The National Beer Wholesalers Association is proud to represent America’s more than 3,000 independent beer distributors. More than 100 members of Congress visited warehouses and learned about the value of the American system of distribution. More than 700 people, including distributors representing all 50 states and industry partners, participated in the 2016 NBWA Legislative Conference in Washington, D.C. Some 1,000 people attended NBWA’s fourth annual Cheers: A Celebration of Beer & Food event, including numerous members of Congress and hundreds of staff. The NBWA PAC once again was one of the strongest in the country. The Next Generation Group increased programs, networking and engagement and experienced record attendance at the Third Annual Success in Leadership Conference. NBWA’s 78th Annual Convention and Trade Show in Las Vegas, Nevada, featured a record number of exhibitors. New member resources, including distributor-specific safety videos and educational webinars, were made available to distributors to help strengthen day-to-day business operations. NBWA led the industry with original research and data that explain the value of independent distributors. Distributors learned more about the Center for Alcohol Policy and its educational initiatives. Purser NBWA President & CEO Travis Markstein NBWA 2015-2016 Chairman of the Board WWW.NBWA.ORG 1 Advocating for Independent Distributors Anheuser-Busch InBev and SABMiller Merger A s the landscape of the beer industry continues to change at a rapid pace, NBWA constantly monitors activities at the federal level and in the states to ensure that America’s successful system of open and independent beer distribution is maintained. After Anheuser-Busch InBev announced its plan to acquire SABMiller, Congress, the U.S. Department of Justice (DOJ) and the states began to examine the potential impact of this proposed merger on a competitive marketplace, consumers and the beer industry. Throughout the review process, NBWA has provided input to help ensure that the U.S. marketplace isn’t negatively impacted by this increase in global market power and that America’s vibrant beer market and successful distribution system can continue to thrive. As a respected leader in the beer industry, NBWA President & CEO Craig Purser was invited to testify at a hearing of the Senate Judiciary Subcommittee on Antitrust, Compe- 2 NBWA 2015-2016 Report tition Policy, and Consumer Rights on December 8, 2015, titled “Ensuring Competition Remains on Tap: The AB InBev/ SABMiller Merger and the State of Competition in the Beer Industry.” Nine senators attended the subcommittee hearing and asked questions covering a wide range of topics such as marketplace power; independent distribution; brewery ownership of distributors; craft growth; and consumer choice. Following the hearing, U.S. Senators Mike Lee (UT) and Amy Klobuchar (MN), the chairman and ranking member of the Senate Antitrust Subcommittee, sent a letter to the DOJ asking it to carefully consider the proposed acquisition. The bipartisan letter reiterated the importance of and need for maintaining an open and independent beer distribution system, closely mirroring NBWA’s hearing testimony, and demonstrated that policymakers understand the role that independent distributors play in promoting competition and providing access to market for smaller brewers and importers. Retailer Initiatives and Trade Practice Concerns In November 2015, NBWA sent a letter to Alcohol and Tobacco Tax and Trade Bureau (TTB) Administrator John Manfreda asking the agency to clarify rules and issue guidance regarding trade practices to ensure that beer distributors are operating in compliance with federal law. NBWA also met in person with TTB’s leadership to express these concerns. The request came after one of the nation’s largest retailers announced a new category management and service initiative that raised several potential state and federal “tied house” law violations based on items of value or prohibited services. In response, the TTB issued guidance in January 2016 citing the limitations of the Federal Alcohol Administration Act’s narrow, specific exceptions related to items of value. The TTB’s directive serves as a reminder to all industry participants and makes clear that certain aspects of proposed programs at retail exceed the intent of the exceptions allowed for by federal law. U.S. Dietary Guidelines In January 2016, the U.S. Department of Health and Human Services (HHS) and the U.S. Department of Agriculture (USDA) released the 2015-2020 Dietary Guidelines for Americans. For the first time, the guidelines include significant language recognizing that all drinks are not equal, noting that, “Packaged (e.g., canned beer, bottled wine) and mixed beverages (e.g., margarita, rum and soda, mimosa, sangria) vary in alcohol content. For this reason it is important to determine how many alcoholic drink-equivalents are in the beverage and limit intake.” In a joint letter, NBWA, the Beer Institute, the Brewers Association and the Wine Institute asked specifically for the Dietary Guidelines to offer consumers more complete and accurate information about alcohol consumption than the 2010 Dietary Guidelines for Americans, which included a misleading definition of a standard drink, generating confusion for consumers. The 2010 Dietary Guidelines defined “one drink” as containing 0.6 fluid ounces of alcohol; however, beer, wine and liquor differ greatly in alcohol-by-volume (ABV) content. Transportation Legislation Recognizing that beer distributors rely on their fleets to do business, NBWA advocated that Congress pass legislation that invests in infrastructure across the country and supports projects that help strengthen local economies from coast to coast. NBWA supported the Fixing America’s Surface Transportation (FAST) Act because it invests in infrastructure and generates projects that help strengthen local economies. In the final weeks of 2015, the bill was signed into law. The $300 billion transportation bill reauthorizes and reforms federal highway, transit and highway safety programs for five years. The legislation includes provisions for military veterans to have a quicker path to obtaining a CDL if they have relevant experience in the military, and it calls for research to study roadside detection for marijuana impairment. The legislation also includes a 2,000-pound weight allowance for natural gas trucks to cover the difference in weight between a natural gas fuel tank and that of a diesel truck. Natural gas trucks can now weigh up to 82,000 pounds. Compromise Legislation on Federal Excise Taxes In 2015, the Craft Beverage Modernization and Tax Reform Act was introduced in the Senate by Sen. Ron Wyden (OR), and companion legislation was introduced in the House by Rep. Erik Paulsen (MN) and Rep. Ron Kind (WI). Although the legislation would not provide tax relief for NBWA’s distributor members, NBWA believes it is a step in the right direction because it reflects current industry structure; applies to all alcohol manufacturers and importers; and recognizes distinctions among beer, wine and liquor. Sen. Wyden led the effort to unify the beer industry, which was split between the BREW Act and the Fair BEER Act, after NBWA expressed concerns that the BREW Act could change industry structure by creating preferential tax treatment for a few brewers. WWW.NBWA.ORG 3 2016 Legislative Conference M ore than 700 independent beer distributors and industry partners gathered in Washington, D.C., for the NBWA Legislative Conference, held April 10-13, 2016. Distributors representing all 50 states conducted more than 400 meetings on Capitol Hill to educate members of Congress about how competition in the U.S. beer market thrives because of open and independent distribution. Beer distributors also asked members of Congress to fund the TTB to ensure it can regulate the alcohol industry and collect federal excise taxes in an effective manner, especially in light of an increasing number of industry participants and products. Distributors encouraged their representatives to pursue tax reform that ensures individual and corporate tax rates are reduced in similar manners; treats S corporations fairly; avoids the repeal of LIFO inventory accounting; leaves in place appropriate capital cost recovery rules to support and Constellation Brands Beer Division Chairman Bill Hackett emphasized the importance and independence of the three-tier system and distributors, which is “paramount to the consumer.” Sen. Beer distributors also asked members of Congress to co-sponsor the Sober Truth on Preventing (STOP) Underage Drinking Reauthorization Act, which is necessary to coordinate federal and state efforts in the fight against underage drinking. The legislation also reaffirms the effective statebased regulation of alcohol. Additional issues discussed by beer distributors included legislative and regulatory options to ensure working men and women are not adversely affected by the Department of Labor’s proposed overtime rule; the Marketplace Fairness Act and policies that would give states the tools they need to level the playing field between brick and mortar businesses and online retailers; tax credits for natural gas vehicles; multi-employer pension plan reform and withdrawal liability relief for small businesses. TTB Administrator John Manfreda highlighted the bureau’s role in enforcing trade regulations and maintaining the regulatory structure that supports the three-tier system. NBWA Legislative Conference attendees, members of Congress, congressional staff, journalists and other D.C. influencers got a taste of the wide variety of beer that independent beer distributors deliver. The event featured a broad selection of beer brands and styles – from pale ales to porters and lagers to lambics – paired with a special food menu designed to bring out each beer’s unique flavors. 6 NBWA 2015-2016 Report WWW.NBWA.ORG 7 Building Relationships and Strengthening Grassroots T Rep. Charles Boustany (LA) at Southwest Beverage Co., Inc. o build on the success of face-to-face meetings with members of Congress on Capitol Hill, NBWA encourages beer distributors to invite their representatives and other elected leaders for warehouse tours back home. Beer distributors hosted more than 100 warehouse tours in 2015, and NBWA is encouraging distributors to host even more in 2016. To help distributors host successful warehouse tours, NBWA provides assistance scheduling the visits, talking points and a “six pack” of warehouse visit tips. NBWA Advocacy App Rep. Derek Kilmer (WA) at Marine View Beverage To provide distributors with a new and improved way to access advocacy resources on the go, NBWA launched an upgraded version of the NBWA Advocacy App. Rep. In 2015, the NBWA PAC raised $2.16 million from 1,000+ contributors. The NBWA Political Action Committee (PAC) plays an active role in supporting candidates who understand beer distributor issues and the importance of state-based alcohol regulation. The NBWA PAC is the largest PAC in the alcohol industry and one of the top business trade association PACs in the nation. WWW.NBWA.ORG 9 Preparing Next Generation Leaders Third Annual Next Generation Success in Leadership Conference T “Not only have I learned a tremendous amount in how to run a business and prepare for the future, but I have also established strong personal relationships with young beer distributors from across the country, representing all brands, operating businesses large and small and serving all types of communities – urban and rural. – 2015 Next Generation Group Chairman Adam Vitale he NBWA Next Generation Group brings together future leaders in the beer distribution industry and helps members learn more about the business, get more involved with NBWA and network with other distributors from all areas of the country representing all brands. In addition to special networking and educational events held in conjunction with NBWA’s Annual Convention and Legislative Conference, the Next Generation Success in Leadership Conference was launched to help educate and train the beer distribution industry’s emerging leaders. Nearly 125 next generation beer distributors attended NBWA’s Third Annual Next Generation Success in Leadership Conference held August 3-4, 2015, in Denver, Colorado. The conference offered educational sessions on attention management and overcoming distractions in a digital age; conflict management; continuity planning in family-owned businesses; leadership skills; creating a 10-year plan; risk management; talent retention strategies; as well as understanding the insurance needed to protect a distributorship. It also featured two operational sessions on warehouse management, covering topics such as extending the effective life and performance of existing facilities and assets; tips for hourly employee retention and recruiting through pay-for-performance systems; and how to effectively reduce sales and delivery costs. The conference also featured presentations led by NBWA senior staff on advocacy and communications programs. Next generation leaders attended a private lunch with Rep. Eric Swalwell (CA), who founded a bipartisan group of 30 freshman members of Congress committed to finding common ground to create jobs and cut the deficit. Rep. Swalwell spoke about issues facing Congress and shared his experiences as the chairman of the Future Forum, a group that focuses on issues impacting millennials. NBWA also hosted a networking event for next gen attendees at a baseball game at Nationals Park. Nearly 4,000 members of the beer industry enjoyed the opportunity to network, hear from high-profile speakers, attend some of the 23 different education seminars and visit nearly 300 companies on the Trade Show floor. NBWA Convention Chairwoman Linda Lawrence Dalton President of Gretz Beer Company Mike Gretz led a discussion of leaders from five brewers and importers that partner with independent beer distributors across the country. Participants included João Castro Neves, zone president North America for Anheuser-Busch InBev; Gavin Hattersley, CEO of MillerCoors LLC; Bill Hackett, president of Constellation Brands Beer Division; Ken Grossman, founder of Sierra Nevada Brewing Co.; and Ronald den Elzen, president and CEO of Heineken USA. NBWA-TV NBWA-TV reporters scouted the 78 Annual Convention and Trade Show to highlight all of the action from the event and delivered newscasts featuring stories about how beer distributors are strengthening relationships with their elected leaders; working with brewers to build their brands; and making an economic impact in their communities. Bryan Wright of Giglio Distributing in Beaumont, Texas, was named the 2015 winner at NBWA’s 78th Annual Convention and Trade Show. Wright was recognized as a standout employee as well as a veteran who served with the U.S. Army during Operation Enduring Freedom. Wright’s promotion from a route salesman to a logistics management role at Giglio Distributing demonstrates how military training can serve as a solid foundation for work in the beer distribution industry. NBWA 2014-2015 Chairman of the Board Eric Best NBWA President and CEO Craig Purser highlighted how distributors can prepare for the future, especially in a dynamic industry operating in a marketplace “evolving right before our eyes.” He pointed to the successes of the open and independent distribution system, citing that, in the 1980s, there were fewer than 50 breweries operating in the United States. NBWA launched the inaugural Brewer Partner of the Year Awards in 2015 to recognize the brewers who do the best job in the marketplace producing great beer; building strong partnerships; providing valuable education; and offering support to their distributor customers in order to bring their beers to market. NBWA announced No-Li Brewhouse of Spokane, Washington, as the NBWA Brewer Partner of the Year during the general session of NBWA’s 78th Annual Convention and Trade Show. Straub Brewery of St. Marys, Pennsylvania, was recognized with the Brewer Partner Sales Execution Award. Dust Bowl Brewing Co. of Turlock, California, was presented the Brewer Partner Marketing Innovation Award. WWW.NBWA.ORG 15 Communicating the Value of Independent Distributors T hrough online communications and social media, engagement with industry stakeholders, advertising, media outreach and events, NBWA helps foster a greater understanding of the independent alcohol distribution system and good will for the beer distribution industry – which are key to advancing state and federal legislative and regulatory initiatives. NBWA explains how the current state-based regulatory system for alcohol delivers commercial, economic and regulatory value for consumers and communities. Media Events One way that NBWA develops relationships with the media is through events. Reporters love the opportunity to taste new products, and receptions and beer pairing events are a great way for NBWA to explain how independent distributors help new labels get to local stores and bar taps. NBWA partnered with CNN on the eve of the New Hampshire primary to co-host a “News and Brews” reception, where journalists and political operatives were able to meet New Hampshire brewers and beer distributors and sample a wide variety of brands and styles that beer distributors deliver to retailers and consumers. NBWA also partnered with CNN to sponsor beer for a brunch the weekend of the White House Correspondents Dinner in Washington, D.C. Ahead of Mardi Gras, NBWA hosted a beer pairing dinner for a mix of local and national reporters to showcase the vast selection of beers available to consumers and how those labels can be part of a gourmet dinner. Food Network Star finalist Jay Ducote emceed the event, which garnered coverage by Roll Call, a Capitol Hill newspaper. NBWA helped the National Press Club welcome Washington Post journalist Jason Rezaian home after spending 545 days isolated in an Iranian prison. NBWA sponsored the beer for the gathering, which showed support for Rezaian and also called attention to the challenges faced by jailed journalists across the world. 16 NBWA 2015-2016 Report New NBWA Website NBWA has continued to add new content and resources to the new mobile-friendly website launched in 2015. In 2016, the website was honored with a PR News Nonprofit PR Award and a bronze award in the Association TRENDS All Media Contest. The national publications recognized the top communication initiatives in the nonprofit and association communities. NBWA Communicators Group NBWA’s Communicators Group shares best practices with public relations and communications professionals in the beer distribution industry and helps drill down effective message points. Over the past year, NBWA provided communication resources surrounding key holidays and industry events, such as Alcohol Awareness Month and American Craft Beer Week. From press releases to social media posts and tips for hosting a beer pairing dinner, beer distribution communicators have used these resources to generate local news coverage, build relationships with the media and increase online engagement with key influencers. Employee Spotlights NBWA’s Employee Spotlight Program showcases the quality jobs that distributors provide and the exceptional employees who represent the face of the beer industry in their communities. Each week, NBWA spotlights a beer distribution employee on social media, the association’s website and The Daily Brew email. NBWA also shares this recognition with the employee’s elected representatives on Capitol Hill. The program has generated local news coverage and helped educate members of Congress about the beer distributors operating in their district and the jobs they provide. WWW.NBWA.ORG 17 Leading the Industry With Quality Data N BWA Chief Economist Lester Jones has positioned the association as a leader in beer industry data and insights by collecting and analyzing data that impacts NBWA members. This quality data is a key resource for NBWA’s federal advocacy and public affairs initiatives. It also has been shared with state beer distributor associations to help support their advocacy efforts on behalf of the beer distribution industry. Economic and statistical information supporting the three-tier system provides important strategic insights for federal and state advocacy. The data for the beer distribution industry are robust and carry a powerful message with regulatory agencies and state houses around the country. NBWA continues to collect and maintain the most up-todate and verifiable information for its members and their state associations. These data demonstrate the effectiveness and efficiencies of the three-tier system and provide factbased talking points that help deliver a sound economic message to policymakers. Economic Report NBWA released an update of America’s Beer Distributors: Fueling Jobs, Generating Economic Growth & Delivering Value to Local Communities, a comprehensive report on beer distribution companies’ total impact on national and state economies. The report provides an in-depth view of beer distributors’ economic contributions by taking into account how beer distributor activities are intertwined with many parts of the economy, especially the personal services sector. It also accounts for the amount of resources contributed by beer distributors in supporting community events and local economic development, contributing to charitable causes and promoting responsible alcohol use. Data collected in 2015 indicated that the beer distribution industry now directly employs 135,000 people in the United States, and beer distributors contribute a total of $70 billion in economic impact across the U.S. 18 NBWA 2015-2016 Report Beer Purchasers’ Index Since the launch of the NBWA Beer Purchasers’ Index in 2014, participating distributor members have received the first and only advance notice of expectations for increasing or decreasing sales. With the help of participating distributor members, this regular monthly statistical release is able to provide a timely and reliable indicator of beer purchasing activity across the industry. Distributor Surveys The Distributor Productivity Report (DPR) is the result of distributor responses to a survey on distributor business operations. This industry-wide research effort provides an actionable tool for NBWA member companies to evaluate their operating results in order to pinpoint strengths, weaknesses and improvement opportunities. The DPR also provides NBWA with quality data that can be used to educate policymakers, the media and the public about the dynamics of the beer distribution industry. Thanks to distributor participation, the report includes data on the explosive growth in the number of products that distributors carry, the number of retail accounts serviced by distributors and the investments distributors make to store, refrigerate, transport, deliver and promote a wide variety of beer brands. Distributor participation in the Compensations and Benefits Study survey also helps NBWA provide a valuable management tool for beer distributors. It allows NBWA members to compare their compensation levels and benefits policies with similar distributors. The first safety training videos released by NBWA focused on safe postures and ergonomics and distracted driving – two areas where distributors experience frequent and expensive insurance claims. Due to the overwhelming success of these safety videos, NBWA released three new videos in 2016. WWW.NBWA.ORG 19 Educating About Effective Regulation Through the Center for Alcohol Policy O riginally founded by the National Beer Wholesalers Association as an education foundation more than a decade ago, the Center for Alcohol Policy has grown to become a leading national authority on alcohol regulatory matters. In 2015, the Center for Alcohol Policy named Mike Lashbrook the executive director for the Center. Lashbrook brings to the Center more than two decades of experience in public policy. As executive director, he guides the Center’s educational activities and research efforts along with the Center’s Board of Trustees, in conjunction with counsel from an independent advisory council. NBWA has worked to heighten the industry’s awareness of the Center’s valuable role in educating policymakers, regulators and the public about alcohol, its uniqueness and its regulation by inviting representatives of the Center to address attendees at NBWA’s Annual Convention as well as NBWA’s Legislative Conference. Center for Alcohol Policy Board of Trustees Chairman Brian Clark was recognized for his years of service to the Center at NBWA’s 2016 Legislative Conference. 20 NBWA 2015-2016 Report Here are just a few of the Center’s educational and research initiatives: State Alcohol Policy Forums Because alcohol is primarily regulated by the states, the Center works to provide state policymakers and regulators with the research, education and networking they need to enact and enforce alcohol policies that balance marketplace competition with public health and safety. In addition to exhibiting at national conferences, the Center hosts educational forums in individual states to educate legislators, regulators and the public about the history and rationale for various state alcohol control policies and how they work in the market today. In recent years, the Center has conducted forums in Michigan, Pennsylvania, Oklahoma and Minnesota. Alcohol Law and Policy Conference Republication of Toward Liquor Control As the 21st Amendment was being considered in 1933, John D. Rockefeller, Jr. commissioned Raymond Fosdick and Albert Scott to study alcohol regulation and prepare America for the return of legal alcohol sales. They produced Toward Liquor Control, which guided policymakers as they set up regulatory systems for alcohol. Much of that effective framework still exists today. The Center republished this previously out of print work to help today’s citizens understand the origins of modern alcohol regulation in the United States. The Center has introduced thousands of copies into circulation to educate regulators, policymakers and the public about the importance of an effective alcohol regulatory system. Each year the Center brings together some of the best minds in the country – including state alcohol regulators, public health leaders, state attorneys general, educators and industry members – to discuss and debate current alcohol issues and challenges. The conference has become the leading national forum for alcohol policy education and networking. Attendees take advantage of this annual forum to learn about a wide range of topics, including 21st Amendment litigation, trade practice enforcement and public health aspects of alcohol regulation. Research and Studies The Center partners with policy experts and those with alcohol regulatory experience to dive deeper into alcohol policy issues confronted in the states today.
