MINISTER OF FINANCIAL SERVICES
On behalf of the Government of The Commonwealth of The Bahamas,
I wish to extend a heartfelt welcome to all delegates and distinguished
presenters to this STEP Caribbean Conference.
This Government considers the Society of Trust and Estate Practitioners
as a valued partner in the promotion and development of the financial services industry in The Bahamas. Additionally, this Government is
deeply committed to engaging in public-private partnerships. This collaborative approach will ensure that The Bahamas maintains its position
and reputation as a preeminent international business centre.
The Ministry of Financial Services is pleased to participate in this STEP
Caribbean Conference as the presenting sponsor under the theme “Exploring Possibilities”. The thematic focus of this conference is a timely
one given the inherent nature of the financial services industry. In order
to maintain The Bahamas’ competitiveness in this ever evolving industry,
the government must always be forward looking; gauging the existing
global marketplace and its current conditions with a view to being flexible and capable of creating policies and initiatives that will allow the
industry to address any challenges that it may face with the global financial landscape.
This Government takes a comprehensive approach to ensuring that The
Bahamas is able to take advantage of new possibilities that will enhance and further develop the Bahamas’ second most important pillar
of the economy.
The Bahamas also is constantly reviewing its regulatory regimes to ensure that it is in keeping with international standards while simultaneously giving the industry the flexibility to be innovative and one step ahead
of the competition.
I look forward to engaging with each and every one of you during the
course of this Conference. I am certain that the caliber of presenters and
the opportunity to share and learn from each other’s experience and
perspectives will forge new paths to new possibilities within the financial
services sector.

Dear Delegates:
After making history last year, it seems that I am doing so once again! I am not with you in Nassau this year because I am
fulfilling another commitment as STEP Chair by attending STEP South Africa which unfortunately clashes with STEP Caribbean
this year. With a full roster of STEP events around the world, it is inevitable that despite everyone’s best efforts these clashes
do occur from time to time. It is the first time that I will not attend the Caribbean Conference but I am reassured that the STEP
Executive is well represented by Deputy Chair John Lawrence.
I know that the Bahamas Committee have planned an exciting programme for you that will not only meet but exceed
the standards that we have set for the conference in the past. As trust and estate practitioners around the world face the
continuing and even burgeoning challenges of meeting new global standards on compliance, it is appropriate that many of
the conference presentations will focus on strengthening your competence in this regard. Several well-regarded international
personages will address different aspects of the challenges and offer key insights into how international finance centres
should be positioning themselves as we face the introduction of FATCA and Global Forum reporting requirements.
STEP Worldwide has set itself the mission of making the TEP brand the gold standard of the profession globally, and as part
of that mission has committed to supporting members everywhere by keeping us all well informed and better equipped to
carry out in our own jurisdictions the role of liaising with our governments as they develop national strategies for meeting their
international obligations in these matters.
It is trite but true to say that these are challenging times. The results of the STEP 2012 survey have been instructive. Globally
members want more and better education offering and more support for their careers and profession. Many are asking
that STEP become a promoter and facilitator. Many more accept that STEP may well need to become a regulator of sorts
providing more comprehensive disciplinary and enforcement mechanisms for those members of the profession who are
possibly not already regulated in some other way. None of this work is possible without many hours of volunteer service on
the part of STEP Members everywhere. In the Caribbean and Latin America we find that there are many volunteers who work
very hard to make STEP a success and commend especially the STEP Caribbean Conference Steering Committee who put on
this superb conference that always leaves us re-energised for the challenges ahead.

It is with much pride and enthusiasm along with the Steering Committee that I welcome each and every one of you to this
our STEP Caribbean Conference’s 16th annual conference.
It was ten years ago that we as a jurisdiction welcomed STEPCC to our beautiful island nation. We are proud to say that the
STEP Caribbean’s inaugural event was held in the Bahamas in 1989, by visionaries who saw the impact and potential that
such a conference would bring to the region and globally to the industry. To them we say “Thank you” for the vision!
The chosen theme for this year’s conference “Exploring the Possibilities” allows us to share with you Solid Solutions to
sustain your business, to grow and to diversify during this demanding and ever challenging period. The cross section
of solutions that will be proposed “will bring a new view and a whole new world of possibilities for the Trust world both
regionally and globally”.

PROF. KEVIN DUTTON, AUTHOR
Kevin Dutton was born in London in 1967. He has a Ph.D. in psychology, and is an expert on the science
of social influence. He is a research psychologist and honorary affiliated member of the Calleva Research
Centre for Evolution and Human Sciences, Magdalen College, University of Oxford.
Kevin’s first book, Flipnosis - The Art of Split Second Persuasion, first published in 2010 and since
translated into 18 languages, documents his quest - from the political genius of Winston Churchill to the
malign influence of some of the world’s top con artists - for the psychological ‘DNA’ of persuasion.
His second book, The Wisdom of Psychopaths - Lessons in Life from Saints, Spies and Serial Killers was
published in the UK (William Heinemann) in September 2012 and in the US (Farrar, Straus and Giroux) in
October 2012. In it, Kevin explores the positive side of being a psychopath, and discovers, first hand, in a
ground breaking ‘How to make a psychopath’ experiment, what it’s like to be one. The effects have since
worn off.

PROF. JASON SHARMAN, GRIFFITH UNIVERSITY
Jason Sharman is a Professor at Griffith University in Brisbane, Australia with the Centre for Governance
and Public Policy. Sharman’s research is focused on the regulation of global finance, especially as it relates
to money laundering, tax, corruption and offshore financial centers. He has worked as a consultant with
the World Bank, Asian Development Bank, Commonwealth Secretariat, Financial Action Task Force, AsiaPacific Group on Money Laundering and in the private sector. His work has been featured in media outlets
like the Economist, the Financial Times and the New York Times, and has been taken as evidence by the
United States Senate Permanent Subcommittee on Investigations. Sharman’s seventh book, Global Shell
Games, co-authored with Michael Findley and Daniel Nielson, reports the results of an exercise based on
impersonating 21 fictitious customers and soliciting offers from over 3700 corporate service providers in
182 countries for prohibited anonymous shell companies.

Julia Abrey specialises in Elder Law and Court of Protection matters and is head of the Withers’ elder law
team. She has a particular interest in international and cross border mental capacity issues. She is chair
of STEP’s multi jurisdictional Mental Capacity Special Interest Group and a regular lecturer on elder law
topics.
A contributor to a number of books including the Law Society’s Elderly Client Handbook, she is a

Tara E. Frater is a Senior Associate in the Barbados office of Lex Caribbean, a pan-Caribbean regional law
firm. She read law at the University of the West Indies (Cave Hill), where she was a UWI Open Scholar. She
completed her legal studies at the Norman Manley Law School and was first admitted to practice in 2003.
Prior to relocating to Barbados in 2010, Tara practised at Walkers and Harney, Westwood and Riegels,

Donal joined the OECD 10 years ago. Currently, he is Deputy Head of the Global Forum Secretariat
working in a multidisciplinary team of dedicated professionals to assist the Global Forum in carrying out
its mandate.
The Global Forum is charged with monitoring and peer review of the implementation of the international
standards of transparency and exchange of information for tax purposes. It has published around 60 peer

HELEN HATTON, ANGUILLA FINANCIAL SERVICES COMMISSION
Widely recognized as the prime architect of the modern Jersey regulatory regime, Helen Hatton retired
as Deputy Director General of the Jersey Financial Services Commission in May 2009 having led the
implementation of regulatory development in the island from its blacklisted state in 1999 to achieving one
of the worlds, best IMF evaluation results.
She established Sator Regulatory Consulting which now undertakes assignments for a range of international
standards setting bodies, governments, regulatory authorities and leading financial services businesses,
including the World Bank, IMF and UK Foreign & Commonwealth Office.
Current regulatory authorities’ clients include the Central Bank of Aruba and the Financial Services
Commissions of Anguilla and the Cook Islands. Financial institution clients include banks, insurance
companies, securities, trust and funds sector businesses. Educated at Hurst Lodge, Sunningdale and St
Wilfred’s, Exeter followed by Plymouth University, Mrs Hatton lectured in Business Studies in further and

Mrs Hatton was appointed director of enforcement to the Isle of Man Financial Supervision Commission in

Edward has a broad Chancery practice with a particular interest in private client work. He has experience
in advising and acting in relation to applications for directions regarding the proper construction of trust
instruments and wills and for the removal and substitution of trustees, executors and administrators.
He is also regularly instructed in relation to breach of trust claims, challenges to the validity of wills and
claims brought pursuant to the Inheritance (Provision for Family and Dependants) Act 1975, as well as
professional negligence disputes arising in these areas.
Edward has appeared in all Divisions of the High Court, in the Court of Protection and in the Court of
Appeal. He also undertakes a wide range of non-contentious drafting and advisory work in relation to
trusts, wills and estates and ancillary tax issues.
Outside the private client sphere, Edward’s practice encompasses all areas of insolvency law, land law and

Jack is a partner and head of Walkers’ Commercial Litigation and Dispute Resolution Group in the British
Virgin Islands. He has appeared as leader or instructing solicitor in the major BVI cases over the past 10
years and has a wealth of experience in BVI litigation. ​
Jack was first admitted as an attorney-at-law in Barbados, but has been practising in the BVI since 1992. ​
Jack is a member of the Barbados Bar Association and the BVI Bar Association, STEP, and the
International Bar Association. He was a member of the committee that drafted revisions to the BVI trust
laws (including VISTA) in 2003 and he remains a member of that committee. ​

Andrew has been working in the estate and Inheritance planning industry for 28 years in Guernsey,
Switzerland and The Bahamas. Andrew advises and coordinates advice to clients and their family offices
on a range of structuring projects which include legal and tax issues and selecting investments and
investment managers. In 2004 he established International Protector Group Limited (IPG) as a support
to family offices specializing in Private Trust Companies, Trusts and Foundations, Protectorships and

Andrew is a past Chairman of The Association of International Banks & Trust Companies (AIBT) in The

Bahamas as well as the review of the Trust and Purpose Trust legislation.
LAWRENCE LEWIS, DELOITTE
Lawrence is a Partner with Deloitte in The Bahamas with more than 18 years of professional experience in
public accounting, risk advisory and management consulting services. He leads Deloitte’s Enterprise Risk
Services practice in the Caribbean and serves as the Foreign Account Tax Compliance Act (commonly
known as FATCA) program leader for The Bahamas and Turks & Caicos Islands. In his FATCA role, he
helps financial institutions understand FATCA, assess its implications for their organizations and develop
approaches to respond. Lawrence works as a part of Deloitte’s network of FATCA experts across the
Caribbean, US and globally, and is a frequent speaker on the topic in the region. He also has broad
experience helping organizations assess, design and implement governance, risk and compliance
programs, improve operational performance and performing independent audits. Lawrence has a variety
of clients across the financial services industry including the commercial banking, private banking and
wealth management, investment funds and insurance.

GEORGE LYALL, BOND DICKINSON LLP (REPRESENTING STEP)
George qualified as a Scottish Solicitor in 1983 and a Scottish Chartered Accountant in 1989. Having
spent nine years at Ernst & Young in Edinburgh, he moved to Newcastle in 1994 and joined Dickinson
Dees and subsequently re-qualified as an English Solicitor. Dickinson Dees merged with Bond Pearce
in 2013 to become Bond Dickinson LLP, which has offices in London and seven other cities throughout
England and Scotland.
George has spent 30 years specialising in providing advice to individuals and their charitable and private
trusts. He has been involved in giving advice to families in relation to legal and financial issues including
taxation, succession planning and acting as an Attorney/Executor and/or Trustee. He has particular
expertise in capital tax planning.
George joined STEP in 1995 and joined the Branch Committee of the North East and Cumbria branch as
an ordinary committee member, taking over the programme directorship and spent four years as Chair.
He had a period of four years on Worldwide Council in the early 2000s and thereafter, joined the England
and Wales Regional Committee serving two years as Deputy Chair and two years as Chair. George was
re-elected to Worldwide Council in 2008 and joined the newly formed Worldwide Board of Directors in
December 2010. His period on both was extended following elections late last year.
SEAN MCWEENEY QC, GRAHAM THOMPSON & CO.
Sean McWeeney QC, a former Attorney-General of The Bahamas (1989-1992), is a senior partner in
the law firm of Graham Thompson & Co., and a specialist in trusts and estate planning, corporate and
banking law. He has been consistently ranked as a first-tier trust lawyer by the leading international legal
rating publications, including Chambers & Partners, and the IFLR 1000. He is also widely acknowledged
as the leading expert in The Bahamas on the law relating to stamp duty, the second major source of
revenue in The Bahamas.
A member of the Bahamas Bar since March, 1978, Mr. McWeeney was appointed Queen’s Counsel (QC)
in 2009.
Mr. McWeeney has also served as Chairman of the Judicial Review Commission, a member of the
National Security Council of The Bahamas, Chairman of the Clifton Heritage Authority and presently
serves as the Chairman of the Constitutional Constitution.
In 1998, on the occasion of the 25th Anniversary of Bahamian Independence, the Government of The
Bahamas awarded Mr. McWeeney the Silver Jubilee Medal for “Outstanding Contribution to National
Development in the Area of Law”.
ANGELA MELE, RISK PASS
Angela Mele has 18 years in international financial services experience, having worked at Dundee Leeds
Management Services in Bermuda, then at the Cayman Islands Monetary Authority, and most recently with
Citi Hedge Fund Services (Cayman) Ltd. (formerly BISYS Hedge Fund Services (Cayman) Limited). Angela
left her position as Head of the Compliance & Training Division of Citi to take over managing RiskPass
Compliance+AML Ltd. (formerly Bodden Compliance & Training Ltd.) in December 2007.
Angela is a Certified Anti-Money Laundering Specialist (CAMS) and is a member of the International
Compliance Association (MICA). In addition, she holds a Bachelor of Arts Degree from the University of
Western Ontario, London, Canada, and a Bachelor of Education from York University, North York, Canada.
She has extensive experience running in-house compliance programs and performing internal AML/CTF
audits for various industries within the financial services sector.
Angela has designed and delivered anti money laundering, counter terrorist financing and business
continuity training sessions for various associations and companies both globally and locally. Such groups
include the Association of Certified Anti-Laundering Specialists (ACAMS), GovRisk, Central Law Training
(UK), the Cayman Islands Bankers’ Association, the Cayman Islands Monetary Authority and the Cayman
Islands Fund Administrators Association (CIFAA).
From 2005-2007 Angela chaired the ACAMS Caribbean Task Force and since 2006 has served as the

Ken has been with Rawlinson & Hunter Limited in the British Virgin Islands since 1997. He began his
offshore career in 1968 in the Cayman Islands before moving to Bermuda in 1972. He spent 18 years in
private banking and trust work with one of the major Bermuda banks, eventually becoming responsible
for all trust, investment and mutual fund administration in the Bermuda office.
Ken has been a frequent speaker at international trust and estate planning conferences, and travels
extensively to discuss the advantages of the British Virgin Islands and to visit clients and potential clients.
He has also had several articles published in professional journals.

Mr. Persaud is currently Chairman of Elara Capital PLC, an Investment Bank based in London and

America and the Caribbean. He was formerly a Senior Executive at UBS, J. P. Morgan, State Street and

Avinash D. Persaud is Emeritus Professor at Gresham College, London, a Senior Fellow at London
Business School, a visiting fellow at the Centre for Financial Analysis & Policy, Judge Institute, Cambridge
University, 2010 President of the British Association for the Advancement of Science (Section F) and past
Governor of the London School of Economics and Political Science. He was ranked as the number two
public intellectual in the world on the financial crisis by an expert panel for Prospect Magazine.
He is a member of the UK Treasury’s Audit Committee and a member of the National Council of
Economic Advisors in Barbados. He is a senior adviser to the Financial Services Law Reform Commission
in India. Formerly, he was the Chairman of the Warwick Commission on Financial Reform, the Chairman of
the regulatory sub-committee of the UN High Level Task Force on Financial Reform, co-chair of the OECD
EmNet and member of the Pew Task Force to the US Senate Banking Committee.
HON. L. RYAN PINDER, MINISTER OF FINANCIAL SERVICES, THE BAHAMAS GOVERNMENT
Honourable L. Ryan Pinder is a member of the Parliament of the Bahamas and has been appointed the
Minister of Financial Services in the Cabinet of the Bahamas. He has responsibility for policy making
relating to the Financial Services Industry, as well as the portfolios of Trade and Industry and the
establishment of the International Commercial Arbitration Center in the Bahamas. He is an attorney
by Profession having been admitted to the Florida Bar as a Board Certified Tax Attorney in 2000 and
Bahamas Bar in 2009.
Before assuming office as a Cabinet Minister in May 2012, Minister Pinder served as an International
Tax and Commercial Consultant in the firm of OL Private Corporate Counsel Ltd., his portfolio included
advising international corporations on merger and acquisition transactions, international commercial tax
structures and preparing international tax policy.
Additionally, prior to May 2012, Minister Pinder also served as a Tax Consultant at Becker & Poliakoff,
P.A. He was also the managing shareholder for the Nassau, Bahamas office. His responsibilities included
establishing the firm’s Nassau, Bahamas office, providing offshore tax planning for United States clients,
providing representation for United States clients conducting business in The Bahamas and providing
representation for Bahamian clients conducting business in the United States.
Prior to the positions identified above, Minister Pinder served as an Associate at Boies, Schiller & Flexner
LLP, in Miami, Florida; worked at Zack Kosnitzky, P.A, in Miami Florida; completed a clinical internship at
the Office of Dispute Resolutions at the National Association of Securities Dealers; and served as a law

Dr Holger Schmieding is Chief Economist at Berenberg in London. Before joining Germany’s oldest
private bank in October 2010, he worked as chief Economist Europe at Merrill Lynch, Bank of America
and at Bank of America-Merrill Lynch in London. Having studied economics in Munich, London and
Kiel, he holds a doctorate from the University of Kiel. Before taking up his first role as financial market
economist in 1993, he also worked as a journalist at “Westfälische Nachrichten” in Germany, as head of a
research group on east-central Europe at the Kiel Institute of World Economics and as a desk economist
at the International Monetary Fund in Washington, DC. In a systematic comparison of the accuracy of
German forecasts since 2002, Financial Times Deutschland has repeatedly awarded top honours to Dr
Schmieding, for instance as “forecaster of the Year” in 2011. Institutional investors rated him as the best
European economist in the 2013 Extel survey.

Vanessa is partner and Local Practice Head of the Private Client & Trusts group at Appleby Bermuda.

Heather L. Thompson is a partner at Higgs & Johnson in The Bahamas and has extensive experience in
international trust and company administration giving her a unique perspective in counselling individual

Paul is the senior partner of O’Neal Webster and head of the firm’s litigation department. He is one of
the most experienced litigation lawyers in the BVI and has appeared as counsel in the High Court, Court
of Appeal, and Privy Council (the BVI’s highest appellate Court) in many of the jurisdiction’s most notable
commercial cases of the past two decades. His standing as an advocate led to a temporary appointment
as a Judge of the Eastern Caribbean Supreme Court in 2001. In recognition of his record and reputation
as an advocate, Paul was appointed Queen’s Counsel on March 14, 2003.
Paul’s practice is concentrated in the areas of corporate insolvency and commercial litigation. He is a past
president of the BVI Bar Association and a member of INSOL.

Anita M. Bain holds a B.A. degree in Accounting from Taylor University, Upland Indiana. She is a Certified
Public Accountant (CPA) and a member of the Society of Trust and Estate Practitioners (STEP). She is
currently employed at The Central Bank of the Bahamas as a Senior Bank Examiner.
Prior to joining The Central Bank of the Bahamas she held directorship and senior management positions
in the offshore bank and trust sector at several institutions. Mrs. Bain began her career with the Big Four
accounting firm, Ernst & Young and spent seven years with the Firm working in both The Bahamas and
New York offices on audit engagements for a myriad of companies mainly in the financial services sector.
She left Ernst & Young having attained the level of Audit Manager.
Mrs. Bain currently serves as the Chairperson of STEP Bahamas Branch and as a Director of the Bahamas
Financial Services Board. She is also a member of The Bahamas Institute of Chartered Accountants and

Roberto is a Panamanian attorney and a Graduate of the Universidad Santa Maria la Antigua Law School

planning.
Prior to joining the firm, he worked at the Bank Superintendence of Panama, where he held the offices

Ivan is currently Chief Executive Officer for The Winterbotham Trust Company Limited. He graduated
from Bath University, UK with a BSc in Business Administration and holds an MBA from the University of
Manchester, UK, on the Wealth Managers, Fiduciaries and Trustees programme. During his degree he
worked at Merrill Lynch International Bank, Private Banking, in London. After graduating, Ivan moved
to Lima, Peru, joining the stock brokerage firm Seminario Sociedad Agente de Bolsa, as Relationship
Manager. During the same period he was a daily columnist for Financial Web, writing a Latin American
markets economic roundup report. He also acted as an Independent Consultant for The Winterbotham
Trust Company (Uruguay) S.A. developing business in Peru, before joining the Group full time in July

heads up Business Development for Winterbotham and from January 1st 2006 also the FX and Securities

Andrew Miller is based in Walkers’ Cayman Islands office and is head of the firm’s Global Trusts
Group. Andrew is also a member of the Steering Committee which drives the strategy of Walkers’ Global

Carlyle K. Rogers is a barrister by profession having studied law in London at Queen Mary and Westfield
College, University of London, where he obtained an LLB (Hons) degree in 2001 and with the University of
London (International Programme) from which he obtained an LLM degree in Corporate and Commercial
Law in 2005. He completed the Professional Legal Studies Course (the Bar) in Auckland, New Zealand
at the College of Law, studied Legal Ethics with the College of Law in New South Wales, Australia and
was admitted to the New Zealand High Court in 2011. He completed the Legal Education Certificate
(LEC) at the Hugh Wooding Law School in Trinidad in March 2013 and was admitted as a barrister of the

Associates of Arts degree in Business Management and a Bachelors of Arts (Summa Cum Laude) degree in
Business Administration (Finance) from the University of the Virgin Islands in 1995. He was also awarded an
MBA degree in Finance from the City University Business School (now the Cass Business School) in London
in 1996 where he studied as a Commonwealth Scholar.
Upon leaving the Albena Lake-Hodge Comprehensive School in 1989, he was employed as an Uncertified
Teacher at the then Road Primary School and Albena Lake-Hodge Comprehensive School until 1992.
He held the position of Deputy Director of the Anguilla Financial Services Commission, previously the
Financial Services Department of the Ministry of Finance, from 1999 – 2006 where he was responsible for
assisting in regulating the financial services industry.
Mr. Rogers has published and presented many papers concerning the Financial Services industry in

José Andres Romero is an international attorney with more than 20 years of professional experience

Chris McKenzie was elected as the chair of STEP’s Caribbean and Latin America region in 2010 after

team from 1996 to 2004 when he joined Walkers as a partner. He relocated to London at the end of 2012
and became a partner of O’Neal Webster in 2013.
Chris chaired the STEP committee, the proposals of which led to the enactment of the BVI’s VISTA trust
legislation and its regulations enabling exempt private trust companies to be set up. He has sat on
various BVI government appointed committees, is a frequent speaker at international conferences and
has written many of the leading works on British Virgin Islands trust and succession law. He is also a
former Vice President of the BVI Bar Association and is the Chair of its probate committee. He has been a
member of the Caribbean Conference steering committee since 1999 and is also admitted to practise in
Anguilla.
