Performance Management and Hiring
Human capital can be the largest investment a company makes. Your staff may be your most valued and
necessary asset, but they also pose the highest potential for financial risk. The process for recruiting, managing,

ensuring employees and managers are adequately familiar with lawful practices.

untrained supervisor can create serious liability for
the organization. This 45-minute FMLA course—

changes—explains supervisors’ responsibilities
through the entire process. Its interactive scenarios
explain complex compliance issues, including
members of the Armed Services and their caretakers.
This course focuses on teaching supervisors how to
provide and deliver a lawful employee performance
evaluation. Performance evaluation training is
presented in this course as a process and not just

Harassment & Discrimination Prevention
Harassment, sexual harassment prevention, Americans with Disabilities Act, and discrimination training
are the cornerstones of any compliance training program. Berkshire offers a full suite of harassment
training and discrimination training that not only helps reduce the occurrence of harassment and
discrimination in the workplace, but can also reduce your organization’s liability in the event of an EEO
claim or employment-based lawsuit.

TOPICS
Americans with Disabilities Act /
ADA Amendments ACT
Sexual Harassment Prevention for
California Supervisors
The ADA Amendments Act modified the ADA
in 2009, expanding the group of people who
will be covered and putting more emphasis on
employers’ behavior when cases go to court. This
Americans with Disabilities Act training course
prepares supervisors to navigate the legal dangers
that arise when disability issues are mishandled
in the workplace.
California is one of the three states that set a
standard for the rest of the country when it comes
to sexual harassment prevention. California State
Law AB 1825 requires California organizations
with more than 50 employees provide two hours
of sexual harassment training once every two
years. Our two-hour sexual harassment course
for California Supervisors provides employers
with an affirmative defense against a lawsuit.
Training on how to report harassment is included
in the course, providing your organization with
a defense in the unfortunate event of a claim.
Our online sexual harassment course satisfies AB
1825’s two-hour training requirements.
Who Should Attend: supervisors, managers,
directors, and all employees responsible for
hiring, terminations, or promotions
Duration: 60 minutes
Unlawful Harassment Prevention
ALL STATES
Although some workplace behavior is easy to
identify as inappropriate, many actions that
appear innocent on the surface can be viewed
as sexual harassment. Unlawful Harassment
Prevention helps learners identify questionable
behavior and know what actions to take if
necessary. This course discusses protected
categories, as well as emerging subjects, including
the rise of electronic harassment through texts,
emails, and other posts online.

Workplace Ethics
Our interactive, engaging online ethics training is designed to help employees understand their critical
role in maintaining company principles. Real-world scenarios challenge the learner to examine common
behaviors and practices, and forecast unfortunate consequences. They ask employees to go beyond
compliance—to look at the larger issues, while still keeping an eye on the bottom line.
eLearning Training
TOPICS
Ethics in the Workplace
The challenge for corporations is to translate
their mission statement into an everyday model
employees can use from the boardroom to the front
line. That’s where this course can help. Our training
classes bridge the gap between mission statement
and corporate practice.
Who should attend: all employees
Duration: 45 minutes
Code of Conduct

and establishes expectations for employee behavior
in the workplace. Employee adherence to the Code
of Conduct is essential to maintaining and furthering
a reputation of integrity and high business ethics.
This interactive course enhances employees’ ethical
problem-solving skills and ensures they read and
agree to adhere to your organization’s Code of
Conduct. You can also track policy acceptance and

Wage and Hour
Wage and Hour law contains some of the most complex regulations HR has to handle. Every state has
a variety of specific wage and hour policies concerning the labor act law, prevailing wage, and others—
varying even by type, industry, and/or sector of employer. Our Wage and Hour training helps employees
and supervisors understand their responsibilities under federal wage and hour laws by focusing on the
top seven high-litigation-risk areas.
eLearning Training
TOPICS
U.S. Wage and Hour for Supervisors
Federal law sets out specific Wage and Hour
requirements, but when supervisors miscalculate
time worked or misclassify compensatory time
and overtime, organizations can face steep legal
consequences. This course is a supplemental
module to our All Employees course, and educates
supervisors on essential managerial issues—
including their role in recordkeeping, addressing
errors, and taking complaints under the Fair Labor
Standards Act.
Who should attend: supervisors, managers,
directors, or executive management
Duration: 60 minutes
U.S. Wage and Hour for California
Supervisors
The fastest expanding risk in employment law are
wage and hour class actions, already more numerous
than all discrimination class actions combined,
with state settlements of $25 million outpacing
federal class action awards. However, California
organizations can reduce their risk by ensuring
employees understand their responsibilities under
the law. This California Supplement training pairs
with the All Employees module in covering essential
Wage and Hour laws, including the FLSA. A
Supervisors Supplement module is also available for
completely flexible training on these crucial issues.

directors, or executive management
