NOW COMES Respondent, DAVID M. LUCAS, the duly elected Sheriff of Belmont
County, Ohio, in answer to Relator's amended complaint in Quo Warranto:
PARTIES AND JURISDICTION
l. Respondent admits Relator's amended complaint is an original action sounding in
quo warranto but expressly denies Relator is entitled to immediate possession. of the Office of
Sheriff of Belmont County, Ohio, in answer to paragraph 1 of the amended complaint.

Respondent admits the allegation contained in paragraph 2 of the amended
complaint.

To the multiple allegations contained in paragraph 3 of the amended complaint,
Respoitdent answers as follows: Respondent admits that his term as Sheriff of Belmont County,
Ohio began on Monday, January 7, 2013, as mandated in R.C. §311.01(A), however, Respondent
was sworn in on Friday, January 4, 2013, by Belmont County Common Pleas Judge, Jolul M.
Solovan, lI. Respondent denies that he did not meet the mandatory qualifications for said office
pursuant to R.C. §311.01(B). Respondent admits the Belmont County Board of Elections
certified him as the duly elected Sheriff of Belmont County, Ohio, as Respondent defeated
Relator in the Noveniber 6, 2012, general election 16,859 to 14,209 (54.26% to 45.74%).
Respondent denies that Relator was the only candidate for Sheriff that met the statutory
qualifications on the ballot, and denies that Relator is the duly elected Sheriff of Belmont
County, Ohio at present. Respondent admits that Relator has commenced this action to remove
Respondent from office but denies that Relator is entitled to the office.

RELEVANT' FACTS
7. Respondent admits the qualifications for the office of sheriff in Ohio are set forth
in R.C. §311.01, in answer to paragraph 7 of the amended complaint.
8. Respondent admits the portion R.C. §311.01(B)(8)(a) is quoted properly, in
answer to paragraph 8 of the amended complaint.
9. Respondent admits the portion R.C. §311.01(B)(9)(a) is quoted properly, in
answer to paragraph 8 of the amended complaint.
10. Respondent denies the allegations contained in paragraph 10 of the amended
complaint relative to his supervisory responsibilities, as established in the `Belmont County
Sheriff's Office Firearms Requalification Program Primary and Off Duty Handguns' records,
which are attached hereto and incorporated as if fiillyre-written herein as Exhibit A. Respondent
admits that he retired from the Belmont County Sheriff 5 Department on October 31, 2007,
holding the rank of Major, and states that he was assigned supervisory responsibilities at all
times relevant up to said date.
11. Respondent admits that lie and his wife purchased vacation property in the State
of Florida via General Warranty Deed executed on or about June 30, 2010, as attached hereto an

a resident of the State of Florida. Respondent fiirther denies that the Belmont County Board of

Elections failed to verify his status as an Ohio resident at all times relevant to this action, in
answer to paragraph 11 of the amezaded coznplaint.
12. Respondent admits that then Belmont County Sheriff, Fred Thompson, attempted
to file a challenge to Respondent's qualifications with the Belmont County Board of Elections on
or about December 23, 2011. Respondent also admits that neither Relator, Gary Landers, nor
any other qualified elector in Belmont County, Ohio attempted to challenge Respondent's
qualifications for almost a full year until Relator and Mr. Gary Landers filed `letters of protest'
in mid-Deceznber 2012. Respondent further denies that the Belmont County Board of Elections
refused to investigate the allegations, as a hearing was held on. or about December 17, 2012, at
which time the protests were rejected, in answer to paragraph 12 of the aznended complaint.
13. Respondent is without knowledge or information sufficient to form a belief as to
the truth of the allegations regarding 1Zelator's communication with the Belmont County Board
of Elections, or its response, in answer to paragraph 13 of the amended complaint.
14. As set forth in his answer to paragraph 3 above, Respondent admits that his term
as Sheriff of Belmont County, Ohio began on Monday, January 7, 2013, as mandated in R.C.
§311.01(A), however, Respondent was sworn in on Friday, January 4, 2013, by Belmont County
Common Pleas Judge, Johii M. Solovan, 11, in answer to paragraph 14 of the amended complaint.
15. Respondent is without knowledge or information sufficient to form a belief as to
the truth of the allegations regarding Relator's communications with the Prosecuting Attorney of
Belmont County, Ohio, or his response, in answer to paragraph 15 of the amended complaint.

17. Respondent is without knowledge or inforznation sufficient to form a belief as to
the truth of the allegations regarding Relator's communications with the Belmont County Board
of Elections, or its response, in answer to paragraph 17 of the amended coinplaint.
18. Respondent admits that he retired as a Major in the Belmont County Sheriffs
Department on October 31, 2007, having begun his service with the Department as a full-time
deputy sheriff on August 12, 1981, and that he was immediately appointed as a Special or
Reserve Deputy Sheriff, effective on October 31, 2007, in answer to paragraph 18 of the
amended complaint.
19. Respondent denies the allegations contained in paragraph 19 of the amended
complaint.
20. Respondent admits Relator has eorrectty copied R.C. §311.01(H)(1) in answer to
paragraph 20 of the amended complaint.

Respondent admits that he did not list his Florida vacation property as his official
residence in his Application for Candidaev as said property was never his domicile or `home
address.' Respondent truthfully listed his domicile(s) /`home address' from 1991 to 2011 on his
Application for Candidacy, which included two (2) home addresses within the City of St.
Clairsville, Belmont County, Ohio. Respondent also admits that he ti-utlifully listed himself as a
reserve deputy sheriff from `2007 to Present' on said Application, in answer to paragraph 31 of
the amended complaint.
32. Respondent admits that he and his wife took vacations to their Florida property
from June 30, 2010, to December 7, 2011, but expressly denies that he ever became a resident of

33. Respondent denies that he ever established a legal residence or domicile in the
State of Florida from October 31, 2007, to December 7, 2011, in. answer to paragraph 33 of the
amended complaint.
34. Respondent denies that he ever established a legal residence or domicile in the
State of Florida from October. 31, 2007, to December 7, 2011, and expressly denies that he did
not pay Ohio State income tax during that period on the strength of his Ohio State tax returns for
tax years 2007-2011, which are attached hereto and incorporated as if fully re-written herein as
Exhibit C (though properly redacted relative to personal information pursuant to S.Ct.Prac.R.
3,12(A)), in answer to paragraph 34 of the amended complaint.
35. Respondent admits that the Honorable Jennifer L. Sargus, then Belmont County
Court of Common Pleas Administrative Judge, approved his qualification for sheriff, in answer
to paragraph 35 of the amended complaint.
36. Respondent denies the allegatiozis contained in paragraph 36 of the amended
complaint, as he provided all documentation requested and/or mandated to the Belmont County
Board of Elections sufficient for them to certify his candidacy.
37. Respondent admits that Respondent has attached two (2) Affidavits and
Respondent's Qualification Document to the amended complaint. However, Respondent
expressly denies that certain paragraphs of Exhibit 1 and 2 represent Relator's personal
knowledge, as paragraph 5 in Exhibit 1 and paragraphs 6, 7 and 8 in Exhibit 2 contain
impermissible hearsay and%or matters outside Relator's personal knowledge, in answer to
paragraph 37 of the amended complaint. Respondent further denies the accuracy of the factual

CLAIM FOR RELIEF
38. Respondent re-states each and every answer provided in paragraphs 1-37 in
answer to paragraph 38 of the amended complaint.
39. Respondent denies that he has usurped, unlawfully holds and/or that Relator is
entitled to the Office of Sheriff of Belmont County, Ohio, as Respondent was properly certified
as a qualified candidate for said office by the Belmont County Board of Elections, and thereafter,
fairly and handily defeated Relator in the November 6, 2012, general election to earn his
entitlement to the emoluments, immunities and privileges appertaining the office Respondent
now lawfully holds, in answer to paragraph 39 of the amended complaint.
40. Respondent denies Relator's entitlement to the Office of Sheriff of Belmont
County, Ohio and denies Relator is competent or qualified to hold said office, in answer to
paragraph 40 of the amended complaint.
41. Respondent denies Relator is entitled to a writ of quo warranto removing
Respondent from office and declaring Relator entitled to possession Respondent's office, in
answer to paragraph 41 of the amended complaiiit.
42. Respondent states that paragraph 41 is identical to paragraph 41, and therefore,
included in error. Nonetheless, Respondent re-states the denial stated in answer to paragraph 41
in answer to paragraph 42 of the ainended complaint.

44. Respondent hereby denies each and every allegation coiitained in the amended
complaint not otherwise expressly answered herein.
FIRST DEFENSE
1. At all times relevant, Respondent met each and every qualification set forth in
R.C. §311.01.
SECOND DEFENSE
2. Respnndent; as the Republican nominee, defeated Relator, the Democrat
nominee, in the November 6, 2012, general election by a total of 16,859 to 14,209 (54.25% to
45.74%), as the Belmont County Board of Elections certified to the Ohio Secretary of State
pursuant to law, thereby entitling the duly elected Respondent to lawfully hold the Office of
Sheriff of Belmont County, Ohio for the term commencing on January 7, 2013, and ending on
January 2, 2017.
THIRD DEFENSE
3. Respondent, as a special or reserve deputy sheriff, was at all times a`deputy
sheriff,' and therefore a law enforcement officer, within the meaning of R.C. §311.04.
FOURTH DEFENSE
4. Respondent can conclusively prove that he was a resident of the State of Ohio
and filed and paid Ohio State izicome tax in all tax years relevant, to-wit: 2007, 2008, 2009,
2010 and 2011. See Exhibit C.

5. Relator has failed to state a claim upon which relief can be granted.

SIXTH DEFENSE
6. Relator's claims are barred by the doctrines of waiver, estoppel and/or latches, as
Relator, having actual knowledge of election-related matters he now challenges had a duty to
promptly act, yet Relator failed to take any legal action whatsoever froin the time of his
nomination on or about March 7, 2012, through to his `letter of protest' filed with the Belmont
County Board of Elections in mid-December 2012, which includes a delay of 244 days from
primary election to the general election; or 275 (or more) days from the primary election until the
letter of protest was filed. Likewise, it took Relator thirty-two (32) days after Respondent took
office on Jaiiuary 7, 2013, to file the instant Original Action in Quo Warranto on February 8,
2013. All this despite the fact that local newspaper accounts of Lucas' candidacy faithfully
reported his retirement in "October 2007" as early as December 4, 2011.

SEVENTH DEFENSE
7. At all times relevant, Relator was a classified employee with the Village of
Bellaire, Ohio, serving as a Lieutenant with the Bellaire Police Department. As such, existing
Federal and State election laws prohibited him from being a candidate for partisan political office
under the Hatch Act, 5 U.S.C. §§ 7321-7326 and/or 5 U.S.C. §1501-1508, as well as R.C.
§ 124.57. As he failed to resign his position with the Village of Bellaire prior to the filing of his
declaration of candidacy, or at any time prior to the general election on November 6, 2012,
Relator failed to fully comply with all applicable election laws, as R.C. §311.01(B)(3) mandates.
Therefore, Relator was not qualified to be a candidate for, or be elected, Sheriff of Belmont

County, Ohio at the general election held on November 6, 2012, and is not entitled to hold the

EIGHTH DEFENSE
8. Respondent reserves the right to raise additional affirmative defenses in this
matter which may become known andior available to Respondent as discovery progesses.

A new full-service hank will open and be in operation in St.
Clairsville within the next two months. Premier Bank & Trust,
located in the Piaza tNn_st strip mall, has under constructioa a
branch bank that is being equipped wifi a duad lane drive-through
facility and an ATM machine.
"t-'ie're really excited about having this new ful,'•. service branch,"
exclaimed Denise Penz, chief operating officer. The new 3,000
square foot facility is being constructed at the northern end of the
str;p mail in the Plaza 1;Nestshopping center that is anchored by
Riesbeck's Food Market.
The new bank is located just a few doors from the present irank;
which has t?een a fixture ir. the mall for two years and wilt continue
uninterrupted operations in the same location. During the two
years it has been in the mall, Penz said the bank has been
involved primarify in "wealth management, doing trusts,
investments, estate piann"ing, stocks and bonds."
But changes 4viii come w3t;''s the branch bank. Penz pointed out all
the services offered by banks, such as checking, savings, loans
and other Onaneial dealings will be available at the branch bank.

Without hesitating, Thompson admitted his greatest experience as
a deputy was being the chief coursty investigator in solving the
serial killing of five outdootsm.e,rti, including one from Belmont
County. Xter an investigation that spanned four years and
involved authorities from five counties as well as state
investigators and the FBI, Stark County residerit Thomas Dillon
was arrested. Dillon received a sentence of life in prison and that's

Dave Lucas of St. Clairsville, who retired with the rank of major

In October 2007, Lucas retired from the sheriff's staf€with the

rank of major. He has since been in:,rolvcd with the fireworks
company.
Also fii!ng his petition for the sheriff's job was Dick Flanagan, a
veteran memberof the Bellaire Police Department.
Another three-way race has developed for treasurer, with former
Befmont Gounty Commissioner Mike Sianconi of Brookside
revealing that he will be a candidate on ttle Democrat ticket that
already includes two earlier Ners - 3Catherine Curfman and Michael
Shaheen.
Bianconi, who has developed a reputation for being outspoken on
various county issues, in particular those involving taxes paid by
county residents, has had 20 years in public service as both a
county cornrnissionerand as a township trustee. "I'm very active
and I like to be involved in county government," f3ianconi asserted.

totally wrpng," Thompson decJared. "The property was sotd at a
sheriff's auction and the money went to United Bank, who owned
the mortgage for the property." iie said the sheriff's department
received a $317 fee for handling the sale,He added, "$167 of that
went for the appraisal and $150 went for taxes. We (sheriff's
department) didn't get a cent,"

At present, I am the duly elected Sheriff of Belmont County, Ohio having
defeated my Democrat challenger, Richard "Dick" Flanagan, 16,859 to 14,209
(54.26% to 45.74%) in the general election held on November 8, 2012

I am the first Republican Sheriff of Belmont County in at least twenty-eight (28)
years.

Prior to my election as Sheriff, I joined the Belmont County Sheriff's Department
as a Deputy Sheriff on August 12, 1981. I was promoted to Sergeant in January
1985, and I was thereafter promoted to Major on August 5, 2007. 1 retired on
October 31, 2007.

In 1994, I was the founding member and first commander of the Special
Operations Branch of the Belmont County Sheriffs Department, which provides
special weapons and tactical support to law enforcement within Belmont County.

8. From November 1, 2007, through to my taking office as Sheriff of Belmont
County, Ohio on January 7, 2013, 1 helped supervise the Belmont County
Sheriff's Office Firearms Requalification Prograrn as a Range Instructor. I served
in this supervisory role prior to my retirement, as well.
9. During that same time period, I was also responsible for, and provided active
training in, Scope Rifle and Sub-Machine Gun recertification/training for the
members of the Special Operations Branch from 2007 - 2011, as I was the only
person within the Belmont County Sheriff's Department that held training
certification from the FBI relative to Scope Rife (Sniper) use and Ohio Peace
Officer Training Acadenly certification relative to Sub-Machine Gun use.
10. As a Range Instructor, I worked full eight (8) hour days on multiple occasions
from November 1, 2007 through July 1, 2012. I have included copies multiple
requalification reports, all of which bear my signature as a Range Instructor, to
my answer to Relator's amended complaint as Respondent's Exhibit A.
11. Though I usually declined compensation, Belmont County, Ohio paid me the sum
of $595.10 for "Instruction-Qualification" in May 2010, via wai-rant number 9720
issued by the Belmont County Auditor on or about June 29, 2010, 1 have attached
a copy of the Warrant Reyuest forin to this Affidvait as a supporting doeument.
12. 1 was also involved in multiple eight (8) hour training days for the Special
Operations Branch, and subject to deployment with the Special Operations
Branch as a sniper/special tactical advisor on a 24 hour / 7 days a week / 365 days

13. During 2007-2011, I was deployed with the Special Operations Branch in Spring
2011 for a possible barricaded gunman on Blaine-Barton. Road in Belmont
County, Ohio for law enforcement activities as a Sniper/Counter Sniper. In
Summer 2012, I was deployed as a Sniper/Counter Sniper with the Special
Operations Branch to provide security for Belmont County Campaign stops of
Vice President Biden and Republican Presidential Candidate Mitt Romney.
14. I fully disclosed my work history on the Candidate Application I completed and
submitted to Belmont County Court of Common Pleas Judge Jennifer Sargus, as
well as the Belmont County Board of Elections.
15. In December 2011, I received notice that then-Sheriff Fred Thompson had filed a
protest with the Belmont County Board of Electiotis challenging whether 1 fully
met the qualification requirements set out in R.C. §311.01(B) to appear on the
ballot.
16. Information about my October 2007 retirement from the Belmont County
Sheriffs Department was widely known throughout Belmont County, and
especially within the law enforcement community, as I unsuccessfully ran for
Sheriff of Belmont County, Ohio in 2008, and my retirement was part of my
candidate profile which was published in the local news media as early as
December 4, 2011. I have attached a copy of that candidate profile to my answer
to Relator's amended coinplaint as Exhibit D.

18. As such, to the best of niy knowledge, I fully satisfied all qualification
requirements for the Office of Sheriff, as set out in R.C. §311.01(B), and I was so
certified by the Belmont County Board of Elections.
19. However, Sheriff Thompson's challenge was widely known and discussed within
Belmont County, Ohio.

Prior to the primary election, on or about February 2, 2012, Richard Flanagan and
I had a conversation about Sheriff Thompson's attempt to challenge my
qualifications when I appeared at a Bellaire City Council meeting. I have
attached a newspaper account of that meeting to this Affidavit as a supporting
document, which clearly states that Mr. Flanagan and I were in attendance
together on that day.

During that conversation, Richard Flanagan, who at the time was running against
then-Sheriff Thompson for the Democrat nomination for sheriff, said he could not
understand why Sheriff Thompson had tried to challenge my qualifications to be
on the ballot given my work history.

From my conversation with him, it was clear to me that Richard Flanagan held a
full and complete understanding of the allegations Sheriff Thompsozi brought
before the Board of Elections in December 2011.

Except for Sheriff Thompson, at no time prior to the general election held on
November 8, 2012, did anyone, including Richard Flanagan, file a for-inal protest
with the Belmont County Board of Elections, or file a legal action in either

BELLAIRE Thursday's council meeting saw several heated debates
regarding business and community ventures in town.

Council Member Patricia Thornas also complained of an unofFicial
Bellaire Facebook site operated by Dan Brown, local business:nan.
She said the site's posts include unfounded accusations of
wrongdoing on the parts of council and village officials. it also
includes names and contact information for council members,
which is public knowledge:
She added that she had brought up questions about the possible
benefits of a Beliaire Facebook site at a prior meeting,
Brown immediately created the site. Council members expressed
concern that ttie people could believe the site was the town's
official Tnternet presence.

Council Member Lou Ann Bennett spoke as a private citizen before
council, saying that the Facebook issue vvas out of hand.
"It is an emtiar-rassment,"she said, adding that the site makes a
poor impression for out-of-town Internet users. She said the site
contains inaccurate information and aflegatiorts and gives the
impression of being village-run. She said she was also critical of
Brown's ego and impulsive behavior and said Brown has been a
disruptive and counterproductive influence on civic organizations
and activities.

Council authorized Law Director Edward Sustersic to ask Brown to
remove "Bellaire, Ohio" from his site and autliorized Sustersic to
incur costs to remove the name.

In other matters, Jim johnston ofEiectronirs Recycling Services
reported progress in transitioning an old school building into an
electronics disassembly and recycling station with nationwide
potential. He said the business could brina_ more than 30;obs to
the area and a corresponding increase in other local businesses.
He added that their employees have assisted in various village
projects such ashelping the sc!iooi place a sign at Nelson Field,
helping to purchase a washing machine for the elementary school,
mulching the park, and aiding in holidays, community cleanups and
festivities.

"We want to be more involved in the communit5;." Johnston said,
adding that they are working with mayor and council to stay within
regulations. "The whole purpose of us being here is for the
betterment of the town."
He said anyone with questions or who has heard negative rumors
are welcorne to stop at the site and talk to him.
He added that he and Brown are both employed by ERC.

private citizen, said it was upsetting that the recycling center was
employing out oFtown wor3cers. He also raised questions about
the buifding permits, saying that the workers did not have a
village permit in hand.
On checkuig with the village, he said he was told Brown paid for
the permits at the same time. He suggested that the village
perform a complete investigation into the work being done at the
buiiding.
He also added his displeasure at the allegations on Brown's
Facebook site.
Code Enforcer Jim Chase said he was not contacted about the
situaticn. He said the permits were issued but might not have
been received by the mayor's secretary for public information.
Chase added that his office was open and he was available to
answer questions.
Brown addressed council, saying he and his familyhave been
threatened online and acknowledged that Facebook postings
have become heated on ali sides.
He added that the ERC building venture was valid and adhered to
regulations.
"I don't believe we've dorie anything wrong or incorrectly. I don't
believe that we've not filed any permits that we needed tc, file,"
he said, adding that state permits were also in order. He also said
he has never claimed tc represent the village online and said he
has acted in good faith to benefit the village.
Mayor Vincent DiFabrizio said all issued would be looked intn. Pricr
to visitors' comments, he also announced that in the future, the
public forum will be strictly moderated. Persons wishing to speak
must come prior to the meeting and fill out a form sncluding the
subjects they wouid be bringing before council. Visitors will be
permitted to speak once per meeting for a period of five minutes.
"We're not going to use these meetings as a chopping block," he
said.
In other matters, Council granted a request from Sustersicfor
$1,800 fior the appraisal of a parking lot. He also gave the opinion
that the present ordinance covering garbage pickup could be
stronger. He suggested a committee review the ordinance.s. In 60
days he will provide some suggested changes.
Also, the finance committee met Wednesday. It is necessary to
clarify holiday pay for employees. A technology committee will be
formed to review tlie Website.
In addition, Frank Manteau visited council to volunteerto assist in
spaying and neutering stray cats. He said grants for such projects
were available and could reduce the cat popuiation in three-to-six
years' time.
DiFabrizio appointed.7oe Campbell to the East Ohio Regional
Board. Campbell reported changes to the board. 1'here was a
recent break on Indian Run across the creek, ,vhich East Ohio
Regional Waste Authority repaired for $100,000. The moneyvdas
in the contingency fijnd so there was no need to borrow or bond.
He noted that North Guernsey Street will require grading. He
added that rates recently increased by 50 cents.
Council Member Jim Williams reported a utility meeting was held
Jan. 31 to discuss decreasing water revenue.
Council approved the appointment of Robert Dodrill to the zoning
committee.
M ichael Shaheen, running for county treasurer, and Dick Flanagan
and David Lucas, running for sheriff, introduced themselves.
