I.
Whether the Section 218 of the West Bengal Municipal Act, 1993 provides
that Board of Councilors of the concerned Municipality can take steps to
demolish the unauthorized structure, can the concerned authorities
violated the aforesaid provision laid down in the said Act without taking any
steps against the complain lodged re3garding unauthorized construction?

The humble petition of the petitioner
abovenamed most respectfully-
SHEWETH:-
1.
That the petitioner is a Citizen of India and has been residing in the
aforesaid address given in the cause title.
2.
That on 29th May,1995 one Sikha Ghosh of Sideshwar Bazar, Tali Khola,
P.O. Birati, Kolkata-700051 by a registered deed of conveyance duly
transferred a plot of land being Dag No.811, C.S. Khatian No.317 and Hal
Khatian No.636 under mouza Birati, measuring of land more or less 1 Cottah
3 Chittak and 65 sq.ft. of land in favour of the petitioner and thereafter on
29th November, 1995 one Naresh Ranjan Ghosh of Sideshwar Bazar,
Talikhola, P.O. Birati, P.S. Nimta, Kolkata-700 051 by a registered deed of
conveyance duly transferred a plot of land being DagNo.811, C.S. Khaian
No.317 and Hal Khatian No.606 under mouza Birati, measuring of land more
or less 2 Cottahs and 36 sq.ft. of land in favour of the petitioner.

Xerox copies of the Registered Deed of Conveyance executed as
29.05.1995 and 29.11.1995 in favour of the petitioner are annexed hereto
and marked as Annexure "P-1" collectively.

That thereafter the petitioner duly mutated his name before the North
Dum Dum Municipal authorities as owners in respect of aforesaid plots of
land in question and paying taxes to the said Municipal authorities in respect
of aforesaid plot of land and the said Municipal authority duly received the
same by granting receipts.
Xerox copy of one of the Tax receipt duly granted by the said
Municipal authority in respect of payment of taxes of the aforesaid plot of
land of the petitioner is annexed hereto and marked as Annexure "P-2".

That the petitioner has been possessing in the said plot of land as
owners of the land and paying the taxes and rents to the North Dum Dum
Municipal authority and the concerned Government authorities as owners of
the aforesaid plot of land.

That all on a sudden one Biswanath Dutta, one of the relative of the
petitioner most illegally started a construction on the aforesaid plot of land
of the petitioner though he was not the owner or co-sharer of the aforesaid

plot of land and running his business in the name and style of Cream-Son
Enterprise.

That the Section 203 of the West Bengal Municipal Act 1993 provides
inter-alia -
"No piece of land shall be used as a site for the erection of a building
unless such site has been so approved [on payment of a fee at such
rate as may be prescribed, and] within the prescribed period, and no
building shall be erected unless a building plan has been sanctioned
for such execution [on payment of a fee at such rate as may be
prescribed, and] in accordance with the provisions of this chapter and
of the rules and the regulations made under this Act.
Provided that no piece of land shall be approved for the
erection of a building and no building plan shall be sanctioned unless a
certificate from the competent authority as defined in clause (d) of
Section 2 of the Urban Land (Ceiling and Regulation) Act, 1976 (33
of1976), to the effect that there is no objection to the transfer of the
land under sub-section (3) of Section 5 of that Act, has been submitted
along with the application for sanction of building plan under the rules
made under this Act;

Provided further that the competent authority as aforesaid
does not issue the certificate within three months from the date of
application for such certificate, it shall be presumed that the "no"
objection certificate" has been issued by it and no further reference to
it shall be necessary".

That the Section 218 of the West Bengal Municipal Act, 1993 provides
inter-alia-
"If the Board of Councilors is satisfied —
a) That the erection of any building —
i)
Has been commenced without obtaining sanction or
permission under the law, or
ii)
Is being carried on or has been completed otherwise than
in accordance with the particulars on which such sanction
or permission was bases, or after such sanction or
permission has been lawfully withdrawn, or
iii)
Is being carried on or has been completed in breach of
any provision contained in this Actor in the Schedule or in
any rules or regulations in this behalf, or

b) That any building or projection exists in violation of any condition,
direction or requisition lawfully given or made under this Actor the
rules as the regulations made thereunder, or
c) That any material alternation of, or addition to, any building has
been commenced or is being carried on or has been completed in
breach of any provision contained in this Act or the Schedule or in
any rules or regulations in this behalf, it may, after giving the
owner of the building a reasonable opportunity of being heard
make an order directing that such erection, alternation, addition or
projection, as the case may be, or so much thereof as has been
executed unlawfully, be demolished or altered and, upon such
order, it shall be the duty of the owner to cause such demolition or
alternation to the satisfaction of the Board of Councilors within
such period as may be fixed in this behalf. In default, such erection,
alternation, addition or projection, as the case maybe, maybe
demolished or altered by the Board of Councilors at the expense of
the said owner.
(2) The procedure relating to the opportunity of hearing to be given to
the owner of the building under sub-section (1) shall be such as
maybe prescribed.

(3) An appeal against an order made by the Board of Councilors in this
behalf shall lie within the [court having jurisdiction].
[(4)******1
(5) Notwithstanding anything contained in the foregoing provisions of
this Section or elsewhere in this chapter, if the Chairman-in-Council
is of opinion that immediate action is necessary in respect of any
building being constructed, or any work being carried on, in
contravention of the provisions of this Act it may, for reason to be
recorded in writing, cause such building or work to be demolished
forthwith."

That on 12th January, 2015 the petitioner made a demand for justice
through his learned Advocate Mr. Manash Sen to the Chairman of the North
Dum Dum Municipality stating inter-alia all the facts aforesaid and it has
been specifically stated that the petitioner is a non-resident Indian who at
present use to live at Canada and he came to know that one Biswanath Dutta
most illegally erected a building on the aforesaid plot of land of the
petitioner and he is not the owner or co-sharer of the aforesaid property and
without taking any prior permission from the concerned Municipal
authorities most illegally erected the building unauthorisedly. It has been
requested to the concerned Municipal authorities to take immediate steps to

demolish the unauthorized construction of building which has been illegally
constructed by one Biswanath Dutta.
Xerox copy of the said Demand for Justice made by Mr. Manash Sen,
Learned Advocate on behalf of the petitioner dated 12.01.2016 is annexed
hereto And marked with the letter "P-3".

That the petitioner states that inspite of aforesaid complain lodged on
behalf of the petitioner, the respondents authorities did not take any steps
to demolish the unauthorized construction as per relevant Rules of the West
Bengal Municipal Act, 1993.

Being Ord aggrieved by and dissatisfied with the illegal and arbitrary
action on the part of the Respondents authorities not taking any steps to
demolish the unauthorized construction in respect of the premises being
Municipal Holding No.280(68) M.B.Road, P.O. Birati, P.S. Nimta, Kolkata700 051, District North 24-Parganas, the petitioner begs to move this
application under Article 226 of the Constitution of India on the following
amongst other :-
GROUNDS
I.
For that the petitioner being the owner of the plot of land being
Municipal Holding No.280(68) M.B.Road, Birati, Kolkata-700 051 but

without any consent and/or without making any application of the
petitioner to obtain prior permission for construction of building in
respect of land in question, the concerned Municipal authorities duly
allowed one Biswanath Dutta to ovent
building
building on the premises of the
petitioner unauthorisedly.
For that according to relevant rules of West Bengal Municipal Act,
1993 it is necessary to obtain approval of building plan from the
concerned Municipal authorities before construction of building but
the concerned Respondents authorities most illegally allowed one
Biswanath Dutta to construct building unauthorisedly.
III.
For that the Respondents authorities ought to have take steps on the
basis of the complain lodged by the petitioner in respect of
unauthorized construction of the building in question but instead of
doing so the Respondents authorities rather allowed one Biswanath
Dutta to continue his illegal activities.
IV.
For that entire acts and/or actions on the part of the Respondents
authorities are illegal, arbitrary, malafide and contrary to the statute
and violation of principle of law of natural justice.

11. That the petitioner states that unless an order be passed directing the
concerned Respondents authorities particularly the Respondents nos.2 to 4
to take immediate steps to demolish the unauthorized construction in
respect of premises being Municipal Holding No.280(68) M.B.Road, P.O.
Birati, P.S. Nimta, Kolkata-700 051, District North 24-Parganas, the petitioner
will suffer irreparable loss and injury which can not be compensated by any
other means.

That the petitioners state that save and except this application no
other application on the self same cause of action has been moved on behalf
of the petitioner before this Hon'ble Court or any other court earlier.
13.
That the records and documents pertaining to this application are
lying outside the original side jurisdiction of this Hon'ble Court.
14.
That the application is made bonafide for the interest of Justice.
In this circumstances stated above your
petitioner most humbly and respectfully
prays before your Lordships for the
following orders :-
a) A Writ of and/or in nature of
Mandamus commanding the respondents,

their servants, agents associates and each
one of them to take immediate steps to
demolish the unauthorized construction in
respect of premises of the petitioner being
Dag No.81, C.S. Khatian No.317, Hal Khatian
No.636 under Mouza Birati measuring of
land more or less 3 Cottahs 4 Chittaks 28
sq.ft. situated at 280(68) M.B.Road, P.O.
Birati, P.S.Nimta, Kolkata-700 051, District
North 24-Parganas;
b)
A Writ in the nature of Certiorari
directing the Respondents, their servants,
agents, associates to transmit all records
and documents pertaining to this
application before this Hon'ble Court so that
the conscionable justice may be
administered by quashing the same;
c)
Rule NISI in terms of prayers (a) and
(b) above;

d) Ad interim order of injunction
directing the respondents particularly the
respondents no.2 to 4 to take immediate
steps to demolish the unauthorised
construction which was constructed on the
plot of land being Holding No.280(68)
M.B.Road, P.O. Birati, P.S.Nimta, Kolkata700 051, District North 24-Parganas;
e)
Costs pertaining to this application;
g)
Pass such other further order or
orders as to Your Lordships may deem fit
and proper.

Dear Sir,
Under instruction and authority on and from my aforesaid client I do
hereby give you following information for taking necessary legal step as per
law.
i) That my Client is the absolute owner of the vacant land measuring
more or less 3 cottahs 4 chittacks 28 sq.ft. within your Municipal
Jurisdiction being Holding No.280(68) M.B.Road, Ward No.18.
ii) That my Client is a non-resident Indian who at present use to live at
Canada.
That while my Client was going to Canada then he verbally entrusted
authority upon one Biswanath Dutta to look after the aforesaid
property and categorically asked not to erect any structure imparing
the plants which remained on the aforesaid land.
iv) That it is my Client's practice, come to India every year. But when he
had come in the year 2013, he saw the said Biswanath. Dutta had
erected structure and privy without my Client's permission as well as

your permission. As per u/s 197(1)(F) of The West Bengal Municipal
Act building means cover an open space between walls or building
to the extent of the structure formed by the roofing or covering of
such space and u/s 203 of The West Bengal Municipal Act it is
incumbent duty of taking permission from the Municipal Authority
for erection of building. But being owner of the holding, my Client
never took permission from you. So the construction lying and
situated at the Holding No.280(68) M.B.Road is illegal one.
That it is for your kind information that in spite of cancellation of
trade license as well as verdict of stop business of Creamson
Enterprise Vide Memo No.NDDM/ License/232 dt.20-01-2015 of
Holding No.280(68) M.B.Road is not being complied with.'
Under the above circumstances, I on behalf of my Client cordially
request you to demolish the illegal construction lying and situated at
Holding No.280(68) M.B.Road and also confiscate the instrument and other
things associate with Creamson Enterprise.
