Dear Colorado Dealer:
If you think summer is just about vacations and down
time, you don’t know the Colorado Automobile Dealers
Association! It is operating in high gear – working on
seminars, events and getting our message – present and
future – heard throughout the state.

Our Next Gen Dealer Group’s second event – nicknamed “Taking Orbit” – is planned for
August 20th. This group had a successful kickoff event June 3rd at the Vehicle Vault in Parker.
The next meeting is from 5-8 p.m. at the Forney Museum of Transportation, 4303 Brighton
Blvd. in Denver’s trendy River North District. The Forney Museum has an amazing collection
of antique cars, trains, horse-drawn carriages and other transportation artifacts.
One of CADA’s key missions and member benefit is to offer education for members and their employees. Several
informative and helpful educational seminars are scheduled in August:
• Legal Compliance for the Service Department and Managing Safety through Good Hiring Practices (for service
managers and directors, fixed-ops manager, dealer principals and general managers):
• August 11th, Noon-2:30 p.m. @ CADA Headquarters, Denver
• August 25th, 7:30-10 a.m. @ DoubleTree, Durango
• August 26th, 7:30-10 a.m. @ Courtyard by Marriott, Grand Junction
• Colorado D&H and Federal Advertising Enforcement (for dealer principals, GMs, GSMs, sales managers, new
and used car managers, controllers, advertising agencies, marketing managers and consultants):
• August 25th, Noon-2 p.m. @ DoubleTree, Durango
• August 26th, Noon-2 p.m. @ Courtyard by Marriott, Grand Junction

The itinerary for the 2015 CADA Project DC trip, held in conjunction with NADA’s Washington Conference in September,
is almost complete. For the last few years, the CADA Board and Next Gen Dealers have attended the NADA meeting and
benefited from the opportunity to really get to know our Colorado Congressional delegation. This year’s Washington DCbound contingency will leave Denver on Sunday, Sept. 27th and return Thursday, Oct. 1st. In addition to the “working”
parts of the trip, plenty of social and networking opportunities are planned.
Do you know a Colorado dealer who should be recognized and honored? Nomination forms for this year’s “TIME Dealer
of the Year” will be distributed soon, and we hope you will make every effort to nominate a dealer who really exemplifies
the best in our industry. This marks the 47th year the national award has been given. The national winner is selected from
those nominated at the state level and will be named at the NADA National Convention and Expo in Las Vegas next April
1st.
The criteria is pretty simple: “In addition to exhibiting exceptional performance in their dealerships, TIME Dealer of the
Year nominees perform heroic community service and are strong advocates for improving the world around them.” Our
2014 Colorado nominee and Colorado Dealer of the Year certainly fit. Scott Ehrlich of Ehrlich Toyota and Scion founded
College Promise, a scholarship program for Greeley students who want to continue their education at Greeley’s Aims
Community College by paying their first year’s tuition. The program has helped more than 400 students since its inception
in 2008 with contributions from Ehrlich, other local businesses and the Monfort Foundation.

CADA maintains good relationships with Colorado’s
elected officials as well as with the local news media.
Legislative Grassroots Meetings and Media
Grassroots Meetings are in full force for 2015.
• CADA organized two recent meetings with
Attorney General Cynthia Coffman. They
included: Jeff Carlson (Glenwood Springs Ford),
Todd Maul (John Elway Chevrolet), John Medved
(Medved Autoplex), Anthony Banno (Stevinson
Lexus of Frederick), Rob Edwards (Groove Toyota)
and Tim Van Binsbergen (Mountain States Toyota)
and many others. The group also included
Mike Feeley (Brownstein Hyatt Farber Schreck)
and CADA representatives Tim Jackson, Tammi
McCoy, and Morgan Smith. George Billings
with the Clear the Air Foundation was also in
attendance. .
• Early this month a meeting was held with State
Rep. Jack Tate (R-Centennial).In attendance
were A.J. Guanella (John Elway Chevrolet), Bill
Carmichael (Summit Automotive Partners) and
from CADA, Tim Jackson, Morgan Smith and
George Billings with Clear the Air Foundation.
• We enjoyed a topical lunch with KMGH’s Anne
Trujillo. Joining us were A.J. Guanella (John Elway
Chevrolet), Ed Dobbs (Land Rover Flatirons), Tim
Jackson and Morgan Smith (CADA) and George
Billings (Clear the Air Foundation). We’re meeting
with KCNC’s Jim Benneman soon.
• We just confirmed an August 4th meeting with
Colorado’s new Secretary of State Wayne
Williams, as well as the Colorado Dept. of
Transportation Executive Director Shailen Bhatt.

College Not the Best Fit for Next Gen? Opportunities
Abound in Auto Technology Fields and in Your Stores
Jobs in automotive service technology pay well and have long-term potential. Certified automotive
service techs spend less time and money in school than at a four-year college and automobile
dealers in Colorado are eager to hire them. In fact, dealers say jobs are going unfilled.
One reason is that high school graduates don’t know – or don’t believe – that college is not the
only way to a good future. According to Lincoln Technical College Director of Career Services Lee
Koelliker “I think high schools still preach that [four-year college] traditional paradigm and it’s been
difficult to get it shifted. We’re working to change some stereotypes.”

Auto tech jobs require plenty of smarts, though, says Schomp Automotive Service Director Jim
Thurman. “The idea is that if you’re not smart enough, you can go work on cars. But working on
cars today is more like being a mobile computer programmer. There used to be maybe 15 things that the computer controlled and
now it’s 250-300.”
Bill Carmichael, CEO of Summit Automotive Partners, agrees. “This is a path for people with technical and critical thinking skills
who are fast thinkers and productive. The opportunity to learn and grow without a college education is a great way to enter into a
career.” Koelliker adds, “Technical college actually teaches skills students can universally use to sustain themselves for a lifetime.”
Training to be an automotive service technician requires investing some time and money, but far less of both than for a Bachelor’s
degree. Auto tech programs lead either to Automotive Service Excellence (ASE) certification or an Associate’s degree. Programs
are available through vocational schools and community colleges.
Denver metro area programs are available through Lincoln Tech, both Denver and Jefferson County Schools (Emily Griffith
Technical College and WarrenTech), and at Arapahoe, Front Range and Red Rocks Community Colleges. Other community
colleges throughout the state also have programs. Scholarships, such as the ones offered by the Colorado Automobile Dealers
Association-sponsored Clear the Air Foundation, are available, as is financial aid. Several programs offer apprenticeships and
training partnerships in conjunction with dealerships and manufacturers. Manufacturers frequently require techs to receive some
additional training specific just to their vehicles.
With auto sales at the highest in years, the need for qualified technicians is also soaring. In Montrose, Flower Motors Fixed
Operations Manager Ron Ellis says “It’s become such a problem that even when I have a full load I devote 45 minutes to an hour
every day” to identifying potential employees. He travels to other cities to interview several candidates at a time, flying the most
qualified to Colorado for a final look-see. “If you’re going to do a quality job in servicing new cars, you’d better have the best
techs on the line.”
Auto service technology is proving popular among military veterans. Lincoln Tech’s Campus President Al Short says, “Veterans are
one of our core groups,” with about 150 among the program’s 800 students. Vets can use their GI benefits for training.
“The opportunity for women is greater than it’s ever been, too, because it’s not just heavy work like it used to be,” Schomp’s Jim
Thurman says.
Once a tech has secured a job he or she can expect frequent ongoing training through their employer to keep up with the latest
automotive technology. “Becoming a master tech is the same as having an advanced degree,” according to Carmichael. “You
can go anywhere, and based on certifications and work ethic, you would be highly valuable.” Lincoln Tech’s Koelliker agrees,

essentially anywhere else in the world.”
“This industry offers great benefits and a good
work environment,” says Thurman. It can also
lead to other jobs, he points out. “I started as a
tech and I’ve done all the pieces of the puzzle
but I always gravitate back to service.”
Salaries for successful auto techs, depending
on level of training and talent can range from
the upper $20ks to low $30ks on the low
end, and all the way up to six-figures for the
best in the industry.
The Clear the Air Foundation is now
capitalized in a way we can offer $50k in
auto tech scholarships annually. To sustain
that level of scholarship funding we count on
Colorado’s new car dealers to contribute old
high emitting cars, which are crushed and later
shredded. So not only are Colorado dealers
clearing Colorado’s air, we are also staffing
service bays with the next generation of auto
tech talent.
The foundation recently contributed $2,500
in scholarship funds to an auto tech student
who was already placed at Medved Chevrolet
North, Wheat Ridge. Lucky for us, Medved
has also contributed several high emitters
which were crushed, later shredded and no
longer pollute Colorado’s air and highways.
Colorado dealers and air quality advocates
have a meaningful program that works.

in June as the Marketing and
Communications Assistant.
She organizes legislative
grassroots meetings as well
as supports member outreach
and marketing efforts.
Morgan’s past experience
in government affairs serves
her well representing the
auto industry in a dynamic political environment. Prior to joining CADA
Morgan worked with the government relations team at Brownstein Hyatt
Farber Schreck during the 2015 legislative session. During this time she
was able to work on many transportation issues while representing
CADA at the Colorado Capitol.
While attending Colorado State University Morgan served as the Executive Director of Government Affairs for the Associated Students of Colorado State University representing over 26,000 students on the local, state,
and federal levels. Morgan enjoyed working closely with the City of Fort
Collins to promote positive community relationships between long-term
residents and the student population. When not working in Fort Collins,
Morgan spent much of her time at the capitol advocating for issues ranging from capital development to higher education
funding.
Morgan earned her B.A.
from Colorado State
University with a major
in Political Science and
a minor in International
Development. She loves
cheering on the CSU
Rams at football games
and looks forward to many more successful seasons in the new stadium.
Outside of work Morgan enjoys traveling, cooking, and running. Her
most recent trip took her to Vietnam, Laos, Cambodia, and Thailand. She
is currently training for her first
half marathon in October and
looks forward to logging many
miles before then.
Morgan resides in the Denver
Tech Center and drives a
2009 Honda Civic.

The Colorado Motor Vehicle Dealer Board
(“Dealer Board”) advises all dealers that the
Auto Industry Division (“Division”) will be
aggressively investigating D&H advertising
compliance.
To date, enforcement has been more educational, with warnings typically issued.
Recent complaints from dealers to the
Division and Dealer Board have escalated,
with dealers demanding compliance by
all dealers.
In addition, the Federal Trade Commission
continues to bring aggressive advertising
enforcement action against dealers.
It is critical that every dealer ensure
proper advertising compliance.

Dommermuth of Denver’s Fairfield &
Woods will cover Colorado and federal
advertising regulations, including recent
recent enforcement activity by the Division

Regulatory and Legal Update
DEALER AND SALESPERSON – NEW
LICENSE FEES EFFECTIVE JULY 1ST
Licensing fees were decreased 5% this year, effective July 1,
2015 to June 30, 2016. A dealer license is now $455, down
from $479, and a new salesperson application is $110, down
from $116. Off premise permits, license re-prints and late fees
remain the same.
As a reminder, Auto Industry Division license fees are subject to
change once each year on July 1st; the new schedule is typically made available on the Auto Industry web site in May or
early June. Visit http://www.colorado.gov/revenue/AID under
“Licensing”, “Fee Schedule”. Be sure to remit the updated fee
amount—most state license application forms do not include the
fee amount since they are subject to change each year.

ERRONEOUS VEHICLE HISTORY REPORTS—
AN UPDATE

Two years ago, the National Association of Dealer Counsel’s
Defender published an article discussing some of the problems
associated with erroneous vehicle history reports (“VHRs”). The
article concentrated primarily on Carfax due to the large segment of the industry that it occupies, and, in particular, the “Total
Loss” designation Carfax assigned to vehicles with only minor
damage. Since that time, I have been contacted numerous times
to provide assistance with false VHRs and in correcting the reports, as well as to provide information as to available remedies
they might have for the lost value they suffered in a sale or tradein. Based on the volume of inquiries, I prepared this update.

The specific, revised form and requirements under these new rules
still need to be finalized and approved by the dealer board. Once
released, it is expected there will be at least a ninety day period to
allow dealers to transition to the new form. Dealers are advised to
begin allowing inventory levels of this form to deplete in advance of
the change. A summary of the requirements and the final form will
be provided as soon as it is approved.
Auto Industry Division: New licensing computer system
conversion set for Sept. 3rd/4th.
The Auto Industry Division has been working for several years to
carefully plan and prepare for a transition to a new, more robust
dealer / salesperson licensing and tracking system. The Division
anticipates this conversion happening in about six weeks. The
licensing system is expected to be unavailable on Thursday/Friday
Sept. 3rd/4th, so dealers should plan accordingly.
DRIVER’S LICENSE WITH RESTRICTIVE
BANNER IS NOW AN ACCEPTABLE I-9
DOCUMENT
As mandated by the Colorado Road and Community
Safety Act, foreign nationals and their family members
in Colorado who are temporarily present in the U.S., including undocumented individuals or those with temporary legal status, may
obtain Colorado driver’s licenses, driver’s permits, or identification
cards. Such licenses contain a banner with a black background
indicating “NOT FOR FEDERAL IDENTIFICATION, VOTING OR
PUBLIC BENEFIT PURPOSES.” Several other states issue licenses
with the same or similar restrictions in compliance with the federal
REAL ID Act.
Until recently, U.S. Citizenship and Immigration Services (USCIS)
had not addressed whether these restricted licenses were acceptable List B identity documents for I-9 purposes. Historically, MSEC
advised employers not to accept these licenses until USCIS provided further guidance. After nearly a year, USCIS has addressed this
issue, clarifying that a license with “NOT FOR FEDERAL IDENTIFICATION PURPOSES” or similar restriction language is an acceptable I-9 List B document, and that employers should not reject it.
MOTOR VEHICLE DEALER BOARD / AUTO
INDUSTRY DIVISION UPDATES
Employers will review and examine these restricted licenses the
same way as the unrestricted ones. Since an employee who presents an acceptable List B document also needs to provide a valid
and unexpired List C document, the employer will also need to
review and confirm the validity of the List C document establishing
employment eligibility.
After numerous stakeholder meetings and formal rule promulgation by the Motor Vehicle Dealer Board, new rules have been
adopted and set to take effect August 14th covering the standard
disclosures required on all retail vehicle sales.
