In addition, parents/guardians will be informed via the district’s rapid notification system. If school is open during stormy weather, parents have the right and responsibility to decide whether their children can safely attend school. Looking Forward to our 2014 – 2015 School Year We have an exciting year ahead as we prepare for some major facility upgrades and focus on increased student learning. My sincere thanks to our great community for the support that was evidenced with the new pool, auditorium and community center projects in the recent referendum. This will be a two year project and we plan to have the facilities available in spring of 2016. It is our honor and privilege to continue providing quality learning experiences for your child. There continues to be a great sense of pride within our schools and great community. Ashwaubenon High School was recognized by US News and World Report as one of the top ten high schools in Wisconsin. Our Valley View Elementary school was also recently recognized a second time as a “School of Merit” by the Department of Public Instruction for Reading and Positive Behavior Interventions. We continue to have a tradition of quality and excellence! Hanes, Ph.D., Superintendent Emergency School Closing Plan - If it becomes necessary to close school after the start of the school day before regular dismissal time, the announcement will be made on local radio and television stations. In addition, parents/guardians will be informed via the district’s rapid notification system. Snow Day Make-ups - If it is necessary to close schools for severe weather more than the two days allotted in the district calendar, make-up days will typically be scheduled starting the day after the last regularly scheduled day of school in June. If this becomes necessary, notices will be sent home via newsletters. In organizing the alumni group we have agreed upon these Guiding Principles for the Ashwaubenon Alumni Association. Create a dynamic Alumni association through stimulating new interest, providing financial support of programs, and strengthening relationships between alumni & friends. Build a network of graduates from AHS to open up social or career opportunities for current or past students. Promote & support the student body through our network and expertise. Sponsor events to draw on the expertise of graduated Ashwaubenon students to educate and enable current AHS students to make career and life choices to help them with decisions they will face in their futures. Hold or support events to promote AHS or student body activities. Recognize Alums. Build upon Jaguar Pride and continue AHS’ rich Tradition of Excellence. Alumni Association Meetings The Alumni Association typically meets on the 2nd Monday of each month from 6:30 to 8:00 pm in the Ashwaubenon High School Library (2391 S. Ridge Road). BUS TRANSPORTATION 2014-2015 PLEASE NOTE: In the past, we published Morning Bus Stop Pickup Times in this calendar. However, due to printing and mailing deadlines, the published information was very preliminary and often out of date by time the school year started. To provide that detailed information, Lamers Bus Lines mails a postcard to each bus-eligible student with their bus route, stop and pickup time. In addition, we post up-to-date bus schedules on our website at www.ashwaubenon.k12.wi.us/busing.cfm Throughout the school year, Lamers will notify you of any changes to your bus transportation. Changes may occur due to such things as timing adjustments and families moving in or out of the district. Bus Eligibility Streets/addresses eligible for bus transport are listed in the following tables. If you have any questions, please contact 492-2905, ext. 1006. If you live in the school’s attendance area and your street is not listed, your child is not eligible for bus transport. Parents of children who are not eligible for district-provided bus transport can contract with Lamers Bus Lines directly at 496-3600. All kindergarten students are eligible for bus transportation. Important School Bus Safety Alert! Certain types of children’s clothing can create a hazard as your child gets off the school bus. Especially dangerous are: • Long, dangling jacket or sweatshirt drawstrings • Long backpack straps • Long scarves or loose clothing Such items can be caught in the bus handrail, door or other equipment as the child gets off the bus. In recent years, a number of children across the US have had their clothing caught as they exited the bus. Several of these children were dragged by the bus and then killed when the bus ran over them. Please take the time to check your children’s clothing to make sure it is safe. Also, please talk with your child about the following safety rules: • Stay away from the Danger Zones around the bus. • Don’t try to pick up something dropped near the bus—the bus driver may not see you. • Remember that other motorists don’t always stop for a stopped school bus— use extreme caution whenever getting on or off the bus. TARGET GOAL – Based on literacy audit results, increase reading achievement of all students and close the achievement gap of students in all subgroups (minority, students with disabilities, economically disadvantaged and English language learners). TARGET MEASURES – 4K-5K • All 4K students will be proficient at the identification of rhyming words on the 4K rhyming assessment. •Increase the application of sight word identification and reading strategies so that 100% of 5K students will read at grade level (attain a Level C) or higher on the Rigby Reading Assessment. Grades 1-5 •100% of students will achieve grade level benchmarks at or above as determined by the standardized assessments (Measures of Academic Progress). • 100% of all third grade students will score at the instructional or independent level on the Rigby Reading assessment. Grades 6-8 •Increase reading achievement of all students and close the reading achievement gap in all subgroups so that WSAS reading score will increase by 5 percentile points for students with disabilities and 10 percentile points for students without disabilities each year. • All students will be reading at grade level by the end of the 8th grade year using Informal Reading Inventories (IRI). Grades 9-12 • Grade 9 - Improvement in the overall English score on the ASPIRE assessment in all student groups by 5% each year. • Grade 10 - Improvement in the overall English score on the ASPIRE assessment in all student groups by 5% each year. • Grade 11- Increase the number of all students meeting the English and Reading ACT benchmark score by 5%. MATH LONG RANGE GOAL – Ensure the delivery of a rigorous and relevant curriculum and program options to improve student learning as measured by local and standardized assessments. TARGET GOAL – Increase math achievement of all students and close the achievement gap of students in all subgroups (minority, students with disabilities, economically disadvantaged and English language learners). TARGET MEASURES 4K-5K • 100% of all 4K students will count with 1 to 1 correspondence of up to 10 objects using the 4K common math assessment. • Improve the identification of numbers 1-30 so that all 5K students are proficient as measured by local assessments. •100% of all 5K students will fluently add and subtract with numbers up to five (5) as measured using the 5K common math assessment. Grades 1-5 • 100% of students will achieve grade level benchmarks or above as determined by standardized assessments (MAP) each year. •100% of students will meet grade level expectations in computation as aligned to the Common Core using grade level common assessments. Grades 6-8 •Increase math achievement of all students and close the achievement gap in all subgroups so that WSAS math score will increase by 5 percentile points for students with disabilities and 10 percentile points for students without disabilities each year. •100% of students will meet grade level expectations in computation as aligned to the Common Core using grade level common assessments. Grades 9-12 • Grade 9 - Improvement in the overall math score on the ASPIRE assessment in all student groups by 5% each year. • Grade 10 – Improvement in the overall math score on the ASPIRE assessment in all student groups by 5% each year. •Grade 11 – Increase math understanding and application of skills so that the number of all students meeting the math ACT benchmark score increases by 5%. ANNUAL NOTICES REQUIRED BY LAW LAST REVISED – SUMMER 2014 Policy review and revision can be an ongoing task of the Ashwaubenon School Board. Therefore, policies may change during the course of a school year. The policies within this booklet were in effect at the time of publication. Portion of these notices and policies may appear in various publications such as student hand-books, newsletter, etc. STUDENT ANTI-HARASSMENT (NEOLA 5517) Prohibited Harassment It is the policy of the Board of Education to maintain an educational environment that is free from all forms of unlawful harassment, including sexual harassment. This commitment applies to all District operations, programs, and activities. All students, administrators, teachers, staff, and all other school personnel share responsibility for avoiding, discouraging, and reporting any form of unlawful harassment. This policy applies to unlawful conduct occurring on school property, or at another location if such conduct occurs during an activity sponsored by the Board. The Board will not tolerate any form of harassment and will take all necessary and appropriate actions to eliminate it, including suspension or expulsion of students and disciplinary action against any other individual in the School District community. Additionally, appropriate action will be taken to stop and otherwise deal with any third party who engages in harassment against our students. The Board will vigorously enforce its prohibition against discriminatory harassment based on the traits of sex, race, color, national origin, religion, or disability, that are protected by Federal or state civil rights laws (hereinafter referred to as unlawful harassment), and encourages those within the School District community as well as third parties, who feel aggrieved to seek assistance to rectify such problems. Additionally, harassment means behavior toward a student or group of students that substantially interferes with the student’s school or academic performance or creates an intimidating, hostile, or offensive school environment. Harassment may occur student-to-student, student-to-staff, staff-to-student, male-tofemale, female-to-male, male-to-male, or female-to-female. The Board will investigate all allegations of unlawful harassment and in those cases where unlawful harassment is substantiated, the Board will take immediate steps to end the harassment, prevent its reoccurrence, and remedy its effects. Individuals who are found to have engaged in unlawful harassment will be subject to appropriate disciplinary action. For purposes of this policy, “School District community” means individuals students, administrators, teachers, staff, and as well as Board members, agents, volunteers, contractors, or other persons subject to the control and supervision of the Board. For purposes of this policy, “third parties” include, but are not limited to, guests and/or visitors on District property (e.g., visiting speakers, participants on opposing athletic teams parent), vendors doing business with, or seeking to do business with the Board, and other individuals who come in contact with members of the School District community at school-related events/activities (whether on or off District property). Other Violations of the Anti-Harassment Policy The Board will also take immediate steps to impose disciplinary action on individuals engaging in any of the following prohibited acts: A. Retaliating against a person who has made a report or filed a complaint alleging unlawful harassment, or who has participated as a witness in a harassment investigation. B. Filing a malicious or knowingly false report or complaint of unlawful harassment. C. Disregarding, failing to investigate adequately, or delaying investigation of allegations of unlawful harassment, when responsibility for reporting and/or investigating unlawful harassment charges comprises part of one’s supervisory duties Definitions Bullying – Bullying rises to the level of unlawful harassment when one or more persons systematically and chronically inflict physical hurt or psychological distress on one (1) or more students or employees and that bullying is based upon sex, race, color, national origin, religion, or disability, that is, characteristics that are protected by Federal civil rights laws. It is defined as any unwanted and repeated written, verbal, or physical behavior, including any threatening, insulting, or dehumanizing gesture, by an adult or student, that is severe or pervasive enough to create an intimidating, hostile, or offensive educational environment; cause discomfort or humiliation; or unreasonably interfere with the individual’s school performance or participation; and may involve: A.teasing; B.threats; C.intimidation; D.stalking; E.cyberstalking; F.cyberbullying; G. physical violence; H.theft; I. public humiliation; or J. destruction of property. Harassment Harassment means any threatening, insulting, or dehumanizing gesture, use of data or computer software, or written, verbal or physical conduct directed against a student or school employee that: A. places a student in reasonable fear of harm to his/her person or damage to his/her property; B. has the effect of substantially interfering with a student’s educational performance, opportunities, or benefits; or C. has the effect of substantially disrupting the orderly operation of a school. Packers @ Titans, 7p AUGUST 2014 A. submission to that conduct or communication is made a term or condition, either explicitly or implicitly, of access to educational opportunities or program; B. submission or rejection of that conduct or communication by an individual is used as a factor in decisions affecting that individual’s education; C. that conduct or communication has the purpose or effect of substantially or unreasonably interfering with an individual’s education, or creating an intimidating, hostile, or offensive educational environment. Sexual harassment may involve the behavior of a person of either gender against a person of the same or opposite gender. Prohibited acts that constitute sexual harassment may take a variety of forms. Examples of the kinds of conduct that may constitute sexual harassment include, but are not limited to: A. unwelcome verbal harassment or abuse; B. unwelcome pressure for sexual activity; C. unwelcome, sexually motivated or inappropriate patting, pinching, or physical contact, other than necessary restraint of students by teachers, administrators, or other school personnel to avoid physical harm to persons or property; D. unwelcome sexual behavior or words including demands for sexual favors, accompanied by implied or overt threats concerning an individual’s educational status; E. unwelcome sexual behavior or words, including demands for sexual favors, accompanied by implied or overt promises of preferential treatment with regard to an individual’s educational status; F. unwelcome behavior or words directed at an individual because of gender; Examples are: 1. repeatedly asking a person for dates or sexual behavior after the person has indicated no interest; 2. rating a person’s sexuality or attractiveness; 3. staring or leering at various parts of another person’s body; 4. spreading rumors about a person’s sexuality; 5. letters, notes, telephones calls, or materials of a sexual nature; 6. displaying pictures, calendars, cartoons, or other materials with sexual content. G. inappropriate boundary invasions by a District employee or other adult member of the District community into a student’s personal space and personal life. H. remarks speculating about a person’s sexual activities or sexual history, or remarks about one’s own sexual activities or sexual history; and I. verbal, nonverbal or physical aggression, intimidation, or hostility based on sex or sex-stereotyping that does not involve conduct of a sexual nature. It is further the policy of the Board that a sexual relationship between staff and students is not permissible in any form or under any circumstances, in or out of the work place, in that it interferes with the educational process and may involve elements of coercion by reason of the relative status of a staff member to a student. Not all behavior with sexual connotations constitutes unlawful sexual harassment. Sex-based or gender-based conduct must be sufficiently severe, pervasive, and persistent such that it adversely affects, limits, or denies an individual’s education, or such that it creates a hostile or abusive educational environment, or such that it is intended to, or has the effect of, denying or limiting a student’s ability to participate in or benefit from the educational program or activities. Race/Color Harassment – Prohibited racial harassment occurs when unwelcome physical, verbal, or nonverbal conduct is based upon an individual’s race or color and when the conduct has the purpose or effect of interfering with the individual’s educational performance; of creating an intimidating, hostile, or offensive learning environment; or of interfering with one’s ability to participate in or benefit from a class or an educational program or activity. Such harassment may occur where conduct is directed at the characteristics of a person’s race or color, such as racial slurs, nicknames implying stereotypes, epithets, and/or negative references relative to racial customs. Religious (Creed) Harassment – Prohibited religious harassment occurs when unwelcome physical, verbal, or nonverbal conduct is based upon an individual’s religion or creed and when the conduct has the purpose or effect of interfering with the individual’s work or educational performance; of creating an intimidating, hostile, or offensive learning environment; or of interfering with one’s ability to participate in or benefit from a class or an educational program or activity. Such harassment may occur where conduct is directed at the characteristics of a person’s religious tradition, clothing, or surnames, and/or involves religious slurs. National Origin Harassment – Prohibited national origin harassment occurs when unwelcome physical, verbal, or nonverbal conduct is based upon an individual’s national origin and when the conduct has the purpose or effect of interfering with the individual’s educational performance; of creating an intimidating, hostile, or offensive working and/or learning environment; or of interfering with one’s ability to participate in or benefit from a class or an educational program or activity. Such harassment may occur where conduct is directed at the characteristics of a person’s national origin, such as negative comments regarding customs, manner of speaking, language, surnames, or ethnic slurs. Age Based Harassment – Prohibited age based harassment occurs when unwelcome physical, verbal, or nonverbal conduct is based upon an individual’s age and when the conduct has the purpose or effect of interfering with the individual’s educational performance; or of creating an intimidating, hostile, or offensive learning environment. Disability Harassment – Prohibited disability harassment occurs when unwelcome physical, verbal, or nonverbal conduct is based upon an individual’s disability and when the conduct has the purpose or effect of interfering with the individual’s educational performance; of creating an intimidating, hostile, or offensive learning environment; or of interfering with one’s ability to participate in or benefit from a class or an educational program or activity. Such harassment may occur where conduct is directed at the characteristics of a person’s disabling condition, such as negative comments about speech patterns, movement, physical impairments or defects/appearances, or the like. Reporting Procedures – Students and all other members of the School District community, as well as third parties, are encouraged to promptly report incidents of unlawful harassing conduct to a teacher, administrator, supervisor, or District employee or official so that the Board may address the conduct before it becomes severe, pervasive, or persistent. Any teacher, administrator, supervisor, or other District employee or official who receives such a complaint shall file it with the District’s Anti-Harassment Compliance Officer at his/her first opportunity. Members of the School District community, which includes students, or third parties who believe they have been unlawfully harassed are entitled to utilize the Board’s complaint process that is set forth below. Initiating a complaint, whether formally or informally, will not adversely affect the complaining individual’s participation in educational or extra-curricular programs unless the complaining individual makes the complaint maliciously or with knowledge that it is false. If, during an investigation of reported act of bullying and/or harassment in accordance with Policy 5517.01 – Bullying and Harassment, the principal or his/her designee believes that the reported misconduct may have created a hostile learning environment and may have constituted unlawful discriminatory harassment based on sex, race, color, national origin, religion, or disability, the principal or his/her designee will report the act of bullying and/or harassment to one of the Compliance Officers who shall investigate the allegation in accordance with this policy. Reporting procedures are as follows: A. Any student who believes s/he has been the victim of harassment prohibited under this policy will be encouraged to report the alleged harassment to any District employee, such as a teacher, administrator or other employee. B. Any parent of a student who believes the student has been the victim of harassment prohibited under this policy will be encouraged to report the alleged harassment to the student’s teacher, building administrator or Superintendent. C. Teachers, administrators, and other school officials who have knowledge or received notice that a student has or may have been the victim of harassment prohibited under this policy shall immediately report the alleged harassment to the Compliance Officer or Superintendent. D. Any other person with knowledge or belief that a student has or may have been the victim of harassment prohibited by this policy shall be encouraged to immediately report the alleged acts to any District employee, such as a teacher, administrator or other employee. E. The reporting party or complainant shall be encouraged to use a report form available from the principal of each building or available from the District office, but oral reports shall be considered complaints as well. Use of formal reporting forms shall not be mandated. However, all oral complaints shall be reduced to writing. F. To provide individuals with options for reporting harassment to an individual of the gender with which they feel most comfortable, each school’s building principal shall be advised to designate both a male and a female Complaint Coordinator for receiving reports of harassment prohibited by this policy. At least one (1) Complaint Coordinator or other individual shall be available outside regular school hours to address complaints of harassment that may require immediate attention. Anti-Harassment Compliance Officers The following individuals serve as “Anti-Harassment Compliance Officers” for the District. They are hereinafter referred to as the “Compliance Officers” Title: Director of Pupil Services Address: 1055 Griffiths Lane; Green Bay WI 54304 Phone Number: 920-492-2900 The names, titles, and District contact information of these individuals will be published annually in the parent and staff handbooks and/or on the District’s web site. A Compliance Officer will be available during regular school/work hours to discuss concerns related to unlawful harassment, to assist students, other members of the School District community, and third parties who seek support or advice when informing another individual about “unwelcome” conduct, or to intercede informally on behalf of the student. Any Board employee who directly observes unlawful harassment of a student is obligated, in accordance with this policy, to report such observations to one of the Anti-Harassment Compliance Officers within two (2) business days. Thereafter, the Compliance Officer or designee must contact the student, if over age eighteen (18) or the student’s parents if under the age eighteen (18), within two (2) business days to advise s/he/them of the Board’s intent to investigate the alleged misconduct, including the obligation of the compliance officer or designee to conduct an investigation following all the procedures outlined in the complaint procedures. The Compliance Officers are assigned to accept complaints of unlawful harassment directly from any member of the School District community or a visitor to the District, or to receive complaints that are initially filed with a school building administrator. Upon receipt of a complaint, either directly or through a school building administrator, a Compliance Officer will begin review and investigation or the Compliance Officer will designate a specific individual to conduct such a process. The Compliance Officer will prepare recommendations for the Superintendent or will oversee the preparation of such recommendations by a designee. All members of the School District community must report incidents of harassment that are reported to them to the Compliance Officer as soon as possible, but always within no more than two (2) calendar days of learning of the incident. Investigation and Complaint Procedure Any student who believes that s/he has been subjected to unlawful harassment may seek resolution of his/her complaint through the procedures described below. Further, a process for investigating claims of harassment and a process for rendering a decision regarding whether the claim of legally prohibited harassment was substantiated are set forth below. Due to the sensitivity surrounding complaints of unlawful harassment, time lines are flexible for initiating the complaint process; however, individuals should make every effort to file a complaint within thirty (30) days after the conduct occurs while the facts are known and potential witnesses are available. Once the formal complaint process is begun, the investigation will be completed in a timely manner (ordinarily, within fifteen (15) calendar days of the complaint being received). If a complainant informs a teacher, principal, or other District employee at the student’s school, the Compliance Officer, Superintendent, or other District employee, either orally or in writing, about any complaint of harassment, that employee must report such information to the Compliance Officer or designee within two (2) business days. Throughout the course of the process as described herein, the Compliance Officer should keep the parties informed of the status of the investigation and the decision making process. All complaints must include the following information to the extent it is available: the identity of the individual believed to have engaged in, or to be actively engaging in, harassment; a detailed description of the facts upon which the complaint is based; and a list of potential witnesses. If the complainant is unwilling or unable to provide a written statement including the information set forth above, the Compliance Officer shall ask for such details in an oral interview. Thereafter the Compliance Officer will prepare a written summary of the oral interview, and the complainant will be asked to verify the accuracy of the reported charge by signing the document. third parties who are interviewed about the importance of maintaining confidentiality. Any individual who is interviewed as part of a harassment investigation is expected not to disclose any information that s/he learns or that s/he provides during the course of the investigation. All public records created as a part of an investigation of a complaint of harassment will be maintained by the Compliance Officer in accordance with the Board’s records retention policy. Any records which are considered student records in accordance with the state or Federal law will be maintained in a manner consistent with the provisions of the law. Sanctions and Monitoring The Board shall vigorously enforce its prohibitions against unlawful harassment by taking appropriate action reasonably calculated to stop the harassment and prevent further such harassment. While observing the principles of due process, a violation of this policy may result in disciplinary action up to and including the discharge of an employee or the suspension/expulsion of a student. All disciplinary action will be taken in accordance with applicable law. When imposing discipline, the Superintendent shall consider the totality of the circumstances involved in the matter, including the ages and maturity levels of those involved. In those cases where unlawful harassment is not substantiated, the Board may consider whether the alleged conduct nevertheless warrants discipline in accordance with other Board policies. Upon receiving a complaint, the Compliance Officer will consider whether any action should be taken in the investigatory phase to protect the complainant from further harassment or retaliation including but not limited to a change of class schedule for the complainant or the alleged harasser, or possibly a change of school for either or both of the parties. In making such a determination, the Compliance Officer should consult the Principal prior to any action being taken. The Complainant should be notified of any proposed action prior to such action being taken. Where the Board becomes aware that a prior remedial action has been taken against a member of the School District community, all subsequent sanctions imposed by the Board and/or Superintendent shall be reasonably calculated to end such conduct, prevent its reoccurrence, and remedy its effects. As soon as appropriate in the investigation process, the Compliance Officer will inform the individual alleged to have engaged in the harassing conduct, hereinafter referred to as the “respondent”, that a complaint has been received. The respondent will be informed about the nature of the allegations and a copy of these administrative procedures and the Board’s anti-harassment policy shall be provided to the respondent at that time. The respondent must also be informed of the opportunity to respond to the complaint. If the respondent is another student, the student may respond to the allegations orally in an interview with the Compliance Officer or in writing within five (5) days. Any act of retaliation against a person who has made a report or filed a complaint alleging unlawful harassment, or who has participated as a witness in a harassment investigation is prohibited. Within five (5) business days of receiving the complaint, the Compliance Officer or a designee will initiate a formal investigation to determine whether the complainant has been subject to offensive conduct/harassment. A principal will not conduct an investigation unless directed to do so by the Compliance Officer. Although certain cases may require additional time, the Compliance Officer or a designee will attempt to complete an investigation into the allegations of harassment within fifteen (15) calendar days of receiving the formal complaint. The investigation will include: A. interviews with the complainant; B. interviews with the respondent; C. interviews with any other witnesses who may reasonably be expected to have any information relevant to the allegations; D. consideration of any documentation or other evidence presented by the complainant, respondent, or any other witness which is reasonably believed to be relevant to the allegations At the conclusion of the investigation, the Compliance Officer or the designee shall prepare and deliver a written report to the Superintendent which summarizes the evidence gathered during the investigation and provides recommendations based on the evidence and the definition of unlawful harassment as provided in Board policy and State and Federal law as to whether the complainant has been subject to unlawful harassment. In determining if unlawful harassment occurred, a preponderance of evidence standard will be used. The Compliance Officer’s recommendations must be based upon the totality of the circumstances, including the ages and maturity levels of those involved. The Compliance Officer may consult with the Board Attorney before finalizing the report to the Superintendent. Absent extenuating circumstances, within ten (10) business days of receiving the report of the Compliance Officer or the designee, the Superintendent must either issue a final decision regarding whether or not the complaint of harassment has been substantiated or request further investigation. A copy of the Superintendent’s final decision will be delivered to both the complainant and the respondent. If the Superintendent requests additional investigation, the Superintendent must specify the additional information that is to be gathered, and such additional investigation must be completed within ten (10) business days. At the conclusion of the additional investigation, the Superintendent must issue a final written decision as described above. The decision of the Superintendent shall be final. If the complainant feels that the decision does not adequately address the complaint s/he may appeal the decision to the State Superintendent of Public Instruction. The Board reserves the right to investigate and resolve a complaint or report of unlawful harassment regardless of whether the member of the School District community or third party alleging the unlawful harassment pursues the complaint. The Board also reserves the right to have the complaint investigation conducted by an external person in accordance with this policy or in such other manner as deemed appropriate by the Board or its designee. Additional School District Action If the evidence suggests that the harassment at issue is a crime or requires mandatory reporting under the Children’s Code (Sec. 48.981, Wis. Stat.), the Superintendent shall report the harassment to the appropriate social service and/or law enforcement agency charged with responsibility for handling such investigations and crimes. Confidentiality The District will make all reasonable efforts to protect the rights of the complainant and the respondent. The District will respect the privacy of the complainant, the respondent, and all witnesses in a manner consistent with the District’s legal obligations under State and Federal law. Confidentiality cannot be guaranteed however. All complainants proceeding through the investigation process should be advised that as a result of the investigation, the respondent may become aware of the complainant’s identity. During the course of an investigation, the Compliance Officer or his/her designee will instruct all members of the School District community and Retaliation Allegations Constituting Criminal Conduct: Child Abuse/Sexual Misconduct State law requires any teacher or school employee who knows or suspects that a child under the age of eighteen (18) is a victim of child abuse or neglect to immediately report that knowledge or suspicion to the Department of Children and Family Services. If, during the course of a harassment investigation, the Compliance Officer or a designee has reason to believe or suspect that the alleged conduct reasonably indicates abuse or neglect of the complainant, a report of such knowledge must be made in accordance with State law and Board policy. If the Compliance Officer or a designee has reason to believe that the complainant has been the victim of criminal conduct as defined under Florida law, such knowledge should be reported to local law enforcement. Any reports made to the local child protection service or to local law enforcement shall not terminate the Compliance Officer’s or a designee’s obligation and responsibility to continue to investigate a complaint of harassment. While the Compliance Officers or a designee may work cooperatively with outside agencies to conduct concurrent investigations, in no event shall the harassment investigation be inhibited by the involvement of outside agencies without good cause after consultation with the Superintendent. Education and Training In support of this policy, the Board promotes preventative educational measures to create greater awareness of unlawful discriminatory practices. The Board will develop a method of discussing this policy with the School District community. Training on the requirements of non-discrimination and the appropriate responses to issues of harassment will be provided to the School District community on an annual basis, and at such other times as the Board in consultation with the Superintendent determines is necessary or appropriate. This policy shall be reviewed at least annually for compliance with local, State, and Federal law. The District shall conspicuously post a notice including this policy against harassment in each school in a place accessible to the School District community and members of the public. This notice shall also include the name, mailing address and telephone number of the Complaint Coordinators, the name, mailing address and telephone number of the State agency responsible for investigating allegations of discrimination in educational opportunities, and the mailing address and telephone number of the United States Department of Education, Office for Civil Rights. A summary of this policy shall appear in the student handbook and shall be made available upon request of parents, students, and other interested parties. 48.981, Wis. Stats. 118.13, Wis. Stats. The Board will not tolerate any gestures, comments, threats, or actions which cause or threaten to cause bodily harm or personal degradation. This policy applies to all activities in the District, including activities on school property, including at any of the school buildings or other property used exclusively or in part, whether leased or owned by the District, for the purpose of school-related functions or events; or while traveling to or from school or to and from school-sponsored functions or events; in transporting vehicles arranged for by School District officials. The policy applies as well during activities that occur off school property if the student or employee is at any school-sponsored, school-approved or school-related activity or function, such as field trips or athletic events where students are under the supervision of school authorities, or where an employee is engaged in school business. Bullying is deliberate or intentional behavior using word or actions, intended to cause fear, intimidation, or harm. Bullying may be a repeated behavior and involves an imbalance of power. Furthermore, it may be serious enough to negatively impact a student’s educational, physical, or emotional well being. The behavior may be motivated by an actual or perceived distinguishing characteristic, such as, but not limited to: age; national origin; race; ethnicity; religion; gender; gender identity; sexual orientation; physical attributes; physical or mental ability or disability; and social, economic, or family status; however this type of bullying behavior need not be based on any of the legally protected characteristics. It includes, but is not necessarily limited to such behaviors as stalking, cyberbullying, intimidating, menacing, coercing, name-calling, taunting, making threats, and hazing. Any student that believes s/he has been or is the victim of bullying should immediately report the situation to the building principal or assistant principal, or the Superintendent. The student may also report concerns to a teacher or counselor who will be responsible for notifying the appropriate administrator or Board official. Complaints against the building principal should be filed with the Superintendent. Complaints against the Superintendent should be filed with the Board President. Every student is encouraged to report any situation that they believe to be bullying behavior directed toward a student. Reports may be made to those identified above. All school staff members and school officials who observe or become aware of acts of bullying are required to report these acts to the building principal or assistant principal, or the Superintendent. Reports of bullying may be made verbally or in writing and may be made confidentially. All such reports, whether verbal or in writing, will be taken seriously and a clear account of the incident is to be documented. A written record of the report, including all pertinent details, will be made by the recipient of the report. All complaints about behavior that may violate this policy shall be investigated promptly by the building principal. The staff member who is investigating the report of bullying shall interview the victim(s) of the alleged bullying and collect whatever other information is necessary to determine the facts and the seriousness of the report. Parents and/or guardians of each student involved in the bullying report will be notified prior to the conclusion of the investigation. The District shall maintain the confidentiality of the report and any related student records to the extent required by law. If the investigation finds that bullying has occurred, it will result in prompt and appropriate remedial and/or disciplinary action. This may include student discipline, including, but not limited to reprimand, suspension, or possible expulsion. Discipline will be administered as close to the point of the student harassment as reasonable. Determination of this will be the purview of the Superintendent or Board of Education President, except where these individuals are part of the case being investigated. Further, the result of an investigation that finds that bullying has occurred may result in discharge for employees, exclusion for parents, guests, volunteers, and contractors, and removal from any official position and/or a request to resign for Board members. Individuals may also be referred to law enforcement officials. The complainant shall be notified of the findings of the investigation, and as appropriate, that remedial action has been taken. This policy shall not be interpreted to infringe upon the First Amendment rights of students (i.e., to prohibit a reasoned and civil exchange of opinions, or debate, that is conducted at appropriate times and places during the school day and is protected by State or Federal law). Retaliation against any person who reports, is thought to have reported, files a complaint, or otherwise participates in an investigation or inquiry concerning allegations of bullying is prohibited and will not be tolerated. Such retaliation shall be considered a serious violation of Board policy and independent of whether a complaint is substantiated. Suspected retaliation should be reported in the same manner as bullying. Making intentionally false reports about bullying for the purpose of getting someone in trouble is similarly prohibited and will not be tolerated. Retaliation and intentionally making a false report may result in disciplinary action as indicated above. The following definitions are provided for guidance only. If a student or other individual believes there has been bullying, regardless of whether it fits a particular definition, s/he should report it and allow the administration to determine the appropriate course of action. “Bullying” is defined on page one. Some examples of bullying are: A. Physical – hitting, kicking, spitting, pushing, pulling, taking and/or damaging personal belongings or extorting money, blocking or impeding student movement, unwelcome physical contact. B. Verbal – taunting, malicious teasing, insulting, name calling, making threats. C. Psychological – spreading rumors, manipulating social relationships, coercion, or engaging in social exclusion/shunning, extortion, or intimidation. D. “Cyberbullying” – the use of information and communication technologies such as e-mail, cell phone and pager text messages, instant messaging (IM), defamatory personal web sites, and defamatory online personal polling web sites, to support deliberate, repeated, and hostile behavior by an individual or group, that is intended to harm others.” The Board recognizes that cyberbullying can be particularly devastating to young people because: 1. cyberbullies more easily hide behind the anonymity that the Internet provides; 2. cyberbullies spread their hurtful messages to a very wide audience with remarkable speed; 3.cyberbullies do not have to own their own actions, as it is usually very difficult to identify cyberbullies because of screen names, so they do not fear being punished for their actions; and 4.the reflection time that once existed between the planning of a prank – or a serious stunt – and its commission has all but been erased when it comes to cyberbullying activity. Cyberbullying includes, but is not limited to the following: 1. posting slurs or rumors or other disparaging remarks about a student on a web site or on weblog; 2.sending e-mail or instant messages that are mean or threatening, or so numerous as to drive-up the victim’s cell phone bill; 3. using a camera phone to take and send embarrassing photographs of students; 4. posting misleading or fake photographs of students on web sites. “Harassment” includes, but is not limited to, any act which subjects an individual or group to unwanted, abusive behavior of a nonverbal, verbal, written or physical nature on the basis of age, race, religion, color, national origin, marital status or disability (sexual orientation, physical characteristic, cultural background, socioeconomic status, or geographic location). “Intimidation” includes, but is not limited to, any threat or act intended to tamper, substantially damage or interfere with another’s property, cause substantial inconvenience, subject another to offensive physical contact or inflict serious physical injury on the basis of race, color, religion, national origin or sexual orientation. “Menacing” includes, but is not limited to, any act intended to place a school employee, student, or third party in fear of imminent serious physical injury. “Harassment, intimidation, or bullying” means any act that substantially interferes with a student’s educational benefits, opportunities, or performance, that takes place on or immediately adjacent to school grounds, at any school-sponsored activity, on school–provided transportation or at any official school bus stop, and that has the effect of: A. physically harming a student or damaging a student’s property; B. knowingly placing a student in reasonable fear of physical harm to the student or damage to the student’s property; or C. creating a hostile educational environment. “Staff” includes all school employees and Board members. “Third parties” include, but are not limited to, coaches, school volunteers, parents, school visitors, service contractors, vendors, or others engaged in District business, and others not directly subject to school control at inter-district or intra-district athletic competitions or other school events. For a definition of and instances that could possibly be construed as hazing, consult Policy 5516. Privacy/Confidentiality The School District will respect the privacy of the complainant, the individual(s) against who the complaint is filed, and the witnesses as much as possible, consistent with the Board’s legal obligations to investigate, to take appropriate action, and to conform with any discovery or disclosure obligations. All records generated under this policy and its related administrative guidelines shall be maintained as confidential to the extent permitted by law. To the extent appropriate in conducting a thorough investigation and/or as legally permitted, confidentiality will be maintained during the investigation process. Notification Notice of this policy will be annually distributed to all students enrolled in the School District, their parents and/or guardians and employees. The policy will also be distributed to organizations in the community having cooperative agreements with the schools. Additionally, the policy will be posted in conspicuous locations in all school buildings and departments within the District and discussed with students, as well as incorporated into the teacher, student, and parent/guardian handbooks. State and Federal rights posters on discrimination and harassment shall also be posted at each building. All new hires will be required to review and sign off on this policy and the related complaint procedure. The School District will also provide a copy of the policy to any person who requests it Records and Reports Records will be maintained on the number and types of reports made, and sanctions imposed for incidents found to be in violation of the bullying policy. An annual summary report shall be prepared and presented to the School Board, which includes trends in bullying behavior and recommendations on how to further reduce bullying behavior. The annual report will be available to the public. Education and Training In support of this policy, the Board promotes preventative educational measures to create greater awareness of bullying behavior. The Superintendent or designee shall provide appropriate training to all members of the School District community related to the implementation of this policy and its accompanying administrative guidelines. All training regarding the Board’s policy and administrative guidelines on bullying will be age and content appropriate. The complaint procedure established by the Superintendent as set forth in AG 5517.01 shall be followed. Wis. Stat. 118.46 Revised 9/13/10 SCHOOL PERFORMANCE REPORT (NEOLA 2700.01) The Board of Education believes that a vital component of the District’s educational programs is ensuring that parents and other individuals are informed of the performance of the schools and the school district. NO SCHOOL: Thanksgiving Break NOVEMBER 2014 State School Performance Report The Board of Education will publish an annual school and school district performance report including all information prescribed by statute. By January 1st of each year the School Board shall notify the parents of each student enrolled in the District of the right to request a school and school district performance report. Parents shall be notified that the performance report will be provided to the parent electronically unless the parent requests a written copy of the report. By May 1st, the Board shall distribute copies of the report to those who have requested, the report including, students enrolled in charter schools located in the District, that have requested the report. The annual school and school district report shall be made available on the District’s internet website for public viewing and will be prepared according to State Statute. Title I Provisions of the School Performance Report In any year that the District receives Title I funding, its school performance report must also include the following information: 115.38, Wis. Stats. 20 U.S.C. 6311 ASBESTOS HAZARD (NOTICE AS PER NEOLA 8431.01) The Board of Education recognizes its responsibility to provide students, employees, and visitors with a safe and healthful environment. Accordingly, the Board directs the Superintendent to ensure that the District satisfies its obligations to deal with asbestos building materials in any building that is leased, owned, or otherwise used by the District as a school building as required under State and Federal law including, but not limited to, the Asbestos Hazard Emergency Response Act of 1986 (“AHERA”). To this end, the Board authorizes the Superintendent to designate an individual responsible for ensuring that the District satisfies its responsibilities under AHERA. This individual will, at a minimum develop and administer an Asbestos Management Plan as required by law. The Plan will address all requirements under AHERA including, but not limited to, inspection, reinspection, periodic surveillance, training and recordkeeping requirements. The Superintendent will also ensure that at least once each school year, the District provides written notice to parents, employees and employee organizations regarding the availability of the District’s Asbestos Management Plan and any response actions taken or planned. 20 U.S.C. 4011 et seq. Asbestos Hazard Emergency Response Act of 1986 (AHERA) Asbestos School Hazard Abatement Reauthorization Act of 1990 40 C.F.R. 763 FOOD SERVICES (NEOLA 8500) The Board of Education shall provide cafeteria facilities in all school facilities where space and facilities permit, and will provide food service for the purchase and consumption of lunch for all students. The Board shall also provide a breakfast program in accordance with procedures established by the Department of Public Instruction. The food-service program shall comply with Federal and State regulations pertaining to the selection, preparation, delivery, consumption, and disposal of food and beverages as well as to the fiscal management of the program. In addition, as required by law, a food safety program based on the principles of the Hazard Analysis and Critical Control Point (HACCP) system shall be implemented with the intent of preventing food-borne illnesses. For added safety and security, access to the facility and the food stored and prepared therein shall be limited to food service staff and other authorized persons. Substitutions to the standard meal requirements shall be made, at no additional charge, for students who are certified by a licensed physician to have a disability which restricts his/her diet, in accordance with the criteria set forth in 7 CFR 15b.3. To qualify for such substitutions the medical certification must identify: A. the student’s disability and the major life activity affected by the disability; B. an explanation of why the disability affects the student’s diet; and C.the food(s) to be omitted from the student’s diet, and the food or choice of foods that must be substituted (e.g., caloric modifications or use of liquid nutritive formula). On a case by case basis, substitutions to the standard meal requirements may be made, at no additional charge, for students who are not “disabled persons”, but have a signed statement from a qualified medical authority that the student cannot consume certain food items due to medical or other special dietary needs. To qualify for such consideration and substitutions the medical statement must identify: A. the medical or dietary need that restricts the student’s diet; and B. the food(s) to be omitted from the student’s diet and the food(s) or choice of foods that may be substituted For non-disabled students who need a nutritional equivalent milk substitute, only a signed request by a parent or guardian is required. Lunches sold by the school may be purchased by students and staff members and community residents in accordance with the administrative guidelines established by the Superintendent. The operation and supervision of the food-service program shall be the responsibility of the Child Nutrition Coordinator and the Director of Business Services. Food services shall be operated on a self-supporting basis with revenue from students, staff, Federal reimbursement, and surplus food. The Board shall assist the program by furnishing available space, initial major equipment, and utensils. Maintenance and replacement of equipment is the responsibility of the program. A periodic review of the food-service accounts shall be made by the Director of Business Services. Any surplus funds from the National School Lunch Program shall be used to reduce the cost of the service to students or to purchase cafeteria equipment. Surplus funds from a-la-carte foods purchased using funds from the nonprofit food service account must accrue to the nonprofit food service account. The food-service program may participate in the “Farm to School Program” using locally grown food in school meals and snacks. The Superintendent shall establish administrative guidelines for the conduct of the school lunch program that shall include provisions for: A. the maintenance of sanitary, neat premises free from fire and health hazards; B. the preparation and consumption of food; C. the purchase of foods and supplies in accordance with law; D. complying with food holds and recalls in accordance with USDA regulations; E. the accounting and deposition of food-service funds; F. the safekeeping and storage of food and food equipment. No foods or beverages, other than those associated with the District’s food-service program, are to be sold during food-service hours. The District shall serve only nutritious food as determined by the Food Service Department and shall not purchase with food service funds and shall not serve, in any food service area during meal-serving hours, carbonated beverages, water ices, chewing gum, hard candy (including breath mints and cough drops), jellies and gums, marshmallow candies, fondant (creamy sugar candy), licorice, spun candy and candy-coated popcorn. Foods and beverages unassociated with the food-service program may be vended in accordance with Board Policy 8540 15.137, 93.49, 115.34-115.345, 120.10(16), 120.13(10), Wis. Stats. 7 C.F.R. 210, 215, 220, 240 42 U.S.C. 1760 Revised 9/24/12 HOMELESS STUDENTS (NEOLA 5111.01) Children and youth, including unaccompanied youth who meet the Federal definition of “homeless” will be provided a free appropriate public education in the same manner as all other students of the District. To that end, students who are homeless will not be stigmatized or segregated on the basis of their status as homeless and will be assigned to the school serving those non-homeless students residing in the area in which the homeless child is actually living. The District shall establish safeguards that protect homeless students from discrimination on the basis of their homelessness. Homeless children and youth are defined as individuals who lack a fixed, regular, and adequate nighttime residence, and include those who meet any of the following criteria: A. share the housing of other persons due to loss of housing, economic hardship, or similar reason (referred to as “Doubled-up”) B. live in motels, hotels, trailer parks, or camping grounds due to a lack of alternative adequate accommodations C. live in emergency or transitional shelters D. are abandoned in hospitals E. are awaiting foster care placement F. have a primary nighttime residence that is a public or private place not designed for or ordinarily used as a regular sleeping accommodation for human beings, or G. live in a car, park, public space, abandoned building, substandard housing, bus or train station, or similar setting Additionally, pursuant to Federal law, migratory children who are living in circumstances described in A-G above are also considered homeless. Children, youth and their families who are homeless shall be provided equal access to the educational services for which they are eligible, including preschool programs administered by the School District. The District shall remove barriers to the enrollment and retention of students who are homeless in schools in the District. Students who are homeless shall be enrolled immediately, even if they do not have the necessary enrollment documentation such as immunization and health records, proof of residency or guardianship, birth certificate, school records, and other documentation. Students who are homeless will be provided services comparable to other students in the District including: A. transportation services; B. educational services for which the homeless student meets eligibility criteria including services provided under Title I of the Elementary and Secondary Education Act or similar State or local programs, educational programs for children with disabilities, and educational programs for students with limited English proficiency; C. programs in vocational and technical education; D. programs for gifted and talented students; E. school nutrition programs; F. before and after school programs. Students who are homeless have the right to remain in their school of origin or the local attendance area school, according to the child’s best interest. The school of origin is the school that the student attended when permanently housed or last enrolled. The local attendance area school is any public school that non-homeless students who live in the attendance area in which the student is actually living are eligible to attend. Students who are homeless have the right to dispute their school assignment, if their assignment is other than their school of origin. In determining the best interest of the student, the District shall, to the extent feasible, keep the student in the school of origin, except when doing so is contrary to the wishes of the homeless student’s parent or guardian or the unaccompanied youth. If the student is sent to a school other than the school of origin or a school requested by the parent or guardian, a written explanation, including a statement regarding the right to appeal, will be provided to the homeless student’s parent or guardian or the unaccompanied youth. The appeal process shall be as set forth in Policy 9130 – Public Requests, Suggestions, or Complaints. The Board of Education requires that these rights and the dispute process be communicated to the parent or guardian of the homeless student or unaccompanied youth. In addition to notifying the parent or guardian of the homeless student or unaccompanied youth of the rights described above, the District shall post public notice of educational rights of children and youth experiencing homelessness in each school. B. If the homeless student moves to an area served by another district, though continuing his/her education at the school of origin, the district of origin and the district in which the student resides must agree upon a method to apportion responsibility and costs for transportation to the school of origin. Code Revised 12/13/10 CELL PHONES & ELECTRONIC COMMUNICATION DEVICES (NEOLA 5518) SEARCH AND SEIZURE (NEOLA 5771) Students are generally prohibited from using or displaying in plain sight electronic communication devices (ECDs) including, but not limited to, cell phones and pagers during the school day, in school buildings and vehicles, and at all school sponsored activities. However, the Board of Education recognizes the value of students maintaining communication with their parents/guardians and other appropriate persons for health, safety and educational purposes. Therefore, possession and use of ECDs may be permitted only if use by the student is determined to be for a medical, school, educational, vocational, or other legitimate use. Such possession or use of an ECD may not, in any way: A. disrupt the educational process in the School District; B. endanger the health or safety of the student or anyone else; C. invade the rights of others at school; D. involve illegal or prohibited conduct of any kind. TThe Board of Education has charged school authorities with the responsibility of safeguarding the safety and well-being of the students in their care. In the discharge of that responsibility, school authorities may search school property such as lockers used by students or the person or property, including vehicles, of a student, in accordance with the following policy. Possession of a cellular telephone or other ECD by a student is a privilege, which may be forfeited by any student who fails to abide by the terms of this policy, or otherwise engages in misuse of this privilege. Violations of this policy may result in disciplinary action against the student, up to and including expulsion. Any student possessing an ECD shall be responsible for its care. At no time shall the District be responsible for preventing theft, loss or damage to any ECD. The Superintendent/designee shall prepare guidelines consistent with this policy. 118.258 Wis. Stats. ENGLISH LANGUAGE LEARNER PROGRAMS Parents of students identified with limited English proficiency will be notified of the district’s ELL (English Language Learner) program. This notification will include the procedures for registering for this program and the parental consent requirement for student placement into this program. HUMAN GROWTH AND DEVELOPMENT (NOTICE AS PER NEOLA 2414) The Board of Education directs that students receive instruction in human growth and development, consistent with Chapter 118.019(2) Wis. Stats, to include the following: A.the importance of communication about sexuality and decision making about sexual behavior between the student and the student’s parents, guardians, or other family member B.reproductive and sexual anatomy and physiology, including biological, psychosocial, and emotional changes that accompany maturation. C. puberty, pregnancy, parenting, body image, and gender stereotypes D.the skills needed to make responsible decisions about sexuality and sexual behavior throughout the student’s life, including how to refrain from making inappropriate verbal, physical, and sexual advances and how to recognize, rebuff, and report any unwanted or inappropriate verbal, physical, and sexual behaviors E.the benefits of and reasons for abstaining from sexual activity. Instruction under this subdivision shall stress the value of abstinence as the most reliable way to prevent pregnancy and sexually transmitted infections. F.the health benefits, side effects, and proper use of contraceptives and barrier methods approved by the Federal Food and Drug Administration to prevent pregnancy and barrier methods approved by the Federal Food and Drug Administration to prevent sexually transmitted infections G.methods for developing healthy life skills, including setting goals, making responsible decisions, communicating, and managing stress H. how alcohol and drug use affect responsible decision making I. the impact of media and one’s peers on thoughts, feelings, and behaviors related to sexuality: 1. u se instructional methods and materials that do not promote bias against students of any race, gender, religion, sexual orientation, or ethnic or cultural background or against sexually active students or children with disabilities 2. p romote self-esteem and positive interpersonal skills, with an emphasis on healthy relationships, including friendships, marriage, and romantic and familial relationships 3. identify counseling, medical, and legal resources for survivors of sexual abuse and assault, including resources for escaping violent relationships The Superintendent will ensure that instruction in marriage and parental responsibility is provided and that instruction, when age-appropriate, fulfills the requirements of Chapter 118.019(2r) Wis. Stats. as listed below: School Property The Board acknowledges the need for in-school storage of student possessions and shall provide storage places, including desks and lockers, for that purpose. Desks and lockers are public property and school authorities may make reasonable regulations regarding their use. The District retains ownership and possessory control of student desks and lockers and the same may be searched at random by school personnel at any time. A showing of reasonable cause or suspicion is not a necessary precondition to a search under this paragraph. Students shall not have an expectation of privacy in lockers, desks, or other school property as to prevent examination by a school official. The Board directs the school principals to provide students with written notice of this policy at least annually and that routine inspections be done at least annually of all such storage places. The Board directs that the searches may be conducted by the Superintendent, building principals, assistant principals, and/or Police Liaison Officer. Student Person and Possessions The Board recognizes that the privacy of students or his/her belongings may not be violated by unreasonable search and seizure and directs that no student be searched without reasonable suspicion that the search will turn up evidence that the student has violated or is violating either a particular law or a particular rule of the school. Any search under this paragraph must be reasonable in scope and reasonable in the manner in which it is conducted. The extent of the search will be governed by the seriousness of the suspected infraction, the student’s age and gender, the student’s disciplinary history, and any other relevant circumstances or information. This authorization to search shall also apply to all situations in which the student is under the jurisdiction of the Board. In a situation in which a search of a student’s person or possessions is appropriate, school administrators should first attempt to contact the school liaison officer to conduct the search under the administrator’s direction. If the officer is not available, the administrator may proceed with the search, unless the information justifying the search suggests that the student is in possession of dangerous materials whereby the expertise of law enforcement is necessary. In such a case, the school official shall conduct law enforcement and request their assistance. Under no circumstances shall a school official ever conduct a strip search of a student. Parking Permit Required Permission for a student to bring a vehicle on school property shall be conditioned upon written consent of the search of the vehicle and all containers inside the vehicle by a school administrator with reasonable suspicion to believe the search will produce evidence of a violation of a particular law, a school rule, or a condition that endangers the safety or health of the student driver or others. If an administrator determines a search is necessary, he or she should request consent to search the vehicle and all containers inside the vehicle. If the consent is not given, a school administrator may proceed with the search. An administrator may contact the police liaison officer or law enforcement agency for assistance in conducting a search. Except as provided below, a request for the search of a student or a student’s possessions will be directed to the principal. S/He shall attempt to obtain the freely-offered, written consent of the student to the inspection; however, provided there is reasonable suspicion pursuant to the above paragraphs, s/he may conduct the search without such consent. Whenever possible, a search will be conducted by the principal in the presence of the student and a staff member other than the principal. A search prompted by the reasonable suspicion that health and safety are immediately threatened will be conducted with as much speed and dispatch as may be required to protect persons and property. JANUARY 2015 A. The presence of the dogs on school property is authorized in advance by the Superintendent, except in emergency situations, or is pursuant to a court order or warrant. B. The dog must be handled by a law enforcement officer or certified organization specially trained to safely and competently work with the dog. C. The dog is represented by the Sheriff or Chief of the law enforcement agency providing the service as capable of accurately detecting drugs and/or devices. The principal shall be responsible for the prompt recording in writing of each student search, including the reasons for the search; information received that established the need for the search and the name of informant, if any; the persons present when the search was conducted; any substances or objects found and the disposition made of them; and any subsequent action taken. The principal shall be responsible for the custody, control, and disposition of any illegal or dangerous substance or object taken from a student. The Superintendent may request the assistance of a law enforcement agency in implementing any aspect of this policy. Where law enforcement officers participate in a search on school property or at a school activity pursuant to a request from the Superintendent, the search shall be conducted by the law enforcement officers at the direction of a District official. Law enforcement searches conducted independent of any District official request or direction shall be conducted based on standard applicable to law enforcement. Anything found in the course of a search pursuant to this policy which constitutes evidence of a violation of a particular law or school rule or which endangers the safety or health of any person shall be seized and properly catalogued for use as evidence if appropriate. Seized items shall be returned to the owner if the items may be lawfully possessed by the owner. Seized items that may not lawfully be possessed by the owner shall be turned over to law enforcement. The Superintendent/designee shall prepare administrative guidelines to implement this policy and shall provide students and staff with written notice of this policy and guidelines at least annually. 118.325 Wis. Stats. 948.50, Wis. Stats. Wisconsin Const. Art. 1 Section 11 U.S. Constitution, 4th Amendment Revised 3/10/14 COMPLAINT PROCEDURES FOR NONDISCRIMINATION (NEOLA 2260B) Introduction The Board of Education does not discriminate on the basis of any characteristic protected under State or Federal law including, but not limited to, age, sex, race, color, religion, national origin, ancestry, creed, pregnancy, marital status, parental status, sexual orientation, or physical, mental, emotional, or learning disability in any of its student programs and activities. Any person that believes that s/he has been discriminated against or denied equal opportunity or access to programs or services may file a complaint with one of the District’s Civil Rights Coordinators or the Superintendent. The individual may also, at any time, contact the U.S. Department of Education, Office for Civil Rights, Citigroup Center, 500 W. Madison Street, Suite 1475, Chicago, IL 60661; Telephone: 312-730-1560, Fax: 312-730-1576; TDD: 877-521-2172; E-mail: [email protected]. Informal Procedures A person who believes s/he has a valid basis for a complaint may discuss the matter informally and on an oral basis with the District’s Civil Rights Coordinator, who will investigate the complaint and reply with an answer to the complainant. If the informal procedures do not resolve the matter to the complainant’s satisfaction or s/he skips the informal process, s/he may initiate formal procedures according to the following steps: Formal Procedure Step 1: Investigation by the District Civil Rights Coordinator: A person may initiate a formal investigation by filing a written complaint with the District Civil Rights Coordinator. The complaint must contain the name and address of the individual or representative filing the complaint, be signed by the complainant or someone authorized to sign for the complainant, and describe the alleged discriminatory action in sufficient detail to inform the Civil Rights Coordinator of the nature and date of the alleged violation, and propose a resolution. The complaint must be filed within thirty (30) calendar days of the circumstances or event giving rise to the complaint, unless the time for filing is extended by the Civil Rights Coordinator for good cause. The Civil Rights Coordinator will conduct an impartial investigation of the complaint. As part of the investigation, the Civil Rights Coordinator shall permit the complainant to present witnesses and other evidence in support of his/her complaint. The investigation shall be completed within ten (10) business days of the written complaint being filed. The Civil Rights Coordinator will notify the complainant in writing of his/her decision and will maintain the District’s files and records relating to the complaint. Step 2: If the complainant is not satisfied with the Civil Rights Coordinator’s Step 1 decision, s/he may submit, in writing, a signed statement of appeal to the Superintendent of Schools within five (5) business days after receipt of the Coordinator’s response. The Superintendent shall meet with all parties involved, formulate a conclusion, and respond in writing to the complainant within ten (10) business days of receiving the written appeal. Step 3: If the complainant remains unsatisfied, s/he may file a written appeal with the Board of Education. The appeal must be filed within five (5) business days of his/her receipt of the Superintendent’s response in Step 2. In an attempt to resolve the complaint, the Board of Education shall meet with the parties and their representative within twenty (20) business days of the receipt of such appeal. A copy of the Board’s disposition of the appeal shall be sent to each party within fifteen (15) business days of this meeting. The complainant may be represented, at his/her own cost, at any of the above-described meetings/hearings. The right of a person to a prompt and equitable resolution of the complaint shall not be impaired by the person’s pursuit of other remedies such as the filing of a complaint with the Office for Civil Rights or the filing of a court case in the appropriate Federal District Court. Use of this internal complaint procedure is not a prerequisite to the pursuit of other remedies. The Civil Rights Coordinator will provide a copy of the District’s complaint procedure to any person who files a complaint and will investigate all complaints in accordance with this procedure. A copy of each of the Acts and the regulations on which this notice is based, may be found in the office of each building administrator. Student Complaint Procedure Under Section 118.13, Wisconsin Statutes Consistent with the requirements of Section 118.13, Wisconsin Statutes, it is the policy of the District that no person, on the basis of sex; race; color; religion; national origin; ancestry; creed; pregnancy; marital or parental status; sexual orientation; or physical, mental, emotional, or learning disability may be denied admission to school or be denied participation in, be denied the benefits of, or be discriminated against in any curricular, extra-curricular, student services, recreational or other program or activity. Areas covered by this policy include admission to any school, class, program, or activity; standards and rules of behavior, including student harassment; disciplinary actions, including suspensions and expulsions; acceptance and administration of gifts, bequests, scholarships and other aids, benefits or services to students from private agencies, organizations or persons; instructional and library material selection; methods, practices, and materials used for testing, evaluating and counseling students; facilities; opportunity for participation in athletic programs or other extra-curricular activities; and school sponsored food service programs. If any person believes that the District or any part of the school organization has failed to follow Section 118.13, Wisconsin Statutes or in some way discriminated against students on the basis of sex, race, religion, national origin, ancestry, creed, pregnancy, marital or parental status, sexual orientation, or physical, mental, emotional or learning disability, s/he may file a written complaint with a District Civil Rights Coordinator, as indicated above, or the Superintendent. The procedure for resolution of complaints shall be as follows: Step 1 A written statement of the complaint shall be prepared by the complainant on the form provided by the District and signed. This complaint shall be presented to the Coordinator. The Coordinator shall send written acknowledgement of receipt of the complaint to the complainant within forty-five (45) days of receipt of the written complaint. Step 2 A written determination of the complaint shall be made by the Board of Education within ninety (90) days of the receipt of the written complaint unless the parties agree to an extension of time. Step 3 If a complainant wishes to appeal a negative determination by the Board, s/he has the right to appeal the decision to the State Superintendent within thirty (30) days of the Board’s decision. In addition, the complainant may appeal directly to the State Superintendent if the Board has no complaint procedure or has not provided written acknowledgement within forty-five (45) days of the receipt of the complaint or made a determination within ninety (90) days of receipt of the written complaint and the parties have not agreed to an extension of time. FEBRUARY 2015 Revised 12/18/09 Revised 07/20/10 Revised 1/10/11 PARENT PARTICIPATION IN TITLE I PROGRAMS (NEOLA 2261.01) In accordance with the requirements of Section 1118 of Title I, programs supported by Title I funds must be designed and implemented in consultation with parents of the students being served. Development of Administrative Guidelines for Parent Participation The Superintendent shall ensure that the Title I plan under Section 6312 contains administrative guidelines which have been developed and approved by the District and parents of participating students and distributed to parents. The guidelines shall describe how: A. the District expects and encourages parents to be involved in the planning, review, and improvement of Title I programs, including their participation in the development of the plan under Section 1112 and the process for school review and improvement under Section 1116; B. meetings will be conducted with parents including provision for flexible scheduling and whatever assistance the District may be able to provide parents in order to better ensure their attendance at meetings, and for providing information in a language the parents can understand; C. meetings will include review and explanation of the curriculum, means of assessment, and the proficiency levels students are expected to achieve and maintain; D. opportunities will be provided for parents to formulate suggestions, interact and share experiences with other parents, and participate appropriately in the decision-making about the program and revisions in the plan; E. information concerning school performance profiles and their child’s individual performance will be communicated to parents; F. parents will be provided with assistance (e.g., literacy training and technology) in providing help to their children in achieving the objectives of the program by such means as ensuring regular attendance, monitoring television-watching, providing adequate time and the proper environment for homework; guiding nutritional and health practices, and the like; G. timely responses will be given to parental questions, concerns, and recommendations; H. the District will provide coordination, technical assistance and other support necessary to assist Title I schools to develop effective parental participation activities to improve academic achievement and school performance; I. an annual evaluation of the parental involvement plan will be conducted with parents, identifying any barriers to greater parental involvement (such as limited English, limited literacy, economic disadvantage, disability, etc.) and how strategies will be devised to improve parental involvement and to revise, if necessary, this policy; J. the parental involvement plan will be coordinated with other programs, such as Head Start, Reading First, Early Reading First, Even Start, Parents as Teachers, and Home Instruction for Preschool Youngsters; K. other activities will be conducted as appropriate to the plan and State and Federal requirements. The Superintendent shall also ensure that the guidelines include a school-parent compact developed jointly by the District and parents, which outlines the responsibilities of the school staff, the parents and the student for academic improvement. The school-parent compact shall include provisions addressing: A. the school’s responsibility to provide high quality curriculum and instruction in a supportive, effective learning environment; B. parent’s responsibility for such things as monitoring attendance, homework, extra-curricular activities, and excessive television watching; volunteering in the classroom; and positive use of extra-curricular time; and C. the importance of parent-teacher communication on an on-going basis through at least annual parent teacher conferences to discuss achievement and the compact; frequent progress reports to parents; reasonable access to staff; and to opportunities to observe and participate in classroom activities. Informing Parents of Their Right to be Involved in Development and Administration of this Policy The Superintendent shall also assure that each Title I participating school develops a specific plan, with parental involvement, which: A. convenes an annual meeting, at a convenient time, to which parents of participating children are invited and encouraged to attend, to explain the school’s involvement under Title I, the requirements to develop this policy, and the parents’ right to be involved; B. involves parents in an organized, on-going and timely way in the development, review, and improvement of parent involvement activities; C. provides participating students’ parents with: 1. timely information about the Title I programs; 2. an explanation of the curriculum, the forms of academic assessment, and the proficiency levels expected; 3. regular meetings, upon request by a parent, to make suggestions and receive response regarding their student’s education; Notice to Parents and Updating the Policy The District will notify all parents of this policy, the guidelines, and the school-parent compact in a language understandable to the parents, to the extent practicable. Additionally, this policy will be made available to the local community and will be updated periodically to meet the changing needs of parents and the school. C. D. E. The undergraduate major of the teacher(s) and the area of study and any certificates for any graduate degrees earned. The qualifications of any paraprofessionals providing services to their child(ren). In addition, the parents shall be provided: 1. information on the level of achievement of their child(ren) on the required State academic assessments; 2.timely notice if the parent’s child has been assigned, or has been taught for four (4) or more consecutive weeks by, a teacher who is not “highly qualified”. The notices and information shall be provided in an understandable format, and to the extent possible, in a language the parent(s) understand. 20 U.S.C. 6311, Elementary and Secondary Education Act of 1965 34 C.F.R. Part 200 et seq. SPECIAL EDUCATION (NEOLA 2460 & excerpts from ‘Model Local Education Agency Special Education Policies & Procedures’ manual) The Board of Education shall provide a free, appropriate public education to all eligible disabled persons ages three (3) through twenty-one (21) which complies with Federal and State laws and guidelines. The Superintendent shall prepare whatever administrative guidelines are necessary to ensure effective implementation of the special education program. 66.30, 115.78 et seq., Wis. Stats. P.I. 11, Wis. Adm. Code IDEA, 20 U.S.C. 1400 et seq. CHILD FIND The Ashwaubenon School District identifies, locates, and evaluates all children with disabilities, regardless of the severity of their disability, who are in need of special education and related services, including children attending private schools, children who are made a ward of the state, county, or child welfare agency under chapter 54 or 880, children who are not yet three years of age, highly mobile children such as migrant and homeless children, and children who are suspected of being a child with a disability even though they are advancing from grade to grade. 34 CFR § 300.111; Wis. Stat. § 115.77(1m)(a) REFERRAL The school district accepts and processes referrals of children suspected to have a disability. The school district has written procedures for accepting and processing referrals. Licensed school personnel who reasonably believe a child has a disability are required to make a referral. Prior to submitting a referral, the people required to make referrals inform the parents of their intent to make a referral. If the Ashwaubenon School District receives a referral for a child who is attending this school district under the Full-Time Open Enrollment law or a tuition waiver under Wis. Stat. § 121.84(1)(a) or (4), the Ashwaubenon School District provides the name of the child and related information to the local educational agency of residence. Whenever the Ashwaubenon School District receives a referral for a resident child attending school in another local educational agency under the Full-Time Open Enrollment law or a tuition waiver under Wis. Stat. § 121.84(1)(a) or (4), the Ashwaubenon School District provides the name of the child and related information to the local educational agency of attendance. The Ashwaubenon School District accepts written referrals. Each referral includes the name of the child and reasons why the person making the referral believes that the child is a child with a disability. The Ashwaubenon School District documents and dates the receipt of each referral. At least annually, the Ashwaubenon School District informs parents and persons required by law to make referrals about the Ashwaubenon School District’s referral and evaluation procedures. The Ashwaubenon School District provides information and inservice opportunities for its licensed staff to familiarize them with the Ashwaubenon School District’s referral procedures. Wis. Stat. § 115.777 EVALUATION As part of an initial evaluation of a child and as part of any reevaluation of a child, the IEP team and other qualified professionals, as determined by the Ashwaubenon School District: Reviews existing evaluation data on the child, including evaluations and information provided by the child’s parents, previous interventions and the effects of those interventions, current classroom-based, local, or state assessments, classroom-based observations, and observations by teachers and related services providers; and On the basis of that review and information provided by the child’s parents, identifies the additional data, if any, that are needed, to determine: Whether the child has a particular category of disability and the educational needs of the child or, in case of a reevaluation of a child, whether the child continues to have such a disability and the educational needs of the child; 20 U.S.C. 6318 34 C.F.R. Part 200 et seq. The present levels of academic achievement and related developmental needs of the child; TITLE I – PARENTS’ RIGHT TO KNOW (NEOLA 2261.02) Whether the child needs special education and related services, or in the case of a reevaluation of a child, whether the child continues to need special education and related services; and In accordance with the requirement of Section 1111 of Title I, for each school receiving Title I funds, the Superintendent shall make sure that all parents of students in that school are notified that they may request, and the District will provide the following information on the student’s classroom teachers: A. Whether the teacher(s) have met the State qualification and licensing criteria for the grade level and subject areas they are teaching. B. Whether the teacher(s) is teaching under any emergency or provisional status in which the State requirements have been waived. Whether any additions or modifications to the special education and related services are needed to enable the child to meet the measurable, annual goals specified in the child’s IEP and to participate, as appropriate, in the general education curriculum. The Ashwaubenon School District administers such assessment and other evaluations as may be needed to produce the additional data. The review of existing evaluation data on the child may occur without conducting a meeting. Stat. § 115.782(2)(b) The Ashwaubenon School District does not require parental consent before reviewing existing data as part of an evaluation or reevaluation or administering a test or other evaluation that is administered to all children unless, before administration of that test or evaluation, the Ashwaubenon School District requires consent for all children. 34 CFR § 300.300(d)(1) Screening of a student by a teacher or specialist to determine appropriate instructional strategies for curriculum implementation is not considered to be an evaluation for eligibility for special education and related services. 34 CFR § 300.302 The Ashwaubenon School District provides the parents of the child with proper written notice, of any evaluation procedures the agency proposes to conduct, and the names of the individuals who will conduct the evaluation, if known. 34 CFR § 300.304(a); Wis. Stat. § 115.782(1)(a) ATTENDANCE (NEOLA 5200) State law requires the Board of Education to enforce the regular attendance of students. Further, the Board recognizes that the District’s educational program is predicated upon the presence of the student and requires continuity of instruction and classroom participation. The regular contact of students with one another in the classroom and their participation in a well-planned instructional activity under the tutelage of a competent teacher are vital to this purpose. All children between six (6) and eighteen (18) years of age shall attend school regularly during the full period and hours, religious holidays excepted, that the school in which the child is enrolled is in session until the end of the term, quarter, or semester of the school year in which the child becomes eighteen (18) years of age, unless they fall under an exception under State law, this policy, or administrative guideline issued under this policy. A child who is enrolled in five (5) year-old kindergarten shall attend school regularly, religious holidays excepted, during the full period and hours that kindergarten is in session until the end of the school term. Written Excuse Required The Superintendent shall require, from the parent or guardian of each student or from an adult student, who has been absent for any reason a written, signed, dated statement stating the reason for the absence and the time period covered by the absence. The Board reserves the right to verify such statements and to investigate the cause of each single absence. School Attendance Officer The Superintendent shall designate an administrator at each school to be the School Attendance Officer. The School Attendance Officer shall perform any duties and responsibilities s/he is required to perform by State law, this policy, and any administrative guidelines issued by the school. The duties of the School Attendance Officer shall include, but not be limited to, the following. A. Determining daily from attendance reports submitted by teachers which students enrolled in the school are absent from school and whether the absence is excused. B. Submitting to the Superintendent, on or before August 1st of each year, a report of the number of students enrolled in the school who were absent in the previous year and whether the absences were excused. The Superintendent shall then submit this information to the State Superintendent. C. Providing student attendance information to individuals and agencies for purposes authorized by State law and the Board’s Policy 8330 - Student Records. Excused Absences As required under State law, a student shall be excused from school for the following reasons: A. Physical or Mental Condition - The student is temporarily not in proper physical or mental condition to attend a school program. B. Obtaining Religious Instruction - To enable the student to obtain religious instruction outside the school during the required school period (see Policy 5223 - Absences for Religious Instruction). C. Permission of Parent or Guardian - The student has been excused by his/her parent or guardian before the absence for any or no reason. A student may not be excused for more than ten (10) days per school year under this paragraph and must complete any course work missed during the absence. Examples of reasons for being absent that should be counted under this paragraph include, but are not limited to, the following: 1.professional and other necessary appointments (e.g., medical, dental, and legal) that cannot be scheduled outside of the school day 2. to attend the funeral of a relative 3. legal proceedings that require the student’s presence 4. college visits 5. vacations D. Religious Holiday - For observance of a religious holiday consistent with the student’s creed or belief. E. Suspension or Expulsion - The student has been suspended or expelled. F. Program or Curriculum Modification -The Board has excused the student from regular school attendance to participate in a program or curriculum modification leading to high school graduation or a high school equivalency diploma as provided by State law. G. High School Equivalency - Secured Facilities - The Board has excused a student from regular school attendance to participate in a program leading to a high school equivalency diploma in a secured correctional facility, a secured child caring institution, a secure detention facility, or a juvenile portion of a county jail, and the student and his/her parent or guardian agree that the student will continue to participate in such a program. H. Child at Risk - The student is a “child at risk” as defined under State law and is participating in a program at a technical college on either a part-time or full-time basis leading to high school graduation, as provided under State law. A student may be excused from school, as determined by the School Attendance Officer, or his/her designee, for the following reasons: A. Quarantine - Quarantine of the student’s home by a public health officer. B. Illness of an Immediate Family Member - The illness of an immediate family member. C. Emergency - An emergency that requires the student to be absent because of familial responsibilities or other appropriate reasons. Unexcused Absences Unexcused absences demonstrate a deliberate disregard for the educational program and are considered a serious matter. The Superintendent shall develop administrative guidelines to address unexcused absences. The Board authorizes, but does not encourage the Superintendent, to suspend a student from a particular class or from school if sincere efforts by the staff and parents cannot rectify the pattern of absence. In keeping with its philosophy, the Board supports efforts to provide for out-of-school alternative educational opportunities for truant students rather than to heighten the effects of absence through suspension. Truancy Plan The Board will issue a Truancy Plan based upon the recommendations of the County Truancy Committee convened under State law, the Board’s policies and procedures, and applicable provisions of State law. The Board will review and, if appropriate, revise the Truancy Plan at least once every two (2) years. The Truancy Plan will include, at a minimum, the following: A. procedures to be followed for notifying the parents or guardians of the unexcused absences of a student who is truant or a habitual truant and for meeting and conferring with such parents or guardians B. plans and procedures for identifying truant children of all ages and returning them to school, including the identity of school personnel to whom a truant child shall be returned C. methods to increase and maintain public awareness of and involvement in responding to truancy within the school district D. a provision addressing the immediate response to be made by school personnel when a truant child is returned to school E. the types of truancy cases to be referred to the District Attorney and the time periods within which the District Attorney will respond to and take action on the referrals F. plans and procedures to coordinate the responses to the problems of habitual truants, as defined under Sec. 118.16(1)(a), Wis. Stats., with public and private social services agencies G. methods to involve the truant child’s parent or guardian in dealing with and solving the child’s truancy problem A student will be considered truant if s/he is absent part or all of one (1) or more days from school during which the School Attendance Officer, principal, or a teacher has not been notified of the legal cause of such absence by the parent or guardian of the absent student. A student who is absent intermittently for the purpose of defeating the intent of the Wisconsin Compulsory Attendance Statute Sec. 118.15, Wis. Stats., will also be considered truant. A student will be considered a habitual truant if s/he is absent from school without an acceptable excuse for part or all of five (5) or more days on which school is held during a school semester. Notice of Truancy The School Attendance Officer shall notify a truant student’s parent or guardian of the student’s truancy and direct the parent or guardian to return the student to school no later than the next day on which school is in session or to provide an excuse for the absence. The notice under this paragraph shall be given before the end of the second school day after receiving a report of an unexcused absence. Notice shall be made by personal contact or telephone call, if possible, and a written record of this notice shall be kept. If such notice is not effective, notice shall be made by mail. This notice must be given every time a student is truant until the student becomes a habitual truant. Notice of Habitual Truancy When a student initially becomes a habitual truant, the School Attendance Officer shall provide a notice to the student’s parent or guardian, by registered or certified mail, which contains the following: A. a statement of the parent’s or guardian’s responsibility under State law to cause the student to attend school regularly B. a statement that the parent, guardian, or student may request program or curriculum modifications for the student under State law and that the student may be eligible for enrollment in a program for children at risk C. a request that the parent or guardian meet with the appropriate school personnel to discuss the student’s truancy The notice shall include the name of the school personnel with whom the parent or guardian should meet, a date, time, and place for the meeting and the name, address, and telephone number of a person to contact to arrange a different date, time, or place. The date for the meeting shall be within five (5) school days after the date that the notice is sent, except that with the consent of the student’s parent or guardian the date for the meeting may be extended for an additional five (5) school days. D. a statement of the penalties, under State law or local ordinances that may be imposed on the parent or guardian if s/he fails to cause the child to attend school regularly as required by State law The School Attendance Officer will also continue to notify the parent or guardian of a habitual truant’s subsequent unexcused absences. Referral to the District Attorney Truancy cases will be referred to the District Attorney as provided in the County Truancy Committee Plan. The School Attendance Officer will ensure that appropriate school personnel have done the following before any case is referred to the District Attorney: A. met with the student’s parent or guardian to discuss the student’s truancy or attempted to meet with the student’s parent or guardian and received no response or were refused B. provided an opportunity for educational counseling to the student to determine whether a change in the student’s curriculum would resolve the student’s truancy and have curriculum modifications under State law C. evaluated the student to determine whether learning problems may be a cause of the student’s truancy and, if so, have taken steps to overcome the learning problems, except that the student need not be evaluated if tests administered to the student within the previous SUNDAY MONDAY MARCH VISIT www.ashwaubenon.k12.wi.us FOR INTERACTIVE, UP-TO-DATE SCHOOL EVENT CALENDARS! Paragraphs B., C., and D. are not required if appropriate school personnel were unable to carry out the activity due to the student’s absences from school. Make-up Course Work and Examinations Excused Absences – A student whose absence from school was excused, except for an expelled student, shall be permitted to make-up course work and any quarterly, semester, or grading period examinations missed during the absences when they return to school. It is the student’s responsibility to contact his/her teachers to determine what course work and examinations must be made-up. Teachers shall have the discretion to assign substitute course work and examinations. Teachers shall also have the discretion to specify where and when examinations and course work shall be completed, including outside regular school hours. The time for completing the work shall be commensurate with the length of the absence, unless extended by the principal based upon extenuating circumstances. Unexcused Absences – Credit in a course or subject shall not be denied solely because of a student’s unexcused absences from school. Students with unexcused absences shall be permitted to make-up course work and any quarterly, semester, or grading period examinations missed during the absence if the student is at risk of receiving no credit in a course or subject if the work is not made up. Subject to the immediately preceding two (2) paragraphs, credit may, but is not required to be given for the completion of make-up work. Further, credit for make-up work may be given only after the student has satisfied consequences imposed for unexcused absences. The extent to which make-up credit is given shall be determined on a case-by-case basis by the principal and the respective teachers. Building principal shall prepare guidelines for considerations in granting credit as appropriate to student age and grade level. If make-up work has been assigned, it is the student’s responsibility to contact his/her teachers to determine what course work and examinations must be made-up. Superintendent Guidelines - The Superintendent shall develop administrative guidelines concerning the attendance of students which: A. ensure a school session which is in conformity with the requirement of the law; B. ensure that students absent for an excusable reason have an opportunity to make-up work they missed; C. govern the keeping of attendance records in accordance with State law; D. facilitate implementation of the Truancy Plan; E. identify the habitual truant, investigate the cause(s) of his/her behavior, and consider modification of his/her educational program to meet particular needs and interests; F. ensure that any student who, due to a specifically identifiable physical or mental impairment, exceeds or may exceed the District’s limit on excused absence is referred for evaluation for eligibility either under the Individuals with Disabilities Education Act (IDEA) or Section 504 of the Rehabilitation Act of 1973 and Chapter 115, Wis. Stats.; G. provide that a student’s grade in any course is based on his/her performance in the instructional setting and is not reduced for reasons of conduct. If a student violates the attendance or other rules of the school, s/he should be disciplined appropriately for the misconduct, but his/her grades should be based upon what the student can demonstrate s/he has learned; H. ensure that all parents and students are informed of the District’s Attendance Policy and related guidelines; I. enable the School Attendance Officer to perform his/her duties under State law and this policy; and J. address unexcused absences. 115, 118.15, 118.125(2), 118.153, 118.16, 118.162, Wis. Stats Revised 8/27/12 ATTENDANCE OF OPEN ENROLLMENT STUDENTS (WIS. STATS. 118.51(5)3 AND NEOLA 5113) An open enrollment student’s ability to maintain their open enrollment status is dependent on their attendance. In 2009, WI Act 304 provides that a nonresident school board may notify the parent of a habitual truant student, that the student may not attend the nonresident school district in the following semester or school year. Habitual Truant is defined as a pupil who is absent from school without an acceptable excuse for part or all of five or more school days on which school is held during a school semester. Policy 5113; Full Time Open Enrollment; A(9) - Whether the nonresident school board has made a determination that a pupil attending the nonresident school district is habitually truant from the nonresident school district during either semester of the current school year, the nonresident school board may prohibit the student from attending the nonresident school district in the succeeding semester of school year. STUDENT ELECTOR REGISTRATION INFORMATION Students eligible to vote can obtain elector registration information from their school principal. STUDENT PRIVACY AND PARENTAL ACCESS TO INFORMATION (NEOLA 2416) The Board of Education respects the privacy rights of parents and their children. No student shall be required, as a part of the school program or the District’s curriculum, without prior written consent of the student (if an adult, or an emancipated minor) or, if an unemancipated minor, his/ her parents, to submit to or participate in any survey, analysis, or evaluation that reveals information concerning: A. political affiliations or beliefs of the student or his/her parents; B. mental or psychological problems of the student or his/her family; C. sex behavior or attitudes; D. E. F. G. H. illegal, anti-social, self-incriminating or demeaning behavior; critical appraisals of other individuals with whom respondents have close family relationships; legally recognized privileged and analogous relationships, such as those of lawyers, physicians, and ministers; religious practices, affiliations, or beliefs of the student or his/her parents; or income (other than that required by law to determine eligibility for participation in a program or for receiving financial assistance under such a program). The Superintendent shall ensure that procedures are established whereby parents may inspect any materials created by a third party used in conjunction with any such survey, analysis, or evaluation before the survey/evaluation is administered or distributed by the school to the student. The parent will have access to the survey/evaluation within a reasonable period of time after the request is received by the building principal. Consistent with parental rights, the Board directs building and program administrators to: A. notify parents in writing of any surveys, analyses, or evaluations, which may reveal any of the information, as identified in A-H above, in a timely manner, and which allows interested parties to request an opportunity to inspect the survey, analysis, or evaluation; and the administrator to arrange for inspection prior to initiating the activity with students; B. allow the parents the option of excluding their student from the activity; C. report collected data in a summarized fashion which does not permit one to make a connection between the data and individual students or small groups of students; D. treat information as identified in A-H above as any other confidential information in accordance with Policy 8350. Additionally, parents have the right to inspect, upon request, any instructional material used as part of the educational curriculum of the student. The parent will have access to the instructional material within a reasonable period of time after the request is received by the building principal. The term instructional material means instructional content that is provided to a student, regardless of its format, including printed and representational materials, audio-visual materials, and materials in electronic or digital formats (such as materials accessible through the Internet). The term does not include academic tests or assessments. For the privacy of students whose parents request that they not take part in the survey, arrangements will be made prior to the time period when the survey will be given, for the student(s) to go to a supervised location where under the supervision of a staff member the student will be provided with an alternate activity. The Board will not allow the collection, disclosure, or use of personal information collected from students for the purpose of marketing or for selling that information (or otherwise providing that information to others for that purpose). The Superintendent is directed to provide notice directly to parents of students enrolled in the District of the substantive content of this policy at least annually at the beginning of the school year, and within a reasonable period of time after any substantive change in this policy. In addition, the Superintendent is directed to notify parents of students in the District, at least annually at the beginning of the school year, of the specific or approximate dates during the school year when the administration of any survey by a third party that contains one or more of the items described in A though H above are scheduled or expected to be scheduled. For purposes of this policy, the term “parent” includes a legal guardian or other person standing in loco parentis (such as grandparent or stepparent with whom the child lives, or a person who is legally responsible for the welfare of the child). 20 U.S.C. 1232(a)(b)(g)(h) STUDENT RECORDS (NEOLA 8330) In order to provide appropriate educational services and programming, the Board of Education must collect, retain, and use information about individual students. Simultaneously, the Board recognizes the need to safeguard students’ privacy and restrict access to students’ personally identifiable information. Except for data identified by policy as “directory data,” student “personally identifiable information” includes, but is not limited to: the student’s name; the name of the student’s parent or other family members; the address of the student or student’s family; a personal identifier, such as the student’s social security number, student number, or biometric record; other indirect identifiers, such as the student’s date of birth, place of birth, and mother’s maiden name; other information that, alone or in combination, is linked or linkable to a specific student that would allow a reasonable person in the school community, who does not have personal knowledge of the relevant circumstances, to identify the student with reasonable certainty; or information requested by a person who the District reasonably believes knows the identity of the student to whom the education record relates. The Board is responsible for the records of all students who attend or have attended schools in this District. Only records mandated by the State or Federal government and/or necessary and relevant to the function of the School District or specifically permitted by this Board will be compiled by Board employees. In all cases, permitted, narrative information in student records shall be objectively-based on the personal observation or knowledge of the originator. Student records shall be available only to students and their parents, eligible students, designated school officials who have a legitimate educational interest in the information, or to other individuals or organizations as permitted by law. The term “parents” includes legal guardians or other persons standing in loco parentis (such as a grandparent or stepparent with whom the child lives, or a person who is legally responsible for the welfare of the child). The term “eligible student” refers to a student who is eighteen (18) years of age or older, or a student of any age who is enrolled in a postsecondary institution. Both parents shall have equal access to student records unless stipulated otherwise by court order or law. In the case of eligible students, parents may be allowed access to the records without the student’s consent, provided the student is considered a dependent under section 152 of the Internal Revenue Code. Girls Var/JV Soccer @ Sheb North Var/JV Baseball vs Sheb North PAST MAY 2015 A school official is a person employed by the Board as an administrator, supervisor, teacher/instructor (including substitutes), or support staff member (including health or medical staff and law enforcement unit personnel); a person serving on the Board; a person or company with whom the Board has contracted to perform a special task (such as an attorney, auditor, or medical consultant); a contractor, consultant, volunteer or other party to whom the Board has outsourced a service otherwise performed by Board employees (e.g. a therapist); or a parent or student serving on an official committee, such as a disciplinary or grievance committee, or assisting another school official in performing his/her tasks (including volunteers). “Legitimate educational interest” is defined as a “direct or delegated responsibility for helping the student achieve one (1) or more of the educational goals of the District” or if the record is necessary in order for the school official to perform an administrative, supervisory, or instructional task or to perform a service or benefit for the student or the student’s family. The Board directs that reasonable and appropriate methods (including but not limited to physical and/or technological access controls) are utilized to control access to student records and to make certain that school officials obtain access to only those education records in which they have legitimate educational interest. The Board authorizes the administration to: A. forward student records, including disciplinary records with respect to suspensions and expulsions, upon request to a private or public school or school district in which a student of this District is enrolled, seeks or intends to enroll, or is instructed to enroll, on a full-time or part-time basis, upon condition that: 1. a reasonable attempt is made to notify the student’s parent or eligible student of the transfer (unless the disclosure is initiated by the parent or eligible student; or the Board’s annual notification - Form 8330 F9 - includes a notice that the Board will forward education records to other agencies or institutions that have requested the records and in which the student seeks or intends to enroll or is already enrolled so long as the disclosure is for purposes related to the student’s enrollment or transfer); 2. the parent or eligible student, upon request, receives a copy of the record; and 3. the parent or eligible student, upon request, has an opportunity for a hearing to challenge the content of the record; B. provide “personally-identifiable” information to appropriate parties, including parents of an eligible student, whose knowledge of the information is necessary to protect the health or safety of the student or other individuals, if there is an articulable and significant threat to the health or safety of a student or other individuals, considering the totality of the circumstances; C. report a crime committed by a child to appropriate authorities, and, with respect to reporting a crime committed by a student with a disability, to transmit copies of the student’s special education and disciplinary records to the authorities for their consideration; D. release de-identified records and information in accordance with Federal regulations; E. disclose personally identifiable information from education records, without consent, to organizations conducting studies “for, or on behalf of” the District for purposes of developing, validating or administering predictive tests, administering student aid programs, or improving instruction; Information disclosed under this exception must be protected so that students and parents cannot be personally identified by anyone other than representative of the organization conducting the study, and must be destroyed when no longer needed for the study. In order to release information under this provision, the District will enter into a written agreement with the recipient organization that specifies the purpose of the study. (See Form 8330 F14.) While the disclosure of personally identifiable information without consent is allowed under this exception, it is recommended that whenever possible the administration either release de-identified information or remove the students’ names and social security identification numbers to reduce the risk of unauthorized disclosure of personally identifiable information. F. disclose personally identifiable information from education records without consent, to authorized representatives of the Federal government, as well as State and local educational authorities. The disclosed records must be used to audit or evaluate a Federal or State supported education program, or to enforce or comply with Federal requirements related to those education programs. A written agreement between the parties is required under this exception. (See Form 8330 F16) The District will verify that the authorized representative complies with FERPA regulations. G. request each person or party requesting access to a student’s record to abide by Federal regulations and State laws concerning the disclosure of information. disclosure of directory data that participates in extra-curricular activity must complete Form 2431 F1 – Parent Acknowledgement of Risk and Release, which includes a limitation on the refusal to disclose directory information obtained during the course of the student’s participation in extra-curricular activities. If parents and eligible students do not submit such written notification to the Board, directory information may be utilized by the District Administrator in District-wide publications, on the cable television educational access channel, or on the District’s website and related District websites. The directory information used will be properly verified and approved by the District Administrator. In accordance with Federal and State law, the Board shall release the names, addresses, and telephone listings of secondary students to a recruiting officer for any branch of the United States Armed Forces or an institution of higher education who requests such information. A secondary school student or parent of the student may request in writing that the student’s name, address, and telephone listing not be released without prior consent of the parent(s)/eligible student. The recruiting officer is to sign a form indicating that “any information received by the recruiting officer shall be used solely for the purpose of informing students about military service and shall not be released to any person other than individuals within the recruiting services of the Armed Forces.” The Superintendent is authorized to charge mailing fees for providing this information to a recruiting officer. Whenever consent of the parent(s)/eligible student is required for the inspection and/or release of a student’s health or education records or for the release of “directory information,” either parent may provide such consent unless agreed to otherwise in writing by both parents or specifically stated by court order. If the student is under the guardianship of an institution, the Superintendent shall appoint a person who has no conflicting interest to provide such written consent. The Board may disclose “directory information,” on former students without student or parental consent, unless the parent or eligible student previously submitted a request that such information not be disclosed without their prior written consent. The Board shall not permit the collection, disclosure, or use of personal information collected from students for the purpose of marketing or for selling that information (or otherwise providing that information to others for that purpose). Inspection Of Information Collection Instrument The parent of a student or an eligible student has the right to inspect upon request any instrument used in the collection of personal information before the instrument is administered or distributed to a student. Personal information for this section is defined as individually identifiable information including a student or parent’s first and last name, a home or other physical address (including street name and the name of the city or town), a telephone number, or a Social Security identification number. In order to review the instrument, the parent or eligible student must submit a written request to the building principal at least ten (10) business days before the scheduled date of the activity. The instrument will be provided to the parent or eligible student within ten (10) business days of the principal receiving the request. The Superintendent shall directly notify the parent(s) of a student and eligible students, at least annually at the beginning of the school year, of the specific or approximate dates during the school year when such activities are scheduled or expected to be scheduled. This section does not apply to the collection, disclosure, or use of personal information collected from students for the exclusive purpose of developing, evaluating, or providing educational products or services for, or to, students or educational institutions, such as the following: A. college or other postsecondary education recruitment, or military recruitment B. book clubs, magazine, and programs providing access to low-cost literary products C. curriculum and instructional materials used by elementary and secondary schools D. tests and assessments used by elementary and secondary schools to provide cognitive, evaluative, diagnostic, clinical, aptitude, or achievement information about students (or to generate other statistically useful data for the purpose of securing such tests and assessments) and the subsequent analysis and public release of the aggregate data from such tests and assessments E. the sale by students of products or services to raise funds for school-related or education-related activities F. student recognition programs The Board shall maintain a record of each request for access and each disclosure of personally identifiable information. Such disclosure records will indicate the student, person viewing the record, their legitimate interest in the information, information disclosed, date of disclosure, and date parental/eligible student consent was obtained (if required). The Superintendent is directed to prepare administrative guidelines so that students and parents are adequately informed each year regarding their rights to: A. inspect and review the student’s education records; B. request amendments if the parent believes the record is inaccurate, misleading, or violates the student’s privacy rights; C. consent to disclosures of personally-identifiable information contained in the student’s education records, except to those disclosures allowed by the law; D. challenge Board noncompliance with a parent’s request to amend the records through a hearing; E. file a complaint with the United States Department of Education; F. obtain a copy of the Board’s policy and administrative guidelines on student records. Only “directory information” regarding a student shall be released to any person or party, other than the student or his/her parent, without the written consent of the parent, or, if the student is an eligible student, without the written consent of the student, except to those persons or parties stipulated by the Board’s policy and administrative guidelines and/or those specified in the law. The Superintendent shall also develop procedural guidelines for: A. the proper storage and retention of records including a list of the type and location of records; B. informing Board employees of the Federal and State laws concerning student records. Directory Information The Board authorizes the use of the microfilm process or electromagnetic processes of reproduction for the recording, filing, maintaining, and preserving of records. The Board will comply with a legitimate request for access to a student’s records within a reasonable period of time but not more than forty-five (45) days after receiving the request or within such shorter period as may be applicable to students with disabilities. Upon the request of the viewer, a record shall be reproduced, unless said record is copyrighted, or otherwise restricted, and the viewer may be charged a fee equivalent to the cost of handling and reproduction. Based upon reasonable requests, viewers of education records will receive explanation and interpretation of the records. Each year the Superintendent shall provide public notice to students and their parents of the District’s intent to make available, upon request, certain information known as “directory information.” The Board designates as student “directory information”: a student’s name; address; telephone number; date and place of birth; photograph; major field of study; participation in officially-recognized activities and sports; height and weight, if a member of an athletic team; dates of attendance; date of graduation; or awards received. Directory information shall not be provided to any organization for profit-making purposes. Parents and eligible students may refuse to allow the Board to disclose any or all of such “directory information” upon written notification to the Board within ten (10) days after receipt of the Superintendent’s annual public notice. Any parent or eligible student that refuses to allow No liability shall attach to any member, officer, or employee of this Board as a consequence of permitting access or furnishing student records in accordance with this policy and regulations. Any entity receiving personally identifiable information pursuant to a study, audit, evaluation or enforcement/compliance activity must comply with all FERPA regulations. Further, such an entity must enter into a written contract with the Board delineating its responsibilities in safeguarding the disclosed information. Specifically, the entity must demonstrate the existence of a sound data security plan or data stewardship program, and must also provide assurances that the personally identifiable information will not be redisclosed without prior authorization from the Board. The Board shall permit students, with written parental permission, to be absent from school during required school periods at least sixty (60) minutes but not more than 180 minutes per week to obtain religious instruction outside of school. A student must be properly registered and a copy of such registration must be filed with the principal. The supervisor of the religious instruction must report monthly to the District the names of the students who are attending the weekly instruction. The District will assume no liability for a student while attending religious instruction nor will it provide transportation for such instruction. No solicitation for attendance at religious instruction shall be permitted on District premises. No member of the staff shall encourage nor discourage participation in any religious instruction program. 118.155, Wis. Stats. RELIGIOUS/PATRIOTIC CEREMONIES & OBSERVANCES (NEOLA 8800) Decisions of the United States Supreme Court have made it clear that it is not the province of a public school to advance or inhibit religious beliefs or practices. Under the First and Fourteenth Amendments to the Constitution, this remains the inviolate province of the individual and the church of his/her choice. The rights of any minority, no matter how small, must be protected. No matter how well intended, either official or unofficial sponsorship of religiously-oriented activities by the school are offensive to some and tend to supplant activities which should be the exclusive province of individual religious groups, churches, private organizations, or the family. District staff members shall not use prayer, religious readings, or religious symbols as a devotional exercise or in an act of worship or celebration. The District shall not function as a disseminating agent for any person or outside agency for any religious or anti-religious document, book, or article. Distribution of such materials on District property by any party shall be in accordance with Policy 7510 and AG 7510A - Use of District Facilities and Policy 9700 - Relations with Special Interest Groups and AG 9700A – Distribution of Materials to Students. The Board acknowledges that it is prohibited from adopting any policy or rule respecting or promoting an establishment of religion or prohibiting any student from the free, individual, and voluntary exercise or expression of the student’s religious beliefs. However, such exercise or expression may be limited to lunch periods or other non-instructional time periods when students are free to associate. the District. Students will be eligible to receive college and high school credit for completing course(s) at institutions of higher education provided they complete the course(s) and receive a passing grade. The School District’s responsibility to pay for tuition, fees, books and other necessary materials shall be limited to eighteen (18) postsecondary credits per student. The Superintendent shall establish administrative guidelines to ensure that the District’s Youth Options Program comports with applicable State law and the administrative rules of the Department of Public Instruction. The Superintendent shall also ensure that students in grades 9-11 and their parents are provided with information regarding the Program by October 1st each year. 118.37, 118.55, Wis. Stats. P.I. 40 DRUG-FREE SCHOOLS In accordance with Federal Law, the Board of Education prohibits the use, possession, concealment, or distribution of drugs by students on school grounds, in school or school-approved vehicles, or at any school-related event. Drugs include any alcoholic beverage, anabolic steroid, dangerous controlled substance. Compliance with this policy is mandatory for all students. Any student who violates this policy will be subject to disciplinary action, in accordance with due process and as specified in the student handbooks, up to and including expulsion from school. When required by state law, the District will also notify law enforcement officials. The District is concerned about any student who is a victim of alcohol or drug abuse and will facilitate the process by which she/he receives help through programs and services available in the community. Students and their parents should contact the school principal or counseling office whenever such help is needed. CONTROL OF BLOOD-BORNE PATHOGENS (NEOLA 8453.01) The Board of Education seeks to protect those staff members who may be exposed to blood pathogens and other potentially infectious materials in their performance of assigned duties. The Superintendent shall implement administrative guidelines which will: A. identify those categories of employees whose duties create a reasonable anticipation of exposure to blood and other infectious materials; B. provide for inoculation of the Hepatitis B vaccine at no cost to the staff member and in accordance with Federally-mandated scheduling; C. ensure proper training in the universal precautions against exposure and/or contamination including the provision of appropriate protective supplies and equipment; D. establish appropriate procedures for the reporting, evaluation, and follow-up to any and all incidents of exposure; E. provide for record-keeping of all of the above which complies with both Federal and State laws; F. develop an exposure control plan. 29 C.F.R. 1910.1030 2009 WISCONSIN ACT 96 INDOOR ENVIRONMENTAL QUALITY MANAGEMENT PLAN ANNUAL NOTICE The Ashwaubenon School District would like to inform staff, students, parents, and the public of the district’s indoor environmental quality (IEQ) management plan. The plan was initially developed in 2012 and is reviewed as necessary. The plan was developed as deemed appropriate for the district. Questions and concerns should be directed to Thomas Schmitt, Facilities and Maintenance Coordinator. Copies of the plan are available at the district office for a fee. The district office is located at 1055 Griffiths Lane, Ashwaubenon, Wisconsin 54304. District office hours are 7:30 – 4:00. Observance of religious holidays through devotional exercises or acts of worship is also prohibited. Acknowledgement of, explanation of, and teaching about religious holidays of various religions is encouraged. Celebration activities involving nonreligious decorations and use of secular works are permitted, but it is the responsibility of all faculty members to ensure that such activities are strictly voluntary, do not place an atmosphere of social compulsion or ostracism on minority groups or individuals, and do not interfere with the regular school program. The flag of the United States shall be raised above each school and/or at other appropriate places during all school sessions, weather permitting. The flag shall be raised before the opening of school and taken down at its close every day. Professional staff members are authorized to lead students in the Pledge of Allegiance or the National Anthem at an appropriate time each school day. No student may be compelled against the student’s objections or those of the student’s parents to recite the pledge or sing the national anthem. Every school in the District shall offer the Pledge of Allegiance or the National Anthem each school day in grades 1 through 12. The Superintendent/designee shall develop administrative guidelines which ensure that any staff member who conducts this activity does it at an appropriate time, in an appropriate manner, and with due regard to the need to protect the rights and the privacy of a nonparticipating student. 118.06(2), Wis. We do not plan on doing a mass mailing of usernames/passwords each fall. Requests for misplaced usernames/passwords can be emailed to [email protected]. Students new to the district will receive their usernames/passwords and other PowerSchool Parent/Student Access information shortly after school begins each fall. Each fall, the Parent/Student Access feature of PowerSchool will be turned on mid-September. PowerSchool is accessible over the internet at: https://powerschool.ashwaubenon.k12.wi.us/public RAPID NOTIFICATION SYSTEM The school district uses a rapid notification system to quickly notify parents/guardians of emergency situation such as snow days, lockdowns, power outages, etc. It may also be used to send other important, non-emergency information. Parents/Guardians are notified by phone and/or email and/or text, depending on the situation. The system uses the applicable phone and cell numbers and email addresses stored in PowerSchool, our student information system. Our frequent use and reliance upon this system is another important reason to keep your phone and cell numbers and email addresses up to date with your child’s school office.
