SUBSTITUTE TRUSTEE’S SALE OF
EXTREMELY VALUABLE REAL PROPERTY
IN ARLINGTON COUNTY, VIRGINIA
In execution of a Deed of Trust dated as of April 5, 2007 and recorded on April 6, 2007
among the Land Records of Arlington County, Virginia as Instrument No. 2007096037 in Book
4085, page 1030 (as amended or modified, the “Deed of Trust”) executed by THE RODNEY P.
HUNT REVOCABLE TRUST BY AND THROUGH RODNEY P. HUNT, TRUSTEE to a
Trustee for the benefit of Bank of America, N.A (the “Beneficiary”), default having been made
in the payment of the debt therein secured and being required to do so by the Beneficiary and
holder of the promissory note secured by the lien of the Deed of Trust, the undersigned Gordon
P. Peyton, Substitute Trustee, will offer for sale at public auction on the front steps of the
Arlington County Circuit Court Courthouse, 1425 North Courthouse Road, Arlington, Virginia
22201 on Thursday, September 27, 2012, at 11:30 a.m., the real estate with improvements
thereon known and described as follows:
Lot One-A (1-A) and One-B (1-B) of a Resubdivision of Lot One and Outlot A,
RIVER VIEW SUBDIVISION, as the same appears duly dedicated, platted and
recorded in a Plat of Resubdivision prepared by Shiller and Associates, P.C., dated
November 11, 1993 and recorded among the land records of Arlington County,
Virginia on June 24, 1994, in Deed Book 2683, at Page 1780
The foregoing property (the “Property”) is generally known as 189 Chain Bridge Road,
McLean, Virginia 22101, but has a mailing address (and a street address) of 201 Chain Bridge
Road, McLean, Virginia 22101 and is located, as aforesaid, in Arlington County, Virginia.
The Property is believed to be improved by approximately 20,000+/- square feet of living
space and recreational area, an elevator, a detached guest house and staff quarters, a basketball
court, a men's gym and showers, a separate ladies’ gym and spa, an indoor exercise pool, a
billiards room, a 2 lane bowling alley, a movie theater, a 15 car underground garage and private
3 car garage. The Property is believed to include an outdoor swimming pool, an outdoor spa,
patio, outdoor kitchen and a covered veranda with fireplace.
Terms of Sale:
ALL CASH. The Property will be offered as an entirety only. A bidder’s deposit of One
Hundred Thousand Dollars ($100,000.00) in the form of certified check or cashier’s check (as
increased per the provisions hereof, the “Deposit”) (endorsed and/or payable to “Gordon P.
Peyton, Substitute Trustee”) shall be required to be presented to the Substitute Trustee prior to
the sale, and shall be paid by the successful bidder (“Purchaser”) to the Substitute Trustee at the
time that the Property is knocked down for sale, which Deposit shall be applied without interest
to the purchase price. The Deposit shall be increased to five percent (5%) of the bid price and
shall be remitted to the Substitute Trustee not later than five (5) business days after the sale.
Immediately after the sale, the successful bidder(s) shall execute and deliver a contract of
sale with the Substitute Trustee for the Property, a copy of which shall be available for
inspection immediately prior to the sale, and shall deliver to the Substitute Trustee the initial
component of the Deposit, which shall be increased within 5 business days as aforesaid. The
balance of the purchase price for the Property, together with interest at 12.25% per annum from
the date of sale to the date of settlement, shall be paid in cash at settlement, time being of the
essence with regard to the Purchaser’s obligations.
No Deposit shall be required in the event the Beneficiary is the Purchaser. Settlement
shall take place within thirty (30) days after the sale at such place as the Substitute Trustee shall
designate. Adjustments, including proration of real estate taxes and utilities, shall be made as of
the date of sale.
If the Purchaser fails to complete settlement, time being of the essence, the Substitute
Trustee reserves the right to forfeit the Deposit, re-advertise and sell the Property at the risk and
cost of the defaulting Purchaser, or without forfeiting the Deposit, Substitute Trustee may avail
himself of any legal or equitable rights against the defaulting Purchaser. All costs of
conveyancing, examination of title, state and local recording taxes and charges, including
Virginia grantor's tax and settlement fees, if any, to be at the cost of Purchaser. Neither
Substitute Trustee nor Beneficiary assume any obligation to deliver possession of the Property.
Should the Substitute Trustees be unable, for any reason, in their reasonable discretion, to
convey marketable title, the successful bidder’s sole remedy in law or equity shall be the return
of the Deposit. Upon return of the Deposit, the sale shall be void and of no effect.
This sale is subject to any state, federal and/or special estate taxes. The Substitute
Trustee reserves the right: (i) to waive or modify the Deposit requirement; (ii) to approve the
creditworthiness of any bidder or final purchaser; (iii) to withdraw all or part of the Property
from sale at any time prior to the termination of bidding; (iv) to keep the bidding open for any
length of time; (v) to reject any or all bids; and (vi) postpone the sale and conduct other sales as
the Substitute Trustee may determine in his discretion.
No representations concerning status of title or liens are made either by Substitute
Trustee or Beneficiary. Sale is subject to matters appearing upon inspection of the Property.
This advertisement does not constitute an invitation to prospective bidders to go on or about the
Property or improvements, if any.
The Property shall be sold in “AS IS,” “WHERE IS,” and “WITH ALL FAULTS”
condition and without warranty, and SUBJECT TO conditions, restrictions, rights-of-way,
easements and reservations, if any, contained in the deeds forming the chain of title, filed and
unfiled mechanics' and materialmen's liens, if any, and all other matters of record taking priority
over the Deed of Trust, if any, and subject to all matters that an accurate survey or physical
inspection of the Property might disclose. Subject to the foregoing, upon information and belief,
the Property contains a Resource Protection Area (RPA) stream buffer. Land disturbance and
tree removal within an RPA is subject to specific provisions of Arlington County’s Chesapeake
Bay Preservation Ordinance. The Property is sold subject to all requirements of the RPA.
The Purchaser recognizes and agrees that any investigation, examination, or inspection of
the Property is within the control of the owner of the property or other parties in possession and
their agents and not within the control of the Substitute Trustee, the Noteholder, or their
successors or assigns.
THE WARRANTIES CONTAINED IN SECTION 55-70.1 OF THE CODE OF
VIRGINIA ARE HEREBY EXCLUDED. THE EXCLUDED WARRANTIES INCLUDE,
BUT ARE NOT NECESSARILY LIMITED TO, FREEDOM FROM STRUCTURAL
DEFECTS, CONSTRUCTION IN A WORKMAN-LIKE MANNER, AND FITNESS FOR
HABITATION.
FURTHER, THE PROPERTY SHALL BE CONVEYED WITHOUT
REPRESENTATION OR WARRANTY OF ANY KIND OR NATURE INCLUDING ANY
REPRESENTATIONS REGARDING ZONING, WETLANDS, FLOOD PLAIN,
SUBDIVISION COMPLIANCE, ACCESS, PHYSICAL CONDITION, PARTIES IN
POSSESSION, TOPOGRAPHY, SOIL TYPE OR CONTENT, ENVIRONMENTAL
CONDITIONS AFFECTING THE PROPERTY AND AVAILABILITY OF PUBLIC
UTILITIES, EXCEPT THE REAL PROPERTY WILL BE CONVEYED BY TRUSTEE’S

herein is the highest bidder at the Auction Sale; and c) the Prospective Buyer named herein as the
highest bidder at the Auction Sale executes a Contract of Sale and closes on the sale of the subject
property in accordance with the terms of the aforesaid Contract of Sale. In the event a commission
reduction is required to consummate a sale, Tranzon Fox reserves the right to proportionately reduce the
commission to Buyer’s agent. If Tranzon Fox is required to litigate to collect the commission, reasonable
attorney’s fees and costs shall be deducted from the gross commission collected and the balance shall be
divided proportionately. In order to be effective, all Broker Acknowledgment Forms must be received by
Tranzon Fox on or before 4:00 p.m. one business day prior to the auction. Agents must accompany
their buyer to the auction. No Broker Acknowledgment Forms will be accepted at the auction site.
