Making big decisions about the kind of help you need and who will provide it can be stressful. We know that you want and deserve high-quality and safe care and to be treated with dignity and respect. I hope you will find this guide a useful tool as you consider your care choices, whether for yourself, a member of your family, or someone you care for. The Care Act has brought about a huge shift in care and support policies this year. It means there is now legal guidance to put wellbeing, dignity and choice at the heart of health and social care. You should be at the centre of decision-making, and you should have access to information that is clear and easy to understand. In Lincolnshire, we already offer support and engagement services for carers, to help them in their caring role. Now their incredibly valuable contribution to communities and the wider health economy is recognised in law, with more rights for carers included in the Care Act. Next year further changes are forecast, with a cap on care costs for the future. It has been our priority since long before the Care Act to make sure you have choices when it comes to your care journey. The care you receive should be right for your individual circumstances and we will work with you every step of the way to personalise your care to meet your needs. We also believe in helping you make informed decisions, ones that you’re confident in because we have worked closely with you. We all hope to be able to stay independent in our own homes for as long as we possibly can. Last year the County Council introduced the Wellbeing Service to help people to achieve that independence for longer. So far, more than 2,000 people have benefitted from the service which has helped people bounce back from set-backs and address problems before they lead to a hospital stay. More information about the Wellbeing Service can be found on page 16 of this Directory. We are working closely with Lincolnshire’s health organisations to co-ordinate health and care and deliver the best experience possible for you. The Lincolnshire Health and Care programme has introduced Neighbourhood Teams around the county, bringing nurses, GPs, social workers, mental health staff and therapists together. They are working together to support the most vulnerable people with the highest needs. Budgets are under pressure and we have a growing elderly population with care needs. If you need help and don’t know where to start, you can complete a short assessment on My Choice My Care and you will be contacted. If you are a carer looking for support, or you have received a Personal Budget and want some help with the next steps, there are providers that can help you consider a range of options. You can find out about financial costs involved in paying for your care needs, and how much we will fund towards this. This Directory’s helpline 0800 389 2077 – information on choosing and paying for care Ensuring good quality services Care and support for adults in Lincolnshire is delivered by public, private and voluntary sector organisations and we work with agencies to make sure they are of good quality. Lincolnshire County Council – Adult Care Adult Care delivers and commissions care and support, and works in partnership with others to deliver services. We offer an assessment of your needs and, if you meet the eligibility criteria, can offer a range of care and support services to help you stay safe and well. We are committed to assuring the quality of our services. A good quality service needs to include elements of all three sections shown in the quality circle, for example a service is not considered good quality if it is safe but your experience is poor. We expect our services to provide a positive experience meeting your personal aspirations. You should feel able to say ‘the service treats me well’ because: choices are respected and you are allowed the freedom to take risks; • you are treated with compassion, dignity and respect; • you are involved in decisions about your care; • you are offered a person-centred service that lets you keep control over your own life; and • you are supported to feel like part of a community. It registers health and adult social care services across England and inspects them to check whether standards are being met. If it finds that a service isn’t meeting the national standards, it takes action to make sure the service improves. Tel: 01522 782341 Web: www.lincolnshire.gov.uk/tradingstandards The new Care Act and what it means for you The Care Act 2014 is the single largest change to health and social care policy for a generation. It seeks to bring together a number of existing laws, and introduce new duties to local authorities to ensure that well-being, dignity and choice are at the heart of health and social care across the country. About the Care Act The Care Act introduces changes to the way that support for adults with care needs is provided and paid for. It will help make the care and support system more consistent across the country. For the first time, there will be a national level of care and support needs that all councils will consider when they assess what help they can give people. ‘Care and support’ is the term used to describe help for adults of all ages with things like washing, dressing, eating, getting out and about and keeping in touch with friends or family. The implementation of the Care Act 2014 will occur in two stages. The first stage, implemented on 1st April 2015, relates to social care reform. The second stage of implementation, due on 1st April 2016, relates to social care funding reform. This will result in significant changes to the way in which a person is assessed and pays for care. 2015 social care reform Key new features for councils which came into force on 1st April 2015 are: • a duty to promote people’s wellbeing, to help prevent or delay needs for care and support; • a duty to provide an information and advice service about care and support; • a requirement to carry out an assessment of both people being cared for and carers wherever they have needs. ‘Carers’ are usually family and friends who provide unpaid care and support to loved ones; • a requirement to consider the wellbeing of each young person or carer when planning their care as they approach adulthood and the transition to adult care and support; • a national minimum eligibility threshold for support. This is the minimum level of need which will always be met in every council area; and • a requirement to offer a Deferred Payment Agreement. For more information on Deferred Payment Agreements, see page 56. 2016 funding reform In April 2016, the cap on lifetime costs for eligible care comes into force. This cap is the maximum amount that anyone can be required to pay for their care and support in their lifetime. A care account will be set up to record payment contributions and allow people to see how they are progressing towards the cap on care costs. This second stage will see the introduction of a number of key reforms, including: • the extension of the means test which will raise the capital threshold at which a person is eligible to receive council support; • the introduction of a cap on the cost of care a person is expected to have to pay in their lifetime – the suggested limit is currently £72,000; • the introduction of care accounts used to monitor the amount a person has contributed to the cost of their care; • a requirement to carry out an assessment of young carers if they have a need; • the introduction of Independent Personal Budgets for self-funders; and • a duty to stimulate a diverse range of high-quality services like residential care homes or home care; • the introduction of a new care and support appeals system. • a requirement to protect people against disruption and changes in care and support when a person moves from one council area to another; See www.lincolnshire.gov.uk/careact for more information or search ‘Care Act’ at www.gov.uk for useful factsheets. They can prevent you from going to hospital, or offer extra care and support after you have been discharged. Your needs and wishes will be paramount throughout the process. Eligibility for care services How we decide your eligibility The national eligibility threshold has three steps to deciding eligibility. Step 1 - First we need to ensure that your needs result from you having a physical or mental impairment or illness. This will be explored in the health and wellbeing area of the assessment. If your needs don’t stem from illness or impairment your needs will not be eligible for support. Step 2 - Where your needs do stem from illness or impairment, we then consider whether they prevent you from achieving any of the ten ‘eligibility outcomes’ set out in the Government’s regulations. To meet the eligibility threshold you need to be unable to achieve two or more of these eligibility outcomes. Unable to achieve them can mean totally unable or able but with significant difficulty, pain or distress. The outcomes are: • managing and maintaining nutrition; • maintaining personal hygiene; • managing toilet needs; • being appropriately clothed; • being able to make use of the home safely; • maintaining a habitable home environment; • developing and maintaining family or other personal relationships; • accessing and engaging in work, training, education or volunteering; • making use of necessary facilities or services in the local community including public transport and recreational facilities; and • carrying out any caring responsibilities the adult has for a child. Step 3 - Where you are unable to achieve two or more of these outcomes we are required to make a judgement about whether there is a significant impact on your wellbeing as a result. We will explore what impact your needs have on your wellbeing in each area of the assessment. It is important we explore this fully as this is what we will base this judgement on. If you meet the eligibility threshold we will look at the needs we have identified, and state which are eligible and which are ineligible. If we believe any of your needs do not prevent you from achieving any eligibility outcomes or are not contributing to the significant impact on your wellbeing we will record these as ineligible needs. Ask your assessor if you would like more details about the national eligibility threshold. What if I don’t agree with the eligibility determination? This gives you full flexibility and transparency about how best to meet your own needs. What are Personal Budgets? A Personal Budget is made up of the amount it would cost to meet your agreed support needs. This money can either be paid direct to you, known as a Direct Payment, so that you can arrange your own care and support, or we can arrange your care and support for you, or you can have a combination of the two. A Personal Budget gives you the independence to: 12 • choose and control the support that is best for you; • be fully involved in decisions about the help you need to live independently; and • support yourself in ways that suit you. How do I get a Personal Budget? You can only have a Personal Budget or Direct Payment if you have an assessment which identifies that you need care and support to meet your eligible needs. The assessment process will help to gather and share information to build an understanding of your situation. An assessment will be completed with you to help understand This Directory’s helpline 0800 389 2077 – information on choosing and paying for care Personal Budgets continued your own strengths, what you can do for yourself, what support you have around you as well as where you have difficulties. It also helps to understand the outcomes which you want to achieve. The assessment process (see page 15) will help determine your needs and give an indication of how much money you can get for your Personal Budget. The Resource Allocation System (RAS) may help by indicating an appropriate amount to meet your eligible needs or we can calculate a budget based on the cost of services. Once the amount is agreed you can start planning how to spend it. We will help you to do this by using our experience to agree a plan which helps meet your support needs. Contributing to your Personal Budget If you receive a Personal Budget you will have a financial assessment to determine whether and how much you will need to contribute towards the cost of your care and support. The financial assessment should not take place before we assess your needs. This is to ensure that your financial circumstances do not impact on the needs assessment process and the support we give you to understand your needs and how they can be met. Will I manage my Personal Budget? Once it has been established that you need a Personal Budget and your support plan is agreed we can organise how you will receive the money. It can be paid directly to you, to someone else if you aren’t happy dealing with the money yourself or we can arrange for a service provider to manage it for you. The most choice and control is usually achieved by having a Direct Payment which enables you to buy care and support directly from individuals or organisations. Alternatively you can ask us to make arrangements to meet your care and support needs. You spend the money in ways that best meet your needs and you are in control as long as you spend the money in accordance with your agreed plan. We will check with you from time to time to make sure everything is going OK and that you are living your life in a way that suits you. Direct Payments Direct Payments are financial payments made to people who have been assessed as eligible to receive support from Lincolnshire County Council. We can make a Direct Payment to most people who need our support, including: • people who have been assessed as needing community care services (including those with mental health needs) aged 16 and over, incorporating short- as well as longerterm needs; • carers over 16 for carers’ services; and • parents of disabled children, for children’s services. Direct Payments allow more control over the decisions that affect your life. They provide more flexibility and choice, as you can buy appropriate support tailored to your individual needs. Another option is for us to source a portion of the care/support needs through services commissioned directly by Lincolnshire County Council and also provide a Direct Payment to arrange those remaining services that you wish to have more control over. What can Direct Payments be used for? If you receive a Direct Payment, the money is used to arrange support to meet eligible needs. You may choose to employ someone directly, to buy services from an independent or voluntary sector provider or purchase equipment to help you live more independently. With Direct Payments, people or agencies employed are accountable to you and not to Lincolnshire County Council. Therefore, Direct Payments enable more control, choice and flexibility over how you plan your support to fit with your life. It is important that the money is used lawfully, and eligible needs are met. However, there are certain items on which these payments cannot be spent, for instance: • services that should be provided by the NHS and/or local health services; and • routine living expenditures – utility and household bills for instance. Most Direct Payments are made to meet regular ongoing support needs, however they can also be made as a single payment, for example, to purchase equipment or a short respite break. What do I do next? The following services are designed to prevent your needs from escalating, reduce the impact of your problems and delay your need for ongoing care and support. If you need to go into hospital, this section tells you about the help available to get home safely, and provides information for you if you are worried about how you are going to continue to cope at home. Some services may carry a charge, please check with the Customer Service Centre on 01522 782155 first. Help after leaving hospital – ‘Home Safe’ If you need help to make sure everything is ready and safe for you to return home from hospital, our new Home Safe service can be arranged by the hospital ward staff to take you home. You can ask your health team more about the service as you plan for admission. Home Safe is a transport and resettling service for individuals returning home after a hospital stay. Our drivers and support staff will take you home where you will be met by a response team member, who will help you settle back in. As well as informing lifeline services and your nominated family member or friend of your return, responders will also check your heating and switch it on if necessary, check dates on food in the fridge, fetch any additional shopping you might need and offer any refreshments. It is aimed at people who do not have family or friends who are able to help, and remains a point of contact if ongoing assistance is required. Urgent Care What Urgent Care provision is available in Lincolnshire? Lincolnshire Community Health Services, NHS Trust, provides Urgent Care for people who experience a health need which requires urgent clinical attention, but not hospital admission. Urgent Care is available at Urgent Care Centres, and when appropriate in the patient’s own home, allowing people to stay safely in their own homes and providing peace of mind for many families. You can access Urgent Care without an appointment at Urgent Care Centres by calling 111 and someone will advise you of your nearest service. Home visits are usually by referral from 111, your GP or the East Midlands Ambulance Service when you have a short-term health crisis which can be safely managed in the comfort of your home. The Urgent Care practitioner will assess your situation, stabilise your condition, and get you comfortable so you can recover in your own home. They will ensure you have the necessary support and treatment in place, and make any further referrals as necessary. This means that you don’t have to have an unnecessary trip to hospital. Reablement services – reabling you and enabling you to live at home Reablement is about giving you the opportunity and confidence to relearn and regain some of the skills you may have lost because of poor health, disability, a spell in hospital or problems at home. After events like this you can lose your confidence or worry about your ability to cope at home again. Reablement is a very personalised approach – the kind of support given is tailored to your individual needs. It focuses as much on your emotional and social needs as on your medical needs. The reablement service gives easy access to physiotherapists and occupational therapists, enabling you to receive a wide range of support for a short time to help you become as independent as possible. How does the reablement service work? Following a referral to the service, a member of the reablement team will visit you to discuss your needs. The team will keep in regular contact throughout your reablement journey. Together we will agree what goals we are working to achieve. Your goals are written down in a reablement care plan. Reablement support will take place in your own home. The reablement service will arrange for your care to be delivered by the reablement support workers. They will review your progress towards your goals, oversee your care and agree the right time for discharge from the service. What happens when your reablement ends? At the end of reablement, the reablement service will assess your ongoing needs. If you still need continued support we will discuss this with you and, if appropriate, refer you for an assessment. Assessment Assessment is the process of gathering and sharing information to build an understanding of your situation. The assessment is really important to understand your own strengths, what you can do for yourself, what help and support there is around you as well as where you have difficulties. The assessment also helps us understand what outcomes you want to achieve. The process should be beneficial to you and it is important that you are as fully involved in the assessment as possible. The assessment may happen face-to-face where you live, in a hospital or place you are staying. Some assessments take place over the phone. Alternatively, you may wish to undertake your own assessment with the support of other people. In these cases we will still ensure the assessment is accurate and appropriate and may still need to involve other relevant people to understand your situation. The assessment will show all the needs we have identified and enable us to determine which of your needs are eligible for care and support. We will always ensure you have a copy of your completed assessment, which will include a statement of your eligible needs. How quickly will this happen? If your situation is very urgent and you are in a crisis or at serious risk of harm, we will aim to see you within 24 hours. If your carer is finding it very difficult to cope, we will try to see you within seven days. In any other circumstances it will be within 28 days of you asking for the assessment. What about confidentiality? We respect your privacy at all times. Any information you give us will be treated as confidential and will only be shared with those involved in your care with your permission – other than in exceptional circumstances where the law says we must show it to someone else. Will I be able to get help? After the assessment we will identify and agree your needs with you and discuss the help and support available to meet them, according to the seriousness of your situation. If you are eligible for help from us we will aim to arrange this within seven days of the assessment being carried out. If you are not eligible for help, we will still give you information and advice on other services that are available to help you to continue to live independently and to maintain your quality of life. If you are not happy with the outcome of the assessment you can ask us to look at your situation again with you and if you are still not happy you can get in touch with us to make a comment, suggestion or complaint. Lincolnshire Wellbeing Service How can the Wellbeing Service help me to live at home? The Wellbeing Service is available to anyone over 18 who needs some assistance following certain triggers – such as recent hospitalisation, bereavement or a fall in the home. It aims to help you live independently at home with the help of personalised support and assistive technology, so you can enjoy and achieve a safe and healthy lifestyle. Many parts of the service will be available to you free of charge, and some of the service is chargeable. The service includes: p to six weeks of targeted support to find solutions to - u the needs identified on your support plan; - a single point of contact to access relevant advice and support; and - co-ordination of a variety of organisations to ensure you have the help you need to live independently at home. 1. A guide to Telecare Telecare has been developed from what was originally known as a lifeline system, and now uses a range of wireless sensors that are placed around the home, or that can be worn (as a pendent or wristwatch). The person can press the pendant to immediately be connected to the 24 hours a day monitoring centre or, if the sensors detect a risk, they will automatically call the monitoring centre for you. The moment a risk is detected, such as a fall, fire or even if you haven’t taken essential medication, an alert is sent to our Telecare monitoring centre, where trained advisers can then talk to you. This service is available 24 hours a day, 365 days a year. Don’t worry if you’ve pressed it by accident, they will be pleased to know you are OK. Telecare is personalised so any referrals for the service should identify what equipment is required and how it can help you. Referrals can be made by health or social care practitioners direct to our Telecare team, or you or your family member or friend can ring our Customer Service Centre (with your permission) who can help to identify if Telecare can help. If you would prefer a face-toface assessment then our Wellbeing Service can be asked to carry out an assessment of your needs and refer you to Telecare if you want support from Adult Care. Telecare can help you remain independent and feel safer in your own home, safe in the knowledge that help can be summoned quickly. The Lincolnshire Wellbeing Service, established on 1st April 2014, is being delivered by Lincs Independent Living Partnership (LILP) on behalf of Lincolnshire County Council (LCC). Four local charities involved in the partnership; Age UK Lincoln, Boston Mayflower Housing, Lincolnshire Home Improvement Agency and LACE Housing are working together to ensure ease of access to preventative care and support services. With the help of community based support and assistive technology, the Lincolnshire Wellbeing Service aims to provide more integrated, high quality support through a joined up approach. Residents can access a range of services including personalised support involving a holistic 18 assessment of needs and up to six weeks of tailored support; simple aids for daily living such as key safes, raised toilet seats, bath/ shower seats and chair raisers and minor adaptations such as grab, hand and banister rails and alterations to steps. The service also delivers TeleCare installations with equipment linked to a 24 hour monitoring service and Rapid Response including Home Safe, a transport and resettling service for patients returning home from a stay in hospital or residential care. The Wellbeing Service is available to any resident in Lincolnshire, aged over 18 and those meeting certain triggers such as recent hospitalisation, bereavement, or a fall in the home will be able to access many parts of the service free of charge. Visit w w w.lincolnshire.gov.uk/mychoicemycare for help and information 25 Integrated Community Equipment Service (ICES) Lincolnshire’s ICES service is a partnership between Lincolnshire County Council and its Clinical Commissioning Group partners. The Integrated Community Equipment Service (ICES) provides short- and long-term loans of equipment, ranging from simple walking aids, through to larger and more complex items such as pressure relieving mattresses and hoists. Equipment may also be designed to help you or to assist carers with the safer delivery of care. The service can also include installation, servicing and maintenance depending on the type of equipment specified. Assessments of your equipment needs and the ordering of items are carried out by practitioners such as occupational therapists, social workers, physiotherapists, nurses or other health/social care professionals. Common items of equipment are held within a central warehouse. We have a targeted standard delivery timescale to deliver the equipment to the service user within five working days after the order is placed. Technicians are trained to unpack and remove any transit packaging to enable the item to be used. Occasionally, complex equipment may require setting up. The health or social care professional will provide some training and demonstrate to the service user and carer how to use the equipment. As the service is a loan service there are facilities in place to return items that are no longer required. To arrange return of items please call 0845 121 2031 to speak to someone who can help you. Every effort is made to refurbish equipment to allow it to be recycled for re-issue to someone else. This reduces our costs and helps preserve our environment. Whilst every effort is made to collect items within five full working days after the request is logged, priority is given to deliveries. Occupational therapy Occupational therapists can help you lead a more productive, active and independent life using a variety of methods, including the use of adaptive equipment. They can assess your home for hazards and point out things that contribute to falls. Visiting you at home, an occupational therapist will be able to suggest adaptations that will improve your mobility and independence. Perhaps handrails up stairs would be useful? Would a ramp up to your front door help if you are in a wheelchair? Alternatively, we can help you find equipment and advice to stay independent at home. Major alterations such as fitting a downstairs bathroom or widening doorways, could be paid for with a Disabled Facilities Grant (DFG), depending on your needs/ circumstances. An occupational therapist will talk you through any new equipment you may be given, as well as help you apply for funding for major adaptations if you need them. An assessment of your needs will determine whether an occupational therapist will be the best person to help and what charges (if any) you can expect. Getting help in your home You may need some more help to live at home independently. Care and support providers can offer a range of different services which may include: • home care – help with personal care such as washing and dressing; • ready-made meals – usually supplied frozen to reheat for yourself; • day services – available in care homes or community centres; • respite care – residential care or care provided in your own home to give you or your carer a break; • housing adaptations – we can provide information about equipment and adaptations to make it easier for you to continue to live in your own home; and • supported housing or extra care housing – provided by your district or borough council and the independent sector. 26 Preparing meals Community Meals, often known as ‘meals on wheels’, can help ensure that people receive proper nutrition on a daily basis, whatever their circumstances. If you are aged 18 and over and are unable to prepare and cook one hot meal a day, having your meals delivered could help make life easier. You may need this service due to a permanent situation such as sight loss, a physical or learning disability, illness or a temporary situation such as recovering after a stay in hospital, to help you maintain your independence and quality of life. The service helps to ensure that your home is in good repair, warm and secure. You may be finding this difficult to maintain, or you may need an adaptation, and the Agency may be able to help you to improve security and undertake repairs and improvements. If you can’t afford the cost of repairs and improvements, the Agency will help you to look at other options. These may include an insurance claim, a loan, a lifetime mortgage (often known as equity release), approaching a charity for help or a grant from the Council or other organisations. We’re here to support you Who is a carer? You are a carer if you provide unpaid help and support to a family member, friend or neighbour who would otherwise not be able to manage to live independently or whose health or wellbeing would deteriorate without this help. Support for carers We recognise that caring can have a major impact on your life and having help and support can make your caring role easier. To help support carers the following information and support is available to all carers who look after a resident in Lincolnshire: • information and advice on many subjects that are relevant to carers; • carers’ newsletter which shares news, events and carers’ experiences, search ‘carers newsletter’ on www.lincolnshire.gov.uk; • details of carers’ support groups; • learning opportunities which help you in your caring role, for example, understanding a diagnosis; • Carer’s Emergency Response Plan – this is a plan created by you which provides detailed instructions for others to follow in an emergency situation. This can provide peace of mind for you and the person you care for; • opportunities where you can become involved, as little or as much as you wish, in helping to support and raise awareness of carers and work with organisations to help shape and influence health and care services; and • carer’s assessment where a carer appears to have a need for support. An adviser can discuss this with you. ‘And how are you?’ is the Joint Carers’ Strategy 2014-18, recognising, valuing and supporting carers in Lincolnshire; search ‘Joint Carers Strategy’ on www.lincolnshire.gov.uk How to contact the services Lincolnshire County Council is the first point of contact for all referrals and general enquiries regarding support for carers. You can contact them from 8am to 6pm, Monday to Friday (except on public holidays) on 01522 782224. In an emergency, out of these hours, phone the Emergency Duty Team on 01522 782333. What is a carer’s assessment? A carer’s assessment is a way of identifying any needs and support that a carer has in relation to their caring role. The assessment will not judge a carer’s ability or the way the caring role is carried out. It is an opportunity to discuss how things are, whether or not any support might be needed and how the support can be provided for the individual’s circumstances. The assessment will consider: • the impact of the caring role on the carer; • the things a carer wishes to achieve in their day-to-day life; • a carer’s view about their willingness or ability to carry on caring; • a carer’s wishes around engaging in work, education or volunteering; and • a carer’s wishes regarding social engagement and access to the community. Where to go for a carer’s assessment A carer can request a carer’s assessment if they provide or intend to provide care for an adult by contacting the Lincolnshire County Council on 01522 782224 between 8am and 6pm, Monday to Friday (except on public holidays). What will happen following an assessment? If a carer appears to have needs for support an assessment is undertaken. The carer will then be informed of whether or not they are entitled to support from us. To establish eligibility for support the following national eligibility criteria for carers will be applied. Carers’ National Eligibility Criteria A carer meets the eligibility threshold if all three criteria listed below are met: 1. A carer’s need for support arises because they are providing necessary care to an adult. For example, if the carer is providing care and support for needs which the adult is capable of meeting themselves, the carer may not be providing necessary care. 2. As a result of the caring responsibilities, the carer’s Visit w w w.lincolnshire.gov.uk/mychoicemycare for help and information 35 What is a carer’s assessment? continued physical or mental health is either deteriorating or is at risk of deteriorating; or the carer is unable to achieve any of the following outcomes: • carrying out any caring responsibilities the carer has for a child; • providing care to other persons for whom the carer provides care; • maintaining a habitable home environment in the carer’s home; • managing and maintaining nutrition; • developing and maintaining family or other personal relationships; • engaging in work, training, education or volunteering; • making use of necessary facilities or services in the local community including recreational facilities or services; and • engaging in recreational activities. 3. As a consequence there is, or there is likely to be, a significant impact on the carer’s wellbeing. Support If a carer has eligible support needs a support plan will be produced. The plan, which will be carer-led, will set how the carer’s needs will be met. A carer can choose to have a Direct Payment and use the money that they receive from us to arrange their own support. If a carer is not eligible for support according to the national eligibility criteria, the carer will be provided with written information and advice in relation to their caring role. Getting out and about We know that life is not easy when you are stuck at home all day, particularly if you need a little extra support. Getting out, taking part in leisure activities and socialising with friends can make all the difference. Day opportunities and day care Day opportunities By ‘day opportunities’ we mean the things or activities people may want to do during the day. This covers all opportunities for people whether it be in the day, evening or at the weekend. We used to call this day services and/or day care. We want you to have more choice and control about what you do during the day. Personalisation will enable you to make such choices and control the services you choose to receive. Whilst the list below focuses on traditional buildingsbased day centres, you may prefer support to do things in your community. You are able to use your Personal Budget to buy support directly from a care and support provider and to help you to do the things you most enjoy. We may be able to help you to develop such opportunities and tell you what alternatives may be available in your area. Day care is a popular service offered to people who need some help with personal or practical care and are unable to get out and about by themselves. Day care is usually available in a resource centre, community building or a residential home and offers more support than an ordinary day centre can provide. Professional caring staff can support you with personal care, such as going to the toilet, reminding you to take 36 medication or help with washing or bathing. You may also be able to have a hot meal and drinks during the day and a chance to socialise and to take part in a number of activities. Day opportunities often provide valuable help in sustaining independence for people. They are provided in a variety of locations including care homes, specially adapted premises and purpose-built centres or in the community. These services aim to help you retain independence in your own home, live healthily and sometimes give a break to a carer or family member who is helping to support you. Some services may be specialised, catering, for example, for people with dementia, or other high-dependency needs. In all cases, good day services should provide a stimulating environment able to address individual needs, including physical or mental frailty and still be met through a Personal Budget. Access to day opportunities may be arranged privately in many cases by approaching the service provider directly. Extra care Extra care housing supports you to live independently in your own home for as long as possible. Whichever of these options you choose, your apartment will be your home. Should you currently benefit from financial help paying your rent or receiving support, this will still be available subject to your circumstances. In Lincolnshire, there are currently extra care schemes in Louth, Lincoln, Bourne, Sleaford, Grantham, Boston, Skegness and Sutton-on-Sea. We are working closely with the developers to increase the number of schemes, which are managed by registered social landlords. Extra care housing enhances the offer to older people when they feel they require a little more support. Often called retirement housing, there are many different types of sheltered schemes, available both to rent and to buy. Schemes usually consist of between 15 and 40 dwellings. These may be bed-sitting rooms, self-contained flats, bungalows or luxury apartments. Some schemes are simply housing designed to meet the needs of older people and linked to a community alarm. The majority of schemes have a scheme manager/ warden and community alarm service. There are often communal facilities such as a lounge, laundry, guest flat and garden. Meals are not normally provided but a few schemes include a restaurant and some can arrange hot meals. Care homes All care providers in the country must be registered with the Care Quality Commission. All services are inspected by the Commission, which reports on its findings and awards quality ratings so that the public can easily see the standard of a service. These inspection reports, and the quality ratings, are available from the care home or the Care Quality Commission website at www.cqc.org.uk Care homes offering personal care only These are commonly referred to as residential care homes. If you are reasonably active but would like greater security and care, subject to a needs assessment, a care home only offering personal care may be the option you choose. Personal care includes bathing, feeding, dressing, and help with moving but it must be paid for if your capital/ savings exceed £23,250. Care homes with nursing These are homes previously called ‘nursing homes’. If you think you may need nursing care in a home, you will need to be visited by Adult Care to access the care you may need. This visit might be in your own home or in hospital if you have been ill. You will be fully involved in planning your care needs. If a care home providing nursing care is the best solution for you, we will give you information to help you find a home that meets your requirements. The cost of the nursing care part of your fees is paid by the NHS to the home directly. This is called NHS-Funded Nursing Care. Currently this is a flat rate of £112.00 per week. It is important that you get your nursing assessment done before you go into the home. You can contact the nurse case management teams for your area through the Clinical Commissioning Group that your GP belongs to. Personal care is not paid for by the NHS and must be paid for by you if your capital/savings exceed £23,250. Moving to a care home is a major step, and before considering this, it is very important to make sure that you have explored all the support options available to enable you to remain at home as support options are developing all the time. Ask for more information on dementia specific activities, i.e. reminiscence or features throughout the home such as specialised signage that makes it easier for people with dementia or memory problems to identify where they are. © 2015 Care Choices Ltd ACTIVITIES In any home there should be a dedicated activities programme that has been designed with all residents’ capabilities in mind, and generally a dedicated activities coordinator is employed to help deliver this with the other care staff in the home. It is important to ask which of these activities have been planned specifically for those who suffer from dementia or who have other memory problems. • Are reminiscence activities available? • Ask about memory boxes. • Will staff compile life story books with you and the person you are looking for to give them a better understanding of their life? STAFF ACCESS It is important to note whether the staff seem friendly and caring towards residents and whether they treat them with dignity and respect. If the person with dementia or memory problems is likely to need equipment or adaptations you may want to check: • Ask if staff have specific training and experience in caring for people with dementia. • There is adequate signage as described earlier throughout the home, to act as prompts and cues. • Who will their key worker be? This should be someone you and they can go to who will have detailed knowledge and particular responsibility of their care. • What is the home’s security policy about locking external doors or being supervised and supported in outside areas? BEDROOMS What room will the person with dementia or memory problems have? • It can be worthwhile considering how easy it would be for someone to find their way back to their room, if there is one available on the ground floor to avoid the risk of falls. MANAGER/HEAD OF HOME A manager who is caring as well as efficient can make all the difference to the atmosphere of a home. It is important for you and the person to have a good relationship so you feel confident in the general running of the home. It is worth talking to the manager and any deputies they may have on how long they have worked in the home, and their general experience. Points to ask about: • Ask if you can bring any personal items of furniture or personal possessions such as photographs that are particularly important to the person you are looking for. This can increase familiarity with their surroundings, trigger memories and help them settle in better. • Do they have detailed knowledge and training of dementia? Can they deal with any difficulties that may arise in an understanding way? The following sections have been included to help you understand the different terms you may come across when arranging care for you or someone else, depending on your level of need for care and support. If a care home or care home with nursing is the right option, this will be chosen following an assessment and discussion with you and your family or carer. • Will they be conducting the initial assessment of the person requiring care in their own home or current place of residence? Intermediate care Intermediate care differs from respite care. While respite care provides care on a temporary basis, intermediate care is designed to rehabilitate you and enable you to manage by yourself. Intermediate care, including care home fees, provided by the NHS, is free. It can be provided in your own home or in a care home and is usually limited to a maximum of six weeks. 46 Based around a programme of therapy and treatment, intermediate care is designed to make you as independent as possible. The structured programme of support may mean that you do not have to go into hospital at all, or may enable you to get home faster after you finish hospital treatment, but cannot manage independently at home. Ask your care manager for further details. This Directory’s helpline 0800 389 2077 – information on choosing and paying for care Continuing care Continuing care is the name given to the care needed by an adult who because of disability, accident, illness or the effects of getting older, requires help over a period of time to manage their daily life. It is a package of care that involves services and funding from both the NHS and social services and is available in a range of settings. All NHS healthcare is provided free of charge. Social services care provision is means-tested and you pay either a contribution or the full cost depending on your financial situation and the setting in which your care is provided. An assessment is carried out by health and/or social care professionals to identify and prioritise your needs. The assessment will be used to determine who is responsible for providing and funding the services to meet your assessed needs. Decisions on how and where services will be provided will be made with your involvement. If you have been assessed as requiring care in a registered care home with nursing and you are not eligible for NHS continuing healthcare the NHS will pay a contribution towards the cost of your nursing care. See ‘NHS-Funded Nursing Care’ on page 56. NHS continuing healthcare NHS continuing healthcare is a package of continuing care that is arranged and funded solely by the NHS. If an assessment of your needs identifies that you have a ‘primary health need’ you will be eligible for NHS continuing healthcare. This means that care services to meet your assessed needs will be provided and funded by the NHS. The National Framework for Continuing Healthcare and NHS-funded Nursing Care sets out the eligibility criteria and the assessment process for accessing NHS continuing healthcare funding. Following a multi-professional assessment of your needs the Clinical Commissioning Group that your GP is registered with will decide whether or not you are eligible for NHS continuing healthcare. If you are eligible your care will be provided free of charge to you in any setting where your assessed needs can be met. In your own home this means that the NHS will fund all the care required to meet your assessed needs. In a care home the NHS makes a contract with the home and pays the full fees for both your care and accommodation. For more information on NHS continuing healthcare see page 56. Reviews As your needs can change, regular reviews will be undertaken which may result in changes to the provision and funding of your care. You can also request a review of your care needs if you feel they have changed. Living with dementia In the UK, as a whole, there is estimated to be over 750,000 people with dementia and the challenge of living with dementia continues to confront increasing numbers of people as our population ages. This is especially so in Lincolnshire, where in the last 10 years the increase in our population aged 65 plus has been three times that of the national average increase, accounting for approximately 22% of the county’s population compared to a 17% national average. Due to this our county continues to show a proportionately higher incidence of dementia than both the regional or national average; in Lincolnshire, the number of people over 65 with dementia has been estimated at 11,843 by 2016, rising to 13,589 by 2020. Most people with dementia are over 65 years of age, but dementia does affect younger people too. Dementia affects everyone differently and can cause a wide range of symptoms. These can include problems with memory, thinking, concentration and language. People may become confused or struggle with how they perceive things. Dementia can also cause changes in mood or emotions and affect how someone behaves. As GPs are usually the first point of contact for people with memory problems they will be working to increase the number of people getting a formal diagnosis. The GP may refer you to a Memory Assessment Service to help make a diagnosis of dementia. Following a diagnosis of dementia, your GP may refer you to a specialist like a Consultant in Old Age Psychiatry, a Community Psychiatric Nurse or an occupational therapist with a special interest in dementia care. A Memory Assessment Service: diagnosis and early intervention A Memory Assessment Service comprises specialist staff skilled in the assessment, early support, intervention and treatment of people experiencing dementia, including consultant psychiatrists, mental health nurses, occupational therapists, psychology, social workers and dedicated support workers. >> Visit w w w.lincolnshire.gov.uk/mychoicemycare for help and information 47 Living with dementia continued >> The Memory team work together to provide specialist assessments to determine whether dementia is present in cases where other common causes have been excluded by the GP. If dementia is diagnosed, then appropriate early intervention and advice, as part of an individualised care plan, are provided and onward signposting undertaken as required. The assessments provided build upon the tests and history started by the GP. Where required, additional investigations are requested such as head scans or further blood tests to support the process of diagnosis and inform the type of care and information required. Following assessment, if dementia is not confirmed, the Memory team will then either signpost on to other appropriate services or discharge back to the GP. The GP will be informed of the findings to ensure continuity of care and signposting to appropriate support networks and organisations for post-diagnosis support. Support for dementia carers Don’t forget to make sure that if you are caring for someone with dementia you also look after yourself. A good first point of contact is the Carers’ Team – see page 35 for more information about having a carer’s assessment and a Carer’s Emergency Response Plan. A new Dementia Carers’ Handbook has been produced which you can ask for. In 2014, Better Care funding was obtained to provide targeted short breaks for dementia carers. The Carers’ Team can help you with all this and more. Lincolnshire Partnership Foundation Trust offers Cognitive Stimulation Therapy, aimed at those in the early stages of dementia. This also offers a parallel course for family carers. Rethink also offers dedicated face-to-face carer’s assessments for carers of people with dementia. See page 63 for contact details. These provide a relaxed and welcoming opportunity to meet other people, share experiences and obtain information and advice. The Alzheimer’s Society also runs a number of Singing for the Brain groups (details on page 49) which, as well as being beneficial for the person with dementia, are highly enjoyable as something for family members caring for a person with dementia and friends to do together. The Dementia Cafés and Singing for the Brain groups offer valuable opportunities for social contact and to build new networks of support and friendship. The Alzheimer’s Society offers a Side by Side service which helps people with dementia to keep doing the things they love, with the support of a volunteer. The Society has also developed a pioneering new service at Pilgrim Hospital in Boston, where dedicated staff based in the hospital offer information, advice, advocacy and support for people with dementia and their families, carers and friends. This helps improve the experience of admission and the stay in hospital, and also assists with discharge from hospital. All About Me is a detailed document containing key information about a person’s routine, interests and preferences. It helps health and social care staff provide attentive and personalised care, based on a sound understanding of the person’s needs, communication, likes and dislikes. It is about people and organisations working together to prevent and stop both the risks and experience of abuse or neglect, while at the same time making sure that the individual’s wellbeing is promoted, including having regard to their views, wishes, feelings and beliefs in deciding on any action. We will always promote the individual’s wellbeing in our safeguarding arrangements. We know that people have complex lives and being safe is only one of the things they want for themselves. Professionals in Lincolnshire will work with the individual to establish what being safe means to them and how that can be best achieved. We want to make safeguarding personal to them. The six key principles which underpin all our adult safeguarding work are: 1. Empowerment – people being supported and encouraged to make their own decisions and informed consent. ‘I am asked what I want as the outcomes from the safeguarding process and these directly inform what happens.’ 2. Prevention – it is better to take action before harm occurs. ‘I receive clear and simple information about what abuse is, how to recognise the signs and what I can do to seek help.’ 3. Proportionality – the least intrusive response appropriate to the risk presented. ‘I am sure that the professionals will work in my interest, as I see them and they will only get involved as much as needed.’ 4. Communities have a part to play in preventing, detecting and reporting neglect and abuse. ‘I know that staff treat any personal and sensitive information in confidence, only sharing what is helpful and necessary. I am confident that professionals will work together and with me to get the best result for me.’ 6. Accountability – accountability and transparency in delivering safeguarding. ‘I understand the role of everyone involved in my life and so do they.’ What are abuse and neglect? There are a number of ways that individuals can be harmed. An individual can be harmed as a one-off or multiple times and the abuse can affect one or more people. Abuse can be long-term in the context of an ongoing family relationship, such as domestic violence or persistent psychological abuse, or opportunistic abuse where money or jewellery has been left lying around. How can we help you? As professionals we can help you think about your life and what you want to do to help you to be safer. We can, if appropriate, point you to agencies who are more specialist than we are or we can help you work out your own safety plan. We may do this with or without partners and our involvement will be dependent on the needs and risks that are presented to us. Make your voice count There are many ways to make your voice count if you feel something is not right or you are unhappy and need further support and advice. Advocacy for people who use Adult Care services Having someone to speak on your behalf and help you secure your rights and represent your interests is often known as independent advocacy. Advocacy can help to safeguard people who are vulnerable by speaking up for them. It enables people with physical or learning disabilities, older people, people with mental health needs and carers to make informed choices and decisions about their own health and social care. Advocacy is completely independent from the organisations that provide social care services. Advocates only act according to the wishes of the person they are speaking for. They do not take their own view of what is best, or try to influence the person to make a different choice. A new contract for independent advocacy services in Lincolnshire is to be in place from 1st July 2015. Commissioning jointly with Children’s Services, the new service will provide a single point of contact and will be delivered in accordance with the national quality standards for advocacy services. Total Voice Lincolnshire, the existing service provider, will provide statutory advocacy services: independent mental capacity advocacy and independent mental health advocacy, and services for anyone – an individual, carer, young person in transition to adult care or a young carer. The Total Voice Lincolnshire advocacy team is very experienced in ensuring that the advocacy process is meaningful for people who use the service. Advocates spend time with people developing methods that suit them best and also signposting people to other organisations that are better placed to help individuals with their enquiries if required. Some of the services Total Voice Lincolnshire provides have a certain qualifying criteria, so if you, or someone who cares for you, feel you might need the support of an advocate the first step is to contact Total Voice for an informal chat. If the service can help, an advocate will talk to you about your concerns, help you explore your options and choices and assist you to find the right information and advice. If you wish, they will express your views and opinions on your behalf at care meetings, during an assessment and at other times when you need to have your say. They will do so only with your agreement, and will not put across their own views about what is best, or try to influence you to make a different choice. If you feel that you do need to raise a concern then you should be able to do so easily and without fear of repercussions to your care and support. Organisations need to know how they are performing and use the feedback they receive from their customers, both positive and negative, together with other suggestions, to make improvements to their services. All services should have a clear complaints policy and process, which you can ask for so you know what to do, and it should not be difficult for you to follow. Initially it is best to raise your concerns, or concerns about a friend or family member, directly with the manager of the service you are using. This way issues can be resolved at an early stage. If you or a family member is receiving care which is regulated, for example in a care home or personal care at home, then that service will be regulated by the Care Quality Commission and you can raise your concerns with the Local Government Ombudsman. Assessments are explained on page 15. If you have assets of less than £14,250 you may be entitled to assistance with your funding from us. Between these two figures, a sliding scale operates whereby you must pay £1 per week for each £250 you have above the lower figure. Before you think about the likely costs of any care and support, it is important that you get information and advice about the options open to you, both regarding the type of services that might suit you, and whether we might contribute to the costs. If you don’t you may make poor decisions about either the care you organise or how you pay for it or both. On www.lincolnshire.gov.uk/mychoicemycare there is a financial calculator under the ‘Information, Legal and Financial Issues’ section. This function will allow you to determine how much you may have to contribute towards your care fees. If you are a friend, relative or carer this facility will also give you the opportunity to help someone work out what they may have to pay towards their care. What is a self-funder? There are many options for help with funding your care. If you are aware that you will need to fund your own care, there are a number of organisations which can offer advice. These include independent or specialised financial advisers who can explain the options available to you. Further information about accessing independent financial advice can be found on My Choice My Care at: www. mychoicemycare.org.uk/i-need-help-with/information,legal-and-financial-issues/independent-help,-advicesupport/independent-financial-advice.aspx If you are paying for the full cost of your support needs, you are known as a ‘self-funder’ which means: • you have chosen not to ask us for support; or • you have been assessed but your care needs do not meet our eligibility criteria; or • you have been assessed as eligible for support but are moving to a care home and will not qualify for help with the fees because your income, savings or capital assets exceed £23,250 (please note this capital limit usually changes every April), or you are eligible for care and support at home but due to your level of capital/ savings or income you have been assessed to pay the full chargeable cost or the maximum charge, and you have therefore decided to fund your care and support yourself. Why do I need financial advice? Whatever option you choose, you need to make sure you will have enough resources to cover the cost of your care going forward. If you do not have enough to cover the cost there is a risk that you will be unable to fund your own care needs for your lifetime or that you will have to move to a different care provider. This is not a situation anyone would wish to find themselves in, but can be avoided by careful planning and obtaining professional advice. You may decide to apply to your local authority for an assessment of your needs, which will determine the level of funding you may receive from your local authority and what you will have to contribute towards your care costs. The local authority will consider your previous investments to make sure you haven’t invested as a way to deprive yourself of capital assets or income; this will include previous investments you’ve made towards your care costs. What options are available to me as a self-funder? You can still contact us and ask for an assessment of your needs; we can help you to identify your requirements and outcomes to help you plan for your support needs: • you may find that you are entitled to support with the costs, or you may be entitled to benefits you are not currently receiving; • you can have a financial assessment even if you think that we will not make a contribution to your support needs; • if you have to pay the full cost of your support, we can offer information, advice and guidance on support and opportunities available to you; >> Visit w w w.lincolnshire.gov.uk/mychoicemycare for help and information 55 What options are available to me as a self-funder? continued >> • we can offer information, advice and support to some people to help to regain your independent living skills through the use of equipment and technology; • we can advise you on the cost of your support needs and how much your support needs are likely to cost; our advice could help you save money; • if you have a carer, your carer is entitled to a carer’s assessment; • we can offer information, advice and guidance on preventative services; we have a number of services within the community that can support your health and wellbeing; and • you could be eligible for reablement (see page 14), especially after being in hospital, having a fall etc. It is important to make sure that you find out as much as possible before making care funding decisions. Assuming you will be moving into care and you meet the eligibility criteria, you may be entitled to some of the following financial assistance and support. Twelve-week property disregard If your former home is included in your financial assessment but your other capital is less than £23,250, and your income is not enough to meet your care home fees, we will help with the cost during the first twelve weeks of permanent care, provided we agree that care is needed. Deferred Payment Agreements After the twelve-week property disregard period, any financial help from us will be charged against the value of your home and recovered once your house has been sold. A legal charge will be placed on your home, and there will be some legal and administrative costs during the set-up of the agreement. Interest will also be charged. Please see the Deferred Payment leaflet available from us for more information. It is important to seek independent legal and financial advice in these circumstances. We may limit how much we will pay and it may affect your entitlement to Pension Credit if your property is not seen to be on the market and becomes treated as capital by the Department of Work and Pensions. Attendance Allowance This is a non-means tested, non-taxable benefit from the Department of Work and Pensions (DWP) paid at the lower rate of £55.10 per week for those needing care by day or night, and at the higher rate of £82.30 per week for those needing care both during the day and night. Everyone can, and should, claim this benefit. Please note that entitlement to this benefit does change upon admission to care so it is important that you contact the Attendance Allowance unit at the DWP on 56 0345 605 6055 with any change in circumstance to avoid any overpayments in benefit being made. NHS community healthcare You can receive community healthcare services in any setting, including your own home or in a care home. This care is usually provided by a community nurse and is free of charge. Healthcare services may also be provided by therapists and specialist nurses or through organisations such as Marie Curie or your local hospice. NHS-Funded Nursing Care Contribution Whether you are a temporary or permanent resident, if you live in a care home that provides nursing care you will be entitled to a non-means-tested NHS Nursing Care Contribution (currently £112.00 per week for the standard rate) towards the cost of your nursing care. This is paid directly to the care home. The National Framework for Continuing Healthcare and NHS-funded Nursing Care sets out the eligibility criteria and the assessment process. NHS continuing healthcare Access to NHS continuing healthcare funding is through an assessment process to determine if you have a primary health need. This is also set out in the National Framework for NHS Continuing Healthcare and NHS-funded Nursing Care. If you are eligible for this funding the NHS will fund the cost of your care in any setting where your assessed needs can be met. This funding will cover the cost of your board and accommodation if you live in a care home. It is not means-tested. However, your eligibility to receive this funding will be reviewed by NHS staff on a regular basis and may be withdrawn following a review and a period of notice. Running out of money If your capital is likely to reduce to £23,250, you must let us know well in advance as we will step in and help with your care fees. We must conduct an assessment of your situation and will make a contribution – described below. If the home you have chosen charges more than this, you must find someone to help pay the difference – this is called a ‘top-up’ payment. Whoever does this, whether family or a benevolent charity, they should realise that they may have to pay this for some time. Alternatively, you would have to find a cheaper home. For more information on top-ups, see page 58. Understanding your rights before moving into care is essential. There are a number of financial products and specialist companies who may be able to help. It is important to seek advice before committing yourself. Please see page 55 for information on accessing independent financial advice. The value of your home is included when assessing capital unless: • your partner; or • a relative who is over 60 or disabled; or • a child under 16 who you or a former partner maintains, still lives there. NO We will contribute financially towards your care costs. How much? To work out how much we will pay, you must arrange an assessment (explained on page 15). This will define your care needs and how they will be best met and your financial situation. Whichever homes you consider must be able to meet these needs. Your choice of care home will be limited to those that accept our funding level. More expensive homes will expect you to arrange a third party to ‘top-up’ the difference (explained on page 58). You are not allowed to do this yourself if your capital is below £23,250. If your capital is less than £14,250 and the home you choose charges fees that are within our funding rate, your contribution will be assessed only on your income. With capital between £14,250 and £23,250 you will be expected to contribute £1 per week for every £250 you have above £14,250. YES Arrange for an assessment with us to define your care needs. Whichever homes you consider must be able to meet your assessed care needs. If, apart from your property, your savings are less than £23,250, we can help with your care costs for the first twelve weeks. After this time, any money from us will be regarded as a loan under the Deferred Payment scheme and will need to be repaid once the scheme is terminated, usually by way of the property being sold or the resident’s demise, within the scheme’s payment terms. (Please see the Deferred Payments leaflet available from us for more information and the explanation on page 56.) Whatever your circumstances Remember: • your partner will not be means-tested, even if they remain living in your home. If you both have a private pension you can opt for only half to be considered when you are assessed; • your assessment will be made up of two elements, a ‘care’ part and a ‘financial’ one; and • a nursing home will generally be more expensive than a residential home which only offers a personal care service. Consider claiming: • Income Support; and • Pension Credit. Definitely claim: • Attendance Allowance, worth either £55.10 or £82.30 per week depending on your care needs. Moving into a care home with nursing? You will be eligible for the NHS Nursing Care Contribution – currently £112.00 per week. Always seek advice Independent help is available to guide you through your financial options. There may be a number of solutions to retaining your capital whilst paying for care. This extra payment is often referred to as a ‘top-up’ or ‘third party payment’. Except in limited circumstances, the law states that you are not allowed to make this additional payment yourself. The responsibility for this often falls to a member of your family or a benevolent sponsor such as a charity. Once this person or organisation has been confirmed, they must sign an agreement formalising the arrangement. It is important that whoever agrees to do this for you is made aware that the amount could increase in the future and they must be confident that any increases will be met. Should payments stop for any reason, you should seek help and advice from us immediately. As the financing of care is a complex area, you are advised to contact us to ask for specific advice and individual guidance. Please note, the rules surrounding top-up payments is likely to change in April 2016. How solicitors can help A solicitor can give you impartial advice about wills, making gifts, estate planning and Lasting Powers of Attorney (LPAs). Some can also offer guidance on immediate and long-term care plans, ensuring (if applicable) the NHS and/or County Council has made the correct contribution to your fees. Lasting Powers of Attorney allow you to appoint someone you trust to make decisions about your personal welfare, including healthcare and consent to medical treatment, and/or your property and financial affairs. A LPA is only valid once registered with the Office of the Public Guardian. It allows for a person of your choice to make decisions on your behalf at a time when you may be unable to do so. The Court of Protection can issue Orders directing the management of a person’s property and financial affairs if they are incapable of managing their own affairs and should they not have a LPA. An ‘advance directive’ allows you to communicate your wishes in respect of future medical treatment but it is not legally binding. You may instead wish to make a living will, properly known as an ‘advance decision’ setting out treatment that you do not want to receive in specified circumstances, which would legally have to be followed, even if you die as a result. Any proposed gift out of your estate needs careful consideration of the benefits, risks and implications, particularly on any future liability for care costs or tax liability. Any contract should explain: the cost of care, what services are included in the price and how often this is reviewed; what complaints procedure is in place; what your rights are and the obligations of the care provider under the contract; the procedure for cancelling a contract and the administering of medication. Inspecting and regulating care services All care providers must be registered under a system which brings adult social care, independent healthcare and the NHS under a single set of essential standards of quality and safety. The Care Quality Commission (CQC) registers, inspects and reviews all adult social care and healthcare services in England in the public, private and voluntary sectors. This includes care homes, care homes with nursing, home care agencies and NHS services, amongst others. 58 Inspectors carry out a mixture of announced and unannounced inspections looking at the quality and safety of the care provided. They look at whether the service is safe, effective, caring, responsive to people’s needs, and well-led. Inspection teams are led by an experienced CQC manager and often include experts in their field. The team may also include professional or clinical staff, experts-byexperience, people who use services, and carers.
