During a forum held at the Roscioli Shipyard, we discussed the Federal Government's role
and how the Government can improve some key issues in Florida:
1. Tax Breaks - Incentives: develop a system that gives incentives to boat owners to spend
the money to repair their boats now and not put off those repairs to a later day.
2. Commerce with Cuba: open access to Cuba for travel and trade will bring thousands of
boats through the waterways of Florida on their way to the island. As there is relatively little repair infra-structure available in Cuba, boats will likely have work done in Florida.
3. Customs and Border patrols restrictions of visa entry for crew
4. Insurance Reform: relief to the state from insurance companies increasing premiums on
boaters that want to stay in Florida waters between June and September
5. Credit Squeeze: work to ease the flow of credit to the marine industry.
6. Work to educate Congress about the significance of Yachting as an industry, not just a
hobby for the wealthy. Work with industry leaders to invite key members of Congress to
Florida to help educate them on this issue.

CLEARING UP THE MYSTERY
SURROUNDING BOAT
SHOW BONDS

As we find ourselves finishing this South Florida boat show season and looking forward
to the next round of shows later this year, I have been approached by several people with
questions regarding the law and requirements for showing or offering a boat for sale or
charter in U.S. waters during a boat show. In an effort to unveil the mystery, let’s take a
closer look at those requirements here.
Foreign flagged yachts entering the U.S. for sale or charter need to overcome two issues: 1)
adherence to U.S. Customs rules regarding foreign good entry into the U.S. for commercial
use and 2) adherence to Florida sales and/or use tax laws. In this article, let’s focus on adhering to the U.S. Customs rules, specifically those regarding Boat Show Bonds, since that is
where most of the mystery seems to reside.
Three ways to satisfy the federal regulations surrounding the importation of a yacht for
sale are: 1) to complete an importation, which requires paying a duty of 1.5% of the current estimated value of the vessel to U.S. Customs; 2) to enter the yacht as a U.S.
built/manufactured good as goods returned; or 3) to enter the yacht under a Boat Show
Bond, allowing a six month temporary importation.
Boat Show Bonds are attractive, in part, because the six month time window allows a broker to show the yacht in the Ft. Lauderdale, Miami, and West Palm Beach shows and are
generally inexpensive when compared to the cost of paying the 1.5% duty. Any previously sold pleasure yacht over 79’ in length is eligible for a Boat Show Bond. The Bond
requires a yacht to surrender its original Certificate of Registry and original U.S. Cruising
License to the local Customs office. Yachts imported under a Boat Show Bond for the purpose of both sale and charter are covered by the bond.
Once under the protection of a Boat Show Bond, a yacht may be advertised to both U.S.
citizens and residents for sale or charter. In addition to the above, while the yacht is not
physically located in a boat show, the owner may use the yacht in the jurisdictional waterways covered by the U.S. Customs office with which the bond was filed. If the Owner
wants to cruise outside of that Customs office jurisdiction, then the Boat Show Bond must
be surrendered to U.S. Customs and voided and the yacht is given back its Certificate of
Registry and U.S. Cruising License. When the owner wants to relist the yacht for sale or
charter, then the broker must go through the Boat Show Bond process from the beginning.

On behalf of the FYBA Board of Directors we would like to thank thank everyone whole
helped out by donating (both monetary and physical donations) to the Haiti relifef fund.
Everyone reached out and made it a huge success. FYBA would especially like to thank
Chris Barlow for going above and beyond the call of duty. Chris took on the responsibility of packing, inventorying, labeling and weighing over 6,000 lbs of donations that all

The first charter open house of 2010 was
held under sunny skies and fair winds on
March 10 at Bahia Mar. The event drew
over 80 people and was one of the highest attended charter open houses in FYBA
history! 8 yachts participated in the open
house, ranging in size from the 80’ BLUE
MOON to the 150’ VITA. The chef of
each boat treated attendees to delicious
hors d’oevres. The event also served as a
membership drive and attracted several
non-members who came to get a feel of
what FYBA does.

Specialist Jennifer M. Saia recently arranged
a Super Bowl charter for client Thomas E.
Hoshko, CEO and President of The Experts,
Inc. Saia and her team helped to design a funfilled charter to Miami aboard the 112-foot
(34.1M) Westport Motor Yacht MILK
MONEY centered around watching the Saints
play the Colts in Super Bowl XLIV on
February 7, 2010. Hoshko’s primary goal for
the trip was to provide first-class corporate
hospitality for his firm’s top customers and
producers in a memorable setting. Home port
for the start of the Super Bowl Charter was
the Diplomat Resort on the Intracoastal
Waterway, which was very convenient for
shopping, restaurants and attending VIP parties on South Beach. MILK MONEY, is available for charter in Florida and The Bahamas
year-round at a rate of U.S. $44,500 per week,
including towed tender. While the yacht welcomes occasional corporate clients, it typically hosts private charter parties of eight persons or fewer.
Boat International Media recently announced
the 2010 World Superyacht Awards Finalists.

the master and VIP, have king beds; there also
is a queen stateroom and guest suite configured with a double and twin bed – perfect for
a nanny and child. ODESSA is available for
charter in The Bahamas this winter season at
a rate of U.S. $240,000 per week, plus
expenses. In summer 2010, she will move to
the Western Med, where her High Season rate
is U.S. $285,000 per week, plus expenses, and
her Low Season rate is U.S. $275,000 per
week, plus expenses. (Please note that
ODESSA is not for sale or charter to U.S. residents while in U.S. waters.) MISS
MICHELLE accommodates 10 guests in five
large staterooms, including a full-beam, maindeck master suite. Seven crew are housed in
highly functional quarters on the lower deck.
MISS MICHELLE is currently in the Turks &
Caicos for the month of February, after which
she will move to The Bahamas. Her winter
charter season rate is U.S. $120,000 per week,
plus expenses. Her summer charter rates are
U.S. $140,000 per week, plus expenses in
High Season and U.S. $130,000 per week,
plus expenses in Low Season. (Please note
that MISS MICHELLE is not for sale or charter to U.S. residents while in U.S. waters.)

After a show is over the broker may only show the yacht to those
prospective clients who came to see the yacht during one of the
shows and registered with the broker. New clients are not
allowed to be shown the yacht in between shows. In order to
facilitate this, it is helpful and recommended for the broker to
keep a detailed log of people viewing the boat during a show.
So what happens if the owner or broker does not obtain a Boat
Show Bond or pay the duty on the yacht? Then the boat is not
duty paid and cannot be offered for sale or charter to U.S. citizens without invoking U.S. Customs penalties as well as Florida
Sales and Use Tax provisions. Both sale and charter brokers
alike should be aware of the location of the yacht at all times and
be sure to avoid incurring customs or tax liability on behalf of
the yacht’s owner.
In addition, if the broker decides to advertise in one of the many
industry magazines, it is important to remember that if the
advertised yacht is docked in U.S. waters without having paid
the duty or obtaining a Boat Show Bond, then the advertisement
must note that “the yacht is not for sale or charter to U.S. citizens/residents while in U.S. waters.”
Take some of the stress out of preparing for the boat shows by
consulting a customs broker and/or a maritime attorney on the
proper procedures to list a yacht for sale or charter in a South
Florida Boat Show.

“As Is, Where Is”
THE ULTIMATE SHIELD?

ne of the most powerful phrases thrown around
in commercial transactions is “caveat emptor,”
also known as Buyer Beware. In yacht transactions, we often see this centuries’ old warning converted to a legal condition when a Seller inserts the words
“As Is, Where Is” into the Listing Agreement or
Purchase and Sale Agreement as a condition of the sale.
By insertion of this clause, Sellers may think they are
converting the sale to a transaction more akin to purchasing an item at a souk or bazaar. This is done as an
effort to discharge the equitable principles and fair
practices Sellers are otherwise required to observe in a
transaction were it not for this “magic” phrase.
O
So, does inserting the “As Is, Where Is”” phrase
into agreements really allow a Seller – or a third
party connected to a transaction like a broker – to
act with impunity?
Recently a court in South Florida held that reliance
upon the doctrine of caveat emptor in an arms-length
transaction is powerful, but not absolute. In fact, it is
often the Seller who must beware that he will not be
shielded from engaging in fraud. Courts will simply
not allow a deceitful Seller to artfully avoid fraud by
using the “As Is, Where Is” clause as an escape hatch.
Fraud (by way of active concealment through misrepresentation or omission of a material fact) will invalidate a Purchase and Sale Agreement, including the “As
Is, Where Is” clause.
While it may be true that a Buyer purchasing a vessel
“As Is, Where Is” and who also inspects the vessel to
his satisfaction may put the Seller and others in the
clear, it is not an absolute defense. Knowledge of latent
defects (which may not be reasonably discoverable
during a routine survey) could expose those in the
transaction to a future claim of fraud.
So beware. You may not be fully protected.

FYBA would like to thank Whit Kirtland of

Frank De Varona will be stepping in to fill the

passion for boating began as a child in Puerto
Rico, where he worked on boats at the San
Juan Nautico. He left Puerto Rico to attend
post secondary education in New England.
Family commitments brought his family to
South Florida, where he began his career as a
Yacht Broker.
After working for several very established
companies, Frank and his wife Betty, who
have worked together in cultivating the South
Florida & Latin American Market, decided to
open their own company, Yachting Experts,
Inc. With this latest endeavor, Frank hopes to
bring knowledgeable, certified brokers to the
area that are energetic and customer service
focused, ultimately bringing the best to the
industry he loves so much.

The first Yacht & Brokerage Show
was held in 1989 at Sunset
Harbor in Miami beach and
featured 56 boats on display
ranging in size from a 36’
Birchwood to a 114’ Broward.
Since then the shows have been
held on Collins Ave. FYBA’s partnership with Show Management
was established in 1992.
The 2010 show featured over 200
boats ranging in size from 26’ up
to 170’. This year’s show featured
a scaled-back lineup of boats and
exhibitors. The number of yachts
and the density of foot traffic
were both significantly down from
years past. Skip Zimbalist, CEO of
Show Management, said snowstorms in the Northeast kept many
potential buyers away during the
show's first two days, when yearover-year attendance was down
15 percent. Things improved
toward the end of the show's fiveday run, but overall attendance
was still down by 10 percent,
which affected sales negatively.
Other categories fared better,
and sales were up among fishing
boats and medium-size yachts,
Zimbalist said.

Among boats larger than 55 feet, U.S. yacht brokerage sales surged in
February, the third month in a row that big-boat sales have outpaced the
same month a year earlier. Across all sizes, unit sales grew by a third,
from 1,323 in February 2009 to 1,759 boats last month, and the value of
those sales increased from $132 million to $221 million. Combined with
January, the number of boats sold was reported at 3,367, a 31 percent
increase over 2009, and valuation was $411 million, up 55 percent.
Sailboat sales, after lagging behind the rise in powerboat sales in January,
were up sharply in February, leading the market with unit sales 41 percent
higher (at 367 boats) and valuation up 77 percent (to $28 million).
All sizes of boats sold better in February than the same month a year earlier, with increases in unit sales of at least 29 percent. And while boats
over 55 feet made the largest gains, strong sales were also recorded
among boats 36 to 45 feet long, with 364 boats changing hands - 44 percent above February 2009.
The only negatives in February's report were that unit sales overall lagged
slightly behind the five-year average for the month, with 1,759 total boats
sold, compared to an average of 1,888. Also, as a reflection of the slowness of the big-boat market throughout the recession, it's not surprising
that the average time on the market for the boats over 55 feet sold this
year so far is up about 40 percent, to 515 days.

As a result of severe pressure from all sectors of its boating industry,
the Croatian government has drastically reduced the so-called 'luxury
taxes' payable on leisure craft that it imposed in August last year.
Originally, the government imposed additional taxation based on 11
price brackets. The lowest bracket was 'Up to Euro 50k'; the highest,
'More than 500k'. Every vessel was subject to the Fixed Luxury Tax
(FLT) applying to its bracket, plus an additional Variable Luxury
Tax (VLT) calculated on how much the actual sales price exceeded
the bracket minimum figure.
The lowest bracket, on boats up to 6,800, imposed no FLT — just a
VLT of 13 percent. In the top bracket, vessels costing 68,500 and
more were subject to an FLT of 24,300 plus 63 percent of the sales
price over and above 68,500.
The new tax regime that came into force on February 14 splits sales
into 12 quite different brackets. Boats costing up to 27,400 are FLTexempt and subject to a VLT of 5 percent, while those of 548,000
and above are subject to an FLT of 61,000 plus a VLT of 16 percent
on the amount above 548,000.

Global climate change is shaping up to be the
topic of a generation
5 - Comply with sewage standards. Install a coast Guard- approved marine
sanitation device on your boat and use it. Consult up-to-date cruising
guides for the locations of pump- out facilities. If you can’t find one in your
area, organize boat owners to convince your local marina to install one.
Green Boating Tips: Boat US recently published a great list of simple
things we can all do to be more environmentally friendly on the water. Here
are some ideas from the BOAT/US Clean Water Trust about how you can
help the waters while boating.
1- Stash your trash. Never throw anything into the water that didn’t come
out of it. Keep trash, even food waste, onboard and bring it back to recycle
or throw away on shore.
2 - Respect marine wildlife. Don’t feed or harass dolphins and other mammals. Reduce speed and give a wide berth to all marine life.
6 - Tune up your engine. A tuned engine improves fuel economy and burns
fuel more efficiently, causing fewer emissions into the air and water.
7 - Refuel with care. Take precautions to keep fuel and oil out of the water.
Do not top off your fuel tanks, as it usually leads to spillage. Use a "bilge
pillow" to soak up leaks in your bilge.
8 - Reuse and recycle. Recycle spent antifreeze, fuel, oil, oil filters, and
batteries. Use less toxic propylene glycol antifreeze whenever possible, but
check before mixing it with other antifreeze for recycling.
3 - Fish for the future. Learn proper catch and release techniques and use
them after you've caught what you need.
9 - Wash often. Wash your decks regularly with fresh water and a scrub
brush to reduce the amount of strong chemical cleaners needed throughout
the boating season.
4 -Watch your wake. Large wakes can unnecessarily accelerate shoreline
erosion. Throttle back in narrow waterways. Use moorings rather than
anchoring in environmentally delicate areas such as coral reef. When snorkeling or diving, never touch any live coral.
10 - Get involved. You can make an even greater impact by donating
money and/or your time to environmental action groups. Be a watchdog. If
you’re out on the water and see oil or chemical spill or other pollution, call
the Coast Guard’s National response Center hotline (800-424-8802).

Florida lawmakers will face a multitude of challenges when they return
to Tallahassee this month. The most pressing problems: a projected $2.6
billion budget shortfall, the highest unemployment rate in more than
three decades and an unemployment trust fund that’s in the red.
Following four straight years of negative or flat growth in general fund
revenue, the Legislature’s Office of Economic and Demographic
Research is predicting 6.6% growth in revenue for the 2010-11 budget
year. However, the growth will not be enough to cover expected increases in Medicaid and other expenses, leaving budget writers struggling to
balance the needs of services such s education, healthcare, public safety
and transportation. Hot Button issues such as offshore drilling and
expanded gambling within the state will also be high on the agenda as
lawmakers look for ways to increase revenue without raising taxes.
Following is how some key issues might play out in the upcoming legislative session.
Unemployment Compensation: Florida’s employers are facing a record
tax increase this year. In August, as the state’s unemployment rate
climbed towards a 35-year high of 11%, the unemployment insurance
trust fund went broke, and the state began borrowing $300 million a
month from the federal government to pay its unemployment compensation benefits. The depletion triggered a readjustment of unemployment
tax rates that will bump the minimum annual rate from $8.40 per
employee to $100.30. The maximum rate per employee will raise from
$378 to $459.
To Drill or Not to Drill: Lawmakers will take another look at the controversial issue of whether to open the state’s coastline to oil and gas exploration. Proponents of lifting the state’s ban on drilling argue that allowing drilling in Florida’s near-shore waters will provide the state with new
revenue and help the nation move closer to its goal of energy independence. Environmentalists and others who oppose the effort content that
drilling is too risky and that a major oil spill would significantly harm
the state’s ecology and devastate Florida’s tourism industry.

DRAWS 1,800 VOLUNTEERS
Florida Fish and Wildlife Conservation Commission
After nearly two weeks of record cold weather in Florida, biologists
counted an all-time-high number of manatees during the annual synoptic survey the week of Jan. 11. The Florida Fish and Wildlife
Conservation Commission’s (FWC) Fish and Wildlife Research
Institute reported a preliminary count of 5,067 manatees statewide. A
team of 21 observers from 10 organizations counted 2,779 manatees on
Florida’s East Coast and 2,288 on the West Coast. This year’s count
exceeded the previous high count from 2009 by more than 1,200 animals. The survey conditions were favorable for aerial observations in
both years, but were especially favorable this year as a result of the
extended period of cold weather.
While this year’s results do not mean the manatee population grew by
more than 1,200 animals in a single year, they do tell researchers there
are at least 5,000 manatees in Florida waters. The FWC is encouraged
to have counted so many manatees. The high count is consistent with
models that show the manatee population is growing or stable in most
areas of the state. The cold weather that helped researchers obtain the
record high count also highlighted the importance of warm-water habitat for the species. During the recent cold snap, biologists noted unusually large numbers of manatees gathered in the warm-water sites for
extended periods of time. FWC researchers, managers and law enforcement officers closely monitored the large numbers of manatees dependent on these sites. To maintain the species into the future, the FWC will
continue to monitor threats such as loss of warm-water habitat which,
models indicate, can profoundly affect the manatee population.
SALES TAX HOLIDAY
STIMULATES THE ECONOMY

Caution about spending is one reason the Legislature has dropped the
Back to School Sales Tax Holiday for two years running. But a study by
the Washington Economics Group (WEG) found that a 2009 sales tax
holiday would have resulted in a net $118 million increase in state and
local revenues. The holiday sparks additional spending that boosts the
state’s critical retail sector, and that in turn increases demand, creates
jobs and grows tax revenues. A Back to School Sales Tax Holiday
would have created an increase in economic activity of approximately
$1.7 billion, boosting Florida’s Gross State Product by close to $1 billion for the year. A 2009 tax holiday would have created 21,896 full
time equivalent jobs in a year of double digit unemployment, the study
found. The analysis was led by economist J. Antonio Villamil and was
commissioned by the Florida Retail Foundation.
On Saturday, March 6, over 1,800 volunteers came by land and in 117
boats to 25 sites to participate in the MIASF 33rd Annual Waterway
Cleanup presented by the Florida Inland Navigational District.
Volunteers removed 15 tons of trash from Broward’s waterways, rivers
and canals. The event garnered strong support from local officials,
including broward County Mayor Ken Keechl.
IYRS TO GET FUNDING
FOR NEW PROGRAM
The International Yacht Restoration School and the Rhode Island
Economic Development Corporation will announce new federal funding they have secured to help establish the IYRS Composites
Technology program. The nine-month IYRS Composites Technology
Program will be offered at the school's facility in Bristol, R.I., beginning
in September.

According the researchers and newspapers, Florida’s population
declined last year for the first time in decades. But the most recent official statistics from the U.S. Census Bureau state that Florida gained
114,000 in population from July 2008 to July 2009. While it’s true that
31,000 more people moved out of Florida to other states than moved
here from elsewhere in the U.S., births outnumbered deaths in the state
by about 58,000, and international migration brought in another 87,000
residents. The net result: Florida gained more than 10,000 people. The
gain came in a bad year when the economy was sour, houses sat empty
and unemployment hit new heights.
DUBAI RENAMES TOWER
FOR ITS NEIGHBOR
The long-awaited opening of the world’s tallest tower, the Burj Dubai,
came with a surprise—the renaming of the structure after Sheik Khalifa
bin Zayed Al Nahyan, the Abu Dhabi leader who gave Dubai billions of
dollars late last year to help its neighboring emirate out of a crushing
debt crisis. Look into what’s inside the tower—and why now might be
the time to give Dubai a second look as a meeting destination.
LIST OF WORLD’S LARGEST YACHTS
ShowBoats International recently released their annual list of the 100 largest yachts in the world. At 235 feet,
KOGO now ranks as the smallest yacht on the list. The new build ECLIPSE now ranks as the largest yacht in
the world at 533 feet. The 281 foot CAKEWALK is the largest private yacht to be built in the United States since

Dear Friends,
Well it is another year and, out of a sincere desire to be altruistic
again, I have entered the National Multiple Sclerosis Society’s “2010
Zimmerman MS Bike Ride” again this year. I will be riding for
Camper & Nicholsons along with my colleague, Georges
Bourgoignie. The course is new but the destination is Key Largo for
the night after a 75 mile ride down from Miami and 75 miles back the
next day.
As many of you know, my daughter Courtney is a Type 1 (insulin
dependent) diabetic.
The race is April 17th (Down to Key Largo) and 18th (Back to
Miami). Last year I was able to complete this race, all 150 miles, at a
speed of 20.2 miles per hour without a stop. I hope to do the same
this year.
