(Comments will be heard on items that do not appear on the Agenda. The Public
Comment portion of the Agenda shall be subject to a twenty (20) minutes limitation. A
time limit of five (5) minutes shall be imposed on each Speaker.
The purpose of having Public Comments as an Agenda Item is to allow any person to
make his/her views known to the City Council upon any subject of general or public
interest.

The Council recognizes that Public Comments are for the purpose of legitimate
inquiries and discussion by the Public, and not for the purpose of advancing arguments or
repetitious questions concerning matters which the Council believes to be closed or not
of general public concern.
The Council shall have the right during this period to decline to hear any person or subject
matter upon proper motion and majority vote by the Council.
Each person wishing to speak during the Public Comment portion of the Agenda must fill
out a Public Comment Speaker Card stating name, address, and the topic about which
he/she wishes to speak as well as a sign-in sheet, and give to the City Clerk at the
Meeting itself.
The purpose of the Cards is to obtain the spelling of the name of the Speaker, contact
information, and provide for efficient meeting administration.
The order of speaking shall be based upon the order of sign-in with first person signing-in
speaking first and so forth. If the twenty (20) minutes has elapsed before all Speakers
who have signed up are allowed to speak, the City Council may elect to continue the time
period.
However, if the City Council elects not to extend the time period those Speakers who
signed up but did not speak may if they so choose to be placed on the next Agenda under
the Public Comments Section and shall be placed at the top of the Sign-In Sheet in the
same order they were in from the previous Sign-In Sheet.
All Speakers shall comply with these rules which shall be posted at the Speaker Sign-In
desk and rulings of the City Clerk. )

CAPITAL IMPROVEMENT PLAN/RESOLUTION NO. 14-057
City Administrator Benson provided his Memo dated June 10, 2014.
The Capital Improvement Plan (CIP), is a Multi-Year Capital Improvement Schedule as part of the
City’s long term strategic planning for infrastructure replacements and enhancements.

The City of Lockport needs to provide dependable infrastructure in order to attract and maintain
healthy commercial and residential growth and offer a better quality of life for its Residents.
The CIP is intended to be a fluid document, which will flex with changing financial conditions of the
City each year. The City Staff will confirm with the City’s Finance Department and Administration
to pre-align each years scheduled projects with the financial forecasts, which outlines available
capital funding for projects. If a budget year includes more funding than anticipated, priority
projects can be moved up from the following year’s projects. Conversely, if a Budget shortfall
occurs, a project planned for the current Fiscal Year may be delayed to the following Budget year.
This flexible plan, allows us to accomplish significant infrastructure goals on current revenue and
cash reserve models, without any new additional revenue recommendations at this time.
The process for preparing the Plan included identifying the inventory of assets requiring
maintenance, repair, or replacement, with particular attention to those assets that are essential to
the City’s mission and long-term vision for the Community. The Plan focuses on the four main
system of infrastructure; Transportation, Water, Storm Sewer, and Sanitary Sewer, and takes in to
consideration all components as a complete system of functioning infrastructure. A prioritization is
made separately for road, water & sewer projects, and then combined to prioritize the Plan as a
complete package.

FAÇADE GRANT 1028 S. STATE STREET
P. Hirth presented her Memo dated July 9, 2014.
Vince Martinez, Owner of 1028 S. State Street, is requesting reimbursement for work
previously authorized under the Façade Grant Program (repainting of the wood façade).
The work was approved under the Fiscal Year that ended June 30th in the amount of
$1,600. The painting was completed prior to June 30th so the money will be taken from
the previous Fiscal Year and will not reduce the amount of Façade Grant funds available
in the current Budget.
The property has complied with the Grant requirements and had provided evidence of
Contractor payment. Staff is requesting reimbursement in the amount of $1,600 being
half the cost of improvements.

2014 SIDEWALK PROGRAM BID LETTING/RESOLUTION NO. 14-053
On July 9, 2014, the City of Lockport received bids for the 2014 Sidewalk Program. The
project will consist of removal and replacement of sidewalk Sections throughout town and
ADA improvements in several areas, including the Abbey Glen Subdivision.
The Engineer’s Estimate for the project was $87,000.00 which included nearly $5000 in
repairs for the Water Department (main break repairs) and the Street Department (curb).
The 2012-2013 FY Budget contains $100,000 or the 2013 Sidewalk Program including
$20,000 for ADA improvements.
The City received four (4) bids for this work and the lowest base bid, in the amount of
$80,530.25 was submitted by Strada Construction Co. Approximately 44000 of this bid
amount was for items added by the Water and Street Departments for main break
restoration & curb repair. This amount will be charged to the Water Department System
Maintenance and Street Department Infrastructure Maintenance Accounts.
We would like authorization to increase the amount of the Contract up to $94,000, if
necessary to accommodate any new service requests that are received until construction
has started. This will leave approximately $10K in the Sidewalk Program Fund for the
Mudjacking Contractor to repair areas that do not need to be completely removed.

STP READ STREET RECONSTRUCTION PROJECT RECOMMENDATION FOR
SELECTION OF CONSULTANT/RESOLUTION NO. 14-054
Director of Engineering, Amy Wagner presented her Memo dated June 30, 2014.
In December 2010, the City’s Engineering Department requested Surface Transportation
Program (STP) Funding from the Federal Government, through Will County
Governmental League, for the reconstruction of Read Street from 7th Strete to Division
Street. In 2011, we were notified that we are to receive the requested funding for Phase
2 Design and Phase 3 Construction in the amount of $1,000,000 or 80% of the total
project cost of $1,250,000.
Read Street is currently in very poor condition with deteriorating pavement and crumbling
curb and gutter as a result of deficient storm sewer infrastructure. The proposed project
will include full reconstruction of 2,670 feet of the roadway, from 7th Street to Division
Street, including a 28’ wide bituminous paved road with two 14’ wide travel lanes. B6, 12
curb & gutter will be installed with inlets and reinforced concrete storm sewer in order to
alleviate the current storm water problems associated with the lack of storm sewer
infrastructure. This project will also include construction of sidewalk to eliminate gaps,
and removal and replacement of existing sidewalk that is in poor condition or does not
meet current ADA standards. Thermoplastic pavement marking will be included to
highlight stop bars and crosswalks for pedestrian safety.
In January 2013, the Engineering Department solicited proposals for the services of a
Professional Engineering Firm to develop a Phase 1 Study and complete the Phase 2
Design process. The City Council passed a Resolution, awarding the Contract for the
Phase 1 portion of the project to Strand Engineering.
Phase 1 Engineering has been sent t IDOT for approval, and the Engineers are ready to
proceed with the Phase 2 (Final Design/Contract Documents). They submitted a
proposal for Phase 2 Engineering Services in the amount of $150,590.12, 80%Federally
Funded by STP funds, with a local share of $30,118.02.
For the Phase 2 Engineering, the City would need to enter into an Engineering Services
Agreement with Strand and a Local Agency Agreement with the State, pay for the
Engineering Services after invoiced by the Consultant, and request reimbursement by the
State for the 80% Federal Share.

2014 STP RESOLUTION – MACGREGOR & NORTH STREET RECONSTRUCTION

The Engineering Department is pursuing Federal Surface Transportation Program (STP)
Funding through the Will County Governmental League (WCGL). This funding will allow
the City to reconstruct MacGregor Road, from Shoals to North, and North Street, from
MacGregor to Reef, and complete Curb repair and resurfacing of North Street, from Reef
to Farrell, with a 20% local match for eligible items.
This type of funding will be used this year for the reconstruction of Garfield Street, and in
2015 for the reconstruction of Read Street.
This Grant is a competitive grant with each project ranked using the evaluation system
(point system) adopted by the Will County Governmental League. The full list of project
rankings will be presented to the Transportation Committee for approval. The highest
ranking projects will be funded and scheduled with the WCGL, IDOT, and CMAP. The
next five highest ranked projects not to receive funding will be put on a Multi-Year B List.
Those projects will receive funding if additional funding becomes available.
The submission of the application must include a Resolution stating that the project
Sponsor will fund the required local match with the funding identified. Please note that
matching funds will need to be budgeted in future Budgets for these projects. Also, an
STP Grant will pay for roadway/transportation items only; watermain and sanitary sewer
items will need to be funded by the City for these projects.
We request that the City adopt a Resolution authorizing the Engineering Department, City
Administrator, Mayor, and City Clerk to apply for Federal Surface Transportation Program
(STP) Funding, to provide all required information for the application, and to execute all
required documentation, and also that the City will provide the required Local Match.

has very little equipment or the inability to prepare, cook, and serve meals within the
establishment. City Council was unable to approve the same definition of restaurant in
the Zoning Ordinance at the Meeting because a Public Hearing at Plan Commission is
required before text amendments to the Zoning Ordinance can be approved.
At the July 8th Plan Commission, a Public Hearing was held to amend the Zoning
Ordinance with the same restaurant definition. There was no Public Testimony, however,
there were concerns with what constitutes “fully staffed”, what makes for a “full menu” and
that portion of the definition that states “the sale of alcoholic liquor shall be incidental to
the sale of meals.” The discussion focused on what number, if any, would define a fully
staffed kitchen (1,3, etc..); opportunity for interpretation of what it means to have a full
menu (burgers and sandwiches for some; breakfast, lunch, and dinner items for others);
and how/who would determine whether the alcohol sales remained incidental to food
sales (certain establishments such as sports bars are generally considered places to
drink not necessary places to eat). Staff clarified that the intent of the revised definition is
to ensure any new business in town seeking a Liquor License can be recognized in the
Community as a dining opportunity. Upon conclusion of their discussion, Plan
Commission recommended approval of the definition as presented, consistent with the
definition Council approved in the Liquor Ordinance. The definition is as follows:
RESTAURANT WITH LIQUOR. An establishment where the principal business is
serving meals prepared in the kitchen of the establishment for consumption on premises.
A full menu, including entrees, and appropriate side dishes, and a fully staffed and
operational kitchen shall be required at all times sales are being conducted or until 9:00
p.m., whichever occurs first. During the above times when meal service is required, the
sale of alcoholic liquor shall be incidental to the sale of meals. Restaurants shall have a
full kitchen with adequate facilities to prepare, cook, and serve meals for its guests,
commonly interpreted as having cooking stations (examples include baking, grill, and
sauté). Equipment shall be of sufficient type and size to prepare and cook meals. The
establishment shall have a seating capacity for the service of meals at tables and/or
counters for not less than 30 patrons at the same time.

PUBLIC COMMENT
John Lukasik, 1229 E. Wellwood Drive, Lockport, addressed the Council. He thanked the
City of Lockport for a job well done on the reconstruction of his street in the Woodlands
Subdivision.
PZC CASE 2014-008: 312 E. 11TH STREET BUILDING ADDITION
Community and Economic Development Director Pam Hirth presented her Memo dated
July 9, 2014.
St. John Episcopal Church, located at 312 E. 11th Street (northest corner of Washington
Street and 11th Street), is seeking approvals from the City that will enable them to
construct an addition on the accessory building east of the Church.

Per the Development Code any additions to a Church must be approved by City Council,
upon recommendation from Plan Commission. From city Council they are seeking
approval of the Site Plan, and Building elevations.
They are proposing an addition of approximately 1,500 square feet (1,475) to the
accessory building, brining it closer to 11th Street. An enclosed walkway/vestibule is also
being added which will provide a covered connection between the Church and accessory
building. Access to the walkway/vestibule is from the parking lot.
The existing accessory building is wood and the Church is stone. Per the proposal, the
exterior of the accessory building (existing portions and the addition will consist of a
cultured stone base (similar to stone on the Church) up to the window sills and the
remainder of the façade will be EIFS.
Concurrent with the Plans for the addition, the Church applied for a variance to reduce the
setback along 11th Street (corner yard) from twenty feet to ten feet. At the July 8th
Meeting, the Plan Commission held a Public Hearing on the variance. They found no
hardship or unique circumstance that is not generally applicable to other property in the
same zoning district and determined the addition should maintain the established setback
on the lot, which is the same setback as the Church.
To provide access to the addition, the Plans show a paved drop-off area in the right-ofway on 11th Street. There was discussion at Plan Commission regarding removal of this
area because such areas are no longer allowed in public right-of-way. Following the Plan
Commission Meeting, the Church decided to no longer seek approval of the drop off area.
Due to the variance not being granted and the building having to be setback further from
11th Street, the Church is going to remove the entry door on that side of the building
addition so the drop-off area is no longer necessary.
The applicant will need to submit revised plans for the next City Council Meeting that
reflect removal of the 11th Street paved area and increased building setback. There
wasn’t sufficient time between the Plan Commission Meeting and Packet submittal for the
July 16th Committee of the Whole Meeting to submit revised plans.
Matt Plum, Vicar at St. John’s the Evangelist Church, 312 E. 11th Street, Lockport
addressed the Council. He discussed their intentions of the proposed Building that was
denied. A discussion ensued.
Chris Cozzo, Developer and Consultant with the Church for four years, addressed the
Council. He explained why the building couldn’t be rotated and explained to the Council
why they were seeking a variance.

Mr. Cozzo stated they will revise their Plans to meet the request of the Plan and Zoning
Commission, and asked for clarification if they have to go back to the Plan and Zoning
Commission after they revise their Plans.
Attorney Caneva answered “No. It does not go back to the Planning Commission.”
Alderman Colarelli asked “Mayor, can I just make a comment on this too, just for the
record?”
Mayor Streit answered “Yes! Of Course!”
Alderman Colarelli said “ Based on what I see here and I do respect the Plan Commission
and their decision, they are capable people, no doubt. The one thing though that I have
an issue with is I understand that there is law, and I understand there is Building Codes
and things like that, they are necessary to create uniformity and predictability in
Development. But, it is hard to do that in a town like ours. To adhere strictly to some of
those when you have an older part of town and a newer part of town, like the Mayor said
when you have an older part of town that has buildings jutting in and out, here, there, and
everywhere, you’re really not accomplishing your end if you’re strictly adhering to some of
these. I believe in a little bit of discretion in this particular case. I would have liked to
have seen it. I respect the Plan Commissions decision. If we had some authority over
this I would at least like to talk to the Plan Commission to hear their thoughts, and then I
would probably be somebody that could consider that variance. But, I just wanted to let
you know what my thoughts were on the issue and that I understand why you want to do
it, especially for a Church that is going to beautify and improve and enhance the
neighborhood. I think this is a place where we could use a little discretion and change it
up a little.”
ACTION: MOTION TO BRING THE REVISED PLANS TO THE AUGUST 6, 2014 CITY
COUNCIL MEETING FOR APPROVAL.
VERBAL PROJECTS UPDATE
City Administrator Benson updated the Council on current projects. He mentioned the
City’s new website. He mentioned the City will be going out for an RFQ for insurance
broker’s services. This will be coming out in August. He will be recommending a three
year agreement this time. A Memo will be forthcoming. This is a set fee base and not a
commission one. The other item is the City is planning on participating in the Will County
Governmental League for Electric Aggregation.
Finance Director Brown further explained about the Electric Aggregation.

SPECIAL SERVICE AREA PHASES 2 AND 5 LAGO VISTA/ORDINANCE NO. 14-020
Attorney Caneva presented his Memo dated June 26, 2014 and updated on July 9th,
2014.
The City of Lockport in the last 13 years has instituted a “Dormant” Special Service Area
in all new subdivisions. A Special Service Area is designed to protect Homeowners
within those subdivisions who’s Homeowners Associations that fail to take care of
common improvements within those subdivisions. For example, if a Homeowners
Association fails to maintain a detention pond in its subdivision, the City can through the
Special Service Area process levy a Special Tax specifically to the Residents of the
subdivision to pay for the costs of maintaining the detention pond. This is a Dormant
Special Service Area because the tax is only levied when the Homeowners Association
fails to maintain the common areas of the subdivision and for no other purpose. Since the
City began this process, there have been no levies under any Special Service Areas
started by the City. The Lago Vista Annexation Agreement contains provisions in which
allows the City to promulgate Special Service Areas within it. Special Service Areas have
been formed for Phase 1 and 2 of the Development but not for Phases 3 and 5.
After Ordinance No. 14-020 is passed, the law requires that a Public Hearing be held to
consider the establishment of the Special Service Area within 60 days after the adoption
of Ordinance No. 14-020. Notice of the Hearing must be published in a newspaper at
least 15 days before the Hearing date. Additionally, notion must be given by depositing in
the United States Mail addressed to the person or persons in whose name the general
taxes for the last preceding year were paid on each property lying within the Special
Service Area. This notice shall be mailed at least 10 days prior to the time of the Public
Hearing. In the event taxes for the last preceding year were not paid, the notice shall be
sent to the persons last listed on the tax rolls prior to that year as the Owner of the
property.
A petition to object to the formation of the Special Service Area signed by 51% of the
electors and 51% of the Owners of the property must be filed with the City Clerk within 60
days of the Hearing. However, it is important to note that Developer pursuant to Section
11 of the Annexation Agreement gave the City the right to create Special Service areas
and waived any objections to its formation. The Annexation Agreement is a Contract that
binds both parties to the terms of the Agreement and also any Successors in interest
which means the Homeowners as well.

FAÇADE GRANT APPLICATION – 928 S. STATE STREET & 932 S. STATE STREET
Director of Community and Economic Development, Pam Hirth presented her Memo
dated June 25, 2014.
Rich Rolih, Owner of two buildings downtown (928 S. State Street and 932 S. State
Street), is requesting Façade Grant money from the 2014 Stub Year Budget to replace
2nd floor windows on the front and back of both buildings. The proposed work includes
replacement of three arch windows on front façade and three square windows on the rear
façade. The work is within the scope of the program. Window replacements on the rear
façade typically aren’t eligible for grant money unless the façade faces a public space. In
this case, the rear facades are visible from the Hamilton Street Parking Lot. The windows
were approved by Heritage and Architecture Commission on June 19th.
Because there are two buildings with separate PIN numbers, each building is eligible for
the Grant. In this Stub Fiscal year, Staff anticipates $20,000 being budgeted for the
Façade Grant Program. Based on the Contractor estimates, the anticipated Budget for
each building is $18,325. The City contribution requested is $18,325 ($9,162.50 for 928
S. State Street and $9,162.50 for 932 S. State Street). If approved as requested, there
will be $1,675 remaining in the Façade Grant Budget through the end of 2014. Money will
not be paid out until work is completed and proof of payment is provided. As you may
recall, earlier this year City Council increased the maximum grant amount per property to
$10,000 (previously $5,000).
ACTION: MOTION TO ACCEPT THE FAÇADE GRANT APPLICATION FOR 928 S.
STATE STREET & 932 S. STATE STREET.
NEW BUSINESS
Alderman Smith stated as long as Joe Findlay talks about the branches, he feels they
should revisit some of the Ordinances regards to the branches that are piled in the
parkway that seem to get moved into the street. He feels this is a huge concern for traffic
as far as driving around the branches. Leaves are a concern too. He would like to come
up with some solutions and how we can work, maybe have a tool out there for Tom Fulton
to use, maybe an Administrative Ticket or whatever to get the branches off the streets.
A discussion ensued. Joe Findlay explained the Street Departments procedure. He
understands Residents get frustrated because their branches or leaves are not picked up
right away. This will be further discussed at the next Staff Meeting.
Administrator Benson said we can maybe Budget and increase the amount of overtime to
cover something like this in the event of a storm.

Alderman Colarelli discussed a Resident calling him over an issue about the Parking
Ordinance. 3:00 to 6:00 a.m. His concern is he has to work early in the morning and he
has to shuffle his cars around in his driveway and he has to push a car out on the street
between 5:00 and 6:00 a.m. He was wondering if it would be possible for us to shrink the
Ordinance to 3:00 to 5:00 a.m. it would still accomplish the end goal which is to keep
disabled vehicles off the street and allow the police to assess the neighborhoods and
know what cars belong where. At the same time it will give our Residents who have to
move things around early in the morning for work to do that without getting a ticket when
they get back from work. Alderman Colarelli asked the Aldermen to talk to the Chief on
the side and maybe see if this is something we could bring up as an amendment?
It was mentioned the cost would be an issue.
Mayor Streit talked about the Summer Art Series, Roxy Theatre Movie, Pop-Up Shopping,
Gala event, High Tea, Battle at Legacy Park.

NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY
OF LOCKPORT, WILL COUNTY, ILLINOIS:

SECTION ONE: INCORPORATION OF RECITALS
The recitals set forth above and all Exhibits to this Ordinance are incorporated
herein as if fully set forth in this Section one.
SECTION TWO: PUBLIC HEARING
A public hearing shall be conducted regarding the creation of the SSA and the levy
of taxes therein by the Mayor and City Council of the City of Lockport on October 1,
2014 at 7:01p.m. The public hearing shall be conducted at the Central Square
Building, 222 E. 9th. Street, 3rd Floor Board Room, Lockport, IL. 60441.
SECTION THREE: PUBLIC HEARING NOTICE
Notice of the public hearing shall be given by publication in a newspaper in general
circulation in the City, at least fifteen (15) days prior to the public hearing. Notice of
the public hearing shall also be given by depositing same in the United States mail
not less than ten (10) days prior to the time set for the public hearing addressed to
the person or persons in whose name the general taxes were paid for the last
preceding year on each property situated within the SSA Property. The form of
notice shall be as set forth in Exhibit “C” attached hereto.
SECTION FOUR: RATE OF TAXES
Special Service Area Taxes levied in the SSA Property shall be in addition to all
other taxes and shall be levied upon the equalized assessed value of the property in
an amount not to exceed an annual rate of 50 one-hundredths percent (.50% or .50
cents per $100.00) of equalized assessed valuation.
SECTION FIVE: NATURE OF THE TAX

The Special Service Are Tax will be utilized to fund “ special services” as defined by
the Illinois Special Service Area Tax Law 35ILCS 200/27-5 et.seq including by way
of example and not as a limitation the maintenance, repair and replacement of entry
monuments, landscaped easements, and stormwater maintenance areas including
aerators with the SSA Property.
SECTION SIX: REPEALER
All ordinances or parts of ordinances in conflict with any of the provisions of this
ordinance shall be, and the same are hereby repealed.
SECTION SEVEN: SEVERABILITY
This Ordinance, and every provision thereof, shall be considered severable, in the
event any court of competent jurisdiction may find and declare any word, clause,
sentence, paragraph, provision or section or part of a phrase, clause, sentence,
paragraph, proviso or section of this Ordinance is void or unconstitutional, the
remaining words, phrases, clauses, sentences, paragraphs, and provisions and
parts of phrases, clauses, sentences, paragraphs, provisions and sections not ruled
void or unconstitutional shall continue in full force and effect.
SECTION EIGHT: EFFECTIVE DATE
This Ordinance shall be in full force and effect from and after its passage and
publication. The City Clerk of the City of Lockport shall certify to the adoption
Of this Ordinance and cause the same to be published in pamphlet form.

NOTICE, is hereby given by the Corporate Authorities of the City of Lockport that

BACKGROUND/HISTORY
The Will County Electric Aggregation Group, as a subordinate of the Will County Government
League, has for its participating municipalities an Opt-In Electric Aggregation Program for
residential and small commercial retail customers.
The purpose of the group is to secure the lowest electricity rates possible for the group’s
customers. By utilizing the economies of scale as one purchasing group, the savings will
minimize the already increasing electricity rates Com Ed is advertising.
The City of Lockport did participate in our own opt-in program in 2012 after the initial
referendum failed during the primary elections. The citizens of Lockport voted in the November
2012 referendum to give the City of Lockport the authority to approach the marketplace on
behalf of the residents of the City of Lockport. To maximize savings to consumers, the City of
Lockport entered in to an agreement with the Will County Electric Aggregation Group
(WCEAG).
When the Will County Electric Aggregation Group first went to market in 2012, they selected
FirstEnergy as the supplier for participants at a rate of $.0483/kwH. This was substantially lower
than the rate ComEd was providing ($.08302/kwH), and residents saved a considerable amount
of money. Because the City of Lockport missed out on the original opt-out program with the
WCEAG and instead had to run an opt-in program, the City of Lockport went out on our own
and selected Verde Energy through a competitive bidding process to represent the participating
residents at a rate of $.04993/kwH.
To date, the WCEAG saved Will County participants a combined total of $25.5 million over a
two year period, or an average of $500-$530 per household.
PROS/CONS/ALTERNATIVES (IF APPLICABLE
The Will County Electric Aggregation Group and the Will County Governmental League voted
14-2 to accept the winning proposal submitted by the Homefield Energy for a 36-month contract
at the rate of $.06996/kwH for the first 24 months and $.06850/kwH for the final 12-month
period. The Homefield Energy rate represents a 6% savings over the current ComEd rate of
$.0742 through May 15, 2015. The rate includes the state-mandated amount of 15% energy from
renewable sources, but the group opted not to pursue the higher cost renewable options. Prices
for energy have gone up considerably statewide, largely due to the losses incurred by the energy
suppliers during the polar vortex this past year. To meet demand during the extremely cold
temperatures, many of the suppliers had to purchase additional energy from outside sources at a
rate higher than what consumers were paying. Due to this reason, the previous supplier of
FirstEnergy chose not to participate in the RFP.
As part of the agreement, we lock in this rate for 3 years guaranteed. In contrast, ComEd has the
ability raise rates anytime on regular residential and small commercial customers without a
contract.
Upon City Council approval, opt-out mailers will be distributed for a 21 day period. Final
approval of residential and commercial account participation will be executed, and in September
we will begin the enrollment process for all eligible participants. After the 21 day opt-out period,
residents can decide to opt-out of the program at any time with no penalty. Residents who optout of the program are unable to rejoin the agreement after they have opted-out.
RECOMMENDATION
The Verde Energy contract for Lockport residents and small commercial customers is coming to
an end, without a new contract, all those effected will have to go back to the Com Ed published
rate, and after the prior increases imposed, is currently at $.0742 through May, 2015 with
potential increases pending. To avoid this increase, it is recommended that the City Council of
Lockport renews the agreement with the Will County Electric Aggregation Group to lock-in the
favorable price for 36 months beginning in November 2014.
Administration recommends that the City Council authorize the participation in the WCEAG by
adopting the Ordinance Authorizing Participation.

ACCEPTANCE OF INTERGOVERNMENTAL AGREEMENT
AND EXTENSION OF AGREEMENT
WHEREAS, the Will County Electric Aggregation Group entered into a certain
Intergovernmental Agreement (copy of one executed Agreement is attached hereto and made a
part hereof) that were signed by various Municipalities at separate times during the months of
May and June of 2012 (the “Intergovernmental Agreement”) ; and,
WHEREAS, The City of Lockport did not execute the Intergovernmental Agreement
because the majority of its electors initially did not vote in the affirmative on the electric
aggregation referendum; and,
WHEREAS, subsequently the majority of the electors of the City of Lockport voted in
the affirmative on the electric aggregation referendum at a subsequent Election; and,
WHEREAS, each of the current members of the Will County Electric Aggregation Group
have passed the Referendum and otherwise coupled with the pre and post Referendum
requirements as set forth in the Intergovernmental Agreement; and
WHEREAS, the members of the Will County Aggregation Group wish to again solicit
bids, or requests for proposals, for electric aggregation for the group as a whole;
WHEREAS, the Will County Electric Aggregation Group wishes to extend the
Intergovernmental Agreement for the term of a second contract with an Alternate Retail Electric
Supplier and to otherwise have the Intergovernmental Agreement remain in full force and effect;
and,
WHEREAS, The City of Lockport requests to participate in the Will Electric
Aggregation Group,
NOW THEREFORE for good and valuable consideration, the receipt and sufficiency of
which are acknowledged by the Parties hereto BE IT AGREED as follows:
Section 1. That the City of Lockport accepts of all the terms of the Intergovernmental
Agreement with the Will Electric Aggregation Group. except that the term of the
Intergovernmental Agreement as set forth in Section 11 thereof is extended for the term of the
next contract agreed to with an Alternate Retail Electric Supplier which shall be for a term period
of not to exceed three (3) years.
Section 2.

BACKGROUND/HISTORY
At the last Committee of the Whole meeting, Staff presented the façade grant
application for 928 and 932 S. State Street. The building owner requested grant monies
to replace windows on the both the front and back of the building. After Council
discussion, it was determined that back windows would not be eligible. Staff was
directed to revise the grant request so it reflects window replacement on the front
façade only and place it on the next City Council agenda for action.
Revised estimates for the front windows show the cost as being $11,932 for each
building, for total project costs of $23,864. Therefore the total grant request is $11,932
($5,981 for 928 S. State and $5,981 for 932 S. State Street, respectively).
Due to the fiscal year, the work must be completed by December 31st in order to be
eligible for reimbursement. The City will not reimburse the property owner until the work
is complete and evidence of payment has been provided.
RECOMMENDATION
Staff recommends approval of the request in the amount of $5,981 for each building,
being half the cost of improvements.

BACKGROUND/HISTORY
This item was not considered directly at a Committee of the Whole meeting. However,
in February, when the discussion was held to increase the amount of the façade grant
from $5,000 to $10,000, the Dairy Queen proposal was the catalyst for Staff to
recommend an increase the amount of matching grant. The owner, Christina
Bergbower, was present at the meeting and provided an overview of her improvements
which included not only façade upgrades but the need to upgrade her existing freestanding sign. At that time, Council appeared receptive to the Dairy Queen receiving
the increased grant amount. Since Lockport’s Dairy Queen is essentially a seasonal
business, the owner is seeking approval as soon as possible in order to begin
improvements during this business season. Therefore staff is asking the Council to
consider this for direct action.
The owner is seeking a façade grant in the amount of $10,000. Improvements to the
property will be extensive and Ms. Bergbower is investing over $40,000 in the project.
The mansard roof will be removed and replaced with a metal parapet roof. Fiber
cement siding will be installed on all four elevations and there will be a brick half wall on
portions of three building walls. In addition to the improvements to the building, a wood
dumpster enclosure will be installed and the existing pole sign will be lowered with a
brick base added. This project will have a positive impact along the 9th Street corridor.
Given the remaining balance in the Façade Grant program ($8,062), this application will
be the last one eligible for funding in this stub budget and will need to be supplemented
by additional cost savings ($1,938) found in the Department’s budget. Staff has been
working with the Finance Department to ensure the needed funding is available without
impact to other portions of the budget including general operations.
RECOMMENDATION
Staff recommends approval of the façade grant in the amount of $10,000 as the
proposed improvements are eligible under the Program and the improvements will
enhance the 9th Street corridor.

The IL-7 / Thornton Street Intersection Improvement Project is being constructed
by the City of Lockport, with the help of special assessment funds and developer
contributions. As part of the Special assessment process, the project must be
awarded and overseen by the Board of Local Improvements.
We have been notified of a conflict between the existing 16-inch water main and
the proposed retaining wall. Attached is a memo from Robinson Engineering,
explaining in detail, the conflict and options for remediating the problem.
We also asked them to summarize the projected construction costs, which are
also attached. At this time it appears that the total construction and
engineering/testing costs will be under the current Special Assessment budget of
$2,250,000.00.
PROS/CONS/ALTERNATIVES (IF APPLICABLE)
The preferred option is to relocate ±220 feet of water main 7 feet to the north,
together with shifting the proposed/future sidewalk location 4 feet to the south
(aligns with the face of the new retaining wall and eliminates the need for
guardrail at the back of curb). This option will cost just under $60,000
(estimated). Since the original award included a contingency of nearly $84,000,
and we have had savings in other areas of the contract, estimated completion
costs remain under the current Special Assessment budget of $2,250,000.00
RECOMMENDATION
To approve the change order to relocate ±220 feet of 16” water main at a cost of
approximately $60,000.

As a follow-up to our discussions, we have prepared this memorandum to summarize the findings,
studies and recommendations to resolve the existing water main/proposed retaining wall conflict
uncovered during construction layout and after final JULIE/City locations were completed in the areas
of the proposed retaining walls along the south side of IL 7.
Proposed Improvements per Contract Plans:
 The area in question is adjacent to the proposed soldier pile retaining wall along the south side
of IL 7 and east of a private driveway (Station 85±00 to Station 86±40
 The proposed wall was to be location 10 feet behind the back of curb
 A future sidewalk was to be provide adjacent to the back of curb, necessitating guardrail (with
rub-rail) installation immediately adjacent to the curb and gutter
 At the time of the plan preparations (by Larson Engineering) it is our understanding that the City
notified the design engineer that the existing 16-inch water main was located ±4 feet behind the
proposed back of curb – thus providing a ±4-foot separation between the outside edges of the
existing water main and the proposed caissons.
 Proposed storm sewers serving the proposed roadway improvements were designed behind
the retaining wall.
Proposed Storm Sewer Adjustments:
 Prior to the determination of the water main/retaining wall conflict, the proposed storm sewer
behind the retaining wall was re-designed during construction to minimize the potential for
undermining the caisson supports. A construction cost saving of ±$4,000.00 is anticipated for
this yet-to-be-completed work.
Description of Conflict:
 Prior to start of construction, the existing 16-inch water main was field marked by the City.
 Prior to the start of excavation for the caissons, the preliminary layout of the caissons showed
an apparent conflict with the water main.
 Contractor was directed to pot-hole the existing water main at 4 locations.
 The existing water main horizontal and vertical locations were field surveyed and it was
confirmed that a majority of the existing water main was in direct conflict with the proposed
caissons for the retaining wall.
Options Considered for Conflict Resolution:
1. Relocate retaining wall SOUTH.
a. The maximum shift considered feasible, primarily due to the existing steep embankment
slopes, was 5 feet.
b. A 5-foot shift would provide a separation between the outside edges of the proposed
caissons and the existing water main of ±3 feet.
c. Shifting the wall would require an increased wall height of at least 5 feet.
d. Shifting the wall would likely result in embedment of the caissons into the existing
bedrock (original design of the caissons did not encroach into the bedrock)
e. The shift in the wall would require a new structural design of the walls/caissons by the
design firm.

f.
Steel beams for the south wall have already been cut, painted and made ready for
construction – likely necessitating a re-stocking cost for the contractor/City.
g. New, longer steel beams would have to be designed, ordered, painted and made ready
for construction.
h. A delay in construction of the wall of at least 30 to 60 days would likely occur. This work
is now on the critical path for the project completion and could result in extending the
project completion beyond this construction season.
i. Assuming that most of the caissons would extend into the bedrock, the additional
construction cost for this option could exceed $100,000.00.
2. Relocate existing water main NORTH & maintain proposed retaining wall location
a. The existing water main would be shifted to ±3 feet behind the proposed back of curb
(shift of ±7 feet) - ±220 feet of water main relocation plus 1 new valve in vault.
b. A minimum 5-foot separation results between the outside edges of the proposed
caissons and the relocated 16-inch water main.
c. While the proposed guardrail would appear to be in conflict with the relocated water
main, there is sufficient room between the proposed back of curb and face of retaining
wall (±9 feet) to shift the future sidewalk adjacent to the wall, provide a 5-foot sidewalk
and a ±4-foot grass parkway – thus eliminating the need for a new guardrail. [Note a
minor cost savings in the future sidewalk project would be realized due to the narrower
sidewalk.]
d. Since the retaining wall would be constructed per the contract plan location, an updated
structural design would not be required.
e. Subject to City concurrence, there would be a ±1-week delay in construction (once the
contractor is authorized to proceed and has re-mobilized).
f. The estimated additional construction costs for this option is ±$57,000.00 (which
includes the deduction of guardrail along this segment.
g. Option 2 is considered the preferred resolution of the water main/retaining wall
conflict.
Construction Cost Status
 Attached is a detailed summary of the approximate, projected construction costs for this project.
 Major changes affecting project costs:
a. Renegotiated unit cost (cost savings) for retaining wall handrail system (September
2013 determination)
b. Supplemental field survey and roadway alignment re-design to resolve conflicts
uncovered during pre-layout due diligence (October 2013 determination).
c. Additional 16-inch water main relocation due to field determination of insufficient cover
over existing pipe (May 2014 determination)
d. Additional driveway replacement at Enterprise Rental (item not included in contract

A RESOLUTION AUTHORIZING THE PURCHASE OF A 2014 ELGIN PELICAN
STREET SWEEPER
WHEREAS, the City Staff has determined the 1998 Elgin Pelican Street Sweeper and
the 2007 Elgin Pelican Street Sweeper have exceeded their useful life; and
WHEREAS, the City has received 2 quotes from the sole source vendor through 2
different purchasing cooperatives
NOW, THEREFORE, BE IT RESOLVED BY THE MAYOR AND CITY COUNCIL OF
THE CITY OF LOCKPORT AS FOLLOWS:
Section 1:
The City Administrator and staff is authorized to purchase a 2014 Elgin
Pelican Street Sweeper from Standard through the Suburban Purchasing
Cooperative for $189,513 minus trade in for the 1998 and 2007 Elgin
Pelican Street Sweepers.
Section 2:
Effective Date: This Resolution shall become effective upon passage,
approval and publication in book and pamphlet form as provided by law.

BACKGROUND/HISTORY
At the July 16th Committee of the Whole meeting staff was directed to place this case on
the August 6th City Council agenda for action. There are a few changes the Church
must make to the development plans before they can be approved. The Church has
requested the case be tabled to the August 20th meeting, allowing them time to
complete the revisions.
