Latvia: Fact sheet for planning levels -LOCAL Planning level Local municipality Type of plan Dviete Rural Municipality Spatial Plan (2005–2017) Facts: Legal basis Spatial Planning Law (adopted 02.05.2002 as amended 10.04.2003, 27.01.2005, 29.03.2007); Cabinet Regulations no.883 “Regulations for Local Self-Government Spatial Planning” (19.10.2004); Dviete Rural Municipality (Parish) Council’s Decisions 29.01.2004 (prot. no.1, §3), 29.09.2005. (no.88), 30.11.2006 and Binding Regulations. Competences Dviete Municipality Council (DMC) leads, supervises and ensures the preparation of the spatial plan, approves it and ensures public participation. The Ministry of Regional Development and Local Government (MRDLG) supervises the development of spatial plans, evaluates the plan’s conformity with the National Spatial Plan and laws. Daugavpils District Council evaluates if the plan is in conformity with the district spatial plan. Binding force Spatial plan is adopted as binding regulations that are in force in the municipal administrative territory. Tasks and contents Dviete Municipality Spatial Plan specifies the spatial development possibilities, directions and restrictions, the present and planned (permitted) utilisation of the territory and restrictions on land use graphically 1:10,000, as well as requirements, territories and objects specified in higher level spatial plans are detailed. It defines land use and building regulations that includes requirements for land plots, their construction and utilities, village borders. It consists of an explanatory note, a graphical component with maps, land use and building regulations and a report on planning process, including documentation on public participation and coordination among institutions. Strategic impact assessment Environmental Report is added. Process, duration, participation DMC adopted the decision on the inception (29.01.2004) of the spatial plan and terms of references. It was prepared by DMC, SIA „Strasa konsultanti” and SIA „Limnoloģijas institūts”. Public participation was organised in two parts – during the inception phase (4 weeks) from 10.02.2004 and after the completion of the first draft (6 weeks) – 14.10.-25.11.2005. Listed institutions provided information, proposals and opinions. Information on relevant decisions, where and when a draft plan is available for public for a review, how proposal have to be submitted and on public participation events was published in the local newspaper “Latgales Laiks” and the official newspaper “Latvijas Vēstnesis”. MRDLG reviewed the spatial plan. DMC adopted (30.11.2006) the plan. It became valid after announcement was published in the official newspaper (05.12.2006). Duration of validity Prepared for next 12 years (2005–2017). Details of the plan Characteristics Location of the area Dviete parish/rural municipality (pagasts) is located in Daugavpils District in SE part of Latvia, 33 km from Daugavpils city and 10 km from Ilukste town. It has 716 inhabitants (01.01.2007), a half of them live in Dviete Village. The size of total area are 677.4 km2, form which 62% covered by forests, 29% – agricultural lands, 2% – mires, 2% – roads, 2% – water areas and 3% – other areas. Eastern border of the municipality forms the Daugava River Valley – valuable nature NATURA 2000 area, also threatened by frequent flooding. In accordance to the Territorial Reform the parish is planned to amalgamate in the Ilukste municipality. Initial situation This is the first spatial plan for Dviete municipality. In 2000 municipality adopted the development program. Particularities of the procedure and/or contents Implementation priorities of the spatial plan are housing quality improvements, high quality economic development, improvement and renewal of public use territories, optimal public transportation provision, restrictions to the change of the existing land use types, flexible and small-scale transformation of the vacant areas, good balancing in main nature areas between recreation and production land uses. Values of the municipal territory are watercourses and lakes, for these specific restrictions are defined, in order to exclude landscape degradation. It is defined that surroundings of lakes should be used primary for public purposes and for tourism and leisure object development. Industrial object should be located in former Soviet period production sites (farms and workshops) by reconstructing and enlarging these areas.
