The London Taxi Benevolent Association for War Disabled is now RQHRIVL[FKDULWLHVKDYLQJVHHQRͿ competition from 600 others, in its category vying for cash, which will KHOSUDLVHLWVSURÀOH Winning would mean it is awarded £3,000, a trophy and the chance to attend a star-studded ceremony which will be broadcast on the BBC. The charity arranges numerous trips for veterans and a convoy of cabs makes an annual pilgrimage to Worthing and to Holland, where the charity marked the 70th anniversary of the liberation last year. Birol Koca, of Woolwich, sprang into action after hearing the terrifying thud and seeing the victim on the ground close to Rita Road, South London, on Monday, June 13. The modest cabbie has since been overwhelmed with support from cyclists around the globe after posting the video of the chase around South London. The 47-year-old pulled over next to the incident, where two men were helping the stricken woman, and was told the culprit was escaping. He said: “I didn’t think about it after that – I just I wasn’t going to let him get away. As a London cab driver I see it as part of my duty – we are part of London.” The YouTube video showing Birol using his driving skills and knowledge of London to catch up to the driver, who was in a silver Astra, has attracted more than 40,000 views. Birol said: “It’s been crazy – I have been contacted by loads of people. The victim phoned to thank me and a group of cyclists wanted to give me £250 but I asked them to give it to charity. It’s not what I did it for – it’s just the right thing to do.” Hermione Drew was thrown up in the air by the force of the impact but luckily escaped with minor injuries, DOWKRXJKWKHELNHZDVDULJKWRͿ She said: “It was Birol to the rescue! He was amazing. Part of the trauma of the impact of that sort of thing is knowing that the driver is still out there and can do that to someone else. Fresh from a positive meeting with Deputy Mayor for Transport, Val Shawcross, the LTDA stood up for the trade at the transport committee’s hearing on the pedestrianisation of Oxford Street and saw Mayor Sadiq Khan reiterate his intention to cap minicab licences in London. I The Hearing In the wake of Sadiq Khan’s manifesto pledge to turn Oxford Street into a “tree-lined shoppers’ paradise”, the FRPPLWWHHXVHGLWVÀUVWKHDULQJRI the session to test out the feasibility – or rather, the impossibility – of the plan and invited LTDA Chair Richard Massett to give taxi drivers’ perspective. Along with Westminster City Council and the New West End Company – which represents business in the West End – the LTDA showed how full pedestrianisation is unworkable in practice. Whilst ZHZRXOGDOOOLNHWRVHHOHVVWUDF on Oxford Street, pedestrianisation is simply not the answer because congestion on the side streets would be just as bad. To ease congestion, the LTDA called for a reduction in the number of buses that go up and down the street – often half-full. This point was supported by members of the panel, with the New West End Company adding that the mayor could cut excess bus capacity straight away. Richard also called for the proper HQIRUFHPHQWRIWUDFUXOHVRQWKH street. Time and again we are seeing minicabs and vehicles using the street in hours reserved for taxis and buses, yet they never seem to be penalised. Westminster City Council acknowledged that it is not enforcing the rules properly and the Committee Chair noted that more must be done. We are scheduling a follow-up meeting with the council to check in on progress. What’s more, Westminster said there are “far more PHVs circling around the borough looking for jobs than taxis” and this was a major cause of congestion. TfL agreed that the “explosion” in PHV numbers was unsustainable and we will be working with the regulator to address this problem. The LTDA also highlighted that taxis are essential for those that rely on a door-to-door service: whether they are disabled, elderly, pregnant, or simply have had a big day out in the shops, taxis must be able to continue using Oxford Street to help these people get from A to B; we are their only choice. The committee took our comments on board, and while there was evident desire to alter the status quo, a reduction in bus services seems the OLNHO\ÀUVWVWHSDWWKLVVWDJH Congestion At the end of the session, Committee Chairwoman Caroline Pidgeon noted that road congestion in the capital was a “growing concern” – especially amidst an “increase in internet shopping, roadworks and the provision of private hire services.” She called on the mayor and TfL to address this. She stated that FRPPLWWHHRFHUVDUHORRNLQJLQWRWKH potential scope of an investigation into congestion and that the committee’s September and October meetings are likely to be used to discuss the topic. Rest assured, the LTDA will be having a say in any investigation. He announced that he will lobby the government to hand him the power to cap the number of PHVs in London and we will be putting pressure on the mayor to ensure he makes good on his promise. Coming up I will be meeting Transport Committee Chair Caroline Pidgeon and London Transport Minister Lord Ahmad in the next fortnight, and will be ensuing that the trade’s concerns are heard loud and clear. Serious and urgent issues, such as those that have an immediate risk to public safety, should be immediately reported to the police. Trade The timescale for the introduction of the new minicab regulations has been set out by Transport for London. Many of the changes came into force this week, including new rules for hire and reward insurance, but only for new applicants. The regulator decided to give existing licence holders a few weeks grace in order to “prepare for some RIWKHPRUHVLJQLÀFDQWFKDQJHV required.” TfL has been heavily criticised for “watering down” the original proposals but claims the regulatory changes will “improve safety” and “convenience” for customers. Hire and reward insurance Start date: Q 27 June 2016 for new applicants Q Existing licensees are expected to comply by 11 July 2016 ------------------------------------------------------------------------------------------------All private hire vehicles must have hire and reward insurance in place both at the point they are licensed and for the entire time the vehicle is licensed, including when the vehicle is not in use as a private hire vehicle. Drivers will fail their inspections if they do not have hire and reward insurance in place at the point of licensing. They need to have your hire and reward insurance available for inspection when the vehicle attends the vehicle test centre. Drivers and those who are operators who do not have the correct insurance face the prospect of losing their licence. TfL claims it is increasing the number of insurance checks. Carrying or displaying the insurance certificate Start date: Q 27 June 2016 for new applicants Q Existing licensees are expected to comply by 11 July 2016 ------------------------------------------------------------------------------------------------Details of a London private hire vehicle’s insurance must be carried in paper form by the driver or displayed in the vehicle at all times. English language requirement Start date: Q 1 October 2016 for new applicants and licensees renewing their licence. ------------------------------------------------------------------------------------------------All new applicants and existing private hire drivers renewing their licence who are not from a majority English speaking country will be required to meet a new English language requirement from October 1, 2016. Applicants will be required to present a valid English language FHUWLÀFDWHZLWKD%OHYHORI(QJOLVKRQ the Common European Framework (CEFR) as part of their new or renewal licence application. Anyone who does not have the appropriate level of English will not be granted a licence. This information will be shared with the relevant government departments, such as the Department for Work and Pensions and HM Revenue & Customs. CHANGES FOR OPERATORS Booking confirmation Start date: Q 27 June 2016 for new applicants Q Existing licensees are expected to comply by 1 October 2016 Private hire operators must provide a ERRNLQJFRQÀUPDWLRQWRDSDVVHQJHU before their journey starts. That service must be available at all times during the operator’s hours of business and at all times during a passenger’s journey. The victim had ordered a ride using the app’s controversial sharing service but was set upon by two men who were already inside. The thugs kicked the woman and shoved her up against the wall, according to the car’s driver, James Farrar. Farrar, founder of the United Private Hire Drivers’ organisation, dubbed UberPool dangerous and XUJHGWKHÀUPWRD[HLW James Farrar said the violence erupted in Cranley Gardens, Kensington, on Saturday, June 11. He said: “When I got there these two guys were aggressive, they’d not realised they were in a shared service, the user interface is confusing. “I took a decision for my safety and the safety of the other passenger that I would not carry them. “There was an argument, they kicked her in the back and dragged her up against the wall. “I tried my best to defend her and they set upon me as well. “The police came, but the main attacker had left the scene. The other guy attempted to leave the scene in a cab but I stopped him.” Farrar has previously criticised the company’s employment practices and exposed the GLFXOWLHVRIHDUQLQJDOLYLQJ wage and says TfL should ban the service. He added: “It absolutely should be stopped. In fact, it should never have started. We told TfL this is a dangerous service, it’s dangerous to drivers and it’s dangerous to the public, especially late at night.” Farrar wants a cap on minicab licences, which are soon set to reach 100,000 and make it impossible for drivers to earn a living. An Uber spokesman said: “Londoners have chosen to share their journeys by choosing UberPool more than a million times, so we were extremely concerned to hear about this incident. We have been in contact with both the driver and passengers concerned and will assist the police with any investigation. “We make very clear to passengers at the time of booking UberPool that they are opting to share their journey.” TfL says it is investigating the incident. A spokesman for City Hall said: “The former mayor agreed to make these payments to minimise the risk of the mayoral appointees bringing employment tribunal claims against the GLA. “He has ensured a fair and consistent formula was applied in calculating the payments so that they were proportionate and WKHRYHUDOOFRVWZDVVLJQLÀFDQWO\OHVVWKDQLW was in 2008.” Johnson had previously criticised his predecessor Ken Livingstone for handing DLGHVD PLOOLRQLQSD\RͿV 6 TAXI|28 June 2016 www.ltda.co.uk | @TheLTDA MASSETT FILE OXFORD STREET PLANS LACK SUPPORT RICHARD MASSETT LTDA Chairman, Chairman, London Cab Ranks Committee Plans to pedestrianise Oxford Street get a mixed reception at the transport committee meeting attended the inaugural meeting of the newly formed GLA Transport Committee under the mayoralty of Sadiq Khan and the chairmanship of Caroline Pigeon on June 15. The Committee was looking to see how it may be possible to implement the mayor’s pledge to pedestrianise Oxford Street. I was invited as one of a panel of guests who were there to give evidence to the committee. The others were representatives of Westminster City Council, Transport for London, The New West End Company, London Travel Watch, and Living Streets. Most of the panel agreed that something had to be done to deal with the current unacceptable OHYHORIWUDFSRRUDLUTXDOLW\ and the general state of the street environment. But it quickly became apparent that there was little support for simply pedestrianising the whole I VWUHHWEHFDXVHRIWKHHͿHFWVWKDWWKLV would have on the surrounding residential areas. Congestion The blame for the current congestion ZDVODLGÀUPO\DW the door of TfL’s buses and the New West End Company, which represents the large business interests, pushing for a 20% year on year reduction on the number of buses using the Street. TfL seemed to accept this and said that it was intending to review all of its central London bus operations in light of the new Hooper ticket, which has been proposed by the Mayor. Myself and others put forward the suggestion that perhaps some bus routes could turn around at each end of Oxford Street with a shuttle service running through the street itself. Westminster was not keen on this idea because it did not want to LTDA Policy Statement It is more essential than ever for drivers to be fully appraised of the various trade organisations’ policies. In order to clarify the LTDA’s position on the important issues facing the industry, the Association reaffirms: 1. Its determination (despite opposition from certain trade organisations) to exclude taxi drivers from any form of restriction on working hours or the compulsory fitting of tachographs in cabs. 2. Its total opposition to the proposed computerised Knowledge testing system (Quickie Knowledge), which is intended to speed up and churn out new licences. 3. Its support for a regular review of taxi usage in London in order to provide effective management of the cab fleet which will prevent the streets of London being flooded with empty cabs. 4. Its support for the introduction of ‘rest ranks’ to enable drivers to legally leave their cabs unattended whilst visiting adjacent toilet facilities. 5. Its support for a complete ban on pedicabs. 6. Its insistence on meaningful consultation with Transport for London. 7. Its support for an effective minicab enforcement team, trained to eradicate illegal touting by minicab drivers. 8. Its campaign for taxi access to all bus lanes. 9. Its insistence that taxis continue to be exempt from congestion charges. Accidents Buses also had WKHÀQJHUSRLQWHG at them as being involved in the largest number of accidents, 30% of those involving pedestrians as well as another 13% who were said to be on buses. On average there is an accident involving a bus every three to four days. Taxis were said to account for 11% of accidents involving pedestrians. It was not made clear but I suspect that this number includes PHVs. Traffic Free Days There are likely to be more of the WUDFIUHHGD\V Surprisingly, Westminster and the New West End Company are not so keen on these because although the number of visitors increases, it does not translate into more sales. Indeed PDQ\UHJXODUVDUHSXWRͿFRPLQJWR the area on event days. The LTDA said WKDWWUDFIUHHGD\VKDYHQRWZRUNHG for our customers because we have not been able to take them where they wanted to go and they had no idea ZKHUHWRÀQGDWD[LZKHQWKH\ZDQWHG to leave. We added that if there is JRLQJWREHPRUHWUDFIUHHGD\VWKHQ they need to be properly planned, with appropriate taxi routes and ranks at strategic locations. Pollution 10. I was also able to make the point that there was currently no enforcement of the regulations governing which type of vehicles are allowed into Oxford Street. I highlighted the lack of cameras and said that even the signs have fallen into disrepair. The chair acknowledged this and said she was surprised at the number of ordinary cars driving along the Street. Westminster acknowledged that there is a problem and said LWLVORRNLQJWREULQJLQHͿHFWLYH enforcement very soon. The committee listened to calls for the Ultra Low Emission Zone (ULEZ) to be brought forward to 2018 and was positive about taxi ZEC vehicles coming on stream next year. I was able to make the point that WKH\QHHGWREHDͿRUGDEOHIRURXUKDUG pressed drivers in order to get the desired level of take up. PHV Congestion Westminster raised the issue of too many PHVs circulating around the borough causing congestion. TfL acknowledged that the explosion in numbers was “unsustainable” and the committee agreed that something had to be done. Taxis The committee members were generally positive towards the trade. It was accepted that we have a vital role to play in helping to make Oxford Street accessible to the less able bodied, and the need for a door to door service was acknowledged. Our iconic vehicles were also seen to be part of a unique experience for tourists. It was also noted that Oxford Street acts as a moving rank for people that need a taxi all along its length. TfL suggested that if the number of buses was to be reduced then the street ZRXOGVLPSO\ÀOOXSDJDLQZLWKWD[LV and it was recognised that this would be counterproductive, but a suggestion for a limited number of permits to be issued to taxi drivers was thought to be unworkable. Cyclists There was a suggestion that if the street were to be pedestrianised then something like a superhighway could run down the middle of it. However, the West End Partnership is engaged in drawing up a range of measures that it believes can improve Oxford Street, to make it even more attractive to visitors than it already is, and there is a commitment to bring the measures forward for public consultation early in 2017. The LTDA, and its colleagues on the Cab Ranks Committee, is working with Westminster City Council on taxi issues connected with the West End Project and we will continue to work for the best arrangements for taxis that can possibly be achieved. Sothisundaram Soorriyakumaran, pounced after picking up the 28-year-old victim from a Pimlico pub last July. The victim asked Soorriyakumaran if she could play her own music through his stereo and moved from the back of the car to the front in Old Kent Road. The driver leaned over and began to touch her before removing his hand DQGGULYLQJRͿDVLI nothing had happened. Soorriyakumaran, of Varley Parade, Barnet, stopped the car again and leaned in to the victim who shouted at him to stop. The 50-year-old apologised but claimed she had misunderstood and asked for the woman’s phone number. The woman gave him a fake number and called the SROLFHDIWHUKHGURSSHGKHURͿ Detective Superintendent Adnan Qureshi, said: “This was an excellent result, which has seen a SHUSHWUDWRURIDGHVSLFDEOHVH[XDOO\PRWLYDWHGRͿHQFH receive a very robust and restricting sentence. “I urge anyone who experiences any kind of assault or unwanted sexual behaviour to report it to police immediately.” The driver pleaded not guilty to sexual assault on June 9 at Woolwich Crown Court, following an investigation by the Cab Enforcement Unit. The jury dismissed his defence and he was found guilty. The judge handed him a 15 month prison sentence, suspended for two years. Soorriyakumaran must complete 100 hours of unpaid work, a 60 day rehabilitation course and DGD\VH[RͿHQGHU programme. He also has to wear an electronic tag with a 60 day curfew and was given a sexual harm prevention order which stops him from working as a private hire driver. He was ordered to pay £3,500 court costs and £1,000 to the victim. More than 4,000 residents have signed a petition against the proposals which they say will blight their lives. I wrote, “it has long been a bugbear of mine that the private hire industry has blurred the lines between them and us, implying at every opportunity they are London taxis. There is a rule against this, its section 31 of PHV (London) act of 1998, which states that no private hire advertising can use the words “taxi,” “taxis,” “cab, or “cabs” or anything resembling any of those words, and that any person who contravenes WKLVLVJXLOW\RIDQRͿHQFH So, when LTDA member Colm Doyle approached me and said he had put in a complaint with regards to breach of section 31, but was not getting anywhere and asked if I would help, I gladly accepted. Mr Doyle had DOUHDG\LGHQWLÀHGVRPHZHEVLWHV P (and counting) breaching section 31, WKHÀUVWRIZKLFK,VHQWRͿWR0DWW Bell at TFL TPH compliance on 6/6/15 IROORZHGE\DQRWKHURQµ It has now been a whole year since we sent in those original 58 breaches of section 31. So, what’s happened in that year? Well apart from Matt Bell being replaced by Anand Nandha, I’m sure you won’t be shocked when I tell you not much else has happened. Of the original 58 companies 13 have gone out of business, ÀYHKDYHQRZFKDQJHGWKHLU websites to comply with section 31, but the remaining 39 are still happily doing as they please. I know you won’t be surprised to hear that, because you know exactly what every other taxi driver knows, that TfL commands zero respect from anyone. As a regulator, that’s just not acceptable. It doesn’t matter so much if no one likes TfL; it is not here to be loved. But it absolutely must command respect, and TfL quite simply does not. Because I’m a fair man, I wrote to Anand when he took over as head of TPH compliance in March of this year and informed him of my unhappiness at the lack of progress on this issue by his predecessor. I said I would be writing this article to update drivers. In April he informed me that his team had gone through the breaches and 13 cases required further investigation, 19 cases had received warnings and the rest were closed. At the time of his reply, 10 had already gone out of business and two had already changed their website to comply. So, in the three months since TfL gave out those warnings, three more have gone out of business and only three additional sites bothered to change their wording to now comply: that’s 19 received warnings but only three took any notice, like I said, TfL commands zero respect. In one year the regulator has PDQDJHGWRJHWMXVWÀYHFRPSDQLHV to obey the rules! We still have another 342 cases to send in; at the current rate we can expect the matter to be resolved in the year 2092! And TfL wonders why it was called woefully inadequate by the now Deputy Mayor for Transport, Val Shawcross. Let’s hope for all Londoners’ sakes Val gets to grips with this bunch of incompetents. A few weeks back I was in Marmaris in Turkey and I noticed that along one of the main thoroughfares they had a segregated cycle highway. The Turks are a friendly bunch, so I asked them about their cycle highway and how much disruption the works had caused. This morning I used the app city planner to plan my route from Waterloo to Clerkenwell Green. The app suggested Uber as I d rather support suppo the black cabs, so I went the faster option. But I’d c to the taxi queue. Five cabs in a row couldn’t take me because they wouldn’t take a card payment. This is so simple to do with m modern technology. It is a basic level of functionality func and convenience that makes passe passengers lives easier. In the end, I ha had to go with my second choice - Uber. If it ever found itself on the shelves of Tesco it would have been replaced immediately with a cheaper, more reliable product. Years ago I could buy a Fairway cab, with the added luxury of a Nissan engine that would last in excess of 600,000 miles and a gear-box that could last equally as long, which could be easily rented at £180 a week. In relative terms, garages today (if they are to maintain an HOHPHQWRISURÀWDELOLW\ZRXOGKDYHWRFKDUJH the equivalent of £430 a week for something that is excessively expensive to buy, and equally expensive to maintain. I don’t like reading “doom and gloom.” It would give me the greatest satisfaction to sit in front of my computer with a beaming smile on my face and write an article saying that it was all wine and roses in our trade. But I’m a realist and the reality is that our oncemighty trade is being pushed to extinction – thanks mainly to the uncapped growth of the minicab trade. I know many young cabbies who are re-training to be electricians and plumbers because they can’t earn enough to pay their mortgages and expenses. Many more mature drivers who are taking part-time jobs in an HͿRUWWRVXSSOHPHQWWKHLU cab takings and plenty of old part timers are handing in their licences, giving it up as a lost FDXVH$VIRUWKHJDOVDQG guys doing the Knowledge, I used to see groups of them on their mopeds every ZHHNHQGEXWQRWDQ\PRUH$W the moment, thanks to the many taxi ranks – especially those at the mainline terminals - we are just about getting by, but I can’t remember the last time I trapped a job on the street. The irony of this situation is that RXURSSRVLWLRQLVVXͿHULQJEDGO\ as well. A couple of blokes I know who work for Swiss Cottage Cars tell me they’re working ridiculous hours to earn the same money as before. A mate of mine was recently chatting to a car dealer at Park Royal and he told him that last year he sold many cars to drivers who were going “on Uber.” This year the vast majority of those cars were returned for re-sale, simply because the guys said that they couldn’t earn DOLYLQJ$UHQ·WDOOWKHVHH[DPSOHV a clear indication that the market is saturated? I get my ear bashed on regular occasions by the motor-mouths that tell me that the LTDA does ´QXQNµ for the trade. A night in jail and 30,000 Euro fine International Two Uber executives have been found guilty of starting an “illegal” carbooking service by a French court. ,WLVWKRXJKWWREHWKHÀUVWFULPLQDO ruling targeting managers of the controversial car-hailing app. Judges ruled that Uber’s “commercial practices” were “misleading” and that it was complicit “in the illegal exercise of the taxi profession.” 7KH86FRPSDQ\ZDVÀQHG €800,000 and Pierre-Dimitri GoreCoty, head of Uber in western Europe, and Thibaud Simphal, head of Uber in France, were ordered to pay €30,000 and €20,000, respectively. The court stopped short of imposing prison sentences or barring the executives from running companies in France. The executives spent a night in jail last June and stood trial in February after taxi drivers protested violently in the streets of Paris at UberPop, which connected customers with drivers without a professional licence. The company axed the service last year after President François Hollande stepped in. France is Uber’s second-largest market in the world, by revenues, and its licensed driver car service has grown quickly. Uber said it would appeal against the verdict. The company said: “We stopped UberPop last summer and are still GLVDSSRLQWHG7KHMXGJPHQWGRHVQRW impact our service in France today.” The conviction follows a series of setbacks which have seen the booking service banned in Spain for one year. UberPop was outlawed in Germany, Italy and parts of Sweden. Uber also pulled out of three German cities last year, saying that regulations had made its business untenable. A court in Frankfurt in June rejected the company’s appeal against a judgment from last year that imposed a country-wide ban on UberPop. Dieter Schlenker, head of Taxi Deutschland, a trade association, said the judgment ´EHQHÀWVDOOWKRVHZKR ÀQGLWKDUGWRGHIHQGWKHPVHOYHVDORQH against the interests of big corporations”. Earlier this year, Uber agreed a $100m settlement and improved driver rights following a class-action lawsuit in the US. RIP GEORGE FREDERICK OWEN M.B.E. October 7 1924 – June 2 2016 ------------------------------------Kind-hearted taxi driver, father and charity volunteer George Owen has died at the age of 91. George, a cabbie for 30 years, was a founder member of the Albany Taxi Charity, which organises events for children with special needs, including the annual trip to Hastings. The charity was set up in 1972 and George was Honourable Treasurer and Honourable Secretary, receiving an M.B.E for his work in 1999. He retired to Herstmonceux in East Sussex in 1998, where he died earlier this month after a short illness. The funeral will take place on Friday, July 8. TfL said it had “not taken this decision lightly,” but had to protect the travelling public. Thousands of people are said to die prematurely each year because of the pollution in the capital which is above legal limits set by the EU. Warnings from campaign groups and politicians appear to have been ignored by motorists. The number of diesel vehicles licensed in London rose from 601,456 in 2012 to 774,513 in 2015, an increase of nearly 29%. Petrol vehicles fell over the same period, from 1,901,127 to 1,797,099, leaving diesel with a record high percentage of the market, at 29.4%.
