The City of Brighton Building Code allows the City to force demolition
of a building determined to be unsafe if the cost of repair exceeds
the assessed value of the building. A home owner whose house was
determined to be unsafe offered to repair the house to bring it in
compliance with code. The trial court and the Court of Appeals both
held that the ordinance was invalid because it took away from the
home owner the right to repair. In April 2014, the Michigan Supreme
reversed the lower court decisions and upheld the Brighton ordinance.
In an article just published in the Michigan Real Property Review (the
issue is dated Spring/Summer 2014, but was, in fact, just published),
Norm has criticized the Supreme Court’s decision as an unprecedented
deprivation of property rights and contrary to law. Bonner v. City of

Your Vision For Injury Prevention
A SAFETY MANAGEMENT SERIES – PART I

I
n his book, Traction – Get a Grip on Your
Business, Gino Wickman, author and
successful entrepreneur, urges business
owners to communicate a laser-focused vision
in order to get everyone working in the same
direction. In other words, he believes that by
upcoming year, it is important to consider your
organization’s injury prevention efforts. If your
vision for injury prevention is focused and shared
by everyone in the organization, then you can get
everyone pulling in the same direction.
Here are three important aspects to consider
when developing a vision for injury prevention:

or even $1,000 on injury claims and lost
productivity. Creating a proactive injury
prevention culture will be an effective tool in
maintaining lasting injury prevention success.

In order to illustrate the power of this focus,
consider the example given by Al Ries in Focus:
“The sun provides the earth with billions of
kilowatts of energy, yet if you stand in it for an
hour, the worst you will get is a little sunburn. On
the other hand, a few watts of energy focused
in one direction is all a laser beam needs to cut
through diamonds.”
As the calendar year draws to a close and you
begin your strategic business planning for the

FOCUS ON TOP FIVEs.
Analyze your loss runs from the previous three
policy periods to identify the top five most severe
(i.e., highest dollar amount) and the top five most
frequent (i.e., highest number) injury types. An
old insurance industry axiom is that “frequency
breeds severity” and this often tends to be true. For
example, if your most frequent injury type is “foreign
body in the eye,” then you have a greater likelihood
for a severe eye injury such as loss of vision. So, by
identifying your organization’s most severe and most
frequent injury types, injury prevention efforts take
on a practical focus. Your organization’s energy and
resources will be focused in on the areas where they
are most needed.
PROACTIVE VERSUS REACTIVE.
Be prepared to require a proactive versus
reactive approach to eliminating hazards likely
to result in workplace injuries. Remember that
for every dollar prudently invested in preventing

type of hazard control on the hierarchy of
hazard controls. The hierarchy follows this
order with #1 being the most effective and
#5 being the least effective: 1.) elimination,
2.) substitution, 3.) engineering controls, 4.)
administration and lastly 5.) personal protective
equipment. The most effective hazard control
that can be used is often times not considered.
By creating and sharing your vision, you will
bring about a laser-focus in your organization.
This concentrated focus is necessary to go to
the next step and achieve excellent results. n

Supreme Court May Finally Rule On Disparate Impact
F
or the third time
in three years,
the United
States Supreme Court
has agreed to hear
a case challenging
the validity of the
disparate impact rule.
A decision by the Court would have significant
impact on apartment owners because the rule
has called into question the legality of some
common industry practices, such as criminal
background screening. By way of background,

Title VIII of the Civil Rights Act of 1968, as
amended (the Fair Housing Act), prohibits
discrimination in the sale, rental, or financing of
dwellings and in other housing-related activities
on the basis of race, color, religion, sex,
disability, familial status, or national origin. The
Department of Housing and Urban Development
(HUD), which is charged with enforcement of
the Act, has long-interpreted the Act to prohibit
practices with an unjustified discriminatory
effect – also referred to as a disparate impact
– regardless of whether there was an intent
to discriminate. Although federal courts have

Lead RRP Recertification
Did you or someone on your staff obtain the
Certified Renovator designation in 2010 as a
part of the Environmental Protection Agency’s
(EPA) Lead RRP Rule? If so, to maintain your
certification the EPA requires you to complete a 4
hour refresher course no more than 5 years from
the date of certification. AAM/HBA has a number
of classes available in the coming months, and
classes include everything you need to keep your
certification current and maintain compliance with
the rule. The RRP Rule applies to remodeling work
disturbing more than six square feet of interior
painted surface or more than twenty square feet of
exterior painted surface in multifamily and single
family structures built prior to 1978. It includes
specific work practices to follow, recordkeeping
requirements, and certification for those doing
the work. Apartment owners performing their
own renovations must follow the EPA registration
process for their firm, and have a Certified
Renovator supervising the project. The other option
is to simply contract the work out to firms which
are certified. See page 10 for registration details. n
