NOTICE TO BIDDERS
Dear Bidder,
We welcome you to our auction house. Please note the points below to assist
you with the registration, bidding and payment at our auctions.
REGISTRATION FOR BIDDING:
If you are registering with us for the first time or have not bid successfully in
the past, we require a deposit of HK$50,000. If you intend to bid more than
HK$200,000 the deposit may be higher. The deposit will be deducted from your
invoice should your bid be successful. If you are unsuccessful, your deposit will
be returned by the same means by which it was paid. In addition we will ask for
your bank and trade references.
We encourage new clients to register for bidding at least 48 hours prior to the
commencement of the sale to allow sufficient time to process the registration.
Prior to the auction, some lots may be designated as “Premium Lots”, which
means a deposit may be required before placing a bid on the item for sale.
Information will be posted on our website in such an event.
Spink have the right at our own discretion to refuse admission to our premises,
attendance at an auction and decline submitted bids.
BIDDING METHODS:
In person
You will be given a registration form that you will need to fill in providing your
up to date address and contact details. Please always have your photo ID with
you and, if you are bidding on behalf of a company, your business registration.
ID information is collected for registration purposes only and will be kept confidential.
Submitting a bid form by email/post/fax
Again please always provide your full up-to-date contact details together with
the lot numbers and the amounts up to which you would like us to bid on your
behalf exclusive of Buyer’s Premium/tax/postage. Should you not receive our
email confirmation of your bids having been received please call our office to
make sure they have been received and processed.
Submitting bids via our website
To submit bids via our website www.spink.com you need to be registered and
logged in. You can leave bids via this method up to 3 hours before the commencement of the sale.
Bidding live on Spink Live
You must be registered and logged into our website www.spink.com. The live
bidding applet can be accessed from one week prior to the sale via the Spink
Live button on our homepage. You will see ‘Auction not yet started’ message
that will be replaced about one hour before the commencement of the sale
with the live feed. You will be able to see and hear the auctioneer live during
the sale.
Telephone bidding
We reserve this service for bidding on lots of value exceeding HK$10,000.
Bidding via agent
Your agent has to inform us prior to the sale that he or she will be bidding on
your behalf, and the usual sale registration has to take place. He or she has to
provide a letter of authorisation signed by you.
Please place your bids following our usual bidding increments published in the
Terms and Conditions for Buyers.
Please note that commission and telephone bids are undertaken subject to
other commitments at the time of the sale, and the conduct of the auction may
be such that we are unable to bid as requested. Since this is undertaken as free
service we cannot accept liability for failure to make a commission bid.
Buy bids and plus one bids will not be accepted.
Please make yourself aware of any Saleroom notices published on lots you are
interested in bidding on.
EXTENSIONS (STAMPS ONLY):
Prospective buyers, who wish to obtain an expert opinion on any lot other than
a mixed lot or lot containing un-described stamps, are requested to notify Spink
in writing no less than 48 hours before the commencement of the sale. Reason
why such opinion is required must be stated together with the identity of an
expert for Spink to consider such a request.
Extensions requested on account of condition will not be accepted for expert
opinions.
PAYMENT METHODS:
Payments should be made by the registered buyer and not by third parties,
unless it has been agreed upon at the time of registration that you are acting as
an agent on behalf of a third party.
Payments are due within seven days after the date of the sale unless it has been
confirmed to you in writing since July 2013 that you are an approved credit
client. If payment is not received by Day 35, the sale will be cancelled. If you are
also a vendor in the sale, please note offsets are not available.

COLLECTION OF LOTS AND SHIPPING:
All lots have to be paid for in full before they can be collected or shipped. If an
invoice is partly paid no lots will be released from that invoice.
It is the responsibility of the buyer to be aware of any import duties or import
restrictions in the final destination. Spink will not accept return of any package
in order to avoid these duties.
Please be aware that your purchased lots will be at your risk in all respects
from the time of collection or the expiry of seven days from the date of sale,
whichever is sooner.

Did you know? – Grappa & Eaux-de-Vie
Grappa & eaux-de-vie primarily serve as “digestifs”, or after-dinner
drinks, in theory to aid digestion. Grappa is a spirit from Italy made
of grape pomace brandy, pomace being the solid remains of grapes
after pressing for juice, notably in the wine-making process. Eauxde vie-are fruit brandies in general and can be produced across the
world. German Schnaps, French Poire Williamine, French Calvados
are some examples of eaux-de-vie.
Often the work of very small producers and not easily available
outside their region of origin, good grappas and eaux-de-vie are often
the pride of spirits aficionados and collectors across the world.

Did you know? – About Romano Levi
In the land of big Italian red wines – Piemonte – also lies one of the
most mythical grappa distillery: the Levi Serafino Distillery.
Romano Levi was an orphan who lived a reclusive life in Neive,
Piemonte where he dedicated his life to grappa, and to watching the
sunset every single evening! He meticulously produced very few
bottles every year (the rumour speaks about less than 300 bottles a
year) in a very traditional manner.
Romano Levi personally painted by hand each and every label for
his bottles. His stick characters like "la donna selvatica" (the "wild
woman") became symbolic of the Levi grappa.

The Levi grappa was of high quality and scarce, and not easy to
get hold of! Rumor has it that Romano Levi denied giving bottles to
sport celebrities or food and wine legends, when they showed up at
his door.
Romano Levi sadly passed away in 2008. Today, the Levi distillery
is still in operations but Romano had no children and grappa
connoisseurs all agree Romano’s legacy has long gone. Today, the
labels are photocopied and colored in.
An artisan and an artist, Romano Levi is widely remembered as The
Grappa Legend. Each bottle pre 2008 is one of a kind and have become
collectors’ pieces, to be proudly taken out at the end of a great dinner
with friends.

Did you know? - About Trinidad’s Caroni rums
In the 18th century, the Caroni Sugar Factory was the largest and most productive holding in Trinidad. In 1918 the Caroni distillery was established,
dealing with the distillation and bottling of rum and became quickly renowned throughout the world for producing one of the finest heavy rums,
receiving high praise from the British Navy.
In 2000s though, the closing of the nearby state owned sugar refinery resulted in the gradual decline of the Trinidad sugarcane production and it
was only a matter of time before the Caroni distillery was shut down shortly after. With the last few bottles still available in the market survives
the legend of Caroni.

Did you know? – The ‘Lost’ Distilleries
In the 1800's there were close to three hundred distilleries in
Scotland. Like any other industry, however, the category saw a huge
consolidation process over time, with socio and economic factors
leading to regular mergers and closures.
The poor socio-economic climate of the inter-war period in Europe,
combined to a lesser extent to the prohibition era in the USA, saw
close to 70 distilleries closing or remaining silent for decades. In the
80’s again, sales of whisky drastically dropped, inevitably causing a
new wave of about 25 distilleries closing.
The stock of few of these closed distilleries was sold to collectors or
independent bottlers, which has made it possible to still find some
stock available today, mostly for the delight of whisky aficionados and
collectors.
It is very difficult, however, to know how much stock from each of

Established in 1819, Brora was initially known as Clynelish. Enjoying
immense popularity from its inception, it wasn’t used in the production
of blended scotch on the contrary to most other malts back then, but
was sold instead only to private customers!
Following two periods of silence in 1931-38 and 1941-45, the demand
finally went up again post WWII, notably driven by very high orders
from blenders. A second Clynelish distillery was opened, under the
same name, this time to produce heavily peated whisky for blending
purposes.
For regulation purposes, the original distillery was forced to close
down in the 60’s (the date is uncertain) before re-opening under the
new name Brora. Brora eventually closed down for good in the whisky
slump of the 1980’s.
Brora’s malts produced between 1969 and 1983 are extremely soughtafter. So are Diageo (Brora’s last owner) releases of Brora 30 Year
Old as it is known that their stocks are certainly drying up very fast…

BANFF, SPEYSIDE
Did you know? - Banff
The Banff industry was founded in 1863 on the site of an old Banff
distillery dating 1824. On May 1977, the production facilities of
the young distillery were devastated by fire (the warehouse luckily
remained unscathed). Its owner, however, wasted no time, started
reconstruction immediately and even expanded the distillery as
he was eager to meet the huge demand increase the industry was
experiencing back then. He also invested in his own fire engine after
the reconstruction, which secured uninterrupted production of whisky
for Banff for a few decades.
Banff was acquired by the Distillers Company Ltd (‘DCL’) in 1932
and shut straight after. The premises were bombed by the Germans in
1941. Post WWII, however, the distillery was repaired and re-opened.
Despite a massive explosion, it was continuously operational until
1983, when it was finally closed, together with ten other malt whisky
distilleries owned by DCL.
As of today, nothing remains from Banff as the last remaining
warehouse was destroyed by another fire in 1991.

The Glenury distillery was established in 1825. In 1835, the distillery
was able to secure permission from King William IV to attach the
epithet 'Royal' as a suffix to the name, a privilege shared only by two
other distilleries: Royal Lochnagar and Royal Brackla.
The distillery was silent in 1852-58, 1938-1953 and in 1983 before
being finally closed for good in 1985. The distillery was demolished
a few years later.
Glenury Royal malts are appreciated for their spiciness and fruitiness.

Sometimes also found under the name Ayrshire, after the council area
of Scotland in which Girvan is found.

Ladyburn was in fact produced from a set of pot stills in a corner of
the Girvan grain distillery in Lowlands. Ladyburn was operational for
9 years only (from 1966 to 1975).

Did you know? - Lochside
The Lochside distillery was established in 1957 only, when an 18th
century brewery was converted into a distillery by Joseph W Hobbs
who also owned some of Scotland’s flagship distilleries: Ben Nevis,
Bruichladdich, Glenkinchie, Glenesk, Benromach and Glenury Royal.
The distillery was closed in 1992 and dismantled a few years later.
Lochside’s whiskies mostly went to the production of blended
scotches, such as Sandy McNab, and hence, the only official bottling
of Lochside was a 10 year-old released in 1991, the year before the
distillery was closed, establishing the distillery’s character as sweet
and floral.

Established as a malt mill on Islay's south coast in 1825 and developed as a distillery from 1833, Port Ellen was first closed in 1929 before being reopened and expanded in 1967. In 1983, however, Port Ellen was closed again, but the whisky made in this 17 year window is considered by whisky
experts as some of the finest examples of Islay malts ever produced, with a high level of peatiness and a phenomenal complexity.

Gordon & MacPhail is an acclaimed independent bottler and distiller
of Scotch Whisky, founded in 1895 and located in Elgin in the northeast of Scotland. It is a family business owned by the Urquhart Family,
which has been bottling single malt whiskies for over 115 years and
could very well be the oldest whisky blender & bottler in Scotland.
Whilst bottling under license for famous distilleries such as Macallan,
Glenlivet, Glen Grant, Linkwood and Mortlach, they began to select
and fill their own casks - almost always Spanish oak, ex-sherry casks
- at these and other distilleries, and to mature the whiskies for much

Did you know? - Rosebank
Established in 1840 on the banks of the Forth and Clyde canal between Edinburgh and Glasgow, Rosebank was one of the founding members of
the Scottish Malt Distillers Ltd (later to be taken over by Distillers Company Limited in 1929). It took its name from the roses which grew along
the side of the canal.
Silent first in 1862-64, then in 1917-1919, the distillery produced steadily until it was dismantled in 1993 for commercial reasons. When Diageo
sold the site, the deeds stated that it could not be used for distilling until 2017. Rosebank is generally acknowledged as the best Lowlands malt
known for low productions and its traditional triple-distilled smooth floral style.
Recent independent bottlings of aged Rosebank malts have been blowing the myth within connoisseurs that Rosebank had to be consumed young
and are seeing their value quickly rising as the supply of maturing casks runs out.

Did you know? – Collectable Crystal & Ceramic Decanters
Recent trends seem to contradict French poet and novelist Alfred de Musset who said
“Qu'importe le flacon, pourvu qu'on ait l'ivresse.” (which translates by “The bottle
is not important as long as it gets you drunk.”). Indeed, the last few years have seen
multiple releases of special decanters in the spirit industries, notably for whiskies &
cognacs.
Strangely enough, whiskies do not have sediment and hence, there’s no real purpose
in decanting a whisky, other than a purely aesthetic one. In other words, a decanter is
simply a far more attractive and far more presentable vessel than the original whiskey
bottle. Crystal tends to be clearer than glass, allowing a person to see the whiskey's
tone and color more clearly; however, this has not lowered the connoisseurs’ taste for
ceramic decanters too.
For the last fifty years, crystal and ceramic decanters have become the preferred
vessels for the most special spirits editions, with famous spirits houses aiming at
the gift, the commemorative and the collectable markets by collaborating with the
most recognized decanter producers: e.g. The Famous Groose, Bell’s, Jim Beam
and Royal Salute with Wade (ceramics), LOUIS XIII de Remy Martin, Camus and
Johnnie Walker with Baccarat (crystal), or Hardy Cognacs and Macallan with Lalique
(crystal).
The bottle becomes precious by itself. These decanters indeed demonstrate the utmost
craftsmanship - often as much as the liquid they contain. They too depict a story.
Finally, they express rarity and are most of the time numbered.

Did you know? - Ardbeg
The Ardbeg distillery was officially established in 1815 although
unofficially production started in 1794.
It is located on the south coast of the isle of Islay, Scotland.
Ardbeg used to produce a very smoky malt until 1981 when the
distillery was mothballed. It resumed production in 1989 but has lost
his extremely smoky characteristics as it now uses malt produced by
the Port Ellen maltings, and not its own malting floors anymore. Since
its acquisition by Glenmorangie in 1997, Ardbeg revived its tradition
of very peaty single malts.
Arbeg is reportedly entirely sold as single malt which is unusual in the
world of whisky, where most of distilleries see part of their production
used in blends.
Ardbeg is now focused on no age statement bottling, which makes the
old Ardbegs new collectors’ pieces.

Did you know? - Bowmore
The Bowmore distillery was reportedly founded in 1779, which would
make Bowmore one of the oldest working distilleries in Scotland.
Since 1994, Bowmore is owned by the Japanese group Suntory.
While modern day Bowmore whiskies tend to be predominantly
smoky, some Bowmores released in the 1970’s and before have a much
lighter, more 'floral' style.
Since the 2000’s, Bowmore is one of the few distilleries which
regularly offer 'finished' expressions of their whisky, such as new
bordeaux and port finishes.

Did you know? - Bruichladdich
The Bruichladdich distillery was founded by the Harvey family in
1881 in Port Charlotte, Islay, directly opposite Bowmore, during the
'whisky boom' of the late 19th century. The Harvey family retained
ownership until 1929 when the distillery was mothballed. It changed
ownership a few times before finally being reopened and expanded in
the late 1960’s.
The distillery shut again in 1995 and was sold in 2000 to a consortium
of twenty five different shareholders that resumed operations in 2001
under the name 'Bruichladdich Distillery Co. Ltd.', including the
charismatic Jim McEwan (formerly of Bowmore). The new owners
also acquired a lot of maturing stocks that they carefully selected and
released with huge success.

Did you know? – Dalmore
The Dalmore distillery was founded in 1839. Dalmore was the first malt whisky ever to be exported worldwide as early as in 1870.
The distillery was closed in 1917 as it was requisitioned by the Navy for the production of deep sea mine. Strongly damaged by both a fire and an
explosion it was left in ruins in 1920, it resumed production in 1922.
The standard Dalmore 12 year old is recognized by all as an all-time favorite for a younger whisky expression; while older expressions are
extremely sought after by whisky aficionados and regularly break new records in auction.
Why the stag? The story dates back to 1263, the year an ancestor of the Clan Mackenzie, founders of the Dalmore distillery, saved King Alexander
III from the fury of a charging stag. In the recognition of this noble act the grateful King granted the Clan Mackenzie the right to use a 12 point
stag, representing a "Royal", in their coat of arms. This zz icon has since adorned each bottle of The Dalmore, symbolizing The Dalmore distillery´s
royal legacy.

Did you know? - GlenDronach
GlenDronach was founded in 1826. The legend has it that its founder,
James Allardice, accidentally built the brand by offering some of his
whisky to some prostitutes in Edinburgh in a moment of despair.
Saddened by an unsuccessful sales trip to Edinburgh to promote its
whisky, Allardice invited two prostitutes to taste its unsold whisky.
The latter loved the elixir so much they shared it with others. Soon
enough the word spread within the city and as bar patrons kept on
requesting GlenDronach, bars quickly had to stock the new flavor of
the week!

connoisseurs today lament the unique direct coal firing, finely peated

Did you know? - Glenfarclas
The Glenfarclas distillery was founded in 1836. Funnily enough, it
was originally known as Glenlivet, a name it eventually had to give up
to the famous Glenlivet distillery we all know. Glenfarclas translates
as valley of the green grass.
The Glenfarclas distillery is one of the last independent family owned
distilleries in Speyside. It is owned by the Grant family which founded
Glen Grant.
The distillery has always been avant-garde and unconventional. Under
partial ownership by the flamboyant Pattison brothers (1895-1898), it
used large-scale innovative advertising in a time when mass media
like radio or television were not invented yet. It opened a visitor center
as early as in 1973. It was also one of the first distilleries to market
a cask strength version of its malt (‘the Glenfarclas 105’). Finally,
Glenfarclas is the last distillery in Scotland which still uses direct
heating of all its stills instead of indirect heating.

About Glenglassaugh, the reborn distillery
The Glenglassaugh distillery sits on a hillside in the Glassaugh
Glen in close proximity to the sea, in the Highlands, just beyond the
boundaries of the Speyside region. The Glenglassaugh Distillery was
founded in 1875.
Between 1908 and 1960 the Glenglassaugh whisky distillery was
only in operation very briefly, for it closed and reopened frequently.
After more than 20 years of significant operations, the stills of the
Glenglassaugh distillery fell silent again in November of 1986.
The Glenglassaugh distillery restarted production in November
2008 after being acquired by an independent investment group and
following a complete refurbishment by the new owners.

GLENGOYNE, HIGHLANDS
Did you know? - Glengoyne
Glengoyne was founded in 1833. Its very singular location in the
Highlands, but a few meters upon the border of the Lowlands makes
it the only Highland single malt whisky matured in the Lowlands.
Indeed, while Glengoyne’s stills are in the Highlands (making it
a Highland whisky), the maturing casks rest across the road in the
Lowlands.
As a matter of fact, Glengoyne is stylistically closer to a Lowland
single malt than a Highland single malt. Indeed, on the contrary to
most whisky distilleries, Glengoyne does not use peat smoke to dry
their barley, but warm air, giving to the malt "the authentic taste of
malt whisky untainted by peat smoke".
In 1984 Glengoyne became suppliers of whiskies to Her Majesty
Queen Elizabeth's household. The Royal Warrant has since been
featured on all Glengoyne products.
Glengoyne is regularly referred to as the "most beautiful distillery in
Scotland".

The Glen Grant distillery was built in the Speyside in 1840 by the Grant Brothers and brought to fame and success by their successor James ‘The
Major’ Grant, a highly ambitious and innovative character and remarkably the first man in the Highlands to own a car. Under his direction, Glen
Grant quickly became one of the leading distilleries in Scotland. Notably, it was the first distillery to have electric light.
Half of Glen Grant’s massive Scotch whisky production is used for the production of blended scotch, notably Chivas which used to own the
distillery (1978-2006). Today Glen Grant is one of the top five bestselling Scotch single malt distilleries in the world. It is also one of a handful of
Speyside distilleries that can handle very extended cask maturation. It is owned by Campari.
Glen Grant is the only remaining distillery which bears the name of its founders.

The Glenmorangie distillery was established in 1843, although
production actually started in 1849.
Glenmorangie usually offers very subtle expressions of malts.
All of Glenmorangie's single malt is aged in first or second fill casks.
Glenmorangie is recognized as a pioneer of the technique of double
maturation / finished whiskies, which they popularize as early as
in the 1990’s with releases such as “madeira finish”, “port finish”,
“Sauternes Cask”, etc. with each of their experiments becoming highly
sought after collectors’ pieces (such as the 1978 Tain L'Hermitage
bottling, the 1975 vintage Cotes de Nuits finish or the 1981 vintage
finished in Sauternes casks from Chateau d'Yquem).
Glenmorangie is one of the smallest and most northerly distilleries
in Scotland. As a result the annual production is very limited and the
reserves of old whisky are even scarcer. Today, due to rising demand
for what is the biggest-selling malt whisky in Scotland, 100% of
production is reserved for bottling as single malt.

Did you know? – Glentauchers
The Glentauchers distillery was founded in 1898 on the site of the
Tauchers Farm, Speyside, in the midst of the whisky boom. It survived
until this day, despite being mothballed between 1985 and 1992.
Glentauchers is a very boutique brand, unknown of most people as it’s
mostly used as a component of whisky blends, notably Ballantine’s,
Teacher’s and Chivas. Chivas Brothers / Pernod Ricard now owns the
distillery.
There have been very few official bottlings of Glentauchers as a single
malt. Old expressions of Glentauchers are rare and have been the sole
property of few acclaimed independent bottlers such as Gordon &
Macphail and Signatory and therefore, they are highly sought after.

After already a few decades of illicit distillation, Highland Park received a license to distill whisky in 1828 – year officially marking the
establishment of the distillery in Orkney, Islands. Highland Park is the most Northern of all Scottish distilleries.

The present Jura distillery was built between 1960-63 on the grounds
of a previous distillery (also called Jura) that had been founded in 1810
but dismantled and silent since 1901. The new distillery is producing malt more akin to the Highlands
style rather than the heavily-peated whisky of near-neighbours Islay,
a strategy that has continued to bear fruit for Jura; although more
experimental peated bottlings from the late 1990s are now finding
their way to market, to some acclaim. Owned by Whyte & Mackay since the mid 1990’s, the distillery now
belongs to the Indian tycoon Vijay Mallya's United Breweries group,
which bought Whyte & Mackay in 2007. With Diageo taking control
of UB Group in 2013, there are rumors it could sell the Jura distillery.

Did you know? – Mortlach
The Mortlach distillery was founded in 1823, decades before
Glenfiddich, making it the first one in Dufftown, Speyside. The
distillery, hwoever, did not meet success at first and was shut ten years
later and sold a number of times. In 1852, it was finally converted back
into a distillery. Despite several consequent change in ownerships, the
Mortlach distillery remained active since then and was even expanded
in the end of the 19th century and refurbished in the mid-20th century.

Did you know? The Macallan
The Macallan distillery was founded in 1824 in Craigellachie, Moray under the original name of Elchies Distillery. The distillery was expanded
toward the end of the nineteenth century and renamed Macallan-Glenlivet as a reference for the 'terroir' in the Speyside region. It’s only in 1980
that the 'Glenlivet' suffix was removed. Even though The Macallan is located in the middle of the Speyside region, it's still labeled as a Highland
malt.
The Macallan used to mature all its single malt production in sherry casks; the remaining being sold to blenders, among which Famous Grouse,
J&B, Chivas Regal, or Ballantine's. They used to proudly boast on their labels: “For reasons not even science can wholly explain, whisky has
always matured best in oak casks that have contained sherry. Due to increasing expense and scarcity, other distilleries no longer insist on sherry
casks. THE MACALLAN DIRECTORS DO.'”
In 2004, however, The Macallan introduced a range of Fine Oak casks, with the whisky mellowed in bourbon oak casks.
Despite one of the biggest productions in Scotland, The Macallan malts are highly sought after and aged Macallan regularly rank at the top of
the most expensive whiskies sold in auctions across the world. Old vintages are highly prized and very valuable while casks have become a rare
commodity!

French Republic in 1883 by the prestigious crystal company Baccarat. Camus have selected some of its oldest
cognacs (‘Hors d'Age’) to fill this exceptional decanter. In the Golden Age of the 1900´s this decanter was set on the
famous tables of the Orient Express and the Trans Siberian trains. The year 1863 which is featured on the company
blazon refers to the establishment year of the cognac house by its ancestor and founder Jean-Baptiste Camus.

Henco was released in the 1950-60's to be enjoyed with
water in order to compete with scotch whisky.
Traditionally, cognac used to be often enjoyed with
water (the so-called ‘Fine a l’Eau’). As blended scotch
grew in popularity in France, cognac got evicted by
scotch whiskies as it was more and more considered as
a winter drink. Henco was released to promote cognac
with water again.

All started with a fruit distillery founded in France in 1827 near Paris
by Mr. Jean-Baptiste Lapostolle. 40 years later, the family, through
marriage, would become Marnier-Lapostolle, a name which would
eventually become famous with Louis-Alexandre Marnier Lapostolle
creating the famous orange liquor Grand Marnier, which he named
following the advice of famous hotelier Cesar Ritz, who reportedly
told him his ‘grand’ liqueur deserved a ‘grand’ name.
In 1921, Louis-Alexandre purchased the Château de Bourg-Charente
in the region of Cognac in which the House produces cognacs as well –
the Marnier-Lapostolle cognacs (now simply called Marnier cognacs),
using grapes from throughout the cognac region.

The Otard cognac house was established in 1795 by Jean-Baptiste Antoine Otard under the name Otard, Dupuy & Co. It is headquartered in the
medieval Chateau de Cognac (also called ‘Château des Valois’), located in the heart of the city of Cognac.
The Chateau de Cognac dates back to the 10th century. The history of the chateau is a story of too many owners, however, in the 17th century, the
owner was King Charles X of France who rebuilt the chateau entirely.
In the eve of the 19th century, the Chateau’s history was ready to be destroyed when Messieurs Otard & Dupuy purchased this historical landmark
to save it from demolition. It’s in the damp and dark cellars under the chateau that the Otard house has been maturing and storing its cognacs since
then.

CONDITIONS OF BUSINESS
Spink Fine Wines and Buyer hereby agree to the following
Terms and Conditions for auctions conducted by Spink Fine
Wines:
1 The Buyer
The highest bidder shall be the Buyer at the ‘hammer price’
and any dispute shall be settled at the auctioneer’s absolute
discretion. Every bidder shall be deemed to act as principal
unless there is in force a written acknowledgement by Spink
Fine Wines that he/she acts as agent on behalf of a named
principal.
2 The Premium
The Buyer shall pay to Spink Fine Wines a premium of 22%
of the hammer price on all lots.
3 Bidder Registration
Bidding is strictly by paddle only. All floor bidders are
requested to register prior to bidding. You must complete and
sign a registration form and provide an identification before
making a bid at auction. Please be aware that we usually
require buyers to undergo a credit check.
If you have not bid successfully with Spink Fine Wines in the
past, or you are registering with us for the first time, we
reserve the right to require a deposit of up to 50% of the
amount you intend to spend. Such deposit will be deducted
from your invoice should you be successful. If you are
unsuccessful at auction your deposit will be returned to you
by the same means it was paid to Spink Fine Wines.
4 Payment
After a lot is sold the buyer must pay to Spink Fine Wines the’
total amount due’ within seven days after the date of the sale.
Any payments by the Buyer to Spink Fine Wines may be
applied by Spink Fine Wines towards any sums owing from
the buyer to Spink on any account whatever regard to any
directions of the Buyer or his agent, whether expressed or
implied.
5 Ownership
The ownership of the lot purchased shall not pass to the
Buyer until he has made payment in full to Spink Fine Wines
of the ‘total amount due’.
6 Collection of Purchases
(a) The Buyer shall at his own expense take away the lot
purchased not later than 7 working days after the day of the
sale but not before payment to Spink Fine Wines of the ‘total
amount due’.
(b) The Buyer shall be responsible for any removal, storage
and insurance charges on any lot not taken away within 8
working days after the day of the sale.
7 Buyers responsibilities for lots purchased
The Buyer will be responsible for loss or damage to lots
purchased from the time of collection or the expiry of 7
working days after the day of the auction, whichever is the
sooner, and neither Spink Fine Wines nor its respective staff
or agents shall thereafter be responsible for any loss or
damage of any kind, whether caused by negligence or
otherwise, while any lot is in their custody or under their
control.
It is the responsibility of the Buyer to be aware of any Import
Duties that may be incurred upon importation to the final
destination. Spink Fine Wines will not accept return of any
package in order to avoid these duties. The onus is also on the
Buyer to be aware of any Customs import restrictions that
prohibit the importation of certain collectibles. Spink Fine
Wines will not accept return of the Lot(s) under these
circumstances. Spink Fine Wines will not accept
responsibility for lots seized or destroyed by Customs.
If the Buyer requires delivery of the lot to an address other
than the invoice address this will be carried out at
the discretion of Spink (Asia) Pte Ltd.
8 Remedies for non-payment or failure to collect
purchases
If any lot is not paid for in full and taken away in accordance
with Conditions 4, 5, 6 and 7. or if there is any other breach
of either of those Conditions, Spink Fine Wines as agent of
the Seller shall, at its absolute discretion and without
prejudice to any other rights they may have, be entitled to
exercise one or more of the following rights and remedies:
(a) to proceed against the Buyer for damages for breach of
contract;
(b) to rescind the sale of that or any other lots sold to the
defaulting Buyer at the same or any other auction;
(c) to re-sell the lot or cause it to be re-sold by public auction
or private sale and the defaulting Buyer shall pay to Spink
Fine Wines any resulting deficiency in the ‘total amount due’
(after deduction of any part payment and addition of re-sale
costs) and any surplus shall belong to the Seller.
(d) to remove, store and insure the lot at the expense of the
defaulting Buyer and, in the case of storage, either at Spink
Fine Wines or elsewhere;
(e) to charge interest at a rate of 2% per month on the ‘total
amount due’ to the extent it remains unpaid for more than 7
working days after the day of the auction;
(f) to retain that or any other lot sold to the same Buyer at the
same or any other auction and release it only after payment of
the ‘total amount due’;
(g) to reject or ignore any bids made by or behalf of the
defaulting Buyer at any future auctions or obtain a deposit
before accepting any bids in future;
(h) to apply any proceeds of sale then due or at any time
thereafter becoming due to the defaulting Buyer towards
settlement of the ‘total amount due’ and to exercise a lien on
any property of the defaulting Buyer which is in Spink Fine
Wines’ possession for any purpose.
9 Liability of Spink Fine Wines and Sellers
All goods are sold “AS IS”. Illustrations in catalogues are for
identification only. Buyers should satisfy themselves prior to
the sale as to the condition of each lot and should exercise
and rely on their own judgment as to whether the lot accords
with its description.
10 Unsold Lots
Spink Fine Wines reserves the right to charge commission up
to one- half of the ‘stated rates’ calculated on the ‘reserve
price’ and in addition ‘expenses’ in respect of any unsold lots.
11 Spink Fine Wines sells as agent for the seller and as such
is not responsible for any default by Seller or Buyer.
12 Any representation or statement by Spink Fine Wines in
any catalogue as to authorship, attribution, genuineness,
origin, date, age, provenance, condition or estimated selling
price is a statement of opinion only.
Every person interested should exercise and rely on his own
judgment as to such matters and neither Spink Fine Wines
nor its respective staff or agents are responsible for the
correctness of such opinions.
13 While the interests of prospective Buyers are best served
by attendance at the auction, Spink Fine Wines will, if so
instructed, execute bids on their behalf, neither Spink Fine
Wines nor its respective staff or agents being responsible for
any neglect or default in doing so or for failing to do so.
14 Spink Fine Wines shall have the right at its discretion to
refuse admission to its premises or attendance at its auctions
to any person.
15 Spink Fine Wines has absolute discretion without giving
any reason to refuse any bid, to divide any lot to combine any
two or more lots, to withdraw any lot from the auction and in
case of dispute to put up any lot for auction again.
16
(a) Any indemnity under these Conditions shall extend to all
actions, proceedings, costs, expenses, claims and demands
whatever incurred or suffered by the person entitled to the
benefit of the indemnity.
(b) Spink Fine Wines declares itself to be trustees for its
respective relevant staff and agents of the benefit of every
indemnity under these Conditions to the extent that such
indemnity is expressed to be for the benefit of its staff and
agents.
17 Any notice by Spink Fine Wines to a Seller, Consignor,
prospective bidder or buyer may be given by pre-paid mail in
Hong Kong or Macau or airmail outside Hong Kong and
Macau and if so given shall be deemed to have been duly
received by the addressee one week after posting.
18 These Conditions shall be governed by and construed in
accordance with Hong Kong law. All transactions to which
these Conditions apply and all matters connected therewith
shall also be governed by Hong Kong law. Spink Fine Wines
hereby submits to the exclusive jurisdiction of the Hong
Kong courts and all other parties concerned hereby submit to
the non-exclusive jurisdiction of the Hong Kong courts.
19 In these Conditions of business:
charges and expenses due from a defaulting Buyer in Hong
Kong dollars;
(d) ‘sale proceeds’ means the net amount due to the seller
being the ‘hammer price’ of the lot sold less commission at
the ‘stated rates’ and ‘expenses’ and any other amounts due
to Spink Fine Wines by the Seller in whatever capacity and
howsoever arising;
(e) ‘expenses’ in relation to the sale of any lot means Spink
Fine Wines’s charges and expenses for insurance,
illustrations, special advertising, packing and
freight of that lot.
20 The headings in these Conditions do not form part of the
Conditions but are for convenience only.
NOTICE
Bids
If instructed, Spink Fine Wines will execute bids, and advise
the intending purchaser. Lots will always be bought as
cheaply as is allowed by such other bids or reserves as are on
Spink Fine Wines’ books. Bids may be placed in writing
before the commencement of the sale by giving to Spink Fine
Wines a bid form for the lot, duly filled in with the name,
contact phone number(s), full address of the buyer, number of
the lot, and amount of the bid in Hong Kong dollars. All bids
when placed by telephone are accepted only at the sender’s
risk, and must be confirmed to Spink Fine Wines in writing,
or by facsimile, before the sale.
Clearance of Purchases
In order to avoid delay in clearing purchases, Buyers
unknown to Spink Fine Wines are advised to make
arrangements before the sale for payment or for references to
be supplied. If such arrangements are not made, checks will
be cleared before purchases are delivered.
Purchase by Non-Residents
Purchases made by non-residents in Hong Kong may be
exported on the instructions of the Buyer at his expense.
Payment shall be made in the full amount equivalent to the
successful bid in Hong Kong dollars. Shipping instructions
may be given upon payment to Spink Fine Wines.
Please note some lots are marked EU to indicate that they are
lying within the European Union tax free for export from
their country of origin.
Applicable local tax and/or duty will apply for local delivery
outside of Hong Kong.
Currency Converter
(b) ‘hammer price’ means the price at which a lot is knocked
down by the auctioneer to the buyer;

only for the guidance of bidders. All foreign currency
amounts displayed are approximations based on recent
exchange rate information and may not be relied upon to
calculate any invoices or statements. Spink Fine Wines
assumes no responsibility for any error or omission in foreign
or Hong Kong currency amounts shown.
(c) ‘total amount due’ means the ‘hammer price’ in respect of
the lot sold together with any premium, and additional

Absentee bids
If you are unable to attend an auction in person, and wish to
place bids, you may consider instructing Spink Fine Wines
Bid Department to bid on your behalf. Upon receiving your
written instructions, our representative will make every effort
possible to try to acquire the lot(s) of your choice at the
lowest price possible, and never to exceed the top limit you
indicate. This service is complimentary and with strict
confidence. Spink Fine Wines offer this value-added service
as a convenience to our clients who are unable to attend the
auction, however, Spink Fine Wines will not be held
responsible for error, omission or failure to execute bids.
Placing absentee bids
To place bids, please use the absentee bid form provided in
the catalogue. Be sure to accurately record the lot number(s)
and the top price you are willing to pay for each lot “Buy”
bids will not be accepted. Always indicate a “top limit” - the
amount to which you would bid if you were attending the
auction yourself.
Alternative bids should be indicated by using the word “OR”
between lot numbers. If your bid on an early lot is successful,
we will not continue to bid on other lots for you. Or, if your
early bids are unsuccessful, we will continue to execute bids
for alternative lots until a bid is successful. Bids must always
be placed in the same order as the lot numbers appear in the
catalogue.
Each absentee bid form should contain bids for one auction
only; the auction code number should appear in the top left
hand corner of the form.
Please place your bids as early as possible. In the event of
identical bids, the earliest received will take precedence.
Telephone bids
Bids may be placed by telephone, but are accepted subject to
Spink Fine Wines’ discretion and are at caller’s risk. At the
sole discretion of Spink Fine Wines, telephone bids may be
recorded. By bidding on the telephone, prospective
purchasers consent thereto.
Buyer’s premium
The “top limit” you indicate on your bid form is for the
hammer price only. A 22% buyer’s premium will be added to
the successful bid price for each lot you buy and is payable
by you.
On-line bidding
We offer internet services as a convenience to our clients. We
will not be responsible for errors or failures to execute bids
placed on the internet, including, without limitation, errors or
failures caused by
(i) a loss of internet connection by either party for whatever
reason;
(ii) a breakdown or problems with the online bidding
software and/or
(iii) a breakdown or problems with your internet connection,
computer or system.
Execution of on-line internet bids is a free service undertaken
subject to other commitments at the time of the auction and
we do not accept liability for failing to execute an online
internet bid or for errors or omissions in connection with this
activity.
