The New Year Brings New Opportunities

Happy 2016! As we ring in the New Year, we realize that it will
bring to us new challenges, joy and struggles. We will make
new goals! We will accomplish most and fail at some. It is all
about the positive attitude that we have to make 2016 a spectacular year!
The 2016 Code of Ethics is now available for you. You can
print it off at www.larawebsite.com under the Professional
Standards button on the left of the home page.
I am in the midst of setting up all 6 live WI CE classes and will
have a flyer with all the information available soon. I am also in the process of setting up the MN Required CE. The flyer for that day of education will be available
soon also.
I would like to thank Mike Pietrek and his committee for all the intense work they did
to surpass our RPAC goal of $13,000. What a huge accomplishment.
The market is still busy and the listings are coming in at a good pace. The final stats
for 2015 will be available next week. I am anticipating great numbers. It is a great
start to a new year.
Let’s toast to a successful 2016!

2016 WI Forms Update
The REEB recently revised the following forms with a
mandatory use date of January 1, 2016.
WB – 40 Amendment to Offer to Purchase
WB – 41 Notice Relating to Offer to Purchase
WB – 44 Counter-offer
WB – 45 Cancellation Agreement and Mutual Release
The intention of the revisions is to make the forms
clearer and easier for licensees to use.
The REEB simplified these forms to the greatest extent
possible and provided more blank lines for the insertion
of provisions.

“If I suspect I’m being tested, does the tester have to admit he is testing me if I ask?”

•
A tester does not have to admit he is a tester if asked.
Areas of Liability
•
Testers can lie about their status and purpose, and their report will still be admissible evidence in court or usable in a fair
housing complaint. Tester’s false pretenses and misrepresentation to you does not disqualify their claim for damages of
being misinformed as to the availability of property or financing for reasons of their race, color, religion, sex, handicap,
familial status or national origin.
Actions to Take
•
Don’t waste your time trying to figure out who is or isn’t a tester. Asking questions suggests concern due to a guilty
conscience and will probably increase the tester’s interest and inquires.
Suggested Response
Broker to sales associate:
•
“A tester doesn’t have to admit what he is doing. And even if he did admit what he is and what he’s doing, that knowledge
should have no effect on the way you treat him. Knowing a person is a tester can only hurt you by tempting you to provide
differential treatment or inhibiting your conduct or attitude. Forget it and do your job.”

Manual Updates
If you do not have access to your DisplayKEY cradle to perform an eSYNC, you can manually
update your key by obtaining an update code from the KIM website or voice access system.
NOTE: If you manually update your DisplayKEY, showing activity remains in your key until the
next time you perform an eSYNC.
To obtain an update code from the KIM website, do the following:
1. Go to wwwsupraekey. corn.
2. Select Log on to KIM.
3. Select the name of your association or MLS from the dropdown list.
4. Enter your DisplayKEY serial number and four-digit PIN code.
5. Click Login.
6. Select the Update Code link in the left column of your screen. The update code displays.
To obtain an update code from the KIM voice system, do the following:
1. Call KIM at 1-888-968-4032.
2. Enter your three-digit area code.
3. When prompted, enter your DisplayKEY serial number and PIN code into the phone,
