ASSESSMENT MANAGER CONDITIONS
1.
The applicant/owner must at all times during development of the subject
land carry out the development and construction of any building thereon and
conduct the approved use(s) generally in accordance with:
a.
The plans, specifications, facts and circumstances as set out in the
application submitted to Council;
b.
To ensure that the development complies in all respects with the
following conditions of approval and the requirements of Council’s
Planning Scheme and the FNQROC Development Manual; and
Except where modified by these conditions of approval.

Timing of Effect
2.
The conditions of the Development Permit must be effected prior to
Commencement of Use, except where specified otherwise in these
conditions of approval.
Water Saving
3.
All toilet devices in the development must be fitted with dual flush cisterns
and hand basins in the development must be fitted with flow control valves
or similar water control devices to generally restrict flow to 9 litres of water
per minute.

FURTHER ADVICE
1.
This approval, granted under the provisions of the Integrated Planning Act
1997, shall lapse four (4) years from the day the approval takes effect in
accordance with the provisions of Section 3.5.21 of the Integrated Planning
Act 1997.
2.
All building site managers must take all action necessary to ensure building
materials and / or machinery on construction sites are secured immediately
following the first cyclone watch and that relevant emergency telephone
contacts are provided to Council Officers, prior to commencement of works.
3.
This approval does not negate the requirement for compliance with all other
relevant Local Laws and other statutory requirements.
4.
The applicant/owner is advised that this approval does not approve the
construction of the internal fit-out and awning. The applicant will be
required to obtain a Development Permit for Building Works.

EXECUTIVE SUMMARY:
Council is in receipt of an application for the internal fitout and the reinstating of the
original window and door openings to the first floor balcony for the existing building on
39 – 49 Lake Street, Cairns. This building is on the State Heritage Register and is
known as the Central Hotel. The development would normally be Self Assessable, but
the site is affected by CairnsPlan Cultural Significance Code, which increases the level
of assessment to Code Assessable and includes the Ecoaccess Unit of the
Environment Protection Unit as a Concurrency Agency.
TOWN PLANNING CONSIDERATIONS:
Proposal
This building on Lot 1 on RP715151, is listed on the State Heritage Register number
QHR600379. The only external works proposed are the removal of bricks in existing
windows and doorways to reinstate these openings on the first floor balcony and the
installation of retractable mesh screen blinds to secure the balcony in the evenings.
Most of the current fit-out will be removed, some original elements such as floors and
wall will be refurbished, and construction of new fit out works within the interior.
Planning Area
The subject site is in the City Centre Planning Area in the CBD Cairns North Planning
District. The property is a registered State Heritage building, and contributes to the
culturally significant streetscape of Spence and Lake streets.

CONSIDERATIONS / ISSUES
The aim of installing the retractable mesh screen blinds is to ensure items cannot be
thrown or fall over the balcony during night trading. The product design is aesthetically
appealing and will complement the external architectural features of the building. The
screening will enable patrons to enjoy scenic outlooks from the balcony whilst ensuring
the safety of pedestrians and property below the balcony. During day trading, the
screening can be retracted or removed.
The reinstallation of original doorway and window openings will enhance the vernacular
architecture of the building. Existing wrought iron balastrading will remain, with any
damage rectified. The internal fit-out has the intention of replicating the cultural décor to
simulate cultural heritage ambience in keeping with the new branding of ‘The Heritage’

The proposed addition demonstrates compliance with the Performance Criteria of the
Cultural Heritage Significance code and is recommended for approval.

The proposed development does not trigger Developer’s Headworks Contributions.
