Wow, the weather has been quite an experience for the last couple of months. Zero to
60 degrees depending on what week or what
area of the state you are talking about. I was
convinced when we got a good shot of snow in
November that we were in for a LONG winter.
So far, we have not had it too bad (knock on
wood).
Whether you want to talk about the controversial 34 hour restart in the hours of service
rules, posting CSA Scores so everyone can view them, highway funding,
driver shortages or etc.; the trucking industry is never wanting for issues.
Unfortunately, there will be federal and state issues that effect this industry
for a long, long time; perhaps forever.
I am writing this message while aboard a commercial flight headed to a
Western Trucking Association Executives Council (WTAEC) meeting. This is
a meeting of my peers in the western states of this country. This is a very
important meeting for me to attend since the western states have so much
in common when it comes to the trucking industry. Our agenda contains industry issues while also including nonprofit trade association management
issues. Since we are all friends and peers, our mutual issues seem to find
mutual answers. It is always a great meeting to participate in.
On Monday, January 12, 2015, I will again be headed to what I call "winter
camp" at the State Capitol in Pierre. With pleasure, I will again be lobbying your efforts to the South Dakota Legislature. Although the South Dakota
trucking industry will not be championing a specific issue in 2015, I know
there will again be a long list of issues that have a direct effect on this industry; highway funding in particular.
Lobbying the State Legislature is an event to which I look forward to going
to but by the time it is over, I cannot wait to get away from. As usual, as it
has been for the last 23 years, I will be on the ground in Pierre for the entire
40 day legislative session. For those that have provided an email address,
you can watch your email for weekly reports as to what is happening in the
State Capitol Building. If you are not in that email group and you want to be,
please call your SDTA Office and request to be added. As always, if there is
an issue about which you would like to visit with me, please call your SDTA
Office and a staff member will get a message to me.

I would like to dedicate this month’s article to Larry McCollam
(aka Midnight). After 33 plus years of just hauling logs Larry
has decided it is time to fully retire. Larry has been a teacher,
role model and mentor for many of us. He set a bar of very
high standards for us to follow. His years of experience, wisdom and caution will be deeply missed. I personally will miss
the enthusiastic good mornings as well as his words of caution of the dangers in the work that we
perform. I will never forget his “Ya-4”
response to a radio conversation. I am
sure you will be able to find Larry on any
given hunting road during hunting season or working in the garden during the
summer months. Maybe you’ll see him
just sitting in front of the shop on a warm
sunny summer day. I know I will be stopping occasionally to mooch fresh vegetables, share some good conversation and
listen to some words of experience and
wisdom. Although you will be missed by
all of us Larry, we wish you many years of
an enjoyable retirement and thank you for
just being who you are (Midnight).
It’s holiday time - a time to be thankful for
the good things in our lives. I for one am
not only thankful for the good things in
my life, but for all the good people in my
life. My holiday wish for everyone is that
I hope you feel as blessed as I do during
this joyful season and hope we all have a
very good year.

Before the sun peeks over the horizon until after it’s set for the day, you are busy. The chores never stop and your presence at
the ranch helps keep things running smoothly.
But what about when you’re sick? How do you make time for a visit to the doctor with so much to do?
Now you don’t have to worry with video visits offered exclusively at Sanford Health. So when those coughs, colds, aches, pains
or rashes strike, all you need is your computer, and you can stay where you are.
Lindsay Huser took advantage of the convenience of video visits during a work conference about four hours away from her
home.
“My eye started getting very red and sensitive to light,” the Sioux Falls resident says. “I had three more days of the conference
before returning home, and knew I needed to see a doctor before then.”
The problem was, her health care provider was not nearby – at least not physically. Lindsay was hesitant to reach out to a
physician or clinic outside of Sanford Health, and then her mother told her about video visits.
“It made me nervous to try and find a doctor that I could trust without being familiar with my surroundings,” Lindsay says.
“But when I learned that I could see a provider I trusted, it was a such a comforting feeling. I’ve always been happy with the
care I’ve received at Sanford, so it was nice to have that option even though I was far from home.”
Video visits were introduced at Sanford this fall, to help deliver expert care in a convenient package. This way you don’t miss
a beat on the job or at home, but still receive the care you need to stay healthy.

After logging in to her My Sanford Chart account, Lindsay simply answered a few questions to determine if a video visit would
be beneficial in her situation. She scheduled an appointment with a Sanford provider that fit her schedule and following a
brief visit, she soon had a prescription for drops in her hands.
“The entire process was beginning to end was so simple and seamless,” she says. “The provider even found the nearest pharmacy for me, and sent the prescription right over for me to pick up.”
Lindsay’s eye quickly cleared up with the drops, and she was able to attend the rest of her conference with no complications.
“I am grateful for this level of convenience when needing to see a doctor,” she says. “I would recommend this to anyone, and
will not hesitate to use it in the future.”

FMCSA Will Clarify Sleep Apnea
Instructions to Medical Examiners
The Federal Motor Carrier Safety Administration will clarify
its instructions to medical examiners concerning screening
drivers for sleep apnea.
In response to congressional concern about sleep apnea
training for examiners, the agency said it will notify examiners and trainers that they should not use federal rules and
advice as guidance for apnea screening and testing.
Acting FMCSA Administrator Scott Darling also said the
agency will commence a rulemaking on sleep disorders this
year. Specifically, the agency plans to request comments on
the costs and benefits of a rule.
At issue is a 2013 law requiring the agency to write the rule
on sleep disorders, rather than handling them through guidance to medical examiners as it has in the past.
In October, the congressmen who wrote the law, Reps. Larry Bucshon, R-Ind., and Daniel Lipinski, D-Ill., warned the
agency that some trainers are giving medical examiners incorrect information.
They said the agency should tell its approved training organizations not to follow any specific steps with respect to
sleep apnea testing and treatment.
In his November 23 response to Lipinski and Buschon (copy
on right), Darling said the agency gives training organizations a list of topics they must cover in their courses.
The agency does not prohibit the organizations from presenting more information about sleep apnea than was available
in a guidance posted in 2000, Darling said.
He said the agency will send a bulletin to examiners and
training explaining that current rules and advice should not
be used as guidance.
“FMCSA will encourage medical examiners to explain to
drivers the difference between actions based on the current
regulations and advisory criteria versus actions based on the
medical examiners’ professional judgment,” he said.
