ORDINANCE NO. 512
ORDINANCE ADOPTING THE "CODE OF ORDINANCES OF THE CITY OF GRUNDY CENTER,
IOWA"
BE IT ORDAINED by the City Council of the City of Grundy Center, Iowa, that:
SECTION 1. Pursuant to published notice and following public hearing on the 7TH day of
April, 2014, so required by Sections 362.3 and 380.8, Code of Iowa, there is hereby adopted by the
City of Grundy Center, Iowa, the "CODE OF ORDINANCES OF THE CITY OF GRUNDY CENTER,
IOWA"
SECTION 2. All of the provisions of the "CODE OF ORDINANCES OF THE CITY OF GRUNDY
CENTER, IOWA," shall be in force and effect on and after the effective date of this
ordinance.
SECTION 3. All ordinances or parts thereof in force on the effective date of this ordinance are
hereby repealed from and after the effective date of this ordinance, except as hereinafter
provided.
SECTION 4. The repeal provided for in the preceding section of this ordinance shall not affect
any offense or act committed or done or any penalty or forfeiture incurred or any contract or right
established or accruing before the effective date of this ordinance; nor shall such repeal affect any
ordinance or resolution promising or guaranteeing the payment of money by the City or authorizing
the issuance of any bonds of said City or any evidence of said City's indebtedness or any contract
or obligation assumed by said City; nor shall said repeal affect the administrative ordinances or
resolutions of the Council not in conflict or inconsistent with the provisions of
"THE CODE OF ORDINANCES OF THE CITY OF GRUNDY CENTER, IOWA"; nor shall it
affect the following ordinances specifically saved from repeal:

April 29 at 5:40 AM on Hwy 20 at the
216 mile marker. CHAD ERHARDT,
age 39, Holland, was eastbound when
a deer entered the roadway and was
struck. Erhardt’s 2004 Chrysler received an estimated $6,300 damage.
No summons, no injury. Investigated
by GRUNDY COUNTY SHERIFF’S
OFFICE.
A two vehicle accident occurred
April 30 at 7:15 PM at Fox Ridge Golf
Course in Dike. MACLAIN WILLIAMS, age 15, Dike, was backing
out of a parking stall when the driver
turned too sharp and struck TROY
MULGREW, Dike. No damage reported to Williams’ 2003 Chevrolet.
Mulgrew’s 2008 Ford received an estimated $2,000 damage. No summons,
no injury. Investigated by GRUNDY
COUNTY SHERIFF’S OFFICE.
A two vehicle accident occurred
May 1 at 5:10 PM on Hwy 14 at 130th
Street. Both vehicles were northbound. JOSHUA DEBOWER, age 22,
Aplington, was slowing to turn west.
JACOB BRAGER, age 27, Grand
Junction, said he did not see a turn
signal and didn’t realize DEBOWER
was turning. BRAGER took evasive
action but still struck DeBower and
went into the ditch. DEBOWER’s
2000 Dodge received an estimated
$500 damage. BRAGER’s 2013 Ford
received an estimated $4,000 damage.
DEBOWER was issued a citation for
NO INSURANCE. BRAGER was
issued a citation for FAILURE TO
MAINTAIN CONTROL. No injury.

SHERIFF’S OFFICE.
A one vehicle accident occurred
May 2 at 9 PM in Conrad. MICHELLE HEASLEY, age 33, Reinbeck, pulled into a parking lot on
Church Street. The right front tire
struck a guide wire that was secured to
the pavement. It continued under the
vehicle and wrapped around the left
front tire. Heasley’s 2010 Chevrolet
received an estimated $2,500 damage.
No summons, no injury. Investigated
by GRUNDY COUNTY SHERIFF’S
OFFICE.
TREVOR FITZ, age 20, Latimer,
was arrested May 4 at 12:22 AM in
Dike and charged with OWI 1st. Released on a promise to appear. Arrested by GRUNDY COUNTY SHERIFF’S OFFICE.

ordinance amending the official zoning map, establishing building lines, establishing and changing grades, or dedicating property for public use; nor shall it affect any prosecution, suit or other
proceeding pending or any judgment rendered on or prior to the effective date of this ordinance.
SECTION 5. The following ordinances, passed subsequent to the preparation of this code but prior
to adoption of this code, are hereby adopted and made a part of this code. These are ordinances
None. Said ordinances shall be codified and incorporated in published copies of this code as supplements thereto following adoption of this ordinance.
SECTION 6. An official copy of the "CODE OF ORDINANCES OF THE CITY OF GRUNDY CENTER, IOWA," adopted by this ordinance, including a certificate of the City Clerk as to its adoption
and the effective date, is on file in the office of the City Clerk, and shall be kept available for public
inspection.
SECTION 7. The City Clerk shall furnish a copy of the "CODE OF ORDINANCES OF THE CITY OF
GRUNDY CENTER, IOWA," to the Judicial Magistrates serving the City of Grundy Center.
SECTION 8. This ordinance shall be in full force and effect from and after the publication of this
ordinance, as required by law.

PUBLIC NOTICE

BOARD OF SUPERVISORS PROCEEDINGS
The Grundy County Board of Supervisors met
in regular session on April 28, 2014, at 9:00
A.M. Chairperson Riekena called the meeting
to order with the following members present:
Schildroth, Bakker, and Ross. Absent: Smith.
Motion was made by Ross and seconded by
Bakker to approve the minutes of the previous
meeting. Carried unanimously.
Motion was made by Bakker and seconded
by Ross to allow Heartland Asphalt of Mason
City, Iowa, to use Secondary Road Department
property at 22580 M Avenue from May 1, 2014,
to July 15, 2014, for its portable asphalt plant
with location, dust control and repair of asphalt
approach at the fuel island to be approved by
County Engineer in addition to Heartland Asphalt providing a satisfactory certificate of insurance to Grundy County during set up of said
plant. Carried unanimously.
Motion was made by Bakker and seconded
by Schildroth to approve Utility Permit Application No. 4-28-14(a) submitted by Mastec North
America of Hugo, Minnesota, for Century Link
on 3 pair cable service line to 27180 – 160th
Street and to authorize the chairperson to sign
said application. Carried unanimously.
Motion was made by Ross and seconded by
Schildroth to approve Utility Permit Application
No. 4-28-14(b) to REC of Grundy Center, Iowa,
on installing an electric fence drop just south of
Bridge N-25 on the east side of the road and to
authorize the chairperson to sign said application. Carried unanimously.
Motion was made by Schildroth and seconded
by Bakker to approve Adopt-a-Highway Permit request by St. Paul’s Evangelical Lutheran
Church on T-19 from City of Wellsburg north to
Highway 20 and to authorize the chairperson to
sign said permit. Carried unanimously.
Gary Mauer, County Engineer, reviewed department matters with the Board.
Wendy L. Monaghan, RN, BSN, Grundy
County Public Health Manager, reviewed the
Grundy County Public Health Quarterly Report
for January 1, 2014, through March 31, 2014,
as well as reported on the drug take-back event
held on April 26, 2014.
At 9:35 a.m., motion was made by Ross and
seconded by Bakker to enter into executive
session by authority of Chapter 21 of the Code
of Iowa and pursuant to the County Attorney’s
request for the purpose of discussing strategy
with counsel in matters that are presently in
litigation or where litigation is imminent where
its disclosure would be likely to prejudice or
disadvantage the position of the county in that
litigation. Roll call vote was as follows: Ayes –
Schildroth, Bakker, Ross, and Riekena. Nays
– none.
Motion was made at 10:02 a.m. by Bakker
and seconded by Ross to adjourn the executive
session and return to regular session. Roll call
vote was as follows: Ayes – Schildroth, Bakker,
Ross, and Riekena. Nays – none.
Motion was made by Bakker and seconded
by Ross to table further discussion of the matters discussed in executive session until the full
board was present. Carried unanimously.
Motion was made by Bakker and seconded
by Schildroth to approve the application for fireworks permit of Jack L. Darland, Jr., of Cedar
Falls. Carried unanimously.
Motion was made by Bakker and seconded
by Ross to appoint Helene Wertz to the Grundy
County Memorial Hospital Board of Commissioners to fill an unexpired term which ends
June 30, 2014, and to fill a full three-year term
beginning on July 1, 2014, and ending on June
30, 2017. Carried unanimously.

NOTICE TO BIDDERS
1. Sealed bids will be received by the Grundy
County Auditor at her office at 706 G Avenue,
Grundy Center, Iowa, until 9:00 A.M. on June
9, 2014, for hauling refuse from the Grundy
County Citizen’s Convenience Center, 20434
220th Street, Grundy Center, Iowa, to the Rural
Iowa Landfill, 20488 M Avenue, Eldora, Iowa.
Said bids shall be opened and considered by
the Grundy County Landfill Commission at 6:30
P.M.a at its meeting held at 706 G Avenue,
Grundy Center, Iowa, on June 12, 2014.
2. The proposal shall be for hauling refuse using
an open top 30-yard container, which container
must be covered with a tarp while in transit. In
addition, the successful bidder must pick up the
said container within three days of being notified
by the Grundy County Citizen’s Convenience
Center. A similar container must be left at the
Grundy County Citizen’s Convenience Center
at the time of pick up or the original container
must be emptied and returned on the same day.
3. The successful bidder will begin hauling refuse from the Grundy County Citizen’s Convenience Center on July 1, 2014, and will continue
for a term of three years, provided, however,
that the contract may be cancelled at any time
by either party by giving a written notice to the
other party at least sixty days prior to cancellation.
4. Failure to execute a contract containing these
provisions and any other provisions deemed
necessary and to file a certificate of insurance
with the Grundy County Landfill Commission
within 15 days of the date of the acceptance of
the proposal as herein provided will be just and
sufficient cause for the denial of the award and
the forfeiture of the proposal.
5. All proposals must be filed with the Grundy
County Landfill Commission, sealed and plainly
marked. Proposals containing any reservations
not herein provided for may be rejected. In addition, the Grundy County Landfill Commission
reserves the right to waive technicalities and to
reject any or all proposals.
6. All of the work set out in this proposal must
be performed by the successful bidder and may
not be sublet or assigned by the successful bidder.

Agenda approving the minutes from the 3-2614 Regular Meeting, 4-7-14 Special Session
and 4-16-14, 4-21-14 and 4-22-14 Work Sessions along with bills presented for payment.

NEW BUSINESS:
The board was given an opportunity to ask
questions from Mrs. Miller, Mr. VanderPol, Mrs.
Lebo and Ms. Murra regarding their monthly
board reports.
The board listened to presentation on the Instructional Practices Inventory (IPI) by Brent
Thoren.
Motion made by Director Saak, seconded by
Director Mathews to approve the Open Enrollment request for Caden Meester. Motion carried unanimously.

by Director Saak to approve the Open Enrollment requests for Andrea and Erika Johnson.

Director Ascher to approve the hiring of Victoria
Duvall as a 5th Grade Teacher and Caleb Bonjour as a 6th Grade Literacy and Social Studies
Teacher. Motion carried unanimously.
The board heard a presentation on the 3rd
Grade Pilot from Rick Schupbach and Jan Lindeman.

Director Ascher to approve the continued membership in the Iowa Association for Education
Purchasing (IAEP) Program. Motion carried
unanimously.
Motion made by Directors Mathews, seconded
by Director Saak to approve continued membership in the Iowa School Finance Information
Services (ISFIS). Motion carried unanimously.
Motion made by Director Ascher, seconded by
Director Saak to approve the 2014-2015 Cross
Country 28-E with Gladbrook-Reinbeck. Motion
carried unanimously.

by Director Saak to approve the renewal with
Mercer Trust Insurance. Motion carried unanimously.

the PMA Financial Planning Program. Motion

trict). Motion carried unanimously.

Director Ascher to approve the 2014-2015Master Contract with a 3.73% increase. Motion carried unanimously.
Motion made by Director Mathews, seconded
by Director Ascher to approve the Contract List
for the certified teachers and coaching contracts for those seasons that have already concluded for the 2013-2014 school year. Motion
carried unanimously.
The board reviewed a request by Mr. Ackerman
to take a group of junior and senior students on

would be responsible for the $1400 cost (per
student) of the trip. No school funds will be used
and no fundraising will be done by students going on this trip.

The board discussed the terms of the Soccer
Program Sharing Agreement including transportation issues to/from practices and games.

Chad Wagner (Business Mgr) from Cassandra
Murra (Supt) as authorized representative for
the Tornado Safe Room project at the MS/HS
building to ensure timely payments. Motion carried unanimously.

Director Mathews, to set April 29th at 5:00 PM
as a special session to conduct Supt. final interviews. The meeting will be held in the School
Administration Building board room. Motion carried unanimously.
