The Danish Golden Age
At the last auction of the year in Bredgade, we focus on the Danish Golden Age with a selection of the finest artists of the period, such as
C.W. Eckersberg, Martinus Rørbye and Christen Købke. In Denmark, the first half of the 1800s was characterized by a blooming artistic
and intellectual life in spite of the many problems facing Denmark at the time – the bombardment of Copenhagen in 1801, the loss of the
navy in 1807, the national bankruptcy in 1813 and the loss of Norway in 1814. The nation was in need of a recovery, and this became the
foundation for some of greatest literary and artistic works in Danish cultural history.
At the auction we will shed light on three areas, which the Danish Golden Age painters focused on in their work – marines, model studies
and southern European motifs. Eckersberg, the period’s leading artist, nourished, with a childhood on the Danish island of Als in the back
of his mind, a special love for the maritime genre. This affection is for instance fully expressed in the work with the frigate ”Nymph” from
1832, which adorns the front of the catalogue. He made extensive studies of the ships’ condition and the wind’s influence on the sails, sea
and sky, and no one mastered the genre with as much precision as Eckersberg (cat. no. 38).
Eckersberg also paved the way for the use of naked female models in the teaching at the Royal Danish Academy of Fine Arts, which seen
through contemporary eyes was highly controversial. One of his own early model studies of a young woman, who is seen weaving her hair,
has found its way to the auction. In the periphery of the group of Golden Age artists stood L.A. Smith. He was a pupil of Eckersberg and
followed in his footsteps with the offered painting of a half-naked and hair weaving woman (cat. no. 42 and 37).
The period is also characterized by the artists’ broad outlook and wanderlust. They often set off
to southern Europe to find artistic inspiration. Based on their experiences during these periods of
studying abroad they created some of the most well known Golden Age art. Rørbye is represented
with the ”Tower of the Winds” from 1839, which depicts the famous weather station from antiquity
near the Acropolis in Athens. With Købke we head to Capri with a piece from Marina Piccola from
1846, while Constantin Hansen focuses on Rome with the depiction of the Roman Forum and the
Temple of Concordia from 1846 (cat. no. 30, 51 and 49).

In November it will be 30 years, since I took over the responsibility and management of Bruun Rasmussen Auctioneers, after my
father had passed away. Today, my two children, Alexa and Frederik, are both employed in the company, which has later become a
family-owned stock company with the three of us as shareholders.
A year ago I began to consider how best to celebrate this 30th anniversary. In this regard, I once again extend my thanks to the
National Gallery of Denmark, which has always been helpful with advice and guidance. In this case, however, direct advice was not
given. Instead it came to my attention that the museum was planning to show C.W. Eckersberg from his best side in the special exhibition ”A Beautiful Lie - Eckersberg”. It seemed right to connect my anniversary with the museum’s exhibition to achieve a synergy
effect. Personally, I wanted to promote a subject dear to my heart, namely the Danish Golden Age of art. The period has for many
years been overshadowed by many people’s enthusiasm for more recent Danish painters - both from the artists’ colony in Skagen, the
more colourful artists from the CoBrA movement and the representatives of the taut concrete art.
I wanted to focus on Eckersberg, but that turned out to be a bit more difficult than expected. Danish and international museums
have long been aware of the artist’s unique qualities. This has meant that they have acquired a large number of his works, which in
turn has resulted in fewer and fewer paintings left by Eckersberg on the art market. I am fortunate enough to be able to remember
some of my father’s auctions of Danish Golden Age art, including the sale of Agathe and Knud Neye’s extraordinary collection, which
was spread out over four auctions. Unfortunately, it is impossible to muster a similar selection of paintings today, so I extended
the anniversary auction to include other artists of the period and chose the title ”C.W. Eckersberg and the Danish Golden Age.” And
this helped things move along! We have managed to gather a large number of significant paintings and drawings, which we are
pleased to present to you at the preview, beginning on Thursday 19 November. In all modesty, our preview actually exceeds the
exhibition at the National Gallery of Denmark in one aspect – all of our paintings are for sale, which I hope many collectors in
Denmark and abroad will find enticing.
To truly show the quality of the paintings the catalogue will this time be published in a wide horizontal format. However, this has
led to the comment: ”Are you doing this because you have so many drawing-room pieces, you want to sell?” I will let the catalogue
speak for itself on this issue, but I hope that you will bring it with you for your visit to the preview, which will take place in the newly
painted showrooms on the 1st floor at Bredgade 33 in Copenhagen. Here we will offer a rare look into the period of Danish painting,
which is probably the strongest, when the different periods in Danish art history is compared with other countries.

Den Danske Guldalder
På årets sidste auktion i Bredgade sætter vi fokus på guldalderen med et udvalg af de fremmeste kunstnere som fx C.W. Eckersberg,
Martinus Rørbye og Christen Købke. I Danmark er første halvdel af 1800-tallet kendetegnet ved et blomstrende kunst- og åndsliv
trods tidens ellers store samfundsmæssige problemer – Københavns bombardement i 1801, tabet af flåden i 1807, statsbankerotten
i 1813 og tabet af Norge i 1814. Nationen havde brug for genrejsning, og det dannede grobund for nogle af de bedste litterære og
billedkunstneriske værker i dansk kulturhistorie.
Vi kaster lys over tre områder, som de danske guldaldermalere kredsede om – mariner, modelstudier og sydeuropæiske motiver.
Periodens frontfigur Eckersberg nærede med en opvækst på Als i bagagen en særlig kærlighed til den maritime genre som til fulde
udtrykkes i værket med fregatten ”Nymfen” fra 1832, der pryder forsiden af kataloget. Han foretog indgående studier af skibenes
beskaffenhed og vindforholdenes betydning for sejlenes, havets og himlens udseende, og ingen beherskede genren med så stor
præcision som ham (kat.nr. 38).
Eckersberg banede også vejen for brugen af nøgne kvindelige modeller i undervisningen på kunstakademiet, hvilket set med datidens øjne var temmelig kontroversielt. Et af hans egne tidlige modelstudier af en ung kvinde, der fletter sit hår, har fundet vej til
auktionen. I periferien af guldalderkunstnere stod L.A. Smith, der var elev af Eckersberg og fulgte i hans fodspor med den udbudte
skildring af en halvnøgen, hårflettende kvinde (kat.nr. 42 og 37).
Perioden er også kendetegnet ved kunstnernes brede udsyn og udlængsel. De vendte i flæng næsen mod Sydeuropa for at finde
kunstnerisk inspiration, og på baggrund af deres oplevelser under studieopholdene skabte de nogle af de mest kendte guldalderværker. Rørbye er repræsenteret med ”Vindenes Taarn” fra 1839, der gengiver antikkens berømte vejr-station ved Akropolis i Athen.
Med Købke drager vi til Capri med et parti fra Marina Piccola fra 1846, mens det med Constantin Hansen gælder Rom med skildringen
af Forum Romanum og Concordia-templet fra 1846 (kat.nr. 30, 51 og 49).

I november for 30 år siden overtog jeg ansvaret og ledelsen af Bruun Rasmussen Kunstauktioner, efter min far var gået bort. I dag er
mine to børn Alexa og Frederik begge ansat i firmaet, som siden er blevet et familieaktieselskab med os tre som aktionærer.
For et års tid siden begyndte jeg at fundere over, hvordan jeg bedst kunne tænke mig at fejre sådan et jubilæum. I den forbindelse
vil jeg endnu en gang rette en stor tak til Statens Museum for Kunst, der som altid er os behjælpelige med råd og vejledning. I dette
tilfælde var der dog ikke tale om et direkte råd, men det kom mig for øre, at de planlagde at vise C.W. Eckersberg fra hans bedste side
i særudstillingen ”En smuk løgn – Eckersberg”. Det ville være oplagt at koble mit jubilæum op på museets udstilling for at opnå en
synergieffekt. Personligt ville jeg gerne slå på tromme for noget, der ligger mit hjerte nært, nemlig Den Danske Guldalder. Perioden
har i en lang årrække været overskygget af manges begejstring for de senere malere – både fra kunstnerkolonien i Skagen, de mere
farverige fra Cobrabevægelsen og repræsentanter for den stramme konkrete kunst.
Jeg ville gerne sætte fokus på Eckersberg, men det viste sig at være en lidt sværere opgave end først antaget. Danske og internationale museer har for længst fået øjnene op for kunstnerens særegne kvaliteter. Det har medført, at de har erhvervet et stort antal
af hans værker, hvorfor udbuddet på kunstmarkedet er blevet mere og mere begrænset. Jeg er så heldig at kunne huske en række
af min fars auktioner over guldalderkunst, heriblandt dem med Agathe og Knud Neyes store private kunstsamling, der blev fordelt
over fire auktioner. Det er desværre umuligt at mønstre i dag, så jeg udvidede jubilæumsauktionen til at omfatte andre af periodens
kunstnere og valgte at give den titlen ”C.W. Eckersberg og den danske guldalder”. Og så gik det ligesom lidt bedre! Det er lykkedes
os at indsamle en lang række betydelige malerier og tegninger, som vi glæder os til at fremvise på eftersynet, der starter torsdag den
19. november. Sagt i al beskedenhed – på et særligt punkt overgår vores eftersyn langt udstillingen på SMK – vores værker er alle til
salg, hvilket jeg håber mange samlere i ind- og udland vil finde attraktivt.
For at værkerne for alvor kan komme til deres ret, er kataloget denne gang i bredformat. Det har imidlertid affødt kommentaren:
”Er det fordi, I har så mange sofastykker, I gerne vil sælge?” Jeg vil lade kataloget tale for sig selv, men jeg håber, at man med det
i hånden vil besøge eftersynet, der finder sted i de nymalede rum på 1. sal i Bredgade 33 i København. Her byder vi på et sjældent
godt kig ind i den periode i dansk malerkunst, der vel nok står stærkest sammenlignet med udlandet.

Excellency Hartvig Frederik Emil von Benzon, son of a chamberlain,
landowner Christian Frederik Otto von Benzon to Christiansdal (Dalum
Convent) at Odense.
As Hartvig Frederick was not the eldest son, his father bought him an
Austro-Hungarian office patent. In 1844 he married the heir of an
estate Emilie von Dorry der Jobterhazar, née Lazar.
While he was serving in the Austro-Hungarian army, they stayed most
of the time on her estate in Hungary. After her death in 1871 he returned
to Christiansdal where he died 13 November 1875 - a few months after
his father.

The painting is a smaller repetition/study with a few variations of
Emil Bærentzen's famous portrait of Johanne Luise Heiberg. That one
at Thorvaldsen's Museum.
Johanne Luise Heiberg was one of the greatest and most famous actresses of the Romantic period. Johanne Louise Heiberg came from a
poor background but rose socially to the top after her marriage to the
writer Johan Ludvig Heiberg and through him she also got to know
contemporary poets such as Adam Oehlenschlæger and Henrik Hertz.
They wrote specific roles for her, as did her husband.

The painting has not been on the market since the artist's
estate auction, and according to the present owner the
painting has never been cleaned or the like, hence appears
in an untouched state.
The motif is actually "View towards Acropolis", and the
ruins in the background are among others Parthenon on
top of the Acropolis. This is probably why the painting in
1905 was exhibited with a question mark after the title,
which originates from the artist's estate auction.

of Mrs. Councillor Heyman. Sold at the Heyman auction in
April 1917, no. 88. Later in the Swedish industrialist and art
collector Falk Simon's collection.
The series "The Story of a Fallen Girl", consists of four small
paintings, which all are engraved by G. L. Lahde and by C.
F. Clemens. The titles are: Part I, The Lover Flees though the
Window; Part II, The Mother negotiates with a Gentleman
on the Girl's behalf; Part III, In a poor attic, the Girl does her
make-up before leaving for a masked ball. Part IV, The former Beauty is begging by the harbour, her old lover walks
by but he does not recognize her. The tragic story is told by
Philip Weilbach in his Eckersberg biography, 1872, p. 18.

In the Catalogues Raisonné by Mario Krohn (1915) and Jørgen
Folmer and Iben From (1996) three versions of the present motif
are mentioned (in both Catalogues Raisonné no. 177, 178 and 179).
It does not seem as if the painting here is among the three - all
in private Danish collections in 1996 - of which two are cited as
unsigned (no. 177: measuring 31 x 25.5 cm and no. 179: measuring
30 x 24 cm) and one is cited as signed C. K. 44 (no. 178: measuring
29.7 x 26.2 cm).
Although the exhibition in Kunstforeningen in 1953 suggests that
the painting is no. 179 in the Catalogue Raisonné from 1915. Due
to the comment in the exhibition catalogue from 1953 (see above)
regarding the inscription Købke Capri, we are confident that the
present painting was in the exhibition and sold at Bruun Rasmussen auction 431, 1981 no. 311.

Hans Edvard Nørregård-Nielsen refers to the motif in "Christen
Købke Italien tur-retur", p. 182 (in Danish): "The slender,
bronze-coloured young boy is the embodiment of the local population that the Golden Age painters were searching for in this part of
Italy, along the coast previously inhabited by Greeks. The boy, with
his red Phrygian cap, is the aged Greeks' descendant on his way to
replace them in doing the day's work along the coast".
The island Capri was "discovered" by artists and travellers in the
beginning of the 1820s at the time when Herculanum and Pompeii
were excavated. A great interest in and fascination of the region
around Naples, the Amalfi coast and Capri arose.
The Danish heir to the throne Christian Frederik (VIII) and his wife
Caroline Amalie visited Capri in 1820. The painter I. C. Dahl stayed
there for a longer time. The sculptor Bertel Thorvaldsen and the
painter Thöming went there in 1828. Petzholdt painted many landscapes from the region and those works inspired Købke to travel
to Capri with his friend Constantin Hansen. They spent several
months there in 1839.
Købke's enthusiasm for Capri and its people can be seen in the
many works - both studies and finished works - of the inhabitants
(the young fishing boy for instance) and the landscapes. Even his
member piece for the Royal Academy of Fine Arts was a motif from
Capri. That one to be sold as lot 51 in this catalogue.

Professor P. O. Brøndsted, who was C. A. Jensen's patron in Rome
when he was a young painter, commisioned Jensen to paint some of
his British science colleagues in London among others C. R. Cockerell.
Sigurd Schultz describes in enthusiastic terms the portrait in the
biography "C. A. Jensen", 1932 p. 338 (in Danish): "The portrait of
Cockerell shines with the cordiality that was Jensen's finest personal ability as a portraitist. Cockerell was a handsome man. The
waving hair suits his quiet seriousness and the bright smile of the
eyes. His eyes are remarkably expressive. They willingly follow the
painter working in front of him." In addition, Schultz praises Jensen's
fine combination of colour in the painting.

The country house Abbéma was built in 1795 after the architect C. F.
Hansen's design to the Batavian ambassador Abbéma on the banks of
the Elbe. The country house was ready for habitation during the years
1796-1797. The house was sold in 1798 to the French emigrant C. l. C.
Rainville. The country house was converted into a restaurant and the

garden was laid out in terraces down to the river. The house was demolished in 1867 and a maritime school was built on the premises and
the garden was laid out as a puplic park.

The present painting is referred to (in Danish): "View of the Elbe, Altona, Rainville, with the now demolished Haus Abbéma, designed by C. F.
Hansen." He exhibited at Charlottenborg in 1826 and 1828.

C. W. Eckersberg received the gold medal of the Royal Academy of Fine
Arts in 1809 and with that one in hand the opportunity to receive one
of the sought-after travel grants to study abroad. Before leaving Denmark for Paris and later Rome he went to Møen, where he spent the
summer of 1809. The result was a series of unique landscape paintings.
The present painting with a Danish village church near the sea could
be painted on the trip to Møen. It is an unusual painting by Eckersberg.
A real clock is placed in the bell tower.
A picture clock or in Danish a "skilderiur" is often seen in German and
Swiss art but is very rare in Danish art and this one painted by such a
talented painter as Eckersberg.
Outside the entrance to the church stands a stout lord with his daughter, who is pointing towards her brother, who is offering the weary
wanderer a dime.

According to Rørbye's diary, he began a study for the painting (30 x 41)
on February 29 and he finished it on March 5 1836 (in Danish): "In the
morning I started on a small study of the Tower of the Winds, a good
motif for folkloristic scenes, because a lot of people visit the fountain
fetching water." The study is owned by Ny Carlsberg Glyptotek, Copenhagen. That one reproduced above.

In Hans Christian Andersen's novel "En digters Basar" (A Poet's Bazaar) dated 1842, Andersen describes the location seen in the painting
so exactly that he either must have seen the sketch or the exhibited
painting from 1839.
Herman Madsen recounts, in the book mentioned above, about the
Tower (in Danish): "Tower of the Winds" is located below Acropolis's
northern slope and is an interesting Prehistorical Memorial. The name
comes from a former figure on top showing the wind's direction. The
reliefs symbolize the different winds. Inside the tower there was a water clock, which indicated the time. It has in other words, been a scientific building. Rørbye's painting gives an amusing impression of the
oriental splendor that characterized urban life in Athens for more than
a century ago".

a brickyard there. The long dark line in the foreground is not a stone

This painting is a classical example of Dahl's "Nordic landscapes"
from his time in Denmark, where he stayed in the years 1811-1818.
At this time Dahl was very inspired by the old baroque masters,
which he studied in the different collections in Copenhagen - in
particular in the Royal Chamber of Arts (later the National Gallery
of Denmark). The term "Nordic landscape" covers an imaginary,
but in Dahl's mind basic Norwegian landscape. Lødrup writes the
following about the painting: "The contrapostal grouping of the
features in the different picture planes derives from the baroque
landscapes Dahl could study in the great collections in Copenhagen" (Marie Lødrup Bang, "Johan Christian Dahl 1788-1857, Oslo
1987, p. 47).

the second owner of the painting. In 1825 Fick founded Kunstforeningen in Copenhagen in collaboration with among other the art
historian N. L. Høyen, the architect G. F. Hetsch and the painters

I. C. Dahl visited Engelholm several times. Initially under the previous owner P. B. Petersen, and he stayed in the summer of 1814
at the manor. Dahl painted several works of the landscape around
Engelholm including two now at the National Gallery of Denmark
from respectively 1814 and 1816, and he improved his landscape
paintings during this stay.

In 1844 Dahl returned to Engelholm now under the new owner
Benjamin Wolff - the two have probably known each other since
the youth - in Wolff's drawing collection is a pencil sketch of
Liselund on Møn from about 1814. Wolff himself has inscribed the
drawing (in Danish): "The first sketch is by I. C. Fick, the rest is by
Dahl" (Claus M. Smidt, ”Tegnekunst på Nivaagaard”, 1983, p. 5-11).

W. Eckersberg started a special summer school in August-September 1839
at the Royal Academy of Fine Arts in Copenhagen. Cathrine Nielsen, called
Trine, sat as a model for 75 hours.
Eckersberg writes in his diary about the painting sessions week after week
during the summer. 1 August: "Seet i Akademiet et par unge Piger, som ville
være Modeller". (Seen in the Academy two young girls who wanted to be
models). 5 August: "I Skolen begyndtes et Billede af en quindelig Modell".
(We started to paint a female model). Many working days followed. 31 August: "Paa Malerskolen, hvor den quindelige Modell var sidste Gang". (The
last day for the female model at the painting school).

C. W. Eckersberg himself painted Trine in a position similar to this, where
the model was placed near a source of light (a window). His painting was
bought by Superintendent Borch. Eckersberg writes in his diary 29 September: "Tilsendt Forstander Borch det lille Maleri, en ung Pige som fletter sit
Haar". (Sent a small painting of a girl plaiting her hair to Mr. Borch). This
painting is today owned by Musée du Louvre. Reproduced in the exhibition
catalogue: "Den nøgne guldalder" p. 109 and to the left.
Unfortunately, Eckersberg does not mention the names of the other summer
school participants of 1839 in his diary.
Today we know that another Eckersberg pupil painted Trine, almost en face.
The work was reproduced in the exhibition catalogue: "Den nøgne guldalder"
p. 111, and sold at Bruun Rasmussen auction 663, 1999 no. 322 for 100.000
kr. L. A. Smith also took part in the session, presumably standing quite close
to master Eckersberg himself, although Trine is seen a bit more en face in L.

The first years after having returned from the long trip abroad to Paris
and Rome Eckersberg primarily painted portraits; but in the 1820s he
began to take an interest in marine paintings, and over the years he
became Denmark's marine painter par excellence. The motives were
not difficult to find in a country surrounded by the sea. The sea and
the sailing ships fascinated Eckersberg. It was very important for him
to present his paintings in accordance with reality, so he carefully
observed how the weather conditions influenced the sail phrase of
the ships and made sure the clouds were accurately placed in the sky.
He meticulously studied the weather, and kept a diary of weather and
wind conditions throughout life. He provided information about how a
ship should be maneuvered under various wind conditions and studied
the ship's technical details. From H. C. Ørsted he borrowed a book with
drawings of the various machine parts of the ships. This painting is
an excellent example of the national and international greatness of
Eckersberg.

It is very rare that paintings by L. A. Smith are for sale. He was a private student of professor C. W. Eckersberg and we know of at least
two paintings of models painted in Eckersberg's studio: "Modellen
Florentine foran et spejl" (the model Florentine in front of a mirror)
sold Bruun Rasmussen auction 727, 2003 no. 1225 for 400.000
DKK and "Pigen, der fletter sit hår" (Trine plaiting her hair). That
one to be sold as lot 37 in this catalogue.
Smith depicts an everyday scene. In the bright room, with the ivy
framing the window, the young mother is busy doing her needlework, while the little girl is watching the bird in the cage.

On the reverse an old label with the following information (in Danish): "A
female figure, which stands at a bed, combing her hair. Eckersberg's list of
models and other topics 1854 catalogue no. 106". On the stretcher also an
old label from Winkel & Magnussen and cat. no. 24.
Eckersberg has often been called both "the father of the Danish Golden Age
of Art" and "the father of the Danish art of painting". Regardless, it is at
least certain that he pioneered the use of female nudes in Danish painting.
When Eckersberg was appointed professor at the Academy in 1820, it was
neither allowed nor condoned to use a naked woman as a model for a painting. The French sculptor Saly had forbidden this when he became director of
the newly opened Royal Danish Academy of Fine Arts in 1754. Eckersberg
did not begin to use female nudes in his private teaching until 1833, and
with the so-called "summer exercises" in 1839 he initiated the use of female nudes in his public teaching at the Academy. Eckersberg, however, had
worked with the female nude on his own before this, for instance during
his stay in Paris between 1810-13. The small study in question is probably
an early piece. It is both similar to and different from Eckersberg's most
famous one: "Kvinde foran et spejl (Woman before a Mirror) from 1839
(the Hirschsprung Collection), where Eckersberg successfully managed to
make the painting more “appropriate” by covering the essential parts of the
woman’s body with the edge of a mirror and a white cloth respectively. In
both paintings, the young woman is doing her toilette, so the nudity seems
almost natural.

Købke writes in a diary 12 August 1829: "Started to paint Grethe" and again
14 September: "Finished the painting of Grethe". (Mario Krohn, "Maleren
Christen Købkes Arbejder", 1915 p. 5).
In the summer of 1829 Købke spent a couple of months at the vicar J.
C. Hahn's home. Here Købke flirted with one of the vicar's two daughters,
Margrethe, called Grethe. He painted the present portrait for the family, and
a repetition for himself as a memory. Hans Edvard Nørregård-Nielsen, Art
Historian, charmingly describes the small, fine portrait in "Christen Købke Omkring Kastellet" p. 112 (in Danish): "Her face is like a winter apple, but with
a sweetness, that moves downwards and gathers around her mouth, while
the sadness in her eyes most certainly is due to her youth and the fact that
the two of them were about to part".

Eleonora Christine Harboe painted all her life and was specialized particularly in copying the old Dutch and Italian masters.
From 1856 on she lived in Rome until her death in 1860.
Eckersberg painted Thorvaldsen in 1814 (Emil Hannover no. 147),
that one was exhibited at Charlottenborg in 1815 and it was donated to Kunstakademiet (the Royal Academy of Fine Arts) by
the painter, where it still remains.
Furthermore exists a replica from 1832 at the National Museum
in Stockholm and another one from 1838 at the Glyptotek.
Eckersberg has not only repeated himself, other artists have diligently copied the known and admired painting. Thorvaldsen's
Museum has since 1890 been in the possession of Christian
Vogel von Vogel Stein's version of the portrait, painted in Rome
in 1814, at the same time as Eckersberg's painting and even a
young Købke has found inspiration in the portrait and copied the
upper part in 1828.

Hanne Hellesen was one of the famous Danish flower painter I. L. Jensen's female pupils, who achieved recognition and
fame in her own right and the Royal Collection of Paintings
and Sculptures, today the National Gallery of Denmark,
bought her paintings. She was also a pupil of Eckersberg, and
he taught her about perspective drawing. Her paintings were
very much inspired by I. L. Jensen and the floral decorations of
the Sèvres porcelain factory.

Danish): "Handed mrs and miss Neergaard's portraits, sent bill ... 55 RBdr.
Each".
Anna was the oldest child in a family of four, and the only daughter. Her
father was landowner Johan Andreas Bruun de Neergaard (1770-1836)
to Svendstrup at Roskilde. His younger brother was Tønnes Christian
Bruun de Neergaard (1776-1824), landowner to Skjoldnæsholm. Tønnes
was known as a man of pleasure, who traveled a lot and was an art lover.
He was the patron of several young artists. Tønnes also had a home in
Paris, where a large part of his art collection was installed.
In 1810 Eckersberg was a young promising artist, who was in constantly
short of money before his real breakthrough, and Tønnes helped him
financially during his stay in Paris. Before leaving for Paris Eckersberg
visited Skjoldnæsholm. Here he may have met Tønnes' pretty 10-year-old
niece Anna for the first time.
19 years old Anna married the 29-year-old Christian Ludwig von Stemann
(1791-1857) later chamberlain and prefect. Within 10 years four children
were born, the youngest Catharine Elisabeth (Betzy) von Stemann was
barely one and a half years old when her mother died.
The portrait here was painted shortly after Anna got married.
19 years old Betzy von Stemann married in 1849 Eugenius Sophus Ernst
Heltzen, who was the ancestor of the Danish branch of the Heltzen family.

In 1836 Eckersberg painted a small painting entitled (in Danish)
"View from the battery of Trekroner with Copenhagen in the distance" (The Hirschsprung Collection). When Eckersberg did the
painting he was standing in a different place on Trekroner than
when he did this drawing, consequently the foreground is different,
but the view of Copenhagen is almost identical.
Provenance: Presumably the drawing sold at the estate auction of
the late C. W. Eckersberg January 1855 no. 375, described (in Danish) "a view from Trekroner. Indian ink; very elaborate".
Trekroner is a fortification on a small island at the entrance to
Copenhagen.

Ramsau is a mountain village in Bavaria, not far from Berchtesgaden.
The town was a popular destination for Scandinavian artists who
lived in Munich. Among them for example Thomas Fearnley, Albert
Küchler, Jørgen Sonne, Fritz Petzholdt, Christian Morgenstern and
Wilhelm Bendz. Several motifs by Bendz are known including the
beautiful church. The painters visited the village in the early 1830s.
Bernt Lund was a student of Thomas Fearnley in the late 1830s, later
he studied at the Academy of Fine Arts in Düsseldorf.
Thomas Fearnley's painting is owned by The Barber Institute of Fine
Arts in Birmingham.

From 3 November to 5 December 1845 in Rome Lundbye did a series of
figure studies in pen or pencil and watercolour, which he called (in Danish)
“Costume drawings”. Common to these costume drawings is that they are
all almost without exception in full figure depicting typical common Italian
people from Rome and the surrounding area, dressed in their characteristic costumes. This drawing must be seen in connection with these costume
drawings - it is a bit later (15 December) and without watercolour, but
otherwise this is a characteristic Italian “type”, the Campagna hunter, in
full figure and with all the hunter’s characteristic attributes drawn with
great accuracy.

Anna Ancher was very preoccupied with the motif "plucking poultry", and she painted many variations of it. One of the earliest is "To
gamle, der plukker måger" (Two old people plucking seagulls) from
1883 (Hirschsprung Collection). The figures and how many they
are, vary in each painting, but the characteristic feature of them
all is the basket or vessel placed in the foreground, in which the
feathers are gathered. In this painting it is a large copper vessel. In
her later paintings of the motif the light has changed compared to
the earlier ones. In this painting light comes in from a window on
the left and falls on the back wall where it creates a shadow play of
light and colour -this light is a very characteristic feature of many

Bonatzi and Elsie were two well-known people in Skagen. The
painters often used them as models. Josef Bonatzi (1845-1913)
was a Bohemian shoemaker who came to Skagen in 1885. He built
a house "Lyrehuset", of what he could find of materials. After his
death the house was used for the Midsummer bonfire. Merry Elsie
Hellesen (1842-1920) was a berry picker and a maid. She picked
berries for the Ancher, the Locher and the Brøndum families. She
lost her sanity when her fiancé drowned a few days before their
wedding.

of art-loving intellectuals in Copenhagen, several of which
are depicted in this painting. These friendships and patrons
got him back on track.

About this painting and the white Wurzburg deer
the following story was told: Christian IX's son-inlaw, Tsar Alexander II of Russia, who was married to
Princess Dagmar of Denmark, participated in a hunt
in Dyrehaven, the Deer Park north of Copenhagen,
although he was an incompetent shooter. When the
hunt was called off and the day's prey was displayed,
Alexander II had nothing to show. Resolutely he shot
Christian IX's white favorite deer, the depicted tame
Wurzburg deer, which used to come to the King and
eat from his hand. When the King heard the news and
saw the painting, he threw his small silver-cane up in
the painting which resulted in a gash - the painting's
upper clouds are the result of the restoration.
The king ordered the painting dismantled and removed, and he never saw it again.

In 1788 George Morland exhibited the painting "Execrable human
traffic" or "The affectionate slave", later known with the title" Slave
Trade", at the Royal Academy in London and in 1790 he exhibited
"African Hospitality ". Already in 1790 the printmaker J. R. Smith
offered two prints after the two paintings, and the first ones were
printed in London in 1791. The painting "Slave Trade" was probably
the first painting against the slave trade publicly exhibited in England, and it is no coincidence that this took place just a year after
the Society for the Abolition of the Slave Trade was founded in 1787

in London. There was a strong growing sentiment in the population
against slavery, and the two paintings clearly try to appeal to those
feelings. It is therefore not surprising that the two prints quickly became very popular and sold well - often as a pair, one depicting a
black African man's compassion and helpfulness to a shipwrecked
European family, and the other depicts the white European man,
who brutally removes an African man from his family to sell him
as a slave. The prints popularity made the motifs widely known and
copied. These two paintings are two very early copies after the
prints after the paintings of George Morland.

A pair of portraits of Johan Sigismund Count Schulin
(Prichsenstadt, Franconia 1694-1750). Count, Privy Council
and Secretary under the kings Christian VI and Frederik V,
and his second wife Catharina Maria von Møsting (Copenhagen 1714-1770). He dressed in flowered vest and red velvet
coat carrying the Grand Cross of the Order of Dannebrog. She
standing in a park wearing a floral dress and red shawl. In her
right hand she is holding a hat. The left arm resting on a basket of flowers. Unsigned. Oil on copper. 33 x 23.5 cm. Richly
carved gilded rococo frames.
The gifted Schulin started his career as a steward under the
Franconian-born Danish Crown Princess Sophie Magdalene's
brothers. Later he moved to Denmark and worked for Christian VI.
Schulin had a long career especially in foreign policy.
Johan Friedrich Gerhard was like Schulin born in Franconia.
They knew each other well and it was Schulin, who arranged the
contact to the Danish royal family in 1741, where Christian VI
bought a work by Gerhard. In 1742 the painter received Danish
citizenship and was paid for two paintings painted on copper. It
could be the present portraits. He always painted on copper.
Provenance: Tølløse manor house, the Schulin-Zeuthen family
until today.

Hendrick van Balen (1575-1632) played an important role in the
renewal of Flemish painting in the 17th century. He had a large
workshop with many pupils, among others, Anthony van Dyck. He is
also known for his collaboration with Jan Brueghel the Elder (15681625). They painted several mythological, allegorical and biblical
motifs together. As a figure painter van Balen painted the figures,
and Brueghel painted the landscape and the many still-life elements in the works. In this painting the figure composition is very
much inspired by van Balen's often very complex compositions with
full and half naked people in extreme positions with perspectively
foreshortened limbs and twisted bodies.

Køber er den byder, der får hammerslag. Den, der byder for andre, hæfter som selvskyldnerkautionist
for berigtigelsen af købet.
På opfordring fra Bruun Rasmussen Kunstauktioner (herefter benævnt Bruun Rasmussen), skal
alle bydere, hvadenten de ønsker at afgive et bud ved personligt fremmøde på auktionsstedet eller
afgive en kommission pr. brev, fax eller hjemmeside eller byde direkte pr. telefon eller hjemmeside,
kunne dokumentere deres betalingsdygtighed samt til enhver tid identificere sig. Bruun Rasmussen
er altid berettiget til at nægte at acceptere et bud, hvis på forlangende ikke tilstrækkelig sikkerhed
er stillet eller en passende à conto betaling har fundet sted.
Bud afgives af byderen ved personligt fremmøde på auktionsstedet eller ved skriftlig kommission
enten pr. brev, fax eller hjemmeside. På online-auktioner afgives bud direkte fra hjemmesiden.
Afgivelse af bud pr. telefon er muligt under visse forudsætninger, der afgøres af Bruun Rasmussen.
Bruun Rasmussen påtager sig intet ansvar for eventuelle fejl eller fejltagelser, der måtte opstå ved

§ 2. BETALING
Ved køb på alle traditionelle auktioner tillægges hammerslagsprisen 30% (for vin, mønter og
frimærker 25%), der dækker salær på 24% samt moms af salæret.
Ved køb på alle net-auktioner tillægges hammerslagsprisen 25%, der dækker salær på 20% samt
moms af salæret.
Visse numre handles efter særlige regler til fuldmoms, så udover auktionsomkostninger på 24% (for
net-auktioner, vin, mønter og frimærker dog 20%), beregnes moms på 25% af både hammerslag og auktionsomkostninger. Disse numre er mærket med en stjerne (*).
Danske momsregistrerede købere skal overfor Bruun Rasmussen oplyse deres SE-/CVR-nr. (momsnr.), da dette skal anføres på de fakturaer, hvor varen købes i fuld moms.
For visse udenlandske købere gælder der særlige regler for afgiftsfritagelse jvf. § 4. Afgiftsfritagelse
omfatter ikke EU private købere, som ligestilles med danske købere jvf. gældende dansk lovgivning
om handel med brugte varer, kunstgenstande, samlerobjekter og antikviteter.
Købesummen forfalder til betaling ved tilslaget. Der kan betales kontant op til DKK 50.000 eller
med Dankort, banknoteret check, rejsechecks, Visa-, Master-, Diners Club- eller Eurocard. Personlige
udenlandske checks kan kun anvendes efter forudgående aftale.
På de traditionelle auktioner i Bredgade skal betaling af købte emner finde sted under eller umiddelbart efter auktionen og under alle omstændigheder senest 8 dage efter fakturadatoen. På
net-auktionerne trækkes købesummen automatisk på det af kunden oplyste betalings-/kreditkort i
forbindelse med, at det købte emne udtages til transport (ca. 12 timer efter dagens salg). Samtidig
tilsendes køber faktura og transportoplysninger.
Betales købesummen ikke rettidigt, skal der svares rente heraf med 1,5% pr. påbegyndt måned.
Betales købesum og renter ikke inden 8 dage efter at Bruun Rasmussen har afsendt påkrav herom til køber, er Bruun Rasmussen berettiget til at annullere købet og bortsælge det købte på ny
auktion hos Bruun Rasmussen eller underhånden og afkræve køber ethvert herved opstået tab. Et
eventuelt overskud tilfalder den, der har indleveret det købte til auktion.
Har den misligholdende køber tilgodehavender fra salg af effekter hos Bruun Rasmussen, er Bruun
Rasmussen berettiget til at berigtige ethvert tilgodehavende hos køber ved modregning.
Har den misligholdende køber indleveret andre effekter til salg, er Bruun Rasmussen berettiget til
at bortsælge sådanne effekter på auktion hos Bruun Rasmussen uden at være bundet af en af

den misligholdende køber fastsat mindstepris. Den misligholdende køber er ikke berettiget til at
kræve udlevering af effekter indleveret til salg, så længe forfalden gæld til Bruun Rasmussen ikke er
betalt, uanset om værdien af sådanne effekter må anses at overstige forfalden gæld.
Bruun Rasmussen er berettiget til at afvise bud afgivet af en køber, der er i misligholdelse med sine
betalingsforpligtelser over for Bruun Rasmussen eller et bud afgivet af en anden på den pågældendes
vegne, ligesom Bruun Rasmussen er berettiget til at kræve et depositum som betingelse for accept af
fremtidige bud.
§ 3. FORTRYDELSESRET
A. Ved køb på alle traditionelle auktioner er der ikke fortrydelsesret. Køb kan derfor ikke fortrydes,
uanset om budafgivning er via web-kommissionsbud, live-bidding eller på anden vis.
B. For privatkøb af emner på en online-auktion gælder loven om fjernsalg, herunder også 14 dages fortrydelsesret. Eventuelle omkostninger forbundet med transport af købte emner retur fra
køber, betales af køber selv.
Såfremt køber benytter sig af sin fortrydelsesret, refunderer Bruun Rasmussen betalingen
umiddelbart efter, at varen er sendt retur og modtaget af Bruun Rasmussen. Bruun Rasmussen
gør opmærksom på, at det herefter er op til bankerne/kreditkortselskaberne, hvornår refusionen
indgår på købers konto.
§ 4. AFGIFTSFRITAGELSE
Udenlandske købere, der opfylder en af nedenstående betingelser, betaler de gældende salærsatser jf.
ovenstående, men bliver ikke belastet af dansk moms. Den danske moms deponeres dog hos Bruun Rasmussen, indtil eksporten er gennemført på dokumenteret lovpligtig vis.
A. Købere, som er momsregistreret i et andet EU-land, kan fritages for at betale dansk moms, når det
kan dokumenteres, at købet er transporteret til den adresse, som køber har angivet over for Bruun
Rasmussen og som er anført på fakturaen. I sådanne tilfælde skal der afregnes moms i henhold til de
gældende regler i det land, hvor virksomheden er momsregistreret. Det tilrådes at søge oplysning hos
de lokale myndigheder.
B. Købere med bopæl uden for EU kan fritages for dansk moms, når det kan dokumenteres, at købet
er transporteret ud af EU. Bruun Rasmussen udsteder så vidt muligt de fornødne eksportpapirer, som
skal fremvises ved toldmyndighederne, og forbeholder sig ret til at opkræve et gebyr herfor.
Foretages eksporten af en af Bruun Rasmussen godkendt speditør skal momsen ikke deponeres. Se listen

§ 5. AFGIFTSBETALING
A. Momsregistrerede virksomheder i andre EU-lande kan undlade at gøre brug af muligheden for
momsfritagelse og i stedet betale dansk brugtmoms/fuldmoms. Dette skal meddeles Bruun Rasmussen inden kl. 10 dagen efter købet.
B. Momsregistrerede virksomheder i Danmark kan vælge at betale fuldmoms jf. ovenstående. Dette
skal meddeles Bruun Rasmussen inden kl. 10 dagen efter købet.
§ 6. UDLEVERING
Købesummen skal være betalt, inden det købte kan udleveres til køberen. Det købte henligger fra
hammerslaget for købers regning og risiko. For varer, der ikke afhentes ifølge aftale efter hammerslaget, vil blive kørt på fjernlager på købers regning og risiko. Købte varer, der er betalt, men ikke
afhentet, vil efter 1 år blive videresolgt for købers regning ved auktion eller underhånden.

§ 7. FORSENDELSE
Såfremt Bruun Rasmussen påtager sig at emballere og fremsende købte varer, sker dette på købers
regning og risiko. Bruun Rasmussen kan således ikke drages til ansvar for skader forvoldt på købte
varer under forsendelse eller for forsvundne forsendelser.
§ 8. KUNSTNERAFGIFT TIL COPY-DA N
CD
Ifølge gældende dansk lovgivning om ophavsret skal der opkræves følgeretsvederlag for værker af
nyere danske og visse udenlandske kunstnere, som enten er nulevende eller ikke har været døde i mere
end 70 år. Følgeretsvederlaget opkræves af Bruun Rasmussen på vegne af kunstnernes organisation
Copydan. Disse værker er mærket (CD) for Copydan ud for katalognummeret.
Den såkaldte Copydan-afgift tillægges hammerslagsprisen inkl. salær, når beløbet overstiger €300.
Copydan-afgiften er:
• 5% af den del af hammerslagsprisen og salæret (ekskl. moms), der udgør indtil €50.000.
• 3% af den del af hammerslagsprisen og salæret (ekskl. moms), der ligger mellem € 50.000
og € 200.000.
• 1% af den del af hammerslagsprisen og salæret (ekskl. moms), der ligger mellem € 200.000
og € 350.000.
• 0,5% af den del af hammerslagsslagsprisen (ekskl. moms), der ligger mellem € 350.000
og € 500.000.
• 0,25% af den del af hammerslagsprisen (ekskl. moms), der ligger over € 500.000.
Copydan-afgiften kan ikke overstige € 12.500 for det enkelte kunstværk.
Euro-kursen er fastsat af Copydan i 2015 til kurs 744,01 pr. € 100.
behæftet med væsentlige fejl, der har medført en væsentlig højere hammerslagspris, end en korrekt
beskrivelse må antages at ville have resulteret i, er køber berettiget til at annullere købet, hvorefter
den samlede erlagte købesum tillagt auktionsomkostninger og evt. moms, vil blive refunderet køber.
Væsentlige fejl i beskrivelsen relateret til mål eller vægt erstattes kun procentuelt i forhold til differencen.
Retten til under de her anførte betingelser at annullere et køb kan kun udøves af den, der købte
den pågældende effekt hos Bruun Rasmussen og er betinget af, at krav om annullering fremsættes
skriftligt over for Bruun Rasmussen inden 2 år efter købsdagen, og af at det købte inden samme
frist returneres til Bruun Rasmussen i den samme stand i enhver henseende, som det købte var i på
hammerslagstidspunktet.
Køber kan i tilfælde af annullering ikke gøre krav på betaling af renter af købesummen og er ej
heller berettiget til at kræve anden udgift eller tab, herunder eventuel mistet videresalgsfortjeneste,
dækket.
Et køb kan ikke kræves annulleret efter ovenstående bestemmelser, såfremt:
a. beskrivelsen i katalog eller på hjemmesiden på hammerslagsdagen var i overensstemmelse med
den på dette tidspunkt gældende opfattelse blandt lærde og eksperter.
b. den eneste måde til på salgstidspunktet at få fastslået et falskneri var iværksættelsen af videnskabelige processer, hvis gyldighed først blev anerkendt efter salgstidspunktet, eller som ville have
været uforholdsmæssigt omkostningskrævende eller uigennemførlige uden beskadigelse af den
pågældende effekt.
I tillæg til ovenstående frist gælder de almindelige forældelsesregler i forældelsesloven, efter hvilke
køber ikke under nogen omstændigheder kan gøre noget krav gældende over for Bruun Rasmussen,
når der er forløbet mere end 5 år fra købsdagen.

§ 9. EKSPORTTILLADELSE
Kulturværdiudvalget er blevet ansøgt om eksporttilladelse, hvor dette kræves iflg. gældende dansk
lovgivning om sikring af kulturværdier i Danmark. Foreligger en sådan ikke, vil dette blive meddelt
den udenlandske køber umiddelbart efter hammerslaget. Derefter vil Bruun Rasmussen igen ansøge
Kulturværdiudvalget på købers vegne, nu hvor prisen kendes. Gives eksporttilladelse ikke, er Kulturværdiudvalget forpligtet til at overtage det købte til den opnåede pris, hvilket betyder at købet
bliver hævet for køber.
§ 10. BESKRIVELSE AF EMNER
Alt sælges i den stand, hvori det ved hammerslaget er at forefinde og som beskrevet i katalog eller
hjemmeside med senere offentliggjorte ændringer og modifikationer.
Beskrivelsen er foretaget efter bedste overbevisning og under anvendelse af de anførte katalogiseringsprincipper.
De solgte effekter er ofte af en alder eller af en art, der bevirker, at de kan være behæftet med fejl,
mangler, restaurering eller beskadigelser, der ikke nødvendigvis angives i katalog eller på hjemmesiden. Afbildninger i katalog eller på hjemmesiden er blot til identifikation og kan ikke anvendes til
vurdering af effekternes stand.
Enhver der ønsker at byde på auktion, bør derfor ved selvsyn på de før auktionen afholdte eftersyn
forvisse sig om de ønskede effekters stand.
Beskrivelsen er udtryk for den på salgstidspunktet blandt lærde og eksperter herskende opfattelse.
Skulle der efter købet opstå tvivl om det købtes ægthed eller dettes overensstemmelse med beskrivelsen, skal dette straks meddeles til Bruun Rasmussen.
Såfremt det må erkendes, at det købte er en forfalskning, eller såfremt beskrivelsen har været

CONDITIONS OF PURCHASE
§ 1. BIDDING
The buyer shall be the highest bidder at the “hammer price”. Any person bidding on behalf of a
third party shall be liable in surety for completion of the sale.
At the request of Bruun Rasmussen Kunstauktioner (hereinafter called Bruun Rasmussen), all bidders, whether they wish to make bids in person at the place of auction or commission bids by letter,
fax or the homepage direct telephone bids or the homepage, should be able to document their
ability to pay and be able to provide proof of identity at any time. Bruun Rasmussen is entitled to
refuse to accept a bid if, when requested, adequate security or adequate payment on account has
not been rendered.
Bids should be made by the bidder in person at the place of auction or by written commission by
letter, fax or the homepage. For online auctions alle bids are submitted via the homepage. Telephone bidding is possible within certain conditions made out by Bruun Rasmussen. Bruun Rasmussen is not to be held responsible for any errors that may occur using this service. The auctioneer
shall have absolute discretion as to the increment of the bids. The auctioneer will also make decisions in all cases of doubt regarding the bidding.
Credit/debit card information must be registered with Bruun Rasmussen before bids can be submitted.
§ 2. PAYMENT
Purchases made at all Bruun Rasmussen traditional salesroom auctions are subject to a 30% fee (for
wines, coins and stamps 25%), which covers 24% buyer’s premium plus VAT of the premium.
Purchases made at all Bruun Rasmussen online auctions are subject to a 25% fee, which covers
20% buyer’s premium and VAT of the premium.
Certain lots are sold in accordance with specific rules on normal VAT arrangement (hereinafter
called normal VAT), so that the purchase price is the hammer price plus an additional 24% (for
online auctions, wines, coins and stamps 20%) in buyer’s premium and VAT of 25% levied on both
the hammer price and the buyer’s premium. The lots subject to Full VAT are indicated as such in
the catalogue and on the homepage with an asterisk (*).
Danish VAT registered buyers shall provide Bruun Rasmussen with documentation of their SE-/CVR
-number (VAT No.) as this has to be quoted on the invoice for goods bought at full VAT.
For some foreign buyers, specific VAT-exemption rules apply (cf. Article 3). VAT-exemption does
not apply to private buyers from the EU who are considered as Danish buyers (cf. current Danish
legislation on Special VAT Scheme for Sales of Works of Art, Collectors’items and Antiques by Public Auction).
The purchase price falls due for payment when the goods have been knocked down. Payment may
be made in cash up to DKK 50,000, by Dankort, banker’s cheque, traveller’s cheque, Visa-, Master-,
Diners Club- or Eurocard. Personal foreign cheques may only be used for payment by prior arrangement.
At traditional auctions payment for purchased items must be made during or immediately after the
auction. Under all circumstances payment must be made no later than eight days from the date of the
invoice. With online auctions, payment automatically takes place when the items are prepared for dispatch (circa 12 hours after the purchase has been made) using the credit/debit card details submitted
by the purchaser. At the same time an invoice and dispatch information will be sent to the purchaser.
Should the purchase price not be paid by the due date, interest at 1.5 % per new month will be
charged.
If the purchase price and interest are not paid within eight days after Bruun Rasmussen has sent its
demand to the buyer, Bruun Rasmussen shall be entitled to rescind the sale and resell the goods at

a Bruun Rasmussen auction or privately, and to demand reimbursement of any related losses from
the defaulting buyer. Any further profit on the sale shall be payable to the person who had deposited the goods for sale by auction.
If the defaulting buyer is entitled to proceeds from a sale of goods by Bruun Rasmussen, Bruun Rasmussen shall be entitled to set off its receivables against its payables to the defaulting buyer.
If the defaulting buyer has deposited other goods for sale, Bruun Rasmussen shall be entitled to sell
such goods at a Bruun
Rasmussen auction without being bound by the reserve stipulated by the defaulting buyer. The
defautling buyer shall not be entitled to demand the surrender of goods deposited for sale as long
as the debt payable to Bruun Rasmussen has not been discharged, regardless of whether the value
of such goods may be deemed to exceed the debt payable.
Bruun Rasmussen shall be entitled to refuse a bid made by a buyer who is in default in respect to
his payment obligations to Bruun Rasmussen, as well as a bid made by a third party on behalf of
such a defaulting buyer. Bruun Rasmussen shall further be entitled to demand a deposit as a condition of accepting any future bids from such a purchaser.
§ 3. MONEY-BACK GUARANTEE
A. Purchases made on all traditional salesroom auctions are uncoditional and can not be cancelled
regardless of the type of bid such as absentee web bid, live-bidding or otherwise.
B. Online purchase of items by private individuals is subject to Danish consumer law, which extends
14 days of money-back guarantee. The purchaser is liable for any costs related to the transport
of returned items.
Should a purchaser seek to avail himself or herself of the money-back guarantee, Bruun Rasmussen will refund the payment on receiving the returned items. Please note that the date on
which accounts are debited is subject to the policy of the purchaser’s bank/credit card company.
§ 4. EXEMPTION FROM VAT
Foreign buyers who meet the following conditions pay the applicable auction fees, cf. above, but are not
charged Danish VAT. However, the Danish VAT must be deposited at Bruun Rasmussen until documentation has been provided to show that the goods have been exported as required by law.
A. Buyers who are VAT-registered in another EU country are exempt from paying Danish VAT when
it can be documented that the item purchased has been transported to the address declared by
the buyer to Bruun Rasmussen and specified on the invoice. In such cases, VAT must be settled in
accordance with the rules in force in the country where the company is VAT-registered. It is advisable
to check with the relevant local authorities.
B. Buyers domiciled outside the EU may be exempt from Danish VAT when it can be documented that
the purchase has been transported out of the EU. As far as possible, Bruun Rasmussen issues the
necessary export documents to be presented to the customs authorities, and reserves the right to
charge a fee for doing so.
If the goods are being exported by a freight forwarder authorised by Bruun Rasmussen, the VAT
need not be deposited. See the list of approved freight forwarders
§ 5. PAYMENT OF TAXES AND DUTIES
A. VAT-registered businesses in other EU Member States may opt out of exercising the option of
VAT exemption and instead pay Danish VAT on second-hand goods/full VAT. Bruun Rasmussen
must be informed of this before 10 am on the day after the purchase.
B. VAT-registered businesses in Denmark may choose to pay full VAT, cf. above. Bruun Rasmussen
must be informed of this before 10 am on the day after the purchase.

§ 6. COLLECTION OF PURCHASES
The purchase price must be paid in full before the purchased lot can be passed over to the buyer. From
the time of the lot being knocked down to the buyer, until its collection, the purchased lot will be held
at the buyer’s own expense and risk.
A storage fee will be charged for lots which have not been collected according to agreement. Lots which
have been paid for but not collected will be storaged at buyers expense. Lots not collected within 1 year
will be resold at auction or privately at the buyer’s expense.
§ 7. DISPATCH
Should Bruun Rasmussen undertake the packaging and forwarding of purchased goods, this shall
be done at the buyer’s own expense and risk. Bruun Rasmussen shall thus not be held liable neither
for any damage caused to purchased goods during dispatch nor for any missing consignments.
§ 8. DROIT DE SUITE
In accordance with Danish copyright law, an additional royalty fee is to be paid for the purchase of works
by contemporary Danish artist and some international artists who are either still alive or who have been
dead for less than 70 years. The additional royalty fee will be collected by Bruun Rasmussen on behalf of
Copydan, which is a Danish-based joint collecting society. Such works are marked with (CD) for Copydan
next to the lot number.
The Copydan royalty fee is added to the auction price including the buyer’s premium when the total
exceeds €300.
Copydan royalty fees:
• 5% of the auction price and buyer’s premium (excluding VAT) totalling up to €50,000.
• 3% of the auction price and buyer’s premium (excluding VAT) of totals between €50,000 and
€200,000.
• 1% of the auction price and buyer’s premium (excluding VAT) of totals between €200,000 and
€350,000.
• 0.5% of the auction price and buyer’s premium (excluding VAT) of totals between €350,000 and
€500,000.
• 0.25% of the auction price and buyer’s premium (excluding VAT) of totals above €500,000.
Copydan royalties must not exceed €12,500 for an individual artwork.
The euro exchange rate has been set by Copydan for 2015 at DKK 744,01 per €100.
§ 9. EXPORT LICENCE
Applications for an export licence must be made to the Danish Cultural Assets Committee when
required in accordance with current Danish legislation on the protection and preservation of cultural assets in Denmark. Where such a licence has not been obtained, the foreign buyer will be
informed thereof immediately after the lot has been knocked down to the buyer. Another application will subsequently be sent to the Danish Cultural Assets Committee by Bruun Rasmussen
on behalf of the buyer, now that the price is known. Should an export licence not be granted, the
Danish Cultural Assets Committee would be obliged to acquire the purchased lot at the purchase
price, and the buyer would thus not be bound to the purchase.
§ 10. DESCRIPTION OF LOTS
All lots are sold in the condition in which they are found when knocked down and as described
in the catalogue and on the homepage with subsequently published changes and modifications.
Description is done according to the best of Bruun Rasmussen’s knowledge and on the cataloguing
principles stated.
The lots auctioned are often of some age or of a kind which makes it possible that they may contain defects, deficiencies, or may have been subject to restoration or damage not necessarily stated
in the catalogue and on the homepage. Pictures are for identification only and cannot be used for
an evaluation of the condition of the goods.

Any person who wishes to bid at an auction should therefore sa-tisfy himself of the condition of the
lots for which he intends to bid by personal inspection at the preview held prior to the auction. The
description is an indication of the prevailing opinion of scholars and expert at the time of the sale.
If any doubts should arise after the purchase regarding the genuineness of the purchased lot or its
conformance with the description, Bruun Rasmussen should immediately be informed thereof.
Should the purchased lot be proved to be a forgery, or if the description contains material errors
which lead to a considerably higher hammer price than that which a correct description would presumably result in, the buyer shall be entitled to cancel the purchase, after which the buyer shall be
reimbursed for the total purchase price paid plus buyer’s premium and VAT, when applicable.
For material errors in the description in respect to measurements or weight, compensation shall
only be paid on a percentage basis in proportion to the difference.
The right of cancellation of a purchase in pursuance of the present conditions can only be exercised by the party who has bought the lot in question at Bruun Rasmussen and shall be subject to
the presentation of a claim for cancellation in writing to Bruun Rasmussen within 2 years of the
purchase date and to the purchased lot being returned to Bruun Rasmussen in the same condition
in any and all respects which the purchased lot was in at the time of the lot being knocked down
to the buyer.
In the event of cancellation the buyer shall not be entitled to claim payment of interest on the
purchase price nor shall the buyer be entitled to claim compensation for any other expenses or loss
incurred, including any possible loss of profit in connection with reselling.
It shall not be possible to state cancellation of a purchase in pursuance of the above provisions if:
a the description on the day the lot was knocked down to the buyer was in accordance with the
then generally accepted opinion of scholars and experts;
b the only way of establishing whether the lot was a forgery at the time of the sale was the
implementation of scientific processes, the validity of which was only acknowledged after the
time of the sale, or which would have required a disproportionate amount of cost, or which
would have been impossible to carry out without damaging the lot in question.
In addition to the time-limits stated above, all purchases are subject to the Statute of Limitations
stipulated by danish law by which Bruun Rasmussen is under no circumstance liable for purchases
after 5 years from the date of purchase.

COMMISSION
Bruun Rasmussen undertakes to execute commission bids for bidders who are unable to be present
at the auction. It is a prerequisite that Bruun Rasmussen receives the commissions by letter, fax or
telephone 24 hours before the start of the auction for the bidders’ credit to be checked, if necessary. Bids by the homepage are to be recieved a minimum of 3 hours before the start of the auction. Bruun Rasmussen is not to be held responsible for any errors that may occur using this service.
CONDITION REPORTS
Bruun Rasmussen undertakes to provide further information about the state and condition of the
lots if possible. This is regarded as a service for customers who are unable to make a personal
inspection of the lots at the preview. Bruun Rasmussen stresses that the information given cannot
be used as the basis for complaints; complaints can only be based on the description.
EXEMPTION FROM VAT
Buyers shall, according to § 2, pay full VAT on lots marked with an asterisk (*).
No Danish VAT is to be paid when VAT registered companies from other EU countries buy at Bruun
Rasmussen and resell to private buyers, The private buyer then only has to pay VAT according to
the rules in force in the country where the foreign company is VAT registered. For further information please consult your local authorities.

Pieces of furniture that are made of Brazilian rosewood or contain parts of
it, require a CITES export permit in order to be exported from Denmark to
a country outside The European Union. Buyers residing outside the EU are
required to obtain this permit. More information is available upon request.

1. januar 1995 trådte nye love i kraft i EU vedrørende moms ved handel på auktion
med brugte varer, kunst­genstande, samler­objekter og antikviteter, der nu kan handles til
brugt moms.
As of 1 January 1995 new EC regulations came into effect regarding the sale of secondhand goods, works of art, collector’s items and antiques; these items may now be traded
under the Auctioneers’ Margin Scheme.
Efter de nye regler er det kun auktionsomkostninger, der skal tillægges moms, og ikke
som tidligere varens fulde pris. I auk­tionsomkostninger er indregnet ikke fradragsberettiget moms.
Under the Auctioneers’ Margin Scheme the premium only is subject to VAT, i.e. the
hammer price is exempted from VAT. The buyer’s premium of 25% will thus henceforth
include non-refundable VAT.

KUNSTNERAFGIFT TIL COPY-DAN
1. Danish VAT registered buyers may choose to pay the 24% buyer’s premium + 25%
VAT on the total amount (Full VAT). The buyer may have the total VAT refunded and
thus pays 24% in buyer’s premium only.
2. VAT registered buyers in other EU countries may avoid Danish VAT by using their
VAT registration number and thereby pay a buyer’s premium of 24% only.
3. Residents of countries outside the EU meeting the Danish customs authorities’
requirements regarding the export of goods pay the buyer’s premium of 24% only
(see Conditions of Purchase §3, Exemption from VAT).

Pursuant to current Danish legislation on copyright an artists’ royalty of 5% of the total
price exclusive of VAT (i.e. hammer price plus buyer’s premium 24%) shall be collected
on works of modern art by all Danish and most foreign artists. These works are marked
for Copy-Dan next to the lot number.
