Take the opportunity to come see what it looks like and find out for yourself what a wonderful addition to our community it will be. Wander around and take in the wonderful views from the inviting deck that surrounds the entire building. See how it blends in with our natural surroundings and flows with the pool house and pool itself. Sit in one of the rocking chairs and breath in the clean fall air, hear the tap of the tennis balls and the games at the basketball court. 10th Annual Pumpkin Fest This has been a long process and we have a lot of past and present Board members and homeowners who volunteered their time and worked to get the clubhouse built. Their efforts will always be appreciated. Thank you for your patience with the construction and the challenges that came with it. In the end it was worthwhile. We will be having some light refreshments throughout the day and welcome you to come in and visit with the staff and mingle with your neighbors. The leaves are turning and the air is cooling so come spend the day enjoying this fun packed event at the Bandstand while supporting the Cub Scouts, Pack 002. They will be selling pumpkins, hamburgers/ cheeseburgers, hot dogs, chips, popcorn, drinks, cotton candy, caramel apples and candy. Scouts will be available to assist you with carrying your pumpkins to your car. There will be plenty for the family to do after you choose your favorite pumpkin and have lunch – we’ll have a magician at the bandstand, hayrides, a jumpie, a rock climbing wall, exciting games for the kids, a variety of booths with crafts and gift items for sale – It’s never too early to start that holiday shopping! Don’t forget to have the kids wear their Halloween costume. A “Mystery Judge” will be walking around to choose our Grand Prize Winner in the Best Costume Contest. Sponsored by: Dr. Heather Davis of the Wellpath Center for Natural Healthcare East Cobb Pediatrics Mountain View Prep School The Gaming Hub Brandi May of Keller Williams Realty HOA News & Information Management & Grounds Here is a brief run down of what’s been happening around Legacy Park: - All the pools are closed until May 2009, with the main pool closing September 28. - The 2009 Budget is being prepared and will be voted on at the November 20 Board meeting. - Many trees in playgrounds and around Legacy Park Circle have been removed because they have been identified as dead or dying or have fallen during the recent storms. - Both Lullwater playgrounds are having the wood re-stained due to heavy traffic. Also graffiti is removed frequently. - After much electrical troubleshooting, the lake fountain was removed from the lake and the motor was sent back to the manufacturer and warranty work was done. The fountain will be up and running again soon! - All street sign poles in each subdivision have been painted. - Installation of pine straw throughout Legacy Park Common Property has been completed. - A no parking between signs sign has been installed at the Carillon intersection. - Fence repairs to all the tennis courts have been made; the hand rail located beside court 9, as well as the Lullwater Pool fence, have also been repaired. - Roof and plumbing repairs have been made to the Lullwater and Winterthur pool houses. - Fall flowers will be planted during October and will be done in the same manner as the spring flowers – at the main entrance and the circle entrances. The subdivision monuments will be kept clean-looking with fresh straw. - The bathrooms at the Lullwater pool house have had new granite countertops installed. The previous laminate tops were damaged and had to be replaced. What a great improvement to the pool house – when the pools open next year, we hope you all will be pleased! New Tennis Pavilion The Board approved a contract with an architect to produce drawings of a pavilion that the HOA can send out to bid. The Tennis Committee along with Board liaisons will be working out the final details of the project and the next update should include a beginning construction date. 2 HOA News & Information 2009 HOA BOARD OF DIRECTORS ELECTION Two of the five HOA Board of Directors seats will be up for election in 2009 at the February 10, 2009 Annual Meeting. If you are excited about volunteerism and becoming more involved in you community… If you have ideas for improving our community…… If you are willing to lend your expertise to help our community with budgetary and maintenance decisions……… Then this is your opportunity to make a difference and get involved in the decisions that affect your community. Qualifications for prospective board members: Interest, Talent, Time and a Desire to serve the residents of Legacy Park on its governing board. Board members must be able to attend a minimum of 2 monthly meetings and participate in LP activities and special meetings. If service on the Board is of interest to you, or if you know someone you believe would be a good candidate, talk to him/her about becoming a candidate. Deadlines for candidates for the 2009 Board of Directors Election: • Board nominations due to HOA office by November 3rd • Candidate biographies due to the HOA office by November 10th HOA Office is Moving The HOA office will be moving into our new space the week of October 6. During this week, you will be able to find us either in the lower level of the clubhouse (easily accessible from the amphitheatre parking lot) or in our current office at the Town Fair. We are hoping for a smooth transition in order to be able welcome everyone to the clubhouse during the Open House on October 11. This has been a long-awaited project and it will be great to have the HOA office finally located on Legacy Park’s property. Be sure to stop by and visit on October 11. Back Entrance on Kirkwood Drive Many residents ask about the gate located at the end of Kirkwood Drive in Lullwater. That gate is privately owned and is NOT the property of Legacy Park. The HOA does own the small piece of land to the right hand side of the gate and the developer in Lullwater built the sidewalk that runs next to the private drive for convenience to residents. Again, the gate is privately owned and the Legacy Park HOA does not have any access codes to it. After a fallen tree broke the majority of the fence, the HOA removed the remainder of the fence that was located adjacent to the sidewalk. Many school age children use the sidewalk to get to North Cobb High School and Awtrey Middle School. However, the sidewalk was NOT constructed for vehicles to drive on it. It is not only dangerous to drive a vehicle on a sidewalk; it is obviously unsafe for the children who may be walking in that area. Should you see anyone using the sidewalk to drive their car along, please contact the HOA or the Kennesaw Police Department immediately with a tag number and a complete description of the vehicle! Covenant Reminder – Political Signs With the upcoming national & local elections, the HOA wants to remind you of the rule regarding signage on your property: Legacy Park Design Guideline 3.2.22(c) provides that: Campaign signs for candidates for elected office, less than 2’x 2’may be erected on individual properties no more than 14 days prior to an election and must be removed within 48 hours after a winner is declared. A maximum of three signs are allowed per yard. Further for those homes that are located on Amenity Lots (including the homes that back up to Legacy Park Circle), Design Guideline 3.4.6(a) prohibits signs being placed in the rear or side of your property. Be Kind to Neighbors………… Neighbors are one of the greatest assets we have in Legacy Park. Neighbors can watch each others homes, retrieve mail, play with the kids, feed the dog while away and in general be available when needed. When we are next door or down the street from each other for years, sometimes we forget the common courtesies that we as neighbors should follow. • Please keep in mind that not everyone is up at the crack of dawn when children are waiting for the school bus. • Please try to maintain the noise level of the children waiting for the bus. • Dogs walked through the neighborhood on a leash with a pooper scooper are neighborly. Dogs off leashes are not allowed in Cobb County or Legacy Park. Allowing dogs to use a neighbor’s yard for a potty break is definitely not neighborly. • Kids playing in the cul-de-sac and on sidewalks are neighborly. Kids throwing or kicking balls into the neighbor’s yard, damaging the landscape is not neighborly. • Cleaning and mowing your yard is neighborly. Throwing the debris you have cleaned from your yard into a neighbor’s yard is not neighborly. Leaving the debris in the street is a violation of a city ordinance as well. • Walking over to your neighbor’s house to say “Hi” is neighborly. Walking through your neighbor’s yard to cut through to somewhere else is not neighborly. • Parking your car or visitors’ cars in the garage and drive way area is neighborly. Parking your car or visitors’ cars in the street in front of a neighbor’s home or blocking a driveway is not neighborly. These are just a few recent issues that have been brought up. Whether these issues affect you are not, it is important to remember how valuable your neighbors are. A little common courtesy goes a long way! For the latest news on Legacy Park events & happenings go to: www.legacypark.org HOA News & Information 3 A Word About Covenants....House Painting - Ahh the dreaded letter! ALL COLORS MUST BE APPROVED - EVEN ORIGINAL ONES!!!! Soon the lawns will go dormant and it will be time to focus on the maintenance of the actual home. So many homes are in need of painting. Many homeowners know that a letter is soon forthcoming, so please inspect your house and get ready. There are homes that have not been painted for 10 years and there are homes that have been painted 3 years ago and are in need of painting already. It is all about the quality of the paint and the painters. I would suggest getting a reputable painter when choosing one. The lowest price is not always the best value. Here are some things to look at when determining whether your house needs repair and painting: 1. 2. 3. 4. 5. 6. Cracking and/or peeling around windows and doors. Faded spots on the siding where the paint looks as if it has worn away. Streaks on the siding that do not go away after power washing. Wood knots showing through on the trim Popped nails can mean rotting boards and water damage. Faded shutters and front door. Painting is a big expense, but one that a homeowner should prepare for when living in a covenant enforced neighborhood. Also, if you do not agree that the house needs to be painted, we have an excellent appeal process in place and you will be heard and treated fairly. Big trees, Little lots The ongoing LP saga of dying lawns and growing mulch beds. It is time to limb up or get rid of that tree in the front that is killing your grass. DO NOT extend your beds. This is not always the best answer and unless approved by the ARC, is a violation. Remember though that before removing any tree, unless it is in danger of falling on your house, it has to be approved. The lawns in Highcroft and Lullwater seem to be the most affected by this issue. Those beautiful trees have grown into monstrosities and are just too big for the front yards. If you are in need of a referral for a tree service, call the office and we can help direct you to a few reputable companies. Also, remember that only 2 types of grass are allowed in the front…Zoysia and Bermuda. Good luck and see you in November!!! Legacy Park - What more could you ask for in a neighborhood? Submit all photos to [email protected]. 4 HOA News & Information Parking Along the Circle Please follow the below guidelines when parking along the circle within Legacy Park. Failure to do so could result in ticketing and or towing by the City of Kennesaw. •Only park on the INSIDE of the circle •Only park WITH the flow of traffic •Do not park in any area where the curb is painted white (intersections and loading and unloading zones.) It is illegal to park within 30 feet of an intersection! •Do not park in front of the fire hydrants •Parking on the grass or the Town Green is prohibited! Additionally, if there are cars parked along the circle, please SLOW DOWN! Slowing down and paying attention could save a life. If you are parked on the circle, please be courteous to the passers-by and limit the time your doors remain open. Thank you in advance for your cooperation! We want to find a cure and there is great hope. With new research on the forefront, doctors and scientists are working on tools to better diagnose, treat and cure life threatening food allergies like the ones my five year old daughter Ellie has. This is why we are participating in FAAN’s Trick-or-Treat for Food Allergies which lets kids join in the Halloween fun while increasing food allergy awareness and collecting monetary donations to help find a cure. The boys and girls teams compete in the local middle school leagues during the Spring and early Fall each year. We are currently looking for boys and girls interested in the game of lacrosse to join our program. We practice 2 days a week in the town green and play our home games at North Cobb High School. Boys and Girls grades 3 - 5 are welcome and encouraged. The 'Lil Warriors program is a feeder program for the boys and girls Middle School teams that play out of Legacy Park. If you or your child are interested in checking out the game, please come by on Tuesday night. The kids will get a chance to play and the parents will have a chance to ask questions and learn about the game. All the kids need to bring with them is a lacrosse stick. Cobb County Teen Driver Awareness Safety Campaign Every year over 5,000 teens die, 200,000 are injured and another 46,000 are left incapacitated. Effective Oct. 1st, The Caution and Courtesy Driver Alliance in conjunction with the Governor’s Office of Highway Safety and the Georgia Department of Transportation will launch a new statewide campaign to identify all “permit” and “first year” drivers with the “CAUTIONNEWLY LICENSED” car magnet. To launch the safety campaign, free magnets will be available at all of the Cobb County Dept. of Driver Services locations. The City of Kennesaw, the first model city to roll out this program, is also providing free car magnets at City Hall to their teen driver residents. The car magnet alerts surrounding drivers of the novice driver and encourages caution, patience, and courtesy when driving in their vicinity. Alan Brown, whose teen son Joshua died in a car crash, is an advocate and spokesperson for Georgia’s new Teen Driver Awareness Safety Campaign. He is also the founder of Joshua’s Law. This law requires teens to have at least 40 hours of supervised driving experience. If under the age of 17, it also requires a completed drivers education course approved by the Department of Driver Services. “We have over 250,000 inexperienced teen drivers in Georgia,” says Brown. “It can be a nerve wracking experience for teens (and their parents) when they are getting their required driving lessons. The last thing they need are people honking and tailgating. The CAUTION-NEWLY LICENSED car magnet really does work and other drivers tend to be more respectful and courteous when they see these magnets on the cars. The minutes of each Board meeting are typically approved at the Board meeting the following month.
