The Board of County Commissioners met in their room in the Court House Annex

being a quorum, the meeting was called to order by the Chairman at 9:30 o 1 clock

The minutes of the April 22nd meeting were read, approved and signed.

Upon motion by Commissioner Cooper, seconded by Commissioner Talton, and
unanimously carried, Commissioner Surguine was authorized to attend q. meeting
of the Upper St. Johns Recreational Development Committee in Melbourne,
F l v rida, May 1, 1963.
Upon motion by Commissioner Cooper, seconded by Commissioner Talton, and
unanimously carried, Commissioner Freeman was authorized to attehd the
annual me e ting of the Orange Blossom Trail Association in Winter Haven, Florida,
May 15 , 1 9 6 3 .
Upon motion by Commissioner Cooper, seconded by Commissioner Talton, and
unanimously carried, Chairman Evans was authorized to attend a meeting of
the U. S. Chamber of Commerce in Washington, D. C., on April 30, 1963.

Housing
Act
Upon motion by Commissioner Cooper, seconded by Commissioner Talton, and
unanimously carried, Commissione~ S~rguine and County Engineer DeWitt were
authorized to attend a dinner meeting of the Mid-Florida Home Builders
Association at Rio Pinar Country Club on May 13th, at which time a 1961
amendment to the National Housing Act will be presented and discussed.

Upon motion by Commissioner Surguine, seconded by Commissioner Freeman,
and unanimously carried, the Chairman was authorized to execute the contract
with Apex Contracting Company, Inc. for construction of County Bond Project
No.28, Amber Road from SR 50 to Heather Road.

and unanimously carried, C. C. Hahn of the County H e alth Department
Mosquito Control Division was granted permission to attend the Florida
Anit-Mosquito .Association annual meeting in Jacksonville on May 5-8, 1963.
Upon motion by Commissioner Talton, seconded by Commissioner Freeman,
Kelly Park
and unanimously carried, statement from C & W Septic Tank Company in the
amount of $325. 00, covering pumping out of septic tanks and repairing of
drainfields at Kelly Park, was approved for payment.

unanimously carried, the Board approved transferring $1,200.00 from the
Road and Bridge Department Contingency Funds to Work done by Contract Funds
to cover Holden Avenue improvements, subject to approval by the Budget

hour having arrived, the Clerk read the notice.

Upon motion by Commissioner Surguine, seconded by Commissioner
Freeman, and unanimously carried, the stipulation was approved.

Mr. D. A. Cheney, Right of Way Agent, appeared before the Board and outlined
Easement Lake Corrine! stipulation requested by owners of property conditioning the granting of a

drainage easement for the Lake Corrine Outfall Canal as follows :

Upon motion by Commissioner Sur guine, seconded by Commissioner Freeman, and
unanimously carried, the stipulation was approved.

The Clerk reported that U. S. Treasury Bills amounting to $545, 000 in the
Project Acquisition Trust Fund mature on Thursday, May 2nd, and he recommend d
that $500, 000 be reinvested at the present market price.
Upon motion by Commissioner Cooper, seconded by Commissioner Freeman, and
unanimously carried, Clerk Arthur W. Newell was authorized to reinvest
$500,000 in U. S. Treasury Bills dated February 7, 1963 and maturing
August 8, 1963, for the Project Acquisition Trust Fund.

Upon motion by Commissioner Freeman, seconded by Commissioner Cooper,
and unanimously carried, Palmer Electric Company was authorized to install
light fixtures in theAgriculture Center Auditorium at a cost of $178.00, being
best price submitted.

Upon motion by Commissioner Cooper, seconded by Commissioner Talton, and
unanimously carried, the Clerk was authorized to advertise for one Bulldozer,
Angle Blade Crawler Type, 1963 Model, bids to be received up to 10:00 o'clock
A. M., May 20, 1963.
Zoning
Changes
Upon motion by Commissioner Surguine, seconded by Commissioner Talton, and
unanimously carried, all zoning changes approved by the Zoning Commission
on April 23rd were tentatively approved by the Board, such approval to become
final at the end of the appeal period on all changes on which appeals have not
been filed.

Upon motion by Commissioner Freeman, seconded by Commissioner Cooper, and
unanimou s l y carried, the Board granted permission for the Zoning Dire c tor,
the Zoning Attorney, and all members of the Zoning Commission, to att €$nd
a short course in Planning and Zoning in Tampa,,Florida, May 16-18, 1963.
Court House
Upon motion by Commissioner Cooper, seconded by Commissioner Surguine , and
unanimously carried, Custodian Van Cleef was authorized to purchase six yards
of top soil for the Court House grounds at a cost of $4. 00 per yar.d.

Upon motion by Commissioner Cooper, seconded by Commissioner Freeman, and
unanimously carried, the Board accepted a continuation certificate on the
Developer's Bond covering Magnolia Manor, and further, the Developers were
granted an extension of 90 days to complete paving and drainage facilities
in said subdivision.
Traffic S t udyj
Upon motion by Commissioner Cooper, seconded by Commissioner Surguine,
and unanimously carried, the State Road Department was resp e ctfully requested
to make a traffic study at the intersection of Lee Road and Wymore Road,
looking toward the possibility of installing some type of traffic control at this
intersection.
Right of Way l Upon motion by Commissioner Cooper, seconded by Commissioner Talton, and
unanimously carried, the following right of way agreement was accepted, and
the Clerk was instructed to have same filed for record:

Upon motion by Commissioner Cooper, seconded by Commissioner Freeman, and
unanimously carried, the Board adopted the following resolution:
"WHEREAS, the Board of County c .o mmissioners of Orange County,
Florida, entered into a contract with Michaels Engineering Company for certain
work to be done toward the surveying of a proposed road from SR 15 to SR 520, anc
WHEREAS, this agreement was forwarded to the State Road Department and
same was rejected, and
WHEREAS, subsequently an additional contract was entered into between the
same parties for the same work which agreement was also sent to the State Road
.
Department, and
WHEREAS, the rates and fees for work to be done by the firm of Michaels
Engineering Company were deemed unsatisfactory to the State Road Department,
and
WHEREAS, the schedule of rates and fees has been changed to comply with
the request of the State Road Department, and
WHEREAS, considerable correspondence has been had and conferences
have been held concerning the obtaining of Engineering Services by the Board
of County Commissioners of Orange County, Florida, to be paid for out of
Secondary Road funds of Orange County, and the attempts made by the Board
have apparently come to no avail,
NOW, THEREFORE, BE IT RESOLVED that the Board of County
Commissioners of Orange County, Florida, request the Han. A. Max Brewer,
Member of the State Road Department, to take such steps as he may feel
necessary to give to the Board of County Commissioners the precise
standards,
rate charges, estimates of cost, resolutions, agreements and documents of any
kind which may be required of the Road Board in order to accomplish the
obtaining of engineering services by the Board of County Commissioners of
Orange County, Florida, for the proposed road to run from U. S. 441 or SR 500
on the West to SR 520 on the East, using the approximate center line of the
now existing SR 528 and suggesting the same easterly and westerly as necessary,
BE IT FURTHER RESOLVED that it is important to Orange County that
th.e work be expedited as soon as possible and that continued delay will not be
in the best interest of Orange County.''

Notice having been gi v en that the Board of County Commissioners would sit
as a Board of Appeal at 2:00 P. M. to hear those for or against the action
of the Orange County Zoning Commission under date of April 2nd on
application by C. J. Gray for a change of zoning from C-3 to M-1 for a
concrete materials mixing plant on property located on the south side of Old
Cheney Highway, 2/10 mile west of SR 15-A, the hour having arrived, the Clerk

The Zoning Commission denied the application in that all the surrounding
properties are of C-3 classification and the granting of applicant's request
would constitute spot zoning.
Mr. C. J. Gray, real ·estate broker representing owners of the property,
Mr. and Mr. Hickman of Indiana, and the proppective purchasers, Inland
Materials Corporation, stated that the surrounding property owners approve
of the proposed change.

Donald Emery Foss for a variance in an R-1-A zone to renew permit to park
house trailer for two years on Lot 14, Block 84, Angebilt Addition, No. 2,
located at 1323 West 34th Street, the hour having arrived, the Clerk read the
notice.
The Zoning Commission denied the application in that the applicant's intention to
build on the property in question did not materialize, and also the applicant
failed to show that a hardship exif;lted which would justify the granting of a varianc e ,.
The Zoning Commission gave t;he applicant 60 days from date of hearing to remove

Mr. Donald Foss stated that the trailer had been there since 1956, that his
parents were separated and the property had been turned over to his sister,
and mother, and him.
He stated that he could not understand why they did not

father had made no effort to start building a home, and that last year the trailer
was rented for at least a year.
Mrs. Burkhalter also expressed opposition, stating they would like to retire there.
She stated they had been willing at first in order to help them out until they could
build their home, but they had made no effort to build same and they are now

It was moved by Commissioner Surguine, seconded by Commissioner Freeman,
and unanimously carried, that the Board sustain the action of the Zoning
Commission in denying a request for a change of zoning from C-3 to M-1 for a
concrete materials mixing plant on property located on the South side of Old
Cheney Highway, 2/10 mile West of State Road 15-A, and that the following
findings of fact be made:
1.
The surrounding properties are C-3, which is commercial, and the
granting of the request would constitute spot zoning.
2.
There has been no change in circumstances in the area which would
justify the rezoning of the property.

and unanimously carried, the Board sustained the action of the Zoning Commission
in denying the request for change of zoning classifications from R-1-A to C-1
on Lots 4 7 through 52, Bel Air Heights, located on the SE corner of Curry Ford
Road and Bel Air Drive, and made the following findings of fact:
1.
The property involved in the request for a change of zoning is
residential and the surrounding property is residential, thus a change to C-1
would constitute spot zoning.
2.
The properties nearby which are commercial are non- conforming
uses and therefore are not the proper basis for a change of zoning.
