The attached letter of May 11, 2015 clearly spells out the matter at hand;
However today May 12, 2015 I received a telephone call at my office at around 1:00pm from Mr. Larry
Shendell, of SHENDELL & ASSOCIATES, P.A. it was not the phone call that prompted this complaint
but his conduct unbecoming of a professional.
He introduced himself as "this is attorney shendell" and I replied that is odd, because I was informed that
attorney Shendell was a female by his secretary.
He replied "Yes, I had a sex change", Laughing and I then replied is this Larry? he stated yes "Larry
Shendell". I knew that Larry was the person that I had been speaking with from the beginning and
sending information to, he did not want to identify himself to me on the phone.
Since this matter is of a sensitive nature to begin with, I was taken back as to his conduct and statement
since I never thought an attorney should be practicing like this. I told Larry that I don't know how he ever
passed the bar but this is not acceptable behavior.
I now understand that his wife is the attorney of record "Tamar Duffner Shendell" and this is the person I
wanted to speak with; however she never returned my calls and never would geton the phone. This is also
why I addressed the letter of May 11, 2015 to her attention. Her Husband Larry Shendell, who I am not
sure is an attorney now was covering up for her.
This kind of practice as I stated in my letter is totally not acceptable. It appears that Shendell, letter of
May 4th 2015 which was totally false and Shendell attempting to take legal action for eviction on a
matter that was addressed constitutes as entrapment.
I was also informed by the association that Tamar Duffner Shendell, was the person who was appointed
to handle all matters pertaining to Orchid Grove association which is why I was trying to get in touch
with her after I did not receive any solution from Larry. As I own a company I also understand that we
put other people in charge of matters; however when an employee cannot fulfill a client needs and they
request myself I then will return the call or email so this is no excuse.
I am asking The Florida Bar to take the necessary disciplinary action on this matter.

Ms. Shendell,
I made several telephone calls to your office this morning in order to have a conversation with
you to no avail. I just return f r o m travels and prior to leaving Friday I received a disturbing
letter f r o m you as to allegations that are incorrect and false.
I have been in contact with your office prior to April 14 2015 and have spoken on numerous
occasions with Larry as to my HOA payments. I informed Larry and sent him copies of my
payments made to date, t have discussed in great detail as t o the process that I make my
payments monthly and gave him the association payment method website in order for him to
further look into the matter.
Larry told me he would get back to me, to my surprise I then now receive a letter dated May 4,
2015 f r o m your office that you are going to go for eviction and that I have disregarded your
previous request.
This is a false statement; it is also entrapment and harassment. I have made all payments
according to the HOA Management web site and balances that are due. Property Keepers was
hired by the Orchid Grove association to collect funding for the association, I feel that I am
being targeted, harass and being entrapped on false statements in order to gain possession of
my property.
Below is Property Keepers website that is posted on my account:
As you can see highlighted in RED "BALANCE DUE" and the amount the association
accountability claims I owe to date. This is a printout of today May 11, 2015 and a copy of an
email that I sent to Brett.

In closing, I find that now I have to take all legal actions to protect my property and interest due
to Property Keepers continue false allegation and entrapment on my property. Ms. Schendell
you and your office also has no right to send me this type of letter. I did send to your office all
the documentation without any decent reply; whereby I will also be issuing a complaint with
the Florida Bar association as to the harassment.

This firm represents Orchid Grove Association, Inc. ("Association"), the homeowners association
governing the above referenced property. Pursuant to section 720.3085(8), Florida Statutes, we demand
that you make your rent payments directly to the homeowners' association and continue doing so until the
association notifies you otherwise.
Payment due to the homeowners' association may be in the same form as you paid your landlord and must
be sent by United States mail or hand delivery to 5340 N. Federal Highway, Suite 201, Lighthouse Point,
Florida 33064, payable to Shendell & Associates, P.A.
Your obligation to pay your rent to the association begins immediately, unless you have already paid rent to
your landlord for the current period before receiving this notice. In that case, you must provide the
association written proof of your payment within 14 days after receiving this notice and your obligation to
pay rent to the association would then begin with the next rental period.
Pursuant to section 720.3085(8), Florida Statutes, your payment of rent to the association gives you
complete immunity from any claim for the rent by your landlord.

As you are aware from my previous correspondence to you, this firm represents Orchid Grove
Association, Inc. ("Association"). In my previous letter to you, I demanded that you forward future
rent payments to the Association c/o Shendell & Associates, P.A. pursuant to Florida Statutes, Section
720.3085(8) which authorizes the Association to collect the rent from you in the event that the unit
owner becomes delinquent in payment of any monetary obligation to the Association. Unfortunately,
you have failed to pay the rent payments to the Association.
This shall serve as a final demand that you forward your rent payments to Association within five (5)
days of the date of this letter. Please make your payments payable to the Shendell & Associates, P.A.
Trust Account and deliver them to the undersigned at the address noted on the letterhead. Please be
advised that should you fail to pay the rent as directed herein, the Association will proceed with further
legal action for eviction.
There will be no further warnings or requests. Should you have any questions, please contact the

and conclude that the decision to close the file was appropriate. Please be advised that The
Florida Bar is without jurisdiction to determine whether the lien filed against the subject property
is valid. Furthermore, Mr. Shendell is not the attorney who filed the lien, so any inquiry
concerning the lien is not appropriately maintained against him.
I have reviewed the information you provided concerning your exchange with Mr. Shendell and
determined there is insufficient evidence that Mr. Shendell has violated the Rules Regulating
The Florida Bar warranting the imposition of discipline. If you would like to pursue a

The attached letter of May 11, 2015 clearly spells out the matter at hand;
However today May 12, 2015 I received a telephone call at my office at around 1:00pm from Mr. Larry
Shendell, of SHENDELL & ASSOCIATES, P.A. it was not the phone call that prompted this complaint
but his conduct unbecoming of a professional.
He introduced himself as "this is attorney shendell" and I replied that is odd, because I was informed that
attorney Shendell was a female by his secretary.
He replied "Yes, I had a sex change", Laughing and I then replied is this Larry? he stated yes "Larry
Shendell". I knew that Larry was the person that I had been speaking with from the beginning and
sending information to, he did not want to identify himself to me on the phone.
Since this matter is of a sensitive nature to begin with, I was taken back as to his conduct and statement
since I never thought an attorney should be practicing like this. I told Larry that I don't know how he ever
passed the bar but this is not acceptable behavior.
I now understand that his wife is the attorney of record "Tamar Duffher Shendell" and this is the person I
wanted to speak with; however she never returned my calls and never would geton the phone. This is also
why I addressed the letter of May 11, 2015 to her attention. Her Husband Larry Shendell, who I am not
sure is an attorney now was covering up for her.
This kind of practice as I stated in my letter is totally not acceptable. It appears that Shendell, letter of
May 4th 2015 which was totally false and Shendell attempting to take legal action for eviction on a
matter that was addressed constitutes as entrapment.
I was also informed by the association that Tamar Duffner Shendell, was the person who was appointed
to handle all matters pertaining to Orchid Grove association which is why I was trying to get in touch
with her after I did not receive any solution from Larry. As I own a company I also understand that we
put other people in charge of matters; however when an employee cannot fulfill a client needs and they
request myself I then will return the call or email so this is no excuse.
I am asking The Florida Bar to take the necessary disciplinary action on this matter.

I made several telephone calls t o your office this morning in order t o have a conversation with
you to no avail. I just return f r o m travels and prior t o leaving Friday I received a disturbing
letter f r o m you as t o allegations that are incorrect and false.
I have been in contact with your office prior t o April 14 2015 and have spoken on numerous
occasions w i t h Larry as t o my HOA payments. I informed Larry and sent him copies of my
payments made t o date. I have discussed in great detail as t o the process that f make my
payments monthly and gave him the association payment method website in order f o r him t o
further look into the matter.
Larry told me he would get back to me, t o my surprise I then now receive a letter dated May 4,
2015 f r o m your office that you are going t o go f o r eviction and that I have disregarded your
previous request.
This is a false statement; it is also entrapment and harassment. I have made all payments
according t o the HOA Management web site and balances that are due. Property Keepers was
hired by the Orchid Grove association to collect funding f o r the association, I feel that I am
being targeted, harass and being entrapped on false statements in order t o gain possession of
my property.

While I understand that you believe the attorney’s opinion is incorrect, I must conclude that your
complaint constitutes a civil dispute which is best resolved through the civil system. The
Supreme Court of Florida has ruled that the disciplinary process and proceedings are not to be
used as a substitute for civil proceedings and remedies.
After careful consideration, I conclude that the matters referenced in your inquiry do not
constitute violations of the Rules of Professional Conduct, and accordingly, your inquiry does
