MEMBERS NEEDED TO PARTNER WITH LOCAL SCHOOLS ON ‘SIMULATED
WORKPLACE’
The CAWV has partnered with the West Virginia Department of Education on a new initiative,
“Simulated Workplace.” The new program is designed to set up workplace environments in
several career and technical centers throughout the state that have a direct connection to the
construction industry. Its vision is to transform students into work-ready employees.
“The CAWV Board of Directors voted unanimously at our October meeting to become an active
supporter of “Simulated Workplace,” said CAWV President Phil Weser, March-Westin
Company, Morgantown. “CAWV members have expressed concern over finding qualified
people to augment our retiring workforce. But first, we must get young people interested in a
career in construction.”
In a Simulated Workplace, traditional classrooms are crafted to emulate company environments,
practices and expectations. An important goal of the program is to provide students with an
understanding of all aspects of a business and how their success leads to the company’s
profitability. “Our role will be to evaluate the various construction career workplaces to
determine whether or not the processes and curriculum being delivered in the classroom will
result in quality employees,” said President Weser. “This is our opportunity to assist in
developing better training centers that will build our future workforces. I encourage all members
to get involved with Simulated Workplace in the schools in their area.”
Members who participate will be asked to view a short on-line training session to learn how to
use their expertise to rate the program and then spend one day at the school evaluating that
school’s program. It would be good to have three to five members per school. Attached to this
week’s Newsletter is a brochure on how members can become involved in Simulated
Workplace, including a map showing which career and technical centers are participating and a

CAWV TO PARTICIPATE IN GOVERNOR’S WORKFORCE DEVELOPMENT COMMITTEE
The West Virginia’s Board of Education’s “Re-imaging Instructional Time Committee,” chaired
by Gov. Earl Ray Tomblin, met this week at the State Capitol. Gov. Tomblin invited the CAWV
to participate in the committee to get input on the development of a construction-related
curriculum at state vocational education schools and community and technical colleges. The
Governor noted that with the recent announcements of a possible cracker plant in Wood
County, the Carbonyx plant in Jackson County, the Piertro Fiorentini plant in Weirton and the
planned expansion of the Sogefi auto parts plant in Wayne County, skilled construction workers
and engineers will be in high demand. The Governor stated he thinks other industries will be
interested in moving to West Virginia to serve the cracker plant which will create even more
demand for skilled workers. Also at the meeting were the deans of WVU, WVU-IT and Marshall
University engineering schools, the chancellor of the state’s community and technical colleges,
and State Education Superintendent James Phares, along with representatives of labor and
economic development agencies.
The purpose of the committee is to get high schools, career and technical schools, two-year
colleges and four-year universities to work with industry to make sure the curriculum being
offered will result in strong workforce for the future. Governor Tomblin charged the committee to
develop relationships with companies that are doing business or expanding in West Virginia to
get a better grasp on what their workforce needs are now and what they will be in the near
future. “We must develop a plan to meet those needs in order to continue attracting businesses
to West Virginia,” the Governor stated.
“With the recent announcement from Odebrecht on plans to build a cracker plant in Wood
County, plus the other announced investments, we need to focus on replacing our current
workers and preparing for the possibility these developments will create thousands of
construction and permanent jobs in spin-off industries for years to come,” said CAWV President
Phil Weser. “The CAWV stands ready to help develop the curriculum and assisting with handson, real-world training in order to aid in developing a skilled workforce,” he said.
OSHA 10-HOUR BILL INTRODUCED IN LABOR COMMITTEE
The Labor and Worker Safety Issues Committee meeting at this month’s legislative interim
meetings introduced a draft of a bill to require all construction workers to complete the OSHA
10-Hour safety training program before working on a project. The bill, which has been defeated
in the last three legislative sessions, has been debated since the creation of the Labor
Committee in June. The draft has been modified from previous years. The proposed bill
requires all employees on a construction project over $50,000 to complete the OSHA 10-Hour
course within 10 days of employment. Previous bills dealt only with publicly-funded construction
projects and the employee had to complete the course prior to starting on the job. The new bill
exempts single unit family home or any multi-family units two stories or less in height. This bill
requires records of employees’ training to be maintained in the employer’s business office rather
than submitting the records with the certified payrolls. The Commissioner of Labor may assess
a civil penalty of not less than $100 nor more than $1,000 to any person or business who
violates the training requirements. Previous bills allowed the commissioner to assess a civil
penalty of up to $3,000, per day, for noncompliance. If the legislature passes the bill, this
version states that for the first year after the legislation is enacted, completion of the 10-Hour
safety program shall occur within 90 days of employment at the site in order to give contractors
time to get their workforce trained. It is anticipated the Labor Committee will introduce the bill in
the 2014 legislative session. The CAWV has opposed the bill in the past because many
contractors use site-specific safety training instead of the generic OSHA 10 program. Previous
bills have also been onerous to contractors as it relates to fines and enforcement. Members

In other action during the December interim meetings, Marvin Murphy, assistant deputy
secretary of the WV Division of Highways, spoke before the Select Committee on Infrastructure.
He presented priority lists for Category 1 and 2 bridge replacement projects. He also presented
the bridge repair list. Legislators had a number of questions of how funding is divided among
the ten highway districts. Mr. Murphy noted lane miles make up the biggest portion of funding
followed by historical data. Lawmakers questioned how they could get their requests for road
maintenance and repair addressed. Mr. Murphy stated contacting the district is the most direct
route, although legislators said they at times they had to call the central office to get an answer.
Subcommittee A of the Government Organization Committee, which has been discussing state
purchasing procedures, presented a draft bill to modify purchasing policies. The draft does not
appear to alter procedures for procuring government construction contracts. Judiciary
Subcommittee B heard a presentation from Miss Utility of West Virginia on expanding the onecall notification system for other underground pipeline facilities, especially those associated with
horizontal well drilling. This was the last interim meeting of the year. The 2014 Regular
Session of the West Virginia Legislature convenes Wednesday, January 8, at noon. The
Governor’s State of the State address is at 7:00 p.m.
MAKE PLANS NOW TO ATTEND TRANSPORTATION DAY - JANUARY 9
West Virginians for Better Transportation (WVBT) will be hosting “Transportation Day at the
State Capitol” on Thursday, January 9, 2014. Plan to join with others interested in the future of
West Virginia’s transportation system and show support for a long-term solution for the state’s
roads, bridges and highways. Members are urged to gather at the state Capitol, meet with local
legislators and help educate lawmakers about the challenges facing transportation across the
state.
A limited number of exhibit spots will be available on the Senate Upper Rotunda area of the
West Virginia Capitol as part of Transportation Day. There is no cost to exhibit, but preregistration is required (these are available on a first-come, first reserve basis). A registration for

CONTRACTORS “CAN” HELP THIS HOLIDAY SEASON
Monday, December 16, radio station WQBE, in conjunction with Kroger and other partners, will
be launching the annual WQBE/Kroger Food Drive to help eradicate hunger this holiday season.
The Union Mission has a goal to collect food for as many as 40,000 needy people ahead of the
Christmas holiday. Food will be collected through Friday, December 20, at area Kroger Stores.
The food collected will be distributed by Union Mission on Saturday, December 21, as they
stage a massive food distribution across 38 outreach sites in 19 counties. Food boxes with
enough food to last several days will be handed out to families at a time when over 17.5% of
West Virginians are living in poverty.
Members from IVS Group and the CAWV will be on hand Monday morning starting at 6:00 a.m.
at the Dunbar Kroger along with WQBE radio station personalities who often acknowledge
contributions on the air. Stop by and make a difference in the lives of needy West Virginia
families. Members unable to make it to a Kroger location can drop off donations at the CAWV
headquarters.
CANSTRUCTION PLANNING MEETING, THURSDAY, DECEMBER 19
CAWV Young Contractors Chairman Erich Reggi has called a meeting at the CAWV
Headquarters on Thursday, December 19, at 12:00 p.m. to begin planning for the 2014
Canstruction competition. The purpose of the meeting is to organize the CAWV’s team and
choose a structure to build. The event is scheduled to take place during The Home Show at the
Charleston Civic Center with Build Day on April 5. For additional information, contact Shannon

We are saddened to report the passing of long-time member James Richard "Dick" Meeks, 72,
past president of Brewer and Company of West Virginia. He was with the company 50 years.
The family will receive friends Tuesday, December 17, from 2:30 p.m. to 4:00 p.m. with a short
service beginning at 4:00 p.m. at Snodgrass Funeral Home in South Charleston. In lieu of
flowers, the family asks that donations be made to Kanawha Hospice Care, 1606 Kanawha

WV DESIGN-BUILD BOARD APPROVES WVU BASEBALL STADIUM TECHNICAL
EVALUATIONS
The West Virginia Design-Build Board met today to consider the evaluations of the West
Virginia University Baseball Stadium project which is being procured under the design-build
method. WVU received responses for the Invitation for Qualifications (IFQ) for design-build
teams. They were: Mascaro, Massaro, Gilbane, P.J. Dick, ABEL and Astorino. Based on the
scoring, four firms were selected to submit proposals. They were: Astorino, Mascaro, P.J. Dick
and Gilbane. The technical review committee at WVU Thursday evaluated the four and
determined the Gilbane’s proposal had a missing portion that was required. The review
committee did not score Gilbane. The scores, which the West Virginia Design Build Board
affirmed are: Mascaro – 90.5; Astorino – 82; and P.J.Dick – 70.6.
Under West Virginia’s design-build statute, the owner shall publicly open and read aloud the
sealed cost proposals that met the minimum qualitative proposal score of 70. The lowest cost
proposed shall be assigned a score of 100. Other cost scores shall be arrived at by the following
formula: (Lowest cost proposed divided by cost being evaluated) x 100 = Cost Score. To
determine the successful design-build proposal, the total of the weighted qualitative and cost
scores shall be added to arrive at a total score. WVU will open the cost proposals Monday.
The Design Build Board is meeting Thursday, December 19, to review the costs. After that,
WVU will award the project.

been appointed to the board to represent the architectural community. He replaces Don
Gombert who recently passed away.

Christmas Safety
“Merry Christmas” everyone. Christmas is here in a few short days and there are lots of
activities going on which can act as distractions to our work. “Did that present we order arrive on
time?” “Did we forget to invite anyone to Christmas dinner?” “What was I supposed to bring to
that Christmas party?”
It is a challenge to stay focused at work during this time of year. So, this is when it is
especially important to take four seconds for safety. When you find yourself working away
and your thoughts running wild with all the plans and activities of Christmas, STOP, take those
four short seconds to look around and come back to the present moment. Look for a hazard in
the middle of your activity. Are you standing on a ladder? Are you in an awkward position or
about to trip on something lying on the floor? Hazards do not go away. Only our awareness of
the hazards goes away. And when we ignore hazards, we tend to get injured.
Christmas injuries tend to put extra stress on everyone. Imagine yourself sitting around the
Christmas table in a leg cast because you fell off a ladder or tripped over something.
Unfortunately, these stories are more common that all of us might admit. Injuries at Christmas
seem to magnify how many people are affected by an injury to one person. How many people
count on you each day to come home safely? If you add them all up you might be surprised.
Taking four seconds for safety may seem unimportant to you yet it is the one activity, the one
action you might take during a busy and distracted day which will have the most benefit in
keeping you safe. Think of it as your Christmas present to yourself. In fact, you can think of
each of those people who would be affected by an injury to you every time you take four
seconds to refocus.
Think about this when you are about to drive away to some gathering this Christmas. The noise,
the excitement, the distraction! Take a moment, take a big breath, count slowly to four, then
drive away. Chances are that you will arrive safely once you focus for those four seconds.
Again, “Merry Christmas” to everyone from the CAWV staff. May the Blessings of this season
warm the hearts of you and your families.

U.S. HOUSE CONTINUES WORK ON WIFIA MEASURE THAT INCLUDES
REAUTHORIZATION OF THE CLEAN WATER ACT
The House Transportation and Infrastructure Committee continues to work on a WIFIA bill that
will include language to reauthorize the federal Clean Water Act. House members are
developing the WIFIA bill in response to the Senate’s WIFIA provisions contained in the Senate
Water Resources Development ACT (WRDA) that is currently subject to House and Senate
Conference negotiations on the WRDA measure. Clean Water Construction Coalition, of which
CAWV is a member, has been actively working with Congressional representatives and
Committee staff to include specific language in the House WIFIA bill that will address Coalition
concerns with the WIFIA component of the Senate WRDA measure.
The following are the coalition’s specific concerns:
(1) All projects should be funded at 100% Federal share. Given the fact that this is a loan
program whereby the Federal Government will not only be repaid, and repaid with interest, but
will also reap the environmental and economic benefits that these projects bring to the nation, a
100% Federal share should apply to all projects that would be eligible for WIFIA funding. Some
versions of WIFIA legislation limit the Federal share to as low as 49%.
(2) There should be flexibility in setting loan interest rates. Most versions of WIFIA proposals
specify that the rate of interest charged shall not be less than the prevailing Treasury rate. While
we support that as a general rule, we request that there also be language included giving the
administrator of the WIFIA program the flexibility to set rates at lower levels should a given
project meet certain criteria such as the return on investment that it brings.
(3) Any total project cost de minimus requirement should be eliminated. Most versions limit
WIFIA funding to projects with a total cost of at least $20 million. Many projects do not reach
that threshold and should not be penalized by the imposition of some arbitrary number that
undercuts potential public policy gains.
The Clean Water Construction Coalition representatives will continue to work with House
members on this issue.
WATER SYSTEM REPLACEMENT, GLEN HAVEN/ CAVALAND, JEFFERSON COUNTY

WVDOH 2013 YEAR-END TOTAL CONTRACTS
The West Virginia Division of Highways let to bid 338 projects totaling $348.9 million in 2013. This
number compares to the 2012 figure of 360 projects totaling $452.7 million and the 2011 figure of 427
projects at $508.7 million. This represents a 23 percent drop in the total dollars obligated in 2013
compared to the previous year. The CAWV figure may be different than WVDOH’s total since the division
incorporates emergency work, WVDOH employee performed construction and purchase order contracts in
their construction totals. The CAWV data tracks low bids on contracts let to bid, which is a good
barometer for measuring how much work is actually performed by contractors. This data is always
available monthly in the CAWV Highway Bulletin or on the website at www.cawv.org.
Below is a breakdown of construction since 2000. The highway program peaked in 2008 at $646 million
and has averaged over $500 million except for the past two years. The Governor’s Blue Ribbon
Commission on Highways has been looking at measures to provide additional funding for the WV Division
of Highways.

DOT SECRETARY PROMOTES PPPs ON DECISION MAKERS
Secretary of Transportation Paul Mattox, Jr., P.E. was a guest on State Journal’s Decision Makers
December 8 and talked about Public Private Partnerships (PPPs) as a method to fund new construction
projects statewide. He responded to recent new articles that Route 35 was about to begin construction as
a PPP project. Secretary Mattox noted Governor Tomblin’s PPP bill that passed this year’s legislative
session “gives the WVDOH a lot of flexibility” to utilize PPP for transportation projects. The secretary said
he views PPPs as a procurement tool instead of as a financing mechanism. “We can use PPP to procure
big, expansive projects by starting them now and pay the contractors back over time.” He told viewers the
DOH would spell out up front to bidders how much they would be paid over a set period of time, perhaps
three to five years. Secretary Mattox said the division is working with a PPP advisory group to determine
how the process would work. (The WVDOH has hired the New York law firm, Allen & Overy, LLP, as its
advisor.)
Bray Cary, president and CEO of West Virginia Media Holdings who operates The State Journal and
various TV stations, noted the work of the Governor’s Blue Ribbon Commission is trying to figure out how
to fund roads but has repeatedly criticized any plan that calls for tax or fee increases. While he said he
would like to see the final 14.5 miles of Route 35 upgraded to four lane, Cary cautioned that the state
cannot be “spending tomorrow’s dollars.” “There has to be diligence,” he said. “We need to take a
practical approach because we cannot be spending future dollars today.” Members can listen to the full

ARTBA, CHAPTERS, MEMBERS PRESENT DBE CONCERNS TO U.S. DOT
Several ARTBA and AGC of America chapters and contractor-members appeared at the U.S. Department
of Transportation's "listening session" on proposed changes to the Disadvantaged Business Enterprise
(DBE) program. Among other issues, several outlined their concerns over proposals to require prime
contractors to include full information on DBE subcontractors with their bids. Rich Juliano, ARTBA's senior
vice president for strategic initiatives, previewed the results of a recent contractor survey showing that
many of the Department's proposed rule changes would add significant new costs to bids. In addition, 42
percent of survey respondents expected to bid on less federal-aid work if these revisions take effect. The
Department will publish a transcript of the listening session in the near future. It is also accepting written
comments on the proposals through December 26.
