Dear Ambassador Raffaelli,
Please find attached the text of a Memorandum of
Understanding between the Government of Hong Kong and
the Government of Austria concerning exports of
certain textile products from Hong Kong to Austria.
This Memorandum of Understanding applies for the
period February 1st, 1993, to December 31st, 1993,
with an extension clause to December 31st, 1994. The
text has been published in the Federal Law Gazette No.
275/1993 of 29 April 1993.

Introduction
1. This Memorandum of Understanding (MOU)
sets out the arrangements that have been agreed
between the Governments of H o n g Kong and
Austria regarding H o n g Kong's exports of certain
textile products to Austria.
2. This M O U was adopted having regard to the
A R R A N G E M E N T R E G A R D I N G INTERNATIONAL T R A D E I N TEXTILES (hereinafter
referred to as the «ARRANGEMENT") done at
Geneva on 20 th December, 1973, as extended by the
Protocol of 3 1 s July, 1986, and by the Protocol of
3 1 " July, 1991, in particular to Article 4 of the
ARRANGEMENT.
Coverage
5. This M O U shall apply to H o n g Kong's exports
to Austria of the textile products set out in Annexes I
and II to this M O U .
Einleitung
1. Dieses Memorandum of Understanding
(MOU) legt die Vereinbarungen fest, die zwischen
den Regierungen Hongkongs und Osterreichs
hinsichdich des Exportes von bestimmten Textilcrzeugnissen von Hongkong nach Osterreich getroffen worden sind.
2. Dieses M O U wurde unter Bedachtnahme auf
das OBEREINKOMMEN UBER D E N INTERNATIONALEN H A N D E L M I T T E X T I L I E N (im
folgenden als ..UBEREINKOMMEN" bezeichnet)
vora 20. Dezcmber 1973, •) vedangert durch das
Protokoll vom 51. Juli 1986 2) und vom 31. Juli

Geltungsbereich
3. Dieses MOU findet auf Exporte der in den
Anhângen 1 und II angefiihrten Textilerzeugnisse
von Hongkong nach Osterreich Anwendung.

Restraint Period
4. (i) This MOU shall apply for the period
February 1", 1993, to December 31", 1993,
if the transition of the textile sector into the
GATT will not come into force on January
1", 1993.
(ii) Should the Uruguay Round transition
arrangement for integration of the textile
sector into the GATT not come into force
on January 1», 1994, this MOU will be
extended for a second period from January
1«, 1994, to December 31«, 1994. However, both governments shall consult to
bring any such extension of this MOU into
conformity with any successor to the
current Protocol of extension to the
ARRANGEMENT if changes are made
therein.
(Hi) This MOU will cease to have effect from
the date the Uruguay Round transition
arrangement for integration of the textile
sector into the GATT comes into force.
Restraint Limits
5. Hong Kong shall restrict exports of the
products set out in Annex I to this MOU to the
limits set out in columns (e) and (f) for the periods
stated therein, save as provided for in paragraphs 8
to 13 and paragraph 25 below.
6. For the purposes of these arrangements, Austria
shall admit imports of textile products of Hong
Kong origin set out in Annex I to this MOU only
where such imports are covered by export licences
issued by the Hong Kong Trade Department and
endorsed to the effect that the consignments
concerned have been debited to the agreed limits for
each restraint period.
7. Furthermore, Austria shall admit imports of
textile products of Hong Kong origin set out in
Annex I to this MOU where such imports are
covered by export licences issued by the Hong Kong
Trade Department on or before January 31*, 1993,
under the terms of the MOU regarding restrained
items between Hong Kong and Austria signed in
Vienna on November 28 th , 1989, and in Hong Kong
on January 12* 1990.

8. The limits in columns (e) and (0 of Annex I to
this MOU may be increased during the relevant
restraint period stated therein by up to five per cent

(iii) Dieses MOU verliert ab dem Datum des
Inkrafttretens der Ubergangsregelung fur
die Einbeziehung des Textiibereiches in
das GATT dutch die Uruguay-Runde
semeGuIugkeh.
5. Hongkong wird Exporte der in Anhang I dieses
MOU's angefuhrten Erzeugnisse vorbehaidich der
nachstehenden Absatze 8 bis 13 sowie 25 auf die in
den Spalten e), und f) angegebenen Mengen
wahrend der don. bezeichneten Zeuraume beschranken.
6. Fur die Zwecke dieser Vorkehrungen wird
Osterreich Importe von Textilerzeugnissen, deren
Ursprungsland Hongkong ist und die im Anhang I
dieses MOU's angefuhn sind, nur zulassen, wenn
sic von Ausfuhrbewilligungen begleitet sind, die
vom Ministerium fur Handel in Hongkong
ausgestellt wurden und mit dem Vermerk versehen
sind, dafl mit den betreffenden Warensendungen die
vereinbarten Kontingente far die jewdlige Beschrankungsperiode belastet wurden.
7. Ferner wird Osterreich Importe von Textilerzeugnissen zulassen, deren Ursprungsland Hongkong ist und die im Anhang I dieses MOU's
angefuhn sind, wenn solche Importe von Ausfuhrbewilligungen begleitet sind, die vom Ministerium
fur Handel in Hongkong am oder vor dem
31. Janner 1993 gemafi den Bedingungen der
zwischen Hongkong und Osterreich am 28. November 1989 in Wen und am 12. Janner 1990 in
Hongkong unterzeichneten MOU's betreffend
beschrankte Positionen zwischen Hongkong und
Osterreich ausgestellt wurden.

12. The restraint limit for any product set out in
column (d) of Annex I to this MOU may be
exceeded, after consultations between Austria and
Hong Kong, by a carryover of not more than 11 per
cent of 12/11*» of the limits set out in column (e) of
Annex I to this MOU and 11 per cent of the limits
set out in column (f) of Annex I to this MOU in the
case of shortfalls in the corresponding restraint limit
for the previous restraint period, and by a
carryforward of not more than 6 per cent of 12/11,h>
of the limits set out in column (e) of Annex I to this
MOU and 6 per cent of the limits set out in column
< f) of Annex I to this MOU. The carryover shall not

carryover and carryforward shall not exceed 11 per
cent of 12/1 !'*» of the limits set out in column (c) of
Annex I to this MOU and 11 per cent of the limits
set out in column (f) of the Annex I to this MOU.

und Vorgriff soil 11 Prozent von " / « der in der
Spalte e) des Anhanges I dieses MOU's des
festgelegten Konungentes und 11 Prozent der in der
Spalte f),des Anhanges I des. MOU's des festgelegten Kontingentes nicht uberschreiten.
13. Should this MOU be continued for a further
period, the carryover and carryforward provisions
set out in respect of the limits in column (f) of
Annex I to this MOU in paragraph 12 above shall
apply.
13. Sollte dieses MOU fur einen weiteren
Zeitraum verlangert werden, finden die in der Spalte
0 des Anhanges I dieses MOU's im oben erwahnten
Absatz 12 angefuhrten Bestimmungen Ober den

Export Authorization
Exportgfnrhmigung
14. Hong Kong shall require all exports to Austria
of the products listed in Annex II to this MOU to be
covered by export authorizations issued by the
Hong Kong Trade Department. An export
authorization shall be issued only on evidence of a
firm contract for the supply of the products involved
and shall be valid for up to 6 months from the date
of issue.

jener Erzeugnisse, die in Anhang II dieses MOU's
angefiihn sind, von der Ausstellung won Expongcnehmigungen dutch das Ministerium fer Handel in
Hongkong abhangig machen. Eine Exportgenehmigung soil nur bet Vorlagc ernes bestehenden
Vcnrages uber die Lieferung der angefuhrten
Erzeugnisse ausgestellt werden und for sechs
Monatc ab Aussteliungsdatum giiltig sein.
15. Export licences to ship products covered by an
export authorization will be issued by Hong Kong
on presentation of the relevant export authorization
within the latter's validity period. An export licence
shall be valid for 28 days from the date of issue.
Hong Kong shall not issue export licences in respect
of exports to Austria of products listed in Annex II
to this MOU which are not covered by a valid
export authorization.
15. Exponlizcnzen zur Versendung von Waren
auf Grand von Expongenehmigungen werden von
Hongkong bet Vorlage der entsprechenden Expongenehmigung innerhalb ihrer Gûlugkeitsdauer
ausgestellt. Eine Expordizenz soil for 28 Tage ab
Aussteliungsdatum giiltig sein. Hongkong wird
keine Exponlizcnzen for jene zum Export nach
osterreich bestimmten Erzeugnisse ausstellen, die
zwar im Anhang II dieses MOU's angefohn sind,
fur die jedoch keine giiltige Expongenehmigung
vorliegt.
16. Hong Kong shall provide Austria with
half-monthly statistical returns showing the quantities covered by export authorizations issued to
Hong Kong's exporters in respect of the products
listed in Annex II to this MOU. Hong Kong agrees
to notify Austria immediately upon receipt of any
applications for export authorizations in exceptionally large amounts in a particular product.
16. Hongkong wird Osterreich halbmonatiiche
statistische Aufstellungen zur Verfogung stellen,
welche jene Mengen aufzeigen, weJche durch
Expongenehmigungen gcdeckt sind, die for Export e u r Hongkongs in Hinblick auf die Produkdiste

Hongkong erklan sich bereit, Osterreich unverziiglich uber den Erhaltvon Antragen auf Expongenehmigungen for ein bestimmtes Erzeugnis in einem
aufierordentlich hohen Umfang zu verstandigen.
17. Austria shall admit imports of the textile
products of Hong Kong origin listed in Annex II to
this MOU where such imports are accompanied by a

market is being disrupted in terms of the definitiont

any product covered by this system, Austria may1
request consultations under the provisions of the:

19. A request for consultations shall be supported1
as soon as possible, and in any case within 14 days off
the date of the request, by a factual statement of the:
reasons and justification for the request, including;
the latest data concerning elements of markett
disruption.

agreed, shall consult as soon as possible within 30)
days of the request for such consultations and shallI
make their best efforts to complete such consultations within a further 30 days.

21. Pending the completion of consultations,,
Austria may request H o n g Kong to limit, during the
period in which the request for consultations is;
made, the issue of export authorizations of the
product concerned to a level not less than the
highest of:

(d) the previous restraint level, if any.

23. In the event that consultations do not result in
an agreement, Austria shall have the right to request
Hong Kong to limit exports to Austria of the
products concerned during the period in which the
request for consultations is made to a level not less
than that calculated according to the formula set out
in paragraph 21 above. Hong Kong agrees that it
will honour such a request.
23. Sofern bei den Konsultationen keine Ubereinstimmung erzielt werden kann, soil Osterreich das
Recht haben, von Hongkong zu verlangcn, dafi es
seine Exporte nach Osterreich fur die betreffenden
Erzeugnisse wàhrend des durch das vorliegende
MOU erfa&en Zeiuaumes auf ein Ausmafi
beschrankt, das nicht geringer ist als jenes wie in der
Formel des oben angefiihnen Absatzes 21. Hongkong erklart sich bercit, einem derartigen Verlangen
nachzukpmmen.

Re-Exports
Wiederausfuhr
25. Austria will, as far as possible, inform Hong
Kong when imports to Austria of the textile
products set out in Annex I to this MOU that have
been debited to agreed limits are subsequently
re-exported from Austria. Hong Kong may then
credit the quantities involved to the appropriate
limits. To this end, an administrative arrangement
has been agreed between both governments as set
out in Annex III to this MOU.
25. osterreich wird, soweit als mdglicn, Hongkong davon in Kenntnis setzen, wenn Importe der
im Anhang I dieses MOlPs angefûhrten Textilerzeugnisse nach osterreich, mit denen die veretnbarten Kontingente belastet wurden, spater «us

26. Hong Kong will provide Austria with
half-monthly statistics of the textile products set out
in Annex I to this MOU licensed for export to
Austria and debited to the limits set out in columns
(e) and (f) of Annex I to this MOU.

such as a reasonable modification of this M O U .
Further, Austria and Hong Kong agree to consult,
at the request of either government, with a view to
bringing this M O U into conformity with any
international arrangement for trade in textile
products succeeding or replacing the ARRANGEM E N T as extended.

30. Where consultations are requested in
accordance with paragraphs 28 and 29 above,
Austria and H o n g Kong shall enter into such
consultations within 30 days of the request and shall
endeavour to complete the consultations within a
further 30 days.
30. Falls Konsultationen im Sinne der Absatze 28
und 29 des gegenstandlichen M O U ' s verlangt
werden, treten Osterreich und Hongkong innerhalb
von 30Tagen ab diesem Verlangen in derartige
Konsultationen ein und sind bestrebt, diese

Aancx III
Notwithstanding the provisions in paragraph 5
and in furtherance of paragraph 25 of the
Memorandum of Understanding, Austria and Hong
Kong agree to the following administrative
arrangements:
(a) For presentation to Austria in support of an
application for a corresponding import
licence, an export licence ceases to be valid
upon the expiration of one hundred and
twenty days from the date of issue of the
export licence. All export licences covering
restraint items will be endorsed to this effect;
(b) Austria will provide Hong Kong at monthly
intervais with a list of export licences which
have been presented to Austria in support of
applications for import licences indicating the
quantity covered by each corresponding
import licence issued; and
(c) In respect of export licences of which the
validity of one hundred and twenty days
referred to in (a) above has expiied and which
are not shown on the lists of export licences
provided by Austria pursuant to (b) above,
Hong Kong will notify Austria, as soon as
possible, the numbers of such export licences
and the quantity covered by each export
licence with an indication that the quantities
will be credited back to Hong Kong for re-use
if nothing is heard from Austria within six
weeks from the date of such notification.
Unbeschadet der Bestimmungen des Absatzes 5
und zur Erleichterung der Durchfuhrung des
Absatzes 25 dieses MOU's treffen ôsterreich und
Hongkong die folgenden Verwaltungsvereinbarungcn:
a) Zwecks Vorlage an ôsterreich zur Begriindung eines Antrages auf Ausstellung einer
entsprechenden Einfuhrbewilligung verliert
eine Ausfuhrbewilligung nach Ablauf von
einhundertzwanzig Tagen ab dem Datum der
Ausstellung der Ausfuhrbewilligung ihre
Gultigkeit. Allé AusfuhrbewiUigungen betreffend beschrânkte Positionen werden mit
eihem diesbezugiichen Vermerk versehen;
b) Ôsterreich wird Hongkong in monatlichen
Zeitabstanden eine Aufstellung der zur
Begriindung von Einfuhrbewilligungsamragen vorgelegten AusfuhrbewiUigungen unter
Angabe der dutch jede entsprechende Einfuhrbewilligung abgedeckten Menge zur
Verfûgung stellen;
c) hinsichdich der AusfuhrbewiUigungen, dercn
vorstehend unter a) angefiihrte Gultigkeitsdauer von einhundertzwanzig Tagen abgelaufen ist und die in dem von Osterreich
gemifi vorstehendem Absatz b) zur Verfûgung gesteilten Aufstellungen nicht aufscheinen, wird Hongkong ôsterreich, sobald wie
môglich, die Nummern von solchen AusfuhrbewiUigungen und die dutch jede Ausfuhrbewilligung abgedeckte Menge mit dem Hinweis darauf bekanntgeben, dafi diese Mcngcn
Hongkong zur neuerlichen Verwendung
wieder gutgcschriebcn werden, wenn von
Ôsterreich innerhalb von sechs Wochcn ab
dem Datum cincr solchen Bckanntgabe keine
RuckaulJcrung cinlangt.
