Spectrum® College Savings Giveaway Official Rules
NO PURCHASE OR PAYMENT NECESSARY TO ENTER OR TO WIN. A PURCHASE
WILL NOT INCREASE YOUR CHANCES OF WINNING. VOID WHERE PROHIBITED BY
LAW.
1. SPONSOR: The sponsor of the Sweepstakes is Carson-Dellosa Publishing, LLC. ("Sponsor"),
7027 Albert Pick Road, Greensboro, NC 27409.
2. SWEEPSTAKES PERIOD: The Sweepstakes begins on or about 12:00:01 AM EST on May
11, 2015, and ends at 11:59:59 PM EST on June 12, 2015 ("End Date").
3. ELIGIBILITY: The Sweepstakes is open only to those persons who reside in the District of
Columbia ("D.C.") or any state of the United States except for Rhode Island, and who have
reached the age of majority under the laws of their state of residence (“Eligible Participants”).
The age of majority is 18 years or older, depending on the state. Sweepstakes is void in Rhode
Island and outside the United States, and also where prohibited by law. Employees, officers,
directors and agents of Sponsor (and members of their immediate families) are not eligible to
participate. By participating, entrants agree to be bound by these Official Rules and the decisions
of Sponsor and judges, which are final and binding in all matters relating to this Sweepstakes.
Only one entry per person.
4. PRIZES: There will be one (1) Grand Prize and two (2) Second Place Prizes awarded.
GRAND PRIZE: Sponsor will make a contribution in the amount of $2,000.00 to the single,
valid, open Section 529 college savings plan account of the Winner’s choice. SECOND PLACE
PRIZES: As each of two Second Place Prizes, Sponsor will make a contribution in the amount
of $1,000.00 to the single, valid, open Section 529 college savings plan account of the Winner’s
choice. Total Approximate Retail Value of all Prizes is $4,000. Sponsor reserves the right to
substitute prizes of equal or greater value in its sole discretion. Prizes cannot be redeemed for
cash and may not be substituted or transferred by any winner except as may be stated in these
rules. TO THE EXTENT APPLICABLE, EACH WINNER IS RESPONSIBLE FOR
REPORTING AND PAYING ANY AND ALL INCOME, SALES OR EXCISE TAXES THAT
MAY APPLY TO ACCEPTING A PRIZE; SPONSOR IS NOT RESPONSIBLE FOR AND
WILL NOT PAY ANY SUCH TAXES. SPONSOR IS NOT RESPONSIBLE FOR
ESTABLISHING, MAINTAINING OR ADMINISTERING ANY 529 COLLEGE SAVINGS
PLAN ACCOUNT. ALL COSTS AND EXPENSES THAN THE PRIZE ITSELF ARE THE
SOLE RESPONSIBILITY OF THE WINNER.
5. ODDS: The odds of winning depend upon the number of eligible entries received.
6. HOW TO ENTER: There are two (2) ways to enter the Sweepstakes:
(a)
ONLINE METHOD: Eligible Participants need to properly enter and submit all required
information in the appropriate fields on the webpage at www.carsondellosa.com/college, and
click “Enter Sweepstakes” at the bottom of the completed entry form. All online entries must be
received by the End Date.
(b)
MAIL-IN METHOD: Print your first name, last name, age, complete mailing address
(including zip code), phone number and email address (if you have one) on a 4” x 6” post card
and mail it with sufficient first class postage addressed to: Spectrum College Savings Giveaway,
Carson-Dellosa Publishing Group, 7027 Albert Pick Road, Greensboro, NC 27409. Mail-in
entries must be legible and submitted in original hand-printed form. Each entry must be mailed
separately and have sufficient postage. Entries mechanically reproduced or made in any fashion
other than by properly submitting an online entry form or by submitting a post card as described
herein are void. All entries by mail must be postmarked by the End Date and must be received by
Sponsor by June 12, 2015.
7. Sponsor is not responsible for lost, late, misdirected, postage due, damaged, mutilated,
illegible or incomplete entries. All entries, entry information and related materials become the
property of the Sponsor and will not be acknowledged or returned. False or deceptive entries or
acts will render the entrant ineligible. Sponsor is not responsible for telecommunications,
network, electronic, technical or computer failures of any kind, including any failures which may
affect an entry, attempted entry, or the Sweepstakes. Entries not in compliance with these
Official Rules are disqualified. Sponsor shall have the absolute right to determine if an entry is in
compliance with these Official Rules without notice to the person attempting to enter. If, for any
reason, the Sweepstakes is not capable of running as originally planned by reason of infection by
computer virus, worms, bugs, tampering, hacking, unauthorized intervention, fraud, technical
failures or any other causes which, in the sole opinion of the Sponsor, corrupt or affect the
administration, security, fairness, integrity or proper conduct of this Sweepstakes, Sponsor
reserves the right, at their sole discretion, to cancel, terminate, modify or suspend Sweepstakes,
and determine winners from eligible entries received prior to the action taken, or as otherwise
deemed fair and equitable by Sponsor. Notice of any such action will be posted on the
sweepstakes webpage, www.carsondellosa.com/spectrum. Sponsor reserves the right to suspend
or cancel the Sweepstakes or modify these Official Rules as necessary for any reason or as
required by applicable law. The failure of Sponsor to enforce any provision of these Official
Rules shall not constitute the waiver of such provision. Entries are void if defective, altered,
forged or submitted via unauthorized channels, and Sponsor reserves the right to disqualify any
individual using such methods. Persons found tampering with or abusing any aspect of this
Sweepstakes, or whom Sponsor believes, in its sole discretion, to be impairing the
administration, security, fairness, integrity or proper operation or play of the Sweepstakes may
be disqualified from the Sweepstakes, may be banned from any future promotions, and may be
subject to legal action by Sponsor or its agents. In the case of dispute regarding Internet entries,
the authorized subscriber of the email account used to enter the Sweepstakes at actual time of
entry will be deemed to be the entrant and must comply with these Official Rules. Authorized
account subscriber is deemed to be natural person who is assigned an email address by an
Internet Access Provider, online service provider, or other organization that is responsible for
assigning email addresses.
8. WINNER SELECTION: The (3) three winners will be determined by a random selection
conducted by Sponsor from among all eligible entries on or about June 15, 2014 in Greensboro,
North Carolina. All results of the selection are final and binding, subject to these Official Rules.
In the event a winning entry is discovered to be invalid for any reason whatsoever or the person
who submitted the winning entry fails to comply with these Official Rules, the prize may be
forfeited and awarded to an alternate winner. If by reason of a printing, computer or other error,
more prizes are claimed than the number set forth in these Official Rules, all persons making
purportedly valid claims will be included in a computerized random selection to award the
advertised number of prizes available. No more than the advertised number of prizes will be
awarded.
9. NOTICE TO WINNER: Within ten (10) days of the random selection, Sponsor will attempt to
notify potential prize winners by email, using the email address provided by entrant on the entry
form. Sponsor is not responsible for lost, stolen, late or misdirected email, mail or delivery or
communication problems of any kind. If unable to make contact with a winner within fifteen (15)
days after Sponsor first attempts to notify the winner, or if the winner fails to claim the prize
within fifteen (15) days after Sponsor first attempts to notify the winner, the Prize may at the
discretion of Sponsor be forfeited or awarded to an alternate winner selected via a random
drawing from all remaining eligible entries received.
10. VERIFICATION OF WINNER: Potential winners will be required to sign, notarize and
return to Sponsor an Affidavit of Eligibility and a Prize and/or Publicity Release. There is
typically a fee of $10.00-$20.00 for the services of a Notary Public, this fee is sole responsibility
of Sweepstakes entrant. Notaries Public can be found at most bank locations, as well as other
locations. The selected winner must be able to provide documentation of age and residence. By
accepting the prize, a winner consents to the use of his/her name, likeness, biographical
information and statements by Sponsor and its designees in advertising, trade and promotional
materials and on their respective web sites without notice or compensation to winner, except
where prohibited by law.
11. By entering the Sweepstakes, each participant warrants that he or she has read and agrees to
abide by these Official Rules and that he or she is not prohibited from participating in the
Sweepstakes. Each participant agrees to release, discharge, indemnify and hold harmless
Sponsor, Prize Providers (i.e., Carson-Dellosa Publishing) and its and their parents, subsidiaries,
affiliates, shareholders, employees, officers, directors, agents, representatives, advertising and
promotion agencies and prize suppliers from any liability arising from or related to the
Sweepstakes or redemption, use, or misuse of any prize, including without limitation, personal
injury, death, property damage, or claims based on publicity rights, defamation, or invasion of
privacy.
12. By entering the Sweepstakes, participants consent to the use of their name, likeness, image,
biographical data, and location for advertising and promotional purposes without additional
compensation, except where prohibited by law.
13. DISCLAIMER/LIABILITY RELEASE: By participating in the Sweepstakes, each entrant
and prize winner assumes all liability for any injury or damages caused or claimed to be caused
by the Sweepstakes, their participation in the Sweepstakes and/or the acceptance, possession, use
or misuse of any prize, negligence, claims, actions, personal and bodily injury, death or
disability, property damage or loss of damage of any kind and releases and holds harmless
Sponsor and its respective parents, subsidiaries, affiliates and the officers, directors, employees,
shareholders and agents (collectively, "Releasees") from and against any and all damages.
Further, Releasees are not responsible for any: (a) telephone, computer or network malfunction,
human or other error or failure to properly process entries; (b) communication disruption or other
forces beyond their control, including inability to access any web site, submit entries or other
disruption related to internet traffic, virus, bug or unauthorized intervention; (c) damage caused
by computer virus or otherwise resulting to any computer (or information stored thereon) from
entrant’s access to the Sweepstakes Web Site or entry into the Sweepstakes; (d) printing or other
errors appearing in the rules or other Sweepstakes materials; (e) misdirected or non-delivered
entries/e-mails; (f) incorrect or inaccurate information, whether caused by Web Site users, or by
any equipment or programming associated with or utilized in this Sweepstakes; or (g) any error,
omission, interruption, deletion, defect or delay in operation or transmission, communications
line failure, theft or destruction or unauthorized access to, or tampering with or hacking of Web
Site.
IN NO EVENT WILL RELEASEES BE RESPONSIBLE OR LIABLE FOR ANY DAMAGES
OR LOSSES OF ANY KIND, INCLUDING DIRECT, INDIRECT, INCIDENTAL,
CONSEQUENTIAL OR PUNITIVE DAMAGES ARISING OUT OF PARTICIPANTS’
ACCESS TO AND USE OF THE WEB SITE OR DOWNLOADING FROM AND/OR
PRINTING MATERIAL DOWNLOADED FROM SAID SITE. WITHOUT LIMITING THE
FOREGOING, EVERYTHING ON THE WEB SITE IS PROVIDED “AS IS” WITHOUT
WARRANTY OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT
LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A
PARTICULAR PURPOSE OR NON-INFRINGEMENT. SOME JURISDICTIONS MAY NOT
ALLOW LIMITATIONS OR EXCLUSION OF LIABILITY FOR INCIDENTAL OR
CONSEQUENTIAL DAMAGES OR EXCLUSION OF IMPLIED WARRANTIES, SO SOME
OF ABOVE LIMITATIONS OR EXCLUSIONS MAY NOT APPLY TO ALL
PARTICIPANTS. PARTICIPANTS SHOULD CHECK THEIR LOCAL LAWS FOR ANY
RESTRICTIONS OR LIMITATIONS REGARDING THESE LIMITATIONS OR
EXCLUSIONS.
14. GOVERNING LAW/FORUM/DISPUTE RESOLUTION: The construction, validity,
interpretation and enforceability of these Official Rules, and the rights and obligations of entrant
and Sponsor in connection with the Sweepstakes, shall be governed by, and construed in
accordance with the laws of the State of North Carolina, without giving effect to any choice of
law or conflict of laws rules or provisions. Any legal claims arising out of or relating to the
Sweepstakes or these Official Rules must be brought in the federal or state courts located in
Greensboro, North Carolina, and shall NOT be brought as part of a class action. You further
agree to the jurisdiction of such courts and that, in any claim/cause of action, your recovery will
be limited to actual costs of participating in the Sweepstakes (if any) and that all other damages
(including compensatory, consequential, incidental and punitive damages) are expressly waived.
15. To obtain the name of the official winners (after the conclusion of the Sweepstakes) or a
copy of these Official Rules, send a self-addressed envelope with the proper postage affixed to:
College Savings Giveaway, PO Box 35665, Greensboro, NC 27425. Please specify "winners list"
or "Official Rules" in your request. Requests must be received by July 10, 2015.
