members of our family, needed
an expensive cancer drug to support their quality of life, who
would hesitate for a moment to
make the expenditure? Should
we be any less concerned about
our own future quality of life
and financial health in retire-
ment?
This being said, why is it that the vast majority
of lawyers, even with the advantages of a doctorate
degree, acquired business acumen, and good old
fashioned common sense, fail to take full advantage
of tax deferred investments in qualified plans such
as 401k’s for their future. This is one of the few
areas aside from the Home Mortgage Interest
Deduction where Uncle Sam is actually our partner.
The logical progression in the practice of law is
from law student to experienced practitioner, to
active parent and community member, to senior
member of the bar, to retiree. If you were to blink
you could pass quickly from one phase to the next
without realizing the transition. Student loans, mortgages, car loans, credit card balances in addition to
Maryland's tax rates (one of the highest in the
nation) erode both the desire and ability to start
investing for the future.
A little knowledge of the fundamentals of
Investing and the" Power of Money invested" reinforce that time is "of the essence". Pursuant to The
rule of 72's you can compute how long it will take
to double your net worth. Simply divide 72 by the
sustained rate of return. I know that it may be hard
to believe, but this is mathematically correct based
on compounding returns. When you consider your
income tax bracket and realize that a qualified pension investment and the compounded growth is
applied tax deferred you understand the immediacy.
Who would want to pay more taxes on their
income to the government rather than build a future
for their family. When put in this context the choice
seems clear!

to announce the appointment of Richard
Dabbs to the position of DCM
Coordinator. Rick has been with the judiciary for over 30 years, most recently in
the role of Lead Family Division Case

renovations: Effective Monday July 14,
2014 at 8:00 PM the Terrace Corridor
connecting the Circuit Court to the EOB
will be closed. The closure is required to
construct a new entrance from the EOB
plaza into the Circuit Court. The closure
is expected to last through November 14,
2014. During that time all access between
the Circuit Court and the EOB will be
through the EOB Lobby located on the

Montgomery county, South Tower
Opened: The South Tower, formally
known as the Annex, officially opened
April 28, 2014. Effective Monday, July
14, 2014 at 8:00 PM, the South Tower
may only be accessed by entering the
Circuit Court from the Maryland Avenue
entrance or the Monroe Street entrance.
The South Tower houses the family and
juvenile divisions, including judges, masters, evaluators, case managers, self-help
center staff and clerk’s office staff.
Courtroom numbers in the North
Tower (formally known as the Judicial
Center) have been renumbered in coordination with the South Tower. However,
phone numbers will remain the same. For

have met extensively to examine the plan,

Family Division. The working groups

So how do you get started? First we
must recognize our own limitations.
Unless you are experienced in balancing
a portfolio among Large, Small and the
Midcap sectors and picking single issue
stocks you are in need of professional
help. Sadly almost anyone can declare
themselves to be an investment advisor.
Even an adviser who holds a Series 7
securities license may only be a salesperson touting the funds their brokerage
offers for sale.
A good financial planner will
research and present multiple investment
options and constantly adjust, reinvest
and rebalance your portfolio.
Sadly, it's not as simple as buying a
few different Stock Mutual funds and
waiting. An ethical and concerned financial planner will move you between different sectors in the same fund and buy
"B" shares to reduce your costs and preserve your corpus even at the expense of
foregoing greater commissions. Such a
financial planner is in it for the long term
being more concerned about positive
feedback and referrals. You need to watch
out for investment counselors who

"churn" single issue stocks or funds earning multiple and quick commissions.
You should take the time to read as
much as you can and always question
investment recommendations and strategies at regular meetings to review your
portfolios performance. Ready to invest
in your future? If not now, then when?

Judges rotation Effective July 7,
2014: On July 7, 2014, the Circuit Court
Judges began a new 18 month rotation
ending January 1, 2016. Starting 90 days
ago, all Civil and Criminal cases that
were newly assigned to Track 4 have
been assigned to a judge in the new rotation.

Preserve Your Precious Papers at
Home!
You’ve been meaning to do something about that box in your attic—filled
with your precious family letters, books,
or photographs. Yet you’re worried that
preserving your keepsakes will take more
time and money than you presently have.
Thankfully, you can put such fears to rest
by following some simple steps to properly store your precious papers at home:
1. First, take that box out of your
attic, and any in your basement while
you’re at it. Choose a new storage spot
somewhere central in your house that
experiences the least amount of rapid
changes and extremes in temperature and
humidly. An ideal environment is 6065°F and 30-40% RH. An unstable environment causes problems such as mold,
dried out adhesives and leather, pests,
condensation, and brittleness. Pick cool
and dry places like under your bed, in a
dresser drawer, or in your closet.
2. Keep your items away from direct
sunlight and florescent light, which can
cause irreversible fading and deterioration. Use blinds and low wattage bulbs
around your papers.
3. Next, select a proper storage box.
Archives and museums use acid-free and
lignin-free boxes or inert polyester
sleeves to prevent brittleness and protect
items from pests, dust, and chemical offgassing. Purchase archival-grade enclosures from suppliers like gaylord.com or
hollingermetaledge.com.

options lying around your house include
older wooden boxes coated with waterbased polyurethane or older plastic containers. The rule of thumb with any container is to avoid it if it has a smell (good
or bad) or is dirty. Pack items loosely, but
securely; avoid using staples, rubber
bands, and newsprint. Store oversized
items flat.
4. Lastly, follow the campsite rule:
leave your items in the same condition
that you found them in. Avoid laminating,
rolling, and folding. Don’t place your
photos in static-cling albums. Avoid writing directly on your items (or do so in
light pencil, if you have to) and handling
them frequently. Label external containers, only touch the corners of your papers,
and make use copies for every-day reference.

get preserving! It’s easy!

that this book is about monarch butterflies, rain, science, sheep, kids, religion
and a small town in Tennessee. The members of our group in past years have read
and enjoyed three (3) of Ms. Kingsolver’s

With lawyers and staff taking time off, is summer a good time to make changes
and implement plans?
Summer can be a challenging time to implement change. Here’s what I recommend coaching clients accomplish during July and August:
1. Set and meet goals for billable hours for you and your staff.
2. Take a vacation (or two) and enjoy it. Make sure you and your staff replenish.
3. Make a strategic plan for the fall and start it the day after Labor Day so you
don’t run into the Thanksgiving/Holiday period. While implementing your plan,
make sure you and your staff keep meeting billable hour goals.
Notice that I mention billable hours mentioned twice. Billing drives the firm
and when you make it a priority, your firm stays profitable. Successful firms always
make sure that billable hours and marketing are consistently driven all months of the
year. There is no good reason not to meet billable hour goals.
Implementing change, whether a policy or staff change, should be done when it
can be most successful and it is important to choose your times wisely. Strategic
leaders know that balance is important. They make sure that they themselves and
the staff get time off and get things done. Plans might be for increased marketing
efforts, increased staff efficiency, administrative changes, a new computer program,
new employees, etc.
So if you want balance this summer make sure you and your staff work hard,
keep your billing up, and get strategic plans ready to be implemented the day after
Labor Day and not a day later.

James rogers Miller, Jr.
June 15, 1931 - July 25, 2014
Jim Miller, Jr. was born in Sandy
Spring, Montgomery County, Maryland
on June 15, 1931. Following his years at
Landon School, he attended Wesleyan
University, graduating with a Bachelor of
Arts in 1953 and then on to Georgetown
University Law Center where he
achieved his LL.B. in 1955.
In that year Jim joined his father and
stepmother in a general, civil practice in
Rockville, at 200B Monroe Street.
During his years of private practice, he
was committed to a variety of endeavors
of public service, ranging from the presidency of the Rockville Chamber of
Commerce, service on the Governor’s
Commission on Reorganization of the
Government of the State of Maryland,
Maryland House of Delegates from 1963
to 1967 and President of the Bar
Association of Montgomery County in
1969-70.
On September 28, 1970, President
Richard M. Nixon nominated Jim to the
United States District Court for the
District of Maryland, where he served
until December 1986 when, as a result of
some questions of health, he took early
retirement from the Bench. The Judge
spent time restoring his health and energies, sailing and enjoying his family at his
home on Maryland’s Eastern Shore.
In August of 1991, Judge Miller
returned to Miller, Miller & Canby and
serving in an “of counsel” capacity took
up the role as counselor to the firm, while
actively building a much renowned reputation as a mediator and arbitrator.
He continued very actively in maintaining a heavy schedule of mediations
and arbitrations, gradually slowing that
endeavor until the death of his wife, Jo
Anne, in 2006.
Not long after that loss, the Judge
once again returned to his beloved
Eastern Shore and to a new winter home
in Boca Grande, Florida and took up a life
of more extensive travel and family contacts.
Judge Miller passed away in Easton,
Maryland, on June 25, 2014. He is survived by his children James R. Miller, III,
Andrew C. Miller, Merrie H. Miller
Delauder and Katherine T. Miller

Goldberg, his loving companion Patricia
L. Chapman, and his brother Thomas C.
Miller.
A memorial service was held on
Tuesday, July 15 at the Bozman United
Methodist Church. Immediately follow-
ing the service, there was a reception at
the Miles River Yacht Club, in St.
Michaels, MD
U.S. District Court Judge Ellen
Hollander, one of the Judge's former law
clerks, delivered a eulogy at the service.

lawyers from the Federal Bar Association,

We will be continuing with the “Nuts
and Bolts” series that has received such a
positive response from the Section over the
past few years. Our first Nuts and Bolts program will be held on Wednesday, October
23rd from 5:30 – 6:30 in the upstairs conference room of the Bar Building. Stay tuned
for more details, but rest assured, the presentation will be both informative and entertaining.

Mentor-Mentee Program, experienced

their experiences and wisdom with their
mentees. Both mentors and mentees build
relationships with each other, involve
themselves in the Montgomery County
Bar Association, and network with other
mentors and mentees. With their involvement, each can learn from one another.

Knight, brings the following matters to

rule 1-322.1: Exclusion of
Personal identifier information in
court Filings. By a Rules Order filed on
May 1, 2013, the Court of Appeals adopted new Rule 1-322.1, effective July 1,
2013, to require the exclusion of certain
personal identifier information from court
filings. Subsequently, by a Rules Order
filed on July 2, 2013, the Court of
Appeals amended Rule 1-322.1 on an
emergency basis (effective July 9, 2013),
and also adopted a new companion rule,
Rule 1-322.2 (with a deferred effective
date of July 1, 2014). The amended Rule
1-322.1 differs from the original in several important ways. First the amended
Rule now applies only to “pleadings and
other papers filed in an action” – in other
words, litigation records – and not to
“administrative records, business license
records or notice records” as defined in
the Rules. Second, the amended Rule
clarifies that it does not apply to filings
by “a judge or judicial appointee.” Third,
the amended Rule no longer classifies
birthdates as personal identifier information requiring exclusion from filings.
Fourth, the amended Rule now allows
only two exceptions, for: financial
account identifiers specifying the property allegedly subject to forfeiture in forfeiture actions, and the record of an administrative agency proceeding. The companion rule, rule 1-322.2, when it takes
effect on July 1, 2014, will require filers
to include, in each covered filing, a certificate confirming their compliance
with rule 1-322.1.

any mental health problem that interferes
with the ability to function on a day to
day basis (alcohol, drugs, anxiety, depression, senility). If necessary we will handle cases for the lawyer involved until he
or she can get back on his/her feet. We
also assist with counseling and closing
one's practice.
We accept anonymous referrals and
our work is strictly confidential. We meet
on the second Wednesday of the month.
However, we can and will meet on short
notice. I can't emphasize enough that
once a matter is sent to Bar Counsel the
ship has sailed. Too many Montgomery
lawyers are sanctioned each year who
could be helped if we were contacted in
time. If you sense something is wrong
whether it be a colleague, an associate, a
lawyer on the other side of a case or
someone you observe in a case in which
you're not directly involved please contact us.

Welcome back! We are currently in
the process of finalizing our fall schedule
and will be sending out e-mails through
the listserve regarding our fall meetings
and CLE events.
Recently, the IRS announced
sweeping changes to its offshore voluntary disclosure program. The changes
include a significantly expanded
streamlined
program,
potentially
increased penalties for taxpayers seeking to apply to the offshore voluntary
disclosure program on or after August 4,
2014 and transitional rules for taxpayers
who are currently participating in the
OVDP program but who have yet to
receive a fully executed closing agreement (Form 906) from the Service.
Each of these changes is discussed in
finer detail below.
Expanded Streamlined Program. For
qualifying taxpayers, the revised streamlined program is a tremendous opportunity to get into compliance without facing
exceedingly high taxes, penalties and
professional fees. Some of the key features include:
• As revised, the streamlined program is now available to domestic taxpayers as well as taxpayers residing overseas (previously, the streamlined program
was available only to those taxpayers
residing overseas).
• The requirement that the taxpayer have a tax liability of $1,500 or less has
been eliminated. Thus, the program is
available to all taxpayers, even if they
have a significant amount of unreported
income, provided that the taxpayer’s failure to file foreign information reports

(FBARs, Form 5471, Form 8938, etc.)
and report foreign source income was not
willful.
• Taxpayers must certify, under
the penalties of perjury, that their noncompliance was not willful. The IRS has
indicated that all certifications will be
thoroughly reviewed.
• Taxpayers must file three years’
worth of tax returns (or amended tax
returns, as the case may be), reporting all
income and six years’ worth of FBARs.
• Taxpayers must pay their
income tax liability in full (plus interest)
and a penalty of five percent (5%) of the
highest year-end balance of all foreign
accounts over the six year period covered
by the FBARs.
Revised OVDP. The OVDP remains
an option for taxpayers who do not qualify for the streamlined program. Some of
the key changes to the program include:
• The offshore penalty (27.5%
previously) increases to 50% in cases
where either (i) the financial institution
where the account was held or; (ii) a
“facilitator” who helped establish the
account has been publicly identified as
being under investigation or as cooperating with a government investigation.
• The offshore penalty is now due
at the time the OVDP is submitted.
• The reduced penalty structure
for taxpayers with inherited and dormant
accounts has been eliminated (those taxpayers are encouraged to consider the
streamlined program).
• Taxpayers must now submit
accountant statements for all accounts,
regardless of account balance. Previously,
copies of account statements were only
required when the asset values reached
$500,000 or more.
Transition Relief. Taxpayers who
entered the OVDP prior to the announcement of the revised procedures discussed
above may be eligible to have their disclosure examined under the guidelines of
the expanded streamlined program and, if
they qualify, the offshore penalty will be

reduced to 5% from 27.5%. The important transition rules include:
• To be considered, a taxpayer
must have submitted a voluntary disclosure letter prior to July 1, 2014.
Importantly, submission of preclearance
documentation to IRS Criminal
Investigations does not count for this purpose.
• The taxpayer must be a current
participant in the OVDP. A taxpayer is a
current participant if he or she has not
received a fully executed closing agreement (Form 906) from the IRS. Thus,
even taxpayers who have signed a closing agreement and submitted all payments are eligible for consideration provided that the IRS has not countersigned
the From 906. Taxpayers who have
received a fully-executed closing agreement are not eligible for the transition
relief.
• The taxpayer must submit a certification of non-willful conduct, similar
to that discussed above. The IRS will
review each certification in detail.
• If the IRS agrees that the taxpay-

er’s conduct qualifies as non-willful, the
lower 5% penalty will apply. If the IRS
does not agree, the taxpayer remains eligible to participate in the OVDP under
the original terms (i.e. there is no threat of
removal).
• The taxpayer must abide by all
other terms of the OVDP, including filing
amended tax returns required under the
program and pay all tax, penalties and
interest due thereon. The taxpayer must
also execute a closing agreement at the
conclusion of the matter.

The Montgomery County Bar
Foundation Pro Bono Program seeks volunteers – whether experienced or newly barred
attorneys – to join our panel. There are many
county residents that are in great need of pro
bono services. Your call to volunteer will
make a difference to those without resources.
The Pro Bono Program provides two
ways for county residents to receive FrEE
lEGAl SErVicES in civil cases – at a
legal advice clinic or through the client
intake line for referral to an attorney volunteer for direct representation. The legal
advice clinics operate in four locations
across the county (SEE BOX ON PAGE
25) and provide residents the opportunity
to walk-in and meet with an attorney volunteer without scheduling an appointment.
Eligible clients present their legal problems
to an attorney and receive free immediate
legal advice and/or referral to a non-profit
or government social service agency that
may be helpful. The client intake line operates out of the main office where the staff

screens calls from potential clients. The Pro
Bono Program staff conducts all screenings
over the phone only. Cases referred to
attorney volunteers include family law,
debt collection, bankruptcy, limited
employment, limited immigration, wills
and power of attorney.
The Pro Bono Program currently is
participating in three projects. First, we
participate in the Judicare Project.
Contested custody and complex family law
cases are referred at a reduced fee to experienced family law attorneys. Attorneys can
seek reimbursement of $80 per hour with a
cap of 20 hours per case. The Pro Bono
Program requires that the attorney must
accept a pro bono case for each case
accepted under the Judicare Project.
Second, we have a working agreement
with the collaboration Project of
Maryland for family law case referrals
that include modifications. Third, we refer

family law attorney. The mentoring group
meetings are your opportunity to ask questions about your case and learn from the

On July 2, 2014, the J. Franklyn
Bourne Bar Association lost one of its
most dynamic leaders with the passing
of Past President Wayne K. Curry.
Wayne died from lung cancer at his
home in Upper Marlboro, Maryland. As
the first African American to serve as
County Executive in the history of
Prince George’s County, Maryland
(1994 – 2002), Wayne was prominently
known as a champion for economic
growth and development in the county.
Wayne was also recognized as a great a
friend, colleague, mentor, and person; as
echoed in the reflections of his colleagues from around our state. Wayne is
survived by his wife, Sheila Mills Curry,
and a host of family and friends. Please
keep them and Wayne in your thoughts
and prayers.

I am taking a moment to look back at all
the interesting and exciting events that we
had this past year through the
Montgomery County Women’s Bar
Association. The Leaders and Legends
gala was just one example of friends and
colleagues getting together on a special
evening to remember old times and create
new memories. Before the summer gets
away from you, take a break from the
daily grind and remember to reach out to
someone who you have not seen in a
while.
On that note, I want to thank our
outgoing Board members this past year:
