PUBLIC DRINKING WATER RULE REQUIREMENT The Texas Commission on Environmental Quality (TCEQ), under Title 3o Part i of the Texas
Administrative Code 290.271-290.275, requires that ALL community water systems deliver the
2009 Consumer Confidence Report (CCR) to their customers by Julyi, 2010. We sent you a
packet last spring with your personalized CCR Template and a blank Certification of Delivery
form. A copy of this 2009 CCR and the completed 2009 Certification of Delivery form were due
to the TCEQ by July 1, 2010.
PROBLEM
As of the date of this letter, we have not received a copy of both your 2009 CCR and your signed
2oog Certification of Delivery form. If you already sent these to us, we apologize, but please
send them to us immediately. If you have not sent these to us, please complete any unfinished
items below. If you need either of these documents go to TCEQ's website to download your
community water system's 2009 CCR and 2009 Certification of Delivery form at:

Our records indicate that your public water system (PWS) failed to post public notice or
failed to report public notice documentation to TCEQ for the MONITORING (TCR),
ROUTINE MAJOR violation that occurred during the month of January, 2012.
As described in 3o TAC §290.122, failure to notify your customers of a MONITORING
(TCR), ROUTINE MAJOR violation results in a reporting violation. Additionally, 3o
TAC §290.122(f) states that a copy of any public must be submitted to the TCEQ within
ten days of its distribution as proof of public notification. Each proof of public
notification must be accompanied with a signed Certificate of Delivery.

The Texas Commission on Environmental Quality (TCEQ) has determined that WOLFE AIR PARK has
a monitoring and reporting violation for failing to monitor the disinfectant residual within the
distribution system or failing to submit a Disinfectant Level Quarterly Operating Report (DLQOR) to
the TCEQ for the following compliance period, second quarter of 2014, as described in Title 30, Texas
Administrative Code (3o TAC), §290.110. The attached Violation Report summarizes each violation by
monitoring period and rule.
PUBLIC NOTIFICATION REQUIRED BY: January 21, 2o15
The public notification requirements are described in 3o TAC §29o.122 and include:
Within 9o days of notification of violation, at a minimum, you must provide notice by mail/direct
delivery to bill-paying customers to which water is delivered. The public notice must use the enclosed
mandatory language for every notice, and include a brief statement about what you plan to do to fix the
problem as described in 3o TAC §290.122(d). This statement must describe what actions the water
system is taking to correct the violation, and when the water system expects to return to compliance.
You are required to repeat the notice every twelve months for as long as the violation persists. You
should use the same method that you used for the initial notice. Please send a copy of the public
notification and a signed Certificate of Delivery for Public Notice to this office within 1o days after it

Attention: Public Water System Owner / Official / Manager
The Texas Commission on Environmental Quality (TCEQ) requires Community and
Non Transient Non Community public water systems (PWS) to monitor for initial lead
and copper samples in accordance with Title 3o Texas Administrative Code (3o TAC),
Chapter 290, Section 290.117(c)(2). In addition, the PWS is required to report any
sample results in accordance with 3o TAC §290.117(i). Based on our most recent
records, the PWS has a Monitoring & Reporting violation(s) for the following periods:

The PWS is required to issue public notification to customers for Monitoring &
Reporting violations as soon as the violation has been identified in accordance with 30
TAC §290.122(c). Enclosed is the mandatory language required for the public notice of
the violations.
The PWS is required to submit to the TCEQ a copy of the public notice that was issued
within ten days of its distribution, along with a completed Certification of Delivery for
Public Notice form (enclosed) as proof of public notification. Failure to properly notify
the TCEQ and your customers will result in an additional violation for your PWS.
Drinking water violations can result in an enforcement action against your PWS.

BACKGROUND
A NOV file record review (investigation no. 1078766) was also conducted on April ii, 2013 to
evaluate the status of the outstanding alleged violations associated with compliance investigation
no. 1021461. A compliance documentation deficiency letter dated April 18, 2013 requested that a
written description of the correction action taken be submitted by May 20, 2013.
ADDITIONAL INFORMATION
The documentation submitted in a letter dated May 16, 2013 appears to resolve one of the
outstanding alleged violations. However, violation track no, 373675 remains unresolved. A

A file record review was conducted on April 17, 2013 to evaluate the compliance status of
this alleged violation. The documentation submitted indicates the MUD voted to approve
line upgrades. and the. installation of flush valves. In addition, the records submitted
indicated the water system had been flushing the "accessible" dead-ends. Please submit
documentation demonstrating the required flush valves have been installed and all
dead-end mains have been flushed at monthly intervals.

A file record review was conducted on March 10, 2014 to evaluate the compliance status
of this alleged violation. The compliance documentation submitted did not adequately
address this alleged violation. The information submitted indicated the water system
planned to complete or had completed improvements to the distribution system including
upgrading line sizes, looping lines (to eliminate dead-ends), and installing fire hydrants
and flush valves. The information submitted did not clearly indicate flush valves had
been installed on all dead-end mains. This alleged violation will be evaluated during any
subsequent investigation.
Recommended Corrective Action: Provide all dead-end mains with acceptable flush valves and
discharge piping.

exceed the combined maximum daily commitment specified in various contractual
obligations.
An investigation conducted on June 21, 2012 documented Port O'Connor MUD did not
have enough production capacity to meet their contractual obligations with La Salle
WCID No. i. Specifically, to meet the contractual obligation, Port O'Connor MUD would
have to provide a total production capacity of 716 gallons per minute (gpm). The
maximum amount of water delivered to Port O'Connor MUD by GBRA shall not exceed
112o acre-feet in any calendar year (which equates to roughly 694 gpm).
The minimum water system capacity requirement was determined by calculating the
requirement (o.43gpm/connection) based upon the number of retail service connection
(1596) and adding that amount to the maximum amount of water obligated or pledged
under all wholesale contracts (30 gpm).

Afile record review was conducted on April 11, 2013 to evaluate the compliance status of
this alleged violation. The documentation submitted indicated that La Salle WCID No.1
was working on securing an additional source of water (drilling a well) to supplement
Port O'Connor MUD's water supply. The well was expected to be completed and placed
into operation by the end of November 2012 and at that time the contract would be
amended. As per a letter dated January 17, 2013 (Plan Review Log No. P-11132o12-o71),
the subject well was not approved for interim use and not allowed to be placed into
service. Additional information was requested to proceed with the review. Please submit
documentation demonstrating the water system provides enough production capacity to
meet their contractual obligations.

A file record review was conducted on March 10, 2014 to evaluate the compliance status
of this alleged violation. The compliance documentation submitted appears to indicate
adequate corrective action has been taken for this alleged violation.
Recommended Corrective Action: Provide enough production, treatment, and service pumping
capacity to meet or exceed the combined maximum daily commitment specified in various
contractual obligations.
Please submit to this office by the compliance due date documentation demonstrating compliance has
been achieved for this alleged violation.
Resolution: The production capacity provided by Port O'Connor MUD was increased from 694 gpm
to Yioo gpm. The contract between Port O'Connor MUD and GBRA was amended on December 13,
2012. In the contract GBRA agrees to sell and deliver treated potable water in a quantity of not less
than 220,000 gallons per day and not more than 1,044,000 gallons per day (725 gpm) not to exceed
1,17o acre-feet (725 gpm) in any calendar year. In addition, the constructed well (well no. 2) was
approved for interim use in a letter dated June 20, 2013 (Plan Review Log No. P-o6202013-134)• The
well (rated for 325 gpm) was placed into service in July of 2013. Based on the contractual obligations
evaluated during the last CCI (i.e., contract with La Salle WCID No, 1) and the number of retail service

This is in response to the Notice of Violation dated April 18, 2013
On Track 373675 Failed to provide all dead end mains with acceptable flush valves and
discharge piping. Please find enclosed our dead end line flushing reports. As noted in
your comment, we have allocated $150,000.00 every year to address this issue. This year
we will be looping Easy Street and Carry Street together to delete two dead end lines.
We will also be upgrading the 2 inch line with a 6 inch line down both Carrie Street and
Easy Street and installation of 3 fire hydrants. We have had several projects that have
eliminated dead end lines since 2009. In 2010, we upgraded a 2 inch line on Monroe
from 6h Street to Washington to an 8 inch line, installing a fire hydrant and tied into a 2
inch line on 2"d Street thus eliminating 3 dead end lines. Another project in 2010
upgraded a 2 inch line down Bay Street to a 6 inch, installing a fire hydrant and flush
valve at the end of the line. In 2011, we did two upgrade projects. First one was on 15th
Street upgrading a 2 inch line to a 6 inch, installing a fire hydrant and a flush valve on the
end. The second was on 12a' Street doing the same thing. Originally these two streets did
not have flush valves on them.
On Track 473839 Failed to provide enough production, treatment, and service pumping
capacity to meet or exceed the combined maximum daily commitment specified in
various contractual obligations. Enclosed please find the new contract with GBRA. which
shows our contracted allocation is 1.044 MGD which equals 725 gpm. WE are still
anticipating an additional 125 gpm for the District and the same for the LaSalle
WCID#1A contractual agreement when the new well is approved. We also have provided
additional information from the District's engineer.

FIRST AMUNDIVIENT TO TREATED WATER SUPPLY CONTRACT
BETWEEN
GUADALUPE-BLANCO RIVER AUTHORITY
AND PORT O'CONNOR MUNICIPAL UTILITY DISTRICT
This A reement (hereinafter called the "First Amendment"), entered into as of the ^^
2012, between the GUADALUPE-BLANCO RIVER AUTHORITY, a
day of ^^
conservation district and political subdivision of the State of Texas (hereinafter called "GBRA."),
and Port O'Connor Municipal Utility District in Calhoun County, Texas, (hereinafter called
"Purchaser" or "District"), shall constitute an amendment to that certain contract between the
parties, dated as of July 19, 2000, entitled "Treated Water Supply Contract Between GuadalupeBlanco River Authority and Port O'Connor Municipal Utility District" (such contract hereinafter
called, "the Water Supply Contract");
WITNESSETH
Recitals
WHEREAS, the Texas Commission on Environmental Quality (TCEQ) representatives
conducted a comprehensive compliance investigation of the Purchaser's water system; and
WHEREAS, based upon such investigation, TCEQ determined that the maximum daily
average purchase quantity of 1.0 million gallons per day (mgd) of treated water is not sufficient
to meet the Purchaser's alternative capacity requirement (ACR) of 0.43 gallons per minute (gpm)
per customer connection; and
WHEREAS, in order to meet Purchaser's ACR, and in consideration of pipeline capacity
limitations, the Parties have agreed that the Water Supply Contract be amended to increase
Purchaser's maximum daily average purchase quantity from 1.0 mgd to 1.044 mgd and to
increase Purchaser's maximum annual quantity from 1,120 acre-feet per year to 1,170 acre-feet
per year; and
WHEREAS, the Parties recognize that the water demands of Purchaser have increased
significantly since 2000 thereby requiring an increase in the average minimum daily amount of
treated water Purchaser agrees to pay for whether taken or not from 120,000 gpd to 2220,000 gpd;
and

NOW, THEREFORE, for and in consideration of the mutual promises, obligations, and
benefits hereinafter set forth, GBRA and Purchaser agree to amend, modify and change certain
sections of the Water Supply Contract as follows:
The first paragraph of SECTION 2 shall be amended in its entirety to read as follows:
