Notes For All Auction Bidders
If you are planning to bid in a property auction,
youare strongly advised to exercise due diligence
and carry out research on the property in advance.
We recommend that you read any legal documents
supplied for your chosen property, and visit the
property for internal visual inspection, so that you can
be sure it meets your requirements.
While you do not technically require a solicitor to act
on your behalf when purchasing property in France,
we feel that it is essential that you do engage the
services of a solicitor that specialises in French
law and property conveyancing to safeguard your
interests and guide you through the buying process.
Ideally such a solicitor would be dual qualified and
bi-lingual, with some bi-cultural experience. We can
suggest suitable UK based firms upon request.
GENERAL AUCTION CONDITIONS
The General Conditions of Sale are set out in the auction catalogue
and on our website, www.frenchpropertyauction.com. We highly
recommend that potential buyers and their legal representatives
read these before taking part in the bidding process.
SPECIAL CONDITIONS OF SALE
The General Auction Conditions of Sale are sometimes
supplemented by ‘Special Conditions’ specific to the seller’s
property. These are provided separately from the catalogue
by the auction team. They are an integral part of the sale. It is
vital for buyers to gain a full picture of all general and special
conditions and satisfy all their enquiries before bidding.
‘MODERN’ METHOD OF AUCTION
Our ‘Modern’ method of auction has been developed specially
for the French property market and is a more client-friendly
process. Unlike the ‘Traditional’ auction method, bids are
accepted on a conditional basis. This means that
the sale doesn’t become legally binding the moment the hammer
falls. Instead, when the bid is accepted, the buyer undertakes
to exchange preliminary sale contracts (“compromis de vente”)
within 21 days, allowing a longer period to accommodate any
necessary buyer due diligence. The sale becomes legally binding
for both sides at this point and is progressed in line with standard
French legal practice.

CATALOGUE AMENDMENTS
On auction day, we publish an Addendum listing all corrections,
additions and amendments to the details in the catalogue. We
strongly advise you to read this document before bidding, to see
if such changes apply to your target property. Changes may be
made up until auction day, so it’s important to obtain the most up
to date information from our auction department. The Addendum
is an integral element of the sale particulars.
LEGAL PACK
Before the property is sold at auction, a legal pack may be
prepared. This pack of legal documents gives the buyer a chance
to examine various legal aspects of the property before placing
a bid. Typically, a legal pack may include, title information and
plans, statutory diagnostics, tenancy documents, planning
permissions, special conditions of sale etc. When the property is
sold, this pack is sent to your solicitor to facilitate the conclusion
of preliminary sale contracts.
VIEWING
Viewings can be arranged through the agents immobiliers
selling the property. Auction properties vary considerably in type
and condition, and we advise you to avoid potential risks and
exercise due caution when visiting any property featured in our
catalogue. Please note that viewings are conducted entirely at
your own risk. These properties are not owned or controlled by
French Property Auction, and we cannot be held liable for loss
or injury caused while you are viewing or accessing any property
presented for sale in our auction.
PRE AUCTION OFFERS
In general, properties in this catalogue will be offered on the day
of sale, as advertised. On occasion, a seller may accept an offer
in advance of the auction, and withdraw the property from the
sale. When a sale is agreed in advance, the auction terms and
conditions still apply. We advise all potential buyers to confirm
that the property that interests them is still included in the auction
sale. The auctioneer or agents immobiliers cannot be held liable
for any costs incurred against lots that are withdrawn or sold
in advance.
CURRENT MARKETING PRICE
The current marketing price is the price, inclusive of agents
immobiliers fees, that the property is currently being marketed at
on the open market and potential buyers must not rely on them
as a valuation.
SEVEN DAY ‘COOLING OFF’ PERIOD
In addition to the flexibility above. Purchasers will also benefit
from the usual seven-day ‘cooling-off’ period in line with standard
French legal practice. This allows the purchaser to withdraw from
the purchase after exchange of the preliminary sale contract
without penalty and have any deposit paid to the seller refunded.
RESERVE PRICES
The reserve price is the minimum price, inclusive of agents
immobiliers fees, which a seller is willing to accept for a property.
Reserve prices are agreed privately between the seller, agents
immobiliers and the auctioneer, and are not made public. All
reserve prices are set below the current marketing price.
SALE CATALOGUE
Our sale catalogue sets out brief details of the property being
sold at theauction. We take every step to ensure the particulars
within the catalogue are correct, but cannot guarantee 100%
accuracy. Each property’s details have been provided by the
agents immobiliers selling that property. All measurements are
approximate, and potential buyers should take full responsibility
for verifying and confirming the particulars of sale and
REGISTRATION
In order to bid for a property, you first have to register and be
given a bidding number. The registration desk will be clearly
identified in the auction room.
CURRENCY
Prices are displayed in (€) Euros. Bidding is also carried out in
(€) Euros.
BIDDING PROCESS
The auctioneer announces each lot, including the full address of
the property, and draws attention to any last-minute notices for
potential bidders. Before bidding, please verify that this is the
correct lot, by checking the current lot number, usually displayed
along with photographs on screens at the front of the room.
The auctioneer will invite bids at a specific price, and you can
place your bid at this price by clearly raising your card, hand or
catalogue. Other bid prices need to be shouted out clearly, or
the auctioneer may not hear you. When the highest bid has been
achieved, the auctioneer will say ‘going, going, gone’ and ‘knock
down’ the property. Please don’t leave your bid until the very last
minute, or you may lose the property. Your bid needs to be very
clear to the auctioneer, as the room may be very busy.
REMOTE BIDDING
Buyers who cannot attend the auction in person can bid remotely,
by telephone or proxy bid. To do this, fill in the remote bidding
registration form which is printed in the auction catalogue or
available direct from the auctioneers offices – tel 01289 330767.
SUCCESSFUL BIDDERS
If you bid successfully for a property, you will be approached by
a member of our auction team and taken to the transaction desk,
where you will need to provide identification and payment for the
administration fee.
We then prepare the memorandum of sale and offer documents
for you to sign. It’s important that you do not leave the auction
room without paying the administration fee, and signing the
relevant documents. The exchange of preliminary sales contracts
will be progressed by your solicitor and notaire in the usual
manner.
ADMINISTRATION FEE
The successful buyer must pay an administration fee to the
auctioneer. The administration fee is in addition to and does
not form part of the purchase price. The administration fee
is non-refundable, except in certain circumstances, see our
Conditions of Sale. The administration fee payable is based on
THREE POINT FIVE PER CENTUM (3.5%) of the Price subject to
a minimum fee of TWO THOUSAND FIVE HUNDRED POUNDS
(£2,500) STERLING and a maximum fee of TEN THOUSAND
POUNDS (£10,000) STERLING inclusive of VAT.
In some circumstances, the standard administration fee may
be varied due to the nature of the property. Any change from
our standard fees will be listed in the Special Conditions for the
property.
Arriving at the Auction
on Time
TRAIN & TUBE
Olympia London is the only venue in London with a dedicated
rail station - Kensington (Olympia). It’s served by the
London Overground and national rail networks. A further five
Underground lines are connected; only a short walk away, so
everyone can arrive together.
London Overground
Kensington (Olympia) is on the London Overground network. It’s
one stop from Shepherd’s Bush (Central line) or West Brompton
(District line). The venue is next to the station.
Central Line
Change at Shepherd’s Bush for a 2 minute Overground train to
Kensington (Olympia).
Piccadilly Line
Hammersmith is a 9 minute walk away. Alternatively a shuttle
bus from Earls Court station is provided for some events. Please
check the corresponding event listing for details.
Hammersmith & City Line
Hammersmith Station is a 5 minute bus ride or 15 minute
walk away.
Circle Line
Hammersmith Station is an 5 minute bus ride or 15 minute
walk away. High Street Kensington is a 4 minute bus ride or 12
minute walk away.
District Line
Change at West Brompton for a 2 minute Overground train to
Kensington (Olympia). Alternatively West Kensington is an 8
minute walk away, and High Street Kensington is a 4 minute bus
ride or 12 minute walk away.
There is also an occasional service from Earls Court on
weekends, and for some major events. Please check before you
travel.

WHAT IF A PROPERTY IS NOT SOLD?
If a property doesn’t reach its reserve price on the day and you
are interested in purchasing it, please register your highest bid

see if a sale may still be possible after the auction. Otherwise,

2. Role of the Auctioneer

he Auctioneer acts as agent of the Seller’s Agent and not as
principal and to the extent permitted by law has no personal liability
of any nature whatsoever to any Bidder whether in contract, under
delict or otherwise.
2.2 The Auctioneer’s decision on the conduct of the Auction is final.
2.3 The Auctioneer may:-

he Auctioneer has prepared the Sale Catalogue in reliance on
information provided by the Seller and/or the Seller’s Agent and
gives no warranty as to the accuracy of such information. It is
for each Bidder to satisfy her/himself as to the accuracy of such

ach Bidder is responsible for ensuring that s/he has a copy of the
most up to date version of the Sale Catalogue and to ensure that
at the time each Property is auctioned s/he is fully aware of any

Property as soon as reasonably practicable including the payment
of any valuation fee;
5.6 if the Buyer intends to use a loan in connection with the purchase of
the Property s/he will apply to the relevant lender and complete all
necessary documentation as such lender may require to process the
Buyer’s application as soon as possible including the payment of any
application fees;
5.7 the Buyer agrees that if Preliminary Sale Contracts for the purchase
of the Property have not been legally exchanged within 21 days of
signing the Sale Memorandum the Seller has the absolute right to
re-offer the property for sale free of any obligation to the Buyer. In this
event the Administration Fee is deemed non-refundable.
4. No Warranty
No warranty is given by the Auctioneer as to whether:-
4.1 any Property is fit for purpose;
4.2 the physical condition of any Property;
4.3 the Seller has a valid and marketable title to the Property concerned;
or
4.4 the Property has the benefit of such planning and other statutory
consents which may be necessary or desirable for the Bidder’s
purposes.
5. Bidding and Reserve Price
5.1 All bids are to be made in Euros exclusive of any applicable TVA.
5.2 U
nless stated otherwise each Property is subject to a reserve price
(which may be fixed at any time prior to the Property being offered
for sale). If no bid / offer equals or exceeds that reserve price, the
Property will be withdrawn from the Auction.
5.3 W
here there is a reserve price, the Seller may bid (or ask the
Auctioneer or another agent to bid on the Seller’s behalf) up to
the reserve price but may not make a bid equal to or exceeding the
reserve price.
C: Buyers Conditions of Sale
6. Termination of Agreement and refund of Administration Fee
On the Auctioneer receiving an acceptable bid or when an offer is accepted
pre or post Auction, the following terms and conditions apply.
It is hereby agreed between the Buyer and the Auctioneer as follows:-
6.1 the Agreement has been entered into by the Auctioneer on the
basis that the Buyer has given certain undertakings to the Seller as
hereinbefore referred to. Should the Buyer fail to comply with such
undertakings strictly in accordance with the timescales hereinbefore
referred to,(or the expiry of any extension granted by the Seller
in writing) the Auctioneer has the absolute right to re-market the
Property for sale free of any obligation to the Buyer other than
to refund the Administration Fee where the failure to exchange
preliminary sale contracts arises solely due to none performance by
the Seller.
6.2 s hould the Buyer decide not to proceed with the purchase of the
Property in accordance with the terms of the Agreement, s/he shall
immediately advise the Seller accordingly, whereupon the Agreement
will immediately terminate. The Administration Fee will not be
refundable to the Buyer in these circumstances.
6.3 s hould the Seller decide not to proceed with the sale of the Property
to the Buyer s/he will immediately advise the Buyer accordingly,
whereupon the Agreement will immediately terminate and the
Auctioneer will refund to the Buyer the Administration Fee.
6.4 S
hould the Property be subject to pre-emptive rights to purchase and
those rights are exercised by the benefiting party, this Agreement will
immediately terminate and the Auctioneer will refund to the Buyer the
Administration Fee.
6.5 T
he Auctioneer and the Buyer enter into the Agreement in good faith
and in reliance on its terms.
1. Sale Memorandum
If a Buyer’s bid / offer for a Property is successful, s/he must sign a Sale
Memorandum under which s/he agrees to be bound by these Conditions
and pay the requisite Administration Fee.
The Buyer must provide all information reasonably required to enable
the completion of the Sale Memorandum (including proof of identity
and address).
The Property concerned will only be progressed with the Buyer
in exchange for payment of the Administration Fee and the Sale
Memorandum signed by the Buyer. In the event that the Buyer fails to
pay the Administration Fee and/or complete the Sale Memorandum
within Sixty (60) minutes following the end of the Auction, the Auctioneer
will be entitled to treat the Buyer’s bid or offer as null and void but without
prejudice to any claim which the Auctioneer, the Seller and/or the Seller’s
Agent may have against the Buyer.
2. Administration Fee
The Administration Fee is strictly non-refundable to the Buyer save as
set out in Section C, Condition 7 hereof.
In some circumstances, the Actioneers standard Administration Fee may
be varied. Any change from the Actioneers standard Administration Fee
will be listed in the Special Conditions of Sale for the Property.
The Administration Fee can be paid by cheque or by direct bank transfer.
We are unable to accept cash.
3. Joint and Several Liability
The Conditions are legally binding and enforceable. Where there are
two or more persons comprised in the Buyer then these Conditions are
enforceable against such persons jointly and severally.
4. Exchange of Preliminary Sale Contracts
The Buyer agrees to use their best endeavours to exchange Preliminary
Sale Contracts within 21 days as laid out in these Conditions. Where in
the case such day would fall on a day which is not a Business Day then
the applicable day shall be the next Business Day following such day.
5. Buyer’s Obligations
The Buyer undertakes as soon as possible following payment of the
Administration Fee and completion of the Sale Memorandum:
5.1 to use all reasonable endeavours to exchange preliminary sale
contracts within 21 days.
5.2 to immediately nominate a Notaire and or a Solicitor.
