July 2012 Newsletter - UNITE HERE Local 47
Vol.4 | Issue 2 | Summer 2012 President/Administrator - Ian Robb’s Report Since the election of the Future 47 team in February 2011 a lot of exciting things have happened in our Local Union. As many of you know, Local 47 has grown from 2005 (imposition of Trusteeship) at approximately 780 members to in excess of 2700 members in 2012. In the last year Local 47 has bargained 6 Camp Collective Agreements and 3 Hospitality Sector Collective Agreements. You will find highlights of those agreements throughout this Newsletter. We have entered into a Voluntary Recognition Agreement with Sodexo Canada for the Pioneer Camp and for all operations in the Province of Alberta. We have a provincial wide recognition which means Local 47 has the right of first refusal for all other operations in Alberta. Sodexo continues to bid on camp jobs and continues to work in cooperation with Local 47. resulted in Local 47 challenging the Alberta Labour Relations Board over one of their rules which denied the true wishes of the members. Local 47 was prepared to take the Alberta Labour Relations Board to the Supreme Court of Canada with a Constitutional Charter challenge. The Labour Board granted the Certification vote. During the process Local 47 negotiated a voluntary recogni- Ian Robb, President / Administrator tion with the Employer. Poplar Creek was a 500 man camp that is quickly growing to a 1500 man camp. I assisted Local 40 (BC) in bargaining with Compass for a camp in British Columbia. I sat at the table and assisted with workload issues and also provided a Local 47 camp Steward to be the Steward at the camp in BC. By working together we are ensuring solidarity and continuity in the Camp Sector across the country. The 3 Aramark Jackfish camps have joined Local 47 – Aramark agreed to a Voluntary Recognition Agreement and it was ratified in March 2012. This resulted in approximately 100 new members. Just down the road from the Jackfish Site is another Aramark Site – Pike Camp. After the ratification at the Jackfish Sites the folks working at Pike contacted Local 47 and we are proud to announce we have ratified another voluntary recognition agreement for this camp. That is another 80 - 100 new members. At the time of printing this newsletter we are in bargaining with Aramark at MEG Energy, Poplar Ridge Lodge. Joanne Moody and I worked with ATCO Structures and Logistics and Sodexo on their bids for new camps representing over 16,000 new beds in the oilsands. If either contractor gets any of those new camps they will be voluntary recognitions for Local 47 in the coming months. Local 47 is in negotiations with Local 41 (Saskatchewan) to merge into one Local. Local 41 is a hospitality Local with approximately 400 members. We look forward to welcoming the members to our family. A special called membership meeting will be scheduled to vote on the proposed merger. We have organized four new camps – the one called Poplar Creek is with the catering company of Horizon North Logistics and the other three are with Aramark. The Poplar Creek organizing effort Local 47 filed an application for certification for a camp that is run by SNC Lavalin OM&G. The Employer fought the application and we had the hearing at the Labour Board in April. This camp will I, as the Chair of the Building Trades of Alberta Camp Rules and Regulations Committee, successfully concluded 2 years of negotiations. I was also elected as the President of the Northern Alberta Building Trades Council. LOCAL 47 GOES VIDEO! It was an amazing experience to have this video conference. Ian Robb and Joanne Moody spent time with Albian members one evening and explained the results of the Safety Shoe Grievance and updated us on the Meal Breaks Arbitration and Bargaining. Lots of good feedback from the members, who ranged from long timers like Ali Khedaloui and Hani Hussein, and brand new work permits like Ted Tecle and Fattha Ahmed. “It is a breakthrough and a nice Albian members in attendance Riad Salha, Deborah Power, Sabrin Abdulmonime, Gert Bouzane, Daphne Stacey, Lynne McRae, Fidaa Fadel, Rocque Chouinard, Vasilios Fikiris, Diane Fikiris, Lien Do, Rawad Radwan, Walid Akiki, Vincent Howe, Said Assaf, Grace Stagg, Gary Stagg, Martha Bernard-Stamatelakis, Emmanuel Stamatelakis, Wade Boyde, Linda Van Holland, Kim Lang, Duane Charlton, Fattha Ahmad, Awad Zamel, Monica Pumphrey, Corinna McDowell, Walid Abouhassan, Abdulmajid Osman, Hani Hussein, Marvin Bassendowski, Victor McRoberts, Ted Tecle, Mohamed El Faki, Souliman Hachem, Cory Lasaga, Ravin Paramanantham, Lorne Power, Carolyn Moore, Christina Scallion, Ali Khedaloui, Vikram Saran, Hilda Mason, Tarek Shibley, Helena McNeil, Butch Barron, Louise MacEachern, Marguerite Herelle, Margaret Mouland, Brian Kennedy, Pauline Hasselgrave, Jean Nicolakakis, Rex Bennett, Brenda Bennett, Bernie Butler, Saad Karout, Michael Lebek, Robert Mireault, Mohamed Karout, Yassine Kobrosli. means to bring the Union together especially with the addition of more sites everyday”. A camp attendant was so happy, she said: “I didn’t even know how they looked like”, another one said: “it was nice, and they were there to answer any question”, a janitor said “It is a breakthrough and a nice means to bring the Union together especially with the addition of more sites everyday”. “A big thank you to everyone who participated in this historic first”. President/Administrator Ian Robb’s Report Cont’d represent another 160 - 180 new jobs. The Union recently won the hearing at the Labour Board and the ballots have been counted. 76 voted in favour of Local 47 and 3 voted against. We are in the process of setting bargaining dates at the printing of this newsletter. Suncor’s new project — the Voyageur camp (which is across the highway from Suncor Baseplant) opened in June. Compass ESS was awarded the contract and they have agreed to take the Collective Agreement we have at the Suncor Site and put it in place at the Voyageur Site. This will represent another 100 – 150 new jobs. Local 47 is working hard to showcase our members as the best skilled camp workers in the oil fields. To help reach that goal we are very happy to announce that we have just purchased a new office building. It is essentially turn-key and we have recently moved into our new home. The building is almost 16,000 square feet and will have a great training centre that will keep Local 47 moving forward – the best of the best. We will continue to have the best trained camp workers in the North! 2 Local 47 Union News | SUMMER 2012 Vice President’s Report by Albert Amire I want to share a little bit with you about the history of our Union and Collective Bargaining. As you all know, Albian, Suncor, Syncrude, Albian Cafeteria, Voyageur and Firebag are up for bargaining now. Your bargaining team will be led by our President/Administrator Ian Robb and Secretary-Treasurer Joanne Moody and will include members working at each site. I think it is important to know and especially for our newer Brothers and Sisters that we were not always paid this well; that we didn’t always have such a good health care and pension plan. Very few people know that in the 80’s we were about 200 members working. At that time, we couldn’t get seniority into the Collective Agreement. We had to fight hard for that. Then in the late 80’s our pension was $.15, $.20, $.25 an hour into our Pension Plan. As members we united together and wanted to plan for our future, and we took all the wage increase the Employer gave us into the Pension Plan. This has benefited all Local 47 members, we are all very proud of our Pension Plan and our Health Care Plan. That is thanks to our Brothers and Sisters who were around then and thought of the future. Albert and his newest granddaughter, Leanne. Now this time, the priority should be the language in our Agreements. What do we want? We want money? Of course, but the company is not there to give, give, give. We need to get our priorities straight for what will protect us and future members. We need to protect our health and safety – so when we retire we are not broken. We have to know what we want, we have to know what our priorities are, we have to give the leadership the tools and our support to get what we all believe are our collective priorities. Remember what we did in the 80’s and what we all take for granted now (seniority/healthcare/pension), we need to plan for the future, for our future. JOB STEWARD TRAINING –COMING SOON! UNITE HERE Local 47 is pleased to announce there will be a Camp Sector Job Steward Training coming up in the fall. Several people have already expressed preliminar y interest in attending this training. Being a Job Steward is not an easy task. There are in fact two ver y impor tant jobs of a Job/ Shop Steward. • The fir st is to monitor work place conditions, deal with complaints, investigate and settle grievances and ensure the Collective Agreement is being followed. • The second is to be the Union’s link between the member ship and the Union Hall. Being a Job/Shop Steward means: •Being available by having your door open or your phone on day and night. • Your room or apar tment is full of paper s and files. solver, an organizer, politically aware. a sounding board and be Your Job/Shop Stewards both in the Camps and in the Hospitality sector constantly go above and beyond to help their brother s and sister s. They volunteer countless hour s of their time to make things better for their co worker s. These people do not receive any extra pay for doing these countless extra things ever y working day and often on their days of f. All Camp Sector member s w ho would like to par ticipate in the upcoming Job Steward training should write a letter to the Union expressing interest, outlining w hy you think you will make a good Job Steward, describe volunteer work you have been involved in and please include your contact infor mation on your letter. All letter s will be considered and par ticipants will be selected based on the above criteria. Please write a letter expressing interest, outlining why you would make a good Job Steward, describe volunteer work and include contact infor mation. • You must - represent the issue - not the individual member - but the issue that is raised. • You will clearly communicate the concer ns of the member ship to the Union Representative and to communicate issues from the Union Hall to the member ship to keep infor mation flowing. •You must be able to communicate clearly and professionally with management often in ver y tense situations. These are just a few examples of w hat being a Job/ Shop Steward means. Basically that individual must be a leader, an educator, a communicator, a problem Local 47 steps up to the plate A big thank you and a shout out to Joanne, Ian and our very diligent lawyers who challenged the receivers at the Crowne Plaza Chateau Lacombe! Sadly, the Crowne Plaza Chateau Lacombe went into receivership on Friday, November 25th. While most unions would stand back and wait to see what might happen, Local 47 stepped up to the plate on behalf of our members at the hotel and made sure that the receivers upheld our collective agreement and revoked the letters of termination/rehire which were sent out to all the members on the day of receivership. It has been a difficult and challenging time for all the members at the Crowne, with cutbacks, layoffs and reduced hours. The news that the hotel went into receivership was demoralizing, let alone the news that all of our vacation pay had vapourized and our only recourse was to apply to the government for compensation of a portion of the monies owed us for vacation time. Thank goodness, Local 47 stood up for us and got all that back! Thank you, Thank you, Thank you! Sincerely, Caroline Schwabe 3 Local 47 Union News | SUMMER 2012 Merger – Local 41 As allowed for in our Bylaws, Local 47 is moving forward to merge with Local 41 in Saskatchewan. There will be a special called membership meeting to vote on the merger proposal in the coming months and a notice will be posted to inform members of the time, date and location. A merger with Local 41 will open up the camp sector in Saskatchewan for our members and allow for better representation for the hospitality members both in Saskatchewan and Alberta. Good results equals positive feedback Ms. Joanne Moody Local 47 RE: Local 47 Contract Negotiations Ms. Moody, When initially approached to represent the Camp Attendants at the CNRL Site, I was hesitant due to the lack of knowledge of the actual process. I now have a new appreciation for the process and can value the work that our union representatives put forward to ensure we are properly compensated for our dedication, loyalty and hard work. When the negotiation meeting was concluded, I have to remark on my feeling of complete pride and absolute confidence in our union leader, Mr. Ian Robb. The qualities that are required to be a great leader are evident in Mr. Robb. He knew the contract through and through. The passion that he exhibited when negotiating our contract certainly left me knowing that we are well represented. I would like to express my gratitude for the opportunity to participate in the negotiation process of our contract. Sincerely, Muriel Strang Camp Attendant 2005 Sell Jimmy! Christmas 2011 - Thanks and Gratitude to Local 47 Local 47 received the following note from Randy Stefanizyn the Manager of Labour Relations for Syncrude Canada Ltd and Shandra Linder, Corporate Labour Relations Advisor. Randy and Shandra sent these notes following the Christmas dinner that Local 47 members put on at the Syncrude Site. Ian, I am sure that you have received a very positive response for the efforts that your people continue to put forth. Obviously the incredible pride in their abilities is reflected in part through the photographs that Heidi was able to share with us. Barge Landing Our thanks to you for the genuine support of Local 47 throughout the entire year, as your organization continues to work with our contractor of choice. We appreciate our very positive working relationship your staff and employees, and especially those employed on our site. Randy Stefanizyn Manager, Labour Relations Syncrude Canada Ltd. Shandra Linder Corporate Labour Relations Advisor Throughout the Oilsands Local 47 members outdid themselves in making Christmas for their customers a memorable experience. 4 Local 47 Union News | SUMMER 2012 Membership Meeting ~ June 10, 2012 At the membership meeting on June 10th in Edmonton at the Holiday Inn Express Hotel your Officers were very pleased to present Brother Michael Lashomb with Lifetime Membership. Brother Mike has been an exemplary member who is always ready to volunteer to help with any project and he attends funerals on behalf of Local 47 of any Brothers and Sisters who pass away. It is because of members like Mike that the Lifetime Membership honour was created. As of June 10th, the Union will pay Mike’s Union dues and his burial fees in appreciation of his service and dedication to Local 47. Kathy Parent’s Statement About Unionizing the Workplace by Kathy Parent, Amarak Jackfish Site What is the process of the union coming to the camp? It was relatively easy to get the attention of the union, because the workforce present at the camp was ready, everyone felt bullied and was sick of the cheap wages that we were being paid. For many of us, we felt that we had nothing to lose, as we knew there had to be a better option for us. Brother Michael Lashomb accepts his lifetime membership certificate from President/ Administrator, Ian Robb and Vice President, Albert Amire. 3rd Annual Catering Championships The 3rd Annual Catering Championship took place on Sepember 13, 2011 at the First Nations community of Fort MacKay. Food service teams from ESS run camps in the Fort McMurray area competed in this ESS lead initiative for the “Catering Chamionship Cup.” It was a heated, yet friendly, competition between the finest of UNITE HERE Local 47 members, from Syncrude, Suncor, CNRL, and Albian Sands. The Albian Sands team won this year’s title and brought the “Catering Championship” cup back home! The team, led by Chef Brian Gregan, included Cooks: Reggie Simms, Mary Chong, and Ryan McIsaac, Baker: Sarah Lawson, and GH’s: Faisal Zahra, Wayne Hanlon, and Moe Karout. Local 47 members continue to showcase their dedication and talents, which enables the employers to provide the best service to the customers. “We compete, not so much against an opponent, but against ourselves “(Bud Wilkinson) Congratulations!! By becoming unionized all of our wages increased by 50% or better, and our jobs have shifted from being just “jobs” to careers. Instead of being employees of a company that exploited us for cheap labour, we now make a fair wage that we can be proud of, as well as being allotted the necessary benefits that we as Canadians value in extended healthcare, dental, and a pension plan. Secretary-Treasurer Report by Joanne Moody I am please to report that the finances of Local 47 are in good shape and I am proud to advise the members of Local 47 that we are in compliance with the International Union’s fiscal policies and procedures. The Trustee’s review the books and bookkeeping practices every two months prior to General Membership meeting and each time they report that the books are in accordance with the policies and are in good order. End of April 2012 – Balance Sheet Total assets of the Union are: $7, 516, 785.11 5 Local 47 Union News | SUMMER 2012 Executive Board Report by Yassine Kobrosli Fellow Brothers and Sisters let’s all take a step back and do a self-evaluation for a second; have we ever asked ourselves where we would be if we weren’t members of this great Union?! This matter is of extreme importance to our organization and subsequently to our lives and livelihood, because taking our membership in Local 47 for granted is leading us to complacency, and complacency is a fertile environment for negative attitude; which contravenes our Union’s mission of providing power, dignity, and independence to the membership. 1 Our wages, benefits, and work conditions have exceeded by far those of the nonunionized workers at the very same Hospitality/Catering industry, which made our Union very appealing to job seekers, and most of us were not an exception, and definitely felt privileged to become members. The relationship between the Union and the members is like the relationship between the heart and the rest of the body, a mutual beneficial partnership, where each is dependent on the other. The Union gave us an opportunity to improve ourselves, and improving ourselves served to improve the Union in return. “When it comes to life the critical thing is whether you take things for granted or take them with gratitude.” 2 Gratitude, towards the Union, could be expressed in loyalty, thankfulness, commitment, contribution, and ownership. This gratitude doesn’t suggest absolute obedience to a person or a group of people, rather to adopting the idea of unity under this organization’s umbrella, and the commitment to its advancement. Bargaining Update Jan 5, 2012 - 41b Cafeteria and Dashaways at the Syncrude Site members ratified a four year Collective Agreement with superior language changes and the addition of the CCIAF Fund contributions, the Benevolent Fund contributions and the Building Trades contributions. The members will receive a RRSP matching system of $1,000.00 per year for 2011 and 2012 and $1,200.00 for 2012 and 2013. In addition the member will receive wage increases of 4% effective today; 4% effective, April 1, 2012; 4% effective April 1, 2013 and 4% effective April 1, 2014. Thank you to Stacey Rogers and Albert Amire for your work on the Bargaining Committee. There’s always going to be room for improvement, because “the arrogance of suc- cess is to think that what we did yesterday is good enough for tomorrow” 3, but negative at- titude, undermining success, destructive criticism, spreading false accusations and rumours, and taking one’s failure against the Union in the form of DFR complaints, have all proven themselves to be destructive to the Union, and fruitless to the member. Dear Brothers and Sisters, it is our choice to choose between negative and positive attitude. Let’s not take our membership in this wonderful family for granted, let’s appreciate what we have, seek improvement through unity, respect, acceptance and understanding of others, and always maintain a positive attitude and remember “to be interested in the changing seasons is a happier state of mind than to be hopelessly in love with spring”. UNITE HERE Constitution. Gilbert Keith Chesterton. 3 William Pollard 1 2 Jan 26, 2012 – Ramada Hotel - Please be advised that a three (3) year Collective Agreement has been ratified at the Ramada Hotel in Calgary. The new agreement includes wage increases retroactive to May 1, 2011. Feb 6, 2012 - Barge Landing Lodge Site ratified the Mediator’s Recommended Settlement. The Collective Agreement has many improvements to language including: workload, scheduling, leave request, seniority etc. In addition, there are increases in travel subsidy with incremental increases each year for 2013 and 2014. Wage increases of 3% retro to February 1, 2011; 4% February 1, 2012; 3% February 1, 2013; 4% February 1, 2014. Thank you to Bargaining Committee members, Pat Thomson and Shakil (Sam) Ashraf for their dedication. Building Trades Golf Tournament – Local 47 team – Ron Bell, Albert Amire, Robert Hargreaves (Syncrude) and Ian Robb. Local 47 sponsored a hole in this years Golf Tournament and Nabiel Sanduga and Joanne Moody sold tickets all day and at the end of the day we gave away a prize of 1 night at the Chateau Lacombe Hotel and a $150 gift card to LaRonde Revolving Restaurant. The Chateau Lacombe graciously donated the free night and Local 47 paid for the gift card. Local 47 raised $970 and President Ian Robb threw in the $30 to make the donation to the Charitable Foundation an even $1,000.00. 6 Local 47 Union News | SUMMER 2012 At the time of writing this newsletter Local 47 is also in bargaining with the Employer at the University of Calgary. Preparations are being made and proposals are being received for bargaining for the Firebag, Albian, Albian Cafeteria, Borealis and Millenium, Voyageur, Suncor Baseplant Cafeteria and Mildred Lake Village Sites. STAY STRONG, STAY UNITED! Membership Information Meetings Strategic Planning Session RE: Presentation at Jasper Park Lodge by Bob Blakely Ms. Joanne Moody The first Membership Information meeting was held in Fort McMurray on Tuesday, February 14th, 2012. President/Administrator Ian Robb spoke to the assembled members about upcoming bargaining and the importance of solidarity during the bargaining process. The most recent Membership Information meeting was held in Fort McMurray on Tuesday, May 8th, 2012. Local 47 Legal Counsel David Mercer spoke to the members about the Collective Agreement and their rights and responsibilities under their Collective Agreement. Voyageur camp celebrates Canada Day! I would like to start off with extending many thanks to the people that invited me to attend the meetings concerning the future of our union on the weekend of 24 Nov 11 at Jasper Park. My first initial thought was “what a great opportunity to see the mountains and a great time to get a bit of relaxation.” I did see the mountains but my original beliefs of how the union meetings transpire were put into perspective. Many people including myself are under the misconception that these meetings are more fun than work. Well, I now know that this is not true. I am still amazed at the hard work that is put forth for our union which was clearly evident in Mr. Blakely’s seminar. Mr. Blakely was extremely knowledgeable and inspirational. He spoke about the direction of our union, including where we are now, where we want to go and how to get there. Everyone at the meeting was encouraged to give their input on how we can achieve our goal, to be the best union. On Saturday morning the meeting started at 8:30am and ran until late evening. Again Sunday morning we all met to resume our seminar until lunch time. After lunch we all parted back to our destinations. With the plan put forth by Mr. Blakely, I feel confident that we can be the biggest and strongest union under the leadership of Mr. Ian Robb.
