Dear Counsel:
I have considered the multiple motions that surround replies that MedStar Montgomery
Medical Center (“MMMC”) and the City of Takoma Park (“Takoma Park”) want to file in reply
to the response made by Adventist HealthCare (“AHC”) to comments made by MMMC and
Takoma Park on AHC’s application for Certificate of Need. I note that AHC added 16 new
exhibits in its response to comments. For this reason, I will grant the motions for leave to file a
reply and deny AHC’s motions to strike. Thus, the replies filed by MMMC and Takoma Park are
part of the official record of this proceeding.
I will grant AHC until May 14, 2015 to file a sur-reply to the replies. AHC cannot add
new exhibits to its filing without my specific permission. COMAR 10.24.01.08F applies to
AHC’s responsive filing, if it chooses to make a responsive filing; however, AHC sur-reply may
