The 2012 Dr. Rick Fink Memorial Lecture, our Fall All­ Day Seminar, will be held on Friday, November 30, 2012 at Salvatore’s Italian Gardens in Depew, NY. This year’s lecture features Dr. Brian Nový presenting “Be Very Afraid … An Introduction to Modern Cariology”. This lecture will 1) describe the three types of bacteria that are implicated in dental caries, 2) interpret results from diagnostic tests for dental caries, 3) implement targeted therapuetics in a variety of patients, 4) create restorations that inhibit secondary (recurrent) decay, and 5) transition patients from high to low caries risk. Dr. Nový is an assistant professor of r estorative dentistry at Loma Linda University, where he teaches a variety of courses including caries management, evidence­ based dent istr y, dental materials, and operative dentistry. He maintains a private practice in Newhall, California and acts as clinical director for two non­profit In this Issue:

The day will begin at 8am with registration and a continental breakfast. Dr. Nový will speak from 8:30am ­ 4pm, with a break at 12 NOON for lunch and the 8th District Business Meeting. The cost is $175 for 8th District Members, $225 for non­members. Attendees will receive 8 MCE credits for this course. This year we will also be featuring a Dental Staff Continuing Education Series. This includes 4 separate seminars that will run simultaneously with the Dr. Rick Fink Memorial Lecture ­ same date, same location, same time. These courses are specifically focused on issues that face the dental staff. There is also a $25 fee for lunch, unless registered for 2 or more courses. Attendees will receive 1.5 MCE credits per dental staff course attended. Following the Rick Fink Memorial Lecture­Fall All Day Seminar and the Dental Staff Continuing Education Series, the Eighth District Dental Society is sponsoring a cocktail hour, from 4­5pm right at Salvatore’s Italian Gardens.

By Chester J. Gary, DDS, JD Large Group Practice and Dental Service Organizations (DSOs) claim to enable dentists to do what they went to dental school to do: practice dentistry. This may be the goal for a small percentage of dentists. Most of us, however, went to dental school to live the dream of personal and professional autonomy. We want control of our practices and our lives. In the face of today’s economic and regulatory challenges, these entities relieve dentists of the financial risks of ownership and the responsibilities of day­to­day operations. Increasing student loan debt, the high cost of practices and the lack of clinical and management experience may force new dentists to postpone the dream of autonomy and settle for corporate employment just to survive. Dentists must realize this “relief” acts as a “Catch 22”. The only way to realize our dream of autonomy is to accept and embrace the very financial risks of ownership and management challenges which many dentists now abdicate to these corporate organizations. Owners and managers in any business control the decision making process. Non­owner employees must accept the owner’s terms or leave. Exercise of this authority earns the owners and managers professional and personal autonomy. In solo and small to mid­sized group dental practices, we, as owner dentists, control our The only way to realize our personal and professional destinies. enjoying the privilege of helping others. We can establish and operate our practices as we see fit, and buy and sell our equity ownership for fair market value as we transition. The practice of dentistry as an employee does not secure these privileges. As corporate entities own and operate dental practices, the corporations, not the practicing dentists, earn the privilege of autonomy. In the Large Group Practice model, dentists function as employees with minimal control. DSOs enter agreements with owner dentists, which result in the DSO providing, among others, materials, human resources, marketing and information technology services. Control of these critical components allows DSOs to function as de facto practice owners. As we abdicate more responsibilities to corporate entities, they, in fact, will begin to dictate the meaning of success to dentists. The slippery slope will continue as corporate stakeholders interfere with the practitioner’s clinical practice. Transitions of equity ownership for fair market value on our own terms will cease to exist. A further threat to our dream of autonomy arises when non­dentists own a majority or all the interest in these corporate entities. States vary on the regulations for non­dentist ownership of dental practices and their enforcement. In many states, non­dentists can legally own and control the practice operation. By Brendan P. Dowd, DDS The latest and most controversial term spoken around the dental water cooler these days is midlevel providers. This is a general all encompassing term used to describe Dental Therapists, Dental Health Aid Therapists and Advanced Dental Hygiene Practitioners. What they all refer to is non­dentists, either licensed or attempting to become licensed, performing irreversible surgical procedures on patients. At this time, there are already two states, Alaska and Minnesota, in which these laws have been passed. There are also a series of legislative efforts in progress which are attempting to bring these practitioners to a number of other states. The American Dental Association’s position concerning midlevel providers is straight forward. We are against non­dentists performing irreversible surgical procedures on patients. Midlevel providers have an inadequate educational background to consistently perform these procedures and be ready to handle all the possible sequelae for this level of care. We all understand the reason why this issue has taken on such an urgent tone. There is a disparity of care in certain areas of the country, especially in poverty stricken and urban settings. The actual percentage of the population who regularly see a dentist in the United States is less than 50%. They are also on average going fewer times and spending less money per visit since the latest recession started in 2008. In its’ “Breaking Down Barriers to Oral Health for All Americans” position papers the ADA has begun to skillfully explain the complexity of the problem. Given the financial issues, problems with the safety net for less fortunate Americans as well as particular workforce issues, it is obvious this problem will not be easily solved. That is a short version of what is occurring on the national level. But what can we do on the local level in our district to help with some of the same problems. As a sole proprietor with my own business, I am a strong believer in the private practice model. But the days of just worrying about your own patients and business are over. Focus on Ethics: Teeth Whitening Q: I have seen advertisements whereby teeth whitening is being performed in venues other than dental offices. Are businesses such as salons and spas allowed to advertise and perform such procedures without having a licensed dentist or hygienist present? A: The New York State Board For Dentistry issued official guidelines for teeth whitening in the latter portion of 2009. The agency charged with the task of enforcing these guidelines is the Office of Professional Discipline (OPD). OPD will not enforce the State Board’s ruling while the Federal Trade Commission (FTC) action is still in effect against the North Carolina Dental Board. A summary of what events transpired with the North Carolina State Board of Dental Examiners (NCSBDE) is as follows: The NCSBDE is composed of eight members: six practicing dentists, one dental hygienist, and one consumer member. They are charged with regulating the practice of dentistry in the state and ensuring compliance of the Dental Practice Act. In response to the popularity of teeth whitening, non­ dentists began offering these services at locations such as mall kiosks, spas, retail stores and salons in approximately 2003. This activity and history mirrors what has transpired in the 8 th District. As of 2006­2007 ­­­ and in response to complaints by dentists in N. Carolina ­­­ the NCSBDE acted as follows: (1) sent numerous letters to non­dentist teeth whitening providers ordering them to cease and desist from offering these services (2) sent letters to manufacturers of equipment used by non­dentist providers ordering them to cease and desist from assisting clients offering teeth whitening services (3) sent letters to dissuade persons considering opening non­dentist teeth whitening businesses (4) sent letters to owners or operators of malls to dissuade them from leasing space to non­dentist providers of teeth whitening services (5) enlisted the help of the cosmetology board to dissuade its licensees from providing teeth whitening services. Agreements to exclude an entire class of competitors from the marketplace by foreclosing access to suppliers, customers, or the market itself have long been treated as per se illegal or presumptively illegal under the antitrust (Continued on page 7)

(ADA Resolution 2000:462) The future of dentists’ professional and personal autonomy rests upon the same principle. need to be aware of the barriers to dental care in our community as well as our district. Collectively as a dental society and individually as members of our profession we need to reach out and help less fortunate members of our communities. Through collaborative projects and volunteerism it is now more important than ever to give back to the communities we live and work in. The solution does not require dentists ignore the entrepreneurial, financial, accounting and management skills of corporate experts. It’s not the expertise itself which interferes with our autonomy; it’s how we utilize and control it. The concept of Large Groups and DSOs can offer the autonomy dentists desire, but only if the practicing dentists maintain controlling ownership and accountability for management. Guests enjoyed music performed by our own dentists ­ Central Groove comprised of Drs. Chet Gary, John Nasca, Joe Modica and Katy Coster­Burgler. Magic Mike, the magician provided entertainment with his slight of hand and other magic tricks. Mrs. Panna Shelawala, Mrs. Dian Tucker and Mrs. Christina Forcier provided entertainment for the children. While the rain fell, they engaged in craft making and when the rain stopped, they headed to the beach for a treasure hunt. The Eighth District Dental Society is currently collaborating with the Health Foundation of Western and Central New York with two projects. We are helping them with their Chompers Program by leasing mobile dental equipment used to treat kids from age 0 to 5 at Head Start Programs. This includes dentists and their staff from community dental clinics travelling to these sites to perform dentistry. It is an unconventional setting for dental work to be done yet it is a chance to examine and treat children who do not see a dentist before problems increase exponentially. Another area we are collaborating on is visiting a number of Senior Centers to give presentations about the importance of a healthy mouth, complete oral cancer screenings and provide a free meal to those who attend. The Health Foundation will provide the financial support and the Eighth District will provide the volunteers for each event. As a practicing dentist there are other ways to volunteer to help your community. The Good Neighbors clinic on the east side of Buffalo provides dentistry for the less fortunate and can always use some help. Volunteering to help at other Eighth District events (Mall Fairs/Oral Cancer Screenings) is another way to contribute. Of course you can give to your community in other ways outside of dentistry altogether. Other not for profit organizations as well as your local churches and schools always have room for people who are well educated with leadership skills. Anyone who already does this almost universally attests to a wonderful feeling at the end of a day of volunteering to help the less fortunate in our communities. Assistance for Dependencies Available

The FTC concluded in July, 2011 that the North Carolina Dental Board illegally stifled competition by stopping non­dentists from providing teeth whitening services. The FTC decision basically states that it is misleading to claim that teeth whitening is really anything that requires professional judgment and that there has not been a single case of harm to anyone that is credible from lay people providing teeth whitening services. from the federal antitrust laws because government regulation is inherently antithetical to antitrust principles and antitrust principles must yield to such legitimate state regulatory schemes. The FTC argument is that the NCSBDE (i.e. which is directly elected by all of the dentists in N. Carolina) is not a sovereign state agency. Rather, it is a collection of competing dentists elected by other dentists and is not otherwise actively controlled by the government of the State of N. Carolina. ***In the interim, all complaints that deal with teeth whitening being performed by non­dentists should be sent directly to OPD ­­­ either by the dentist making the complaint or the non­dentist consumer who is making the complaint. IF these complaints are logged with OPD and IF the FTC decision is reversed in court, THEN OPD may initiate action on these cases and complaints. The FTC case has been appealed by N. Carolina to the U.S. Court of Appeals for the Fourth District and is likely to be heard sometime in October. The legal opinion is that the merits of the case are very poor at present for N. Carolina because they failed miserably to demonstrate that teeth whitening was something requiring a skilled professional’s judgment. The only real hope for N. Carolina is a technical antitrust argument that the actions of a state agency are immune from antitrust scrutiny by the FTC under a legal doctrine created by the U.S. Supreme Court known as the “state action doctrine.” The state Personal Finance Symposium

This year the mentoring lunch was replaced by the implementation of the new year­long mentoring program. The business meeting was held during a lunch for members and featured John Murphy as the speaker. The lunch was attended by 30 members. 7 Mentoring Program The word mentor is of Greek origin meaning a trusted friend, counselor or teacher with more experience. A mentor advises and serves as an example. A mentor can be older, younger or of the same age as the person being mentored. Earlier this year, the Eighth District Dental Society, the Erie County Dental Society, the Niagara County Dental Society and the UB School of Dental Medicine joined forces to begin a new mentoring program. The format of the program is to match students with a mentor dentist with similar interests. They meet four times during the year. The students felt that they lacked knowledge regarding private practice, ownership of a business, associate agreements, financial situations and transitions. They indicated that they wanted to learn from someone who has been through it. They felt that they lacked real world experience. These are some of the topics which the students and mentors have explored. 1. What type of dentist do you want to be? 2. How do integrity and ethics fit into a modern dental practice? 3. How did you prepare to enter into private practice? 4. When did you know you wanted to own or be a partner in private practice? 5. What did you do when you had trouble with a procedure and needed help? 6. Where did you learn the financial skills to run a practice? 7. Who does the bookkeeping? What about credit card fees/processing? 8. How did you find your accountant and how often do you contact him/her? 9. When do you take out a loan? How do you apply for a loan? 10. Business Insurances – Liability/Business Overhead/Malpractice/Disability/Health/Life (term or life) 11. How much debt do you take on as a percentage of the worth of the practice? 12. What about billing/collections and past due accounts? 13. How did you set your fee schedule and how often do you adjust it? 14. Discussion on student debt. 15. What is the process for hiring an employee? 16. How do you evaluate an employee? In this inaugural year, approximately 60 students and 60 mentors participated. Requests will be going out soon asking for mentors for 2013. Please consider volunteering for this rewarding program.

On August 23, the Buffalo Chapter of igniteDDS joined forces with Patterson Dental Company and Ivoclar Vivadent to provide the University at Buffalo dental students with an evening of CEREC training. Dr. David Rice presented the latest tips, tricks and protocols relating to chairside CAD/CAM dentistry. The event was held in Amherst at Ivoclar Vivadent’s North American headquarters and training center.
The Eighth District Dental Society received a grant from the Health Foundation for Western and Central New York to support strategies directed at improving the oral health of seniors in the community. A portion of this grant was given to the UB CARES Program to provide financial assistance to elderly patients receiving oral health treatment at the UB Dental Clinic. Fall, 2012

Dr. John Nasca will be installed as President of the Eighth District Dental Society at the Buffalo Club on Saturday, January 26, 2013. The event begins with cocktails and hors d’oeuvres at 6:00 pm, the program at 7:00 pm, with dinner and dancing to follow. Dr. Ronald Jarvis will be the recipient of the prestigious Harvey Sprowl Leadership Award. It is given to recognize the long term contributions of members of the Eighth District Dental Society to organized dentistry. Life membership is bestowed on members attaining the age of 65 and who have been members in good standing for 30 consecutive years. These are the members who will receive the honor this year: John P. Peter: We are a family business that is an independent repair facility and not a franchise. It was started by my father­in­law, who received technical training from the military years before and opened his own successful location in 1984. I began working for the company in 1990. Eighth District: How long have you been in this business? Dental Dynamics Inc. Peter: Dental Dynamics has been serving the dental industry since 1994. We are located in the Owners Buffalo area, but over the years have grown to have clients nationwide. Eighth District: Do you repair the dental equipment yourself? Peter: ABSOLUTELY. We repair 99% of the equipment we receive in­house. Only if a part is unavailable or a repair is something we are not able to provide will we send it out to the manufacturer or authorized distributor. We have a vast inventory of parts so we can repair most brands and return them to our clients in a short period of time. We repair KaVo, Star, Midwest, NSK, Brasseler, Lares, Bien Air, Kinetic, W&H, Patterson, Innovators, Champion and many other models old or obsolete. Eighth District: What sets you apart from other dental handpiece repair companies? Peter: Our years of experience and contacts in the dental industry allow us to be very selective with our parts suppliers. Choosing to purchase only the best parts from different manufacturers lets us provide to our clients quality repairs at affordable prices. Dental Dynamics also repairs more than just highspeed handpieces. We repair highspeeds, slowspeeds, attachments, nosecones, heads, electric contra angles, electric lab equipment, surgical handpieces, endo contra angles, air driven lab handpieces, belt driven units, and more. Eighth District: Do you provide other services besides repairs? Peter: YES. We provide in­office services for specific repairs such as dental units, tubing replacements, fiber optic systems, vacuum systems, syringes, etc. Our clients often call us first because pricing for our repair service is much lower than other companies. We sell new equipment, parts, bulbs, maintenance products, and for all repairs we include FREE shipping both ways ­ locally and nationwide. Eighth District: What is your service policy? Peter: At Dental Dynamics we strive to satisfy our clients 100%. It is important to us that we meet their demands and accommodate their individual needs. OBITUARIES Dr. Joseph E. Margarone Jr. passed away on July 24, 2012. Dr. Margarone Jr. was the beloved husband of Teresa (Schwab); loving father of Joseph E. Margarone III, DDS (Mary Anne), Teresa A. (David) Maida, Sandra P. (Lalit) Goel, and John R. (Laura); dear grandpa of Vickram, Joseph IV, Suneil, Lauren, Juliana, Sophia and John R., Jr (expectant). Dr. Margarone Jr. was a Retired Life Member of the 8 th District Dental Society, NYSDA, and ADA. Dr. Christy M. Feneck, age 92, passed away on Friday, July 27, 2012 in LaPlace, Louisiana where he resided with his son and daughter­in­law. He was born in Lackawanna, N.Y and was a retired Dentist for 27 years having practiced in New York, California and Florida. Dr. Feneck was a member of the Eighth District Dental Society. Dr. Burton H. Singer passed away on August 13, 2012. He was the devoted husband of Seena (Sultanik); father of Laura (Jim) Williamson of Trumbull, CT and Ellen (Jim) Smith of Washington, D.C.; brother of the late Gerald and Eugene Singer; brother­in­law of Celene Singer; grandfather of Nicole Williamson, Julie and Karen Smith. Dr. Singer was a Life Member of Eighth District Dental Society. Dr. Edmund A. Cohen passed away on August 21, 2012 at the age of 88. He is survived by his beloved wife, Betty. Dr. Cohen practiced dentistry for 36 years in Buffalo, NY and Snyder, NY. He was a Life Member of Eighth District Dental Society.

The Erie County Dental Society will be hosting their first All Day Seminar on Friday, November 9, 2012 at Salvatore’s Italian Gardens in Depew, NY. Dr. Michael DiTolla will present “The Modern Restorative Practice”. After completing this program, the dental professional should be able to:

Recognize the shift from PFM’s to monolithic materials that allow the clinician to use high strength materials while satisfying patient’s esthetic desires
·
Understand when the use of a rapid anesthesia technique and how anesthetizing mandibular molars without a block is beneficial for clinicians and patients
·
Understand digital impressions and their use in digital restorative dentistry and se a demonstration of each of the currently available systems
·
Be familiar with full contour zirconia and the pros and cons of using this structural ceramic material as a crown and bridge material
·
Be familiar with the new class of cementable all­ceramic restorations such as lithium disilicate, and understand how the CAD/CAM milling process an improve consistency and quality Dr. DiTolla graduated from the University of the Pacific School of Dentistry with honors in 1988. He was awarded fellowship in the Academy of General Dentistry in 1995. Dr. DiTolla is a graduate of the LVI, and is also a clinical evaluator for CRA. In 2001, he became Director of Clinical Research and Education at Glidwell Labs, giving him an intimate knowledge of American dentists and their crown and bridge habits. Dr. DiTolla launched Chairside Magazine in 2006 and is the clinical editor of this quarterly publication that frequently presents his own clinical case studies, and writes a monthly column on restorative dentistry for Dental Economics. The day will begin at 8am with registration and a continental breakfast. Dr. DiTolla will speak from 8:30am ­ 4pm, with a break at 12 NOON for lunch and Business Meeting. The cost is $185 for Erie County Dental Society, $225 for non­ members, and $85 for staff members. Attendees will receive 7 MCE credits for this course. Fall, 2012

Dr. Peter Rouff will be installed as President of the Erie County Dental Society at the Greatbatch Pavillion at the Martin House Complex on Saturday, January 5, 2013. The event begins with cocktails and hors d’oeuvres at 6:30 pm, the program at 7:30 pm, with dinner and dancing to follow. Dr. Marshall Fagin will be the recipient of the prestigious Frank Stone Award. The Frank Stone Award is given to an individual who in the considered judgment of its Erie County Dental Society members, 1) has made outstanding contributions to the dental profession in Erie County through teaching, patient service, dental research, organized dentistry or community service; 2) must be a role model for the dental profession who inspires his/her colleagues and mentors younger dentists to become all that they are capable of being; 3) demonstrates a high level of involvement in the dental profession and organized dentistry as well as the community in which he/she contributes their profession; 4) is an effective communicator for the profession and represents the highest personal standards of integrity, compassion and moral character.
