AUKTIONSBETINGELSER
for auktionen den 3. maj 2008 afholdt af Viegaard Sport Horses ApS
1. HESTENES SUNDHEDSTILSTAND
1.1 Alle udbudte auktionsheste er, indenfor de seneste
30 dage, forud for auktionen besigtiget af en dyrlæge og
der er foretaget en rutinemæssig røntgenundersøgelse
(begge forbens hovseneben, alle fire bens tæer i sideprojektion, begge bagbens haser i tre planer og begge bagbens
knæled i sideprojektion). Resultatet af disse undersøgelser
ligger til gennemsyn på auktionskontoret og byder/køber
er forpligtiget til selv at gennemse disse undersøgelser inden auktionen starter. Dyrlæge Hans Scougaard er til stede
på auktionsdagen såfremt køber/byder har spørgsmål til
hestenes tilstand. Køber kan således ikke reklamere helbredsmæssige forhold som allerede fremgår af dyrlæge- og
røntgenundersøgelserne på auktionstidspunktet. Der er ikke
udført yderligere undersøgelser. Såfremt køber ønsker udvidet undersøgelse af auktionshesten, end de standard undersøgelser der ligger til gennemsyn, har køber/byder ret til
dette såfremt dette foretages i rimelig tid inden auktionen og
for købers/byders egen regning.
Besigtigelse/afprøvning af auktionshestene kan ske efter aftale med sæl­ger fra den 28. april til den 4. maj.
2. AUKTIONSGENSTANDEN
2.1 Bortset fra punkt 1.1 sælges hestene i den tilstand, hvori
de forefindes ved hammerslaget, som beset af købere og
uden forsikring og garanti af nogen art. I auktionskataloget
er hestens uddannelsesniveau opført, som ej er at jævnføre
med eventuelt konkurrenceniveau. Konkurrenceniveau er ej
oplyst.
2.2 En hests ID/hestepas og eller stamtavle medfølger altid,
med mindre andet er oplyst.
2.3 Umiddelbart efter hammerslagstidspunktet henstår
hesten for købers opsyn, regning og risiko.
2.4 Det påhviler køber umiddelbart efter udlevering af
hestens papirer at kontrollere, at disse stemmer overens med
hesten og de på tavlerne i auktions­lokalet oplyste data.
3. AUKTIONENS GENNEMFØRELSE
3.1 Til brug for auktionen udarbejdes der et auktionskatalog.
Auktions­kataloget er kun vejledende og ret til at meddele
ændringer under auktionen forbeholdes.
3.2 Med mindre andet fastsættes af auktionslederen i det
konkrete tilfælde, f.eks. når auktionen af en hest genoptages i
henhold til pkt. 3.13, vil hesten ikke blive fremvist igen.
3.3 Såfremt flere byder samtidig afgør auktionslederen, hvem
der får buddet.
3.4 Auktionslederen har ret til at ændre den rækkefølge, hvori
hestene auktioneres.
3.5 Kun data fremvist på auktionstavlerne og oplyst af auktionarius er gældende.
3.6 Størrelsen af mindste bud som kan afgives og overbuds
mindste størrelse afgøres af auktionslederen.
3.7 De enkelte salg sker ved, dog med forbehold jfr. pkt. 3.12,
at hammerslag efter 3 gange gentaget opråb uden overbud,
gives til den højestbydende.
3.8 Opstår der, efter at hammerslag er givet, tvivl om, hvem
der er højestbydende foretages fornyet opråb.
3.9 Den bydende kan såvel under som efter auktionen
afkræves sikkerhedsstillelse.
3.10 Den, der byder for en anden, forpligter sig derved som
selvskyldnerkautionist.
3.11 Køber flere i foreningen, hæfter de solidarisk.
3.12 Såfremt auktionsrekvirenten (sælger) forud for auktionen, skriftligt til auktionslederen har fastsat en ej publiceret
mindstepris (limit) på hesten som betingelse for bortsalg af
hesten, gives der ikke et definitivt eller endeligt hammerslag,
men derimod et udsat salg med forbehold for sælger, dersom
denne mindstepris ej opnås. I en sådan situation kan auktionslederen vælge at udsætte auktionen over den pågældende
hest i op til 20 minutter ved at proklamere “udsat”, for at auktionslederen i denne periode kan få afklaret med auktionsrekvirenten, hvorvidt auktionsrekvirenten vil trække den
fastsatte mindstepris tilbage. I det tidsrum på op til 20 minutter, hvor auktionen således udsættes, er højestbydende bundet af sit afgivne bud med mindre andet aftales.
3.13 Hvis auktionsrekvirenten (sælger) accepterer at trække
sin mindstepris tilbage, genoptages auktionen straks herefter,
og såfremt der ingen overbud kommer på den genoptagne
auktion, meddeles der hammer­slag til den, der før auktionen
blev udsat, var højestbydende.
3.14 Auktionsrekvirenten (sælger) har ret til at afvise bud
som ligger under den fastsatte men ej publicerede mindstepris på hesten.
3.15 Køber skal umiddelbart efter hammerslag meddele
navn, adresse, land (og evt. momsnummer såfremt købet er
et erhvervskøb) til auktions­leder. Opgiver køber ikke fuldstændig korrekte data, afgør auktionslederen, om hesten skal
fremstilles på auktionen igen. Denne bestemmelse fritager
ikke køber for erstatningsansvar overfor såvel auktionsrekvirenten som auktionsholder.
3.16 Såfremt auktionslederen ved en fejl kommer til at
bortauktionere en forkert hest, er køber pligtig til at tåle, at
handlen går tilbage, uden at køber derved kan gøre misligholdelsesbeføjelser gældende overfor sælger eller et erstatningsansvar gældende overfor auktionslederen.
3.17 Hestene auktioneres på dansk sprog og i danske kroner (DKK) fra aktuel plads hvor hestene befinder sig på auktionstidspunktet. Som ser­vice for udenlandske købere vil
auktionslederen lave en engelsksproget præsentation af de
enkelte heste og der vil være mulighed for at følge budene
i andre valutaer (EUR, USD, NOK, SEK) på en dertil indrettet
monitor i auktionshallen. Dette er dog kun vejledende og
med forbehold for eventuelle valutakurs ændringer.
4. KØBESUM
4.1 Budsummen tillægges IKKE auktionssalær.Såfremt hesten
er momspligtig (+ moms) er dette opført i auktionskataloget
og hesten auktioneres da netto (budgivning netto) og ved
fakturering tillægges budsummen 25% moms. Fakturering
netto uden moms kan ske til;
I. købere i et andet EU land, forudsat at disse kan fremvise et
originalt Handelsregisterudtræk med et gyldigt EU-momsnummer samt at firmategneren fremviser original paslegitimation.
II. købere med registreret firmaadresse i 3. lande udenfor EU,
forudsat at disse kan fremvise et originalt udtræk fra Handelsregisteret dateret indenfor de seneste 6 måneder samt at firmategneren fremviser original paslegitimation.
III. private købere fra 3. lande udenfor EU, forudsat at disse
kan fremvise original paslegitimation og en officiel anerkendt
bopælsattest dateret indenfor de seneste 6 måneder.
4.1.2 Betingelsen for fakturering netto uden moms er endvidere at køber inden 30 dage fra købsdato, dokumenterer
overfor sælger, i form af et anerkendt indførselsdokument
påstemplet af offentlig myndighed, at hesten definitivt er indført i destinationslandet.
4.2 Købere fra andre EU lande og købere fra 3. lande udenfor
EU som ønsker fakturering uden moms, er forpligtiget til og
ansvarlige for, at udføre transaktionen på lovlig vis. I tilfælde,
uanset årsagen og tidspunktet, hvor fakturering uden moms
underkendes af en offentlig myndighed i sælgers land eller
købers land, er køber forpligtiget til at indbetale den fulde
moms af budsummen til køber, svarende til den gældende
momssats i det land hvor sælger var registreret på salgstidspunktet.
4.3 Den fulde købesum uden fradrag forfalder til betaling, netto
kontant, straks efter hammerslag. Betaling skal ske på auktionskontoret. Ønsker køber at betale med check eller via indbetaling
i bank eller bankoverførsel, skal dette aftales med Viegaard Sport
Horses ApS på auktionskontoret. Køber er forpligtiget til at fremvise personligt ID og/eller firma ID på auktionskontoret. Betales
hesten ikke kontant eller ønsker køber at betale med check eller
via indbetaling i bank eller bankoverførsel, udleveres hesten og
hestens ID/hestepas og/eller stamtavle først til køber når den
fulde betaling uden fradrag, uigenkaldeligt er registreret på
sælgers bankkonto og ved betaling med check kan udlevering
først ske 3 bankdage efter at checken er clearet, med mindre andet er skriftligt aftalt med Viegaard Sport Horses ApS.
4.4 Såfremt købesummen ikke betales rettidigt i henhold til
pkt. 4.3, afgør auktionsrekvirenten (sælger) og auktionslederen, om hesten skal fremstilles på auktion igen, og om købet
derfor skal hæves overfor køber. Denne bestemmelse fritager
ikke køber for erstatningsansvar overfor såvel auktionsrekvirenten som auktionsholder.
4.5 Betales købesummen ikke rettelig og rettidigt, jfr. 4.3, beregnes 2% rente på den fulde købesum pr. påbegyndt måned
regnet fra hammerslags dato indtil betaling sker.
Ejendomsretten til den købte hest overgår først til køber, når
den fulde købesum uden fradrag, og med eventuelle påløbne
renter og omkostninger, er betalt fuldt ud og uigenkaldeligt.
4.7 For købesum og evt. moms haves i medfør af dansk auktionslov en udpantningsret, og fordringen kan derfor umiddelbart danne grundlag for udlæg, jfr. dansk retsplejelovs regler herom.
5. AFHENTNING
5.1 Købte heste skal afhentes senest 7 dage efter auktionsdagen, såfremt andet ikke udtrykkeligt er aftalt. Ved forsinket
afhentning pålægges køber udgifter og udlæg til forvaring af
den købte hest.
6. SÆLGERS ANSVAR FOR FEJL OG MANGLER
6.1 Køber kan kun hæve et auktionskøb såfremt hestens data
ikke stemmer overens med de på tavlerne i auktionslokalet
oplyste data, og denne forskel har væsentlig betydning. Uanset
ovenstående er det en betingelse, for at udnytte hæveadgangen, at den købte hest tilbageleveres i samme stand, som det
befandt sig på auktionstidspunktet. Køber er ikke berettiget til
at kræve erstatning for afholdte omkostninger eller udlæg.
7. ANSVAR I ØVRIGT
7.1 Auktionen sker uden ansvar for auktionsleder der også er
auktionarius og hvis opgave er at auktionere auktionshestene
i henhold til dansk lov om afholdelse af auktioner og disse
auktionsbetingelser der er opført i auktionskataloget og
opslået i auktionshallen.

AUCTION TERMS AND CONDITIONS
for the auction to be held on 5 may 2006 by Viegaard Sport Horses aps
1. THE HORSES’ STATE OF HEALTH
1.1 During the 30 days prior to the auction, all of the horses
up for auction will have been examined by a veterinarian, and
will have been subjected to a routine X-ray examination (of
the distal sesamoid bones of both front legs, the toes of all
four legs in a side projection, the hocks of both hind legs in
three planes, and the knee joints of both hind legs in a side
projection). The results of these examinations will be available
for previewing at the auction office, and bidders/buyers are
responsible themselves for going through the examination
results before the auction begins. Veterinarian Hans Scougaard will be present on the day of the auction to help bidders/buyers with any questions they may have concerning
the condition of the horses. Hence, no buyer will have the right
to lodge a complaint about health conditions that are already
evident from the results of the veterinary and X-ray examinations at the time of the auction. No further examinations have
been performed. Should a bidder/buyer wish to have an auction horse examined more extensively than in the standard
examinations available for previewing, the bidder/buyer has
the right to do so, provided such further examinations are
carried out in reasonably good time before the auction and
paid for by the bidder/buyer. The horses up for auction can be
previewed/tested from 1 May to 4 May if arranged in advance
with the seller.
2. THE ITEMS UP FOR AUCTION
2.1 Except as described in clause 1.1 above, the horses are
sold in their present state and condition at the fall of the hammer (the final tap), as is, and without insurance or guarantees
of any kind. The auction catalogue contains information on
each horse’s training level, which is not to be compared with
its competition level (if any). No information on competition
level is given.
2.2 A horse is always accompanied by an ID/horse passport
and/or pedi­gree, unless otherwise stated.
2.3 The horse is given over to the care, account, and risk of the
buyer immediately after the fall of the hammer.
2.4 Immediately after receiving the horse’s documents, the
buyer is responsible for checking that the documents are consistent with the horse and with the data stated on the boards
in the auction room.
3. CONDUCTING THE AUCTION
3.1 An auction catalogue will be prepared and issued for the
purposes of the auction. This auction catalogue is only indicative, and the issuer reserves the right to announce changes to
the information during the auction.
3.2 Once presented for auction, a given horse will not be presen­
ted for auction again, unless the auctioneer decides otherwise in
the particular case in question, for instance when the auctioning
of a horse is resumed according to clause 3.13 below.
3.3 If more than one person bids simultaneously, the auctio­
neer will decide who gets the bid.
3.4 The auctioneer has the right to change the order in which
the horses are auctioned off.
3.5 Only data posted on the auction boards or announced by
the auctioneer shall formally apply.
3.6 The auctioneer will decide the size of the lowest accep­
table bid and the lowest acceptable increment for bidding.
3.7 Each individual sale – except where clause 3.12 below applies – is finalized when no higher bids are given after bids
have been called for three (3) times, with the fall of the hammer indicating that the item goes to the highest bidder.
3.8 If, after the fall of the hammer, doubt arises as to who the
highest bidder was, bids will be called for again.
3.9 A bidder can be requested to provide security, both during and after the auction.
3.10 Persons bidding on behalf of someone else thereby undertake liability as primary debtors.
3.11 If two or more persons make a joint purchase, they shall
be jointly and severally liable.
3.12 If, prior to the auction, the party requesting the auction
(the seller) has notified the auctioneer, in writing, that the sale
of a given horse shall be subject to an unpublished minimum
price (a limit) for that horse, no conclusive or final fall of the
hammer is given. Rather, the auctioneer can postpone the
sale, making a reservation on behalf of the seller in the event
that the minimum price is not achieved. In such a situation, the
auctioneer can choose to postpone the auction of the horse
in question for up to twenty (20) minutes by declaring the sale
“postponed” under provisionel (in Danish “udsat”), so that during this period the auctioneer and the seller can resolve whet­
her or not the seller wishes to retract his stipulated limit. During
this postponement period (under provisionel) of up to twenty
(20) minutes, the highest bidder shall remain bound by the bid
submitted, unless otherwise agreed.
3.13 If the party requesting the auction (the seller) consents to
retract his limit, the auction will immediately be resumed, and
provided no higher bids are made at the resumed auction, the
fall of the hammer finalizes sale to the person who was the
highest bidder before the auction was postponed.
3.14 The party requesting the auction (the seller) has the right
to reject bids that are lower than the established but unpu­
blished minimum price (the limit) for a given horse.
3.15 Directly after the fall of the hammer, the buyer must notify the auctioneer of his or her name, address, and country (and
possibly VAT registration number, if the purchase is a commercial purchase). If the buyer does not provide totally correct
data, the auctioneer will decide whether the horse is to be
presented for auction again. This clause does not exempt the
buyer from liability for damages towards the party requesting
the auction or the auctioneer.
3.16 If, by mistake, the auctioneer inadvertently auctions off
the wrong horse, the buyer must tolerate and accept that the
transaction is reversed, without this consequently giving the
buyer any right to claim a breach of agreement with the seller
or to claim any liability on the part of the auctioneer.
3.17 The horses will be auctioned off in the Danish language
and in ­Danish kroner (DKK) from the place in which the horses
are located at the time of the auction. As a service to foreign
buyers, the auctioneer will give a pre­sentation in English of
the individual horses, and it will be possible to follow the bidding in other currencies than DKK (namely: EUR, USD, NOK,
and SEK) on a monitor set up for that purpose in the auction
room. However, this data will only be indicative and will be
subject to possible fluctuations in exchange rates.
4. PURCHASE PRICE
4.1 No buyers commission will be added to the hammer
price. If a given horse is sold subject to VAT (“plus VAT”), this
will be stated in the auction catalogue, and the horse will be
auctioned off net (with bids not including VAT). In connection
with invoicing, a VAT amount of 25% will be added to the bid
price. Invoices for net amounts, without VAT added, can be issued to:
I. buyers from another EU country, provided these buyers can
produce an original data extract from the trade register with
a valid EU VAT registration number, and provided the person
authorized to sign for the company can produce original
passport ID.
II. buyers with a registered commercial address in a third
country outside the EU, provided these buyers can produce
an original data extract from the trade register issued/dated
within the last six (6) months, and provided the person authorized to sign for the company can produce original passport ID.
III. private buyers from a third country outside the EU, provided these ­buyers can produce original passport ID and an
officially approved certificate of address issued/dated within
the last six (6) months.
4.1.2 A further condition for invoicing net, without including
VAT, is that the buyer can document to the seller – within thirty
(30) days from the date of purchase, and by means of an approved import document duly stamped by a public autho­rity
– that the horse has conclusively been imported into the destination country.
4.2 Buyers from other EU countries and buyers from third
countries outside the EU who wish to be given invoices without VAT have an obligation and a responsibility to carry out
the transaction in a lawful manner. In the event that invoi­cing
without VAT is rejected by a public authority, in the seller’s or
the buyer’s country, regardless of the reason and the time for
the refusal, the buyer is obliged to pay the full VAT amount
on the bid price to the seller, corresponding to the VAT rate
in force in the country where the seller was registered at the
time the sale took place.
4.3 The entire purchase amount, with no deductions, is payable net cash immediately after the fall of the hammer. Payment must be made at the auction
office. If the buyer wishes to pay by cheque, or pay into a bank
account, or pay by bank transfer, this must be agreed with
Viegaard Sport Horses ApS at the auction office. The buyer is
under obligation to produce personal ID and/or company ID
at the auction office. If the horse is not paid for in cash, or if the
buyer wishes to pay by cheque, bank deposit, or bank transfer, the horse and the horse’s ID/horse passport and/or pedi-
gree will not be handed over to the buyer until full payment,
with no deductions, has irrevocably been registered as paid
into the seller’s bank account. For payments made by cheque,
hand-over cannot take place until three (3) bank days after the
cheque has been cleared, unless otherwise agreed in writing
with Viegaard Sport Horses ApS.
4.4 If the purchase price is not paid promptly, in accordance
with clause 4.3 above, the party requesting the auction (the
seller) and the auctioneer will decide whether the horse will
be presented for auction again, and whether the sale to the
buyer will consequently be cancelled. This clause does not exempt the buyer from liability for damages towards the party
requesting the auction or the auctioneer.
4.5 If the purchase price is not paid properly and promptly,
in accordance with clause 4.3 above, an interest of 2% will be
charged on the total purchase price per month or part thereof,
counting from the date of the hammer fall and until payment
has been effected.
4.6 The ownership of the purchased horse does not pass to
the buyer until the total purchase price, with no deductions
and including any accrued interest and costs, has been fully
and irrevocably paid.
4.7 Pursuant to the Danish auction act, the seller shall have
a lien on the buyer corresponding to the purchase price and
any VAT due. Such a debt can therefore immediately serve
as the basis for levying execution, cf. the relevant rules in the
Danish Administration of Justice Act.
5. PICKING UP THE AUCTION ITEMS
5.1 Purchased horses must be picked up within seven (7) days
after auction day, unless the parties have expressly agreed
otherwise. If pick-up is delayed, the buyer will be charged for
expenses paid and costs incurred while the purchased horse
was kept and cared for.
6. SELLER’S RESPONSIBILITY FOR FLAWS AND
DEFECTS
6.1 The buyer can only cancel a purchase at auction if the
horse’s data do not correspond to the data posted on the
boards in the auction room, and if the difference is of material importance. Regardless of the above, it is a condition for
exercising the option to cancel that the purchased horse is returned in the same condition it was in at the time of the auction. The buyer does not have the right to claim damages for
costs incurred or expenses paid.
7. OTHER LIABILITIES
7.1 The auction will take place without any potential liability
to the auction manager, who is also the auctioneer, and who
has been engaged to auction off the auction horses in accor­
dance with the Danish legislation concerning the conducting
of auctions and with these Auction Terms and Conditions,
which will be presented in the auction catalogue and posted
in the auction room.

the Auction Terms and Conditions, or to the description of the auctioning process, you should contact
the auction office to have your questions answered

Contact the veterinarian at the auction office before
bidding starts if you wish to see examination reports
and X-rays for the horses you are interested in bidding on.
In particular, be aware that the horses are auctioned
“plus VAT”, meaning that bids do not include VAT.
