum of life.
A No Contact Order was also issued, ordering Bonaparte to stay
at least 300 yards from the persons and residences of Katherine
Bonaparte and Gail Hubbard.
Bonaparte is currently being
held at the Clearwater County jail
on a $75,000 bond.
A preliminary hearing is scheduled for Wednesday, Oct. 29, at 12
noon.
Orofino Fire responded to the
scene, and was assisted by C-PTPA, Sunny Side Fire Department,
Upper Fords Creek Fire, and Twin
Ridge Fire. Clearwater County
Ambulance also responded to the
scene.
The investigation is ongoing,
with assistance from the Idaho
State Fire Marshall’s Office, Nez
Perce Tribal Police, Clearwater
County Search and Rescue, and
Clearwater County Sheriff’s Office.

State Constitutional
Amendment
(HJR 2) a proposed amendment
to the Idaho State Constitution
asks “Shall Article III,
of the
Constitution of the State of Idaho
be amended by the addition of a
new section 29, to confirm that
the legislature may authorize executive rulemaking; however, the
legislature shall not relinquish
oversight, which such oversight is
done by approval or rejection, in
whole or in part, of an executive
rule; and to provide that the legislature’s approval or rejection of
such a rule shall not require the
approval of the governor?”
Meaning, purpose and
result to be accomplished
The Legislature’s ability to approve or reject executive rules is
an important aspect of the separation of powers, because these
rules have the force and effect
of law. Existing law allows Idaho
state agencies to make rules that
implement or interpret statutes
passed by the Legislature. The
Legislature currently oversees that
rulemaking process by accepting
or rejecting adopted rules. The
proposed amendment confirms
and protects the Legislature’s
practice to authorize executive
branch rulemaking, and to accept
or reject adopted rules.
