A rapid enzyme-linked immunosorbent assay
(ELISA) test for detection of BVDV antigen in
immunotolerant, persistently infected (PI) cattle
using ear notch tissue. It can be used in the clinic
or at the farm to test all new introductions to the herd—newborn
calves, replacements, or bulls—in order to prevent the spread of BVDV.
The device will develop color on the flow matrix when used and you
can read the results on the flow matrix without any other equipment.
Positive results from this assay are valid for calves of any age.
All test kits come in packs of 10 tests with 1 bottle of conjugate, and
a complimentary accessory pack for the Large Ear Notch sample type
(sample * 1 cm on a side). The test can also be run on serum and/or
Small Ear Notch samples (sample is 2-3 mm in width). Serum samples
and Small Ear Notch samples require a different protocol than Large
Ear Notch samples. IDEXX recommends that all customers run the
Large Ear Notch Protocol because it is faster and easier. The Large
Ear Notch Protocol requires one SNAP BVD 10-Test Kit (10 tests, 1

Social Media: Continuing Issues for Employers

I. Introduction
In previous articles in The Messenger, we have discussed the advent
of “social media” and the new challenges it presents for employers.
The focus of our first article was on the risks that social media can
present to employers and in particular, the risks that could result from
employee misuse of social networks. We offered policy language that
employers might want to consider for the purpose of regulating social
media activity by employees. In our second article on this subject, we
examined the use of social media in the hiring process. We touched on
the advantages in using social media in making hiring decisions as well
as the risks that might be presented to employers in doing so. In this
month’s article, we discuss new developments that argue for caution by
employers in using information gleaned from social media sources as
the basis for disciplinary action against employees.
II. Privacy Interests Implicated by Social Media
Policies
Issues continue to be presented by employees’ claims to right to privacy
in their social networking activities. In fact, there appears to be some
disagreement among the courts as to whether there is a legitimate
expectation of privacy, especially when the employee has imposed
privacy protections around his online activity, and, even if there is,
whether countervailing considerations outweigh an individual’s right
of privacy. For example, in one case a court granted an employer access
to evidence from an employee’s My Space and Facebook accounts—
not only those portions that were currently public but also deleted
information. In contrast, in another case, a court indicated that an
employee may have a protectable privacy interest in information that
he has specifically shared with a controlled group online, particularly
where the employee had imposed privacy protections around his
online activity. In that case, although the jury concluded that the
employer had not violated the employee’s common law right to
privacy, the court found that the employer had violated the federal
Stored Communications Act. Of importance, the court noted that
an employee had provided the employer a password to the My Space
group under duress. At the very least, these cases argue for the adoption
of a social media policy that clearly puts employees on notice that they
should have no expectation of privacy with respect to their on-duty
personal use of employer-owned communication devices. With that
said, while employers should not be able to pressure employees to
provide access to privatized online information, courts may not allow
employees to avoid the disclosure of information in lawsuits simply by
attempting to “privatize” their social media sites.
III. Limitations on the Use of Social Media to
Discipline Employees Under the National Labor
Relations Act
New developments under the National Labor Relations Act (NLRA)
also might create risks for employers in using information obtained
from an employee’s social media site for disciplinary purposes. Under
Section 7 of the NLRA, employees have the right to engage in concerted
activity for the purpose of collective bargaining or other mutual
aid or protection. Section 7 activities are protected regardless of the
unionization of the employee and in workplaces with no unionized
workers. It extends to employees who attempt to “improve terms and
conditions of employment or otherwise improve their lot as employees
through channels outside the immediate employee-employer
relationship.” Section 8 of the NLRA extends Section 7 protection by
making it unfair for an employer to “interfere with, restrain or coerce
employees in the exercise of their rights guaranteed in Section 7.”
In October of 2010, the National Labor Relations Board (NLRB)
filed a complaint against an employer after the employer had fired
an employee for posting negative comments about her supervisor on
Facebook. It was the NLRB’s position that the employee’s Facebook
discussions were protected concerted activity under the NLRA.
The case began when an employee was questioned by a supervisor
about a customer complaint concerning the employee’s work
performance. The employee requested union representation, which
she was denied. The employee went home that night and responded
by posting negative comments about her supervisor on Facebook.
Her post generated supportive comments from her co workers, to
which the employee responded with additional negative comments
about her supervisor. The employer suspended the employee for her
Facebook posts and then terminated her for violating the company’s
social media policy that in relevant part prohibited employees from
making “disparaging, discriminatory or defamatory comments when
discussing the company or the employee’s supervisors, co workers
and/or competitors.” The NLRB complaint alleged that the discharge
violated federal labor law because the employee was engaged in
protected activity when she posted comments about her supervisor
and responded to further comments from her co workers. The NLRB
complaint also alleged that the employer maintained an overly broad
policy regarding social media. The case settled in February of 2011
when the employer agreed among other things to revise its social media
policy to ensure that it did not restrict employees from discussing
wages, hours and working conditions with co workers while not at
work.
The NLRB has continued to file complaints against employers arising
out of their efforts to control employee use of social media. For
example, in one case, an employee posted a comment on her Facebook
page regarding a co worker’s allegation that the employees did not
do enough to help the organization’s clients. The post was made
prior to a meeting with management on working conditions and
generated responses from other employees who defended their job
performance and criticized working conditions. Learning about the
posts, the employer had discharged the employees who participated,
claiming that their comments constituted harassment of the co workers
mentioned in the original post. The NLRB complaint alleges that the
employee’s Facebook discussion was protected concerted activity under
Section 7 of the NLRA because it involved co workers discussing the
terms and conditions of their employment, including job performance
and staffing levels. The case is still pending. Similarly, in May of 2011,
the NLRB filed a complaint against a car dealer for allegedly unlawfully

terminating an employee for posting photos and comments on
Facebook that were critical of the dealership. The employee, a salesman,
and his co workers were unhappy with the fact that the dealership
served hot dogs and bottled water at a customer promotional event.
The employees were concerned that the quality of food and beverages
could have a negative effect on their sales and commissions. The NLRB
claims that the Facebook posting was protected concerted activity
within the meaning of Section 7 of the NLRA because it involved
discussion among employees about the terms and conditions of
employment. This case is also still pending.
In sum, while the law is still unsettled with respect to the reach of the
NLRA to activities by employees on social media sites, employers are
well advised to consider the following:

• Section 7 of the NLRA extends the right to engage in concerted
activity to employees even if employees are not unionized and in
workplaces with no unionized workers. It protects employees who
attempt to improve terms and conditions of employment and
includes discussions about wages, hours and working conditions.
For conversations between employees to be considered protected
concerted activity, they must look toward group action, and mere
“griping” may not be protected.
• Employers’ social media policies should not be overly broad as
to prohibit or chill concerted activity. For example, policies that
prohibit employees from “disparaging” the employer may be found
by the NLRA to be too broad.
• Any adverse action taken against an employee for comments made
on a social media site should be carefully considered. Care should
be taken to ensure that the disciplinary action is not based on an
employee’s engagement in concerted activity as that term has been
defined under the NLRA. Factors that may be critical to this analysis
include: (i) whether the online activity consists of one or more
employees; (ii) whether the activity is engaged in for mutual aid and
protection, e.g. employees discussing wages, hours or other working
conditions; (iii) whether the adverse action contemplated against an
employee would chill future protected activity; and (iv) whether the
employer’s social media policies have been followed and whether the
actions engaged in by the employee were within the scope of such
policies.

Successful Practices Know How to Change

Imagine a room full of veterinarians eagerly ready to start their own
animal hospital. You are an experienced veterinarian consultant with
knowledge and experience in the sector. You have worked with the
most successful practices as well as the biggest failures. From your
experience, you know what to do. The vets are all clinically
trained and the best in their field. Some have business
experience while others have little. Some will be lucky,
others will not. What message would you impart on
them as they start or acquire a practice? Would
you tell them to steer clear of the pitfalls of failed
practices, or impart upon them your experience
from the successful ones?
The Small Business Administration analyzes
the successes and failures of the loans they
originate.* Veterinary services suffered a
0.04% charge off rate in 2007, 0.22% in
2008, 0.32% in 2009, and 0.59% in 2010.
Compared to other professions, veterinary
services had the lowest failure rate in 2007 and
the second-lowest failure rate in 2010. Only
funeral homes and services had a lower rate. Do
not be alarmed by the spike in failed loans over
the past few years. The economic downturn and
credit crisis of 2008 led to an increase in failures in
all market sectors. As time passes and the economy
grows, failure rates will lower to the levels seen in 2007.
After studying the sector loss rates, you can imagine the
difficult task in understanding failures in a sector that had nearly no
failures before 2008. Now is a great time to look back over the past few
years to understand why practices struggled and failed. Veterinarian
practice owners can learn from the mistakes and poor decisions. Using
this knowledge, they will be able to make the right decisions.
Successful veterinary practices embrace change. All owners and
staff need to be “Change Agents.” Too many businesses create a well
thought-out and intuitive business plan, but when things change, they
do not change their plan. They force an old business model on a new
practice situation, which inevitably leads to slow growth or failure.
Examples of this behavior can be seen throughout many communities
hit hard by the poor economy. Many pet owners lost jobs and could
not afford to pay for veterinary care. Struggling veterinarians hoped
to wait out the poor economy, which led to a failure. Other practices
grew because of their ability to lower prices, create more affordable
healthcare options, promote the importance of pet health to their
clients in the community, and offer new services like home delivery.
Always take the time to analyze the way your business operates and be
open to change.
Successful owners use systems to monitor their practices. A quotation
from sociologist William Bruce Cameron that Albert Einstein also liked
is, “Not everything that can be counted counts, and not everything
that counts can be counted.” Like any business, successful veterinary
practices track anything and everything that can be counted when it
comes to running the practice. They record new and active patients,

revenues, case acceptance, and expenses, just to name a few. They also
take the time to follow up on practice concerns that are not as easily
tracked. For example, practice owners need to take time to ensure
that all employees are on the same page when it comes to the goals of
the practice. Does your practice have a list of core values that
all employees know and follow? Tracking core values in a
quantitative sense is difficult, but taking time to review
and teach employees your values will help in the long
run. Successful practices are able to find the proper
balance between tracking important
benchmarks and taking the time to
create a strong team that understands
the culture of your veterinary practice.
The best practice owners continually
make the best decisions. In addition
to tracking business progress, they
utilize industry-specific experts that advise
practice owners in difficult situations. It is highly
recommended that, as a small business owner,
you align yourself with good advisors including a
CPA, an attorney and a management consultant who
are readily available on short notice. For the smaller
day-to-day questions, rely on the financial benchmark
data that you collect and your own experience. Weigh
all options when pondering what to do when it comes to a
decision, then act. If the decision was good, proceed. If it turns
out to be poor, do not be afraid to go back and change.
The bottom line is that successful practices know how to change. The
worst thing a practice owner can do is not change or adapt to the
changing veterinary marketplace. But changing for the sake of change
is not a good philosophy, either. Practices must utilize systems to track
progress. From your systems and data, make the right decision to

Promoting Veterinary Expertise

The early days of the Internet were like the Wild West of
information, the Gold Rush of access, and the Space
Race of expertise. With veterinary teams busy
doing the day-to-day work that keeps pets
healthy and alive, others staked claims
to the treasures of the Web. They sold
themselves as experts, and because petcare professionals found themselves
otherwise occupied, people believed
those self-styled experts (and still do).
Everyone knows 75% or more of what’s
published on the Internet is junk, and
yet, it’s still there taking up virtual space
and getting real attention.
The question, then, is: How do you market
yourself as an expert when it seems as though
everyone else claims to be one as well?
Differentiation and Positioning
As a clinical professor at Northwestern University, Kellogg Graduate
School of Management, Tim Calkins, MBA, brings years of consumer
marketing experience to his on-campus role teaching, among other
things, biomedical and health enterprise marketing. Calkins explains
that all marketing takes root in what makes you different from others
who work in the same geographical area and the same professional
space.
“There are many different ways to differentiate, but you’ve got to find
something,” he says, “In the veterinary world, it could be a focus on a
particular type of animal, a focus on a particular type of technology, a
focus on a particular approach, but you have to give people a reason to
choose you over the next person. And, you have to give them a reason
to believe you are the perfect solution for whatever problem they have.”
“You don’t have to be mean in this world,” Calkins points out. “You
do have to point out that there are differences, and I think it’s very
important to tell people that not every clinic is the same.”

A Light in the Darkness
The information explosion, comparison shopping, and online retail
options (including pet products and even drugs) make easy targets as
the “enemy.” Rather than a mud bog of sketchy advice and potentially
counterfeit products, think instead of the Internet as creating
even more opportunity for you to shine through the
darkness as a beacon of clarity, accuracy, and
perspective.
“People have access to incredible amounts of data
these days, which is both good and bad,” Calkins
says, “but for me, that doesn’t diminish the
role of a veterinarian or a particular clinic. If
anything, it almost makes it better. If you’re
a pet owner with a sick animal, there is so
much data on the Internet that it’s hard to
process. It’s almost a greater opportunity for
clinics to stand out by helping people make
sense of it all.”
Veterinary medicine, at its core, is a service
business. And, services, Calkins says, are tough to
deliver entirely via the Internet. Sure, information flows
freely on the Web, but it’s much harder to deliver a service
there—especially one as personal as animal healthcare. “You’re not
selling mortgages or computer chips,” Calkins says. “This is a service,
and it’s an incredibly emotional space.”

Selling What You Know
Across medical professions, TiaMarshae Sanford from Ego Trip Media,
which has offices in both Florida and Ohio, sees the same mistake: Not
staying in regular contact with current clients.
“They only talk to them when the client comes in or when the client
has a problem,” Sanford says. “The returning client is the best client
because they are the ones who are going to give you referrals.”
Sanford is a fan of Constant Contact®, an email marketing system that
allows you to create and send attractive, useful, and targeted emails to
your client database (assuming you have email addresses and an opt-in
process).
Sure, you can use such ongoing touch-point strategies to promote any
specials you have going, but it’s also a nice way to showcase what you
know as a way to show off who you really are.
“You are still selling something,” Sanford explains. “You’re selling
yourself. What you are actually doing is marketing your knowledge.
That means you have to be more engaged and more accurate with the
knowledge you share.”

For example, rather than simply telling clients the benefits of using
flea/tick products, demonstrate their use in some way. That could
include:
• Links to a video demonstration you made
• Step-by-step photos with written captions that walk clients through
the process
• Before and after photos of pets that suffered, then recovered, from
flea issues
“Think of it as best practices: when to use it, why to use it, how to
use it. When you combine your expertise with the product, it lends
a lot more integrity to the person from whom you are getting the
information,” Sanford says.
The key, Sanford cautions, is this: “Don’t talk about yourself. Talk about
what you know.”
How is that different exactly? Let’s compare a couple of sentences that
might show up in a marketing email or Facebook post:
• About You: ABC Animal Hospital provides comprehensive care to
both dogs and cats.
• About What You Know: ABC Animal Hospital’s Dr. Jones recently
attended an international symposium on aging pets. Armed with the
latest science in pet longevity, we updated our lifelong care plans for
your dogs and cats.
While it’s tempting, in this situation, to share information about senior
pet care only with people who currently have older pets, Sanford
prefers to let your entire client base see such messages. In an ideal
world, those with younger pets learn what’s ahead. Plus, they might
pass along your email to a friend or family member with an older pet.
“You really want them to know you offer a complete, holistic approach
to the health of the animals,” she says.
Sanford also recommends doing a small survey (maybe five questions)
as your first foray into regular marketing contact with clients. Asking
people what they want to know more about, for example, is a nice
way to build engagement with them. “It goes back to thinking from a
revenue perspective,” she says. “What do I want my clients to come in
and do? What builds my business? What keeps the lights on and the
bills paid? Build your questions from there.”

“Selling products that are widely available is challenging,” Calkins says.
“A lot of it will depend on how well the companies that manufacture
the products manage their brands.”
Products sold all over at drastically different prices leave little room
for you to set pricing margins. Matching often becomes the only viable
option. That’s one reason Calkins recommends sticking to companies
that carefully manage products, brands, and pricing. Apple is famous
for this, as are some other big-name brands such as Weber Grills. When

“The problem is that if you sell product where there is a wide variance
in pricing,” Calkins says, “then I think that can actually hurt your
practice. If you sell a product and someone finds out they can get the
product on the Internet for 30% less, then they have to logically say,
‘Well, my gosh, I bet the practice is overcharging me on other things
too because I know they are overcharging me on this product.’ Now,
you may not be actually overcharging, but the perception is that you
are, and every time they look at your price, they are going to say, ‘Oh, I
bet that price is too high.’”

Calkins adds, “If you’re having your staff spending time placing orders,
stocking, and restocking products with no profit, then you have to ask
yourself, ‘Why are we doing this?’” One reason might be that there is a
great benefit to your patients—such as a product that is needed ASAP
and cannot wait for an at-home, online order.

1. We are data hungry: We now want to have three to four different

point is provided (such as a website), we start to wonder what is
wrong with that business because information is absent.
2. Quick consumption: Show it to us quickly or forget about it. How

easily on a mobile device, market share is lost.

9 out of 10 people who use social networks are on Facebook. People
expect to learn about what you have to offer on Facebook, including

Search Engine Optimization: Google is “the” search engine in the
Internet universe. Depending on the statistics one reviews, Google
conducts up to 75% of the searches, followed by Bing and Yahoo. These
three search engines process 98% of the searches online. It is crucial
that your shopping cart be optimized for these three search engines.
If your cart is optimized for other search engines, that’s OK, but not a
“must have.”
Ideally, each product in the shopping cart should be optimized with
keywords. These words would be the product name, brand, and what
it does. Using a fictional heartworm product, some of the keywords
would be heartworm, Heartworm PLUS (product name), by X drug
company. The shopping cart as a whole should be optimized as well
with words that make sense. The best way to find these words is to use
tools provided by search engine optimization software and Google.
For example, you could optimize for animal hospital, animal clinic,
veterinary hospital, and so forth.
