I N EXERCISE of the powers vested in him by Article 3 of the Emergency Powers
(Colonial Defence) Order in Council, 1939, and the Emergency Powers (Defence)
Act, 1939, the High Commissioner has made the following Defence Regulations :—
1. These Regulations may be cited as the Defence (Amendment)
Regulations (No. 2), 1942, and shall be read as one with the Defence
Regulations, 1939, hereinafter referred to as the principal Regulations.
2. Regulation 5 1 of the principal• Regulations is hereby revoked
and the following Regulation substituted therefor :—
"Kequisitioning
of property
other than land.
5 1 . — ( 1 ) Subject as hereinafter provided, the
High Commissioner, if it appears to him to be necessary or expedient so to do in the interests of
public safety, defence or the efficient prosecution
of the war, or for maintaining supplies and services
essential to the life of the community, may requisition —
(a) any chattel in Palestine (including any
vessel or aircraft and anything on board a
vessel or aircraft), and
(6) any ship or aircraft registered in Palestine
or anything on board such ship or aircraft,
w herever the ship or aircraft may be;

and may give such directions as appear to him to
be necessary or expedient in connection with the
requisition :
Provided that: this Regulation shall not author
ise the requisitioning of anything on board a Unit
ed Kingdom or Dominion ship or aircraft.

(2) Where the H igh Commissioner requisitions
any property under this Regulation or any pro
perty (other than land) is in the possession or at
the disposal of the H igh Commissioner by reason
of the exercise of any power exercisable by virtue
of section 49 of the Post Office Ordinance, the
High Commissioner may use or deal with, or au
thorise the use of or dealing with, the property
for such purpose and in such manner as he thinks
expedient in the interests of the public safety, de
fence or the efficient prosecution of the war, or for
maintaining supplies and services essential to the
life of the community, and may hold, or sell or
otherwise dispose of, the property as if he were the
owner thereof and as if the property were free
from any mortgage, pledge, lien or other similar
obligation, and, in a case where the property re
quisitioned is a vessel, vehicle, aircraft, excavator,
crane, agricultural implement or agricultural ma
chinery, may acquire it by serving on the owner
of the vessel, vehicle, aircraft, excavator, crane,
agricultural implement or agricultural machinery a
notice stating that he has acquired it in pursuance
of this Regulation
W h e r e a notice of acquisition is served under
this paragraph on the owner of any vessel, vehicle,
aircraft, excavator, crane, agricultural implement
or agricultural machinery, then, at the beginning
of the day on which the notice is served, —
(a) the vessel, vehicle, aircraft, excavator,
crane, agricultural implement or agricul
tural machinery shall vest in the H igh Com
missioner free from any mortgage, pledge;
lien or other similar obligation, and
(b)
the period of the requisition thereof shall
end.
(3) The High Commissioner, if it appears to him
to be necessary for the effectual exercise of his
powers under paragraph (1) of this Regulation so

to do, may, by order made as respects the whole
of Palestine or any part thereof —
(a) direct that no person who, at the time
when the order takes effect, has in his possession or under his control, at any premises
in the area to which the order relates, any
such articles as may be described in the order, shall remove the articles, or cause or
permit them to be removed, from the premises until the removal of the articles therefrom is permitted by such authority or person as may be specified in the order;
(6) require the owner or occupier of any premises in the said area to send to such authority or person as may be specified in the order
a written declaration stating or estimating
whether or not, on such date as may be specified in the order, any such articles as
aforesaid were or will be on the premises,
and, if so, the number or quantity of those
articles which was or will be on the premises on that date, according as the order
may direct.
(4) The High Commissioner may, to such extent and subject to such restrictions as he thinks
proper, delegate all or any of his functions under
paragraphs (1) and (2) of this !Regulation to an}'
specified person or class of persons.
(5) The powers conferred by the preceding provisions of this Regulation shall not be exercisable
in relation to any of the following things, that is
to say, currency, gold, securities or negotiable instruments.
(6) Any reference in this Regulation to articles
shall be construed as including a reference to substances, vehicles, vessels or animals."

1. These Regulations may be cited as the Defence (Compensation for Acquisition) Regulations, 1942, and shall come into force
on the date of publication in the
Gazette.
2, Where before the date of the coming into force of these Regulations any motor vehicle has been requisitioned by virtue of the
Order by the High Commissioner No. 107 of 1939, made under Regulation 51 of the Defence Regulations, 1939, and subsequent to
the date of such requisitioning a notice by the Controller of Road
Transport has appeared in any newspaper published in Palestine
containing an intimation that such vehicle had been purchased by
requisitioning by the Palestine Government, then, notwithstanding'
anything contained in the Compensation (Defence) Ordinance,
1940, or in any other Ordinance or law —
(a) any such vehicle shall be deemed to have been lawfully purchased and acquired from the owner thereof by the Palestine
Government on the date on which such vehicle was requisitioned as aforesaid; and
(b)
in any case where any sum has been paid or agreed to be
paid by or on behalf of the Palestine Government as compensation for the requisitioning for purchase of any such vehicle
as aforesaid, any sum so paid or agreed to be paid shall be
deemed to have been and to be the amount of compensation
payable in respect of such requisition for purchase and acquisition as aforesaid of such vehicle, and in any such case
no claim whatsoever relating to the compensation or amount
or method of assessment of the compensation paid or agreed
to be paid as aforesaid shall, from and after the date of the
coming into force of these Regulations, be brought or entertained before any Court or Tribunal in Palestine :
Provided that nothing in this paragraph shall, subject to
the provisions of the Crown Actions Ordinance, preclude any
person entitled thereto from claiming the amount of any compensation agreed to be paid as aforesaid if not paid before
the date of the coming into force of these Regulations.

ORDER BY A COMPETENT AUTHORITY UNDER REGULATION 4 6 .
I N EXERCISE of the powers vested in me by regulation 46 of the Defence Regulations, 1 9 3 9 , I, CHRISTOPHER W I L S O N B R O W N , Director of Public Works, being a
Competent Authority for the purpose of the said regulation do hereby order as
follows :—
1. This Order may be cited as the Defence (Control of Pipes for Irrigation)
Order, 1942.

I n this Order :
"Director" means the Director of Public Works and includes any Assistant
Director of Public Works who is a Competent Authority for the purpose of
regulation 46 of the Defence Regulations, 1939.

"Agricultural holding" means any parcel of land which has at any time within
the preceding three years been used, or which is being used or which is intended to be used, either wholly or partially for the growing of agricultural,
horticultural or arboricultural produce.
"Agricultural water pipe" means any iron or steel pipe used or intended to be
used for the purpose of conveying water to or distributing water upon any
agricultural, horticultural or arboricultural land.
3. No person shall uplift or otherwise remove any agricultural water pipe except
under the authority of a written permit signed by the Director of Agriculture and
Fisheries.
4. No person shall transport across the boundaries of any agricultural holding
any agricultural water pipe which is at the date of this Order in such holding except
under the authority of a permit in writing signed by the Director of Agriculture and
Fisheries.
5. Any person who, under the provisions of paragraphs 3 and 4 hereof, may lawfully uplift and remove any agricultural water pipe or who may lawfully transport
any agricultural water pipe across the boundary of any agricultural holding shall not
sell such pipe except under the authority of a permit in writing signed by the
Director of Agriculture and Fisheries.
6. Any person who under the provisions of paragraph 5 hereof may lawfully sell
any agricultural water pipe shall not sell such pipe at a price exceeding that set forth
in the Schedule to this Order.
7. Any person authorised in writing in that behalf by the Director or by the D i rector of Agriculture and Fisheries may enter and inspect airy agricultural holding
and examine the agricultural water pipe found thereon and any books, plans or
other documents relating to such agricultural holding or such agricultural water pipe
with a view to securing compliance with the provisions of this Order.

I N EXERCISE of the powers vested in me by regulation 48 of the Defence Regulations, 1939, I hereby take possession of the land more properly described in the
Schedule hereto and I hereby authorise the Assis Palestine Fruit Products Company,
Ramat Gan, to enter into possession of the said land on my behalf until further
order;
And I do further order that no person shall exercise any rights over the said land
which he may have been enjoying at the date of the publication of this Order whether

EXPLANATORY NOTE.

for principal immigrants and about 1,750 immigration certificates for wives and
children making a total of 3,000 certificates.

be read as one with the Trading with the Enemy (Specified Persons) (Amendment) Order (No. 5), 1941, hereinafter referred to as
