Snyder Oh The Things They didn't Teach Us In Law School The old adage, "It's not what you know, but who you know" does not hold true in the modern practice of law. As classic overachievers, many of us began to compete in elementary school, continued to work hard to obtain the best grades and then to achieve the highest score on our college SATs. Once in college, we realized that the competition intensified, culminating in a big push on the LSATs. Having made the grade, we looked around on the first day of law school, and realized that being an overachiever in a classroom of overachievers is not enough, and made even greater strides to excel. Finally upon graduation, we all put in a Herculean effort to sit for the Maryland Bar examination only once. The problem is that after being sworn in as attorneys, we all have the harsh realization that law school really did not prepare us for the practice of law. In reality, law school can do little more than teach Socratic reasoning and problem solving, encourage the development of research and writing skills, and provide a rudimentary understanding of the rules of procedure. This became apparent to me in 1977, the summer INSIDE THIS ISSUE 3 6 8 9 10 Rent/Lease Ads Attorney Opportunity Ads Judges Schedules Calendar R EWSLET TE (Continued on page 4) BAMC HAPPY HOUR Thursday, October 2, 2014 5:00 p.m. - 7:30 p.m. Bar Louie (Rockville) 150 Gibbs St., Rockville, MD 20850 Featuring: Indecent Exposure Food & drinks courtesy of September 2014 BAR LUNCHEON SCHEdULE September 2, 2014 – Speaker: Senator Brian Frosh Topic: Legislative Update October 7, 2014 February 3, 2015 November 11, 2014 March 3, 2015 December 2, 2014 April 7, 2015 Rockville United Methodist Church 112 W. I knocked on the door of Barney Welsh, a senior lawyer and a part-time law professor who had the reputation, unbeknownst to me, of being quite a character. I had no idea what I was in for! He asked me in a scolding tone "What do you know and what can you possibly offer a law firm? You will not have any idea what this is all about until you have practiced law for ten years.” I stood my ground, and told him I was willing to learn and would be a hard worker. Needless to say, I walked out mad as a hornet, and without a job. What really angered me was that over the next five to ten years, I realized that he was right. I needed to learn so much more than was offered in law school. At our March Bar luncheon, we were pleased to have University of Maryland Law School Dean Haddon speak to us about the need for experienced attorneys to serve a mentors to graduating law students. Chief Administrative Judge John Debelius asked the question that was on 4 most members minds, “Why doesn't law school curriculum include pragmatic education as to the basics, such as setting up IOLTA accounts, and running a law office?” Clearly, law schools recognize the need to address these issues but with limited time and resources the law schools have been unable to do so. As a bar association, we can help by providing gap-bridging programs and practical supplemental education for recent graduates on these subjects as well as the need to belong to our association and become part of the legal community. It was clear from the Dean's presentation that if we don't step up and assist, this vital need goes unanswered. John Monahan has begun formulating our contribution of CLE programs for this purpose. These presentations have been well received by recent admittees who now desperately recognize this need. For those of you who have the ability of paying it forward by mentoring recent graduates and assisting in this program, you can help ease the culture shock we all have experienced. Merely knowing the players is a help, but WHAT YOU KNOW by way of introduction to the real practice of law is critical. The BAMC Mentor/Mentee program is in full swing, so if you are interested in becoming a Mentor or are looking for a mentor, please contact Eby Kalantar at [email protected] or Roz Tang at [email protected]. If you have any other ways you would like to become active in this endeavor, please feel free to give me or Julie at the Bar Office a call. September, 2014 The Bar Association of Montgomery County, MD Newsletter 7 TECHLECTIC ... by Pat Hoover Congratulations to those of you who bought shares when GoPro's IPO was issued just a few months ago. The initial share offer doubled and as of this gives the user/wearer a birds eye view of exactly what is seen in real time by the remote camera and it's wireless input! I've read about this thing for some time writing. Though down from its blast off high, it is still trading at an amazing 0.58% increase over the original public IPO share price when last I checked. Almost as nice as the blowout IPO share price, GoPro's fantastic product line of small video cameras continues to dominate the world market in outdoor video. I know you've seen the little GoPro video cameras held securely inside its clear waterproof case (and the many GoPro knockoffs flooding the market) either on the ski slope, at the beach, attached to bicycle helmets, skateboards, and or fixed to about any other place imaginable that allows for the kind of "right now" reality video for our inner extreme sport selves. www.gopro.com. A real plus is the free remote, control app available for both android and apple mobile devices allowing remote control video and playback of all three GoPro camera models. Sweet. Course if it's your kid who's busy snorkeling away over some tropical reef with a GoPro video camera, be prepared for nightly vacations videos of your in house Jacques Cousteau. But don't sneer, you might just love it cause the GoPro video cameras are easily capable of producing amazing video recordings. Try checking out the GoPro vids at YouTube or at www.gopro.com. For an even higher end tech look into the ever expanding world of full capture personal video, checkout the Fat Shark from RC Vision Systems www.fatshark.com. Fat Shark makes a series of closed viewing, wrap around, wearable goggles for an experience unlike any other. The Fat Shark product and have seen it in action, but it wasn't until recently when I used the Fat Shark Dominator, that I experienced the awesome power of this product. The Fat Shark is mostly associated with drone operators - you know, those ever increasingly seen toy sized helicopters, quadcoptors and very small sized fixed wing airplanes. Introduced in '02, the Fat Shark goggle, or more accurately the wearable video monitoring it provides to the viewer, is frankly amazing. Picture yourself wearing a small lightweight but closed view goggle like 8 an eye piece monitor which shows you in near 3D clarity and resolution, exactly what your remotely controlled, stealthy flying drone aircraft is also seeing in real time, together! Amazing. What's next, a wireless nano video stream projected from inside a human being, sent in real time to the doctor's office?!?!?! Oh, sorry, they have that already....it's just not yet available as an app to the public...I'd love to beta test that one!!! HELPING OPPORTUNITIES ... CHAMBER CHATS Our September Chamber Chat will take place on Wednesday, September 10, 2014 at 12:30 p.m. and will be hosted by the Honorable Eric M. Johnson. Judge Johnson will be retiring this fall. However, he has graciously agreed to host one last Chamber Chat. Judge Johnson has been on the Circuit Court bench since August 29, 2000. During his time on the Circuit Court bench, Judge Johnson has served as a member of the Family Law Committee and the Public Awareness Committee for the Maryland Judicial Conference and the Drug Treatment Court Commission. Prior to joining the Circuit Court bench, Judge Johnson was a member of the District Court bench for four years. Bring your lunch, along with any questions, and take advantage of this opportunity to get to know a member of our Circuit Court bench in an informal setting. No RSVP is required, but it is appreciated for planning purposes only. The Chamber Chat is open to all members of the Bar, not just members of the New Practitioners Section. Judge Johnson’s Chambers is located in the Circuit Court Building at 50 Maryland Avenue, 9th floor of the North Tower, Courtroom 9C. If you have any questions, please feel free to contact Elizabeth McInturff, Chamber Chat Committee Chair, at (240) 399-7900 or [email protected]. Elizabeth McInturff, Chair Chamber Chat Committee Kathryn E. Deckert, Co-Chair Caitlin C. Grant, Co-Chair As a new practitioner, it is important to have the mentorship of an experienced attorney to assist a young attorney achieve their professional and personal goals. The practice of law involves a multitude of considerations to include, not only a variety of practice areas, but also work/life balance, a choice between government and private practice, and practice at a large or small firm. Assessing one's priorities and finding a practice that fits one's goals can be a difficult task. This task can be made less daunting with the guidance of an attorney-mentor. By participating in the Montgomery County Bar Association Mentor-Mentee Program, experienced attorney-mentors are paired with newpractitioner-mentees. The mentors share their experiences and wisdom with their mentees. Both mentors and mentees build relationships with each other, involve themselves in the Montgomery County Bar Association, and network with other mentors and mentees. With their involvement, each can learn from one another. If you have practiced law for more than seven years, we encourage you to volunteer as a mentor in the Montgomery County Bar Association Mentor-Mentee Program. If you have been practicing law for less than seven years and would like guidance from a mentor, we encourage you to apply to get a mentor. Applications to be a mentor or mentee are available on the BAMC website, and can be submitted at any time to Rosalyn Tang at [email protected]. Only a handful of restaurants have been approached and the following have agreed to a 20% discount: Mama Lucias, Bar Louie, Taste Gastropub, 82 Steak Out. The response has been overwhelming and can apply to any service business. Please let your clients and friends with local businesses know of the opportunity to be exposed to 2500 families with a chance to post their menus and products on our website. It is a win/win! We are asking for anyone who has a contact at a local restaurant to help us with this effort, or anyone who is interested in contacting restaurants at which we do not have a contact to reach out to those restaurants. This is a great way to increase the benefits provided to our members and benefit our community, but we need your help! This is just the first step in our plan to offer discounts at a range of restaurants and other local businesses and service 24 providers. We have had a warm response so far, with several local restaurants providing tentative agreements to participate. Please contact Jim Mood (301-4240400), [email protected], or Kate McQueen, (240-507-1718), [email protected], if are willing to assist in this effort. Phase Two of AJAC largely continues in this spirit. Appeals employees presented with new information in examination cases are clearly instructed not to take “investigative actions or perform analysis of new information or new issues.” Instead, the case must generally be returned to IRS Examinations for its determination on the supplemental facts. In order to remain independent, direct ex parte communication between Appeals and the unit in which a case originates is generally prohibited. Phase Two clarifies DAMAGES IT DOES NOT MATTER DAMAGES IT’S ECONOMICS TO US. ■ ■ DAMAGES (Continued on following page) September, 2014 The Bar Association of Montgomery County, MD Newsletter 25 COMMITTEES & SECTIONS (Continued from preceding page) when contact between IRS Appeals and other units is permissible (such as for purely ministerial reasons) and how to prepare case files for return to other IRS functions to avoid improper communication with personnel. One caveat seen throughout both Phase One and Phase Two of AJAC is that a “new issue” or alternative legal argument raised by a taxpayer is not the same as new information or facts. Nonetheless, the Phase Two guidance instructs Appeals to provide the originating unit of the IRS with an opportunity to examine any new issues. Appeals may generally not raise new issues on its own or re-open issues already agreed upon at the Examination level. Although perhaps the most ambiguous aspect of AJAC, Appeals’ consideration of new issues and alternative theories is constrained by the express prohibition under the Phase One guidance that Appeals may not develop new facts to support any novel theory. Thus, the potential for abuse by either taxpayers or the IRS appears limited. The Montgomery County Bar Foundation Pro Bono Program seeks volunteers – whether experienced or newly barred attorneys – to join our panel. There are many county residents that are in great need of pro bono services. Your call to volunteer will make a difference to those without resources. The Pro Bono Program provides two ways for county residents to receive FREE LEGAL SERVICES in civil cases – at a legal advice clinic or through the client intake line for referral to an attorney volunteer for direct representation. The legal advice clinics operate in four locations across the county (SEE BOX BELOW) and provide residents the opportunity to walk-in and meet with an attorney volunteer without scheduling an appointment. Eligible clients present their legal problems to an attorney and receive free immediate legal advice and/or referral to a non-profit or government social service agency that may be helpful. The client intake line operates out of the main office where the staff screens calls from potential clients. The Pro Bono Program staff conducts all screenings over the phone only. Cases referred to attorney volunteers include family law, debt collection, bankruptcy, limited employment, limited immigration, wills and power of attorney. The Pro Bono Program currently is participating in three projects. First, we participate in the Judicare Project. Contested custody and complex family law cases are referred at a reduced fee to experienced family law attorneys. PRO BONO UPdATE Attorneys can seek reimbursement of $80 per hour with a cap of 20 hours per case. The Pro Bono Program requires that the attorney must accept a pro bono case for each case accepted under the Judicare Project. Second, we have a working agreement with the Collaboration Project of Maryland for family law case referrals that include modifications. Third, we refer eligible clients with debt buyer cases to attorney volunteers for direct representation under the Consumer Protection Project. The Pro Bono Program provides FREE LEGAL TRAINING to attorney volunteers. The Rita Rosenkrantz Family Law Training is available via webcast to attorneys for free in exchange for agreeing to accept a family law case. You can sign-up to begin the training at your convenience over the next 30 days. The most recent training was taped during the recent live class presentation held the 1st week of May 2014. Maryland barred attorneys in good standing can watch a preview of the training and then determine if they would like to proceed with the entire seminar. Please call Yesenia at 301.340.2534 to obtain the website and necessary code to watch the preview and to get the Pro Bono Program Training Agreement form. Attorneys participating in the training have the opportunity to immediately join a mentoring group hosted by an experienced family law attorney. The mentoring group meetings are your opportunity to ask questions about your case and learn from the attorneys participating in the group. If you have a desire to serve self represented litigants you can help in one of two ways: 1. Impromptu Volunteering: If you happen to be at the Courthouse between 12:00 pm and 2:00 pm and have a little time to spare, stop by and see one, or maybe two, clients. We almost always have clients waiting during lunch hours, and could use your assistance. 2. Scheduled Volunteering: If you have more time to spare or prefer a more structured arrangement, please contact our Bar liaison: Judi Bluefeld, (301) 2797817, [email protected], or stop by and consult with the Center staff. In that way, we can let you know when the Center will be shorthanded, and can most use your valuable assistance. Time that you volunteer at the Family Law Self Help Center can be counted as Pro Bono hours to the Court of Appeals. 34 The Bar Association of Montgomery County, MD Newsletter September, 2014 JUdGES SCHEdULES ~ Updates to these schedules can be found in the Court Schedules section of the Bar Association website ~ Circuit Court *Family Duty; CM=Criminal Motions; PT=Criminal PreTrial Jury Demand/Appeal Docket September, 2014 The Bar Association of Montgomery County, MD Newsletter 35 Newsletter of the BAR ASSOCIATION OF MONTGOMERY COUNTY, MARYLAND 27 West Jefferson Street, Rockville, Maryland 20850-4200 CR LCR C/S Bar Office Conference Room Lower Level BAMC Conference Room See Committee/Section Pages for Location Periodicals Postage PAID at Rockville, MD CLR CLE CLE Classroom CLE Seminar–Call (301) 340-2534 to Register SEPTEMBER 1 2 4 8 9 10 11 13 16 17 18 19 20 23 24 25 28 30 ~ HOLIDAY – Bar Offices Closed ~ 11:00a.m. CR Employment Law Section Meeting 12:15p.m. Bar Luncheon 8:00a.m. C/R Circuit Court Bench Bar Committee 12:15p.m. CR Youth Courthouse Project Committee 5:30p.m. CLR Leadership Academy Committee 8:00a.m. C/R District Court Bench Bar Committee Noon C/S Estate & Trust Law Section Meeting 5:00p.m. CR Executive Committee Meeting 8:00a.m. CR Fall Outing Committee Meeting 8:00a.m. C/S Real Estate Law Section Meeting 8:00a.m. CR Elder Law Section Meeting 12:15p.m. CR Criminal Law Section Meeting 12:30p.m. C/S Circuit Court Chamber Chat 5:00p.m. CR Lawyer Assistance Committee 8:00a.m. C/S Law Firm Management Section 5:00p.m. CR Foundation Board of Directors Meeting 5:30p.m. C/S Workers Compensation Law Section 9:00a.m. CLE CLE–Public Speaking For Attorneys 8:00a.m. C/S Commercial Litigation Section 5:30pm.
