Calgary, AB T2H 2V6 2/16/07 10:09:01 AM ASSOCIATIONinformation Carol oxtoby |President | CHBA – calgary region WORKING FOR THE INDUSTRY There is no question that the world today is in turmoil, considering the uprisings in the Arabic countries in the Middle East, the financial chaos that is happening in Greece and could spread through Europe, and the monetary and housing crises in the USA. Alberta is a bit of an oasis, but there is no doubt that the impacts of the global economic and political scene fuels uncertainty with our own economy, causing consumers to step back and delay decisions on large-ticket items, particularly home purchases. Some of our builders report “steady” traffic and sales, but volume stops short of the buoyant market they hoped for in the last quarter of 2011, even though Calgary and Alberta continue to be leaders across the country, according to many economists. The latest report from BMO Capital Markets says Alberta should lead the country’s growth this year at 3.1 per cent, moving to 2.7 per cent next year, second only to Saskatchewan. A report from TD Economics earlier this fall was similar. The Conference Board of Canada recently reported that Calgary will lead the country in Real GDP average annual growth over the next few years with a 4.1 per cent average from 2013 to 2015. But it is still a very volatile market and the recent political changes have contributed to the instability. It has been one year since our mayor and new council were elected. Mayor Naheed Nenshi has been quoted as “still excited” after his first year. And a recent poll by Ipsos Reid/Global News proclaimed an 86 per cent approval rating. But are we, as an industry, “still excited?” We are awaiting changes on the red tape issues that create so many problems for companies across the country and particularly with our industry in Calgary and delays at city hall with applications are continuing to have a negative impact on our businesses and frustrating those trying to provide quality development and alternative choices for Calgarians. And while we do pay our fair share of growth, we’re still finding the issue of funding infrastructure related to growth painting the industry with a negative brush. We are moving forward as an industry with representation at city hall on key issues affecting us. A number of policy changes are coming that will impact our industry, from the new growth management document that will determine the criteria for where and how our city will grow, to the proposed redevelopment levy for inner-city projects. We have a number of new initiatives we will keep you informed about, and we continue to provide input on all items that could impact the way you conduct your business, as well as help mitigate homeowners’ concerns. On the provincial front, we have a new premier, Alison Redford, and cabinet, including Doug Griffiths, the new Minister of Municipal Affairs. Congratulations to the premier and cabinet on their election and we look forward to working with them through our provincial CHBA – Alberta board on the many issues that affect the housing industry, either directly or indirectly. I encourage you to read the CHBA – Alberta column in this issue by new president Sandra Young. It will provide you with provincial priorities the Association is dealing with. One area that we will be watching carefully is the notion of city charters, which both the premier and municipal affairs minister have already indicated they support, and which Mayor Nenshi wants to institute to provide the city with more financial independence. While the idea has merit, it could potentially pose further constraints on the industry and the new homebuyers, or be a disincentive to attracting the very growth that keeps our economy stimulated. Municipalities everywhere are having a difficult time finding new ways to fund infrastructure and other needs, but we do not want the solution to be a burden shouldered by new homebuyers alone. We endeavour to make housing safe, affordable, of high quality, and with choices for consumers in all areas and in all price ranges. Both sites contain news article critical to the local industry and now that we have new communication tools, we need our members to tell us what key issues they are facing and suggesting ways to alleviate problems. We must be nimble to change and use it to benefit and leverage our membership strength. The core reasons why members joined in the past have begun to shift along with our member generations. In short, we must tell our story and it must be told in a way that resonates with all of our audiences: members, partners, municipalities, and new home buyers, to name a few. In order to become engaged fully in this change, we have begun implementing a new communication enhancement strategy that will lead us clearly and sustainably into the future. First on our agenda was hiring a Director of Communications, namely Kathy McCormick, who I am happy to say has settled in very nicely and is quickly learning all about our arsenal of communication tools. Kathy brings with her more than two decades of experience writing about our industry, and we could not ask for a better team member to lead our communication – telling our story. By now I hope that you have had a chance to browse our newly launched website and tried out some of the new features that will help you uncover quickly the valuable information that CHBA-CR has to offer its members. Connecting you to information that is important to your business is our top priority. For example, have you learned about the City of Calgary’s Growth Management Framework that will determine the direction in which our city will grow, or what changes are being proposed in the redevelopment levy? Not only can you go to the website to find out about the important issues being discussed in our region but you can sign up to have that information sent to you as soon as it breaks. The website is not our only launch: we are jumping into the social media realm with offerings on Facebook, LinkedIn and Twitter. These vehicles will serve to enhance our story to larger more specific groups with more immediate information while providing an opportunity for two-way dialogue and feedback. I hope you will ‘Like’ us! We will try our best to be quick in responding to you and instituting changes you may recommend. These are not the only changes you will see. We have incorporated a fresh new look to our electronic newsletter and newsletter communication. You will also see video being used to tell our story. The Profile magazine will continue on a quarterly basis and we will be saying goodbye to Naylor as our publishers this issue and welcoming local member Source Media Group as our magazine publisher beginning with our next issue. Tribute Stephen Dupuis, My Friend and Mentor It is with a heavy heart that I announce the sudden death of Stephen E. Dupuis, president and CEO of BILD, the Building Industry and Land Development Association of the Greater Toronto area, on September 23. My friend and mentor was a true leader and an inspiration, not only to his association members in Toronto, but throughout all of the home builder organizations across Canada. His dedication, motivation, and effective messages were heard throughout the country. We shared our pride in doing the work we love each day along with the love of our industry and most importantly our members. He was a highly-visible passionate champion of the industry who served BILD with the highest degree of integrity and honesty for more than 25 years. Condolences go out to his wife Linda and two children, Kendall and Carson, as well to the BILD association and its members. BILD will hold a tribute event for the late President and CEO in November and at the same time establish an education fund for Stephen’s children. The health of our industry is fundamental to the economic fabric of the province and we must never forget how much that can impact the well being of Albertans. CHBA – Alberta members don’t just build homes; they build the communities that both new and long-time Albertans will make their own in the coming years. In addition, many of those living in Alberta communities depend on our industry for their livelihood and to support their families. That is why it is so important for our Association members to remain diligent, whether by making sure cost downloads from governments to home owners are limited, or confronting building code changes that will cause unintended, negative and expensive consequences. Our industry is at the forefront of ensuring that Alberta remains an economically sustainable environment for families and business. This will continue to be a focus at CHBA – Alberta. Without access to safe and affordable housing, the workforce needed to help Alberta move forward will not be able to live here. This problem will get worse if it is not addressed by cooperation from industry as well as the provincial and federal governments. People from across Canada, south of the border, and indeed around the world want to make their home in Alberta. We need to play our part in helping to develop solutions that make Alberta more accessible and affordable. Nobody is going to do this for us, and the time for action is now. Issues Update Mandatory Warranty and Condominium Property Act— Members and staff continue to engage with the government relating to changes to the Condominium Property Act, some of which are tied in with ongoing discussions on Mandatory Warranty. The government has been keen to hear input, involving CHBA - Alberta in many discussions. Seniors’ Housing—CHBA – Alberta recently sent a letter to key decision-makers, including PC leadership candidates, outlining a proposed new classification for seniors’ housing in Alberta. It is important that we show how new community-based ideas that increase choice, quality of life, and affordability can also reduce the growing burden on provincial expenditures. We have received several favourable responses to this document and discussions will continue. Building Codes—The Association and members are participating actively in the building codes cycle that is currently taking place. It is important that we maintain to the greatest extent possible a focus on the intent of these codes, which is to address basic health and safety issues. Part of CHBA’s role is to identify proposed code changes that will impact affordability and choice negatively, and then propose constructive solutions to the issue. Work such as this will proactively prevent issues such as those that occurred with the changes related to HIRF that have had a substantive negative impact on the industry. It is also important that we identify and attempt to address issues within the codes process that leave little room for recourse when a harmful change is implemented. Slave Lake Recovery—The recovery effort is a logistical challenge for everyone involved. A situation like this has not occurred in Alberta and requires continued coordination between many different organizations. For the past few months, CHBA – Alberta and its members have been active participants in the organization of the rebuild, but our future involvement will be minimal. We have registered a number of concerns related to creating certainty in the business environment enabling a quick rebuild, but we are not managing to make progress. Labour—CHBA – Alberta has been working to assess and confront our industry’s challenges with regard to labour and this will continue. Recent activity has included the circulation of a survey of current and future labour needs, as well as discussions with provincial officials and stakeholder groups. Moving forward we are looking to work with both the federal and provincial government to ensure that Alberta is able to access workers in a timely and cost competitive manner, to ensure that sustainable growth can take place. Our Conference—The 2011 BUILD Conference was held at the Fairmont Jasper Park Lodge, September 15–18. This year’s conference saw nearly 500 registered delegates and a record number of awards submissions. Five renovation companies had six homes to view: Ultimate Renovations with two homes, Pinnacle Group, Astoria Renovations, Gemini Group, and Van Manna Homes. More than 50 Calgary and area renovators are part of RenoMark™, the program that was set up by the home builder organization to help combat the fly-by-night underground economy. According to Canada Mortgage and Housing Corporation’s Renovation and Home Purchase Report 2011, Calgarians spent $1.5 billion on renovations last year, with the average cost at $13,236. “And with the federal government’s renewal of its popular ecoENERGY Retrofit – Homes program earlier this year, renovators have been busier than ever,” says Stinson. Safety Barbecues Were a Hit Safety is an important mandate for the Canadian Home Builders’ Association and its members, and to that end, our safety committee just wrapped up its most successful Safety Barbecues earlier this fall. Close to 700 trades and suppliers from building sites around the city took part in the free BBQs where a total of 10 exhibitors had booths and discussions on areas related to safety in the workplace. “We’re not doing this for us,” says Georgina Nicholls, safety advisor with Stepper Custom Homes and the chair of the safety committee. “We’re doing this to make sure our members get to go home to their families every day.” The event was a success, says Nicholls. “Everyone enjoyed the free lunch, but they also took the opportunity to speak with our exhibitors, find out about services and products available to them, and watch demonstrations of different products, safety initiatives and techniques.” This year’s barbecues took place in the communities of SkyView Ranch, Sage Hill and Mahogany. CHBA – Calgary Region had draws for prizes for participants who had to have passports stamped from at least two exhibitors on site to be eligible for the draws. A little of both, if you talk to the amicable, down-home country music artist who makes Calgary his home. “Having kids gives you a new perspective as an artist and writer,” Brandt said in a recent interview when he was the guest speaker/performer at the first monthly meeting of the Canadian Home Builders’ Association-Calgary Region in September. “You see things differently.” At the same time, he was so inspired to help others when he and his wife Liz made a trip to Cambodia that he began putting his feelings down in song. “I was horrified to find out you could actually purchase a person for $30 anywhere there,” says Brandt. “That made me question what a human life is worth, and from there, I decided to do what I could to raise funds to recognize the value of a human life.” That led to the founding of his charity, aptly named Priceless, the Gift of Hope. And the song writing was a natural outcome. Now Brandt has recently released his first new album in more than four years. “The album Give it Away, which is a seven-disc box set [the eighth slot can be filled next year with another song that he will bring out], has as its inspiration ‘live for the moment,’” he says. “The whole idea is a message of hope for the future, a celebration of life.” A coincidence—some would say synchronicity, the occurrence of events that are unrelated, yet are very connected and meaningful—occurred that changed the life of Brandt and wife Liz, but also resulted in changing the lives of many people, and counting. “We were watching ‘Extreme Makeover: Home Edition’ one night on TV and I was bawling my eyes out,” he says. “I thought, ‘Wouldn’t it be cool to do a show that allowed me to build houses to give away?’” The next day, Country Music Television (CMT) phoned to suggest exactly that, but the Brandts had an even better idea, a twist that would take it one step further. “Liz and I thought about what that dream could be and we thought, what if we could pair that with these same families building houses, in turn, for people in a Third World country?” And the seed was sown. It didn’t take long for the seed to grow into a big, healthy tree, and now Brandt aims to make it a whole forest. BUILD IT FORWARD was launched in Calgary with Habitat for Humanity-Calgary and Samaritan’s Purse as major partners, but the residential construction industry in the city jumped aboard quickly, says Brandt. “Once the concept of the local families going to developing countries sank in, we had way more help. Entire houses were donated, and land. We had so many volunteers and people who donated services – families came out and whole crews of construction trades. Paul Brandt was an obvious draw, but so were the 300-plus “guests” who flew in especially for the occasion from the Maritimes. But they were soon up to their necks in hot water, thanks to the other 300 eager guest members who turned out for the event. For the second year in a row, the first meeting of the new year featured fresh Nova Scotia lobster for dinner, complete with instructions on the intricacies of de-shelling the gorgeous creatures for everyone’s enjoyment, thanks to our capable CEO Donna Moore. Steaks were also on the plate, for those who didn’t choose the company of our special “guests.” The night, which highlighted Brandt’s career (complete with a mini-concert), was to thank the builders and developers who were involved in his latest charity work, BUILD IT FORWARD, but also to raise awareness for another event he was holding to raise money for the fire-ravaged Slave Lake community. A silent auction was held and the CHBA – Calgary Region donated close to $10,000 altogether for Brandt’s charity, Priceless Gift of Hope Foundation. The big winner was none other than our president, Carol Oxtoby, who went home with a guitar signed by Brandt. Hope we can expect some country tunes to open our next meeting. so far away would do something like that for them. In September, he held a concert in Edmonton called “Up From The Ashes” with proceeds from the concert, more than $150,000, going to the Slave Lake community to help the area that was ravaged by fire earlier this year. The monies will go toward rebuilding the community’s library, including buying chairs, desks, computers, and hand-selected books. “In the spirit of BUILD IT FORWARD, a portion of the monies collected will go toward undeveloped countries,” Brandt says, noting the community was eager to step forward with the idea to give back 25 per cent of the profits from the concert. Once you’re in the members’ 8/10/10 1:55:21 PM site, everything from the top tabs to the icons along the side turns red, so you know you’re in the right place.” A big advantage for members is the enhanced member-to-member directory, which allows individuals to upload as much information about themselves as they want – from photos to Facebook and Twitter addresses – and allows that information to be shared with other members. “We’ve added the latest communication tools, including allowing our members to put in direct RSS feeds to their in-boxes, and Facebook and Twitter pages as well,” Veldhuyzen says. “They can now make available as much information as they want to share with other members.” A key feature is the three boxes on the home page that have always-updated news for members, whether political, technical, or economic, industry happenings, special events, or anything else that pertains to the residential construction industry. “It keeps our members current on what’s happening.” We’ve also added a video component to the website. The current videos speak to the theme of “Why Membership?” and features members sharing their experiences about why they joined and what benefit the membership in CHBA – Calgary Region provides their organizations and themselves personally. Check out www.chbacalgary.com today. ■ INDUSTRYNEWS by Vanessa Gash, Residential Plans Examiner–Building Regulations Division, City of Calgary Secondary Suites: A “Suite” Idea Secondary suites have been a hot topic in Calgary recently. Alternative housing options that are affordable, sustainable and a more efficient use of land and municipal services are desirable as our city continues to grow. With all the talk about secondary suites perhaps you, as a renovator or builder, have had inquiries about renovating or upgrading your customers’ existing non-conforming suites or even creating a new one. A secondary suite that is safe for your customers and their tenants, conforms to city guidelines, and provides them with a reliable source of income will benefit everyone involved. A secondary suite is a self-contained living space located within a singledetached house or in a detached building on the same property. There are several types of secondary suites. The most common is a basement suite, where the homeowner typically lives on the main floor with a tenant living in the suite below. Another common type of suite is known as a garage suite, where a living unit is built above a detached garage. A garden suite, which is a freestanding detached building containing only the suite, is also another option. When developing a secondary suite, there are local bylaw requirements and provincial building code requirements to which you must adhere. These regulations are in place to ensure guidelines for safety, city planning and community involvement have been met. As you know, though, development permits and building permit applications must be made and the permit issued prior to starting any project. For application requirements visit the City of Calgary website at www.calgary.ca/secondarysuites. For those interested in the opportunity of developing a secondary suite, the city has many resources available to provide information and assist contractors and homeowners through the process. Owners who qualify may also be eligible for up to $25,000 in grant funding from the City of Calgary to help with the cost of renovating so that an existing suite will conform or to help in creating a new suite. Approximately once a month, the City of Calgary hosts a Pre-Application Workshop for homeowners and contractors interested in developing a secondary suite. The workshop is hosted by a team of individuals who deal directly with the secondary suite program. Representatives from the various departments involved in the approval of Development Permits, Building Permits, Building Inspections and the Grant Program present information on their requirements. The presentation is followed by a question and answer period and the opportunity to review individual questions and drawings one-on-one with the individuals present. This enables the process to move more smoothly and efficiently and provides applicants the opportunity to speak with the persons knowledgeable in the appropriate areas. Hydronic Heating Requirements Switching topics completely, Glenn Costello, a Senior Plumbing and Gas Safety Codes Officer here in Building Regulations, would like to mention a few items about hydronic heating requirements. Moving forward, we will be ensuring that the insulation being used for hydronic heating meets code. Last September we called your attention to the requirements of CSA Standard B214-07, which addresses the installation of hydronic heating systems. We sent out a Builders’ Bulletin indicating that for hydronic heating systems you would need to have the approved drawings onsite and that an Air Test would be required at the time of inspection. The bulletin also mentioned that insulation is to be installed on the underside of the tubing and that each radiant loop needed to be tagged to indicate the length and area serviced. This radiant loop or zone also requires a method of system balancing. The Builders’ Bulletin also indicated that the requirements applied to hydronic heating systems used either as the primary or secondary source. Lately we have noticed that in many of these installations the insulation being used for hydronic heating does not meet the minimum requirements set out in the B214-07. So, we would like to use this forum to mention that as of November 1, 2011 our Safety Codes Officers will be ensuring that this code requirement is being complied with. The requirement states that “there shall be a minimum thermal resistance value equivalent to an RSI value of 0.9m/sq (R 5 h.ft/sq. °F/btu) between the concrete and the highest point of the water table.” In that case, the product itself must be approved with the RSI value of 0.9m/sq (R 5 h.ft/sq. °F/btu ). Construction projects are inherently risky ventures, as accidents or other unexpected events at a worksite can result in significant losses or liabilities to an owner or contractor. Parties therefore routinely turn to construction insurance policies to protect themselves against such risks and to help ensure that the benefits of undertaking a project are not outweighed by its potential costs. Although there are many different kinds of insurance policies that provide coverage relevant to construction projects, five key types of construction-related insurance are: Commercial General Liability Insurance; Property Insurance; Builders’ Risk Insurance; Professional Liability Insurance; and, Wrap-Up Insurance. Each of these types of policies will be reviewed in turn. COMMERCIAL GENERAL LIABILITY INSURANCE Coverage – Commercial General Liability (CGL) insurance is designed to respond to liability resulting from damage caused by the insured to third parties. As a liability policy, it does not cover damage to the insured’s own person or property, but instead covers claims made against the insured by other parties who have suffered loss or damage as a result of some event for which the insured is responsible. Exclusions – There are numerous exclusions in a standard CGL insurance policy that significantly narrow the scope of an insured’s coverage under the policy; however, three of the most critical exclusions in a CGL Policy are those that preclude recovery from the insurer for property damage to the insured’s own products, property and work. PROPERTY INSURANCE Coverage – Commercial property policies are intended to protect the insured against damage to its own property arising from a variety of risks, including intentional damage to the property by third parties but excluding damage caused by the insured itself. Exclusions – Property insurance exclusions differ between policies but may exclude coverage for damage to the insured’s property arising from a wide range of sources (e.g., pollution, arson, mould, vandalism, temperature changes, settlement and earth movement, among others). Property policies also include a number of exclusions that preclude 2 4 | P r o f i l e | w w w . c h b a c a l g a r y. c o m coverage for internal defects in the insured property (e.g., faulty materials, workmanship, design and latent defects or inherent vices). BUILDERS’ RISK INSURANCE Coverage – Builders’ risk insurance is a specialized type of property insurance that is employed by contractors in the construction industry to protect against liability for direct physical loss or damage to a structure or project which they have contracted to build. Exclusions – Common exclusions include those for faulty materials, workmanship or design, latent defect and/or inherent vice, wear and tear or gradual deterioration and extreme weather events or temperature changes. Certain policies may also exclude coverage for losses arising due to the collapse of a building, excavation or shoring activities, or theft at the project site. PROFESSIONAL LIABILITY INSURANCE Coverage – Professional liability Insurance is commonly known as Errors & Omissions (E&O) insurance. In the construction industry, professional liability insurance is often obtained by architects or engineers acting as consultants on a project to shield them from liability for any negligent acts or omissions arising out of the work performed in their professional capacity. Exclusions – The exclusions in a professional liability policy can be divided into three This is an excerpt from a larger article published in 2009. categories: (1) exclusions for liabilities relating to activities separately insured; (2) exclusions for liabilities for moral risks; and (3) exclusions for liabilities for extraordinary risks. WRAP-UP LIABILITY INSURANCE Coverage – This global liability policy is known as a “wrap-up” policy and generally provides coverage for the owner, contractor and all subcontractors and consultants for CGL, Professional Liability and Employers’ Liability, among other types of liability risks. Wrap-up policies are typically placed for a term encompassing the period of construction of a project plus an additional number of years after completion to deal with any issues arising during the warranty period. Exclusions – One notable downside to wrap-up insurance is that it usually excludes coverage for damage to the project itself during construction. This is only a basic overview of the scope and potential exclusions of common types of insurance policies employed in construction projects. Every policy is different, and each policy has to be reviewed in light of the particular project for which it is being used. Risk on a project may be unavoidable, but with the right insurance coverage it can be successfully managed. ■ INDUSTRYNEWS Paul Tamagi, Account Manager–Customer Service, WCB Alberta WCB Optional Personal Coverage: Are You Protected? Some questions still exist in the business community about WCB optional Personal Coverage. Under the provisions of the Workers’ Compensation Act (WCA), directors of corporations, individuals who are employers and partners in a partnership that employs workers are not automatically covered for their own work-related injuries. Directors of corporations are also not automatically protected from lawsuits by injured workers. Under Alberta law, a corporation is a separate legal entity from its directors and shareholders. As such, it is the corporation that employs the workers and, therefore, is entitled to immunity, not the individual directors. Because directors of corporations are not workers under the WCA they are also not automatically entitled to coverage for their workplace injuries. The WCA allows directors of corporations who wish to obtain protection from lawsuits and coverage for their workplace injuries to purchase personal coverage for themselves. Individuals who are employers or partners in a partnership that employs workers are entitled to immunity from lawsuit because these individuals are employers. However, such individuals are not eligible for benefits for their workplace injuries because they are not workers under the WCA. In the event that individual employers or partners wish to obtain workers’ compensation coverage for their own workplace injuries, the WCA allows these persons to purchase personal coverage for themselves. Should a director of a corporation purchase optional personal coverage? Because directors of corporations are not workers under the WCA they are also not automatically entitled to coverage for their workplace injuries. This is a risk management decision to be made by the corporation. If a director, through direct action, omission or decision at a worksite, has the potential to cause injury to workers, the corporation may wish to consider buying personal coverage for that director, to provide protection from lawsuit. Directors, individuals who are employers, and partners in a partnership that employs workers should remember that personal coverage brings all of the effects of the WCA into play including all WCB benefit policies and the loss of the right to sue others.
