Three years ago Mr. Fotheringham entered into a private contract with the
Lexnora-MouSicker Copper Mining
company, under tha terms of which he
waa to construct a 150 ton smelter and
purchase 150,000 (tons qf or from the
company. Thla contractwas afterwards
transferred to James Breen under an
agreement which provided
that Mr.
Breen give him a position in the amel-te- r
st $110 a month; also that ha should
receive a tenth Interest in the smelter,
with the privilege of purchasing another
tenth.
The present suit is merely for damages for the failure on the part of Mr.
Breen to carry out the terms of the
contract.
